MANILA, Dec. 19 (PNA) – Philippine National Police (PNP) chief Director General Ronald “Bato” Dela Rosa on Monday asked for forgiveness for those killed in the war on drugs. ”Kaya ang hinihingi ko sa inyo ipagdasal niyo kami na sana Lord patawarin niyo kami sa mga nangayyari ngayon (Hence, we are asking you to pray for us that the Lord will forgive us with what is happening now),” Dela Rosa said. Filipinos ‘OK’ with drug war

MANILA, Dec 20 (PNA) – President Rodrigo Duterte’s war on drugs continues to gain satisfaction from majority of Filipinos. Citing the latest findings from the Social Weather Stations (SWS), Presidential Communications Secretary Martin Andanar said the SWS 4th quarter survey found 85 percent of Filipinos is satisfied with the Duterte administration’s performance in its campaign against illegal drugs. Likewise, the same report showed a sizeable 88 percent of Filipinos saying there has been a decrease in drug problem in their areas since President Duterte took office

on June 30. “Clearly, the results of the survey showed that drug-related problems are becoming less among our people’s worries,” Andanar said.

De Lima: Much at stake’ by scrapping VFA By Azer N. Parrocha

MANILA, Dec 18 (PNA) – Amid threats of Pres. Rodrigo Duterte to scrap the country’s Visiting Forces Agreement (VFA) with the US, Sen. Leila de Lima on Sunday warned the President that there was so much at stake by doing so. “There is so much at stake here – the Filipino people’s lives, well-being, security and even our very sovereignty. I hope he doesn’t sacrifice those interests,” De Lima, a staunch critic of the President’s, said in a statement. The VFA, signed in 1998, is a bilateral agreement that allows US military and civilian personnel temporarily in the Philippines in connection with activities approved by the Philippine government. CHR revives team to probe Duterte’s claim of killing criminals MANILA, Dec 21 (Mabuhay) – The Commission on Human Rights (CHR) has “reconstituted” its team that would look into President Rodrigo Duterte’s claims that he “personally” killed criminals when he was still mayor of Davao City. “CHR has reconstituted a team to further investigate [and] look into the new revelations and public admissions that may shed light on our previous findings,” CHR chairperson Chito Gascon said. PHL now safe, crime rate is significantly down MANILA, Dec 19 (PNA) – “The Philippines is now safer from theft, carnapping, robbery, physical injury, and rape.” This is the statement of Presidential Communications Secretary Martin Andanar as the Philippine National Police (PNP) released figures showing index crime volume declined 25,673 to 55,391 in July-November 2016 period, from 81,064 a year ago. Citing the said PNP report, Andanar said index crime rate went down to 31.67 percent in July to November this year as compared to the same period

last year. Index crimes are defined by the PNP as crimes against persons (such as murder, homicide, physical injury, and rape) and crimes against property (like robbery, theft, carnapping, and cattle rustling). Data showed crimes against property posted a significant slide to 42.48 percent, while crimes against person dropped 12.25 percent. With barely two weeks left in year 2016, Philippine Air Lines (PAL) is set to claim another robust year into its storied corporate journey. Allan Q. Coo, PAL regional manager for North America, enumerated the headways that the Philippine flag carrier has achieved throughout the year 2016, chief of them: acquiring two more Boeing 777s. “The first one – RP7778 – was added to our fleet during the last week of October and just 2 days ago, we received our 8th 777 and will be ready to be added to our roster this December operating the trans-pacific routes,” Coo announced during the annual PAL Christmas party held at the Crowne Plaza Hotel in Los Angeles last December 16. Coo also announced the new PAL routes: Manila to Saipan, Taipei to Osaka, non-stop flight from Los Angeles to Cebu; the Singapore to Cebu route and Cebu to Caticlan and Cebu to Clark via Caticlan (started on December 16. The new local routes were meant to support the growth Cebu, which PAL consider as itssecond hub, according to Coo. “We have also strengthened our flight connections to and from Cebu to better serve our countrymen from Southern Philippines.” The airline executive as took pride in PAL’s twice daily, non-stop flight from Los Angeles to Manila that started last Thursday (Dec 8). “This gives our passengers a choice of leaving during the day or our regular evening flights. Both flights are operated by a Boeing 777,” Coo pointed out. In Canada, PAL recently added two “turnaround flights to Vancouver

(PR116/117) on Tuesdays and Thursdays. Toronto also received an additional flight to Manila on Saturdays which started last Saturday Dec 10. “This gives PAL 10 weekly NONSTOP flights from Vancouver to Manila and 4 times a week service from Toronto to Manila via Vancouver,” Coo added. Philippine Airlines is celebrating her 75thAnniversary. PAL’s new tagline “Heart of the Filipino” embodies its dedication to service and make Philippine Airlines a 5-Star carrier. “We are all looking forward to the New Year and years to come as we take on more deliveries, the Airbus 350s in 2018 and 12 Bombardier Q400s. DND to tailor equipment list to fit into Chinese 100-M yuan grant MANILA, Dec. 22 (PNA) – Department of National Defense (DND) Secretary Delfin Lorenzana said they are now tailoring the list of equipment which they intend to acquire under China’s one-time grant worth 100 million yuan. “We at the DND and Armed Forces of the Philippines are still preparing our list,” he added. “We do not know yet the quantities, but we are looking at fast boats, drones, night vision goggles, and communications equipment,” Lorenzana stressed. One hundred million yuan is worth USD14 million or around

PHP720 million. The grant was announced following the meeting of President Rodrigo Duterte with Chinese ambassador to the Philippines, Zhao Jianhua last Dec. 19 at the Malacañang Palace in Manila. The Chinese envoy conveyed that the grant is China’s support to the President’s war on illegal drugs and terrorism. The Chinese government also offered a low-interest long-term loan amounting to USD500 million. Lorenzana said the DND will study the offer vis-à-vis the current AFP Modernization Program.

