PHL campaign spending outrageous, needs controls: Drilon MANILA, Feb 2 (Mabuhay) – As campaign period kicks off next week, Senate President Franklin M. Drilon on Tuesday called for stronger campaign regulation in the country to prevent what he called an “outrageous, ridiculous and out of control” election spending.

“I am calling on the Commission of Election to exercise a stronger regulation of expenses of politicians before and during the actual campaign period,” Drilon said.

“The campaign spending in the country is outrageous. Any way you look at it, the election in the country is one of the most expensive in the world,” he added.

A Nielsen Philippines Advertising Information Service (AIS) report earlier revealed at least three presidential candidates in the 2016 polls spent a combined P1.4 billion on TV ads in Metro Manila in the first 11 months of 2015, with Vice-President Jejomar Binay spending more than half a billion pesos on TV ads last year.

As the World Health Organization (WHO) declares the current spread of the Zika virus a Public Health Emergency of International Concern, the Philippine Government, through the Department of Health, has advised its citizens to remember and use ‘4S’ against Zika virus and other mosquito-borne diseases. File bankruptcy – Rebuild credit After a debtor receives a discharge in bankruptcy, creditors whose debts are discharged are required to report that the account has a zero balance.

The bankruptcy itself is a public record and stays on your credit report for 10 years, but as you will see from this article, this is not all bad.

A debtor interested in re-establishing credit after bankruptcy should obtain credit reports from the 3 largest credit reporting agencies, (Experian, Equifax, and Trans Union) and ensure that the account balances have all been zeroed out.

If not, the debtor should contact the credit reporting agencies and ask that the record be corrected.

Credit reports can be obtained free, once a year, from the credit reporting agencies own sponsored website “Annualcreditreport.com”.

There are several methods of re-establishing credit. A debtor seeking to re-establish credit should apply at banks that specialize in offering credit cards to post bankruptcy customers. These can be found by searching on the internet. Many banks will offer a secured card program. This is usually a Visa or Master Card, where the customer is required to establish a savings account at the bank. The deposit into the savings account is used as security or collateral for the card. Typically, the limit on the card is based on the amount of collateral put up in the form of the savings account. Often, the bank will have an annual fee. The benefit of the secured card is that it provides a way forward to reestablishing your credit.

Other methods include buying a car from a local car dealer who advertises that it specializes in making car loans to persons with a recent bankruptcies. Also, a debtor with a personal relationship with someone at a local bank should not hesitate to seek assistance from that source.

Caution in Rebuilding Credit.

Debtors emerging from bankruptcy should use their experience to avoid getting into the same financial traps, which snared them before. All too often, this was the easy availability of unsecured credit in the form of unsolicited, pre-approved, credit cards.

Debtors should take steps to budget properly, not spend beyond their means, and resist the temptation to incur debt beyond their reasonable ability to repay just for the purpose of re-establishing credit.

Avoid these so-called “credit repair” agencies. They are often simply unregulated rip-offs, who prey on the financially-distressed, and do nothing more than what debtors can do themselves. You can do this yourself, by exercising your legal rights under the Federal Fair Credit Protection Act. Some debts cannot be discharged in bankruptcy. As a general rule, older income taxes (more than 3 years old) can be wiped out in bankruptcy; but newer income taxes (less than 3 years old) cannot. A debtor/employer can wipe out the employer’s portion of older, but not newer, payroll taxes.

The discharge-ability of state and local taxes, such as sales and use taxes, will depend upon their true nature, i.e., whether they are excise or withholding taxes. The trust fund portion of payroll taxes is generally not dischargeable. Prior to filing bankruptcy, the debtor should have his own particular tax situation

assessed.

The Test for wiping out income taxes in bankruptcy include: The tax return was due more than 3 years prior to the filing The tax return was filed at least 2 years prior to the filing The tax has been assessed for at least 240 days prior to the filing The tax is not based on a fraudulent return There was no willful tax evasion by the debtor.

In Chapter 13, income taxes can be wiped out if the return was due more than 3 years prior to the filing, and was assessed at least 240 days prior to the filing. In some cases, the tax may be dischargeable even if not assessed prior to the filing.

Can Utility Debts Be Discharged in bankruptcy? Public utilities, such as the gas and electric company, are not permitted to discontinue service because of a bankruptcy filing. However, if the utility bill is included in the bankruptcy and not paid, then the utility has the right to demand that the debtor pay a deposit within 20 days to ensure the continuation of service. Sometimes, the requested deposit is several times the amount of the bill, so it often makes sense for a cash-strapped debtor to simply pay the bill. Utility bills for service arising after the bankruptcy filing is not included in the bankruptcy, and must be paid.

Does the Bankruptcy Code prohibit discrimination based on a bankruptcy filing? The Bankruptcy Code contains an “anti-discrimination” provision, stating that government units and private employers may not discriminate against a person solely because that person has filed bankruptcy or was insolvent. Also, if a debtor has lost his driver’s license solely because of his inability to pay damages resulting from an accident, then a bankruptcy discharge will allow the debtor to get his license back.

As stated above, a bankruptcy stays on your credit report for 10 years. However, you can still rebuild good credit getting a fico score above 700 in just a few years. There are many companies that target people with bankruptcy discharges. Here are the reasons why: You cannot file a new bankruptcy and discharge debt again for 8 years.

PHL will lose Mindanao if federal system not put in place: Duterte MANILA, Feb 2 (Mabuhay) – Davao City Mayor Rodrigo Duterte said the Philippines could lose Mindanao if a federal system of government is not put in place.

In a radio interview, Duterte said if a unitary system of government is maintained, “We might lose Mindanao.”

“Hindi lang kasi alam ng buong bayan that there is an urgent problem,” said Duterte, the presidential candidate of PDP-Laban.

Duterte said the problem in Mindanao cannot be solved by the current version of the Bangsamoro Basic Law (BBL) which has not yet been passed

by Congress.

“I saw the draft and sabi ko, mahihirapan ito. Sabi ko baka idi-dribble lang ito sa next administration,” said Duterte, a lawyer who graduated from the San Beda College of Law in the same year that Martial Law was declared in 1972.

“Hindi ko maintindihan kung bakit sinasabi nila in favor ako sa BBL. Sabi ko na sa kanila, hindi lulusot ‘yan, idi-dribble ‘yan. I predicted it correctly,” added Duterte, the lone presidential candidate from Mindanao.

“Ako naman sa Mindanao, I’m just trying to strike a happy balance,” he said. “I’m trying to save Mindanao from spinning into a cycle of violence.” He said it was important to talk to different stakeholders in Mindanao, the Moro Islamic Liberation Front (MILF), Moro National Liberation Front (MNLF), Nur Misuari, and others.

According to Duterte, the solution to unifying the different factors in Mindanao is to adopt a federal system of government where power is divided between a national or federal government and various regional governments.

At present, the Philippines has a unitary or central system of government.

Duterte said some think the problem in Mindanao is just a peace and order issue.

He traced the Mindanao problem to the time when Portuguese conqueror Ferdinand Magellan arrived in the Philippines in 1521.

He said Magellan imposed Christianity on the islanders even though Islam was already in place in Mindanao decades before Magellan arrived in the Philippines. (MNS)

Duterte: I never killed an innocent person MANILA, Feb 2 (Mabuhay) – He had claimed to have killed over a thousand people, but Davao City Mayor Rodrigo Duterte maintains that he “never killed an innocent person.”

Asked during a radio interview how Duterte knew that none of those he killed were innocent, the Davao mayor replied, “Wala akong sinabi.

May pinatay ba akong inosente?”

“Yung kriminal, huwag na yon, huwag na nating pag-usapan yon, kasi mamamatay talaga yan,” said Duterte, whom Amnesty International accused of having killed 700 people.

To this, Duterte responded last December that he had actually killed 1,700 and not just 700.

Duterte said while he admits to killing people, he is not in favor of extrajudicial killings.

He said the killings happen when the police and the military come face to face with criminals.

