Los Angeles, United States | AFP | Wednesday 2/17/2016 – US sports equipment giant Nike on Wednesday axed Manny Pacquiao after he described gay couples as “worse than animals”, slamming the Filipino boxer’s remarks as “abhorrent.” A Nike statement said the company had severed its ties with Pacquiao, who triggered a firestorm of controversy with his comments to a Filipino broadcaster earlier this week. “We find Manny Pacquiao’s comments abhorrent,” a Nike statement

Though it is a common enough word, what exactly does bankruptcy mean? And what are its implications? As is to be expected, filing for bankruptcy is a complicated process but before such a step is taken it is essential to understand exactly what it is all about. Simply put, bankruptcy can be defined as the legal process thorough which individuals or businesses in financial trouble are able to work out their debts and pay them out under the protection of the bankruptcy court. Often “liquidations” or “reorganizations” are the words that are used to sum up the process that unfolds when you file for bankruptcy. The two kinds of bankruptcy that you can file for are Chapter 7 and Chapter 13. There are various factors that would determine whether you should opt for Chapter 7 or Chapter 13. Through Chapter 7 Bankruptcy you liquidate all unsecured debt, providing any assets you may have are exempt under bankruptcy rules. Most people never lose anything, because they don’t have any non-exempt assets. In the event debtor is making too much money, they choose Chapter 13 Bankruptcy, which is the reorganization type of bankruptcy.

The debtor is allowed three to five years over which to pay back a portion of the debts, based on disposable income. Say that you have $100.00 in disposable income. You would have to pay that into a plan for 60 months. After 60 months, the balance of your debts would be discharged in full, even if they are far from being paid off. One should keep in mind that there are intricate details to this legal process that need to be taken into consideration before decisions are made to file for bankruptcy. Who qualifies? Which kind would apply to you? Will you be able to keep all of your property? There are many such questions that arise in such a situation. In this situation, you need to consult with an experienced bankruptcy law firm that can guide you through these complicated decisions and procedures. Filing for bankruptcy may not be the solution to all your financial problems though. In fact, bankruptcy does not cover all debts. For example, debts related to child and spouse support, or taxes are not covered in bankruptcy. Do you have a Co-signer? FILIPINO-Americans in Los Angeles, in an exemplary display of political maturity, set aside partisan politics and gave President Benigno Aquino III a rousing send-off at a Hilton hotel here near the Tom Bradley International Airport shortly before he flew back home on Wednesday night. President Aquino, who seemed unaware that the congregation before him was composed of people who belong to different political persuasions, gave a speech that briefly assailed corruption during the Marcos regime, took swipes at a presidential contender and a senatorial candidate and culminated in the endorsement of administration’s presidential bet Mar Roxas. Surprisingly, tension did not build up throughout the president’s speech despite the fact that many of those

present were prominent leaders of organizations campaigning for presidential and vice presidential candidates in the upcoming Philippine elections. Among those who were present were leaders of the Grace Poe for President Movement, Bongbong Marcos Movement and prominent supporters of Senator Francis Escudero. Expectedly, the supporters of Mar Roxas and Leni Robredo got the biggest slice of the political divide. The political leaders did not formally represent their respective organizations during the event. The president’s well-wishers also included some elected Filipino-American leaders, notably; Carson City Mayor pro tempore Elito Santarina and Cerritos Mayor Mark Pulido. Aquino said this in a media interview during his working visit to Los Angeles, California. President Aquino’s speech, which was almost entirely delivered in Filipino, and gamely laughed at his jokes and swipes at some political opponents of his administration. The speech was almost a miniState of the Nation Address (SONA) wherein he highlighted his administration’s achievements, which he said, included the supposed massive expansion of the Pantawid Pamilyang Pilipino Program (conditional cash transfer program), the strengthening of the Philippine Health Insurance Corporation (popularly known as Philhealth), the adoption of K-12 in public education, meeting the government’s deficit in school room construction, road and infrastructure projects all over the country, the continuing economic growth and burgeoning international reputation of the country as investors’ haven. President Aquino credited all these gains to his administration’s “Daang Matuwid” tenet. In the same speech, Aquino took a swipe at the Marcoses by talking about the building of azucareras in Mindanao by the cronies of the former dictator which used public funds. The behest loans, he said, were later paid for by the Filipino people. As Aquino explained to the audience why he vetoed the bill that would have increased the pension of Social Security System members, he took potshots at Vice President Jejomar Binay, a 2016 elections presidential candidate, and party-list Rep. Neri Colmenares, a senatorial candidate. “Hindi naman ako katulad ng dalawa diyan na gusto lang magpa-pogi,” Aquino said which drew laughter from the gallery. Increasing pensions for SSS retirees is one of Binay’s campaign promises. The bill that sought to achieve that was authored by Colmenares. The president said SSS would be driven to bankruptcy if he has signed the bill into law. The bill sought P2,000 pension hike. In passing, Aquino also took a swipe at Senator Bongbong Marcos who is supposedly photoshopping his pictures to hide his gray hairs from the public. “Ako po humaharap sa inyo ngayon, ipapadaya ko pa po ba sa photoshop ang buhok ko? Talaga naman pong kasama sa trabaho ang pagnipis niyan. Ang sa akin po, doon na lang ako sa totoo,” Aquino jested which also drew laughter from the crowd. Meanwhile, Carson City Mayor pro tempore Elito Santarina called President Aquino’s visit as a “big blessing.” He added that he thought that the Philippine president was able to

