NO US ARMS DEPOT DND says US will not be allowed to build military depots in PHL bases

MANILA, Jan. 31 (PNA) – The US will not be allowed to build any military depots in bases ear-marked for the Enhanced Defense Cooperation Agreement (EDCA) under the US. This was disclosed Tuesday by Department of National Defense (DND) public affairs office chief Arsenio Andolong in a message to the Philippine News Agency. “The Secretary of National Defense supports the President’s statements not (to) allow construction of military depots by the US,” he said. “We are reviewing the provisions of the EDCA on allowable infrastructures and ensure that the Presi-

US State Dept. makes public notice revoking visas for 7 Muslim-majority states WASHINGTON, Feb. 1 (PNA/Sputnik) – The US Department of Justice made public the details of the Department of State notice that implemented President Donald Trump’s executive order last Friday to revoke most visas from seven Muslim-majority nations. On Jan. 27, Trump signed an executive order “Protecting The Nation From Foreign Terrorist Entry Into The United States,” which suspends entry to the country for all nationals of Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen for 90 days. “I hereby provisionally revoke all valid non-immigrant and immigrant visas of

nationals of Iraq, Iran, Libya, Somalia, Sudan, Syria, and Yemen,” the notice, issued by Deputy Assistant Secretary of State for Consular Affairs Edward J. Ramotowski stated. It was made public on Tuesday. Also on Tuesday, DHS officials said holders of US green cards had been exempted from the revocation order, the Washington newspaper Politico reported. The economy may have improved slightly, but for the jobless, things have not changed very much at all. We are still experiencing continued corporate and government downsizing, which means there are still many more people suddenly losing their jobs, and can no longer meet the financial obligations incurred during more prosperous times. The first way to deal with debts is to communicate simply and honestly with creditors. Everyone knows the economic situation. Suing for money owed is as annoying and costly for the creditor as it is for the debtor. The key here is: Don’t make any promises you can’t keep and keep all promises that you make. We’ve seen some people write checks that they know will bounce, in their desperation to get an annoying bill-collector off their backs. A bounced check is a broken promise. It can subject you to criminal prosecution and will almost always make that creditor harder to deal with in future. Constant harassment by collection agencies is another problem faced by those in financial trouble. State and federal laws regulate the practices of debt collectors, and certain tactics are prohibited. When unfair tactics do take place, a letter from a lawyer is often enough to provide relief. If not, various legal remedies are available. When things have gone too far to work out with creditors, the Federal courts can offer protection under bankruptcy laws, designed to protect you, and give you a fresh start. There are several types of bankruptcy, each named after a chapter of the United States Bankruptcy Code. Of these, Chapters 7 and 13 are the two that most concern the consumer. Chapter 7 Chapter 7 is what most of us think of when we think of bankruptcy. In a Chapter 7 proceeding, all of your property which is not exempt by law is sold, and the proceeds are distributed to your creditors. At least that’s the theory. In practice, with the exemptions provided by law, and careful planning, an average middle class family would not give up anything at all. Their assets would be deemed exempt, and the creditors get nothing. The final result is that your debts are discharged, and you are permanently free of those obligations. However, there are some debts that cannot be discharged in a Chapter 7 proceeding. For example, education loans cannot be discharged unless one can show extreme hardship. Other non-dischargeable debts include damages from a willful tort claim, certain taxes, loans obtained through false financial statements, debts incurred through fraud, deception, or embezzlement, consumer debts of $1000.00or more, for luxury goods or services owed to a single creditor and incurred within 180 days before you filed your bankruptcy petition, cash advances of more than $1000 obtained within 180 days before you filed your petition, court-ordered fines and restitution, and personal injury debts caused by driving while intoxicated or taking drugs. In some cases, a creditor must file a special proceeding in the Bankruptcy Court to determine whether the debt is non-dischargeable. A creditor can also sue you to prevent the discharge of a debt if you transferred or concealed assets or refused to explain the loss of assets. Chapter 13 Chapter 13 is available for any individual with a steady income and debts which do not exceed $360,000 in unsecured debt and $1,081,000.00 in secured debt (“Secured debt� is when the creditor holds a mortgage or some other sort of lien on the property.). It allows you to submit a plan to pay off your debts, in whole or in part, over a period of three or five years. You don’t need a regular paycheck to qualify, but you must have income stable and regular enough to make payments under a plan. One advantage of Chapter 13 is that it allows you to keep your assets even if they are not exempt. This can be important if you own a lot of equity in a home. Another advantage is that, if you owe a debt jointly with someone else, such as a relative who co-signed a note for you, Chapter 13 will provide some protection for the other per-

son, while Chapter 7 will not. Some debts which could not be discharged under a Chapter 7 proceeding can be discharged after partial payments under a Chapter 13 plan. These include some types of educational loans, damages for willful torts, and some taxes. You may, at any time, voluntarily dismiss a Chapter 13 proceeding or convert it into a Chapter 7 proceeding. But if you dismiss it, your debts will not be discharged, and you will still owe the unpaid amounts. Chapters 11 and 12 Chapter 11 allows businesses and individuals to restructure large debts. It generally is used for people who want to restructure their debts but have more assets or debts than the limits for a Chapter 13 case. Creditors vote on whether to accept or reject a plan, which must also be approved by the court. Its provisions are quite complicated and generally require the assistance of an attorney familiar with Chapter 11 proceedings. Chapter 12, enacted during the 1980s, is a special form of debt work- out for family farmers. In many ways, it is similar to Chapter 13, but eligibility is limited to people whose income derives primarily from a family- owned farm. Automatic Stay When you file a bankruptcy case, an Automatic Stay takes effect immediately on all collection efforts by all creditors. Evictions, foreclosures, repossessions, lawsuits, annoying telephone calls all must stop, and any creditor who refuses to comply can be held in contempt of the Bankruptcy Court. If you hear from any creditors, we can generally get them to back off by writing them a letter informing them of your bankruptcy filing. Secured creditors can ask the Bankruptcy Court for permission to continue collection actions against you. A motion for relief from the Automatic Stay is heard and decided by the Bankruptcy Judge. Chapter 13 not only provides an automatic stay for you, but if you owe a debt jointly with someone else (such as a relative who co-signed a note), it provides a stay for the co-debtor as well. Bankruptcy Petition For any bankruptcy case, you must file a complete schedule of your assets, liabilities, income, and expenditures and answer a questionnaire about your financial affairs. The most daunting aspect of filing a bankruptcy case is the need to compile a thorough and accurate list of this information. The success of a bankruptcy proceeding depends on the accuracy and completeness of the petition. You will also find, that many questions on the form don’t apply to you, and can be answered with a simple “NA� or “None.� If you are filing a Chapter 13 case, we must also propose a plan for a partial or full repayment of your debts. Any Secured and Priority debts must be re-paid in full. Unsecured debts can be paid partially. The Plan must also provide for a required fee to the Chapter 13 Trustee. DepEd to continue K-12 curriculum with IP communities By Juzel L. Danganan

