DND eyes Russian sniper rifles MANILA, Dec. 14 (PNA) – While the People’s Republic of China has expressed its willingness to provide the country’s military units with firearms with generous payment terms, Department of National Defense (DND) Secretary Delfin Lorenzana said they will still look at sniper rifles being offered by Russia. This is based on the orders by President Rodrigo Duterte, he said. “The President told us to look into the sniper rifles being produced by Russia as these are good. Although we are still to see anything yet, they (Russians) will show
us some models for testing to (determine whether these are suitable for our needs),” Lorenzana said in Filipino. Earlier, DND undersecretary for finance, munition, materiel Raymund DV Elefante said the country is open to acquire weapons of all kinds from Russia but said these are dependent on the nation’s capabilities to handle these equipment. Duterte: I join police ops in Davao to kill criminals MANILA, Dec 14 (Mabuhay) – When he was still mayor of Davao City, President Rodrigo Duterte led by example to the police and joined them in operations to “personally” kill criminals. In a speech delivered late Monday night in Malacañang during the Wallace Business Forum, Duterte denied that the extrajudicial killings of drug suspects were state-sponsored. “We do not, you know, we do not wrap people with plastic tape. We are not producing mummies in the Philippines for export. Those are indications of torture,” he said. “Why will I torture when we are going
to arrest you because you are committing a crime? There’s no need for us to torture or rather you just shoot him and fire a bullet in the head. Why go into this charade of wrapping people? You don’t indicate that there are tortures and forcing people to say something,” he added. Then, he added that only a third of the reported drug-related killings, which soared to around 2,000 since he became President on June 30, were a result of police operations. “But in Davao I used to do it personally. MANILA, Dec. 13 (PNA) -- China- Philippine relations will be considered “explosive” starting mid 2017 as both nations work on strengthening their friendship and cooperation, Chinese Ambassador to Manila Zhao Jianhua on Monday night said. Jianhua, during a Christmas party he hosted for Philippine media at the Shangri-la Hotel in Makati City, said as a result of President Rodrigo Duterte’s visit to China, the Philippines will export more fruits to China and more Chinese tourists will visit the Philippines in 2017. He also said China will sponsor a high level forum in May and a summit in September of 2017, and President Duterte is expected to attend. “Five major emerging power get together in September next year in Xiamen . I think your President [Rodrigo R. Duterte] will be invited to attend the meeting because the Philippines will assume the rotating chairmanship of ASEAN [Association of Southeast Asian Nations],” the ambassador told the attendees. He said they have foreseen that “the Philippines will be becoming a more important country in the future.” Jianhua assured that Chinese President Xi Jinping will attend the ASEAN meeting in November and there is a great possibility that they will sign a bilateral agreement. Eviction threatens future of seniors, Pinoy caregivers in Westwood By Abner Galino
As eviction looms over the heads of 150 disabled residents of a seniors’ apartment in Westwood, the jobs of their caregivers – mostly Filipinos – also hang in limbo. Up in arms against their landlord are the residents of the Vintage Westwood Apartments at 947 Tiverton Avenue. The distressed seniors received eviction notices recently from Watermark Retirement Communities. The notices said residents should vacate their units by April 27, 2017. The owners reportedly plan to upgrade the 12-storey building into a more luxurious residential facility for elders. Watermark said eviction was necessary because they need to cut off the utilities inside the building during construction. Los Angeles City Councilman Paul Koretz has taken up the cudgels for the embattled seniors. He said the eviction would destroy the community that the seniors in the building have built through the years. “Their units are much more affordable than Watermark’s future elder care facility, and they have no place
to go in the meantime,” Koretz told the media during a press conference in front of the building on Thursday. “The law may allow Watermark to do this but it’s still the wrong thing to do and I can’t support it.” In a related development, caregivers working with seniors in the said building also expressed concern over the impending evictions of their clients. The caregivers who are mostly employed by two caregiving agencies accredited by Watermark told US Asian Post/Weekend Balita that many of them fear losing their jobs once the seniors start moving out. “Tiyak maraming mawawalan ng trabaho (A lot caregivers will lose their jobs for sure). Yung iba dito 20 hanggang 10 taon na nagta-trabaho dito. (Some caregivers have been working here for 20 to 10 years),” said one caregiver who requested anonymity. Some seniors may move too far away from Los Angeles or they may move to other senior apartments that would not allow them to bring in their own caregivers, according to

S. 1555 passed the US Congress unanimously after the House of Representatives approved it on 30 November 2016.

Asian Americans defending Affirmative Action file papers to join Harvard lawsuit Prospective Asian American and Pacific Islander Students Represented by Asian Americans Advancing Justice-Los Angeles LOS ANGELES - Asian Americans Advancing Justice - Los Angeles (Advancing Justice-LA) has joined the lawsuit challenging Harvard’s race-conscious holistic admissions policy by filing papers on behalf of two prospective Asian American and Pacific Islander (AAPI) Harvard applicants who support affirmative action. “Advancing Justice-LA and the students chose to get involved in this case because the vast majority of Asian Americans support affirmative action and have historically benefitted greatly from the consideration of race,” says Nicole Ochi, supervising attorney at Advancing Justice-Los Angeles. “We refuse to be used as a wedge by outside players stoking the insecurities of newer Asian immigrants, provoking them to lash out at the very programs that have helped communities of color gain access to higher education. In our current political climate where racism and bigotry continue to be normalized, it is more important than ever to acknowledge that race still matters and should not be the only aspect of an applicant’s story that is excluded from consideration in the admissions process.” In 2014, Edward Blum orchestrated the lawsuit against Harvard claiming that its race-conscious admissions
policy intentionally discriminated against Asian Americans. The case is also the first time that Asian Americans have been overtly recruited and placed as the primary challengers of a race-conscious admissions policy. In the Fisher, Grutter, Gratz, and Bakke cases, the plaintiffs featured were white and usually female. On Blum’s Project on Fair Representation website, the image of an Asian American student is featured next to the caption: Were you denied admission to Harvard? It may be because you’re the wrong race. Blum is the architect of a series of lawsuits designed to eliminate the consideration of race in admissions and voting, rolling back decades of progress on civil rights. This past summer the U.S. Supreme Court upheld the consideration of race in Fisher II as one factor in a holistic admissions policies. In their decision, the court acknowledged that the empirical data demonstrates that race-neutral alternatives do not result in the same levels of diversity and that Asian Americans do not necessarily lose out under affirmative action. The current case against Harvard is the first time that a private university’s affirmative action policy has been challenged and could lead to another fight before the Supreme Court. Under a Trump administration, there is a high likelihood that the Supreme Court would rule less favorably on the issue. “Part of the Ivy League obsession
of some Asian Americans may be rooted in a sense of insecurity about our place in America. However, we know that in real life, an Ivy League pedigree is not enough to stop people from screaming at us to ‘go home’ or to stop U.S. Immigration and Customs Enforcement from picking us up or stop TSA from racially profiling and escorting us off an airplane. Thus, if we are trying to use education as some sort of shield against discrimination, it isn’t working,” said Jason Fong, a high school senior and Harvard applicant. “I got involved in this case because I feel it’s important for Asian Americans like myself to ask why we aren’t doing more to fight against racism directly. And as someone who has benefitted greatly from being educated in an environment with great diversity in race, class and thought, I believe diversity is a valuable criteria for any campus to embrace.” “Opponents of affirmative action

With “amicus plus” status, the students in this case will have an opportunity to file an amicus brief at any dispositive juncture in the case, participate in oral argument, and submit evidence, which greatly amplifies the students’ voice beyond typical amicus standing.

