MANILA, Feb. 17 (PNA) – The Department of Justice (DoJ) on Friday filed three counts of illegal drugs charges before the Muntinlupa City Regional Trial Court (RTC) against Senator Leila De Lima and several others in connection to her alleged involvement in the illegal drugs trade inside the New Bilibid Prison (NBP) in Muntinlupa City. In a press conference held at National Bureau of investigation (NBI), Justice Secretary Vitaliano Aguirre said no arrest warrant yet will be issued against De Lima since the case will be raffled at Muntinlupa RTC on Monday afternoon. De Lima was charged before the Muntinlupa City Regional Trial Court for violation of Section 5 (sale and trading of illegal drugs) in relation to Section 3 (jj); Section 26 (b), and Section 28 (criminal liability of government

officials and employees) of Republic Act 9165 or the Comprehensive Dangerous Drugs Act of 2002. MANILA, Feb. 14 (PNA) – The Philippines has been chosen as one of the best countries in the world for raising family, Presidential Spokesman Ernesto Abella announced on Tuesday. In a press briefing, Abella said the survey was conducted by InterNations, the world’s largest network for expatriates of people who live and work abroad, which was founded in 2007. “The Philippines ranked number 17 in the list of best countries for raising a family,” Abella said. According to the survey, the Philippines is also one of the best in the world for quality education and being a place that has a friendly

attitude towards children. “Accessible education is priority for the Duterte administration and the DepEd was given the highest increase of 31 percent in this year’s budget (PHP3.35 trillion),” Abella said. PAL Clark hub launches new flights to Cebu, Davao, Puerto Princesa

After opening Clark – Boracay (Caticlan) – Cebu and Clark-Incheon flights in mid-December 2016 and first week of January 2017, respectively, Philippine Airlines is ramping up operations in its Central Luzon hub. Starting January 30, 2017, PAL will begin operating non-stop flights between Clark and Cebu four times weekly (Monday/Wednesday/Friday/ Sunday). PR837 departs Clark at 7AM and arrives in Cebu at 8:15AM; PR838 leaves Cebu at 8:55AM and

touches down in Clark at 10:10AM. On the same day (January 30), PAL will also start non-stop service between Clark and Davao thrice weekly (Wednesday/Friday/Sunday). Departure from Clark on PR831 will be at 10:50AM and arrival in Davao will be at 12:45PM; PR832 departs Davao at 1:25PM and arrives in Clark at 3:15PM. Trump to issue new executive order on immigration WASHINGTON, Feb.17 (PNA/Xinhua) – U.S. President Donald Trump said Thursday he will rescind his controversial executive order temporarily barring entry to refugees and immigrants and replace it with a new one next week. “The new order is going to be very much tailored to what I consider to be a very bad decision,” said Trump during a news conference in the White House, referring to a decision by the Ninth Circuit Court of Appeals that blocked his travel ban earlier this month. The travel ban is aimed at what the president said to keep out “radical Islamic terrorists.” “We are issuing a new executive action next week that will comprehensively protect our country,” Trump said. Also on Thursday, the Department of Justice asked the Ninth Circuit Court of Appeals not to review a decision by a three-judge panel to keep the immigration policy on hold while it moves through the legal system, citing plans to soon replace the order with a “superseding” one. “Rather than continuing this litigation, the president intends in the near future to rescind the order and replace it with a new, substantially revised Executive Order to eliminate what the panel erroneously thought were constitutional concerns,” the department said in a document to the court of appeals. “In so doing, the president will clear the way for immediately protecting the country rather than pursuing further, potentially time-consuming litigation,” it said. PAL to open 8 new domestic routes The domestic route expansion of Philippine Airlines continues with the opening of eight new routes – from Clark and Cebu – in the first quarter of 2017. Meanwhile, the four new routes out of Cebu begin March 26. Cebu-Puerto Princesa flights will be four times a week; Cebu-General Santos three times a week; Cebu-Surigao three times a week; and Cebu-Coron daily. Flights to Puerto Princesa and General Santos will use the 156-seater A320 aircraft. Flights to Surigao will use the 76-seater Q400 while those to Coron will use the Q300. The new routes from Cebu bring to 12 the total number of domestic points, apart from Manila, linked to Cebu. PAL operated its first Manila-Cebu flight in 1946 after World War II. The flag carrier used to operate missionary flights to link the islands and help spur economic development in the countryside.

House leader calls for overhaul of recruitment protocols

MANILA, Feb. 14 (PNA) – A leader of the House of Representatives is calling for a major overhaul of recruitment manuals and protocols following the issuance of the Implementing Rules and Regulations (IRR) for Republic Act No. 10911 or the anti-age discrimination law. In a statement on Tuesday, House appropriations committee chair and Davao City Rep. Karlo Nograles lauded Labor Secretary Silvestre Belo for leading the swift completion of the IRR, saying that RA 10911 will not just promote equality in employment but will also increase the country’s work force. Nograles, one of the proponents of the anti-age discrimination law, said human resource managers and employers should revise the content of their hiring collaterals and adver-

tisements, as well as change their mindset in hiring new employees, especially with the IRR now in place. “This law should not just stop the practice of requiring job applicants to indicate their age in their resumes but it should also end the wrong mindset that old people can no longer contribute to help their families and their communities,� Nograles said. Under the anti-age discrimination law, it now becomes unlawful to require age limitations in employment and it ensures the protection and the equal treatment of all employees and workers, regardless of age in terms of compensation, benefits, promotion, training and other employment opportunities. The law covers all employers, labor contractors, sub-contractors and labor organizations, the government

and all its branches, subdivisions and instrumentalities, all government-owned and controlled corporations, and government financial institutions, as well as non-profit private institutions or organizations. It prohibits an employer from requiring the declaration of age or birth date during the application process, declining any employment application due to individual’s age, discriminating against an individual in terms of compensation, terms and conditions, or privileges of employment on account of individual’s age. It also prohibits the employer to deny any employee’s promotion or opportunity for training because of age, forcibly lay-off on the basis of old age, or impose early retirement on the basis of employee’s or worker’s age.

SC scraps parts of regulation on tax exemptions for minimum wage earners By Christopher Lloyd T. Caliwan

MANILA, Feb. 14 (PNA) – The Supreme Court ordered the Department of Finance (DOF) and the Bureau of Internal Revenue (BIR) to scrap several provisions of Revenue Regulation No. 10-2008 that restrict the enforcement of Republic Act No. 9504 providing tax exemption for minimum wage earners (MWEs) in 2008. In a 56-page decision penned by Chief Justice Ma. Lourdes Sereno dated Jan. 24, the Court granted the consolidated petitions for certiorari, prohibition, and mandamus against such regulation, stating that the DOF and the BIR committed grave abuse of discretion of discretion in promulgating Sections 1 and 3 of RR 10-2008. “Sections 1 and 3 of RR l02008 add a requirement not found in the law by effectively declaring that

an MWE who receives other benefits in excess of the statutory limit of PHP30,000 is no longer entitled to the exemption provided by R.A. 9504,� the SC declared. The SC noted that the increased exemptions were already available much earlier than the required time of filing of the return on April 15, 2009 while R.A. 9504 came into law on July 6, 2008 or more than nine months before the deadline for the filing of the income tax return for taxable year 2008. “Here, not only did R.A. 9504 take effect before the deadline for the filing of the return and payment for the taxes due for taxable year 2008, it took effect way before the close o f that taxable year. Therefore, the operation of the new set of personal and additional exemption in the present case was all the

more prospective,� the Court held. It added that there was nothing in R.A. 9504 that provides or even suggests a prorated application of the exemptions for taxable year 2008. The Court en banc also declared null and void the Sections 1 and 3 of RR No.10-2008 insofar as they disqualify MWEs who earn purely compensation income from the privilege of the MWE exemption in case they receive bonuses and other compensation-related benefits exceeding the statutory ceiling of PHP30,000. �Also declared null and void is the provision in Section 3 that provides for the prorated application of the personal and additional exemptions under R.A 9504 for taxable year 2008, and for the period of applicability of the MWE exemption to begin only on July 6, 2008,� the SC said.