MANILA, Jan. 31 (PNA) – The Education Department said it will continue its K-12 curriculum with indigenous people communities through the IP Education Program (IPEd). According to a statement from the department, the move aims to sustain dialogues and collaboration with IP elders and other community representatives to ensure education programs are inclusive, culture-sensitive and relevant to the aspirations of the IP community. The department said the regions were rolling out the initiative to prepare indigenous lesson plans, which starts with elementary levels, support capacity building activities,

consultative and curriculum development workshops with key IP elders. It noted 7,767 public school teachers and school heads had undergone basic retooling on IPEd. Last Jan. 18, Education Secretary Leonor Magtolis-Briones also signed the multi-year implementing guidelines on the allocation and utilization of the indigenous peoples education program support fund. It will provide for the following areas: Cordillera Administrative Region, Region 2, Region 3, Region IV-A, MIMAROPA, V, VI, VII, Negros Island Region, VIII, IX, X, XI, XII and CARAGA. MANILA, Feb. 1 (PNA) – The Metropolitan Manila Development Authority (MMDA) will allot an additional lane for trucks along C-5 from midnight to 4a.m. within the month. MMDA General Manager Thomas Orbos said the measure seeks to facilitate faster transport of delivery trucks in the whole stretch of C-5 which has experienced a significant increase in the volume of trucks passing through during truck hours. The decision was made after a meeting with the Confederation of Truckers Association of the Philippines (CTAP). Officials of CTAP led by Alberto Suansing said there is a need for another truck lane along C-5 as the existing lane has been heavily

congested causing delay in the delivery of goods. MMDA and CTAP have also agreed on the following initiatives: CTAP shall provide their own crane during road emergencies; conduct of meeting with container yard operators; hold a dialogue with ICTSI to review the Terminal Appointment Booking system; MMDA will provide CTAP a list of accredited towing companies and matrix of towing fees and conduct of an ocular inspection along R-10 and Mindanao Avenue within the month. Orbos reiterated that at no time during the day will trucks be allowed to park on any part of C-5 and that private vehicles are allowed to use the truck lane during truck ban hours or 6a.m. to 10a.m. and 5p.m. to 10p.m. except Sundays and holidays.

No additional FA-50PHs orders for now – DND MANILA, Feb. 1 (PNA News Feature) – Pending the arrival of new security threats, there are no plans so far to acquire additional units of the Korea Aerospace Industries (KAI)-made FA-50PH “Fighting Eagle,” of which four units are now in service and another eight expected to arrive this year. This was disclosed by Defense Secretary Delfin Lorenzana Tuesday when asked on whether they have plans to acquire additional units of the Mach 1.5 capable jet fighters for the Philippine Air Force (PAF). “(There are) no plans to get more that the 12 we ordered. Four are already delivered (as of this posting), the other eight will be delivered this year,” he added in a message to the PNA. During the time of then Defense Secretary Voltaire Gazmin, a study was made on the feasibility to acquire additional six FA-50PHs units to further secure the country’s airspace. With Lorenzana’s statement, it seems that the PAF will have to content with the 12 FA-50PHs until Horizon 2 of the Armed Forces of the Philippines Modernization Program, which is to start this 2018 and end on 2022, before they can acquire more advance and sophisticated jet aircraft. The FA-50PHs landed recently landed in the headlines after it participated during a surgical air and artillery strike that severely wounded Abu Sayyaf commander Isnilon Hapilon and seven others aside from killing an estimated 15 terrorists during a military offensive in Butig, Lanao Del Sur last Jan. 26. It was the first combat mission for the above-mentioned aircraft, military leaders said.

MANILA, Feb. 1 (PNA) – The decision of the New People’s Army (NPA) to lift the unilateral ceasefire, which will end noon of Feb. 10, will have no effect on the military. This was stressed by Department of National Defense (DND) Secretary Delfin Lorenzana in a message Wednesday. “If the CPP-NPA (Communist Party of the Philippines-New People’s Army) will terminate or stop their unilateral ceasefire it is up to them. It will not affect the AFP (Armed Forces of the Philippines), anyway despite their declared ceasefire they have not stopped extorting under the guise of their so-called revolutionary taxation, went on recruiting, burning buses and equipment, ambushing and kidnapping soldiers,� he added.

Pending instructions from President Rodrigo Duterte, Lorenzana said the DND will continue to enforce the government unilateral ceasefire. “Our troops will not actively operate against the NPA while our ceasefire is in effect. However, it will continue to maintain peace and order and run after lawless elements whoever they are. We do not recognize any areas under NPA control nor are they allowed to roam around with their firearms intimidating people,� Lorenzana stressed. “The August 28, 2016 unilateral declaration of interim ceasefire issued by the Central Committee of the CPP (CPP-CC) and the National Operations Command of the New People’s Army (NPA-NOC) is hereby terminated,� NPA spokesperson Ka

LEDAC members agree to meet ‘more regularly’ MANILA, Jan. 31 (PNA) – Members of the Legislative-Executive Development Advisory Council (LEDAC) have agreed to meet once in every quarter to hasten passage of priority bills, a Palace official said on Tuesday. “In the past administration, I think it (LEDAC) meets only twice. But this time it’s going to be more regularly. MANILA, Jan. 31 (PNA) – Government troops, conducting relief and disaster response operations in flood-battered CARAGA and Northern Mindanao, were subjected to a series of unprovoked rebel attacks Monday. This was disclosed by 4th Infantry Division public affairs office chief Capt. Joe Patrick Martinez in a statement Tuesday. This includes a New People’s Army (NPA) rebels lobbing two hand grenades to troops undertaking relief operations thereat. “Fortunately, the said grenades which landed just a few meters from the evacuation center, did not explode. This could have caused undue casualties and further misery to the civilian flood victims thereat,� he added. Massive PNP crackdown shows Duterte’s resolve to also win war vs corruption, criminality By Cielito M. Reganit

MANILA, Jan. 31 (PNA) – A House leader on Tuesday said President Rodrigo Duterte’s decision to temporarily restrict the Philippine National Police (PNP) from conducting anti-drug operations to make way for a massive crackdown against police scalawags is a clear demonstration of the government’s resolve to win not just the war against drugs but also the war against corruption and criminality. House Appropriations Committee Chair and Davao City Rep. Karlo Alexei Nograles said “the President’s action only shows that he understands the breadth and depth of the corruption problem and he wants to place extra focus in the effort to cleanse the PNP of scalawags and misfits.� At the same time, he also disputed insinuations that President Duterte’s action is a manifestation that he has lost his confidence on PNP chief Director General Ronald Dela Rosa’s

London Mayor to urge global community to condemn Trump’s immigration order MOSCOW, Feb. 1 (PNA/Sputnik) – The Mayor of London, Sadiq Khan, is expected to urge the international community on Tuesday to condemn US President Donald Trump’s immigration order that bans citizens of seven Muslim-majority countries from entering the United States. UN hopes to see temporary US refugee ban ‘lifted as soon as possible’ UNITED NATIONS, Feb 1 (PNA/Xinhua) – The United Nations on Tuesday said that the world body hopes to see that the temporary US ban on the entry of refugees into the country “will be lifted as soon as possible.� “We hope it will be lifted as soon as possible,� UN spokesman Stephane Dujarric said at a daily news briefing here in response to a press question. Thousands of protesters rallied in front of the White House in Washington D.C. on Sunday while demonstrations continued across more than 30 American airports after US President Donald Trump signed an executive order temporarily barring all refugees and seven Mideast and North African countries’ citizens from entering the United States. Under the order, refugees from all over the world will be suspended US entry for 120 days while all immigration from so-called “countries with terrorism concerns� will be suspended for 90 days. MANILA, Feb. 1 (PNA) – The Department of Labor and Employment (DOLE) said it is up to an employee whether he/she will respond to work-related messages from their employers after office hours. Labor Secretary Silvestre Bello III noted that the “right to disconnect� or employees disregarding such is, technically, a voluntary engagement between employers and their employees. “Answering or ignoring texts, e-mails from employers after working hours is a voluntary engagement of an employee, and they are not obliged to respond. The right to disconnect is a choice of an employee,� he said in a statement. Bello believed that the proposed measure before the House of Representatives might ease burnout and

stress of the employees by drawing a clearer line between work and home. “Employees and employers know that there’s time for connection and so does a time for disconnection. It’s always up for the employees to oblige themselves to work even after office hours,� the DOLE chief added. But, he noted that completely disconnecting would not apply for certain jobs, and the employers must be the one to implement a policy in accordance with the standards of the labor code, which will benefit both parties. “It’s the employers’ own assessments and evaluations to reduce out-of-hours work. They either implement policy that will prevent their employees to work after office hours or compensate them for extra workload,� Bello added.