convince Filipino-Americans about the gains made by the Aquino administration. Santarina echoed Aquino’s call for unity amid differences in political affiliations. A leader of the Bongbong Marcos movement, Fernandico Gonong, also empathized with Aquino’s call for unity. “Ang pulitika parang relihiyon din ‘yan. Hindi ibig sabihin na magkaiba tayo ng pulitika o magkaiba tayo ng relihiyon ay magka-away na tayo. Pwede pa rin tayong magsama-sama na hindi na natin kailangan pag-usapan ang ating pulitika o relihiyon,” Gonong explained. Another community leader, Art Garcia, lamented that President Aquino failed to bring up to US President Barack Obama the issues of Filipino World War II veterans. Garcia’s sentiment was echoed WWII veteran Franco Arcebal who even attempted to speak with President Aquino after his speech but to no avail. Outside the Hilton hotel, people belonging to community organizations such Bayan and Gabriela braved the rain to protest the alleged human rights violation of the Aquino administration. They carried flags and placards and exhorted passersby and motorists to show approval to their demonstration. Singer and composer Noel Cabangon performed a solo concert as he entertained the Fil-Am audience while waiting for President Aquino. Prior to his speech, President Aquino conferred the Order of Sikatuna, with the rank of Grand Cross, to Philippine Ambassador to the US Jose Cuisia Jr. The Order of Sikatuna is an order of diplomatic merit given to individuals who have rendered exceptional and meritorious services to the Republic of the Philippines. Vitangcol links Roxas, Abaya, et al to MRT deal MANILA, Feb 18 (Mabuhay) – Former Metro Rail Transit 3 (MRT 3) General Manager Al Vitangcol is urging the Supreme Court to halt the proceedings before the Sandiganbayan against him on charges of graft over an allegedly anomalous $12 million maintenance deal for the rail system. In a 4-page motion filed with the SC, Vitangcol also urged the high court to implead the Sandiganbayan Third Division in his pending case before the high court, and admit as part of the records of the case an affidavit that contains a “full account of his knowledge and participation in all transactions concerning the [MRT 3],� dated February 15, 2016. “Petitioner hopes that this disclosure will help the honorable court arrive at a fair and impartial resolution of his motion for reconsideration (MR) and application for a [temporary restraining order] and injunction,� Vitangcol’s motion read. Vitangcol filed a petition before the high court on September 4, 2015 that sought the junking of his graft charge. The SC dismissed his petition on October 22 of the same year, causing Vitangcol to file an MR. The MR remains pending to this date. Vitangcol asked that the Sandiganbayan be impleaded in the case because he was already arraigned before the anti-graft court last January 21, 2016 despite his refusal to be arraigned.

“[T]he Sandiganbayan Third Division must also be temporarily, preliminarily and, after due proceedings, be permanently restrained/enjoined from proceeding with the preliminary conference, pre-trial and/or trial in the case,� the motion read. In his 23-page affidavit, Vitangcol lamented how he had been “singled-out by the Office of the Ombudsman in connection with the procurement of the interim maintenance services for the [MRT 3], a Project Management Office (PMO) under the Department of Transportation and Communications (DOTC).� “I am the only DOTC official charged by the Ombudsman despite the unmistakable knowledge, involvement, participation and instruction of my superiors in the DOTC headed by former Secretary Manuel ‘Mar’ A. Roxas II, current Secretary Joseph Emilio ‘Jun’ A. Abaya, Undersecretary for Legal Affairs Atty. Jose Perpetuo M. Lotilla and Undersecretary Rene K. Limcaoco, who should have been the ones brought to justice for gross and inexcusable inaction if not willful and deliberate manipulation of the events and processes related to the maintenance of MRT 3,� Vitangcol’s affidavit read. Vitangcol narrated that as early as December 10, 1997, the Metro Rail Transit Corporation (MRTC) entered into a Maintenance Agreement with Sumitomo Corporation (as maintenance provider).