Arroyo pushes for additional tax exemption for elderly care MANILA, Feb. 14 (PNA) – Former President and now Pampanga Rep. Gloria Macapagal Arroyo is pushing for additional tax exemption for taxpayers who care for their elderly parents. Arroyo has filed House Bill No. 1522, which seeks to amend paragraph B of Section 35 of Republic Act No. 8424 or the National Internal Revenue Code (NIRC) of 1997 to include an additional exemption of PHP25,000 for each elderly parent being cared for by a taxpayer. “An additional exemption of PHP25,000 for each elderly parent shall be likewise be allowed to the individual taxpayer: provided, that the elderly parent is chiefly dependent on and living with the taxpayer,� Arroyo stated in her bill. Under the measure, an elderly is defined as any parent who is at least 60 years old with no means of support. The current law allows an individual taxpayer an additional exemption of PHP25,000 for each depending child not exceeding four. Arroyo said this measure seeks to relieve taxpayers who are taking care of their elderly parents from additional tax burden and also allow them to save money which can be used to meet the nutrition, education, medicines and other basic needs of other dependents. Arroyo cited that Republic Act No. 7432 or the Senior Citizens Act had allowed a taxpayer, who is head of the family, to include a senior citizen as a dependent under the NIRC.

MANILA, Feb. 14 (PNA) – The Armed Forces of the Philippines (AFP) is strongly discouraging the payment of ransom to the Abu Sayyaf Group (ASG) as videos of 70-year-old German captive, Juergen Kantner, urging his government to pay the bandit’s PHP30 million ransom demand, were spread all over the Internet. Payment of the ransom will further embolden the terrorists and give them more funds to buy the loyalty of the communities they are hiding in, said AFP public affairs office chief Col. Edgard Arevalo on Tuesday. In the same vein, he said the government does not pay ransom or negotiate with terrorists. Arevalo stressed the military will

exert all efforts to rescue Kantner from his ASG captors. “We will exert all efforts to rescue him (Kantner), especially that we now have continuing operation against the ASG which has been yielding good outcomes, so we are still positive that we will be able to rescue him,� he added. Kantner, in the video, said the bandits are threatening to behead him this coming Feb. 26, around 3 p.m. if the PHP30 million ransom are not paid before that date. Kantner was kidnapped by the ASG bandits while his yacht “Rockall� was cruising off Sulu waters last November. His companion, 56-year-old Sabine Mertz, was allegedly raped and killed by the bandits.

Alvarez stands firm on death penalty for plunder amid anomalous PAGCOR deal MANILA, Feb. 14 (PNA) – House Speaker Pantaleon Alvarez on Tuesday said he has more reason to retain plunder in the list of crimes punishable by capital punishment in the death penalty bill. Alvarez made the comment after the hearing of the House Committee on Good Government on the anomalous PHP3.2 billion lease agreement between the Philippine Amusement and Gaming Corp. (PAGCOR) and Vanderwood Management Corp. He tagged former Pagcor chairman Cristino Naguiat and members of the board as well as former Government Corporate Counsel Raoul Creencia who gave the go signal to the deal. Alvarez urged the House panel led by Surigao Del Sur Rep. Jonny Pimentel to subpoena officials of the original lessee of the property Oceanville Hotel and Spa Corporation, namely Simon Paz, Cornelio Aldon and Mario Leabres. Alvarez wants to find out why Oceanville sub-leased the property to Vanderwood for only PHP300,000 a month, the same amount it pays to the City of Manila which owns the property. Alvarez said the committee will likewise summon former President and now Manila Mayor Joseph Estrada to provide them the opportunity to explain their side. Creencia, in turn, said he gave PAGCOR the discretion to go ahead with the caveat that they should ensure there are no legal impediments against it. Alvarez said Creencia must have taken pains to ensure that the deal complies with the requirement of the law that the “lessor must have absolute ownership of the property�. In an interview after the hearing, Alvarez said he has requested the Good Government committee to look into the possibility for the panel to be the main complainant in filing charges against responsible officials before the Office of the Ombudsman. Alvarez said COA has already issued a directive to halt the deal as it violates the procurement law and is highly disadvantageous to the government.

An afternoon stroll at the expansive Getty Villa A two-hour stroll at the Getty Villa: overwhelmed this author’s friends, Diji Rapista and Trini Esguerra by the collection of Medieval antiquities. The Getty Villa is located in the southerly end of Malibu coast and the Pacific Palisades neighborhood of Los Angeles. It was well worth the drive and cultural time spent inside the museum, as well as outside, where guests are ushered on its iconic entrance, overlooking the courtyard. The Getty Villa is one of the two locations, which is described as “educational center and museum, dedicated to the study of the arts and culture of ancient Greece and Rome.” The museum’s collection has 44,000 Greek, Roman and Etruscan antiquities dating back from 6,500 BC to 44 AD, including the Lansdowne Heracles and its “Victorious Youth.” Oil tycoon J.Paul Getty, opened his museum,in 1954, but when he ran out of space, he built another house adjacent to his museum in the Pacific Palisades area. The design of the Villa was inspired by the Villa of the Papyri at Herculaneum and incorporated additional details from several other ancient sites. The Villa was designed by architects: Robert E. Laughlin, Jr. and Ernest C Wilson, Jr. in consultation with archeologist Norman Neuer-

berg. It opened in 1974, but was never visited by by Getty, who died in 1976. Following his death, the museum inherited $661 million which then helped build the now-famous Getty Center in Brentwood, where portions of the Greek, Roman and Etruscan antiquities were moved for display while then Getty Villa was closed for renovation. In 2004, the museum (Getty Center), and the University of California, Los Angeles (UCLA) started holding educational summer institute programs. The Getty Villa, on the other hand, self-identifies with Malibu as it is located just east of the city limits of Malibu in the City of Los Angeles, in the community of Pacific Palisades. The 64 acre (26 ha) museum complex sits on a hill overlooking ther Pacific Ocean, which is about 100 feet (30 m) from the entrance to the property. It has an outdoor, 2,400 square foot (200 m) of entry pavilion, which is also built into the hill, near the

in honor of Barbara and Lawrence Fleishman. Perched up on the hill above the museum now stands Getty’s private ranch house , which is currently used as curatorial offices, meeting rooms and library. And, not opened to the public is J.Paul Getty’s grave on the hill behind the ranch house. The day we were there, we were amazed at the enormous (44,000) Greek, Roman and Etruscan antiquities dating from 6,500 BC to 400 AD. Among the items that really stood out was the overpowering statue of “ Victorious Youth,” along with jewelry and coin collections, and the expansive architectural plan surrounding the Villa, which was arranged by themes, such as “Goddesses,” “Dionysius and the Theater,” and “”Stories of the Trojan War,” which was conceived by Boston architects Machado and Silvetti Associates, whose design goal, according to the docent, was to “simulate an archeological dig.” For those of you who can spare two hours of cultural experience, admission to the Getty Villa is free when you book for reservations on line as the all tickets are timed. Question: What is a ‘revocable’ Living Trust? Answer: A ‘revocable living trust’ for a single person (including a typical “survivor’s trust” that is revocable by the surviving settlor as described in) will provide for distributions to the settlor during the settlor’s lifetime. With a joint trust there is a substantial possibility that the day will come when both settlors are living but only one of them is competent. A settlor with substantial separate property and children from a prior marriage or partnership who becomes incompetent may be unwilling to allow the competent settlor to make unrestricted withdrawals of the incompetent settlor’s separate property—particularly when community property is available for the competent settlor’s support. Naturally, there should be provisions to explain and pursue this possibility.

