MANILA, Jan. 10 (PNA) – The Supreme Court (SC) on Tuesday directed former Justice Secretary and now Senator Leila de Lima to comment on the disbarment complaint filed by lawyer Fernando Perito late last year in connection of her admitted love affair with her former driver Ronnie Dayan. ‘No way’ to Nickelodeon park if it harms environment – Lopez MANILA, Jan 11 (Mabuhay) – Environment Secretary Gina Lopez said Wednesday she would not allow US television network Nickelodeon to build an underwater theme park in Palawan if it will damage the environment. While Lopez said she was not aware of any application from Nickelodeon, she said “I will never allow the corals to be harmed, that’s what we have, that’s our wealth. MANILA, Jan 11 (Mabuhay) – President Rodrigo Duterte on Wednesday spoke of strengthening “existing friendships” as he hosted his first New Year’s Vin d’Honneur in Malacañang for members of the diplomatic corps. “We value partners as we strengthen existing friendships even as we pursue new ones. MANILA, Jan. 10 (PNA) – The feast of the Black Nazarene ended generally peaceful early Tuesday morning with 1.4 million devotees joining the celebration this year, the National Capital Region Police Office (NCRPO) said. NCRPO Chief Police Director Oscar Albayalde said there were no major untoward incident during the ‘Traslacion’ or grand procession on Monday. Albayalde noted zero crime incident during the ‘Traslacion’ as he expressed his gratitude to all the help extended.
The procession started early after the mass at the Quirino Grandstand early on Monday. The procession was expected to last for many hours as its pace was very slow due to the huge crowd and flock of people waiting along the image’s procession route. The procession, which lasted for about 22 hours, ended as the Black Nazarene’s carriage finally reached Quiapo Church around 3:42 a.m. on Tuesday. As is to be expected, filing for bankruptcy is a complicated process but before such a step is taken it is essential to understand exactly what it is all about. Simply put, bankruptcy can be defined as the legal process thorough which individuals or businesses in financial trouble are able to work out their debts and pay them out under the protection of the bankruptcy court. Often â&#x20AC;&#x153;liquidationsâ&#x20AC;? or â&#x20AC;&#x153;reorganizationsâ&#x20AC;? are the words that are used to sum up the process that unfolds when you file for bankruptcy. The two kinds of bankruptcy that you can file for are Chapter 7 and Chapter 13. There are various factors that would determine whether you should opt for Chapter 7 or Chapter 13. Through Chapter 7 Bankruptcy you liquidate all unsecured debt, providing any assets you may have are exempt under bankruptcy rules. Most people never lose anything, because they donâ&#x20AC;&#x2122;t have any non-exempt assets. In the event debtor is making too much money, they choose Chapter 13 Bankruptcy,
which is the reorganization type of bankruptcy. The debtor is allowed three to five years over which to pay back a portion of the debts, based on disposable income. Say that you have $100.00 in disposable income. You would have to pay that into a plan for 60 months. After 60 months, the balance of your debts would be discharged in full, even if they are far from being paid off. One should keep in mind that there are intricate details to this legal process that need to be taken into consideration before decisions are made to file for bankruptcy. Who qualifies? Which kind would apply to you? Will you be able to keep all of your property? There are many such questions that arise in such a situation. In this situation, you need to consult with an experienced bankruptcy law firm that can guide you through these complicated decisions and procedures. Filing for bankruptcy may not be the solution to all your financial problems though. In fact, bankruptcy does not cover all debts. For example, debts related to child and spouse support, or taxes are not covered in bankruptcy. Do you have a Co-signer? Before filing for bankruptcy it is important to know that your co-signer might be held liable for the cosigned debt. However, a Chapter 13 bankruptcy may protect your co-signer, since it offers a partial repayment plan. With a Chapter 7 bankruptcy, only the debtor is protected and the co-signer would be liable for the debt. In this case, the creditors have the right to demand that your co-signer pay off the outstanding payments. Under chapter 13 bankruptcy, as long as the bankruptcy plan is active the co-signers will receive a stay for the duration of the debtors payment plan. At the end of the plan, a co-signer could once again liable to pay any outstanding payments, even though the debt is discharged in favor of the bankruptcy debtor. BEVERLY HILLSâ&#x20AC;&#x201D;A budding dream maker from the Philippines helped enliven â&#x20AC;&#x153;Zootopia,â&#x20AC;? a story about racism, that won best animated feature at the Golden Globe Awards Sunday night. In a backstage interview with the media after accepting the award, co-director Rich Moore paid tribute to the animated filmâ&#x20AC;&#x2122;s co-head, Josie Trinidad, saying she brought â&#x20AC;&#x153;her own point of view to that story.