Young client seeks Chapter 7 relief for $70K credit card debt Clients are spouses who own and run a business together. They own an S-corporation that has been in business for 20 years. They have 10 employees. An S-corporation, as distinguished from a C-corporation, is one where the profits of the business “flows through� to the 1040 of the individuals, unlike a C-corporation that pays its own income tax based on corporate profits. For instance, if the S-corporation business makes a net profit of $100K for 2015, that net profit is added to the gross income of the stockholders of the S-corporation. If you own 20% of that S-corporation, you will have to add $20K to your gross income for 2015 in addition to your income from all other sources. Whereas if that were a C-corporation, the corporation would pay income tax by itself on the $100K profit for 2015, and either keep the net profit after tax in the coffers of the corporation as retained earnings, or distribute the net profit to the stockholders, in which case, the profit distribution becomes a dividend to the stockholder which the stockholders declares as dividend income in his individual tax return. Other than this differentiation in the treatment of corporate profit, both S and C-corporations have all the same benefits that a corporation

provides. Both S and C corporations are legally separate entities from their stockholders. Liabilities of the S and C corporations and deemed liabilities of the corporations themselves and do not transfer to the individual stockholders. This is called the “corporate shield� given to stockholders. For all intents and purposes by law, the corporation is treated as a separate and distinct “legal person� from the individual stockholders. For example, Volkswagen was recently found cheating on emissions. The company programmed the computers in their diesel cars to act in a way that it appeared that emission standards were being complied with. In fact, they were not. In other words, Volkswagen, the corporation told a bold

face lie. When it was found out, there was a big scandal and its stock tanked. Massive penalties for fraud soon followed levied by the Feds in the billions. There were multiple lawsuits filed against Volkswagen. Buyers wanted to return what they bought. If you were a stockholder of Volkswagen, can you be sued for this corporate fraud with millions of victims worldwide? If you were a stockholder of Volkswagen, do you have to worry about being sued by the victims because you own shares in Volkswagen, certainly not. Because the fact that Volkswagen is a corporation means that the company is legally a separate and distinct entity from you as a shareholder. Therefore, you cannot be sued as a stockholder of Volkswagen for the corporate wrongdoing of the company. This is called ‘corporate legal fiction’ which is actually quite a brilliant idea that allows free enterprise to prosper. Without this ‘corporate shield and legal fiction’ people will be afraid to invest in businesses for fear of having their individual assets exposed to liability for anything that goes wrong with the corporation that causes damage In clients’ case, their business was doing well for 17 years. But the last 3 years was bad. Clients had to refinance their house to put in another $80K in the corporation to finance the loss of the last 3 years. Refinancing their house was actually making a bad situation worse. Why suck out the equity in your house causing you to pay a higher mortgage to keep a business that is hemorrhaging to keep it afloat? You’re letting the business loss drag your house down too. The corporation is supposed to be separate from your personal assets, but by refinancing your house, you combine the two together. In other words, if the business is sinking, why let your house sink with it too? You business can sink and die, that happens many, many times in the world of business. But to link your house to the business, that’s the same as getting a gun and shooting yourself in the leg. Clients’ S-corporation owes $120K of bank loans and suppliers credit, which it can no longer pay. Clients decided to discontinue the business because of mounting losses. I ask them if they want to continue the business with a Chapter 11 and perhaps get away without paying any of the $120K. They decide for a Chapter 7 because too much competition has made the future of the business very bleak. Will the S-corporation Chapter 7 affect the stockholders as individuals, of course it will not. The stockholders keep their good credit and everything else. They are not affected by the bankruptcy of the S-corporation, because after all, even an S-corporation is a legally separate and distinct entity under the law, therefore, it can file a bankruptcy by itself

without affecting the individual stockholders. YOUNG CLIENT SEEKS CHAPTER 7 RELIEF FOR $70K CREDIT CARDS Client is 33, and recently married. He also dabbled into business, using his credit cards to fund the business. The business never turned a profit. He maxed out his credit cards at $70K. PHL’s transformation highlighted by Aquino in Los Angeles World Affairs Council LOS ANGELES, CA – President Benigno S. Aquino III, in his address to the Los Angeles World Affairs Council (LAWAC) on Tuesday, 16 February, highlighted the Philippines’ transformation into a nation that is able and willing to be more involved in international affairs. In the forum entitled, “The Philippines and Security in East Asia,” the President asserted that the Administration’s reforms, such as the introduction of the zero-budgeting system, expansion of health insurance coverage, strengthening of technical and vocational education, and the conditional cash transfer program, are beginning to bear fruit and promising a better quality of life for Filipinos in the long-term. The mystery of Medical Marijuana: Is it safe to use as a remedy for pain?