The snatching incident took place

MANILA, Dec. 20 (PNA) – The Philippine peso touched the 50-level Tuesday and the local bourse was generally on the red as external environment continues to worry the markets. The local currency remained shy of closing the 50-level after it finished the trade at 49.99, same as the Nov. 20, 2009 finish, from 49.96 Monday. Bangko Sentral ng Pilipinas (BSP) Deputy Governor Diwa Guinigundo told reporters Tuesday that this level was not worrisome given the increased demand for the greenback. He traced the demand to several factors such as the end-of-the-year demand for dollars for debt servicing by the government and the corporates, higher dollar inflows, and concerns on the global economy due to concerns on the Federal Reserve

rates and its path and the economic and immigration policies of US president-elect Donald Trump. “We continue to see the same factors that drive negative market sentiment. But again we would always emphasize that the macroeconomic fundamentals remain strong,” he said. The central bank official said the current performance of the peso was due to its “episodic movements” and that the central bank, though concerned with the state of local currency, is focusing more on the impact of inflation on the exchange rate. He said there were some things that monetary officials considered before they could say that the movement of the peso concerns the central bank. “It concerns us but we just have to monitor and allow the exchange rate to move like it should be as our first line of defense,” he added.

China commits to provide 100-M yuan worth of military equipment to PHL: Lorenzana By Priam F. Nepomuceno

MANILA, Dec. 20 (PNA) – Department of National Defense (DND) Secretary Delfin Lorenzana on Tuesday announced that the People’s Republic of China has committed to provide 100 million yuan (equivalent to Php720 million) worth of equipment to the Philippines. He made this statement shortly after the gift-giving activity on Tuesday at the Armed Forces of the Philippines Medical Center in V. Luna, Quezon City. Lorenzana said the commitment was made by Chinese Ambassador to the Philippines Zhao Jianhua during a meeting with him and President Rodrigo Duterte Monday night. “They asked us what we need and they provided us with a equipment list and we will look into that to determine what type can we can. Their commitment is 100 million yuan which is equivalent to Php720 million and that only amount to US$ 14.4 million,� the DND chief said in Filipino. Lorenzana said the grant will

allow them to acquire small arms, speed boats or night-vision goggles. The DND chief said he is hopeful that the country will be able to finalize the Philippine request list before the end of this year. And by first quarter next year, a technical working group will be deployed to China to look into the equipment. Lorenzana is confident that the Chinese military equipment will be transferred by second quarter of 2017. Aside from these, China has also offered soft loans amounting to US$ 500 million for the acquisition of big-ticket military items. He added that they are still to discuss on what these items are. Lorenzana said these concessions were offered by China to help the country in its ongoing campaign against terrorism and the illegal drug menace. “(Ambassador Zhao Jianhua) told the President that he is well aware of our problems in terrorism and illegal drugs, and they want to help us,� he added.

He said the Philippines has its own bilateral agreement with China to ensure no further actions would raise tension in the disputed region. “We feel that this is necessary also as part of a confidence-building measure so that we can later on go back to the issue of our dispute in the West Philippine Sea, through peaceful resolution,� Yasay said. “Let them take whatever action is necessary in the pursuit of their national interest is concerned and we will leave it at that,� said Yasay who was referring to US and Japan. DFA spokesman and Assistant Secretary Charles Jose, last week said that Manila was verifying the report. If proven, he said it would be a “cause for serious concern because it tends to raise tension and undermine peace and stability in the region.�

All of you, except the criminals,� President Duterte said in his speech during the 81st Anniversary of the Armed Forces of the Philippines (AFP) at the Camp Crame in Quezon City.

President Duterte made the declaration following a consultation with religious leaders, well-meaning individuals and peace process officials. President Duterte also said he talked with National Democratic Front (NDF) chief political consultant Jose Maria Sison early Tuesday morning and they agreed to pursue peace process. “Now as agreed with some local and religious leaders, I will honestly and sincerely ask you for a ceasefire beginning Dec. 23 to 27 and then in New Year from Jan. 1 to 3 depending on the response of those who would like to embrace us as brothers,� the President said.

DOTr on Metro traffic: Modest improvements seen but there’s more to be done By Aerol B. Patena

MANILA, Dec. 20 (PNA) – Traffic congestion particularly in Metro Manila and other urban areas of the country has been a major concern for the public as it has caused inconvenience in travel and cost much time that could be better utilized for productive activities. Some motorists and commuters have observed that traffic congestion seems to happen in most parts of the metropolis and hope that the government will immediately address the situation. Thus, the Department of Transportation is committed on implementing short and long term projects and policies to improve the traffic situation and upgrade the state of transportation in the country. “There’s more to be done, but I think the DOTr has done all it could to improve the current traffic situation in Metro Manila”. The Duterte administration has formed the Inter-Agency Council on Traffic (I-ACT) as a sole authority that would implement schemes and policies on traffic management in the National Capital Region. One stop shop for OFWs opens in San Fernando City, La Union

MANILA, Dec. 20 (PNA) – A One-Stop-Shop Center (OSSSCO) for overseas Filipino workers was opened over the weekend at the Manna Mall in the City of San Fernando, La Union. The opening of the OSSSCO is in accordance with the directive of President Rodrigo Roa Duterte to ensure that all requirements needed by the public are housed in one location, for convenience. The establishment of OSSSCO in Region I was initiated by the Department of Labor and Employment (DOLE) Region I under the leadership of Regional Director Henry John S. Balbuena including DFA RCO La Union, POEA, OWWA, MARINA, PhilHealth, BI, NBI, TESDA, SSS, PRC, HDMF, NBI, CHED, among others. During the event, the awarding of NegoKart and starter kits to beneficiaries and awarding of Child Labor Free Barangay Certificates and Angel Tree kits were also held. At the end of the event, the representatives of said government agencies signed a Commitment of Partners on Advocacy on Overseas Filipinos Reintegration Network. The said government representatives also attended a session on the Organization of Migration and Development Sub-Committee which was held at the DFA RCO La Union Office.