Duterte’s admission he killed drug suspects might be part of his strategy: Gordon MANILA, Dec. 14 (PNA) – Senator Richard Gordon said on Wednesday said President Rodrigo Duterte’s admission that he personally killed drug suspects when he was still mayor of Davao City might be part of his strategy to fight drug menace in the country. “The President is prone to making exaggerated statements. I think that is part of his strategy, I don’t know,� Gordon, chairman of the Senate committee on justice and human rights, said in a media interview. Gordon said President Duterte, a former fiscal, knew what he is talking about when he made his admission before a group of businessmen in Malacanang late Monday night. The President even said he used to go around in Davao City on a big bike, patrolling the streets and was looking for encounter to kill criminals and drug pushers. “I’m not surprised anymore with the President. The President is very, as I said ‘loose lips sink ship’. That is his own look out. He is a lawyer. He knows that. He served as fiscal for many years. He knew what he is doing,� Gordon said. When asked if the admission could lead to impeachment of the President, Gordon explained that circumstances on why the former mayor killed the drug suspects should be
established first. “If self-defense, he is not liable. If he really said that (killing drug suspects), perhaps he has reason. If somebody wants to file impeachment case, then file it because I know he knows how to defend that. He will not say if he has no defense (strategy),� Gordon said. “When you said you killed people, you have to know the circumstances. You have to investigate. He (the President) should be the one who should clarify,� he added. Gordon explained that encounter with drug suspects and criminals is common to the local leaders, particularly mayor. “When you are a mayor, there are lot of instances that you will encounter that kind situation,� Gordon, a former Olongapo City mayor, said. Gordon believed that President Duterte was just trying to defend and save his constituency of law enforcement when he admitted killing drug suspects and criminals when he was mayor. “That is mayor talking about policemen that he promised that he will defend police. I know what he is playing,� Gordon said. He also believed that President Duterte is not involved in extra-judicial killings amid the government’s strong campaign against illegal drugs.

House Speaker Pantaleon Alvarez and House Committee on Justice Chairman Reynaldo Umali personally filed the complaint against De Lima in DOJ for violation of Article 150 of the Revised Penal Code for disobedience to summons issued by the national assembly, its committee or subcommittees. �(What we filed) is violation of Article 150 of the revised penal code and DoJ has the jurisdiction since this is a crime under a revised penal code. Award for De Lima meant to hit Duterte, says ally MANILA, Dec 14 (Mabuhay) – A lawmaker believes Senator Leila de Lima was honored by an international award-giving body to hit President Rodrigo Duterte and his war on drugs. De Lima was among the 100 Foreign Policy Global Thinkers recognized in Washington D.C. on Monday. Organizers said its honorees prove there are individuals who could step in to ease the suffering of others, especially in today’s world where challenging strains of populism seem to be redefining the new normal. Oriental Mindoro Representative Reynaldo Umali believes the award was given to De Lima as a knock against Duterte’s war on drugs, which De Lima had been vocally
opposing. “I don’t know, this may be a lobby that was being done by some groups somehow to hit more on the President because as you very well know, the Americans are so critical of the war on drugs of the President,� he said. “I guess they will do all these things also to hit back on the President,� he added. Umali, who chairs the House Committee on Justice, said the award-giving body would have had a different reaction had they read the report implicating De Lima in the drug trade. “They do not know what is happening. Award-giving bodies are abroad. They do not know what is happening here. They have not really, I guess, looked into closely on probably our report.