Most recently, a longtime friend of this author wrote that he no longer has diabetes problems and claims that Medical Marijuana has helped him fight the disease. He currently promotes its use openly in the State where he lives, where the medicinal plant has been approved for use particularly by people like him who have debilitating diseases. Some claim that the definition of Medical Marijuana “refers to the use of Cannabis extracts and its cannabinoids to treat diseases or help improve patients’ quality of life. Others however claim that Cannabis, used as medicine has actually not been rigorously and scientifically tested, often due to some government regulatory restrictions.” According to some historical accounts, Cannabis called “ma,” (meaning “hemp” or ‘numbness” in Chinese), was used in Taiwan as an alternative to fiber, some 10,000 years ago. Around 2737 BC, Emperor Shen - Nung, a pharmacologist by profession, wrote a book on treatment methods , which included the “medical benefits of Cannabis. He recommended the substance for many treatment uses such as: constipation, gout, rheumatism and absent-mindedness. During the same time period, some Chinese considered Cannabis as one of the 50 “fundamental” herbs in traditional Chinese medicine. “ The “Cannabis” plant has a history of medicinal use dating back thousands of years across many cultures. However, its current use is quite controversial. The Ameri-

can Medical Association, as well as The American Society of Addictive Medicine and other medical organizations have issued separate statements opposing its use for medical purposes. Following is a background of various cultures worldwide that used Cannabis for medicinal purposes: In Ancient Egypt (around ca. 1550) the Ebers Papyrus described Medical Cannabis as the substance used in lieu of suppositories to relieve the pain of hemorrhoids. But, in Asian countries such as Ancient India, Cannabis was used to treat a variety of illnesses such as: insomnia, headaches, gastrointestinal disorders and pain including women’s childbirth. Likewise, in Ancient Greece, they used Cannabis to dress wounds and sores on their horses, while with humans, they used dried leaves of Cannabis to treat nosebleeds. During the Medieval Islamic period, (from the 8th to the18th century), Arabic physicians used Canabis as diuretics, antiemetics, antiepileptic, analgesic, anti-inflammatory and antipyretic treatments on various ailments. From exorbitant long distance calls to free Facetime Migrant workers: Connecting to home through the years By Abner Galino

(2nd of two parts) Migrant workers fell in love with “voice taping” because recording a monologue was way easier than writing one’s thoughts. And most important of all, the process naturally brings out the exact emotions that the sender wants to convey. I had a kababata whose father was a welder in Saudi Arabia. In one instance, we were invited to listen to his father’s voice tape. My friend’s father talked about how food was so abundant in one of their employer’s houses. He worked for a member of the Saudi royal family. He talked about the crazy weather in Saudi Arabia and how big were the fish that he and his co-workers had caught during one of their days off. We laughed when some of our names were mentioned in the voice tape, including some funny crazy moments that were all known to us. There was a roller coaster of emotions as the voice tape rolled on. He never complained about anything but somehow we all got the sense that working abroad was a hard and lonely endeavor. We knew that it was hard to be away from home. At the end of the playback, my friend, his siblings and his mother were all in tears. If it was that hard for those who remained to cope with the absence of a family member, you could just imagine how much harder it was for the person who went away. And to think that we lived in a relatively happy neighborhood. The next craze that came around was the Betamax (videocasette magnetic tape). I couldn’t recall anyone of my neighbors who came home from abroad who did not buy a Betamax machine. Some bought their Betamax from where they came from and bought them locally as soon as they got home.

The Betamax was like a trophy for the returning Saudi Boys (we referred to the whole Middle East as Saudi during that time). Probably very few migrant workers were able to record their narratives into the Betamax tapes. You would need a camcorder to do that and they were not cheap. We Pinoys have this penchant to turn brand names or an object’s name into a verb that takes the action of what that object is used for. For example, Kodak , a camera brand, is used this way: “Kodakan mo ako” which means “take a picture of me.” It was in the same way that Betamax became another Filipino verb. “I-betamax natin yan. (Meaning, let’s put that in a video.),” people would say then. It didn’t take long for betamax to evolve into other meanings such as sleazy, scandalous, vulgar, sex video, porn etc. So, when a friend tells you: “Pare may betamax ako ni …… at ni …..” that means, the gang is coming together to watch the video. Well, between then and now, the difference would be: you hear about it or tipped off and then you search for the video on the Internet. Ok, let’s keep walking down the memory lane. Later on, camcorders evolved into smaller versions that were known as handycams. It was at this stage when they also became another overseas workers’ “thing.” I mean, it became something that they would acquire if they can afford it just like those distinctive “enormous” Saudi gold rings, bracelets and necklaces − the so-called katas ng Saudi. It was probably the middle of 1980s, when home videos became a popular pastime for those who can afford a handycam. However, the craze was not able to duplicate the popularity