â&#x20AC;? â&#x20AC;&#x153;Sheâ&#x20AC;&#x2122;s from the Philippines. Sheâ&#x20AC;&#x2122;s a woman of color,â&#x20AC;? said Moore, who described Trinidad as â&#x20AC;&#x153;incredibly talented.â&#x20AC;? He said the film was â&#x20AC;&#x153;about bias and discrimination and racism and the damage that does to our society and the damage that leading by fear does to society.â&#x20AC;? OFW reunites with family on Christmas time after 7 years By Abner Galino
(Last of a two-part series) Lester Ramos used to be a materials controller in a gadget plant in General Trias, Cavite, a job that was usually held by people who have engineering background. But Lester, who rose from the ranks, said he got the job through sheer hard work and experience. “Kapag nagtrabaho po kasi ako, pinag-aaralan ko po talagang mabuti,” recalled Lester. The job though only paid enough for his family to get by. Lester wanted a better life. In 2008, Lester went to Ermita, Manila and applied for an overseas job. One employment agency was looking for materials controller. He was interviewed and found to be qualified. Lester shelled out $500 for processing fee. As his application supposedly moved on, the agency asked him for another $1,700 allegedly to cover for insurance, accommodation and “miscellaneous.” There was a hiatus after the last payment. For months, Lester didn’t hear anything from the agency.
“Akala ko wala na ’yun (placement fee). Sabi ko, naloko yata ako,” Lester narrated, which would turn out to be an omen. But his apprehension melted away when he got a call and was told that he would be part of a group of workers to be deployed to Tennessee. The workers were supposedly bound to work for a theme park in the said US state. Lester raised another $3,000 for his plane ticket and additional “processing fee.” To raise the money, Lester sold every valuable in his household and borrowed from his sister who was also an overseas contract worker. “Noong kulang pa rin ’yung pera, ni-refer nila (agency) kami sa nagpapautang (loan shark),” Lester revealed. Lester was confident that he would be able to pay back all the money he borrowed. He was promised an H2-B visa which supposedly would be renewed four months upon his arrival in the US. And that visa would be regularly renewed for up to three years.
Wife of fugitive Chinese official pleads guilty to immigration fraud Case related to ‘popular’ EB-5 investor visa
LOS ANGELES – The ex-wife of a former Chinese government official has pleaded guilty to charges that she conspired to fraudulently obtain visas to enter the United States through the immigrant investor program. Shilan Zhao, 53, of Newcastle, Washington, pleaded guilty yesterday to one count of conspiring with her ex-husband to commit immigration fraud by submitting false documents to federal authorities. As part of a plea agreement with prosecutors, Zhao agreed to cooperate with the government’s investigation into this matter. Zhao and her ex-husband – Jianjun Qiao, also known as Feng Li, 53 – were charged in a federal grand jury indictment unsealed in March 2015. Qiao remains a fugitive who is being sought by federal authorities. According to the indictment, Zhao and Qiao were divorced, but, in documents filed with U.S. immigration authorities, they falsely claimed to be married. The indictment also accused them of lying about the source of Zhao’s investment in the U.S., an investment which was required under the EB-5 immigrant investor program to obtain U.S. immigrant visas. Zhao pleaded guilty today pursuant to a plea agreement in which she admitted that she submitted false documents, prepared or obtained by her ex-husband, to U.S. immigration authorities under penalty of perjury to support her immigration application. REUNITED: On a rundown sofa inside a two-bedroom apartment in Buena Park sits Lester, 41, his wife Rudilyn, 38, son Lance Daniel, 11 and daughter Leah Anne, 8.