He mentioned that tapping the police’s and military’s help will also

be his tactic to achieve his aim of wiping out drugs and criminality within three to six months of assuming office, if he is elected president.

“No secret. I will use the military,” he said. “I will tell them to farm out and hunt the drug lords. Totoo ito, karamihan diyan may armas. Mga sharpshooter yan.”

“Sasabihin ko sa military, ‘If you think that your life is in jeopardy, ang buhay mo nasa delikado na, shoot,” he added.

Duterte said he dislikes the idea of having policemen or military men killed by criminals.

“Ayaw kong mamatay ang pulis at militar na nagtratrabaho lang naman. At kung sabihin mo na magkakabarilan, sasabihin ko, wag kang magpabaril,” he said.

“Barilin mo. But if you are asking me, talian mo tapos babarilin mo sa likod, wag na yang extralegal [killing],” Duterte said. “If you are in danger of losing your life, bakit (pabayaan) mo when you are allowed to save yourself?”

No more chance to pass SSL IV, EO is best option: Drilon MANILA, Feb 4 (Mabuhay) – Senate President Franklin Drilon said Thursday there is no more chance for the Congress to pass the proposed law increasing the salaries of government employees when it resumes session after the national elections.

“Wala na. Hindi na kaya,” Drilon said during the weekly forum Kapihan sa Senado when asked about the appeal of Budget Secretary Florencio Abad for the bicameral conference committee to pass the proposed bill.

He said it would be too late for them even if they take it up in May as they will be convening as the National Board of Canvassers to canvass votes for the president and vice presidential candidates.

The Senate chief then reiterated his appeal to President Benigno Aquino III to just issue an executive order for the purpose.

“My suggestion is the President exercises his executive power to de-

cree salary increases as it is already authorized under the General Appropriations Act for this year,” he said, referring to the P57 billion allocation for salary increase of government employees.

Drilon said the amount would automatically become savings if it will not be utilized.

“The General Appropriations Act has provided for a salary increase.

There is every reason to act on this immediately,” he said.

“The proposed Salary Standardization Law is a measure coming from Malacañang. So the only difference is the proposed SSL was for four years while my proposal is an executive action only for one year while Congress would review this issue of being able to provide for our military pensioners whose monthly pension is sourced from the GAA, not from the GSIS [Government Service Insurance System],” he added.

SC junks with finality Laude kin’s bid to transfer Pemberton to regular jail MANILA, Feb 2 (Mabuhay) – The Supreme Court has dismissed with finality the petition of Jennifer Laude’s family to transfer US Marine Corporal Joseph Scott Pemberton to a regular jail.

SC spokesperson Theodore Te announced the decision in a press conference Tuesday afternoon.

In a decision on Nov. 24, 2015, the high court dismissed the petition because it was filed “”without the conformity of the public prosecutor.”

The court cited that any criminal case filed in the name of “People of the Philippines” should be represented by a government prosecutor, Te said.

“Petitioners have not shown any reason for exception treatment,” the court said.

The Olongapo City Regional Trial Court, which found Pemberton guilty of homicide for the killing of Laude last December, had initially ordered Pemberton detained at the New Bilibid Prison in Muntinlupa City.

Pemberton, however, was detained at the Armed Forces of the Philippines’ headquarters in Camp Aguinaldo.(MNS)

Comelec has power to cancel Poe’s COC for president: Guanzon MANILA, Feb 2 (Mabuhay) – The Commission on Elections started its arguments before the Supreme Court on Tuesday, stressing its jurisdiction to cancel the certificate of candidacy for president of Senator Grace Poe. Commissioner Rowena Guanzon opened the Comelec’s case with the poll body’s power to cancel Poe’s COC after the senator’s camp argued over the past two weeks that it was beyond the Comelec to disqualify the senator from the presidential elections in May. “The Comelec has jurisdiction to cancel the certificate of candidacy of the petitioner in this case under its constitutional mandate or broad powers to administer and enforce all laws and regulations relative to the conduct of the elections,” Guanzon told the Supreme Court.

“We enforced according to the evidence Section 78 of the Omnibus

Election Code. The Supreme Court has recognized the jurisdiction of Comelec to cancel certificates of candidacy in the cases of Ongsiako-Reyes versus Comelec and the case of Gonzales versus Comelec,” she added.

Poe is questioning before the SC the Comelec’s twin decisions canceling her COC for president for alleged material misrepresentation as regards her questioned citizenship and alleged lack of residency.

Tuesday marked the first time the Comelec presented its case before the SC. The first two hearings before the high tribunal saw Poe’s legal counsel, Attorney Alexander Poblador, present her case before the SC.(MNS)

US envoy urges Pinoys: ‘Reinvigorate’ peace efforts despite BBL’s ‘death’ MANILA, Feb 3 (Mabuhay) - US Ambassador to the Philippines Philip Goldberg on Wednesday urged Filipinos to “redouble efforts” to carry out the peace agreement with the Moro Islamic Liberation Front (MILF) despite Congress’ failure to pass the proposed Bangsamoro Basic Law (BBL).

While Goldberg refused to comment on the fate of the Bangsamoro bill, he said the US would like to continue seeing progress in the peace process in Mindanao.

“What we would urge everybody is to reinvigorate efforts to carry out the peace agreement. I’m not going to discuss the BBL because that is domestic legislation. That’s for Congress to do. But we all can say without hesitation that we’d like to see the peace process go forward,” he told reporters at a press conference.

“It’s clear that the more people, the more members of the Muslim community in Mindanao enter into the peace process, the better,” Goldberg added.

Leaders of both the Senate and House of Representatives have sounded the death knell on the proposed BBL ahead of the adjournment of sessions today, with Senate President Franklin Drilon and House Speaker Feliciano Belmonte Jr. saying they no longer have time to pass the measure in plenary.

The Bangsamoro bill, a product of the peace pact signed by the government and the MILF, seeks to formalize the creation of a new political entity that will replace the existing Autonomous Region in Muslim Mindanao.

Despite Congress’ admission of its failure to pass the proposed BBL, Malacañang said the Aquino administration remains committed to proceed with the peace process.

“Whatever the final fate of the proposed BBL, government was determined to support the peace process and encourage all stakeholders to give peace a chance,” Communications Secretary Herminio Coloma Jr. said last week. (MNS)

Vulnerable Asia fears Zika outbreak

Mumbai, India | AFP | Wednesday 2/3/2016 – Densely packed slums, rampant mosquitoes and a history of rapidly spreading infections make Asia particularly vulnerable to the devastating Zika virus, posing a massive challenge for the region, health experts warn.

Thailand confirmed Tuesday that a man contracted the mosquito-borne infection, blamed for a surge in the number of brain-damaged babies in South America, while Indonesia has also reported a domestic case.

The cases in Asia come as top US health authorities confirmed this week a patient in Texas contracted the Zika virus through sexual transmission, fuelling fears the disease may spread rapidly.

Officials in India worry it could be next, noting that the Zika and dengue fever-carrying Aedes aegypti mosquito thrives in the high-density communities of its teeming cities, where sanitation is often poor.

“In India particularly there is a great threat of the Zika virus spreading quickly given the presence of the Aedes mosquito and favorable environment,” said Om Shrivastav, an infectious diseases specialist.

“It would definitely be a big challenge for Asian countries to control the spread of the virus... considering high population in the region,” added Shrivastav, who is based in Mumbai, home to Dharavi, Asia’s biggest slum.

More than half of Mumbai’s 20 million inhabitants live in slums – at least one million reside in Dharavi alone – enduring cramped conditions, poor ventilation and a lack of toilets. Every summer monsoon, heavy rains lash Mumbai for four months, flooding parts of the city, including the slums’ maze of alleyways, which become fertile breeding grounds for mosquitos and lead to a massive spike in tropical diseases.

Soumya Swaminathan, director general of the Indian Council for Medical Research, warned against panicking but said a surge of den-

gue cases worldwide recently, was a cause for concern. “(Because of) the way dengue has spread over the last several years across continents and across countries, (and with) Zika being a mosquito borne illness, there is a potential for spread,” she told Indian news channel NDTV. Zika, which was first identified in Uganda in 1947, causes relatively mild flu-like symptoms and a rash.