Does Trump travel ban aect Filipinos? It seems everyone is on edge regarding the latest executive order announced by US President Trump - and those who are not even on edge can’t help but talk about the newest onslaught of immigration news. Every newspaper in North America, if not the world, has its papers filled with immigration news and who / who can’t enter the USA. Most recently there seems to be a high increase of refugee asylum seekers that are taking taxis to the Canada/USA border and risking their lives in the cold terrain into Manitoba. Earlier, the travel ban of seven designated countries by Trump caused outrage which was eventually struck down by the courts. Whether the president can overrule the courts will be determined later but there is no doubt that the current atmosphere in the Trump administration is to clean up America and to take measures to remove those who are not wanted. In Trump’s defence, he wants to rid of terrorists. That is fine. However, the manner in which he is doing so is the problem. Unfortunately, the train has left the station and Trump is taking many steps to make good on his election promises. One important question that many are asking is if Trump’s immigration policies can affect Filipinos? Yes, they can in several indirect ways. Firstly, if a Filipino national is present in the USA with a criminal record, Trump has announced that steps are being taken to deport such individuals. Filipinos who have no status in the USA are also at risk as Trump’s next overhaul is to eliminate illegal immigration. Finally, a Filipino who is also a Canadian Citizen will be subject to the new law ( Bill C-23 )

introduced by Public Safety Minister Ralph Goodale that is likely to pass in the current sitting of Parliament. The bill solidifies the law of the reciprocal agreement for customs and immigration pre-clearance signed by the governments of Stephen Harper and Barack Obama in 2015. Both houses of Congress passed the U.S. version of the bill in December. Pre-clearance allows Canadian visitors to the U.S. to clear U.S. Customs and Immigration while still in Canada at a Canadian port of departure. Under the proposed law, US immigration officers will have the authority to ask all passengers (even while on Canadian soil) to identify themselves and to answer a series of questions. They can also demand to see your phone and demand your password. Physical searches are also permitted. Now, if a person does not like the way the interview is going, it may not be so easy to just turn around and go home. Passengers now can be held and forced to explain the reasons for leaving, and to explain their reasons for wanting to withdraw. That is the scary part. Another aspect of C-23 is that a CBSA agent posted at a U.S. airport has the right to prevent a permanent resident from boarding a flight to Canada. Wally Sombero Jr., the alleged middleman of Chinese gaming tycoon Jack Lam, from leaving the country since his name is in the list of Immigration Lookout Bulletin (ILBO) list issued by the DOJ last December. Pacquiao admits being friends with Sombero MANILA, Feb. 14 (PNA) – Less than a decade ago, boxer-senator Manny Pacquiao used played poker with retired police Senior Supt. Wally Sombero, who is also alleged as middleman of Macau-based gambling tycoon Jack Lam. Pacquiao on Tuesday confirmed to reporters that he is indeed a longtime friend of Sombero, after the latter claimed so upon his arrival in Manila from Vancouver the same day. “I met him (Sombero) a long time ago. We became friends. We were in the same barkada (circle of friends). We would play poker when I was still gambling. That was a long time ago -- eight or nine years ago,� Pacquiao said. Pacquiao has long quit gambling before entering politics. He also admitted that Sombero would contact him while he was abroad telling him that he feared his return to Manila and at the same time asked for help. “We contacted each other. He texted me. DOF, DTI agree to ease proposed excise tax on cars By Kris M. Crismundo

MANILA, Feb. 14 (PNA) – The Department of Finance (DOF) and the Department of Trade and Industry (DTI) have agreed to ease the proposed excise tax on automotive vehicles, the trade chief said on Tuesday. DTI Secretary Ramon Lopez told reporters that DOF had agreed to give the lowest excise tax adjustment to cars selling at lower price range. DTI is eyeing for 1.0 to 2.0 percent excise tax on cars priced at Php 1.0 million and below, the price range of vehicles registered under its Comprehensive Automotive Resurgence Strategy (CARS) Program.

Lopez, however, did not mention the final excise tax rate and bracketing for automobiles under the tax reform package. In the previous proposal, DOF wants to increase excise tax for cars priced at Php 600,000 to Php 1.1 million to 5.0 percent from its current rate of 2.0 percent; a 20 percent excise tax for cars selling above Php 600,000 to Php 1.1 million; 40 percent for those selling over Php 1.1 million to Php 2.1 million; and 60 percent for cars with prices over Php 2.1 million. Seniors face end of interest only mortgage payments need Chapter 13 to stop foreclosure

Client is 61. Her husband is 60. In my book, they are young seniors. They bought their house in 2006 just before the crash of the housing market. They used a zero down 10 years interest only mortgage for the first 10 years. Thereafter, they have to start paying interest and principal. They

paid $2,400 a month for the purchase date up to early last year, which is interest only. As you well know, interest rates have been very low for the last 10 years. The Feds have been keeping rates at rock bottom so as not to derail the slow but steady improvement in the performance of our economy. With the expiration of the 10 years, mortgage payments doubled to $4,400. It appears that they have $250K of equity in the house. Since they could not pay $4,400, they asked the bank for a loan modification last year. Bank placed them on a 3-month trial period that they complied with. However, nothing happened after the trial period. Bank started to send them statements demanding $4,400 after the trial period ended. Clients received the recorded notice of default last October. Foreclosure sale is now scheduled for February 15, which is next week. Their arrears on the mortgage is $60K. A third party continues helping them to get the loan modification but they have now decided to try to sell the house. But one week is not enough time to sell the house. If the house is foreclosed next week, the auction sale may wipe out more than half or all of their equity of there are no serious buyers that show up for the auction sale. If no serious buyers show up, then bank will bid the balance of the loan for the house and that will wipe out the entire $250K of equity. The house is worth $800K while the balance of the mortgage owed to bank is $550K leaving equity of $250K. But if

there are no buyers at auction, bank will bid $550K, the balance of the mortgage then debtors get nothing. If a serious buyer shows up and bids $700K, then bank gets paid $550K, and clients realize an amount over the balance owed to bank or equity of $150K.The higher the purchase price, the higher the equity realized by clients. It is certainly to their advantage to prevent the foreclosure next week, so they can have enough time to get a serious buyer for the right price. Clients decide to get Chapter 13 relief. What will Chapter 13 do for them? First, it will immediately stop the foreclosure next week, so it creates time for them to sell the house for the right price. Second, if they can find the right buyer, a motion seeking court permission to sell the house can be filed in the Chapter 13 case. The court protects the house by preventing the foreclosure while the court gives them permission to sell the house. Third, it makes their loan modification request stronger because the filing of the bankruptcy proves financial hardship, which is a sine quo non-element of a loan modification request. If they decide not to sell the house if the LM is approved, or for some reason, they are now able to afford to pay interest and principal as well as the plan payment, then they can just stay on the 13 for five years. But of course, a serious buyer for $800K would do the trick because clients walk away with at least $200K of equity. They can use the