No transfer of FPJ’s remains to heroes’ cemetery: Poe MANILA, Dec 14 (Mabuhay) – Senator Grace Poe on Wednesday said her family has no plans of transferring the remains of her father, the late actor and presidential bet Fernando Poe Jr, to the Libingan ng Mga Bayani. In a speech commemorating Poe’s death anniversary, the senator said her father wanted to be buried in the Manila North Cemetery so that he could be close to his loved ones. More importantly, she said her father wanted to be close to the poor. “Bakit natin ililipat? Thousands of Filipino Americans flocked to the Our Lady of the Angels church in downtown Los Angeles on Friday (December 15) for the opening of the nine-day traditional Simbang Gabi (now on its 14th year in LA). A parade of Parol (Christmas lanterns) started the celebration. Dozens of parol were carried by ministers from different parishes of the pastoral regions of Santa Barbara, San Fernando, San Gabriel and San Pedro. Representatives from the Philippine Consulate in Los Angeles, business and civic organizations also joined the parade of parol. Devotees dressed in colorful traditional Filipino costume danced ahead of the parade inside the cathedral. The Filipino Ministry of the Archdiocese of Los Angeles organized the event under the theme: “Jesus, make us generous dispensers of your divine mercy. LA Archbishop Jose H. Gomez officiated the Mass. Father Albert Avenido, head of the LA Filipino Ministry, said Simbang Gabi is part of the Filipino’s rich cultural heritage. After wedding, Solenn releases third studio album
Solenn Heussaff has announced the release of her third studio album, “Solenn.” It is her first music project since her sophomore effort, “SOS,” in 2013. “We have been working on this album since last year, but we decided to release it now, as I begin a new stage in my life,” the newly married Heussaff said. The sexy actress, whose music began back in 2011, explained that the album’s tracks will be primarily about the “different types and different stages” of love, and will feature
vocals from other singers as well. “It’s my way of expressing how I felt when I was going through these stages. Discharging student loans or taxes in bankruptcy For cases filed after October 7, 1998, Student Loans are only dischargeable if: 1. You can prove that having to repay it would impose an â&#x20AC;&#x153;undue hardshipâ&#x20AC;? on you (as defined below), OR, For cases filed PRIOR TO October 17, 2005, 2. If the PROGRAM under which your student loan is issued, insured, administered is a FOR-profit, PRIVATE (non-government) entity, it may be dischargeable. (However, if the program itself, such as LAL, GSL, etc. receives nonprofit funding by participation of nonprofit entities, the loan is not dischargeable in bankruptcy). To obtain a discharge based on undue hardship you must prove all of the following: 1. that you cannot maintain, based on current income and expenses, a â&#x20AC;&#x2DC;minimalâ&#x20AC;&#x2122; standard of living for yourself and your dependents if forced to repay the loans; 2. that additional circumstances exist indicating that this state of financial affairs is likely to persist for a significant portion of the repayment period of the student loans; and, 3. that you made good faith effort to repay the loans, for example, by past payments for several years, etc. Making payments is not always required if you didnâ&#x20AC;&#x2122;t ever have the money to pay the loans. Forbearances may be sufficient. NEW: The Ninth Circuit recently ruled (in April 2003) that courts have the authority to issue partial discharges of student loans, in cases where the debtor shows the ability to repay some, but not all, of the loans. This is a huge improvement in the ability to possibly discharge some of these debts, because before the rule was if you could afford to repay any of the loans, you had to repay it all. Discharging taxes and removing tax liens Certain types of tax obligations, such as income taxes, may be discharged under specific circumstances. Many required factors must be met before any tax can be discharged under Chapter 7 or Chapter 13. In Chapter 7, the minimum requirements for discharging federal or state income taxes are: (1) it has been over 3 years since the returns were last DUE (including extensions), (2) the returns were timely filed or it has been at least 2 years since the returns were filed, (3) there was no fraud involved or attempts to evade the tax, AND, (4) the taxes were not assessed within the last 240 days. If it has been over 3 years since your returns were last due and they have not been assessed in the last 240 days, BUT you have not yet filed the returns or there was some kind of fraud involved in filing them, then they may be dischargeable in a Chapter 13. Again, discharging taxes is an extremely complicated area, and you should definitely consult with a knowledgeable attorney before deciding whether to file based on dischargeability of your taxes and before you take any further steps with your taxes (such as filing past due returns) Sometimes filing a late return can work against you as far as being
able to discharge those taxes in a Ch. 13, so definitely speak to an attorney before doing anything. Tax Liens that have attached to property will survive a bankruptcy. What does that mean? It means that the lien will stay against your property regardless of your discharge of the underlying debt. So, when you ultimately sell that property, if there is extra money available, the lien will be paid first from those proceeds unless you have the lien removed. Discharging fraudulent debts or fraud debt judgements Debts that you incurred which were the results of an intentional or even negligent misrepresentation on your part are not dischargeable in a Chapter 7. Examples of these might be if you misstated your income on a credit card application, made false statements in order to induce someone to give you a loan, ran up your credit card debt shortly prior to filing bankruptcy, used your credit card or obtained a loan without any intent to repay it, or if someone has obtained a court judgment against you based on fraud. However, the news isnâ&#x20AC;&#x2122;t all-bad. These types of debts may be discharged in a Chapter 13. Retirement accounts and pension plans Whether or not you can exempt amounts held in a retirement account depends on numerous factors, including which set of exemptions you choose to use (you need to discuss this with your attorney â&#x20AC;&#x201C; in California, there are two sets of exemptions). According to the United States Supreme Court, if your retirement plans is ERISA approved, meaning that it contains a trust â&#x20AC;&#x153;anti-alienationâ&#x20AC;? provision making it impossible to transfer or withdraw the funds prematurely, and it is automatically exempt. Individual Retirement Accounts may be exempted only up to the amount reasonably necessary for the debtorâ&#x20AC;&#x2122;s support and maintenance, taking into account all other anticipated and existing sources of income and expenses. Obviously, exempting retirement funds is very tricky and requires the expertise of an experienced bankruptcy attorney. Getting rid of liens, abstracts of judments and trust deeds against your property The bankruptcy code enables a broad range of powers, which can enable you to avoid liens that were placed against your personal property or real property (like a house). It is too complicated an analysis to deal with here, but if you has liens against your property; make sure to discuss this with your attorney. Types of liens you may be able to get rid of include judgment liens recorded against your home or specific personal property. Also, in a Chapter 13 junior trust deeds against your home may be able to be removed under certain specific circumstances. This is not an option in a Chapter 7, so make sure to discuss this with your attorney. Paying taxes with your credit card Debts incurred on your credit cards to pay taxes to the IRS will usually NOT be dischargeable in chapter 7 but may be dischargeable under Ch. 13. New military graduates coming at right time in line with AFP modernization: Lorenzana MANILA, Dec. 13 (PNA) – As 194 members of the Major Service Officer Candidate Course formally graduated Tuesday, Department of National Defense (DND) Secretary Delfin Lorenzana said these young men and women are coming at a very opportune time as the Armed Forces Philippines (AFP) is now modernizing in all aspects. “Our graduates today are fortunate to be able to gain entry into the noble profession of arms. they come at an opportune time as our Armed Forces is currently in the midst of upgrading and modernizing its assets, and professionalizing its human resource,” he added. As of this posting, various modernization projects are on the way for the AFP with several items now undergoing delivery. The delivered equipment consists of four brand-new FA-50PH jet fighters, three Hamilton-class cutters, assorted armored personnel carriers and rifles, among others. Graduation rites for the 194 mem-
bers of the Major Service Officer Candidate Course took place at the AFP Theater, Camp Aguinaldo, Quezon City. Graduates numbered 68 for the Army; 63 for the Navy and another 63 for the Air Force, the DND chief stressed. “Thus, we have now a new human resource acquisition of 194 strong, young and healthy prospective second lieutenants and ensigns. they are well-trained, idealistic and dynamic, and will join the Officers Corps of the AFP under its three Major Service Commands,” he added. “I commend and congratulate the leaderships of the Training Commands of our Major Services for maintaining the lofty education and training standards of the prime learning institutions of the our Armed Forces,” Lorenzana emphasized. The DND chief also said it is significant to note that the Officer Candidate Course (OCS) traces its humble beginnings from the school for reserve commission in 1937.

MANILA, Dec. 13 (PNA) – Department of National Defense (DND) Secretary Delfin Lorenzana on Tuesday said he strongly supports a bilateral ceasefire agreement with the New People’s Army (NPA) as it would prevent rogue elements of the rebels from creating trouble in the countryside. “Of course, we would like a bilateral ceasefire agreement as it prevent the (rogue) NPAs from creating trouble in the countryside. We are still getting reports that some of their elements are still extorting. Hopefully, once the bilateral ceasefire agreement is signed, and the NDF
(National Democratic Front) can control their people, these criminals will not commit anymore criminal acts in the countryside,” he said in Filipino. Lorenzana also clarified that there will be no pullout of troops in countryside and that the military will continue responding to reports of lawless elements creating havoc. “The difficulty in this situation is that the NDF is that they cannot prevent their people from conducting extortion rackets, and burning trucks and equipment (of businesses not giving it to their demand). That’s why President (Rodrigo Duterte) told them to stop these atrocities or peace negotiations will stop,” he added.