219,617 OFWs benefit from DOLE-POEA’s MANILA, Dec. 21 (PNA) – Over 200,000 overseas Filipino workers (OFWs) including those who are still planning to work abroad have benefitted from the One-Stop Service Center for OFWs (OSSCO) initiated by theDepartment of Labor and Employment (DOLE) and the Philippine Overseas Employment Administration (POEA) In a statement, the DOLE said as of Dec. 7, OSSCO has already served 219,697 clients, majority of them came from the POEA OSSCO located at lobby of POEA Main Office in Mandaluyong City. A total of 6,222 clients have been served in region-based OSSCOs in Baguio, Pampanga Calamba City, Palawan, Cebu, Iloilo, Tacloban, Zamboanga, and Koronadal City. Launched in August, the OSSCO provides OFWs or those intending to work abroad with a range of accessible inter-agency services by putting in one location all government agencies that provide documentary services and other assistance to those who are currently working or planning to work overseas. The OSSCO in POEA Main Office had served the biggest number of clients with a total of 51,373 clients who availed of documentation of workers on leave or the

Balik-Manggagawa and inquired about OFW concerns. The Overseas Workers Welfare Administration (OWWA) catered to 39,611 clients who renew or apply for membership and inquire on other OFW-related concerns. Followed by the Home Development Mutual Fund (HDMF) after serving 28,808 people, who applied for Pag IBIG membership, loyalty card, STL, and provident benefit claim. A total of 29,288 Social Security System (SSS) clients that registered and amended their membership data, applied for benefit loan claim, verified their loan or contribution status, enrolled for their Unified Multi-purpose ID Card (UMID) and inquired about their other SSS concerns. The Philippine Health insurance Corporation (PhilHealth) recorded the fourth biggest number of people served at 22,174, who paid their PhilHealth contribution at the Centre, applied for or renewed their membership, and inquired about other Philhealth-related concerns. A total of 16,002 OFWs have availed of pre-processing of passport applications and inquired about other consular services at the Department of Foreign Affairs (DFA) booth.

Balikbayan box tax free up to Php150,000

MANILA, Dec. 20 (PNA) – A welcome news and fitting gift to the country’s Overseas Filipino Workers (OFW) this holiday season. Starting December 25, balikbayan boxes with values not exceeding Php150,000 will be exempted from paying duties and taxes. The good news was announced by Bureau of Customs spokesperson Col. Neil Anthony Estrella at a press briefing in Malacañan Tuesday. Bureau of Customs Administrative Order 05-2016 lifts taxes on balikbayan boxes for qualified Filipinos while abroad, including Filipino citizens who are residing abroad and Filipinos who are holders of student, investors, and tourist visas. To be covered by this ruling, balikbayan boxes shall contain personal and household effects only, and content should not be in commercial quantities or intended for sale. Also, the availment of this privilege is limited to a maximum of three times per calendar year. At the same press briefing, Estrella also announced the Bureau’s heightened alert against smuggling of goods in the country. “Customs Commissioner Nicanor Faeldon has issued a memorandum to remind all officials and

personnel to keep a tight watch on the entry of illegal finished firecrackers, fireworks, and other pyrotechnic devices in the country,” said Estrella. The only exemption which is allowed by law is the importation of ingredients used in manufacturing fireworks. Menwhile, Estrella announced that the Bureau of Customs has already collected Php19.947 billion which is 57 percent of the Php35.116 billion assessed target for the last month of the year. The Bureau expects to achieve a good revenue collection performance this month similar to November, when BOC exceeded its target revenue collection by more than Php3 billion. “Given this improvement, BOC is already at 93.3 percent of the Php409 billion assessed target for the whole year,” said Estrella. At the same press briefing, Presidential spokesperson Ernesto Abella said the President is very transparent when it comes to the state of his health. “The President’s health is very transparent. You know, like people ask should we have a medical bulletin? But I think he’s so transparent about himself,” Abella said. The President’s Spokesperson also said that despite his hectic schedule and long working hours, the President is in good health.

Duterte plays Santa to PSG MANILA, Dec. 20 (PNA) – President Rodrigo Duterte on Monday, Dec. 19, distributed cash gifts, bonuses and educational benefits to the members of the Presidential Security Group (PSG). Duterte gave the members of the PSG Christmas bonus of Php 5,000, combat pay, 14th month pay, and Php 5,000 from the Office of the President. NAIA Expressway Christmas Lane opens today MANILA, Dec. 21 (PNA) – The Department of Transportation (DOTr) and the Department of Public Works and Highways (DPWH) opened Wednesday a partial segment of the NAIA Expressway (NAIA-X) Christmas Lane which would provide access from Diosdado Macapagal Boulevard to NAIA Terminal 3 and Skyway. The NAIA-X Christmas Lane, which is the first phase of the project, is expected to reduce travel time by at least 40%, according to the DPWH. Construction is ongoing for its second section that would provide easier access to the South Luzon Expressway (SLEX).

“This will greatly help our public for the Christmas season as this will further improve traffic flow,” DOTr Sec. Arthur Tugade said as he led the final inspection and ceremonial opening of the expressway with DPWH Sec. Mark Villar. For his part, Sec. Villar expects that full access of the NAIA Expressway will be completed by the first quarter of 2017. The PHP 20.45-billion NAIA Expressway Project is a four-lane, 12.65-kilometer elevated expressway and 2.22-kilometer at-grade traversing Sales Avenue, Andrews Avenue, Paranaque River, MIAA Road and Diosdado Macapagal Blvd.