cash to buy a more affordable house with a smaller mortgage payment. Senior needs Chapter 13 to stop sale of $1-M house by judgment lien of $30k Next client is 66. He owns a house with a small mortgage balance of $140K. His house is now worth $1.0M. So he has over $850K of equity. The problem is that his divorce 15 years ago “wiped him out�. I don’t really know what that exactly means. I surmise that the divorce judgment required him to pay alimony and to buy out his ex wife’s 50% share in the house. As some famous actor said, two divorces wiped him out. Each divorce felt like his heart was being ripped through his wallet. I can’t remember his name right now but the description of the financial agony that client went through with his divorce is appropriate. Oh, yeah, it was Robin Williams who said this. His first divorce wiped out half his assets and the second divorce wiped out the other half of his assets. Client has social security of $1,400 and makes $2,600 driving UBER full time. A judgment creditor had a judgment lien of $15K on the house 15 years ago. That lien has now ballooned to $34K. And judgment creditor has just filed a motion to sell client’s house to pay the lien. Is this even possible that the enforcement of a judgment lien can result in the involuntary sale of the debtor’s house? Sadly, it is true. The CA code of civil procedure allows the judgment creditor, by motion, to request court permission to force the sale of the house to satisfy the lien! Surprised? As POTUS Trump will tweet “NOT NICE AND NOT FAIR!!� “THAT JUDGMENT LIEN CREDITOR IS A TERRORIST AND MUST NOT BE GIVEN A VISA!� Well, the only way to stop the forced sale of the house is

to file a Chapter 13. Even a missile from Iran will not stop a foreclosure but a Chapter 13 stops it dead on its track. Yes, a Chapter 13 is more powerful than a missile from Iran. In a Chapter 13, client will be allowed to pay the $34,000 over 60 months without interest, that’s about $570 a month. I am wondering why client waited until the last minute to take care of this problem that it should come down to this. After all, he had 15 years to take care of it. Court judgments accrue interest at 10% p.a. until they are paid in full based on diminishing balance. Client said he wasn’t able to think right after the divorce. I guess it’s a traumatic event that has devastating financial implications. Don’t wait until the last minute. Credit card debt must be wiped out now by Chapter 7 or 13. Otherwise, these debts will become lawsuits that become judgment liens that will put your house at risk. If you wipe them out now, they are wiped out, nipped at the bud. BI blocks entry of alleged Al Qaeda man at NAIA

MANILA, Feb. 14 (PNA) – A suspected member of the Al Qaeda terrorist group was denied entry to the country by Bureau of Immigration (BI) authorities at the Ninoy Aquino International Airport (NAIA). BI Commissioner Jaime Morente said Muhammad Arif, 43, a Pakistani national was intercepted on Saturday at the NAIA 1 terminal upon his arrival aboard a Thai Airways flight from Bangkok. He explained that the foreigner was denied entry upon confirming that he is in the BI database of blacklisted aliens and suspected foreign terrorists and in the Interpol’s database of “Al Qaeda Sanction List” of individuals. Arif was immediately turned back and booked on the first available flight to his point of origin. “We were informed that his purpose in coming here was doubtful because he could not pinpoint the places that he wanted to visit. He also could not tell

why he was traveling alone,” Morente said. The BI chief added, “Our immigration officers had no choice but to exclude him for posing a threat to our national security and risk to public safety.” At the same time, the BI database showed the Pakistani was the subject of a blacklist order issued by then BI chief Ricardo David Jr. in Sept. 2011, also for being an alleged Al Qaeda member. During the interview with immigration supervisor, Arif claimed he owns the Dawn pharmaceuticals store in Islamabad and is a distributor of Novartis Pharmaceutical Company. He added that he intends to have a vacation in the Philippines and will stay for four days at the Malayan Plaza Hotel in Ortigas Center, Pasig City. Immigration authorities also noticed a resemblance between the passenger’s passport picture and the photographs of a Muhammad Arif stored in the Interpol database.

NFA assures enough rice supply in quake-hit Surigao provinces

Aquino said more than 232,000 bags of rice were strategically positioned in its warehouses in Caraga, sufficient to supply the rice consumption requirements of the region for more than two weeks. NFA also has sufficient rice inventory nationwide at 8.88 million bags as of Feb. 10, 2017. Based on the reports of the NFA monitoring teams, prevailing market price of commercial rice also remains stable despite the declaration of Surigao City under state of calamity. The NFA market monitoring teams were immediately deployed to assess the rice supply and price situation in the market. They also inspected NFA-accredited rice retail outlets to ensure that affordable government rice is readily available and accessible to the consuming public, especially those in affected areas in the region.

MANILA, Feb. 14 (PNA) – The National Food Authority (NFA) on Tuesday assured it has enough buffer stocks of rice in warehouses nationwide, particularly in earthquake-hit Surigao provinces. The NFA released 200 bags of rice requested by the local government unit (LGU) of Surigao del Norte for its relief operations after the 6.7-magnitude earthquake hit the province on Feb. 10. “It is one of the mandates of NFA to provide rice to a calamity-stricken area within 22 hours from the occurrence of a calamity or emergency,” said NFA Administrator Jason Laureano Y. Aquino. The NFA has a standing memorandum of agreement (MOA) with various relief agencies wherein LGUs can withdraw rice on credit from NFA anytime during calamities and emergencies.

There are many solutions available to homeowners falling behind on their payments. Most people think Bankruptcy is the only option, short of just letting the Bank take their home. Bankruptcy is a good option, and while it can strip off the second trust deed if the home is upside down in current value, bankruptcy cannot change the terms of payment on the first mortgage. Frequently, we use a combination of strategies including bankruptcy to strip all secondary liens, modify the terms of the first, and convert the adjustable to an affordable fixed loan. Some lenders offer workout options. Others want you to “catch up� all the missed payments first. A few major banks have sent out letters to their borrowers, offering to modify and lower the loan balance if you meet certain qualifications. However, in instances where you do not qualify for a loan modification, the home owner should definitely consider a “Short Sale�. Short Sale Facts. If you are facing foreclosure, a short sale can be a beneficial alternative. It is an agreement with your bank or mortgage company, allowing you to sell the property for an amount less than what you owe. Usually, the bank requires an appraisal, and will accept an offer that’s relative to the current fair market value. Unfortunately, the seller (current home owner) cannot also be the new buyer. What are the advantages of a short sale vs. foreclosure? The main advantage of a short sale is preventing foreclosure and the consequences that foreclosure incorporates. Short sales are considerably less damaging on credit ratings than foreclosures. Remaining on your report for up to 7 to 10 years, a foreclosure is often times more damaging than a bankruptcy, (unless it’s included in a bankruptcy), and may take you 3 years or more to re-qualify for a new home loan. While Short sales may be reported to the credit bureaus, they are noted as “paid in full� or “settled for less than owed� and have far lesser effect on fico scores. 2013 is a great year to complete a short sale, and get out of a property that is “under water�. Because a short sale allows the homeowner to sell their property for less than the outstanding mortgage debt, it creates a “deficiency�, written off as a “forgiveness of debt� by the lender. In years past, debt forgiveness was considered taxable income. The lender would send out a 1099. Imagine adding $200,000 to your regular taxable income! However, for 2012 and 2013, the federal government has given us a pass on debt forgiveness taxable income on short sales. However, it is wildly expected to end in 2013. (Please note, this column does not provide tax advice. Always seek advice from a tax professional, when