Exhilarating, four-hour animal adventure at the San Diego Zoo Safari Park Through the generous courtesy of this author’s son Michael, we all had an exhilarating, four-hour animal adventure at the 32-mile San Diego Zoo Safari Park on a lovely sunny day this past weekend. More known as the San Diego Wild Animal Park until 2010, the land area of the park is 1,800 acres, located in the San Pasqual area of San Diego County, California, near the City of Escondido. Though it it is located within the San Diego County city limits, it has an Escondido address. It is one of the largest tourist attractions in San Diego County, which houses a wide selection of wild and endangered animals, including numerous species from various continents worldwide, such as Africa, Asia, Europe, North & South America, as well as Australia. Annually, the park is usually visited by around 2 million visitors and it houses over 2,600 animals, representing more than 300 species, along with around 3,500 plant species. It has the world’s largest veterinary hospital, and both the park and the San Diego Zoo are operated by the Zoological Society of San Diego. The park officially opened on May 10, 1972, and the general layout was designed by Charles Faust, according to the docent who initially walked with us from the main entrance. Further, she related to us that though the park was opened for three years from its groundbreaking, it literally took ten years to develop the whole park. The first two animals to arrive at the park were the Nilgai, an antelope from the plains of North India, and the black and white-striped Grant’s Zebra, which was a native of East Africa. In the summer of 2003, the San Diego Zoological Society and Lowry Park Zoo, orchestrated the capture

of eleven (11) wild African Elephants from the Hiane Royal National Park in Swaziland. However, due to animal disputes, on fencing and transport costs from Swaziland, only seven of the elephants are now housed at the San Diego Zoo Safari Park and all of us have watched and witnessed how these elephants enjoy playing with each other in their habitat setting. In the Hidden Jungle section, there is a climate-controlled indoor exhibit of tropical African birds, stick insects and arachnids, which apparently has been opened since 1993. Right next to this section is the Condor Ridge, which features thickbilled parrots, porcupines and desert tortoises. The Lion Camp, which opened in 2004, houses the park’s thirteen African Lions in a one-acre exhibit. One side of this exhibit is dominated by an artificial rock “kopje,” which has a 40-foot long glass-viewing window and heated rocks.The path through the Lion Camp continues through an acacia-studded ravine, which leads to a replica observation tent and a small viewing window. The next trail brings visitors to African Woods where there are vultures and cheetahs, separated by a central lagoon, where there are flamingos and monkeys. The exhilarating 30-minute ride on the Africa Tram tour brought all of us to see 200 acres of wildlife from different parts of Africa, roaming around

large enclosures, which replicate their natural habitat. Such amazing wildlife include: giraffes, mingling with gazelles, elephants and rhinos, while they gather at their watering hole. For the park visitors who wish to see the extensive botanical gardens, there is a tethered balloon ride from

Trump’s ban is essentially a racist Muslim ban Question: I have heard that Trump issued an executive order which bans Muslims. Can you clarify what is the executive order? Answer: The Executive Order essentially does the following: Suspends the refugee program for 120 days and suspends the Syrian refugee program indefinitely; Caps refugee resettlement numbers at 50,000 for FY 2017; Suspends immigrant and nonimmigrant entry for people from predominantly Muslim countries for a minimum of 90 days while the government undertakes a review of visa issuance and immigration benefits processes for nationals of Iraq, Iran, Libya, Somalia, Sudan, Syria, and Yemen Requires in-person interviews for nonimmigrant visa applicants; Establishes requirements for “extreme vetting�; Prioritizes refugees whose claims are based on religious persecution

but only if the person’s religion is a minority in their country of origin; Directs the Secretary of Homeland Security to expedite the completion of an entry-exit system. Question: What about refugees from Syria? This will just end? Were they not already ‘vetted’? Answer: Refugees are already required to go through an extremely rigorous vetting and security clearance process. These people are literally fleeing for their lives and the lives of their children. Shuttering our refugee program in a time of great need is the wrong thing to do. Rather than slamming

the door, we should be welcoming them and offering the protection which America has historically provided as the beacon of light to the world. President Trump makes it seem like these changes will be temporary by ‘suspending’ programs, but based on the positions he has taken and the stringent conditions imposed, the U.S. refugee program will be severely crippled. Question: It seems the executive order is really just a bar to the Muslim people. Is that true? Answer: This Executive Order is a thinly veiled effort to make good on the President’s promise to ban all Muslims from coming to the United States and to end our long, proud history as a leader in providing protection to those fleeing persecution. Discrimination is anathema to the principles upon which our nation was founded, is contrary to the principles of the Constitution, and has no place

US to send tanks this week to territories near Russia’s borders NEW YORK, Jan 31 (PNA/ItarTASS) – U.S. Army is sending its tanks this week to the countries locate along Russian borders in what appears to be the largest deployment of armor in East Europe since the end of the Cold War, the Wall Street Journal (WSJ) said on Monday. “After joint U.S.-Polish exercises in northern Poland on Monday, some of the M1A2 Abrams main battle tanks used in the drills will be transported to the Baltic states of Latvia, Estonia and Lithuania,� where they will remain until NATO puts into operation its ‘deterrent force’ sometime in spring. It quoted the head of a think tank called the European Leadership Network, Adam Thomson, a former U.K. ambassador to NATO, as saying the dispatching of U.S. troops and armor to Europe “shows the allies are implementing their decision to create a small force to better detect any Russian moves in the Baltics and to show Moscow that the alliance’s major powers stand behind its eastern members.� He said along with it the allies remained concerned over the “mixed

messages on NATO� sent by U.S. President Donald Trump and his advisors, who expressed full support to the North-Atlantic pact, on the one hand, and described it as “outmoded�, on the other. Trump “clearly has issues with the alliance,� Thomson said. “It is a new experience for NATO to be described as obsolete.� The WSJ recalled a U.S. Army unit known as the Iron Brigade the 3rd Brigade based in Colorado - arrived at the naval base in Bremerhaven, Germany, earlier this month “with about 3,500 soldiers, 144 Bradley fighting vehicles, 87 tanks and 18 Paladin artillery systems.� It will be deployed in Europe, with headquarters in Poland, for nine months, after which another unit will arrive to replace it. “During its deployment, elements of the brigade will also be sent to Hungary, Poland, Germany and Romania,� the WSJ said. The newspaper indicated the U.S. had also built up stocks of military hardware in Europe by increasing the number of helicopters and bringing in an additional force of 900 combat-support soldiers.