Lacson downplays UN call to probe Duterte MANILA, Dec. 21 (PNA) – Senator Panfilo “Ping” Lacson on Wednesday downplayed the call of United Nations (UN) High Commissioner for Human Rights Zeid Ra’ad Al Hussein to Philippine judicial authorities to probe the admission of Pres. Rodrigo Duterte that he had killed people when he was Mayor of Davao City. Lacson, in a statement, pointed out that the UN rights chief “is not familiar” with the Philippine Constitution and its laws. He noted that all Philippine presidents enjoy immunity from suit during his or her term and that there has yet to be proof of state-sponsored killings in the country. “First, our president enjoys immunity from suit during his term. A: If you cannot pay your bills, creditors will take steps to collect. That’s natural, but continued harassment can be emotionally depressing. If you have lost your job, or simply cannot cope, because debts have grown to the point where you have to choose who gets paid this month, and who doesn’t, then you need to consider the benefits of filing a bankruptcy. Q: Will a bankruptcy stop collection agencies from calling me? A: Yes, filing a bankruptcy protects you from creditor harassment, and provides peace of mind. Creditors will not contact you if you filed bankruptcy and have an attorney representing you. Otherwise they risk being cited for contempt of federal court, something they will not risk. Another reason to consider a bankruptcy now, even if you do not have assets to protect, is that after a bankruptcy, you can immediately begin the process of repairing your credit. This usually takes between 6 to 12 months, so an early start will get you there faster. Q: I have just received a summons from a creditor. Is it too late to file a bankruptcy? A: No. When you file for bankruptcy, an automatic stay goes into effect immediately stopping any lawsuit filed against you and any action against your property by a creditor, collection agency or government entity. This can be very important, Especially if you are at risk of being evicted or foreclosed on, being found in contempt for failure to pay child support or losing such basic resources as utility services, welfare or unemployment Here is how the bankruptcy filing affects some common emergencies: Utility disconnections. If you’re behind on a utility bill and the company is threatening to disconnect your water, electric, gas or telephone service, the automatic stay will prevent the disconnection for at least 20 days. Bankruptcy will also discharge the past due debts for utility service. Although the amount of a utility bill itself rarely justifies a bankruptcy filing, preventing electrical service cutoff might be justification enough. Q: Will filing a bankruptcy stop the foreclosure on my home? Five BeneďŹ ts of establishing a Revocable Living Trust

There is never the perfect time to think about who you would like to inherit from your estate in case you pass away or at least who among your closest friends (BFFs) and family members are even deserving of inheriting from your estate. In doing so, you should also think about which vehicle you plan to use in implementing your estate plan. One of the best vehicle in implementing your estate plan is a revocable living trust. Five major benefits of establishing a revocable living trust are: 1. Your estate can avoid the time, cost, and hassle of going through the probate court process. If you pass away without a will (intestate) in California, one of your close family would have to file a petition in probate court to probate your estate. Your estate will be divided and distributed according to the California probate code rules of intestate succession. Even if you have a will when you pass away, your family would still need to file a petition in probate court if your estate is worth over $150,000 and go through the probate process. This can become a circus if certain beneficiaries contest the validity of the Will or the distribution of the estate. Your estate will pay for attorney’s fees, probate referee fees, appraisers and other experts, CPA fees, etc. If people contest the case, your estate would end up paying legal fees to defend the estate in litigation. The entire process can take anywhere from 9 months to years depending on the contentiousness of the probate case. With a revocable living trust, your trustee or successor trustee if you were the initial trustee, would administer the trust and distribute the estate according to the trust

document without having to open a probate court case. If the trust is funded with all your assets, it is possible to administer and distribute the trust assets without any Court involvement at all. This process is a lot faster than going through probate. 2. Your estate is not public record When you file a probate case, the public has access to your probate case file. The public will know the assets of the estate including the values of those assets. If the Will is admitted into probate, the terms of the Will is open to public scrutiny. Establishing a revocable living trust makes your estate affairs private. Strangers do not have access to the terms of your living trust. Only certain beneficiaries and possible heirs can request a copy of the revocable living trust after you pass away. 3. You can dictate who will inherit from your estate. If you pass away without a Will, your estate will be divided and distributed in Probate Court following the rules of intestate succession in the California probate code. Certain relatives will be entitled to a share of your estate even if you feel they are not deserving. By establishing a revocable living trust, you can designate who you want to inherit from your estate. You can designate what and how much each one will received from your estate after you pass away. The assets distributed to

each beneficiaries does not have to be equal. The people you designate as beneficiaries of your living trust does not even have to be close family members. You can designate anyone as a beneficiary, with certain exceptions, of your estate. 4. You can structure your estate to minimize estate taxes If your estate is valued above the estate tax exemption, establishing a trust can allow you to divide up your estate into smaller sub trusts to minimize the overall estate tax effect on your estate. It allows you to set up a vehicle for certain charitable giving which carries tax advantage and asset protection. 5. You can choose who will administer your estate after your death When you establish a revocable trust, you can appoint someone else as trustee or you can appoint a successor trustee if you are the initial trustee. The trustee will be administering (managing) the trust after you pass away without a need to open a probate court case. This allows for continuity in operating the trust and the efficient and cost effective distribution of estate assets. If you are concerned about whether you can trust any family members as your trustee, you can appoint an institution as a professional trustee to carry out the terms of the declaration of trust. These type of trustee services are often offered by banks, financial institutions, wealth management firms, and business management firms for a reasonable fee. Dealing with debt: Are there other options besides bankruptcy? For people who are considering bankruptcy as a way to get out of debt, some questions constantly arise. Am I doing the right thing? What other options are available? If I decide to file bankruptcy, should I file now or do it later? Filing for bankruptcy is a serious decision to make. Unfortunately, a lot of people are hopelessly trapped in debt that it is their only chance of starting over. Most of them already have late payments, collections, judgments, etc. on their credit report. Some are in danger of getting their wages garnished, their bank accounts levied or their property and assets being taken. If you are in any of the above situations, filing bankruptcy may actually help you more than it can hurt you. It may be just what you need to turn your situation around and change your life for the better. In certain cases, there may be alternatives to filing bankruptcy.: 1. Settle with creditors- In some cases, depending on the nature of the debt and the amount owed, it may be possible to settle directly with creditors, often for less than full amount especially if you are offering a lump sum settlement. For example, my office regularly settles debts for 40-60% of the amount owed. Where the debtor doesn’t have the cash to settle, an installment plan may be arranged. Late penalty payments and interest may be waived. Bill collectors are aware that as time goes by, the ability to collect from the debtor diminishes. Often, the creditor will choose to take something now rather than wait forever to collect. 2. Review your monthly income and expenses- If you are living be-