But the World Health Organization (WHO) said it “strongly suspected” the Zika virus of being responsible for a rapid rise in cases of microcephaly, a condition in which a baby is born with an abnormally small head and brain.

Latin American countries, particularly Brazil, have reported a leap in cases of microcephaly since the Zika outbreak was declared in the region last year.

The UN-body has declared the situation a “public health emergency of international concern” and has created a global Zika response unit to contain the virus.

WHO expert Anthony Costello has stressed there is no reason to believe the crisis would remain limited to Latin America, where 25 countries so far have reported Zika cases.

‘Preventative measures’ “We know that the mosquitoes that carry Zika virus... are present through most of Africa, parts of southern Europe and many parts of Asia, particularly south Asia,” he said.

Eloi Yao, a WHO spokesman in Manila, said there was a “likelihood” that Zika would spread to Asia but described the present risk as “low”.

“Right now, we don’t want to raise the level of anxiety,” he told AFP, noting that Zika had been found in Asian countries before.

The Zika infection was reported in Cambodia in 2010 and the Philippines in 2012, according to WHO. Asian governments are no strangers to dealing with deadly outbreaks of viruses and could be forgiven if they felt jittery over Zika.

US says SE Asian summit ‘not anti-China’ Washington, United States | AFP | Wednesday 2/3/2016 – A summit with Southeast Asian leaders that President Barack Obama is hosting later this month is “not anti-China,” a State Department official said Tuesday.

The meeting will bring leaders from the 10-nation Association of Southeast Asian Nations (ASEAN) at the Californian resort of Sunnylands on February 15-16.

“This summit is not about China.

It’s about the US and ASEAN,” US Assistant Secretary of State for East Asia Daniel Russel said in an interview with the AP, Reuters and AFP

news agencies.

“This is not about China, this is not anti-China.”

The US administration has focused on bolstering ASEAN as a counterpoint to Chinese regional power.

“This is the culmination of a seven-plus-year investment the United States has made first and foremost in the Asia pacific region, but also in ASEAN in particular,” Russel said.

“I think it demonstrates that the rebalance has reached cruising altitude,” he added, referring to the Obama administration’s focus on its “pivot” toward Asia since 2009.

Patent case jury orders Apple to pay more than $625-M San Francisco, United States | AFP | Thursday 2/4/2016 – A Texas jury on Wednesday said that Apple should pay $625.6 million for violating patents held by a US company devoted to patent litigation.

Jurors in a federal court agreed that Apple had infringed on VirnetX Holding Corporation patents in its iMessage and FaceTime services as well as in its VPN on Demand, according to VirnetX attorneys.

“We are surprised and disappointed by the verdict and we’re going to appeal,” Apple said in an email response to an AFP inquiry.

“Our employees independently designed this technology over many years, and we received patents to protect this intellectual property.”

The four VirnetX patents at issue in the case have been found invalid by the patent office, according to Apple.

“Cases like this simply reinforce the desperate need for patent reform,” the California-based company contended. VirnetX Holding Corporation makes the bulk of its money through patent litigation.

Company’s that hold patents to make money from lawsuits instead of producing products are referred to as innovation-thwarting “trolls” by Silicon Valley firms that have called for the reform of US patent laws.

“We are thankful for the jurors’ hard work and attention in this case, and for reaching a just verdict,” said VirnetX attorney Jason Cassady.

NUJP slams Aquino govt for broken FOI pledge MANILA, Feb 3 (Mabuhay) – The National Union of Journalists of the Philippines (NUJP) has decried the failure to pass a Freedom of Information (FOI) bill which was among the campaign promises of President Benigno Aquino III in 2010.

In a resolution passed during its 9th National Congress in Baras, Rizal from Jan. 29 to 31, the NUJP cited the refusal of President Aquino to certify as urgent the passage of the FOI bill despite the dominance of his allies in Congress.

The passage of the FOI will “significantly boost efforts to ensure transparency in government and combat graft and corruption,” according to the media group in its resolution approved by more than 60 delegates and participants.

The NUJP vowed to pursue the passage of an FOI bill in the next administration.

During its congress, the NUJP elected a new set of officers for 2016 to 2018 led by its new chairman Ryan Rosauro, a Mindanao correspondent of the Philippine Daily Inquirer (PDI).

Joseph Alwyn Alburo of GMA 7 was re-elected as vice chairman while Dabet Castaneda-Panelo (ABS-CBN) is the new secretary general. Also elected were Fred Villareal (safety office coordinator) as deputy secretary general; Che de los Reyes (ABS-CBN), treasurer; and Kimberly Quitasol (Northern Dispatch), auditor.

So, it’s not a great business, but allows client to survive. He has no retirement accounts, no 401K or pension, and expecting minimum social security when he turns 66 next year. In other words, client still

needs to keep the business going beyond retirement, just so he can live a decent life in a rented home. He doesn’t even own a house.

The problem with client’s business is that a service, is performed by individuals who are not technically speaking, employees. When the service is rendered, client takes a cut from the receipt and gives the rest to the individual who performed the service. Let’s just say that these individuals are more independent contractors than employees. Business owners, if they can get away with it,

prefer the independent contractor to the employee. Independent contractors are paid on a per customer basis. If a customer walks in and the service is performed, client just gives the independent contractor his share of the payment for services rendered.

If there is no customer, there is no salary to pay. In addition, there is no overtime pay to worry about. For instance, trucking companies prefer to have their drivers buy their own trucks so they can classify them as independent contractors. As independent contractors, drivers do not qualify for employee benefits and do not get paid a salary. Instead, they get a check for each delivery they make. At the end of the month, they probably get about $10K. From that amount, they deduct their operating expenses. Whatever is left is their net profit for that month. Are truck drivers employees of the trucking company or are they independent contractors? The same thing can be said for UBER drivers. They own their cars. But UBER gets them the passengers and cuts them a check for each ride. I have clients who make $2K a month gross with UBER doing part time driving. Some make $4K a month gross. Are UBER drivers, employees of UBER or are they independent contractors?

The IRS uses the â&#x20AC;&#x153;controlâ&#x20AC;? test. If the business owner has control over most of the time of the individual, that individual is deemed an employee, not an independent contractor.

Going back to client, he has 4 individuals who perform the advertised service for clientâ&#x20AC;&#x2122;s business. He takes a cut from the gross receipt, then, gives the balance to the individual.

There are no set â&#x20AC;&#x153;workâ&#x20AC;? times (9 to 5). If a customer comes in at 9.30 pm, the individual performs the service for the customer and then client and individual split the gross receipt for services rendered. Client has operated his business using this method for 8 years. Certainly, he considers the individuals independent contractors, and for 8 years, the individuals appear to agree. But recently, all 4 individuals filed 4 separate state court lawsuits for overtime and back pay with each claiming $250K of unpaid overtime and back pay!!

Thatâ&#x20AC;&#x2122;s $1.0M of overtime of back pay. Where will client get $1.0M? If he had $1.0M, he would probably just close his business and retire somewhere in the world where no one knows him and where he can live like a king. Maybe in the Caribbean or some remote island country where thereâ&#x20AC;&#x2122;s plenty of sunshine everyday, and live the rest of his life in peace.

Last he checked, he only had $1K in his business checking account. Heâ&#x20AC;&#x2122;s just short $999K. Client opts for Chapter 7 for a fresh start to discharge the $1.0M lawsuits. But can bankruptcy wipe out claims for unpaid overtime and

back pay? It sure can. They are not exempted from discharge; therefore, they are dischargeable. Even if plaintiffs attempt to prove that these claims are not dischargeable under say, â&#x20AC;&#x153;intent to cause damageâ&#x20AC;? or â&#x20AC;&#x153;fraudâ&#x20AC;?, client would prevail because clientâ&#x20AC;&#x2122;s intent was to enter into a business contract with these individuals and these individuals voluntarily and freely agreed to this business relationship between client and them. Client did not put a gun on their heads to force them to perform the service. Itâ&#x20AC;&#x2122;s clearly a business relationship that worked for both client and plaintiffs for 8 years.