Caregiver overtime law becomes permanent In September Governor Jerry Brown signed SB 1015 into law. This law is critically important because it permanently guarantees caregivers the right to overtime compensation. Originally, the Domestic Worker Bill of Rights (DWBR), which guarantees overtime pay for in-home caregivers, was set to expire on January 1, 2017. Under the DWBR, in-home caregivers must be paid overtime compensation when working more than 9 hours a day or 45 hours a week. In my experience, very few 24-hour caregivers are paid correctly. With California’s increase in the minimum wage to $10 an hour, non-exempt caregivers who work 24-hour shifts must be paid a minimum of $315 a day. If you are working as a caregiver and paid a day rate less than $315, under California law, you are not being paid any overtime and may have a substantial unpaid overtime claim. Often, employers attempt to avoid overtime liability by claiming the caregiver is an “independent contractor.” However, the DWBR defines in-home caregivers and personal attendants as domestic work employees, meaning that employers cannot lawfully classify them as independent contractors. Therefore, the law will likely invalidate any agreement that wrongfully classifies an in-home caregiver as an independent contractor. The change in the overtime rules for caregivers first became effective on January 1, 2014, when the DWBR became law. Previously, employees who worked in a private household and qualified as “personal attendants,” including caregivers and nannies, did not qualify for overtime. The DWBR eliminated the overtime exemption for personal attendants and provides that personal attendants “shall not be employed more than nine hours in any workday or more than 45 hours in any workweek
unless the employee receives one and one-half times the employee’s regular rate of pay for all hours worked over nine hours in any workday and for all hours worked more than 45 hours in the workweek.” This means that now caregivers, nannies and babysitters (with limited exceptions) must be paid overtime compensation. Unfortunately, this law does not cover workers for In-Home Supportive Services (IHSS) and those caring for close family members. Under Labor Code § 1194, caregivers are not only able to recover their unpaid overtime in a civil action, but they also may recover reasonable attorney’s fees, costs and interest. California law also provides for severe penalties to workers who are not properly paid overtime compensation. If you are working as a caregiver and you are not paid overtime compensation when working more than nine hours a day, or 45 hours a week, you should consult with an attorney to discuss your rights under this law. With the penalties, interest and attorneys fees allowed, claims often exceed $100,000 for 24-hour caregivers who have worked one year. Debt forgiveness without bankruptcy? You’ve probably seen a lot of these ads: “Settle your debts for pennies on the dollar!”, “Reduce your debts legally without filing bankruptcy!” “Stop bill collectors now and pay them only what you can!” Are all these just exaggerated claims? Or are any of these ads true? How can you protect yourself from being scammed? If you’ve accumulated a lot of credit card and other debts and have found it difficult to make your payments, perhaps you would like to find a way out of debt without having to file for bankruptcy as much as possible. After all, bankruptcy is often a last resort for most people when no other options exist. But how do you know who to trust before giving anyone your hardearned dollars? Unfortunately, bad things happen even to good, honest and decent people. And when you are in a situation where your bill collectors are hounding you day and night for payment, you may be tempted to accept the first offer of help from someone who comes along although you may not really understand what you are getting into. FACT: Debt settlement companies are everywhere, often telling you things that are not true. You see them
advertising in newspapers, on TV and on the internet. I am sorry to say but a lot of these companies are “scams” for lack of a better term. They will tell you whatever you want to hear and making promises that they can’t keep. Once you hire one of these debt settlement companies, your phone will never stop ringing and they have no way to legally protect you because they are not attorneys (although a lot of them lie to you and claim that they are somehow affiliated with law firms). Don’t believe a word of what they tell you and be very careful especially if this is a company that you have not met with face to face. A lot of these companies are out of state and once they have your money, you may not hear from them again. Does this mean that all debt settlement companies are dishonest? No,
that’s not what I’m saying. But you need to be very careful as there are a lot of unscrupulous and deceitful companies out there who want to take advantage of your misfortune. Before you hire a debt settlement company, make sure that you understand the agreement that you are signing. Over the years, I have heard hundreds of horror stories from clients who have put their faith and trust in a debt settlement company who made a lot of big promises that they could not eventually deliver. They charge large up-front fees before they do any work and in a lot of cases, they don’t explain to you exactly what services they will be providing. Most of them also do not tell you that the credit bureaus will still report your accounts as “late” on your credit report. Thus, if your credit will be ruined anyway, wouldn’t you just be better off filing for bankruptcy so you can get out of debt much quicker without spending so much money? This doesn’t mean that debt settlement is not an alternative to filing bankruptcy. In some cases, it is better than bankruptcy if settling your debts is the best way to protect your assets without having a bankruptcy

on your record. Remember, however, that settlements are only available on unsecured debts like credit cards, medical bills and department store cards, auto repo and foreclosure deficiencies. Also, you may need to file bankruptcy right away if there is an immediate threat to your property or income such as a lawsuit, wage garnishment, bank levy or foreclosure. And If it’s going to take more than 12-18 months to negotiate settlements with your creditors, in most cases, bankruptcy might be the better way to go. House panel OKs bill on condonation of water districts’ debts MANILA, Dec. 13 (PNA) – The proposal seeking to remove conditions for condonation of all unpaid income taxes of local water districts (LWDs) hurdled the committee level at the House of Representatives on Tuesday, inching its way to approval after being vetoed during the Aquino administration. The House committee on ways and means approved House Bill No. 42 authored by House Deputy Speaker Romero “Miro” Quimbo. Under the proposal, a one-time general amnesty shall be granted for all unpaid taxes or any portion thereof due from a local water dis-
trict for the period starting August 13, 1996 until the effectivity of the proposed act. The bill sought to remove the two conditions for tax condonation, specifically the proof of financial incapacity as determine by Bureau of Internal Revenue and a program of internal reforms as submitted to Congress. During the 16th Congress, both chambers of Congress ratified the bicameral conference committee report on such proposal, which reconciled House Bill 3675 and Senate Bill 2518. Its enactment into law, however, did not push through.
Former President Benigno Aquino III has vetoed the bill, saying that the bill will remove the laudable intent of Republic Act 10026, which is to grant tax reprieve only to LWDs that are financially incapable and committed to instituting fiscal reforms. Aquino also said the bill “sends a message to errant taxpayers that delinquency is acceptable since amnesty or condonation may be given away, even without benefit of proper documentation”. Data from the Philippine Association of Water Districts (PAWD) revealed that there are about 251 cases involving the unpaid tax lia-
bilities of 164 water districts from fiscal year 1997 to 2007 which should be covered by the implementation of the condonation clause of Republic Act 10026. Quimbo said during the 14th Congress, RA 10026 was enacted to resolve inconsistencies in tax treatment that may have hampered the growth and efficient provision of safe, adequate and potable water to more than 15 million people outside Metro Manila. Thus, RA 10026 included LWDs in the list of government agencies exempt from the payment of income taxes and also allowed the condonation of their tax liabilities.