yond your means, perhaps you can sit down and take a good look at exactly where your money is going every month and simply cut out unnecessary expenses. Review detailed information of your monthly income and monthly expenses to better understand your resources. I find that a lot of people don’t even know exactly how much they owe and how much they are paying to their creditors every month. This is unbelievable. If you need to cut expenses to the bone until you pay off your debts, then do it. Some people are so lazy to even look at their monthly budget that they often overlook expenses that can easily be eliminated without much sacrifice. 3. Do nothing (Well, at least for now) - I normally don’t recommend this option because if you do nothing, oftentimes your debt problems will only get worse over time. Sooner or later, you will need to face the music and deal with your creditors, so why not do it now? You can’t shun off from them forever. In some cases, however, where you have no income and no assets and you don’t expect this situation to change anytime soon, you may be considered “judgment proof”. What that means is that even if your creditors sue you and get a judgment, the judgment is worthless because it is uncollectible. Be aware, however, that if

your financial condition does improve in the future, then you may no longer be judgment-proof. More importantly, if bankruptcy is in fact your only way out, you are better off filing now while you still qualify. If you wait to file until later when your financial situation has improved, you may no longer qualify at that time and thus, you would have missed your only chance to get out of debt once and for all. 3 alien fugitives nabbed in Cebu MANILA, Dec. 19 (PNA) – The Bureau of Immigration (BI) nabbed three foreigners wanted for various crimes in their homelands in Cebu City. The fugitives were identified as Peter Alan Towle, 61, an American national and South Koreans Choi Ki Young, 42 and Han Dae Sung, 48. “All of them are now detained at our detention facility in Bicutan, Taguig while awaiting deportation to their countries where they will stand trial for their crimes,” BI Commissioner Jaime Morente said in a statement on Monday. They were collared in three separate operations conducted by operatives from the bureau’s fugitive search unit (FSU) last December 14. Towle, was arrested inside his unit at the MS Uptown Apartelle along Rahmann Street, Cebu City. The US embassy said that the American is a convicted pedophile who was ordered re-arrested by

a California court in 2013 for his failure to register as a sex offender. He was previously convicted on charges of engaging in lewd and lascivious acts with a child under 14 years of age. On the other hand, the 42-yearold Korean was collared inside his house along P. Burgos Street in Mandaue City. The Korean embassy said an arrest warrant was issued last Aug. 16 by a Korean district court for violating his country’s national sports promotion act. He is also the subject of an Interpol red notice. The other Korean arrested was nabbed inside the Ayala Center Mall in Cebu City. He is the subject of three arrest warrants due to a string of fraud cases that were filed against him.

Duterte makes pitch for Minda

MANILA, Dec. 20 (PNA) – President Rodrigo Duterte attended Go Negosyo’s Christmas Townhall with the President on Monday, Dec. 19, aimed at rallying support for development efforts in Sulu. In his message, the President reiterated his campaign pledge to fight corruption, drugs and criminality. On the economic side, the President said he wants to leave it to the economic managers to create the environment where businesses can thrive peacefully with the least intervention of government. Duterte said that during the election campaign, he was dismayed that no candidate talked about Mindanao. If Mindanao is not handled very carefully, the Philippines will end up being dismembered. The President told businessmen that he is negotiating with Nur Misuari and with the MILF. “I hope, I said that before the year ends, something concrete and positive will come out,” the President said. “And ito ang gusto kong sabihin sa bayan: You have to heed us people, guys from Mindanao because we are telling you the truth, you have to really transform this country.” The President renewed his initiative with business leaders to push for federalism in the country. The fact that the Muslims are willing to go federal means that they will accept control of the national government, he noted. In the spirit of Christmas, Go Negosyo through the KAPATID initiative started the Negosyo Para sa Kapayapaan sa Sulu: Christmas Town hall with the President. Sulu is part of the Autonomous Region in Muslim Mindanao (ARMM). It’s population of 824,731 is predominantly Muslim Tausug with 125,564 concentrated in the capital Jolo City. It is the base for the Moro National Liberation Front (MNLF) led by Misuari. However the military is largely pursuing the Abu Sayyaf Group in second district areas. Negosyo Para sa Kapayapaan in the province of Sulu is an initiative for the private sector to get involved in supplementing government efforts to establish peace and development in the area. Among the members of the private sector that committed for Sulu’s development were the Manuel V. Pangilinan group, which pledged development in telecom, hospitals, and coconut mill industry. San Miguel Corp. made a commitment to build a power plant and to reorganize Sulu’s school of arts and trade. It also promised to create a feed mill supply chain. The National Book Store also committed to provide school supplies for at least 100,000 school kids in Sulu, while the Department of Agriculture will provide tractors, farm implements and agricultural training. Other donors are Bounty Fresh Good, Inc., W Group, Kawad Kalinga, Lucio Tan Group, Kapatid Agri Group, and the federation of Filipino-Chinese businessmen.