On October 2009, Lester left the Philippines with nine other workers. When they got to Tennessee, they were told that the bad weather had caused the theme park to be closed. The contingency plan, which was handled by the Hotel Catering Management Services, was to bring the workers to Fairhop, Alabama which was about 10 hours drive away. “Pinagkasya kami sa isang van. Sampung tao kasama ‘yung driver. Hindi kami komportable, ang haba pa naman ng biyahe,” Lester narrated. That was a foretaste of things to come. The workers were sheltered in a dilapidated and isolated house – without being provided with essentials such as food – and in the middle of winter. “Nag-ambagan kami, tapos bumili kami ng rice cooker. ‘Yun lang ang lutuan namin kaya lahat ng pagkain namin sa rice cooker namin niluluto,” Lester narrated. When their “guide” came back, the workers were told that they would work at a fastfood restaurant which was two miles away. Without any winter clothes, Lester and his peers layered themselves with whatever clothes they have. They walked each day from the house to the fastfood restaurant for four long months – making a measly $450 a month. Lester’s predicament was aggravated by the mental and emotional burdens of thinking about his family in the Philippines. The loan shark had started to bug Lester’s wife for payments. “Nagsisisi na ako dahil mas lalo pang naghirap ang buhay ng pamilya ko,” Lester said.
By that time, the more daring workers had fled to other places. Fortunately, for Lester a certain “Pastor Dan” helped him “escaped” from Alabama. He later found work in a shop in Illinois. He stayed there for a couple of months and went on to work in a Florida restaurant. Worried about his immigration status, Lester decided to move to southern California and took a caregiving job in a board and care facility where he thought he would be incognito. It was during Lester’s stint as a caregiver that he met with the members of the Filipino Workers Center (FMC) who regularly conduct welfare programs for caregivers. The same people hooked Lester with Migrante Southern California. Appraised of his rights and as well as of his chances to get justice for the wrong done to him, Lester decided to file a case against his recruiters in 2013. “Hindi basta-basta magdesisyon na mag-file ng kaso kasi siyempre iisipin mo na baka ’yun pa ang maging dahilan na ma-deport ka,” Lester said. Two years later, on Christmas time, Lester’s wife Rudilyn, 38, son Lance Daniel, 11, and daughter, 8, were around a Christmas tree in a Buena Park apartment. Lester’s battle isn’t over yet. But there’s a good chance that he might win it. Well, this is America – where the wheels of justice grind diligently for the weak and the strong, the rich and poor. Or, so we believe.

Filipino American Catholics in Los Angeles expressed jubilation over the appointment of Filipino-born Bishop Oscar Solis, as the new head of the Diocese of Salt Lake City in Utah. Solis, 63, currently an auxiliary bishop for the Archdiocese of Los Angeles, will fill a nearly two year vacancy in Salt Lake City after Bishop John Charles Wester was appointed to lead the Archdiocese of Santa Fe, New Mexico, in April 2015. Trini Paredes Foliente, one of Solisâ&#x20AC;&#x2122; ardent supporters in the Archdiocese of Los Angeles, disclosed that the news of Solisâ&#x20AC;&#x2122;s promotion immediately reached their â&#x20AC;&#x153;circleâ&#x20AC;? just minutes after the Vatican made the announcement. â&#x20AC;&#x153;We were so overjoyed!,â&#x20AC;? Foliente recalled, â&#x20AC;&#x153;we know in our hearts that he truly deserves the post. And as Filipinos, we are so proud because he represents everyone of us here.â&#x20AC;? The Filipino bishop, who speaks good Spanish, is also expected to get a warm welcome from Latinos who comprise the majority of the Diocese of Salt Lake City. Quoted in the Angelus News, the publication of Archdiocese of Los Angeles, Archbishop Jose H. Gomez said â&#x20AC;&#x153;our loss will be a gift to the family of God in Salt Lake City,â&#x20AC;? â&#x20AC;&#x153;I know that Bishop Solis will be for them a model of prayer and compassion and a great bishop. And I fully expect that he will become the leading voice for the millions of Filipino Catholics in this country, who are a beautiful sign of growth and renewal in our Church and in our country.