considering tax ramifications in property sales) Short Sale Summary You can buy another home in as little as 12-18 months. Under Mortgage cancellation Tax Relief Act of 2007 (H.R. 3648) Forgiven debt may NOT be taxed. Get more time in your home, and avoid the threat of immediate eviction pending a short sale process. Permanent tax free debt relief. It usually takes 1-4 months to complete a short sale; you may remain in your home during this time. May qualify for Government relocation assistance – up to $3000 What is a Loan Modification? Loan Modification Facts A Loan Modification is usually a conversion from an adjustable (and uncontrollable) to a fixed interest loan. It could also involve changes to one or more of the following: Interest Rate; Principal Balance and even forbearance on penalties. It also should bring the account current, creating a fresh start for the borrower. There are many reasons for seeking a Loan Modification, however not everyone can qualify. Most Lenders will tell consumers they do not qualify, or deny the first attempt in order to collect the full amount due. Our law office will qualify you according to the lender’s guidelines and negotiate on your behalf to get the lender to accept your situation and thereby agree to the modification. A loan modification will take the mortgage you now have and change the interest rate, terms or payment requirements in order to convert to a fixed rate. Changes in rates and payments do not require new closing costs, legal fees, survey, appraisal, or taxes. In contrast, if you “refinance� a loan you’ll be required to have a closing and be forced to pay a variety of fees and taxes. Rock singer Malou Toler and her Friends of Mine (FOM) band recently headlined a successful fund-raising concert for the Sigma Delta Phi Sorority Alumni Association Inc., particularly its University of the Philippines’ (UP) West Coast Alumnae Association. Arguably the most prolific rock and roll performers in Los Angeles (LA), Toler and her FOM band, brought the house down with their renditions of 1970s Filipino rock and roll songs. The crowd was particularly impressed by their “Nosi Balasi” version, a song popularized by Pinoy rock and roll icon Sampaguita. The FOM band utilized the saxophone as one of its leads in the song’s instrumental parts. “The feeling of performing for a good cause is always amazing. Never felt bored or tired. I had so much energy. God is good. Giving back what God has given is me is cool,” Toler said after the show billed as “Valentine’s Party for Cause which was held at Kapistahan Grill in downtown LA on Saturday (February 11). The event organizer, Weekend Balita columnist Myrna Aquitania, said she was happy that the show met its goals and thanked everyone for their support. Aquitania was devotedly assisted by an equally recognized LA-based journalist Lydia Solis. Another prolific LA-based performer Mon Concepcion added color to the night with his renditions of pop songs and a couple of original compositions. Asian groups speak out vs Trump’s anti-immigrant EOs

New York City – The Asian American Legal Defense and Education Fund (AALDEF) participated in a press conference today with Asian American groups in New York City to speak out about the president’s recent executive orders and ongoing immigration enforcement raids and their impacts on local Asian American communities. Annie Wang, a staff attorney in AALDEF’s Immigrant Access to Justice program, said: “While AALDEF applauds the Ninth Circuit decision last Thursday upholding the U.S. district judge’s temporary order blocking implementation of the Jan. 27 executive order, this is not the end of the road for the president’s discriminatory executive actions on immigrants and refugees. We will also continue to closely monitor the status of the Deferred Action for Childhood Arrivals (DACA) program. In light of the ICE enforcement actions over the past week, it is more critical than ever that we provide legal advice about their immigration options to individuals affected by the travel ban, as well as to DACA recipients and their families.” On Jan. 27, the president signed an anti-immigrant and anti-Muslim executive order, which would have suspended the U.S. refugee admissions program for 120 days, indefinitely halted the admission of Syrian refugees, and banned immigrant and nonimmigrant entries of nationals of seven Muslim-majority countries (Iraq, Iran, Libya, Somalia, Sudan, Syria, and Yemen) for at least 90 days. The Jan. 27 order is currently on hold due to a successful legal challenge brought by Washington State, in which a federal district judge issued a temporary restraining order. Gov’t firm on ‘no-ransom’ policy – Palace MANILA, Feb. 15 (PNA) – “The Government stands firm on our no-ransom policy.” This was stressed by Presidential Spokesperson Ernesto Abella Wednesday after a German hostage held by the bandit group Abu Sayyaf (ASG) appealed to authorities to heed his captors’ ransom demand to prevent his impending execution. “The Government stands firm on our no-ransom policy. The AFP (Armed Forces of the Philippines) has been directed to continue and intensify its military operations,” the Palace official said. “The government will continue efforts to safely rescue all hostages held by these terrorists. It is also working closely with the concerned local governments as well as other sectors to facilitate the safe rescue of Mr. Jurgen Kantner,” Abella added. Kantner’s appeal was contained in a video posted on social media. In the video, he asked authorities to heed his captors’ PHP30-million ransom demand to prevent them from beheading him later this month. The 70-year old German national said his execution has been set for February 26 at 3 p.m..

“If the money is not in the hands of the pirates at this time, they will behead me,” Kantner said. Kantner was kidnapped by the ASG bandits while his yacht “Rockall” was cruising off Sulu waters last November. His companion, 56-year-old Sabine Mertz, was allegedly raped and killed by the bandits. But despite Kantner’s appeal, the AFP said the government is maintaining its policy against negotiating with terrorist groups and giving in to ransom demands. On Tuesday, AFP public affairs office head Col. Edgard Arevalo said that payment of the ransom will further embolden the terrorists and give them more funds to buy the loyalty of the communities they are hiding in. In the same vein, he said the government does not pay ransom or negotiate with terrorists. Arevalo likewise stressed the military will exert all efforts to rescue Kantner from his ASG captors. “We will exert all efforts to rescue him (Kantner), especially that we now have continuing operation against the ASG which has been yielding good outcomes, so we are still positive that we will be able to rescue him,” Arevalo said.

“Hate speech would be something exhibiting hate without a criminal act,” explained Phyllis Gerstenfeld, criminal justice professor at California State University, Stanislaus. “If there’s no criminal act, then hate speech is protected by the First Amendment,” Gerstenfeld said, adding that journalists should be able to distinguish between the two acts. And better still, journalists should understand why hate speech is protected by the First Amendment despite overwhelming evidence that in most cases such kind of messages instigate actual acts of violence. Well, in case it is not clear: Curtailing hate speech could establish a system of censorship that might infringe on the vibrancy of our freedom of speech in general. Gerstenfeld went on to explain that the line between a legally actionable hate speech and a hate speech that was not can get fuzzy, “especially when there are threatening comments involved.” “That’s not to say those communities were immune to hate speech,” she said. Even when a crime has occurred and seems tied to a message of hate, researchers say most prosecutors are reluctant to file hate crime charges. “In order to convict someone you have to prove that they were motivated by the victim’s group,” Gerstenfeld said. “Proving motivation is always difficult though.” Most states have laws protecting groups based on ethnicity, country of origin and religion, but few include provisions for gender identity and sexual orientation. Five states, including South Carolina, Georgia, Indiana, Arkansas and Wyoming don’t have a hate crime law on the books. In those cases, Gerstenfeld said, the federal government can step in and prosecute under its own hate crime law, as was recently seen in the case of South Carolina mass-shooter Dylann Roof. “This is rare though, and the federal government typically only steps in when there is a high body count or other aggravating factor,” Gerstenfeld said. Gerstenfeld was one of the resource speakers during the national press call organized by the New America Media (NAM) on hate crime reporting on Wednesday (January 18). But while hate speech may seem like a hard nut to crack, communities are not actually helpless against it. The Southern Law Poverty Center, a nonprofit legal advocacy or-