U.S. travel ban ‘not way to best protect’ America, other countries: UN chief

UNITED NATIONS, Feb. 2 (PNA/Xinhua) – UN Secretary-General Antonio Guterres said here Wednesday that the U.S. travel ban imposed on refugees and immigrants from seven countries “is not the way to best protect the U.S. or any other country,� voicing his hope that “this measure should be removed sooner, rather than later.� The secretary-general made the remarks in response to a press question as he was briefing reporters here on his travel to Ethiopia, where he attended an African Union summit. In the Ethiopian capital of Addis Ababa on Monday, Guterres commended African countries for opening their borders to refugees and people fleeing violence while other parts of the world, including the developed West, close boundaries and build walls. “In my opinion, this is not the way to best protect the U.S. or any other country in relation to the serious concerns that existed about the possibility of terrorist infiltration,� he said. “I don’t think this is the effective way to do so.� “What was lacking was a capacity to have a comprehensive approach to the problem,� he said of the U.S. ban, adding that it is very important to review “the very dramatic situations the refugees are facing when they have no chance to reach protection.�

Senior needs Chapter 13 relief for $24k credit cards Client is 65. She still works middle management and earns $37K yearly. Although she is married, I would say that she has some kind of money agreement with her beloved husband that arrangement works well for one side only, and that’s not her side. She herself owes $24K of credit cards. She needs to pay at least $800 a month of minimum interest payments to keep the $24K current every month. With her monthly gross of $3K, her net take home pay is $2500, more or less. From her net pay of $2500, she has to pay 100% of the mortgage of $1600, leaving her $900 for utilities, food and monthly necessities for both herself and her husband. Client feels overwhelmed by the burden of paying $900 a month for credit cards at her age of 65. Next year, she can retire and get full social security benefits. SS benefits of course will be about $1600 in her case, which is less than her current take home pay of $2500. If she still has to worry about $24K of credit cards next year, half her social security would have to go to card payments. This is not something she looks forward to, to say the least. Despair and depression would be a more accurate description of how she feels right now. I tell her not to feel so bad because truthfully, she owes her creditors money only, not her enjoyment of life! “WE HAVE STRENGTH FOR ALL THINGS IN CHRIST WHO EMPOWERS US – HE INFUSES US WITH INNER STRENGTH AND WE ARE SELF SUFFICIENT IN CHRIST’S SUFFICIENCY!� Philippians 4:13 I wanted to say this because client was so depressed and I could see her depression clearly on her face. Please, it’s not the end of life and of the world,as we know it. We all can rely on Jesus who will help us. So, cheer up! Together, we can solve this problem and get rid of this burden. For the husband’s part, he gives

her $1K a month as his share of all the household expenses plus the mortgage. And he doesn’t want to file bankruptcy even if he himself owes $40K of credit cards. Supposedly the $1K a month he gives her is half his take home pay. The other 50% he uses to pay his $40K of credit cards, which require at least $1200 a month of minimum payments. He’s still short $200. Perhaps he drives for UBER for the extra $200? Well, let’s just say the wall is about to break even if Mexico did pay for it. Even if POTUS used American-made cement and American citizen workers, the wall will still break under the load of too much credit card debt for this family. Can client file for bankruptcy herself to handle her $22K of credit cards? Yes. Non-filing husband will be left to his own resources to handle his $40K of credit cards. They have $230K of equity in their house. Her homestead exemption is $175K, so that still leaves $55K of non-exempt equity. This means that she cannot do a Chapter 7 to discharge the $24K. If she did Chapter 7, trustee would sell her house, give her $175K in cash then use the rest of the sale proceeds to pay off the $24K. Who wants to lose their house because of credit cards? Certainly not this client and none of my clients want to lose their house in a Chapter 7. She can, however, file for Chapter 13. In Chapter 13, she will pay $400 a month for 60 months. At the end of the plan, she will be fully paid, because there is no interest in Chapter 13, and the court will give her

PNP: Filing of complaint of robbery-extortion vs. Angeles cops welcome development MANILA, Jan. 31 (PNA) – The leadership of the Philippine National Police (PNP) on Tuesday termed as a “welcome development� the filing before the Criminal Investigation and Detection Group (CIDG) in Region 3 (Central Luzon) of a criminal complaint by one of the three South Korean nationals who were allegedly victimized of robbery-extortion perpetrated by seven policemen from Station 5 of the Angeles City PNP. �I have already directed the RD (Regional Director) of Region 3, that is why bumalik yung Koreano na complainant na isa dahil nakiusap yung RD natin doon na kung pwede bumalik sya para magkaroon ng linaw ang kaso at bibigat yung aming case against those erring policemen,� Dela Rosa said. �Yung 7 na involved sa Angeles City police. The development came following the directive of PNP chief Director General Ronald “Bato� Dela Rosa to PNP Region 3 Director Chief Supt. Aaron Aquino to coordinate with the South Korean embassy to ask the victims to return to the country and execute their respective statements. Dela Rosa believes now that there is a complainant, there is a basis to file the case against the seven policemen involved in the robbery-extortion incident. Aside from the Station 5 commander and six of his men, the chief of police of the Angeles City PNP was also relieved from his post because of command responsibility. Lee Ki Hoon, one of the three South Korean victims, on Tuesday filed the complaint before the CIDG Region 3. So, I hope client will feel a lot better now that there is light at the end of the tunnel. She can look forward to a good retirement with no credit cards to bother her. FORMERLY RICH SENIORS NEED CHAPTER 7 RELIEF The next clients are spouses who are both 64. They have a million dollar house, which unfortunately also has a million dollar mortgage. This mortgage was taken 10 years ago with nothing down and interest only for 10 years. The problem is two months from now, 10 years would have been reached and the interest only portion expires. When interest only portion expires, guess what, you have to start paying principal too. With principal payments, mortgage payment will double, from $3k to $6K. Time to let the house go. There is minimal equity. Clients have listed the house for sale for over a million with no offers. Just some dogs sniffing around, and stray cats looking for food. No serious buyers. As POTUS would tweet out “NOT NICE!� There is a second mortgage of $150K. And credit cards of $60K. If the house is not timely sold for the right price, the right price being, at least $1.15M, then eventually the first mortgage holder will foreclose. When that happens, they will not owe anything on the $1.0M first mortgage, but they will still owe the $150K, which

MANILA, Jan. 31 (PNA) – Another Filipino household service worker (HSW) died after she was allegedly beaten to death by her employer in Kuwait, the Department of Labor and Employment (DOLE) reported on Tuesday. Amy Capulong Santiago, 33, succumbed to suspected beatings when brought to the Farwaniya Hospital at around 10 p.m. on January 25. With this, Labor Secretary Silvestre Bello III has ordered the labor attaché in Kuwait to closely monitor the OFW’s case. “I am truly disheartened that such tragedies happen. The petition for the issuance of a writ of amparo petition seeks to protect the families of ‘Tokhang’ victims whose rights to life, liberty and security are violated or threatened from alleged harassment and intimidation by the police. Atty. Gleo Guerra, Assistant Chief of SC Public Information said the Court made the decision during their regular en banc, issuing the Writ of Amparo and also granted the urgent relief sought by petitioners and issued a temporary protection order (TPO) against anti-narcotics police officers. ”Issue a temporary protection order prohibiting the respondents and any of their agents from entering within a radius of one kilometer from the residence and work addresses of the petitioners,” the high court said. The SC order, however, applies only to the concerned police station not to the PNP in general.