SENIORS WITH $48K CREDIT CARD DEBT The next client is 68 with equity in his residence of $150K but owes $48K of credit card debt. He started getting social security of $1,800. His wife gets social security of $1,200.

After the house payment of $1,500 and necessary expenses, there is no money left to pay minimum credit card debt of $1,400 monthly. This is a no brainer. Client and wife opt for a fresh start as seniors to discharge $48K of credit card debt, which they carried for 20 years. They only paid $312K of interest in 20 years and they still owe the same $48K. Palace echoes US envoy, Tagle: Choose leaders with integrity MANILA, Feb 3 (Mabuhay) – Malacañang on Wednesday welcomed the remarks of United States ambassador to the Philippines Philip Goldberg, who said that the country’s next top leader should continue the reforms started by President Benigno Aquino III. “Ambassador Goldberg has seen the benefits brought about by a government headed by President Aquino who leads by example. He has seen that good governance translates to good economics,” Presidential Spokersperson Edwin Lacierda said in a statement.

How would you have handled Mamasapo ops, Enrile asks AFP generals MANILA, Feb 3 (Mabuhay) – Senate Minority Leader Juan Ponce Enrile on Wednesday used the Commission on Appointments hearing to ask high-ranking military officials how would they have handled the Mamasapano operation in January last year.

During the hearing of the CA committee on national defense, Enrile asked Lieutenant Generals Romeo Tango, Glorioso Miranda, and Mayoralgo dela Cruz a single question.

“If you were chief of staff on Jan. 25, 2015 and you learned what was happening in Mamasapano, and you learned about the plight of the 72 men in police uniform, what would you have done?” Enrile asked the three separately.

Tanalgo said given the information that he would have received, he will be directing the units on the ground “to provide the necessary assistance, to reinforce, to try to extricate the beleaguered troops.”

To save the troops first, Enrile butted in, to which Tanalgo replied in the negative.

Enrile also asked if Tanalgo would inform the commander in chief and defense secretary, to which the military official also said, ‘Yes.’ Miranda, for his part, said he would direct the ground commanders to support and diffuse the situation “to make the mission successful.”

“I also expect my senior officers would be able to evaluate the situation,” he said.

He also said that he would inform and advise the commander in chief and the secretary of defense.

For his part, Dela Cruz also said that he will direct his subordinate commanders to extend the necessary assistance to help the comrades.

Enrile said what he is doing is “to remind you that you are not being paid by the President but by the Republic of the Philippines and your loyalty is in the people and to no one else.”

During the Mamasapano operations last year, the military was accused of not helping the beleaguered SAF commandos.

Drilon said that it is part of the duties of the Comelec to make sure that the election will be fair to all by ensuring that the candidates will not exceed the limit on the amount of campaign spending and that they follow the campaign regulations.

Under the Omnibus Election Code, candidates for vice-president and president are only allowed to spend P10 per voter; P3 per voter for an individual candidate supported by political party; P5 per voter for an individual candidate not supported or nominated by political party; and P5 per voter for political parties.

Given the 54 million registered

voters and an additional budget of P5 per registered voter for political parties, a presidential or a vice-presidential bet can spend a maximum of around P800 million for campaigning.

Fraud waiver under INA Section 237(a)(1)(H) Immigrants sometimes find themselves in immigration removal proceedings (deportation) because they have obtained their green cards through fraud and or misrepresentation. A common example would be married children of US citizens who lie to the US Embassy about their marital status by stating that they are single in order to obtain permanent residency. Another common example would be a married person who misrepresents her status as single to the US Embassy or USCIS in order to obtain a green through a petition from a new US Citizen spouse.

These immigrants could have their green cards revoked and later on placed in removal proceeding by the USCIS should the government find out about the fraud or misrepresentation. The USCIS (formerly INS) usually discovers the fraud when the immigrant tries to petition another relative or when the immigrant tries to apply for US Citizenship.

However, there are certain relief available in immigration court for such immigrants who are the immediate relatives of either a US Citizen or Permanent Resident.

This is the fraud waiver under INA §237(a)(1)(H). The waiver of removal provision under INA §237(a)(1)(H), 8 USC 1227(a)(1)(H), specifically states: (H) Waiver authorized for certain misrepresentations. The provisions of this paragraph relating to the removal of aliens within the United States on the ground that they were inadmissible at the time of admission as aliens described in section 212(a)(6)(C)(i) [8 USC §1182(a) (6)(C)(i)], whether willful or innocent, may, in the discretion of the Attorney General, be waived for any alien (other than an alien described in paragraph (4) (D)) who â&#x20AC;&#x201C; (i) is the spouse, parent, son, or daughter of a citizen of the United States or of an alien lawfully admitted to the United States for permanent residence; and (ii) was in possession of an immigrant visa or equivalent document and was otherwise admissible to the United States at the time of such admission except for those grounds of inadmissibility specified under paragraphs (5)(A) and (7)(A) of section 212(a) [8 USC §1182(a)(5)(A), (7)(A) ] which were a direct result of that fraud or misrepresentation.

A waiver of removal for fraud or misrepresentation granted under this subparagraph shall also operate to waive removal based on the grounds of inadmissibility directly resulting from such fraud or misrepresentation.

Statutory eligibility for the §237(a) (1)(H) waiver is established by an alien who having entered the United States by fraud or misrepresentation, whether willful or innocent, after having obtained an immigrant visa or equivalent document, and is the spouse, parent, son or daughter of a United States citizen or lawful resident alien.

Once statutory eligibility is established, the waiver is granted in the exercise of the Attorney Generalâ&#x20AC;&#x2122;s discretion.

For an alien in removal proceedings, the determinations of statutory eligibility and favorable exercise of discretion are made by an immigration judge. 8 C.F.R. §240.11(d). furthermore, unlike most other immigration petitions and applications, as well as most other forms of relief from removal or deportation, there is no formal application or fee required in order to request the §237(a)(1)(H) waiver.

It is well established that the §237(a) (1)(H) waiver is available to cure removability and deportability for an alien whose permanent residence was obtained by misrepresenting his/her marital status, despite the fact that s/he would not have qualified for the immigrant status accorded and never would have been accorded that status had the true facts been known. Casem v. INS, 8 F.3d 700 (9th Cir. 1993) In exercising discretion over a § 237(a) (1)(H) request, the fraud or misrepresentation for which the alien seeks forgive-

ness is to be considered in the balancing of positive and negative factors when determining whether the waiver is merited in the Attorney Generalâ&#x20AC;&#x2122;s discretion.

Matter of Tijam, Interim Decision 3372 (BIA 1998) Adverse factors may include the nature and underlying circumstances of the fraud or misrepresentation involved; the nature, seriousness, and recency of any criminal record; and any other additional evidence of the alienâ&#x20AC;&#x2122;s bad character or undesirability as a lawful permanent resident of the United States. Favorable considerations may include family ties in the United States; residence of a long duration in this country, particularly where it commenced when the alien was young; evidence of hardship to the alien or her family if deportation occurs; a stable employment history; the existence of property or business ties; evidence of value and service to the community; and other evidence of the alienâ&#x20AC;&#x2122;s good character. Hernandez-Robledo v. INS, 777 F.2d

536 (9th Cir. 1985); see also Matter of Mendez-Moralez, Interim Decision 3272 (BIA 1996).

In addition, equities which were achieved as a result of the fraud or misrepresentation cannot be discounted despite the illegality of the immigrant status obtained. Discounting of lengthy residence and employment as favorable factors is improper: â&#x20AC;&#x153;the inquiry is not into the illegality of his or her presence in the United States but the reasons that an alien should be allowed to stay, despite the illegality. Discounting of child born in the United States as a result of having immigrated fraudulently also has been held impermissible. Casem v. INS, supra In addition, the Supreme Court has recently held that repetitions or other instances of the fraud that was used to obtain entry in other immigration-related contexts which are â&#x20AC;&#x153;removed in time and circumstance from respondentâ&#x20AC;&#x2122;s entryâ&#x20AC;? can be considered as adverse discretionary factor(s). Yang v. INS, 96 Daily Journal D.A.R. at 13633. This means that the immigration judge must weigh such additional instances of fraud â&#x20AC;&#x201C; as with any other adverse factors â&#x20AC;&#x201C; against the equities, hardships and any other positive factors.