Gov’t open to amending Constitution for peace: Sec. Jesus Dureza MANILA, Dec. 19 (PNA) – Presidential Adviser on the Peace Process Jesus Dureza has said that the government is open to amending or even rewriting the 1987 Constitution to address the root causes of armed rebel resistance to the government. “If you really look up what they (rebels) aspire for, you have to open up our Constitution to be able to accommodate them. That is the reality,” Dureza said in his remarks during the recent Konsult Mindanao Peace Conference in Davao City participated in by Lumad, Muslim and Christian leaders from across Mindanao. He noted that the existing Philippine Constitution has become a “stumbling block” in effectively negotiating peace with the National Democratic Front of the Philippines/ Communist Party of the Philippines-New People’s Army (NDFP/CPP-NPA), the Moro Islamic Liberation Front (MILF) and the Moro National Liberation Front (MNLF). “If you talk with the CPP and even the Bangsamoro (MILF, MNLF) they will never admit and agree that they will be circumscribed by a Constitution or by our laws,” Dureza said. He added that all agreements previously signed with the said major rebel forces made no reference to the Philippine Constitution.“We always refer to international laws and protocols,” he added. Dureza explained that, as government negotiators, they have to work within the “confines of the Constitution” in order to allow both parties to continue working on a final peace settlement despite their opposing views and ideologies. The head of the government peace process however said the desire of Philippine President Rodrigo Duterte to shift from bicameral and presidential form of government to parliamentary and federal will require constitutional reforms. It could also open up to other reforms in response to the strong clamor of the president for a more inclusive economic development strategy and direction. Dureza said the failure of Congress to pass

the Bangsamoro Basic Law can be attributed to some perceived unconstitutionality of some of the provisions of the proposed bill. Instead of refilling an improved version of BBL, Dureza said the contentious provisions of the BBL could be included in a proposed new charter. Amending or writing a new charter could also accelerate the peace negotiations with the NDF, Dureza further added. The government peace panel is set to leave for Rome, Italy on January 18-25 for the third round of talks with the NDF. Topping the agenda in the Rome round of talks are the social and economic reforms that the rebels are putting across the negotiating table. Negotiators from both sides are also expected to tackle and agree on the mechanics and guidelines for a bilateral ceasefire agreement and political and constitutional reforms. Meanwhile, Dureza underscored the need to further strengthen and expand the existing “peace tables” in order to make them more inclusive and ensure the success of the ongoing peace negotiations with various rebel groups. He pointed out that the peace or “negotiation tables” with the NDFP, MNLF and MILF are “very small tables as compared to the bigger peace table” which is the general public. “If you do not get the bigger public first to be informed of what is happening in the peace table[s], and if they don’t understand what we are doing, chances are they will reject what we agree on in [those] negotiations table,” Dureza stressed. The two-day event peace conference organized by the Bishops-Ulama Conference (BUC) and supported by OPAPP, aimed to, among others, revisit the recommendations made during the Mindanao-wide multi-sectoral BUC consultations in 2009 as inputs to the ongoing GPH peace negotiations and initiatives and expand a people’s platform for dialogue towards the understanding of historical and socio-political issues in Mindanao.

De Lima says blaming her won’t solve PHL drug problem MANILA, Dec 21 (Mabuhay) – Sen. Leila de Lima on Wednesday said pinning the blame on her over the proliferation of drug trade during her stint as Justice secretary will not solve the problem. In a statement, De Lima said such mindset is a “fantasy that the Duterte administration has been weaving,” adding that it is frightening that “high-ranking public figures” seem to believe it. She said the proliferation of illegal drugs in the Philippines is a systemic problem that “will not be solved by forming a lynch mob to gang up on a scapegoat.” “It’s saddening and frightening that even high-ranking public figures have swallowed hook, line and sinker the fantasy that the Duterte administration has been weaving: that a single person was single-handedly responsible for the proliferation of drugs in our country, and that it took place only over the course of my term as Secretary of Justice,” she said. “It is frightening because buying into that fallacy exposes us to the dangerously myopic oversimplification of the problem, which will prevent us from truly solving it because we can’t even admit that the problem is systemic,” she added. De Lima also said the problem “will not be solved by denying facts, including

Let me start my column my greeting Weekend Balita readers a Merry Christmas. Happy holidays also to my editor, Rhony Laigo, and his wife, Ruth and their kids, to Dong Camacho, our production manager, and his family as well as to my publisher, Luchie Allen her family. Speaking about Christmas, I found out that Christmas means “mass of Christ.” The word X’mas, which was first used in Europe in the 1500’s, is derived from the Greek alphabet in which X is the first letter of Jesus Christ’s name, which is “Xristos.” According to historians, the birth of Jesus Christ was estimated to be between 7 or 2 BC. The exact month or day Jesus was born are unknown and have not been the focus of attention of billions of people around the world every time they celebrate Christmas Day. life will continue and that there is hope to stay or remain positive that good things will happen. *** President Duterte’s war on drugs and terrorism got a big boost following the release by the Chinese government an initial grant of $14.4 million for the purchase of arms and equipment for the Philippine National Police (PNP) and the Armed Forces of the Philippines (AFP) The grant of $14.4 million could be part of the long term soft loans worth $500 billion that President Duterte got from China during his recent visit in Beijing. The Beijing government has publicly supported President Duterte’s war on drugs, terrorism and all forms of criminality, which has resulted in the death of 5,300 persons in less than 6 months. President Duterte should be credited for being able to secure the much needed financial assistance from China to modernize the antiquated arms and equipment of the PNP and AFP.

No wonder, our police and soldiers have always been outgunned by criminals and terrorists. That is exactly what happened in the “Masasapano massacre” in which 44 PNP commandos were slaughtered by heavily-armed Muslim terrorists. While we are thankful for the assistance the Chinese government has extended to us, President Duterte should be extra cautious of China’s extreme generosity to our country. The AFP should remain vigilant to prevent the Chinese from further fortifying their defense facilities in the disputed island located in the South China Sea. The Philippines and China have conflicting territorial claims in the South China Sea. Even Senator Panfilo Lacson, a Duterte ally, has expressed his apprehension about China’s extreme willingness to fund the President’s war on drugs and terrorism. Lacson, however, was quick to point out that his apprehension or pronouncements should not be misinterpreted as being against the government’s accommodation of assistance from China. Lacson has promised that an indepth analysis and thorough discussions among top national security advisers should be undertaken concerning major foreign policy matters. Lacson probably was concerned about possible implications that

might arise from the granting of the financial loans extended to the Philippine government. Hopefully, President Duterte will not give in to the Chinese government to give up our rights to the disputed island in the South China Sea. *** It is good that controversial Senator Leila De Lima, the suspected drug queen of the Philippines, is now back in the country. If she is really innocent of all the charges leveled against her, she should now answer them point by point instead of just denying everything and claiming that she is just a victim of political persecution under the Duterte administration. De Lima was implicated by Ronnie Dayan, (De Lima’s lover/bodyguard/ driver) and other high profile drug inmates at the National Bilibid Prison (NBP) as being the recipient of drug money’s and even organized the operation to raise money through the sale of illegal drugs to fund her senatorial candidacy. Now that formal charges have already been filed against her, De Lima will now have opportunity to cross examine all her accusers to find out who are telling the truth. I hope too that the Senate Ethics Committee, headed by Senator Tito Sotto will convene early next year to deliberate on the ethics complaint filed against De Lima by the Lower House.