and usefulness that the cassette tapes achieved with regard to migrant workers’ efforts to connect to home. For a while, prepaid phone cards or just simply called phone cards sold like hot cakes among overseas workers and expatriates. With the Internet and the digital technology still in its infancy, the phone cards allowed migrant workers to dial home anywhere and anytime. When my wife and I came to the US in 2005, we spent around $100 to $300 a month to be able to connect to home on a regular basis. That was, of course, big money relative to what we were earning. But migrant workers would spend their last penny just to keep in touch with family and friends. Instant messaging and chat rooms were already available for free through Yahoo Messenger, but they were not enough. The yearning was simply insatiable. Certain technologies have been around but did not become available to the general public because they were too expensive, and therefore not marketable, or restricted for government use. For example, video conferencing have been around since the early 1990s. Although it was not the Internet-based video calling that we now use, it practically was the same concept. The big break came when these geniuses got it right with the webcam. Not only did they simplify the webcam, they also managed to make it marketable (read: Affordable). And later on, they were able to build it in the gadgets themselves. Arguably, the next big break was the smart phone. It literally and figuratively put everything into an individual’s grasp. Everything is within the reach of the fingers: Google, social media, games, radio, TV, and best of all, the capability to be in real-time with friends

loved ones. Regular people, though they may find it to be an amazing technological leap, usually just take this for granted. There are few reasons for them to be excited about it. For migrant workers, real time is simply precious. It is not perfect, but the only thing that possibly could thump it out from its prime spot in a migrant worker’s heart is when technology would someday allow us to “teleport.” You know, just like how they were doing in the Star Trek. Real time or as it happens. To be at the place where moments unfold. Imagine how big is that for someone who has not been home for some time. To be there when your daughter was blowing her birthday cake. To be there when your mother was showing you how to cook a new recipe. To be in the same place when they were changing your grandson’s diaper and personally handing out the pasalubongs when your children were opening up the balikbayan box that you just sent and they were showing you how they appreciate each of the items. Of course, “being there” is not enough. But how much strength, how much sanity, how much courage, how much joy, how much hope, those real time moments bring into the life of a migrant worker is just immeasurable. Friendster and Myspace, the forerunners of Facebook, deserve credit too for a starting a revolution in social media which spawned Twitter, Instagram and Youtube. “Status update” or posting “selfies” are mostly amusement activities for the rest of us. But for a migrant worker, the “status updates” and “selfies” of loved ones, family, friends and acquaintances are bridges and passages that bring him to his cravings, his longings, his self-assurance, his out of sight identity and peace of mind.

Canada tightening visa-free travel to its shores Ottawa, Canada | AFP | Tuesday 2/16/2016 – Canada will tighten its rules on entering the country next month, adding a layer of security that will impact Europeans and others previously allowed to visit without a travel visa. Formerly visa-exempt foreign nationals, including those passing through on a stopover, will have to fill out an online Electronic Travel Authorization (eTA) in advance and pay a small administrative fee (Can$7), starting March 15. The measure is similar to one set up by the United States in 2008, and will affect people from more than 50 countries. Americans will be exempt. Anyone caught unaware of the new reg-

Aquino: PHL has no plan of arming, fortifying defense vs China

MANILA, Feb 17 (Mabuhay) – President Benigno Aquino III on Wednesday said the Philippine government has no plans of either arming itself or building deterrents against China, which is aggressively asserting its dominance in disputed areas in the South China Sea. In his speech at the Los Angeles World Affairs Council on February 16 [Feb. 17 in Manila], Aquino said: “We have zero ambitions ... of arming ourselves with our own weapons of mass destruction; we have no plans of trying to come up with some sort of deterrents against the military might of that superpower.” He was referring to the threat of the aggressive actions of China in the disputed seas. “As for our region in Southeast Asia, we are also witnessing very aggressive actions by our big neighbor to our West and North – the world’s second largest economy, and a nuclear power at that,” Aquino said. Months after China completed its reclamation activities on disputed islets and atolls in the Spratlys, China has reportedly deployed an advanced surface-toair missile system to one of the disputed islands it has built up, Taiwan and US officials said on Wednesday. In his LA speech, Aquino also stressed that he would rather like to spend the country’s limited resources on “butter” rather than trying to arm against China. However, he said, the Philippine government would continue to assert the country’s rights through legal and peaceful means based on international law. But he said that whatever is the outcome of the Philippine case against China in The Hague-based International Abitral Tribunal, Manila is ready to accept. “My nation has resolved to accept whatever decision the Arbitral Tribunal makes, and we are hopeful that our neighbor – who has constantly reiterated their respect for international law – will in time do the same,” Aquino said. China, however, has continued to decline participation in the arbitral process. Aquino arrived at the Palm Springs International Airport early Tuesday morning (PHL Standard Time) to attend the US-ASEAN summit hosted by US President Barack Obama. The ASEAN-US summit is expected to further strengthen and improve the Joint Strategic Partnership between ASEAN nations and America. SC urged to resolve Poe cases with dispatch