Should the immigration judge grant your waiver application, after balancing all the equities against the adverse fac-

tors discussed above, the immigration judge may terminate your removal case and let you keep your permanent resident status. The effect of your waiver would be retroactive to the time that you first obtained your permanent resident status.

Credit score education Educating my readers about how to work on getting their credit good enough to buy a house is always important. Credit debts are not the enemy. It’s just that many people have never been taught how to use them properly. They are not cash, but they are a great tool for moving your credit score higher, if not used correctly it will lower your credit scores. So don’t cut them up just yet, learn how to use them.

When it comes to credit limits, you should view their limits as just 20% of whatever the card’s state limit is.

If a card is used for business but paid in full each month, that’s completely fine. Many of you pay your bills when they come in the mail. But credit companies typically report seven to ten days before bill arrives. That’s why it is so important to know the

date that each credit card reports.

To find this date you can either call them and ask, or see the date they were last uploaded with the credit bureaus.

Once that reporting date is found, try to make payments in full or partial within two to three days before that date, by doing that you should see credit scores increase by 100 points in just a couple of months.

Fico scores might not have been important before 1995, when Fannie

Mae and Freddie Mac first started using them, but today they can be the deciding factor if you can qualify for a loan or not. How many times have you found your scores of 619,670 or 719 – just shy of the mid score you need for a certain loan to get you better pricing?

If you want better scores overall you should focus on your credit information reported within the last 24 months. On the derogatory accounts, look at the date last reported for each credit agency-which often varies among them. On the open accounts, look at the date last reported or updated and also the date of last activity. If no activity has been reported on an open credit care, you should use that card often to bring it back to the mix of what is affecting credit scores, and increase the score quickly. Remember use only about 20 no more than 40% of the limit allowed.

Instead of setting up another new account, see first what you already have and try to improve on it if you can. Opening a new account sometimes will decrease your scores the first few months due to your overall limits and usage. Settling on small accounts would definitely help boost scores, I don’t want to hear that excuse of “those accounts not belonging to you” or “ they are supposed to be

paid by the insurance companies”, if you have small balances that has been on your credit report for a few years, it’s very hard to dispute and you most likely won’t anyways, so why bother. Just pay those accounts and get your bad reporting accounts out of your credit report to get better fico scores.

Clinton’s White House dream stays despite Bernie surge

New York, United States | AFP | Wednesday 2/3/2016 – It may be the narrowest victory in Iowa history, but Hillary Clinton’s win over Bernie Sanders puts her on course to clinch the Democratic nomination even if it’s more of an uphill battle than she once hoped.

The former Secretary of State took 49.8 percent of the vote compared to 49.6 percent for Sanders, allowing her to breathe “a big sigh of relief” in the Midwest heartland that ditched her for Barack Obama eight years ago.

“Make no mistake we are in a fight to the finish,” she told voters in New Hampshire as the Republican field edged into a three-horse race between evangelical Ted Cruz, billionaire Donald Trump and telegenic Marco Rubio.

Sanders, who just months ago posed no threat as a fringe firebrand, declared a moral victory for his brand of progressive politics, brimming with confidence as polls give him a double-digit lead for next week’s primary in New Hampshire.

“For Clinton, it was clearly a case of surviving and advancing,” said Dante Scala, associate professor of political science at the University of New Hampshire, which hosts the next Democratic debate on Thursday.

“That narrow a win – it’s tough to take. I’m sure it’s a sigh of relief... because I think a loss would have gone a long way to changing the conventional wisdom about Sanders’s ability to win the nomination.”

The 74-year-old senator from Vermont has inspired a passionate following among young voters with his Scandinavian-inspired anti-Wall Street, poverty busting, democratic socialist agenda.

Clinton loses youth vote His surge of support may have taken the establishment by surprise, but in Iowa he failed to match what Barack Obama achieved in 2008, when he shocked Clinton by snatch-

ing 37.6 percent of the vote to her 29.5 percent.

“He’s clearly someone to contend with, however I don’t think he managed, though he came awfully close, to shock the national political media with the results and it was in a state where Clinton did lose eight years ago,” said Scala.

Neither would a defeat in New Hampshire ruffle too many Clinton feathers in a predominantly white state neighboring Sanders’s home base of Vermont.

“They never voted against anybody from next door except when an incumbent president asked them to do something else,” Clinton’s husband, former president Bill noted drily at the start of the week.

What is more unsettling, say some, is the support Sanders enjoys among moderate, blue collar Democrats in New Hampshire traditionally expected to vote Clinton.

Perhaps most disconcerting for Clinton in Iowa, was Sanders’s crushing victory among Democratic voters aged 17 to 29, who gave him 84 percent of their vote.

The 68-year-old Clinton – by contrast – did best among caucusgoers aged 65 and over, a turnout likely to fuel criticism that her message shaped during two decades on the public stage is not geared toward the future.

Elite, minorities back Clinton But the more decisive test will come in racially diverse states in the west and south, such as Nevada and South Carolina, where Clinton’s support among blacks and Latinos is expected to defeat Sanders on February 20 and 27.

“If you look at the national polls thus far, she is pretty consistently and noticeably ahead of Bernie, although the gap is narrower,” said Robert Shapiro, political science professor at Columbia University.

“If Sanders can do better than expected in those places, he is going to be in for the long haul.”

Aquino may order pay hike for govâ&#x20AC;&#x2122;t workers sans SSL, Drilon says MANILA, Feb 3 (Mabuhay) â&#x20AC;&#x201C; Even without the passage of the proposed Salary Standardization Law (SSL), President Benigno Aquino III may order a salary increase for the 1.3 million government workers this year, Senate President Franklin Drilon said on Wednesday.

Drilon made such recommendation as he revealed that the proposed measure remained â&#x20AC;&#x153;stuckâ&#x20AC;? in the congressional bicameral conference committee over the indexation issue on the salary increases of the active personnel in the Armed Forces of the Philippines (AFP) and the police. â&#x20AC;&#x153;Well, unfortunately itâ&#x20AC;&#x2122;s stuck in the bicam as we talk. We passed the Salary Standardization Law, the issue there is the indexation of the salary increases of the active personnel in the armed forces and the police indexed to the retirement pension to the pension of those who are retired so if the salary increase in the active service, say P1,000, those retired also gets P1,000,â&#x20AC;? he said in an interview over ANC.

The indexation of the salary increases for the military and police personnel, he said, would mean another P20 billion to the P58 billion budget allotted to raise the pay of state workers in 2016.

Drilon explained that unlike government workers, the pension system for the armed forces and the police is â&#x20AC;&#x153;non-contributory.â&#x20AC;? â&#x20AC;&#x153;Not like an ordinary government employee, they (the military and police personnel) will contribute to the GSIS (Government Service Insurance System).

They are not covered by the GSIS and itâ&#x20AC;&#x2122;s the budget which pays for the pension so this must be resolved,â&#x20AC;? he said.

However, while the issue is being resolved, Drilon said the president can raise the pay of government workers at least for a year. â&#x20AC;&#x153;My recommendation is that letâ&#x20AC;&#x2122;s increase the salaries of our workers in government for just one year while weâ&#x20AC;&#x2122;re reviewing this very difficult issue,â&#x20AC;? he said.

Top universitiesâ&#x20AC;&#x2122; profits double under Aquino term: youth group MANILA, Feb 3 (Mabuhay) - A militant youth group claimed on Wednesday that profits of some of the countryâ&#x20AC;&#x2122;s top private universities have nearly doubled under the term of President Benigno Aquino III - a sign, they said, of the â&#x20AC;&#x153;commercializedâ&#x20AC;? nature of the countryâ&#x20AC;&#x2122;s educational system.