This is no doubt it is in direct correlation to Trump’s victory. Statistics already indicate that families and skilled applicants in the USA (with or without legal status) are applying at record numbers to Canada. The fact that a person has no status in the USA or lost status in the past is not a ban to applying for Canada. For many, the “Plan B” (immigrating to Canada ) is no longer the second choice but is now “Plan A”. Those from the USA have an indirect advantage over others. In particular, applicants from the USA are more likely to have a strong proficiency in English – one factor Canada looks at. As well, most applicants in the USA have at least one or two college diplomas. Again, a strong factor Canada values under their current immigration selection program. Work experience and age are other

2017 national housing forecast, according to Realtor.com The 2017 national real estate market is predicted to slow compared to the last two years, across the majority of economic indicators. Home prices are anticipated to increase 3.9 percent and existing home sales are forecasted to increase 1.9 percent to 5.46 million homes. Interest rates are expected to reach 4.5 percent due to higher expectations for inflationary pressure in the year ahead. Mortgage rates have hit a high of over 4% for conforming limits and is due for more hikes in the coming months. That has slow down the purchase market and unqualified some first time buyers knocking them off the park in terms of affordability. Prior to this month’s election, demographics and an improving economy were laying the foundation for a substantial increase in first-time buyers in 2017, but due to mortgage rate increases over the last few weeks realtor.com predicts first timers will face new hurdles as they navigate the qualification and buying process. These higher rates are associated with anticipation of stronger economic and wage growth next year, both of which favor buyers. However, higher rates will make qualifying for a mortgage and finding affordable inventory more challenging. “We don’t expect the outcome of the election to have a direct impact on the health of the housing market or economy as we close out 2016. However, the 40 basis points increase in rates in the days following the election has caused us to increase our interest rate prediction for next year,” said Jonathan Smoke, chief economist for realtor.com®. “With more than 95 percent of first-time home buyers dependent on financing their home purchase, and a majority

Yearender: House ends 2016 on productive note By Filane Mikee Cervantes

MANILA, Dec. 19 (PNA) – This year saw the House of Representatives (HoR) set the bar high for congressional productivity with a total of 63 measures approved in only 56 session days during the first six months of the 17th Congress. The lower chamber under the leadership of Speaker Pantaleon Alvarez has been faring well on the legislative end, processing an average of six measures per session day. “So far, so good,” Alvarez said as he summed up the collective performance of the HoR in its initial stage of legislative work. The House processed a total of 321 measures, broken down as follows: 63 measures passed; 201 referred resolutions on inquiries; 53 measures substituted/consolidated; and four measures in the Calendar of Business. Moreover, the House produced 46 committee reports. As for the 63 approved measures, there were 18 bills passed on third and final reading; 11 bills approved on second reading; one enacted law; one ratified bicameral conference committee report; and 32 adopted resolutions. The only bill enacted into law is Republic Act 10923, deferring the barangay and Sangguniang Kabataan elections from October 31, 2016, to October 21, 2017. Alvarez also highlighted the passage of House Bill 3408 or the 2017 General Appropriations Bill (GAB) as early as Oct. 19, 2016, and both chambers subsequently ratifying

the bicameral conference report last December 13, thus effectively making budget re-enactment a thing of the past. Majority Leader Rodolfo Fariñas noted that “for the first time in history, the roll call was conducted and the quorum was established every morning”, referring to the marathon hearing of the Duterte administration’s first budget bill. The GAB provides for a PHP3.35 trillion national budget for next year. According to President Rodrigo Duterte, the 2017 national budget embodies the people’s clamor for real change and a compassionate government. The budget bill, however, faced a standstill during the bicam conference over the PHP8.3 billion allocation for development projects in the Autonomous Region in Muslim Mindanao (ARMM). The House contingent eventually accepted the Senate’s position to allocate the PHP8.3 billion to the Commission on Higher Education (CHED to finance free tuition for students in all State Universities and Colleges (SUCs) and additional funds for incentives and grants. Of the 18 bills approved on third reading, nine are of local significance while nine others are of national significance. One of the controversial measures heatedly debated upon before its final approval was House Bill No. 4144, which seeks to retain the two-tier excise tax system on tobaccos instead of the unitary rate.

Seniors want bankruptcy relief for $100k credit cards: Chapter 13 or chapter 7; best wishes to all readers for Christmas! Husband and wife are both 66. They were my clients 15 years ago. I do not remember how much credit cards were discharged then but I do remember that their problem was too much credit cards. After they wiped out these cards in 2001, they were able to buy a house. They were also able to rebuild their credit scores pretty fast with timely payments on the house and car loans. As their credit scores improved came the avalanche of new credit cards that were offered to them. For a while, they had no difficulty paying for the new debts because both of them were still working. Don’t forget that 15 years ago, they were only 51. At 51, you don’t really think about getting older. But, time does not walk; it flies. All of you remember the day you left your country of origin. That could be 30 or 40 years ago. You left a young man or woman of 20. Now as you read this article, you are 50 or 60, probably with grandchildren. Where did all that time go? I don’t know, all I know is, time feels like it goes much faster here because we have to do everything ourselves so we are busy all the time. We have to clean the house, cook and pick up the kids ourselves, and we still have to work. We wake up early in the morning and we are just busy doing something the whole day until it’s time to sleep which is late at night. We look at our nice cars and beautiful houses, and we conclude that the American dream is truly worth it. At least, we have something to show for all our hard work. Our children also succeed. They go to college, become professionals, and make good money. So this is what the good life is all about. The problem is that we can’t really make time stand still, can we. If