MANILA, Feb 17 (Mabuhay) – With the conclusion of the oral arguments on Tuesday, the Supreme Court should resolve immediately Sen. Grace Poe’s plea challenging her disqualification from the May 2016 presidential elections. This was according to legal experts on Wednesday, who also said that should the high court uphold Poe’s disqualification by the Commission on Elections late in the campaign period, the votes she would be getting would be wasted. Election lawyers Edgardo Carlo Vistan II and Romulo Macalintal, and former Integrated Bar of the Philippines national president Vicente Joyas all agreed that the high tribunal should already decide on Poe’s two petitions. Vistan said in the event Poe’s disqualification is upheld by the SC but voters still end up voting for her in the May polls, those votes “cannot be credited to her as they would be considered stray votes.” Since January 19, the high tribunal conducted a total of five rounds of oral arguments on the Poe cases. “It is important that the Supreme Court resolve the disqualification cases against Sen. Grace Poe expeditiously,” said Vistan, adding that just because the Comelec had already started printing the 57 million ballots does not make the resolution of the Poe cases less urgent. “Even if the ballots would be printed already with Sen. Poe’s name as one of the presidential candidates, there is still an urgent need for a speedy resolution of the case so that the Comelec can make appropriate adjustments to the automated vote counting and canvassing protocols or procedures in case Sen. Poe is disqualified,” he said. Like Vistan, Macalintal also said votes cast for Poe would be rendered worthless if the SC upholds her disqualification. “It will be considered stray votes. Hindi bibilangin iyong [boto kay Poe]. At kahit

siya pa ang makakuha ng pinakamaraming boto, balewala iyon. Ang ipo-proclaim ay ang susunod na nakakuha ng pinakamaraming boto,” said Macalintal. Dapat ipinapakita ng SC ang urgency. Eh ang lumalabas sa SC, parang hindi urgent,” said Macalintal. Both Vistan and Macalintal agreed that the SC could have resolved the cases earlier had it conducted oral arguments more often than just once a week. Vistan said even if the oral arguments lasted six or seven rounds, the SC could still decide on the case much earlier if it had held oral arguments “twice or three times a week.” Macalintal, meanwhile, even wanted oral arguments to be held daily. “With due respect to the high court, dapat maging araw-araw ang oral arguments and dapat hindi na dapat ganoon katagal kasi hindi naman contested ang facts ng case. Alam na nila ang nangyari. Si Sen. Grace Poe, sa residency, naglagay na siya ng statement [sa COC]. Walang problema sa facts of the case,” said Macalintal. He said all that is being debated in the oral arguments are not questions of facts but legal issues which all involve questions of law. The election lawyer went as far as to declare: “I don’t think kailangan pa nga nila mag-hold ng oral arguments dito eh,” adding that he thinks the case could be decided right away based solely on the pleadings and comments submitted. Joyas also agreed “it is important to resolve the cases of Sen. Poe with dispatch.” The former IBP head however said the high tribunal must also be given “reasonable time to hear and decide the cases because of the significant issues involved.”

In a highly symbolic gesture, the pope climbed a ramp facing the Rio Grande that separates Mexico’s Ciudad Juarez and El Paso, Texas, laid flowers under a cross and blessed hundreds of migrants on the American side, who waved at him. Francis then celebrated mass with more than 300,000 Catholic faithful on the Juarez side of the border, with tens of thousands more following it on a giant screen in an El Paso stadium. Immigration is a hot-button issue on the US presidential campaign trail and White House hopeful Donald trump criticized the pope’s decision to hold such a mass. But Latin America’s first pontiff did not talk directly about the politics across the border, focusing instead on the plight of migrants. “We cannot deny the humanitarian crisis which in recent years has meant the migration of thousands of people, whether by train or highway or on foot, crossing hundreds of kilometers through mountains, deserts and inhospitable zones,” Francis said. “The human tragedy that is forced migration is a global phenomenon today,” he said on the last day of a five-day trip to Mexico. Duterte sputters, coffers empty Grace Poe gets Danding’s support

The presidential campaign of Davao city Mayor Rodrigo Duterte is apparently losing its steam or sputtering due to its inability to augment its meager campaign kitty needed to bolster its chances of winning the presidency on May 16. Because of its limited financial resources, Mayor Duterte is unable to organize a potent political machinery needed to launch an effective presidential campaign nationwide, except perhaps in Davao city. Up to now, there are only a handful of governors, mayors and congressmen who are supporting the presidential bid of Duterte. These politicians, as expected, are all from the Mindanao areas. He has no known political supporters in Metro Manila, Northern and Southern Luzon areas. His campaign strategists are hoping that voters will ultimately choose the feisty mayor as their preferred presidential bet because of his proven track record as a crime-buster and for his honesty as a public servant for many years. If Duterte’s bid for the presidency is hobbled by lack of adequate campaign finances, this cannot be said in the case of Senator Grace Poe Llamanzares. By now, everybody knows that the presidential candidacy of Senator Llamanzares is being financed by billionaire businessman Danding Cojuangco, a food and beverage magnate and chairman emeritus of Nationalist People’s Coalition (NPC). With so much campaign money being given to her to help bolster her bid for the presidency, Senator Llamanzares has no problem getting the all-out-support of governors congressmen and mayors, as well as barangay captains all over the country. No wonder, Senator Llamanzares can afford to pay a television network close to P674 million for the airing