Client seeks Chapter 7 relief for $57k credit cards; Senior seeks Chapter 7 relief for $100k credit cards Client is 52 and married. Her husband filed for Chapter 7 relief for $30K of credit card debts two years ago. At that time, I suggested to her that she should just file a joint Chapter 7 petition with her husband so that she could also get rid of her $35K of credit cards. She said that although she was having a hard time making the payments on the cards, about $1K a month, she wanted to wait and see. She grossed $3K a month and nets $2,500. I told her then that her minimum payment of $1K a month represented 40% of her net income. Thatâ&#x20AC;&#x2122;s a big chunk of her net income. If she were making a net of $10K a month, then $1k a month would only be 10% of her net. That would not put too much of a strain on her. But 40% means that for every $1 that she makes 40 cents goes to credit card interest. Sheâ&#x20AC;&#x2122;s actually working for the credit card companies. I filed her husbandâ&#x20AC;&#x2122;s case two years ago. Wiping out $30K of credit cards was a big relief for him. His net income was $1,500 and $1K a month credit cards was simply outrageous. More than half of his net income was being used to pay for his cards. Both client and her husband come to see me. He says heâ&#x20AC;&#x2122;s pretty happy that he has no credit cards to pay

PHL unemployment rate hits 10-year low at 4.7% By Leslie D. Venzon
MANILA, Dec. 13 (PNA) – Philippine unemployment rate dropped to a 10-year low at 4.7 percent in October 2016, reflecting the country’s economic growth generates job opportunities. The Philippine Statistics Authority’s Labor Force Survey (LFS) shows that employment rate rises to 95.3 percent to reach 41.7 million Filipinos employed. This is the highest among the results in all of the previous October rounds of the LFS since 2006. “This means that the growth of our economy is becoming more inclusive as it engages more and more Filipinos to participate in the labor market,” said Socioeconomic Planning Secretary Ernesto M. Pernia. The services sector remained the top employment contributor with a share of 54.9 percent, or 22.9 million
of the total employed. The industry sector, meanwhile, accounted for 17.2 percent, or 7.2 million, of the total employed in October 2016, driven largely by strong growth in manufacturing and construction. “With the decrease of unemployment in October 2016, our implied full-year unemployment rate will be 5.5 percent, exceeding the government target for 2016 of 6.5 to 6.7 percent,” he added. The unemployment rate among the youth continued to decline in October 2016 at 11.6 percent, also a record low for all October rounds of the LFS since 2006. The share of inactive youth — those who are neither studying nor employed — has consistently been declining in the past four years and has dropped to 20.5 percent in October 2016. Duterte: No to Charter change if land will be sold to foreigners
MANILA, Dec. 13 (PNA) – President Rodrigo Duterte has said he is open to the proposal to touch the economic provisions of the Constitution except for the selling of lands to foreigners. During a two-hour talk with a business group late Monday in Malacanang, President Duterte said he will support Charter change even if Congress will reverse the 60/40 percent foreign ownership provision. “Maybe, I said, the equity can be increased to reverse, 60-40 or 70 if it’s a foreign corporation. But to sell the land, I will not. For the life of me, I will not agree to that. I will lose my country to foreigners,” the President said. President Duterte explained that the Filipinos, most of them are poor, might be tempted to sell their lands to the world’s superpowers like China and United States. “With the growing economy of the super giants, China and the rest, you know, they can always come here and buy the land and they can buy the whole of Tondo and relocate there and we’ll have with nothing and everything sold,” the President said. “At this time of our financial life and civilization, you can easily sell the land even for a pittance. It would come to other people almost as free and then what happens? Where will I go if everything is already owned?,” he added. Last week, President Duterte signed Executive Order No. 10 creating a 25-member consultative committee that will review the 1987 Constitution. The committee shall study, consult and review the Charter provisions “including, but not limited to, the provisions on the structure and powers of the government, local governance and economic policies.” The panel has six months to complete its recommendations and proposals which will be submitted to President Duterte before it will be transmitted to Congress. Expected to be included in the recommendations and proposals is the shift of the form government from presidential to federal with a prime minister and a president. President Duterte said federal form of government is the solution to the long decades of armed conflict in Mindanao. “If we do not adopt federalism, there is no way that peace can be attained in Mindanao, now or in the future,” he told the business leaders. The President said he is ready to step down if Congress can craft a Constitution creating a federal form of government even midway of his six-year term. “If they can craft a Constitution creating a federal setup, a country, and providing for a strong president just like the type which France has, then I am willing to step down without waiting for the six years,” he said. President Duterte said he already instructed Senate President Aquilino ‘Koko’ Pimentel III and House Speaker Pantaleon Alvarez to hasten the shift of government to federalism. “That’s why I said for those who are asking for my ouster, do not dream about it. If you do not like me, go for the federal type and you are freed of my presence in government,” he said.