ganization, has the following guidance posted on their website on how to fight hate speech: 1. Act – Do something. In the face of hatred, apathy will be interpreted as acceptance – by the perpetrators, the public and, worse, the victims. Decent people must take action; if we don’t, hate persists. 2. Unite – Call a friend or co-worker. Organize allies from churches, schools, clubs and other civic groups. Create a diverse coalition. Include children, police and the media. Gather ideas from everyone, and get everyone involved. 3. Support the Victims – Hate-crime victims are especially vulnerable, fearful and alone. If you’re a victim, report every incident – in detail – and ask for help. If you learn about a hate-crime victim in your community, show support. Let victims know you care. Surround them with comfort and protection. 4. Do Your Homework – An informed campaign improves its effectiveness. Determine if a hate group is involved, and research its symbols and agenda. Understand the difference between a hate crime and a bias incident. 5. Create an Alternative – Do not attend a hate rally. Find another outlet for anger and frustration and for people’s desire to do something. Hold a unity rally or parade to draw media attention away from hate. 6. Speak Up – Hate must be exposed and denounced. Help news organizations achieve balance and depth. Do not debate hate-group members in conflict-driven forums. Instead, speak up in ways that draw attention away from hate, toward unity. 7. Lobby Leaders – Elected officials and other community leaders can be important allies in the fight against hate. But some must overcome reluctance – and others, their own biases – before they’re able to take a stand. 8. Look Long Range – Promote tolerance and address bias before another hate crime can occur. Expand your community’s comfort zones so you can learn and live together. 9. Teach Tolerance – Bias is learned early, usually at home. Schools can offer lessons of tolerance and acceptance. Sponsor an “I Have a Dream” contest. Reach out to young people who may be susceptible to hate-group propaganda and prejudice. 10. Dig Deeper – Look inside yourself for prejudices and stereotypes. Build your own cultural competency, then keep working to expose discrimination wherever it happens – in housing, employment, education and more.

Put up or shut up Last week, former President Fidel Ramos urged former First Lady Imelda R. Marcos to disclose what she knows about the assassination of former Senator Ninoy Aquino Jr at the Manila International Airport (MIA) 34 years ago. Aquino was apparently shot and killed by his military escorts shortly after he deplaned upon his arrival in Manila on August 21, 1983. To this day, Ninoy’s murder remain unsolved. Ramos is urging “Imelda,� now currently the representative of the 2nd district of Ilocos Norte, to come clean and put closure to the Aquino murder case for the sake of the Filipino people. I find this preposterous. Ramos must either be hallucinating or is now in his advanced state of dementia. Or maybe, Ramos is just seeking publicity now that he has been “out of the loop� for sometime. If there are people that I suspect who had knowledge about the assassination, it is either Ramos or former Senator Juan Ponce Enrile or both of them. However, both Ramos and Enrile denied for years any knowledge about the murder case. But former Senator Aquilino Pimentel believed otherwise. In a privileged speech he delivered in the Senate in 1988, Pimentel said it is impossible for Ramos not to know about the planned assassination of Aquino.

He said that if Ramos did not know who the plotters were before the murder was done, it is impossible for him not to know the people behind after the assassination was carried out. During the assassination of Aquino, Ramos, a first cousin of the former Philippine “strongman� and dictator Ferdinand Marcos, was the current Philippine Constabulary Chief. Enrile, on the other hand, was the Minister of National Defense. If Ramos really wanted to put closure on the Aquino murder case, he should have ordered an investigation during his six-year presidential term to unravel the mystery, including the identities of the mastermind or masterminds. But he never did, and now is passing the buck to Mrs. Marcos. Same with Cory and her son Noynoy. Both were elected Philippine president but never ordered a full-blown investigation to uncover the truth behind the murder of their loved one. As a matter of fact, both Cory and Noynoy tried their best to dissuade any

efforts on the part of their allies to instigate an investigation as to what really transpired at the airport tarmac where Aquino was shot and killed. It is about time that the people know who were the people responsible for the murder of Aquino. You are right President Ramos, let us put closure to this 34-year old murder case so that the Filipino people will find out the truth, as well as the identities of the persons involved in the murder. • Former Senator Bongbong Marcos’ dream of becoming the next Philippine President may become a reality after all. But first, he has to hurdle the difficult task of proving that Vice President Leni Robredo won the VP race through votes shading and tampering of electronic voting machines in the middle of canvassing of votes during the May 9 national elections. So far. Marcos has been fortunate enough to gain momentum on his election protest against Robredo. Early this week, the Supreme Court, acting as Presidential Electoral Tribunal (PET), affirmed its earlier resolution finding the former senator’s protest to be “sufficient in form and substanceâ€? and was beyond question. The PET, on the other hand, denied the motion of Robredo to dismiss the election protest of Marcos for lack of jurisdiction. With the resolution now affirmed

by the PET, the election protest of Marcos is expected to move at a faster pace for the public to know soon what really transpired during the May 9 national elections last year. In his protest, Marcos has been requesting for a system audit to prove that election results were affected when a Smartmatic technician changed the program of the electronic voting machines in the middle of canvassing of votes on late at night on Election Day. But Comelec refused to allow an audit of the system to be undertaken. The poll body is headed by the poker-faced Chairman Andres Bautista, a certified Liberal Party member and the former campaign manager of Mar Roxas when he ran unsuccessfully as vice presidential candidate against former Makati Mayor Jojo Binay in the 2010 national elections. I hope the Comelec is not trying to cover up electoral fraud just to make sure Marcos will not win the vice presidential plum in order not to displease former President Noynoy. It is also about time that Congress pass a law so that the penalty for anyone convicted of electoral fraud will be life sentence without the possibility of a parole. Otherwise, this blatant and fraudulent vote padding or shading will happen again in future elections and will subvert the real choice of the people who they want to be their leaders in the future.

4 ways ďŹ ling for divorce can beneďŹ t your immigration case Couples get divorced for various reasons. California is a no fault state. The reasons why a couple is getting divorced are often irrelevant to the issues of the family law case. Divorce is often a difficult and negative experience for most families. However, getting divorce may have some unintended benefits in the immigration law arena. Four situations in which filing for divorce can be beneficial to your immigration case are as follows: 1. Married Sons and Daughters of US Citizens If you were petitioned for legal permanent residence by your US Citizen parent as a married son or daughter 21 years old or over, you are classified in immigration law under family sponsored third preference (F3) which usually carries a long wait time. The wait time for Filipinos for example is currently 22 years. The priority date is normally the date the petition was initially filed by your US Citizen parents. If you get divorced, you revert back to single status and your category auto-

matically becomes reclassified to first preference (F1) where the waiting time is substantially shorter. For example, for Filipinos the wait time under F1 category is 10 years shorter than F3 category. This means if your parents filed your immigration petition 12 years ago, then you can adjust to a green card now instead of waiting another 10 years. 2. Married Sons and Daughters of Legal Permanent Residents If your parents are legal permanent residents, getting divorced will convert you back single status making you eligible to be petitioned by your legal permanent resident parents under the family based second preference (F2b) category if you are 21 years old or older or under the family based second preference A