of her campaign informercials. Even her family must have benefitted from the unlimited cash flow coming from the Danding Cojuangco business empire. Her eldest son, Brian, recently was criticized by hundreds of voters who saw his picture on “Facebook” wearing a Nike limited edition sneakers worth $19,999 The controversial pair of sneakers was expensive because it is a collector’s item. Brian, however claimed, that the shoes are “fake” when confronted by newsmen. He claimed he only paid P10,000 which he got from his saving. Senator Llamanzares defended her son, saying that Brian has the right to choose what he wants to buy for himself as long as he will not steal the money to purchase something. Like his mother, Brian is also good at lying. With Danding Cojuangco backing up her candidacy with unlimited finances and the entire NPC political machinery working to ensure her victory in the presidential election, there is now a growing perception that Llamanzares might be the person to replace Aquino in Malacañang. Among the five presidential candidates vying for the top post, Senator Llamanzares is the least knowledgeable and prepared to handle the difficult job of being the head of a nation, however. This is the reason why Cojuangco picked Llamanzares to be his presidential candidate. He can easily dictate on her what he wants her to do during her six-year stint

in Malacañang palace. This was the same reason “Danding” picked “Noynoy” over his own nephew, Defense Secretary Gilbert Teodoro during the 2010 presidential elections. Not only did Teodoro not get the support of “Danding,” he was not given a single centavo by his “uncle” to help him with his campaign finances. When I went back to the Philippines in 2013 for the death of my mother, I had a lunch with an NPC northern Luzon congressman. When I asked him how come “Danding” picked “Noynoy” instead of his own nephew, the answer I got jolted me. He said “Danding” disliked “Gilbert” because of his stance as “pro-poor” and his proven track record as an honest public servant.”Danding” also disliked his nephew for being “matigas ang ulo (hard headed). Picking “Noynoy” over “Gilbert”,

according to “Danding,” my NPC congressman said, was a no brainer. At least, he said, “Noynoy is “tamad” at walang utak as compared to “Gilbert” who is too intelligent to be manipulated by his uncle and “mahirap pakiusapan. “Sobrang diretso sa pamamalakad niya sa anumang bagay,” he added. But “Danding’s financial and political backing for “Noynoy” came with a price. His permanent hold of his huge shares in the San Miguel Corporation(SMC) which is being questioned by PCGG and the controversial multibillion coconut levy fund pending for so many years in the Supreme Court, remains intact. When “Noynoy” was elected into office, “Danding” as expected, was able to hold on to his prized SMC empire until today, as well as the coco levy fund which still has to be decided by the High Court.

The Philippine delegation is composed of Undersecretaries Carlo Carag (Finance), Ardeliza Medenilla (Public Works and Highways), Analiza Rebuelta Teh (Environment and Natural Resources), Edwin Enrile (Interior and Local Government), Catherine Gonzales (Transportation and Communication), Raul Aguilos (Energy), Carol Yorobe (Science and Technology) and Rolando Tungpalan (NEDA); and other officials from the Departments of Budget and Management, Education, Health, Public Works and Highways, and Trade and Industry, as well as the GPPB Technical Support Office. Do you need to be living in separate residences to be considered ‘separated’ from your spouse under the California Family Law? Family Code 760 provides that all property acquired by the spouse during the marriage is community property. That means each spouse has a half interest on any assets that are acquired during the marriage, with certain exceptions, since it is generally characterized as community property. On the same token, Family Code 771(a) provides that earnings and accumulations of a spouse while living “separate and apart� from the other spouse, are the separate property of the spouse. How about the situation where the couple continues to live together due to economic reasons like roommates. Is a couple living “separate and apart� under family code 771(a) when they continue to live together in the same home even though they no longer live their lives like married couple? The California Supreme Court, in a recent case In re Marriage of Davis, 61 Cal 4th 4th 846 (2015), held that the phrase “living separate and apart� in the California family code refers to a situation in which spouses are living in separate residences and at least one of them has the subjective intent to end the marital relationship, abrogating In re Marriage of Johnson, 134 Cal. App.3d. 148. Prior to this decision, the date of “separation� occurs only when the parties have come to a parting of the ways with no present intent to resume their marriage and their conduct evidences a complete and final break in the marital relationship. The Court would consider all of the relevant evidence regarding whether the parties’ conduct evidences a complete and final break in the marital relationship. Living in separate