Citing annual financial statements gathered from the Securities and Exchange Commission (SEC), Kabataan party-list said that five universities - Far Eastern University (FEU), University of the East (UE), Lyceum of the Philippines University (LPU), University of Santo Tomas (UST), and De La Salle University (DLSU) - have increased their revenues and profits in a span of five years.

The youth group said that FEU posted an 81 percent profit growth: from P713 million in 2010 to P1.08 billion in 2015. The LPU posted 140 percent growth in its profits in the past five years: from P272.6 million

in 2010 to P657.6 million in 2015.

The Manila-based UE also grew its net profit by 30 percent, from P352.3 million in 2010 to P463.5 million in 2015.

Considerable increases in net revenue were also posted by non-stock, non-profit universities like DLSU and UST: DLSU recorded a 62-percent growth from P381.9 million in 2010 to P734 million in 2015, while UST increased its net revenue from P941 million in 2010 to P1.3 billion in 2015.

Meanwhile, tuition rates have also soared in the past five years both in the private and state universities.

In state universities and colleges (SUCs), tuition collection has increased by 55 percent, from P5.3 billion in 2010 to P8.1 billion in 2015.

National Union of Students of the Philippines (NUSP) president Sarah Elago assailed the increase in profits in some universities, saying that these schools have turned education into a â&#x20AC;&#x153;lucrative business.â&#x20AC;?

The President made the statement during the 65th anniversary of the Department of Social Welfare and Development (DSWD), which implements the said flagship anti-poverty program of the government.

The government increased the 2016 budget for the CCT, or the Pantawid Pamilyang Pilipino Program (4Ps), to P62.7 billion to cover 4.6 million households.

The government’s official web portal defines the 4Ps as “a human development measure of the national government that provides conditional cash grants to the poorest of the poor, to improve the health, nutrition, and the education of children aged 0-18.”

The program is patterned after the CCT schemes in Latin American and African countries, which the government said have lifted millions of people around the world from poverty.

Aquino said the CCT’s success will further extend to the youth after the government broadened the program’s coverage to include high school students from indigent families.

Also at the anniversary, the President announced a P10,000 “milestone” bonus for employees of the DSWD. Aquino also touted the transformation of the DSWD’s image to an agency perceived to be ready and prepared to respond to calamities.

“Kapag sinabing DSWD, ang agad nang maiisip: handang-handa at alisto. Kababalita pa lang na may paparating na bagyo, automatic na ang prepositioning ng ayuda.

Nariyan ang buong ahensiya, kumpleto ang datos, para makapaghanda nang tama at maayos,” he said.

But Aquino admitted that the disaster response of the government is far from perfect, citing the Yolanda tragedy in 2013 wherein prepositioned goods were ransacked in warehouses, and first responders in local communities were also affected by the typhoon.

“Ito po, inaaral natin, kasama ng iba pang puwedeng maisaayos, para higit pang mapabuti ang serbisyo sa ating mga Boss,” he said.

The President was also all praises for Secretary Corazon “Dinky” Soliman, who he said was on call “25 hours” a day, eight days a week, without overtime pay and incentive bonus. (MNS)

Growing number of children in migrant sea crossings: UN Geneva, Switzerland | AFP | Tuesday 2/2/2016 – Children now make up more than one third of the migrants and refugees making the perilous sea journey from Turkey to Greece, marking a sharp increase in recent months, the UN said Tuesday.

“Children currently account for 36 percent of those risking the treacherous sea crossing between Greece and Turkey,” the UN children’s agency UNICEF said.

And for the first time since the start of the migrant crisis in Europe, there are now more women and children crossing the border from Greece to Gevgelilja in Macedonia than adult males, spokeswoman Sarah Crowe told reporters.

“Children and women on the move now make up nearly 60 percent,” she said.

That compares to June last year, when 73 percent of the migrants on the move were adult males, and when only one in 10 were under the age of 18, she said.

“The implication of this surge in the proportion of children and women on the move are enormous,” said Marie Pierre Poirier, UNICEF’s special coordinator for the refugee and migrant crisis in Europe.

“It means more are at risk at sea, especially now in the winter, and more need protection on land,” she said in a statement.

Underlining her point, the International

Organization for Migration said Tuesday that 60 children were among the 272 who died trying to cross from Turkey to Greece by sea in January.

On Tuesday, the Turkish coastguard recovered the bodies of nine migrants, including two babies, after their boat sank.

Large numbers of minors have also arrived in Europe unaccompanied, leaving them vulnerable to trafficking.

On Sunday, EU police agency Europol said more than 10,000 unaccompanied children had disappeared in Europe over the past two years, warning many risked being criminally exploited.

Crowe lamented the lack of clarity around the fate of many migrant children.

This “is really a failure of child protection systems across the region,” she told AFP in an interview Monday, referring to Europe.

“Procedures need to be a lot faster and children need to be part of that process so they don’t fall through the cracks and they do not fall prey to smugglers and traffickers,” she said.

In January, almost 62,200 migrants and refugees entered Europe through Greece, the IOM said. Nearly 20,000 of the arrivals, who came mainly from Syria, Afghanistan and Iraq, were unaccompanied minors, the organization said.

WHO declares global health emergency over Zika situation Geneva, Switzerland | AFP | Monday 2/1/2016 – The World Health Organization on Monday declared that a surge in serious birth defects in South America was “strongly suspected” of being caused by the Zika virus and constituted an international health emergency. “We need to take action,” WHO chief Margaret Chan told reporters in Geneva. The UN health body said that a surge in cases of microcephaly – a devastating condition in which a baby is born with an abnormally small head and brain – was likely caused by the mosquito-borne Zika virus and declared the situation a “public health emergency of international concern.”

Chan said a meeting of global health experts who make up the agency’s emergency committee had agreed “a causal relationship between the Zika infection during pregnancy and microcephaly is strongly suspected, though not scientifically proven.”

“All agree on the urgent need to coordinate international efforts to investigate and understand this relationship better,” she said.

“The experts also consider patterns of recent spread and the broad geographical

distribution of the mosquito species that can transmit the virus, the lack of vaccines and rapid and reliable diagnostic tests and the absence of population immunity in newly affected countries were ... further causes for concern,” Chan said.

“The clusters of microcephaly and other neurological complications constitute an extraordinary event and a public health threat to other parts of the world,” she said.

WHO warned last week that the mosquito-borne virus was “spreading explosively” in the Americas, and said the region could see up to four million Zika cases this year alone.

The WHO is under pressure to act quickly in the fight against Zika, after admitting it was slow to respond to the recent Ebola outbreak that ravaged parts of west Africa.

In addition to microcephaly, Zika is also believed to be linked to a neurological disorder called Guillain-Barre syndrome.

The virus is transmitted by the Aedes aegypti mosquito, which also spreads dengue fever and the chikungunya virus. It produces flu-like symptoms including a low-grade fever, headaches, joint pain and rashes.

And he bemoaned a drop in the number of people signing up for a religious life, but warned against taking just anyone.

“Why is the womb of consecrated live becoming so sterile?” he asked.

“Some congregations experiment with ‘artificial insemination’. What do they do? They welcome... ‘Yes come, come, come’. And then there are problems,” he said.

“No. We must be serious about who we take. We must clearly distinguish if it is a real vocation, and help it to grow.”

Death penalty to drug lords The illicit drug trade in the Philippines has grown bigger and its operations becoming more sophisticated thereby making it difficult for law enforcers to make significant strides in its campaign against organized crimes.

Law enforcers even admitted during a recent Senate hearing that drug lords have devised a myriad of methods to ensure the efficient and safe delivery of their illegal drugs all over the Philippines.

It is a known fact that many parts of the country, particularly large areas of Metro Manila, are awash with illegal drugs and more people are becoming scared and insecure even inside the sanctuary of their homes for possible drug-related break-ins.

The police, most often than not, seemed overwhelmed by the high incidence of drug-related crimes in the country, with the exception of Davao city which is the turf of presidential candidate Rudy Duterte.