(F2a) if you are under 21 years of age. For those who married after they were petitioned by their LPR parents (F2A and F2B), the petition is automatically revoked under operation of law the moment you get married and cannot be reclaimed by a divorce. In theory, it can be argued that filing a subsequent petition after your divorce under the same category inherits the previous petition’s priority date under 9 FAM 42.43 N10 and 8 CFR 204.2(h), Part 205. However, success of such argument is not clear since the old petition was automatically revoked the moment you married. The best thing that can be done in this situation is to have your LPR parent repetition you as an F2A or F2b even if you are unable to reclaim the previous petition’s priority date. 3. Conditional Legal Permanent Residents in failed Marriages For those who obtained their legal permanent residence status through marriage based petition by their US Citizen spouse of less than 2 years marriage, the legal permanent res-

idence status conferred is usually a “conditional legal permanent residence� valid only for 2 years. The couple would need to sign and file a joint petition to remove this condition prior to the expiration of the 2 years or the conditional legal permanent resident spouse would fall out of status. The problem arises when the marriage is in trouble. Often it becomes difficult to obtain the cooperation of the US Citizen spouse specially when the couple has separated. US Citizen spouse often refuse to sign the I-751 for or appear at the I-751 interview if one is set by the USCIS. Filing for divorce would terminate the marriage and allow you to file a “waiver� of the joint petition to remove the conditional LPR status based on entering into the marriage in good faith. Married Aliens in Non-Immigrant Visas and those without Status For those who enter the US as a non-immigrant and are separated from their spouse but still married, filing a divorce would open up opportunities in case they meet a new significant other who is a US Citizen and who can petition them as an immediate relative. This is usually the fastest of process in obtaining legal permanent residence. In countries such as the Philippines where there is no divorce, many people come to the US to start a new life after they have been separated from their old spouse (often still married to them). Even if the alien over stays their status as a visitor, the alien can still adjust to that of a legal permanent residence if petitioned by a US Citizen spouse. If the alien was never inspected, the alien can still adjust to legal permanent residence if they are grandfathered under INA 245(i) and there are no special restrictions on their status. To be grandfathered under INA 245(i), the alien must have been a beneficiary of a legal permanent residence petition filed no later than April 30, 2001. Finally, a common concern of divorcing immigrants is “What happens if my spouse refuses to sign the divorce papers?” The truth is you do not need your spouse’s signature to obtain a divorce in California. You only need to provide your spouse no-

tice that you filed a divorce by personally serving your spouse the divorce petition and summons. In countries that are members of the Hague Convention, special procedures need to be followed to effect service. So yes it is possible to divorce your spouse even if your spouse is in a country that does not recognize divorce among its citizens such as the Philippines. Filipino optimism for 2017 remains ‘very high’ MANILA, Feb. 14 (PNA) – A Social Weather Stations (SWS) survey showed ‘very high’ optimism among the Filipinos in their quality of life six months after they elected former Davao City mayor Rodrigo Duterte as the country’s president in May 2016 elections. According to the SWS 2016 Fourth Quarter survey conducted from December 3-6, 48 percent of the 1,500 respondents expect that their personal quality of life would improve in the next 12 months compared to 3 percent that said it would get worse.

The survey also showed that 51 percent of Filipinos have expressed optimism that the Philippine economy in 2017 will get better compared to only 8 percent who said it will deteriorate. On the other hand, 37 percent of Filipinos said their lives improved in the last 12 months compared to 21 percent who said their lives worsened. Presidential Spokesman Ernesto Abella said the latest survey affirmed that President Duterte is on the right track of pursuing economic progress as well as peace and order.

Shaina Magdayao has asked for calm after Piolo Pascual revealed that they have been “exclusively dating” for five years now, downplaying it by saying that she doesn’t want to label their relationship. “Yes, it has been years that Piolo has been there for me as a great friend I can always count on,” she said. “We have become very special to each other, even his whole family has become dear to me.” “Just for the record, he is free to date anyone he wants, the same way I’m free to date anyone I want,” she continued. “Nagkataon lang siguro na we’re both not dating other people kaya nagka-exclusively dating label. Gerald excited to participate in 2017 LA Marathon Gerald Anderson is looking forward to the upcoming Los Angeles Marathon. In a press conference, Anderson shared how he is preparing for the 42-kilometer run which will happen on March 19. “Before pumasok ‘yung campaign, nag-te-training na ako. I was already doing triathlons and of course nag-ba-basketball ako. I work out every day. Noong pumasok na ito, there was extra motivation so it became twice a day workouts. Preserving critical healthcare benefits What happens to Medi-Cal? Dr. Tom Price is the new Health under the Aordable Care Act and Human Services (HHS) secretary.

The Board of Supervisors moved to do all it can to fight the threatened repeal of the Affordable Care Act and to preserve critical healthcare benefits that millions of people in Los Angeles County rely on. Board Chairman Mark Ridley-Thomas and Supervisor Sheila Kuehl filed a read-in motion that called for continuing to strongly oppose a repeal and any efforts to weaken the critical Medicaid health program which covers millions of County residents. The motion would also direct the County to explore and support any options that would minimize the number of people who stand to lose their health insurance, and maximize the federal funding that the County would need to keep a safety net over its residents, should a repeal occur. “Rolling back the ACA would endanger the health and economic well-being of millions of people, not only in Los Angeles County but across the country,� Chair Ridley-Thomas said. “We must fight efforts at every step that would endanger this landmark legislation to prevent a tsunami of hurt triggered by a repeal.� “The new administration in Washington and its threats to repeal the ACA pose a very serious challenge to the health and wellbeing of County residents,� Supervisor Kuehl said. “Should

repeal or any significant diminution occur, LA needs to be at the forefront of helping to craft a way to protect those we serve because if it doesn’t work for LA County, it won’t work for California.� The ACA enabled about 1.2 million County residents to gain health insurance through Medicaid and Covered California. Many more people benefited from other provisions, such as those that allowed children to stay on their parents’ coverage until age 26; required most employers to provide health insurance; prohibited insurers from denying coverage to persons due to pre-existing conditions and capping coverage for persons with catastrophic illnesses; mandated coverage of preventive care and family planning services; and established equity pricing for women. “It is critical that Los Angeles County and the State of California are prepared to care for those who may lose insurance under threatened cuts to the ACA,� said Los Angeles County Health Agency Director Dr. Mitch Katz. The ACA also provided medical assistance to newly Medicaid-eligible individuals whose care otherwise would have been funded by the County. It provided more resources for the County’s In-Home Supportive Services program that serves the elderly and persons with disabilities, as well as for public health programs.

Many are anxious: What happens to my Medi-Cal? In 1965, MediCaid was enacted into law. MediCaid is a federal program that provides matching funds to the states to enable the latter provide health assistance to their low-income residents. In 2010, the Affordable Care Act (Obamacare) afforded the states the opportunity to expand MediCaid. Under the law, the federal government would finance the cost of expansion 100% from 2014-2016, 95% in 2017, and gradually decreasing until only 90% in 2020. In addition, the law includes those receiving incomes less than 133% of the Federal Poverty Level eligible for MediCaid. The states administer MediCaid. In California, MediCaid is known as Medi-Cal. Enrollment to Medi-Cal has been made easy and accessible since 2014 thru Covered California, a health care marketplace established by Obamacare. The Department of Public Social Services (CA) processes enrollment applications, in perfect coordination with Covered California. According to the Department of Health Care Services (CA) website, “as of March, 2016, more than 4.7 million Californians have begun receiving comprehensive health care benefits provided by Medi-Cal since Obamacare was implemented�. Furthermore, millions have been dependent on their Medi-Cal eligibility to finance their Medicare premiums even before the advent of Obamacare. The current political rhetorics of “repeal and replace Obamacare�, therefore, causes concern to many Medi-Cal