Reforms in PNP will rid the force of rogue cops – Palace

MANILA, Feb. 1 (PNA) – Malacañang said on Wednesday that the reforms currently being implemented in the Philippine National Police (PNP) will eradicate the scalawags and criminals within the PNP. “Reforms in the PNP will rid the force of rogue cops,” Presidential Spokesman Ernesto Abella said in a press statement. Abella said the President’s directive to PNP chief Director General Ronald ‘Bato’ dela Rosa to abolish all anti-illegal drugs units in the PNP is proof of President Duterte’s “zero tolerance policy against corruption within the organization.” Abella reiterated that extrajudicial deaths that marred the President’s war on drugs are not sanctioned by the government. “This is also the conclusion of the Senate’s committees on justice and on public order and illegal drugs. Their joint investigation on deaths during police anti-drug operations shows there is no stated-sponsored policy of extrajudicial deaths,” Abella said. “There is relentless effort on the part of the PNP to carry out the campaign properly and within legal processes,” he added. In line with the President’s directive to abolish all PNP’s anti-drug units, Dela Rosa ordered also the suspension of the anti-drug Oplan Tokhang which is being used by rogue cops to pursue their own illegal activities. As of January 31 this year, the government’s war on drugs has resulted in the surrender of 1.1 million drug personalities; 53,025 arrests and 2,555 neutralized drug pushers and users. Earlier, Abella assured United Nations Special Rapporteur on Extrajudicial Killings Agnes Callamard that President Duterte will not tolerate as he ordered a thorough investigation. Callamard welcomed the suspension of Oplan Tokhang but said it must be coupled with an investigation of all the unlawful killings, accountability and reparation. “On Callamard’s remarks that the government should look into unlawful deaths, the President has clear directives that extrajudicial killings must be thoroughly investigated according to established internal procedures; the results of which will be made public in due time,” Abella said. “We acknowledge the statement of the UN Special Rapporteur Agnes Callamard. However, the war on drugs, as the President has said, continues until the last day of his administration,” he added. Abella said the Duterte government “does not condone extrajudicial killings perpetrated by common criminals which have been wrongly attributed in some unvetted reports as part of police operations.”

Zero killings following halt in drug war is a ‘commendable coincidence’

MANILA, Jan. 31 (PNA) -- A Senator on Tuesday said reports that no killings took place overnight after the Philippine National Police (PNP) suspended its campaign against illegal drugs was a “commendable coincidence.” Sen. Panfilo “Ping” Lacson made this remark on his Twitter account pointing out that an average of 10 to 11 people were killed daily while the war against drugs was still being implemented. “When (Oplan) Tokhang was active, we’re averaging 10 to 11 days overnight. I think it’s worth clarifying with them,” Lacson said. While only policemen should be following the order of Pres. Rodrigo Duterte to stop the crackdown against illegal drugs, Lacson said that it seemed like vigilantes also followed the order. “If there were zero killings overnight, let’s ask ourselves: Why does it seem like even vigilantes followed (the order)?” Lacson told reporters in an interview. Lacson, a former PNP chief, said that it “says a lot” about the PNP crackdown against illegal drugs.

He said that ironically, the PNP will have to explain why there were zero deaths this time instead of explaining why the death toll was increasing. The senator, however, said that it was better not to bring reports of zero killings into attention as it might makes matters “worse.” “If we call this to their attention, a person might die tonight. Damn if you do, damn if you don’t so it’s better not to talk about it. It’s good enough there people are not dying overnight,” he added. Lacson also said that the right way to carry out the crackdown against illegal drugs is with coordination with the Philippine Drug Enforcement Association (PDEA). Bello: CPP-NPA unilateral truce withdrawal an ‘unpleasant surprise’ MANILA, Feb. 1 (PNA) – The government’s chief peace negotiator on Wednesday said the decision of the Communist Party of the Philippines-New People’s Army (CPP-NPA) to terminate its interim ceasefire came as an ‘unpleasant surprise,’ coming just a week after the third round of peace talks in Rome. In a press briefing at the House of Representatives, Labor Secretary Silvestre Bello III said they were surprised with the turn of events since there was prior agreement between the government and the National Democratic Front (NDF) to meet again later in the month. The government and NDF panels met in Rome last January 19-25 which ended with both sides giving assurance that their separate unilateral ceasefire would hold pending their upcoming talks. “It was an unpleasant surprise since all the while, our scheduled meeting on February 2225 in the Netherlands is solely for the purpose of upgrading the existing separate ceasefires into that of a bilateral ceasefire,” Bello said. Earlier Wednesday, the Communist rebels said the unilateral ceasefire that they de-

clared last August 28, 2016 will be terminated effective February 10. Jorge “Ka Oris” Madlos, spokesman of the National Operations Command of the NPA, said the termination was due to the alleged non-compliance of the government in the release and amnesty of political prisoners and the alleged “encroachment of government on rebel territory.” The Armed Forces of the Philippines likewise accused the communist rebels of violating their own truce by staging attacks and extortion activities. However, Bello said the accusations from both sides has made it more imperative for the government and the NDF to hammer out a bilateral ceasefire agreement and said that he would advise President Rodrigo Duterte to continue with the ongoing talks. “These developments merely underscore the need to come out with a bilateral ceasefire agreement so that you will know when an act will constitute a hostile act or when an act will constitute a violation of the ceasefire agreement,” he said.

For the past few weeks, Aguirre has been claiming to the media that the arrest of Senator De Lima, dubbed as the country’s illegal drug queen lawyer-starved queen, is imminent with the filing of appropriate charges against her. But so far Aguirre has been unsuccessful in carrying out his arrest threats against the dubious De Lima. All Aguirre does is talk, talk and talk more. He should back up his threats against De Lima with action. As of now, De Lima is facing six criminal complaints lodged in the Department of Justice (DOJ) for her role as protector of illegal drug lords in the country during her stint as DOJ Chief. On top of that, De Lima was also accused of accumulating millions of pesos from illegal drugs trade at the NBP to finance her senatorial bid in the May 2016 national elections. Despite having millions of pesos to splurge to ensure her victory in the polls, De Lima placed last in the Senate magic circle 12. Aside from facing six criminal complaint, De Lima is also facing an election protest filed by former MMDA Chairman Francis Tolentino. The former MMDA official is claiming that De Lima is a beneficiary of a “dagdag-bawas” scheme done by the previous administration to enAsidethe victory of their allies in the polls. With the expected resolution of all criminal complaints against De Lima expected to be resolved within days, Aguirre is again claiming that the arrest is imminent. Well and good if it happens. It is about time that evil and corrupt government officials like De Lima is jailed. Maybe even better if the presiding judge will give De Lima the death penalty, once Congress restores the capital punishment. *** After three years of being a fugitive, former police senior superin-