Duterte and his vigilante groups have reportedly been exterminating drug lords and drug addicts that they collar in Davao city. This however, cannot be verified by Human Rights officials and Philippine courts due to the absence of witnesses willing to testify.

Weeks ago, Duterte warned that unless the government addresses the problem, the Philippines might eventually become a narco state in the near future.

Duterte said the government has to bring back the death penalty for drug traffickers and smugglers and to impose more jail time for drug offenders, particularly recidivists.

What makes it worse, according to Director General Arturo Cacdac Jr,

head of the Philippine Drug Enforcement Agency (PDEA), agents are stymied in their relentless campaign against the illegal substance due to alleged connivance of some corrupt elected officials and police officers in protecting and coddling drug lords.

During a Senate hearing on illegal drugs, the PDEA chief pointed out to lawmakers that out of 1,821 arrest made by PDEA agents on “high value” drug personalities, 63 of them were elected councilors and barangay captains, 31 policemen and 103 government employees. These rogue officials and government employees were arrested in buy-bust operations.

I hope Congress will consider bringing back the death penalty, as proposed by Duterte, to act as a deterrent to members of organized crime and to put a stop to their illicit trade. *** Nonagenarian Senator Juan Ponce Enrile, as expected, was able to prove the direct participation of President Aquino in the planning and operation of “Oplan Exodus” which resulted in the slaying of 44 police commandos in Maguindanao last year.

During the re-opening of the Senate investigation of the Mamasapanoi massacre, Enrile said Aquino disregarded the chain of command of the AFP and the PNP by assuming complete responsibility in the botched police operation to bag a Muslim terrorist.

Enrile also chided Aquino from hiding under the “skirt” of his friend, Suspended PNP chief Alan Purisima, to evade liability for his stupidity, ineptness and lack of leadership.

Aquino made Purisima head of “Oplan Exodus” despite being suspended by the Ombudsman. Purisima has numerous graft cases pending with the Ombusdman.

Enrile also castigated the president for excluding members of his cabinet, including officers of both the AFP and the PNP in the planning and execution of “Oplan Exodus” to capture Malaysian terrorist Zulkifli Bin Mir alias “Marwan.” Although Marwan was eventually terminated, 44 SAF commandos were killed during several hours of firefight with Muslim rebels. Marwan was in the Most Wanted list of the FBI with a $5 million reward for his capture, dead or alive.

During the same hearing, Enrile took a swipe at presidential candidate Grace Poe Llamanzares saying that her report did not have sufficient facts to show that Aquino was respon-

sible in the Mamasapano incident.

He belittled the report, claiming that it was merely conclusions. He pointed out that in criminal law, one has to deal with facts and not conclusions.

Enrile also brushed aside speculations that he sought for the re-opening of the Mamasapano tragedy to “even up” the score with Aquino for sending him to jail for his questionable projects funded by DAP and PDAF. I, for one, sincerely believe that his motive was to seek justice for the families of the slain 44 police commandos. During his tenure as Secretary of Defense of former President Ferdinand Marcos, Enrile developed a strong bond with the military as well as with the police.

I think that his closeness with Filipino soldiers made him survive and eventually succeed in the 1986 people’s revolt which drove Marcos out of Malacañang. Enrile was also a key figure in the numerous coup attempts made by the military to unseat former President Corazon after the Marcos downfall.

The two have worked together on several projects, including “Diary Ng Panget,” “Wang Fam,” and their newest movie together “Girlfriend For Hire.” – and while they find each other attractive, too – they remain friends, nothing more and nothing less.

Like what many of the young stars say these days, the focus is on career.

“We’re focusing on work. What’s good about it is maganda ’yung feedback ng mga fans kasi as artists, we really want to entertain people. I’m really happy they love it. Sa pagka-develop (sa isa’t-isa), wala pa kasi we’re focused on our work muna,” Andre said at the press conference of “Girlfriend For Hire.”

Yassi said their busy schedules keep love at bay.

While she sees Andre as “gwapo, matangkad, mabait” she said, “Mahirap po kasi sa schedule namin ngayon. So sa work lang kami nagkakasama. Minsan pumupunta siya kasama ’yung friends ko. Pero hindi siya ’yung every day na kailangan naming mag-spend ng time together kasi grabe din ‘yung (taping schedule ng) soap niya at events namin.”

The Viva artist said she is “in

love” but with family and work, not with any man. After going through a heartbreak before, Yassi has become more cautious in falling in love and having a relationship.

“Mahirap ma-in love. Na-in love na ako dati nang grabe kaya po kailangan na bago ka mag-desisyon na mai-in-love ka, dapat you’re 100 percent sure. Hindi pwedeng padalos-dalos.

Ingat-ingat din sa puso. Madaling ma-in love pero madali din masaktan kaya dapat choose wisely.”

Aside from his love team with Yassi, Andre also has a love team with Barbie Forteza on “That’s My Amboy.” Yassi doesn’t mind that Andre has another onscreen partner. “’Yung sa amin ni Andre, ’yung suporta ng fans namin laging andiyan.

Kahit ’yung simula pa lang, andiyan sila palagi. Siguro ‘yung blessing kay Andre, mas nakikita ko ’yung love team nila as a blessing for him. Ang dami nilang projects. Sabi ko nga, ‘Ang gwapo kasi ng (ka-)love team ko, in-demand siya.’ Hindi ko siya nakikita na conflict,” she said.

AARP unmasks ‘Fearless at 50’ Filipina Roxanne Cai WASHINGTON, D.C., February 2, 2016 – Recognizing the milestone 50 represents, AARP recently launched “Fearless at 50,” a campaign to celebrate real people who are challenging outdated perceptions of what it means to be 50 and over.

The campaign features real people boldly trying new things or just feeling good about who they are in video vignettes. Roxanne “Rock N Roll” Cai co-founded The Initiative, a group working to fight crime, help the needy, and make the San Francisco Bay Area a safer place – all dressed as superheroes. The volunteer group organizes food and clothing drives, used needle-pickups, and street patrols.

“We are activists who sometimes wear costumes. Our tagline is we try to save the world one deed at a time,” said Cai, who immigrated to the U.S. from Manila when she was two years old. “When I joined this Real Life Super Hero community, I knew that there was a big emphasis on costumes, and that was very appealing to me. It’s fun to dress up in costumes and in masks and capes!”

“Passing age 50 is often a big

PHL jumps six notches in Heritage Foundation’s 2016 index of economic freedom WASHINGTON, D.C. – The 2016 Index of Economic Freedom released today by the Heritage Foundation reaffirmed economic freedom in the Philippines, and recognized notable success in monetary freedom and management of public finance.

The Philippines improved to 70th place in 2016 from 76th in 2015 in the annual survey of 186 countries published since 1995 by the Heritage Foundation, a Washington-based think-tank.

The 2016 Index continued to grade economies based on 10 independent factors called Economic Freedoms, and the Philippines showed improvements in business freedom (+7.7); freedom from corruption (+2.0); and trade freedom (+1.0).

The Philippines achieved an Economic Freedom Score of 63.1 out of a possible 100, which is above the global and regional averages. The Philippines ranked 14th among the countries in the Asia-Pacific that were surveyed.

“The Philippines welcomes the release of the 2016 Index of Economic Freedom. Its improvement

by another six notches in the global ranking this year captures the sense of endless possibilities and potential that imbue the Philippine economy today under the leadership of the President, the steady and prudent economic management of the economic managers, as well as the leadership and hard work of the rest of the Cabinet, who have restored our government agencies to professionalism and institutional integrity,” said Philippine Ambassador Jose L. Cuisia, Jr. In the report, the Heritage Foundation observed that “the Philippine economy has been growing steadily at an average annual rate above 6 percent for the past five years. The government has pursued legislative reforms to enhance the entrepreneurial environment and develop a more vibrant private sector to generate broader-based job growth.”