we could, then we would all press the pause button so that we can enjoy this kind of life indefinitely. Let’s get back to clients, who I would say, did buy the American dream after their first bankruptcy in 2001. They now have a house with $170K of equity. They did not have a house in 2001. Well, that’s all good until they tell me that they have new credit card debt of $100K. Well, that’s not good, particularly for seniors at 66. You know you need at least $3K a month to pay for minimum interest on $100K of credit cards. $3K a month at 66 is a luxury that seniors at 66 normally do not have. In fact, $3K a month is a heavy burden for any person at any age to handle. I’m thinking there’s no problem with the house because at 66, the homestead exemption is $175K plus 6% cost of sale. The house is now worth $400K so 6% is another $24K to be added to the $175K homestead exemption. As a result, in a Chapter 7, clients will be able to keep their house. No problem. I ask them for their income. Wife has social security of $800. Husband has social security of $1800 and still works the same job that he had in 2001. This nets him $2500. They have household income of $5100. That’s not bad at all. They can easily pay the mortgage of $1700 so their house is not at risk. At $5100, they still qualify for Chapter 7 under the means test. There is no presumption of abuse. Looks like a clear-cut Chapter 7 case

to wipe out the $100K credit cards. But wait. I ask them how many cars they have and what kind of cars are these? They have a new accord that they just purchased with a car loan. And what else? They have two luxury cars, although older model cars that are both fully paid. The mileage on one of them is less than 40K and the other has mileage of 100K. Well, those are not a lot of mileage especially for one of them. Chapter 7 trustees are focused on luxury cars that are fully paid even older model ones. A luxury car, even one that is 8 years old with low mileage can still have a blue book value of $10K to $15K. The combined current value of the two luxury cars is at least $18K, less the car exemption of $3,500, exposing a non-exempt car value of $14,500. This means that in a Chapter 7, the trustee will take the two luxury cars and sell them, unless clients settle with the trustee so that he lets them keep both cars. The new car is not a problem because it has no equity. In the context of Chapter 7, to settle with the trustee means that clients will have to offer to buy back the luxury cars from the trustee for at least $10K to $12K in cash. Clients wince at the prospect of buying back their cars, which have been fully paid for some time. The painless way of dealing with this situation is to file a Chapter 13, not a Chapter 7. In Chapter 13, clients will pay the $14,500 non-exempt equity for the two luxury cards through a 60 months Chapter 13 plan. They get to keep their house and 3 cars. They only pay $250 a month for 60 months to the Chapter 13 trust. Out of the $100K that they owe, the plan allows them to pay 14.5% of the $100K card.

In other words, Chapter 13 will allow them to pay $14,500 over 60 months, no interest at the rate of $250 a month. After the 60th payment, the court will discharge $85,500 of their credit cards. So at the end of the 60th payment, they will owe nothing to the credit card companies. For $14,500, they get rid of $100K of debt! The debt relief provide by Chapter 13 is immediate because: instead of making $3000 of minimum monthly payments, under the plan, they only pay $250! That’s an immediate relief of $2,750 a month. In addition, after paying 60 payments of $250, they will owe zero to credit cards, whereas if they don’t have Chapter 13 relief, they will have to pay $180K for 5 years, and still owe the same $100K after five years! Chapter 13 is a super great deal for clients! I think this is the best Christmas gift that they can give themselves! We celebrate the birth of our Lord and Savior on Saturday! Termination of employment of government employees If you are employed by the state government or a state agency, your employment is considered a property right. It is very different from employment in the private sector, which is considered to be employment-at-will, unless there is a reason that makes it otherwise. The typical employment lawsuit in private companies relating to wrongful termination, discrimination, harassment, retaliation and others can still apply to state government employment. Thus, if you feel you were wrongfully discriminated against, you can still bring a claim against your employer. However, there is one aspect in the employment relationship between the state agency and the employee. This arises from the fact that, as stated above, the employee has a proprietary right to his/her employment. There is a procedure that has to be followed in the termination of the government employee. If a state employee is to be terminated, typically a Notice of Adverse Action (“NOAA�) is served on the employee. The NOAA specifies the actions of the employee that form the bases for the discipline. The NOAA will also specify the witnesses to such actions by the employee. The documents that will support the adverse action will also be laid out. The employee will be informed of the “adverse action,� which is termination. Before the employee is terminated, he/she is offered a Skelly hearing. In a Skelly hearing, the employee has an opportunity to present his side of the story. He can deny the accusations, or he can give justifications. The employee can present witnesses and documents at the Skelly hearing. If the Skelly hearing officer is convinced by the presentation of the employee, then the termination of employment will not be put in place. The employee retains his job. Oftentimes, however, the Skelly hearing officer will decide that the evidence presented to him justifies the termination of employment. In this case, the employee can decide to appeal the termination to the State Personnel Board.

The State Personnel Board (“SPB�) is an independent board that makes decisions on employer-employee disputes, primarily among them disputed terminations. Typically, the SPB to an Administrative Law Judge (“ALJ�). The ALJ conducts an evidentiary hearing, then forms an opinion which he submits to the SPB. The SPB then either adopts the ALJ decision, or sometimes, the SPB makes its own decision different from the recommendation of the ALJ. If the decision is unfavorable to the employee, the employee may decide t o seek a Writ of Mandamus from a superior court. I believe that it is oftentimes necessary and critical to have an attorney experienced in these matters help the employee. There are so many pitfalls that the employee need to hurdle: deadlines for doing tasks, procedures, presentation of the proper witnesses and documents, understanding various standards that apply to alleged wrongdoings, and others.