tendent Glen Mancao finally gave himself up to police authorities. Mancao was also romantically involved with Senator De Lima and was implicated in the murder of public relations man Bobby Dacer and his driver, Emmanuel Corbito, in 2000. He and Senator Panfilo Lacson, then PNP Chief and former police superintendent Michael Ray Aquino, were implicated in the twin murder case. Lacson was eventually cleared by the Court of Appeals. Mancao, on the other hand, was not and has been arraigned by the court. Mancao can be convicted if there are glaring evidence that would warrant his conviction. The surrender of Mancao caught embattled Senator De Lima by surprise as well as shok. I will not be surprised if Mancao tells everyone what he knows about the “other life” of De Lima when they were both having sexual relationship. The surrender of Mancao might give Secretary Aguirre the much needed ammunition to eventually nail down the lying De Lima. Meanwhile, the sudden resignation of Anti Money Laundering Council (AMLA) head Julie Abad will also make it easier for Aguirre and the government to monitor and check the bank accounts of De Lima. Abad has been reluctant to give any specific details regarding the bank records or transactions regarding bank statements of De Lima’s accounts. The resigned AMLA executive director was handpicked by former President Noynoy Aquino to head the agency tasked to combat money laundering activities in the country. *** Better shape up or ship out. This could be what PNP Chief “Bato” de la Rosa is trying to impart to his men in the police force. It is really very hard to weed out all the corrupt cops in the entire police force. But General De La Rosa has to start getting his act together or he himself might be shipped out by President Duterte himself for

doing a lousy job as PNP Chief. General Bato should be firm and decisive in his decision to punish or suspend or even terminate from the service any cops involved for in criminal activities. If there is enough evidence against police superintendent Rafael Dumlao and police officer Ricky Sta Isabel in the kidnap-murder case of a Korean businessman, appropriate criminal charges should be filed right away as a deterrent to rogue cops from being involved in any nefarious activity. It is sad to know that the police, who are supposed to protect the citizens from criminals, are actually the ones committing the crimes. These rogue cops should be put in a firing squad once they are convicted of their crimes. *** The sale of illegal banned sub-

stances on the streets of Metro Manila and in some parts of the country is expected to resume following the recent dismantling of all police anti narcotics units. The units have been disbanded following the recent involvement of two police officers in kidnap for ransom activities which resulted in the death of a South Korean businessman. The disbanded units, however, will do an equally better job for the people and the country. These police officers will be tasked to gather data and monitor the activities of cops suspected to be involved in criminal activities. PNP Chief General De la Rosa said there will be no more drug operations for the time being. He, however did not say when the operations against illegal drug will resume.

MANILA, Feb. 1 (PNA) -- Office of Presidential Adviser on the Peace Process (OPAAP) Secretary Jesus Dureza on Wednesday advised President Rodrigo Duterte not to lift unilateral ceasefire with the communist groups. Dureza made this recommendation to the President after New People’s Army (NPA)’s spokesman Ka Oris announced on Wednesday that the rebel group is ending unilateral ceasefire effective February 10. “On the part of the Office of the Presidential Peace adviser, we respectfully recommend to President Rodrigo Duterte that the government continues to maintain and uphold the unilateral ceasefire to sustain peace in the communities where our people desire to live in peace,” Dureza said in a press statement. Dureza also recommended that government forces should continue to be relentless in their campaign to protect the civilians from harm and terrorism. The OPAPP official expressed dismay at NPA’s withdrawal but said “we respect their decision.” “This cancellation came just after some progress were made in the third round of peace talks in Rome where negotiating panels from both sides agreed to further discuss a bilateral ceasefire in The Netherlands sometime end of this month,” Dureza said. Caller: Hi Ken, I talk to you four to five years ago and you suggested that I hold to my underwater property then because I don’t have a choice. Since property values have gone up and I did benefit from the interest write offs, what should I do with my property? Ken Go: This caller reach out to me about 4 years ago about his rental property that was upside down in value. Since, they both make a decent income and they have excellent credit. I suggested they help on to their small condo that was already rented out. Back then they owe about close to $300K on a condo that was worth about $265-270K back then. It’s a older condo is a just ok location. They were ready to let the property go into either a foreclosure of a short sale. But I thought they would not benefit from the transaction and their credit would be ruined for the coming years. The negative on the rental was easily written off on their taxes which benefited them until now. They did raise the rental income and as of today, the value has gone up to about $350K. I suggested that if they really want to sell, now is the time, condo always goes up at the tail-end of the market appreciation. They will almost come out even after fixing and cleaning up the house to market for sale. I thought that my advice was on the money! Caller: I let a property that was a rental go into a short sale with a friend who is an agent two years ago, now I received a letter from a buying agent requesting for a cancellation of escrow and the earnest money deposit back with interest. I will provide you with all the info you need, but I have not been in touch with the agent nor the lender for over a year and don’t

know what is going on? Ken Go: I did look into the entire situation and it is a mess. The caller has a property that they entrusted to an acquaintance. The seller was busy with her multiple jobs and believed that the realtor friend was handling it and they would not have to worry about anything. After two years, the sellers received a cancellation notice from a buyer’s agent requesting for the earnest money deposit refunded. After researching all the Realtors involved and checking online sites for what is going on to the property. I found out that there was a fraud case reported against who is listing the property. The funny thing is the person listing the property is actually not the so called acquaintance realtor that the sellers originally entrusted to sell the house. Turns out there is a case against the realtor for money laundering case #H-40509LA with Bureau of Real Estate filled this year. The realtor/owner of an escrow company took earnest money deposit from his own escrow company and commingled funds and maybe embezzled. So, the FBI is currently investigating and hopefully soon prosecution. I even took time to drive the property and found out that there are people living there. Maybe someone is collecting rent without the sellers knowing. We are currently reporting this situation to the local authorities. As for the sellers, once we report and the property goes into foreclosure,

then we hope that the lender does not get her for deficiency judgement. Caller: Ken I took out a reverse mortgage for my house and my interest rate keeps going up and the supposedly payment I am not making is too high due to miscellaneous taxes and insurance. What can I do? Ken Go: I remind everyone that a Reverse Mortgage is not for everyone, that is why you have to really be the right fit for these types of loan. Let me explain first hand that if you take a reverse mortgage, Yes, you will not have any mortgage payments upfront, but the lender are still taking your interest portion of the amount owed from the back end. Meaning, your loan balance will go up every month due to interest charges you will owe the lender. For Some retirees, this is exactly what they want, no payments upfront, just take it out of my loan balance. But for most who is thinking about giving or passing the

property on to their heirs. You have to realize that on top of paying off the interest, there is an insurance called MIP ( mortgage insurance premium) that you have to pay every month that is about 1% of your loan balance or so taken out every year on a month basis. So, know your options before jumping into a reverse mortgage. I am recently getting more calls on homeowners that still never got caught up with the mortgage crisis, these callers are still not out of the problem yet and still are paying a large amount of money for their property because they cannot refinance it to a better terms. High cost keeps Californians away from the coast By Abner Galino