beneficiaries. My take on the subject: Don’t let the short-term noise depress you. Our politicians are nowhere short of good intentions. While I will admit that Medi-Cal funding, eligibility and benefits may be on the table as the U.S. Congress discusses health care reform, the Republican majority promised to apply lessons learned on Obamacare to be reflected on the new health care legislation. In his early executive orders, President Trump directed all agencies in his government to act “to ease the burden�caused by Obamacare. Besides, Governor Jerry Brown and CA legislators are expected to do everything in their power to protect low-income people from losing their health coverage. Official help for low-income people dates back to 1965. No reason for it to end now. The devil will be in the details. Let’s wait for the new health care legislation. By the way, Medi-Cal beneficiaries receive renewal forms to determine their eligibility every year. This is part of a normal, usual process. Do not be alarmed. U.S. philosophers slam Trump’s anti-Mexican policies MEXICO CITY, Feb. 16 (PNA/ Xinhua) – Nearly 500 philosophers from across the United States on Wednesday announced their rejection of the anti-Mexican policies of U.S. President Donald Trump. In an open letter signed by more than 480 philosophers working at universities around the country -and posted to the website of a leading Mexican university -- the academics stated their “strong repudiation of the Trump administration’s intended policies towards our neighboring country of Mexico.” The “xenophobic” policies “distort our deep historic, economic, cultural and academic bonds,” the undersigned said. “We are deeply concerned by the fact that plans are already underway for the construction of a wall on our border under the premise that Mexicans themselves will pay for it. This is an unacceptable threat, an act of profound disrespect, and a direct aggression to an historic economic partner and cherished friend,” the group said.

They also expressed “major ... concern” for “the announced mass deportations of undocumented immigrants, including Mexicans,” and urged the administration “to change these erroneous and compromising policies.” Academics from some of the most prestigious universities joined in denouncing the measures, including MIT, Harvard, Princeton, Yale and NYU. Mexico’s National Autonomous University of Mexico (UNAM), whose Institute of Philosophical Research (IIF) hosted the letter on its website, said it was working closely with its academic counterparts in the U.S. The director of the IIF, Pedro Stepanenko Gutierrez, who coauthored the open letter, warned Mexicans against turning against the U.S. or its citizens, despite deteriorating bilateral ties under Trump. “It behooves us to show solidarity with U.S. citizens who must endure their president and not foster a nationalism that closes ranks against all North Americans,” he said in a statement.

Over 380,000 illegal migrants came to Europe in 2016 – Frontex MOSCOW, Feb. 16 (PNA/Sputnik) – The EU border agency Frontex stated on Wednesday that the bloc is experiencing high migration pressure, with about 382,000 illegal migrants arriving in European countries in 2016. Frontex said that although the numbers decreased in comparison to 2015, it was still higher than any annual figure for arrivals in 2010-2014. “In 2016, migration pressure at Europe’s external borders remained high with the detection of over half a million illegal border-crossings. Frontex estimates that this figure corresponds to about 382 000 migrants coming to Europe from the Middle East, Africa and Asia,” Frontex said in a statement. According to the agency, most of migrants arrived in Italy and Greece, with each reporting about 180,000 new arrivals. For instance, in 2016 Italy registered a 17-percent increase in number of migrants, compared to the previous year, with most of them “departed from Libya aboard overcrowded and unseaworthy rubber dinghies.” Frontex stressed that persons claiming to be Syrian nationals represented “the highest share of migrants” illegally entering the Eu-

ropean Union (17 percent) in 2016, which actually remained unchanged for the forth consecutive year. Landlord outreach event aims to help end homelessness New county and city incentives take the risk out of renting to homeless men and women

Los Angeles, February 15, 2017 – Today, over 200 landlords attended a HouseLA event to learn about programs that offer financial incentives in exchange for partnering with the County, City, and non-profit service providers to end LA’s homelessness crisis. County and City staff shared information about the Homeless Incentive Program (HIP), which provides financial protections and other safeguards to landlords who agree to accept subsidized tenants holding County or City issued vouchers such as Veterans Affairs Supportive Housing vouchers or Section 8 vouchers. The incentive programs have three major components: 1. One month payment to hold the rental unit while a tenant is referred. 2. Move-in assistance to homeless individuals such as money for the security deposit and utility connection fees. 3. Financial assistance to landlords to mitigate damage caused by tenants during their occupancy. The Homeless Incentive Program is part of an unprecedented and comprehensive effort by the County and City of Los Angeles to end homelessness. “Landlords want peace of mind,” said Abraham Kohen, a landlord who owns several local properties and has been partnering with the County. “With these programs you have nothing to lose. Landlords have all the support they need to be successful.” “It is our responsibility to dedicate all available resources to establishing successful landlords and tenant relationships,” said Sean Rogan, Executive Director of the Housing Authority of the County of Los Angeles (HACoLA). “It takes a special kind of landlord to recognize that they can do good and do well at the same time. It can be very difficult for men and women who have been homeless to get back on their feet. Americans divided over Trump’s first 3 weeks in White House WASHINGTON, Feb. 15 (PNA/ Xinhua) – US voters are almost evenly split over President Donald Trump’s job performance in his first three weeks in the White House, according to a poll released on Tuesday. When asked if the Trump administration is working on things that will help their family, 47 percent of voters say yes, while 48 percent say no, according to the Fox News Poll. Moreover, most voters feel strongly one way or the other, as 35 percent “strongly” approve and 41 percent “strongly” disapprove. The split is heavily based on partisan lines. As many as 87 percent of Republicans give the thumbs up to Trump’s performance, as do just 52 percent of independents and 10 percent among Democrats. In February 2009, after Barack Obama’s first month in the White

House, 60 percent of voters approved his performance, including 90 percent of Democrats, 62 percent of independents, and 29 percent of Republicans. As for Trump’s first 100 days in office, twice as many voters say it’s extremely or very important for him to work on cutting taxes (52 percent) and repealing Obamacare (49 percent), than building a border wall (26 percent), the poll shows. The poll also finds 50 percent feel confident in Trump’s judgment in a crisis, up from 43 percent in October 2016. The Fox News poll is based on landline and cellphone interviews with 1,013 randomly chosen registered voters nationwide and was conducted from February 11 to 13. It has a margin of sampling error of plus or minus three percentage points for all registered voters.

2016 remittances to PHL exceed gov’t growth target By Joann Santiago

MANILA, Feb. 15 (PNA) – Cash inflows from overseas Filipinos exceeded the government’s 2016 target of four percent after it jumped five percent. Data released by the Bangko Sentral ng Pilipinas (BSP) Wednesday showed that total cash remittances last year reached USD26.9 billion, higher than year-ago’s USD25.61 billion. Including in-kind remittances, this totaled to USD29.71 billion, 4.9 percent higher than the USD38.31 billion in the whole of 2015. Last December alone, cash inflows posted a record-high of USD2.6 billion, 3.6 percent higher than the

USD2.5 billion last year. It was also higher than month-ago’s USD2.2 billion. Personal remittances posted a new record level of USD2.8 billion from year-ago’s USD2.73 billion. BSP Deputy Governor and officer-in-charge Diwa C. Guinigundo, in a statement, attributed the rise of personal remittances to the 7.6 percent increase of those sent by landbased workers with work contracts of one year or more to USD23.2 billion. ”This made up for the 3.7 percent decline in remittances from seabased and land-based workers with work contracts of less than one year to reach USD6.1 billion,” he said.