Duterte says he is pro-business, assures investors of gov’t support MANILA, Dec. 13 (PNA) – President Rodrigo Duterte assured businessmen on Monday that his administration will honor contractual obligations, fight corruption and red tape, and allow businesses to flourish under a free market environment. During the Wallace Business Forum Dinner in Malacanan, President Duterte addressed various concerns of investors in the country particularly on his economic policies and agenda. A representative from the business process outsourcing (BPO) industry expressed concern about the stability of BPOs amid changes in policies of the current administration. “Forget your fears. This is a democracy. We follow the free enterprise. There would be changes, there would be changes for the better, not to kill businesses,” President Duterte said as a response. “You can stop worrying, it’s actually a product of the other side. They would like to create an economic situation whereby there would be a tilt of balance there somewhere and destroy the economy and blame it on me,” he added. The President said he believes in free enterprise and businessmen could come in and invest, and should not worry about contracts as long as they pay the right taxes. “I am a lawyer and I believe in free enterprise, I believe in democracy that’s why I ran for President. I’m duty-bound by the Constitution. And about the outsourcing there, I would even guarantee to you that the Philippines would honor its contractual obligations,” he further said. He then encouraged businessmen to put more money in the Philippines. The President likewise assured investors that there will be no graft and corruption in his
government. He vowed to fight red tape in the bureaucracy and told investors to approach members of his Cabinet should they encounter problems. Also discussed during the forum were moves to amend the present Constitution, with the President saying he is ready to reverse the 60-40 foreign ownership as long as Congress is ready. “I will go along with it,” he said, stressing however that he would not allow selling of lands to foreigners. With regard to the Philippines’ hosting of the ASEAN Summit next year, the President said he will particularly focus on spurring economic activity in Mindanao. “Well, one thing is that we lack the connectivity. We have to have our own BIMP-EAGA (Brunei Darussalam-Indonesia-Malaysia-Philippines East ASEAN Growth Area). We have to create an economy over there,” he said, adding the reason why the Abu Sayyaf prospered was because of lack of economic activity when the barter trade in the southern region was shut down. He said the barter trade was good and it provided livelihood to many people, especially the Muslims. The country’s terrible traffic congestion problem was also discussed and the President expressed his frustrations over the moves of Congress for not acting fast enough to give him special power to tackle the traffic situation. There’s no movement at all, and he told Filipinos that he is sorry but his government is trying to overcome the challenges. Mining operations and the appointment of Environment Secretary Gina Lopez was also discussed.
Fariñas: No railroading of death penalty bill MANILA, Dec 14 (Mabuhay) – House Majority Leader Rodolfo Fariñas on Wednesday denied claims that the passage of the death penalty bill is being railroaded at the House of Representatives. “How could it be railroaded? Na-file ito House Bill 001. It was filed on the opening of Congress on July 25. Ano na ngayon, December? So five months na na-percolate, dumaan sa committee and everything. Paano mo ire-railroad ‘yan?” Fariñas said. The “Magnificent 7” alternative minority bloc has claimed that the Duterte administration is “railroading” the passage of measures that would restore capital punishment. This, according to Albay Rep. Edcel Lagman, is evidenced by the successive hearings being held by the House justice committee since emerging from a session break earlier in November. “The committee on justice set a whole day of meeting again tomorrow. It’s a whole day meeting. Prior to that, there was also another meeting,” said Lagman. “So that would only show to you how they would like to railroad the passage of this bill in the committee level. And I think the
same strategy will hold true in the plenary,” he added. In response, Fariñas said the proper forum to discuss the matter is really during the plenary. “Kaya nga nandoon sila sa committee, nag-oobject sila and everything, hindi naman sila makaboto because they’re not members of the committee. They have speaking rights but they don’t have voting rights,” he said. Fariñas maintained there really is a need for the reimposition of the death penalty, given the increasing number of extrajudicial killings. He added that this was part of President Rodrigo Duterte’s legislative agenda. “The President is the one moving for it. This is his legislative agenda. Pumunta ang Presidente sa Kongreso noong SONA. Leni and Leila Leni and Leila have so many things in common. Aside from having their first name start in L, they were both elected by Filipinos in the recent national elections last May. Leni Robredo was elected as vice president and Leila De Lima as senator. Both, however, were elected through alleged manipulation allegedly orchestrated by some Comelec officials sympathetic to former President Benigno Aquino and the Smartmatic. Both Leni and Laila are facing election protest for alleged election fraud and irregularities as claimed by their vanquished political foes. Former Senator Bongbong Marcos filed an election protest against Leni claiming he was cheated in the election through the manipulation of the electronic transmission of vote results. The case is still pending in the Supreme Court, sitting as Presidential Electoral Tribunal (PET). Leila is also facing an election protest lodged by former MMDA Francis Tolentino before the Senate Electoral Tribunal (SET). On top of the election protest case filed against her, Leila is also facing criminal and graft charges for her alleged involvement in the proliferation of drugs in
the National Bilibid Prisons (NBP). If the gossips being peddled in the social media are true, then Leni may have similar problems like De Lima as she was rumored to be the longtime girlfriend of a married Quezon City Congressman. Of course, fake news are all over the Internet. Leila, on the other hand, have been publicly exposed by Ronnie Dayan, her former love/driver/bodyguard, as having not one but three lovers during her stint as Justice Secretary during the Aquino administration. Both women are members of the Liberal Party (LP) of former President Aquino and defeated presidential candidate Mar Roxas. Both also seemed to have presidential ambition judging from their public statements and role as critics of President Duterte as well as fiscalizers in the current administration. Lacson says Duterte should make his medical records public MANILA, Dec 15 (Mabuhay) – Senator Panfilo Lacson said President Rodrigo Duterte should make his medical records public, following the chief executive’s statements that he was suffering from migraine and spinal problems. At a media briefing Thursday, Lacson said Duterte’s state of health is a “national concern.” “He should [release his medical records] because nagpahiwatig nang ganun. All the more that the public should be informed ano ba state ng health of the President kasi kung meron talagang sakit, sabihin talaga kung ano yung ailment,” Lacson said. While he revealed he has Barrett’s esophagus and Buerger’s disease, Duterte denied that he had cancer. “I have, might as well tell you about my medical history. Don’t believe in cancer,” he said. Barrett’s esophagus, according to Mayo Clinic “is associated with an increased risk of developing esophageal cancer.” Buerger’s disease, meanwhile, “is a rare disease of the arteries and veins in the arms and legs.” Malacañang, for its part, said Duterte’s physical aches were part of being a senior citizen. “He is doing very well. And whatever pains he’s experiencing, is basically as the doctors would say, basically wear and tear,” Abella said at a news conference in Cambodia.

Both do not have the charisma to unite or convince people to rally behind them and to believe them in all their tirades against Duterte and his program of good governance. Leni does not have or very little leadership qualities. She is new in politics. She was the last minute choice of the LP as their VP candidate to replace Senator Grace Poe who refused to run alongside Roxas. Leila, on the other hand, has leadership qualities compared to Leni. She is also very articulate and knowledgeable in the crafting of laws and the ins and outs of politics. She seems also an expert when it comes to lying and illicit relationship, however. Leni’s resignation from the Duterte cabinet was an attempt to drum up public support and sympathy. It was a dud. Nobody paid attention to it although it merited a page one story in all major newspapers. I think Leni committed a political blunder by resigning from the Duterte cabinet. By the way, did she resign or was fired by President Duterte? Too bad she listened to the wrong
advice of her partymates in the LP. She should know by now that she is being manipulated by the same people that took advantage of the former President Aquino. She should have stayed as Chairperson of the Housing and Urban Development Coordinating Council for her to gain not only managerial skills but as well as attain political maturity. For Leila, her short political career may be over. In three years when she will run for re-election for a senate seat, I’m sure she will be repudiated by the voting public. The voting public will always remember her as the queen and protector of illegal drug lords and an adulterer. We will see if Leila will come back to the country, after getting her “award” in Germany, to face criminal charges filed against her in the DOJ. I’m sure Leila will find a way to be able to establish her innocence by claiming that all allegations against her were purely based on circumstantial or inconclusive evidence. She is claiming that under a Duterte presidency, she will never get a fair treatment in court and she will never expect that she could get justice from all the trumped up charges leveled against her. Another exaggeration, says Aguirre of Duterte ‘killing’ druggies MANILA, Dec 14 (Mabuhay) –Just because you kill suspects does not mean you have violated the law, Justice Secretary Vitaliano Aguirre II said of the President Rodrigo Duterte’s fresh admission that he personally killed drug suspects as mayor of Davao City. Aguirre said Duterte’s remark was just another hyperbole. “Sinabi naman n’ya yun noong nakaraang kampanya pa. Palaging hyperbole yan si Presidente, palaging exaggerated just to put his message across,” he told reporters at the Senate. Aguirre noted Duterte’s statement during the campaign period that he had killed kidnappers, who refused to surrender to him. Asked if the President had violated the law, the Justice Secretary said, “Wala, wala. Hindi nangangahulugan na porke pumatay ka ng suspect ay may violation ng laws. “It could be done with a justifiable cause and justified circumstances as a public officer in order to arrest pero lumaban yung suspect. He must have been forced to kill.”Asked again if he would investigate the President, Aguirre said he was not in a position to do it. In a speech Monday night in Malacañang, Duterte admitted that he “personally” killed drug suspects when he was mayor. “I know it because—I am not trying to pull my own chair—in Davao I used to do it personally. Starting the new year fresh with a divorce To many people, the New Year signifies a chance to have a fresh beginning. People dispose of old personal items and clean out the closet in order to make room for the new. The same line of thinking goes with getting rid of the spouse upon realizing over the holidays that your spouse is stuck in his or her old ways which you can neither change nor live with. You decide to take action and file a divorce. Before you take any action, you need to think about your situation carefully. First, you should decide whether you should you move out of the family residence or not? If you and your spouse are communicating and have some type of respect left with one another, it may be more economical to continue residing in the same household until you resolve the issues in the divorce case. However, if your relationship is heated and riddled with conflict, then someone should to move out. If your spouse has threatened you, hurt you, or committed domestic violence, you may file a domestic violence temporary restraining order and request the court to order your spouse to move out of the house. In the same application, you may also request for custody, support, and attorney’s fees. If on the other hand you decide to be the one to move out, you should move somewhere close to your spouse if you have children to make it easier for both of you to co-parent with the children. Second, you should decide whether your spouse is the type who will disclose all the financial assets or not after you file for divorce. Although the family code (family code 2100 et seq.) imposes a duty to disclose
all material facts and information, spouses’ are not always forthcoming in disclosing completely all assets, debts, income and expenses specially after a divorce case is commenced. What sometimes happens is once a divorce case is commenced, assets are either not disclosed, disappears, or documents/ bank statements are not produced even with formal discovery. You should gather and make copies of all financial documents before filing the divorce. Third, there is an automatic temporary restraining order (ATROS) in place once you file and serve your spouse with the divorce papers. The four standard mutual restraining orders are 1) removing their minor children from the state without the prior written consent of the other party or a court order. family code Section 2040(a)(1) 2) restraint from transferring, encumbering, hypothecating, concealing, or in any way disposing of any property, real or personal, whether community, quasi-community, or separate without the other party’s written consent or court order; fam code 2040(a)(2) 3) restraint from cashing, borrowing against, canceling, transferring, disposing of, or changing the beneficiaries of any insurance or other coverage, including life, health, automobile, and disability held for the benefit of the parties and their child for whom support may be orders. BSP chief hopes for limited PHP-USD movement as year ends By Joann S. Villanueva
MANILA, Dec. 15 (PNA) – Weakness of the Philippine peso and the local bourse after the Federal Reserve’s decision to hike key rates Thursday morning (Manila time) is as expected but Bangko Sentral ng Pilipinas (BSP) Governor Amando Tetangco Jr. hopes this movement will be limited as the year ends. After the two-day meeting of the Federal Open Market Committee (FOMC) on Dec. 13-14, the Fed increased key rates by 25 basis points to between 0.5 percent and 0.75 percent, which has been widely expected by markets, after noting sustained economic improvements. For the day, the peso opened at 49.90, weaker than the previous day’s 49.82. It has traded between 49.95 and 49.88 as of 10:10 a.m. Also, all indices in the local bourse are in the red, with the main index, the Philippine Stock Exchange index (PSEi), down by 1.17 percent, or 81.07 points, to 6,847.7 points as of 10:32 a.m. Tetangco, in a text message to reporters, cited that since markets have priced in a 25 basis points increase in the Fed’s key rates the focus would be more on the “Fed dot plot, which shows a more “hawkish” Fed than market first expected.” He, on the other hand, noted that “even then markets would likely not dwell too much on that because market also knows that those dots do change over time.” “I am hopeful the recent US dollar-Philippine peso movements have also factored these in and that any further movement during the balance of the year would only just be small refinements to bank positions,” he said. “Going forward, we’ll watch for indicators on how global markets judge the potential expansionary US fiscal policy, its impact on global demand, prices of global commodities and how these would affect our own domestic inflation and growth dynamics,” he added.