Californians, it turned out, are Californians. I mean, in as much as the world knows them to be – people who love the ocean and their beaches. And the numbers back this up: 90% of registered California voters said the condition of the ocean and beaches were important to them. But as much as Californians want to enjoy the vast California coast, they are somewhat prevented from doing so by the high cost of parking and overnight accommodations. These information and related issues came into fore during a forum organized by the New America Media (NAM) at Japanese American Cultural and Community Center in downtown Los Angeles. The meeting was attended by officers of state agencies and by environment and social justice advocates. Jon Christensen, adjunct assistant professor of the University of California Los Angeles (UCLA), presented a recent survey which showed that aside from the 90% of California voters who care about the ocean and beaches, a remarkable 57% rated it as a very important concern. The pollster, said Christensen, also found out that 62% of the same voters are concerned about limited access to the coastline. The respondents enumerated the problems as the lack of public transit to the beach, affordable parking and affordable overnight accommodations. According to the survey, 77% of voters visit the coast at least once a year. Of that total, 37% visit several times a year and 26% visit at least once a month or more. Researchers found that voters

under the age of 40, parents with children under age 18 and people living in counties along the ocean visit the coast more than others. Least likely to visit are African Americans, residents of the Central Valley and people age 65 or older. During the Powerpoint presentation, Christensen said researchers found out that an average day trip “had a total value of $36.74 with travel to the coast costing $22.09, not including expenses at the beach, leaving a surplus of $14.65.” The average overnight trip of four nights had a total value of $605.05, with travel costing $194.41, not including lodging, leaving a surplus of $410.64.” Effie Turnbull Sanders, vice chair of the California Coastal Commission, said their agency have done a lot in protecting and improving the condition of the ocean and the beaches through supervision and regulation. However, she added, the commission could only do so much as making the beaches more accessible to public would require a lot of support from local governments particularly in the areas of public transportation and making overnight accommodations affordable. The California Coastal Act of 1976 established the California Coastal Commission. The law gave the planning agency powers to protect the environment, oversee development, provide public access and manage marine resources along the 1,100 miles of coast. Guang-yu Wang, deputy director and senior scientist of the Santa Monica Restoration Commission, added that improving access to the beach is not limited to constructing pathways, parking spaces and providing public transport. He said creating

Massive fish kill hits Lake Sebu anew, state of calamity mulled GENERAL SANTOS CITY, Jan. 31 (PNA) – The municipal government of Lake Sebu in South Cotabato is planning to declare the area under the state of calamity due to another major fish kill that already destroyed around PHP6.5 million worth of tilapia. Zaldy Artacho, Lake Sebu municipal agriculture officer, said Tuesday the ongoing fish kill started late last week in portions of the lake after its dissolved oxygen dropped to critical levels anew. He said the phenomenon, known locally as “kamahong,” came after almost a week of sporadic heavy rains in the area. The official said several fish cage operators initially reported on Friday afternoon that some of their tilapia appeared gasping for air. “By night time, the fish kills already started in a number of fish cages,” he said in a radio interview. Citing their initial assessment, Artacho said a total of 72,335 kilos of tilapia have been destroyed as a result of the incident. The prevailing farm gate price for tilapia in Lake Sebu is PHP90 per kilo. Artacho said this figure only came from 19 affected fish cage operators in Barangays Poblacion and Takonel. He said the validation and assessment is presently ongoing for the other affected fish cage operators, which were earlier estimated at more than 300. Some operators were forced to conduct massive emergency harvests

over the weekend in their bid to save the remaining tilapia, he said. As a result of the incident, Artacho said Mayor Antonio Fungan ordered their office and the fish kill-hit barangays to prepare the necessary data for the declaration of a state of calamity. He said the mayor specifically directed the affected barangays to fast track their calamity declarations. Fishery officials had blamed the fish kills in Lake Sebu to the occurrence of “kamahong,” a phenomenon caused by the sudden rise in the water’s temperature. “Kamahong,” which usually occurs during the rainy season, triggers the rise of sulfuric acid in the lake’s waters that eventually caused the massive fish kill. The Office of the Provincial Agriculturist said the phenomenon occurs when cold rainwater, which is heavier than warm water, settles at the abyssal zone of the lake. It causes the upturn or upwelling of warm water carrying silts, sediments and gases such as hydrogen sulfide, ammonia, sulphur and methane gas produced by the decomposing organic matter such as fish feeds. Such situation results in the reduction of dissolved oxygen in the water, “forcing fishes to take in oxygen directly from the atmosphere and eventually die,” it said. Last year, the municipal government of Lake Sebu recorded at least eight fish kills that destroyed around PHP1.4 million worth of tilapia. The major fish kill in the area was in 2014.

Maricela Morales, executive director of the Central Coast Alliance United for a Sustainable Economy (CAUSE) raised the issue of “environmental racism” during her turn to speak. Arguing that coastal access was important to the physical and mental health of people, Morales noted that beaches on areas that were inhabited largely by affluent and white people were “preserved and respected” better than the beaches that were in areas inhabited largely by poor and colored people. Morales cited the case of Oxnard, sandwiched by the pristine beaches of Malibu and Montecito, where

three fossil-fuel power plants were operating. At the close of the forum, the resource speakers agreed that Californians should encourage legislators and local government executives to focus on the coast – for them to take actions that would make the beaches more inclusive, with more public transport options, with affordable parking fees and as well as with more low-cost overnight accommodations. The members of the panel also included Amy Hutzel, deputy executive officer of Coastal Conservancy and Thomas Wong, president of the board of directors of San Gabriel Valley Water District. The forum was hosted by Sandy Close, executive director of New America Media.

Australian-led scientists discover new bacteria that could change evolution theory SYDNEY, Feb. 2 (PNA/Xinhua) – Scientists at the University of Queensland in Australia announced on Thursday they have discovered a new bacterium that could change long thought to be certain theories on evolution. Regular convention dictates there are three domains of life; bacteria and archaea which are single cell organisms without a nucleus, and eukaroytes, which comprise of every other living creature, big and small. A particular bacterium has never fit the mould, ‘Gemmata obscuriglobus’ has been given the monniker of the platypus of microbiology, due to how it defies convention by having features that are inclusive of those found in eukaroytes. The discovery by the team led by Emeritus Professor John Fuerst, of ‘G. obscuriglobus’ having pore like structures in its membrane that are

similar to eukaryote pores, has Fuerst excited about the possibilities. This is a remarkable evolutionary finding, since most bacteria do not possess these structures, Fuerst said. Like the membrane-bounded nucleus, nuclear pore complexes had been thought to be restricted to eukaryotes. Fuerst says the discovery could be pivotal, as it would lead to a better understanding of how the first complex cells came into creation. The results are of evolutionary significance, since the origin of eukaroytes is a major event in lifes history, Fuerst said. Finding nuclear pore-like structures in the bacterial species ‘G. obscuriglobus’ is significant for understanding how the cell nucleus and the pores embedded in its membrane envelope could have evolved - a major unsolved problem in evolutionary cell biology.

MANILA, Jan. 31 (PNA) – “The Philippines is not included in the Trump ban.” This is the good news announced by the Department of Homeland Security of the United States through its spokeswoman Gillian Christiensen, which was relayed by the Migrant Heritage Commission (MHC), a non-profit run by Filipino immigrants based in the U.S., to this writer on Tuesday. “Please help us disseminate this information to our kababayan (citizens) Green Card holders in the U.S.A.,” MHC said in an e-mail signed by MHC Executive Directors Rev. Arnedo S Valera, Jesse A. Gatchalian, and Grace Divina Valera, MHC directors. US President Donald Trump has issued an Executive Order stopping refugee admission to the United States to protect the nation and Americans from terrorist attacks by foreign nationals admitted to the United States. However, MHC clarified that the Philippines is not included in the ban based on the official announcement by the Department of Homeland Security. MHC has been receiving queries about the refugee ban.“To all our Kababayans, who are Green Card Holders and currently on travel outside of US, our law firm and the Migrant Heritage Commission are receiving a number of phone calls and queries in the social media, including FB (Facebook) since yesterday on this