residences, although a factor to be considered, was not required for a separation. In re Marriage of Davis involved husband and wife married in 1993. The couple had 2 children. Couple stopped having sexual relationship in 1999. Wife moved to another bedroom in the house either in 2001 or 2004. Husband and wife attended children’s activities but used separate cars. On June 1, 2006 wife announced she was “through� with the marriage. Wife believed couple were acting simply as roommates after 2006. Wife increased her earnings after this date while husband left his job. Parties continued to live in the marital home and went on vacation together. Wife filed for divorce in 2008. Wife moves out of the marital residence on July1, 2011. Wife alleges date of separation of June 1, 2006. Husband alleges a date of separation of July 1, 2011. The trial court and the court of appeal found June1, 2006 as the date of separation. The California Supreme Court reversed the decision holding that living in separate residences “is an indispensable threshold requirement for a finding that spouses are “living separate and apart� for purposes of section 771(a). The interpretation aligns with the common understanding of the words, the statutory history of the provision, and legitimate pub-

lic policy concerns. The In re Marriage of Davis decision now requires the parties to be living in separate residences as a prerequisite to a separation. In IRMO Davis, the California Supreme Court looked into the plain meaning of the statute, the legislative intent and history of the statute, and the case law in interpreting the term “separate and apart.� The California Supreme Court looked into the wording and legislative intent of family code 771(a) by tracing it back to a 145 year old predecessor statute enacted in 1870 “ An Act to Protect the Rights of Married Women in Certain Cases.� Section 4 of the 1870 act provided a procedure for a wife who was “living separate and apart� from her husband to sell her real property without joining with her husband by stating in a declaration �her own place of residence that is “separate and apart from her husband� which strongly suggests that the statute was directed at a situation where the spouses had physically separated and the wife in fact had her own residence. The Supreme Court also relied on the holding in the Norviel case which held that living apart physically is an indispensable threshold requirement to separation, whether or not it is sufficient, by itself to establish separation. Although the Davis case has adopted a bright line test in determining date of separation, it also acknowledge that there may be “exceptional circumstances� when a couple is under one roof but still separated. This was noted in footnote 7 in Davis and the concurring opinion written by Justice Liu and joined by Justice Werdergar. Davis

has listed facts that do not qualify as exceptional circumstances. The date of separation is one of the most litigated issues in a divorce case since it directly affects the characterization and division of community property. This case changes that analysis and may create problems in its practical application to the realities of contemporary families. Refinancing again in three months, does it make sense? My advise has always been towards homeowners refinancing without paying loan fees at all. This is why most home borrowers are refinancing and buying home mortgages without paying any fees. Rates just took a huge nose dive to around 3.75% no points for purchase loans. Mostly everyone can get a possible 3.875% rate on refinancing without any fees. But if you had just paid fees to refi, you can still do it but you might have thrown good money away on that cost of the recent refi. But if you can reduce by even .25-.375% without having to pay fees. Please consider this opportunity to lower your payments. This window of opportunity might not stay forever. Refinance your Mortgage Without Extending the Term? Obviously, the simplest way to refinance without extending the term is to select a new mortgage with a shorter term. How do you refinance your 30 year loan after paying for a few years to another 30 years loan without extending the terms is the questions. This is what banks don’t really want you to know if order for you to keep paying your mortgage sometimes never really paying it off. Much the best method is to refinance at the same term or a shorted term, but increase the payment by the amount required to amortize over the period you wish. Let me explain:“I want to refinance my 4.25% 30-year mortgage, taken out in 2010, without starting the 30-year amortization period all over again. I read recently that the best way to do this is to borrow an amount equal to the original

balance, then immediately prepay an amount equal to the difference between the original balance and the current balance. Do you endorse this?� No, there are better ways to accomplish your objective. Assume you took out a $250,000 fixed-rate mortgage in 2010 for 30 years at 4.25%. Your monthly mortgage payment was $1229.85. If you made no extra payments, your balance 5 years later would be $227,019.24. You now have an opportunity to refinance at 3.875% on a new 30-year loan with zero cost, but you want to pay off in 25 years, as you would have if you hadn’t refinanced. There are 2 ways to do this. Shorten the Term The simplest way is to make the term on the new loan 25 years instead of 30. Then your new payment will be $1187.79, which would still be below your current payment. The rate on 25-year loans is usually the same as that on the 30, but 20-year terms carry lower rates.. Increase the Payment A much better alternative is to refinance the current balance for 30 years, but increase the payment by the exact amount you were previously paying $ 1229.85, instead of paying $1187.79 which

City of Oakland, Bonta offer new tool to build affordable housing (Sacramento, CA) – Filipino-American Assemblymember Rob Bonta (D-Oakland) today introduced AB 2031 to empower California cities with a new tool to address the growing affordable housing crisis. Oakland Mayor Libby Schaaf explained the urgent need for AB 2031. “Between 2010 and 2014 the Bay Area added roughly half a million private-sector jobs, but

only 54,000 more units of housing,� said Schaaf. “This housing scarcity is exacerbating the regional affordability crisis for vulnerable and long-time residents in cities like Oakland. Assemblymember Bonta’s legislation is badly needed because it offers a mechanism for meeting California’s high demand for more affordable housing development.� Bonta concluded, “No one should be driven, by no fault of their own, from the communities they love, grew up in, and want to raise their families in.