Learn from other peoples’ mistakes and how to avoid making them yourself I thought this might really help my readers in making smart choices in their next quest for a home loan financial. Not to brag but I have been told that I was very straight forward when I speak I did not take it the wrong way because it is absolutely true. My theory for my business is this: The more true information you teach people about your business, the easier it will be in practicing it. Again, I have been in this business for over 29 years and the last thing I want is someone calling me in the wee hours of the evening crying about their loan not closing on time or their payments going up without warning. Here are some Q & A’s from our readers that I thought might be informative to everyone. Caller: I am currently applying for a home loan refinancing and it has taken longer than expected and I don’t even have any type of disclosures on fees and rates. What is going on ? Ken Go: In all fairness to all agents, first you have to ask yourself if you have provided all information to your lender, such as complete income information, have they pulled your credit report or have you given them your credit scores (3). Basically, with your complete income information ( only if going full documents ) and a completed credit report, any lender should be able to quote rates by phone or fax immediately. Even if you have issues with your credit, a loan officer (experienced ) should know where to place your loan and be able to give you a confirmed rate for the day. Now, about all the fees and miscellaneous closing cost that should also be disclosed asap. If you have not been given these disclosures I would not pay them any appraisal
fees until I am satisfied with a written quotation. Remember always ask if the rates are locked. Caller : Another refinancing question. I had a late on my mortgage because when I was refinancing my loan, the loan officer advise me to not pay the following months mortgage and they claimed that we should be closed before the payment is due. Ken Go: Please be aware that the loan officer who is refinancing your loan has no relations to your existing lender, even if you are refinancing with the same bank you still need to be sure yourself that your payment or the payoff meets your mortgage due date. Can you blame your loan officer, Yes of course, but that might be after the fact and your lender will hold you responsible for the payments not your loan officer. I have received multiple calls on this and in some cases the loan dragged on for almost three months and the interest now are up almost .50% from just a month ago. Caller: I got turned down by a lender because I am buying a new house again with in a 8 months period and the new house is only less than 4 miles away from a house I just bought. Ken Go: Actual case that we closed for this client. We immediately assess the entire situation and found out that there is a valid reason why these clients are buying another home close by and within such a short period of time. They have just relocated from
another state, bought the first home they saw and was not happy with it, they were also living with an elderly parent who cant go up the stairs and the new home has a room on the ground floor. This buyer was able to buy this house, with minimal money down and we were able to close within 3 weeks that avoided them a penalty from the home builders. They acted early enough for us to save their deal. Reminder, if you sense a slight problem with your loan, maybe you are not getting return calls from your lenders and or you are getting the run around and still don’t know what is going on. Look else where chances are something is wrong. Typical loan approval now a days are within 24-48 hours of your initial interview, with completed loan packaged you should close your loan within 2 weeks maximum 3 weeks. Caller: I paid a company $450 six months ago to clear my credit and have not heard back from them. Ken Go: In my 29 years experience doing home loans, I have only met one person in the early 90’s who can erase bad credit and he has disappeared a few years after. My guess is he is probably either hiding somewhere or in jail. No one can erase bad credit legally ( I would like to know if anyone might have any good experience with a credit clearing companies, please call me so we can share the info to other readers). I have developed a simple way to send the bureaus a letter if you have a dispute with your credit. Call me and I will fax it over to you for free. As far as your funds are concerned, its probably a no guarantee service contract and non-refundable fee. Caller: I have been offered a low interest rate loan by a Lender (do not
prefer to discredit ) but I am being charged close to $15K for the entire closing cost. Ken Go: Another actual case, when I got the estimated closing statement from this lender the caller was not sure of why they are paying so much for the closing cost. It turned out that they were charge a “Origination Fee” and another “Discount Points” totaling almost 9K for a $350,000.00 loan. I was shocked, both are actually the same fees, the terms were originally use for Government loan ( FHA) and this is a conventional loan. Not only that, there is a miscellaneous fee for $1500.0 and a couple of junk fees that is not common. I told the caller to compare that estimate with one we gave her and she was able to save $9500.00 of cost and I was able to actually save her $26.00 on the payments too. This lender finally called the client back and said they would discount another $1500.00 in order for her to go with them. Even if you might not see all the cost that is factored into the loan, you will feel it when you sell because that is less money to your pocket later. Check everything little cost on a loan. There are some lender/ bank that don’t do full disclosure of rebate fees (lender credit) due to all the regulatory changes, some lenders are actually benefiting from hiding these fees. Interest rates are certain to go up this month, per investigations from different real estate offices there seem to be more listings and prices of home might slowly get reduced. Duterte gives PHP1 B for medicines of poor patients in public hospitals MANILA, Dec. 13 (PNA) – Poor patients in government hospitals, like the Philippine General Hospital (PGH), can now go to the Department of Social Welfare and Development (DSWD) and ask for financial assistance to buy medicines. This after President Rodrigo Duterte announced on Tuesday that he gave PHP1 billion of the PHP5 billion from the Philippine Amusement and Gaming Corporation (Pagcor) to the DSWD. “Andrea Domingo (chairperson of Pagcor) gave PHP5 billion right there and then,” President Duterte announced in his pre-departure speech before leaving for a four-day state visits to Cambodia and Singapore. “All those Filipinos with doctor’s prescriptions from PGH and government hospitals, go to nearest DSWD and you can ask for your medicine there. It’s PHP1 billion I released the other day,” the President added. President Duterte said another PHP1 billion will also be released for the medications of drug addicts under the rehabilitation programs of city health officers. “I don’t know if it would be enough but I still have PHP3 billion. I’m just holding and you can still buy medicines. For example, the tranquilizers, the medicines that would keep you calm and would restore your sanity if there is still hope,” the President said. The Chief Executive recently inaugurated a mega drug rehabilitation center in Nueva Ecija that can house 10,000 in-patients once the construction of the facility is completed. The mega rehab center, situated inside Fort Magsaysay military camp, was donated by Chinese philanthropist Huang Rulun who was impressed by President Duterte’s war on drugs. Since President Duterte launched his campaign against illegal drugs six months ago, almost 800,000 drug pushers and users have surrendered to the authorities. On the other hand, the Philippine National Police’s Oplan Tokhang has resulted to the arrest of more than 37,000 and the killing of close to 2,000 drug addicts in legitimate police operations. President Duterte has claimed that illegal drug has contaminated almost four million Filipinos and “could contaminate 10 million more if not stopped.”