While noting the problems of poor infrastructure, lingering institutional challenges, and the lack of dependable enforcement of the law, the Heritage Foundation also highlighted a number of positive de-

velopments. It recognized that public debt has been maintained below 40 percent of GDP, and budget deficits were controlled. The time involved in dealing with licensing requirements for new business has been notably reduced, and the cost of completing them has been cut. It also said that the financial sector, which is gradually modernizing, remains relatively stable and sound.

The Index measures economic freedom based on 10 quantitative and qualitative factors grouped under four broad categories or pillars – rule of law, limited government, regulatory efficiency, and open markets.

Based on an aggregated score, each of the 186 countries graded in the Index are classified as “free” (with a score of 80 or higher), “mostly free” (70-79.9), “moderately free” (60-69.9), “mostly unfree” (50-59.9), or “repressed” (under 50).

In previous years, the Philippines was under the “mostly unfree,” but it has returned to the “moderately free” category during the Aquino administration.

Ambassador Cuisia again thanked

the Heritage Foundation for its transparency and objectivity in receiving information and data from the Embassy and other Philippine agencies.

UC launches DREAM Loan Program to help undocumented students More than 3,000 undocumented undergraduate students will have access to a system-wide student loan program for the first time as the University of California implements the California DREAM Loan Program it sponsored, UC President Janet Napolitano announced last Friday.

The financial aid offices of UCâ&#x20AC;&#x2122;s nine undergraduate campuses will be reaching out to undocumented AB 540 undergraduates with offers of loan assistance through the program, now available for the 2015-2016 academic year.

Under Assembly Bill 540, qualifying undocumented students are charged resident fees and exempted from out-of-state supplemental tuition. â&#x20AC;&#x153;By reducing barriers and expanding access to higher education for undocumented students, the University of California is investing not only in the future of these students, but also

in the future of our state and nation,â&#x20AC;? said Napolitano.

The DREAM loan program, proposed by Napolitano in 2014, was authorized that same year when the Legislature passed SB 1210, authored by state Sen. Ricardo Lara.

Funding was not made available until this academic year.

The initial $5 million for the California DREAM Program, equally funded by the University of California and state general funds appropriated to UC, will be distributed according to need across campuses. â&#x20AC;&#x153;The DREAM loan program will grow our college-educated workforce and make good on the promise that a college degree is possible for all hard-working, qualified California students regardless of their immigration status,â&#x20AC;? Lara said.

Under current law, undocumented students who graduate from a California high school and meet the California DREAM Act requirements are

eligible for state and university aid.

Their undocumented status, however, disqualifies them from receiving federal aid, which severely limits their access to student loans. In addition, they have difficulty accessing private loans. â&#x20AC;&#x153;This new program will reduce that gap,â&#x20AC;? said Napolitano. â&#x20AC;&#x153;It will

help even the playing field for undocumented students struggling to make ends meet.â&#x20AC;?

Some campuses have eased the financial burden on undocumented students with case-by-case loans from the institution, but the DREAM program provides assistance across the UC system.

Two US generals in favor of the draft for women

Washington, United States | AFP | Tuesday 2/2/2016 â&#x20AC;&#x201C; American women should be required to register for the draft, two top military officials said Tuesday, following the Pentagonâ&#x20AC;&#x2122;s decision to open all jobs including elite commando positions to females.

Though the US military has been an all-volunteer force since near the end of the Vietnam War, in 1973, all men aged 18-25 must nonetheless register for the draft in case of a national crisis and re-institution of conscription.

After Pentagon chief Ashton Carter in December announced a â&#x20AC;&#x153;No Exceptionsâ&#x20AC;? decision to unlock every occupation in Americaâ&#x20AC;&#x2122;s vast military to women, lawmakers and observers have wondered if it is only fair they register for the draft, too.

Speaking at a Senate Armed Services Committee hearing, top generals from both the Army and the Marine Corps said it was time for women to be eligible for the socalled selective service. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s my personal view that, based on this lifting of restrictions for assignment ... that every American whoâ&#x20AC;&#x2122;s physically qualified should register for the draft,â&#x20AC;? said General Robert Neller, the com-

mandant of the Marine Corps.

Army General Mark Milley made a similar statement, saying â&#x20AC;&#x153;all eligible and qualified men and women should register for the draft.â&#x20AC;? Some gender equality advocates argue the current law is sexist, and a menâ&#x20AC;&#x2122;s-rights group in San Diego is suing the government to change it.

Currently, the government website through which young men sign up retains its male-only language telling people to register. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s what a manâ&#x20AC;&#x2122;s got to do. Itâ&#x20AC;&#x2122;s quick, itâ&#x20AC;&#x2122;s easy, itâ&#x20AC;&#x2122;s the law,â&#x20AC;? the site states, while noting there has been no decision to require females to be subject to a future military draft.

Democratic Senator Claire McCaskill, who raised the issue at the hearing, said she would like to see women register. â&#x20AC;&#x153;Asking women to register as we ask men to register would maybe possibly open up more recruits as women began to think about ... the military is an option for me,â&#x20AC;? she said.

Milley noted that the first female recruits would likely arrive for infantry and armored basic training at the Armyâ&#x20AC;&#x2122;s Fort Benning in Georgia in the fall.

PNU honors Tokyo alumna, 15 others

A Language professor, who is also a school administrator in Tokyo, Japan, was among the 16 Eminent Alumni recently honored by the Philippine Normal University (PNU).

A PNU Plaque of Recognition was awarded last month to Aurel Feir Shimo, Director Principal at Komazawa Park International School and a foreign language instructor at Waseda University. She is also a curriculum consultant and education researcher. Shimo, who graduated Cum Laude of PNU Class 1966, also holds the distinction as the first female Filipino to become an international school administrator.

The awardee said â&#x20AC;&#x153;she felt goodâ&#x20AC;? and â&#x20AC;&#x153;was overwhelmedâ&#x20AC;? when the PNU informed her that she would join the list of 16 alumni who will be honored for their achievements in their respective teaching careers. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s a recognition of a lifetime of hard work and dedication to my

career,â&#x20AC;? Shimo told Weekend Balita.

Shimo spent 14 years teaching in the Philippines. She later migrated to Japan after marrying a Japanese national and practiced her profession there for 26 years.

The Filipina professor added that her experience in Tokyo bear out to the outstanding qualities of Filipinos, who she said â&#x20AC;&#x153;excel wherever they go.â&#x20AC;?

Shimo teaches Filipino language at the Waseda University as part of its project to prepare students to learn the language of a host count where they are bound for an immersion tour.

According to her, there is a strong enthusiasm among Filipino-Japanese kids to learn not only the language but as well as the culture of the country where one of their parents came from. â&#x20AC;&#x153;It is good that Filipino culture has been integrated in the language course,â&#x20AC;? Shimo said.

PAL announces the launching of its non-stop LAX-Cebu flight on March 15

LOS ANGELES -- Philippine Airlines is expanding its United States service with the launching of its non-stop flight from Los Angeles to Cebu, an executive of the Philippines’ national flag carrier announced.

The launch of the flights between Cebu and Los Angeles coincides with the airline’s 75th founding anniversary on March 15, said Jemma Saranillo, PAL Los Angeles Sales Manager during the Roadshow Presentation held at the Millennium Biltmore Hotel in Los Angeles last Wednesday, February 3.

According to Ms. Saranillo, PAL will utilize its 254-seater Airbus A340 for the Cebu-Los Angeles flights. The Airbus A340 is equipped with a 36-lie flat business seats and 218 economy-class seats.

This new direct flight from Los Angeles to Cebu will provide travellers to either Visayas or Mindanao the convenience of having to travel without stopping in Manila. Cebu is a short stop to any point in the Visayas and Mindanao, as well as to Palawan.

No less than Consul General Leo Herrera-Lim endorsed Philippine Airlines. “PAL is the best carrier if you are travelling to the Philippines,” he said, citing the many advantages of taking PAL’s non-stop flights to the Philippines.

While Philippine Airlines expects strong traffic from Filipino travelers and balikbayans for the Los Angeles-Cebu flight, the Philippine Department of Tourism sees this development as a great opportunity to further promote Cebu as a tourist destination.