Trump yesterday signed a sweeping executive order to suspend the arrival of refugees and impose tough new controls on travelers from Iran, Iraq, Libya, Somalia, Syria and Yemen, as part of new measures to “keep radical Islamic terrorists” out of America. Condemning the move, Nadella, in a post on LinkedIn, said “As an immigrant and as a CEO, I’ve both experienced and seen the positive impact that immigration has on our company, for the country, and for the world. We will continue to advocate on this important topic,” Microsoft President Brad Smith said as many as 76 Microsoft employees are affected by this new executive order. “We appreciate that immigration issues are important to a great many people across Microsoft at a principled and even personal level, regardless of whether they personally are immigrants. Satya has spoken of this importance on many occasions, not just to Microsoft but to himself personally. He has done so publicly as well as in the private meetings that he and I have attended with government leaders,”

Smith said. “As a company, Microsoft believes in a strong and balanced high-skilled immigration system,” he said. Pichai also criticized Trump’s controversial immigration order saying it will create “barriers” to bringing great talent to the US. The Internet search giant also ordered its travelling staff to return to America. Pichai in an email to staff said the US ban on foreign nationals from seven Muslim-majority countries will hit nearly 200 Google employees. “It is painful to see the personal cost of this executive order on our colleagues. We’re upset about the impact of this order and any proposals that could impose restrictions on Googlers and their families, or that could create barriers to bringing great talent to the US,” Pichai said. Facebook CEO Mark Zuckerberg was one of the first to address the ban publicly. “We need to keep this country safe, but we should do that by focusing on people who actually pose a threat. Expanding the focus of law enforcement beyond people who are real threats would make all Americans less safe by diverting resources...,” he wrote on Facebook. Zuckerberg called for keeping doors open to refugees and those who need help. “That’s who we are. Had we turned away refugees a few decades ago, Priscilla’s family wouldn’t be here today,” he said. “My great grandparents came from Germany, Austria and Poland. Priscilla’s parents were refugees from China and Vietnam. The United States is a nation of immigrants, and we should be proud of that,” he asserted.

Caregiver Rights Update

2016 was a sensational year for caregiver rights. In January 2016, when California raised the minimum wage to $10 an hour, the minimum daily rate of pay for many 24hour caregivers was raised to $315. The calculation of the daily rate is as follows: Under the Domestic Worker Bill of Rights (DWBR) law, the first 9 hours of work must be paid at minimum wage (9 hours x $10 an hour = $90), and the next 15 hours of work must be paid at the overtime rate (15 hours x $15 an hour = $225) making the total daily rate due caregivers for 24-hours of work $315 in 2016. This wage increase, along with other changes to California’s labor laws that went into effect at the start of the year, truly set the stage for an eventful year in the world of caregiver law. To raise awareness of the plight of caregivers, who are all too often ignored, Kevin Rehwald, a partner at Chaleff Rehwald, wrote a 5000word article examining caregiver rights. The editors of the magazine were so impressed with Kevin’s work that he was asked to appear on the cover of the November issue of Los Angeles Lawyer, the magazine of the Los Angeles Bar Association. Gregorio Santillan, 69 Gregorio G. Santillan (Gregorio Santillan), 69, passed away peacefully in his sleep on January 26th,2017 at his home in Pasadena, surrounded by family (including Cynthia Gianzon Mehta, Jake Martinez) and friends. Greg had only recently been diagnosed with an extremely rare and aggressive cancer. Greg Santillan, known affectionately as Tatay by his kids and family, is survived by his wife Elvie Castillo Santillan, and his two adult children Andy and Lisa, and by his two brothers, Leandro Santillan and Tirso Santillan. Recently retired as a Chemistry Professor at Cal State Los Angeles, Greg never retired from being a husband, father, and grandfather to his three grandchildren, Dantes, Cybellia and Lily. Greg had a strong social consciousness, and had been involved in the Filipino Civil Rights movements of the 1970’s and 1980’s. Even afterwards, he gave selflessly to both the Philippines and the local community as one of its leaders.

Although he was professionally a teacher, he had a curious mind and was perpetually a student. He learned to speak and write in six languages, and constantly found ways to challenge himself. He was as physically active as he was mentally active. He was an avid bicyclist, backpacker, botanist, tinkerer- a true Renaissance Man. Tatay will be sorely missed by his family, friends, comrades, and anyone who had the good fortune to meet him.

The 2018 Legacy, the roomiest sedan in the midsize segment Cherry Hill, N.J. - Subaru of America, Inc., which posted its eighth consecutive year of record-breaking sales, today announced that it will debut the 2018 Legacy midsize sedan at the 2017 Chicago Auto Show on February 9th. The new Legacy features revised styling and significant upgrades to comfort, safety, and multimedia capability. In addition to major changes, myriad smaller engineering and design details throughout the 2018 Legacy enhance the driving experience. The 2018 Subaru Legacy will go on sale this summer. The 2018 Legacy, the roomiest sedan in the midsize segment, is available in a 2.5i model with an efficient and responsive 175-hp 2.5-liter 4-cylinder BOXER engine, or, as the Legacy 3.6R with a 256-hp 3.6-liter 6-cylinder BOXER engine. Both engines come teamed as standard with the Lineartronic CVT (continuously variable transmission) with manual mode and paddle shift control switches. A retuned ECU for 2018 provides the CVT with more responsive and smoother acceleration. The 2.5i will be available in standard, Premium, and Sport trims; Limited offers a choice of 2.5i or 3.6R engines. Subaru Symmetrical All-Wheel Drive and Active Torque Vectoring are standard in all trims, making the Legacy the only midsize sedan to feature all-wheel drive as standard on all models. Already an exemplar of passenger safety, the Legacy adds to its array of driver-assist features for 2018, including available new Steering Responsive Headlights (SRH). Available in conjunction with LED headlights, SRH aims the lights into turns as the driver steers. Also for 2018, Limited models with EyeSight utilize the systems’ cameras for High Beam Assist, which automatically turn the high beams on and off depending on traffic conditions. Sportier, Yet More Elegant Design The Legacy wears a sportier and more elegant look for 2018, highlighted by wider, lower grille openings and new bumper that complement the wider Subaru hexagonal grille, now with distinctive wing element. extending outward from the grille subtly suggest the piston motion of the BOXER engine, a Subaru core technology. The redesigned headlights now feature distinctive “Konoji” daytime LED running lights. Available LED fog lamps lend a sophisticated image. Other design details bolster the luxury-class appearance for the 2018 Legacy, including new high-contrast wheel designs and two rich new exterior colors, Magnetite Gray Metallic and Crimson Red Pearl. From the rear, the 2018 Legacy conveys a wider, more planted stance, although the car measures the same width as before. The new tailpipe design integrated into the lower fascia adds a premium touch. More Responsive and Quieter Subaru went through the Legacy chassis to make the 2018 model even more comfortable to drive, while also retuning its suspension to enhance agility and steering and brake feel. Retuned dampers reduce the initial impact of bumps while also reducing body roll through turns. Smoother, more linear response from the Electric Power Steering (EPS) and a firmer, more direct brake-pedal feel also make the Legacy more engaging to drive. Already lauded for its quiet ride, the Legacy moves another step up in cabin comfort for 2018 with further reductions from all noise sources. The Lineartronic CVT on 2.5-liter equipped cars now uses a quieter ultra-short-pitch chain, and adjustments to engine timing under acceleration further reduce powertrain noise. Reshaped exterior mirrors are among a number of enhancements that help reduce noise entering the cabin.