U.S. FDA warns on anesthesia use on infants, pregnant women
WASHINGTON, Dec. 15 (PNA/ Xinhua) – Lengthy use – longer than three hours – of general anesthetic or sedation drugs during surgeries may harm the brains of six-month-old fetuses and children younger than three years old, the U.S. Food and Drug Administration (FDA) warned Wednesday. However, a single, relatively short exposure to general anesthetic or sedation drugs in infants or toddlers is unlikely to have negative effects on behavior or learning, the agency said. The FDA said the warning was based on a comprehensive analysis of the latest published scientific studies. “To better inform the public of the risks, we are requiring warnings to be added to the labels of these drugs,” Janet Woodcock, director of FDA’s Center for Drug Evaluation and Research, said in a statement. “We recognize that in many cases these exposures may be medically necessary and these new data regarding the potential harms must be carefully weighed against the risk of not performing a specific medical procedure,” Woodcock said. According to the FDA, animal
studies have shown the use of general anesthetic and sedation drugs for more than three hours caused widespread loss of nerve cells in the brain, which have been linked to long-term effects on the animals’ behavior or learning. Studies have also been conducted in children, some of which supported findings from the animal studies, particularly after repeated or prolonged exposure to these drugs early in life, it said. The FDA noted that all the studies in children had limitations. It’s unclear whether any negative effects seen in children’s learning or behavior were due to the drugs or to other factors, such as the underlying medical condition that led to the need for the surgery. The U.S. agency said it has been investigating the potential adverse effects of general anesthetic and sedation drugs on children’s brain development since the first animal study on this topic was published in 1999. It has also formed a partnership with the International Anesthesia Research Society to fund research in this area.

Professional and amateur performers took the stage on Saturday night (December 10) at the Celebrity Centre in Hollywood to showcase traditional Filipino Christmas songs, dances and poetry during the “Himig Pasko” show. Organized by the Philippine Institute of Language, Arts and Culture (PILAC) and the United Nations for Human Rights (UNHR), the show coincided with the celebration of the International Human Rights Day. Bernie Targa-Ganon, president of PILAC, said they envision “Himig Pasko” to become an annual event. Filipinos, Targa-Ganon, have a very strong culture of Christmas caroling. As the traditional nine-day Simbang Gabi begins, Christmas caroling also begins around the Philippines -- involving adults and children, the sophisticated and the unpolished. Aside from highlighting the Filipino Christmas traditions, Himig
Pasko also provided a platform for ordinary people and aspiring artists to show off their talents. “Pero ang maganda rito (Himig Pasko) nabibigyan natin ng pagkakataon ‘yung mga ordinaryong tao na makapag-perform in a big stage as the Celebrity Centre,” Targa-Ganon said. New AARP Fraud Prevention Handbook outlines common scams and how to protect yourself WASHINGTON, D.C., December 14, 2016 – Approximately 15 million people are victims of identity theft every year. AARP’s new free Fraud Prevention Handbook outlines how to protect yourself from common types of fraud. It uncovers the strategies that scammers use and provides resources to help you defend yourself against their tricks. “Con artists often target immigrant communities because they are particularly vulnerable, but knowing how they work can help you spot and avoid scams,” said Daphne Kwok, AARP Vice President of Multicultural Leadership, Asian American and Pacific Islander Audience Strategy. “AARP launched the Fraud Watch Network to provide people with information about what makes them vulnerable and the tools they need to outsmart con artists before they strike.” Common scams include: An immigration scammer might place an advertisement in the newspaper or online offering to provide legal advice, help with paperwork, or other tasks involved in the immigration process. The scammer usually asks for an upfront fee, takes the money, and disappears immediately. Some scammers might use a natural disaster or current event to appeal to their target’s emo-
tions. Setting up a fake charity, they solicit generous contributions using standard methods to collect “donations.” Blessing scams appeal to people’s superstitious beliefs. They first appeared in China and have seen a rise in the United States in recent years. Posing as a fortune-teller, the scammer will say that he or she can sense a curse on the target or a member of the target’s family. Most telemarketing scams involve offering targets highly attractive deals like vacations, trial offers, loans, or subscriptions that end up having hidden fees. A scammer may pose as a charming salesperson, making small talk and claiming to work for a reputable company. A few steps to protect yourself against scams and identity theft include: Never give personal information, credit card numbers, or Social Security number to telemarketers who call you on the phone. If they pressure you, they could likely be a scammer. Double-check references for door-to-door sales, home repair offers and other products. Verify that businesses and others who contact you are who they claim to be before you provide any personal information. If you think the request for information is legitimate, contact