â&#x20AC;? Q. I want to apply as an immigrant to Canada. I believe I am qualified as I am a doctor from the Philippines. The problem is that I have no status in USA. I overstayed. I am getting conflicting information. Can I file an application while I have no status or not? Do I need to leave the USA to do my medical? Iâ&#x20AC;&#x2122;m confused. A. Assuming you are qualified and assuming you file properly, you can indeed file an application when you have no status. We have been successful in doing so many many times. Second, you do not need to leave USA to obtain medical or police clearances. Q. My parents are visiting me in Canada. They have been visitors on valid status for over two years. They have been a great help to our family as they take care of the children. I researched the possibility of sponsoring them for humanitarian reasons but I recently received a refusal letter from Canada Immigration. I am receiving conflicting information. I know many people whose parents were in Canada and obtained permanent residence. Why was mine refused? I earn a very good living and finances are not an issue to care for them. So what went wrong? A. In short, you filed the wrong application. I am not certain if your poor advice was given to you via a friend or perhaps from the telecentre or from a consultant. Nevertheless, if done properly parents can indeed be sponsored while they are visiting Canada. Applications of interest are currently being accepted until February 2 for the 2017 quota. We have been successful in processing many such cases without requiring parents to even step outside Canadian soil. Best to obtain professional help. Q. I am saying this because one of the requirements for you to become an immigrant under the live in caregiver class is that no dependant must be inadmissible or have an enforceable removal order. If you marry, your spouse is your dependant and he has enforced removal order. Either not marry or have spouse leave Canada. Q. Iâ&#x20AC;&#x2122;m a student in Canada and will graduate soon. I was charged with a crime in Canada. The bail order says I must stay in Canada. I want to go home and/or stay in Canada to extend my studies. Will I be denied if I have a criminal case pending? A. During the â&#x20AC;&#x153;Traslacionâ&#x20AC;?, towels or handkerchiefs are hurled to the marshals escorting the Black Nazarene, with requests to wipe these on the statue in hopes that the miraculous powers attributed to it would â&#x20AC;&#x153;rub offâ&#x20AC;? on the cloth articles.
Traditionally, only men were permitted to become â&#x20AC;&#x153;namĂĄmasĂĄnâ&#x20AC;? (the devotees pulling the Ă ndas by its two ropes), but in recent years, female devotees have also been allowed to do so. Religious veneration of the Black Nazarene is rooted among Filipinos who identify themselves with the Passion of Jesus Christ. Many devotees of the Black Nazarene relate their poverty and daily struggles to the Passion of Christ as represented by the image. The Black Nazarene is borne in procession on its Ă ndas, accompanied by devotees clad in maroon who walk barefoot as both penance and in imitation of Jesus on his way to Mount Calvary.

The box office tandem of Sarah Geronimo and John Lloyd Cruz is back. The two are set to reunite in the upcoming movie “Dear Future Husband” three years since they last worked on a big-screen project together. While the cameras have yet to roll, supporters of the two could no longer contain their excitement that the film’s working title made it to the local trending topics on Twitter on Monday night. Photos of Geronimo and Cruz posing beside each other’s standee have also gone viral and are now making the rounds online. No other details about Geronimo and Cruz’s movie have been revealed yet. Then I have a meeting with Star Cinema for another possible project.” It’s said GMA Films is being revived in co-production with Regal Entertainment and one of their projects is a movie pairing him with Jennylyn Mercado. “Narinig ko rin ‘yan, sana nga matuloy,” says Dingdong. And there’s also a possible new with movie with Director Erik Matti for another “Aswang Chronicles” sequel. So have they patched things up after Matti promised him “Honor Thy Father” then gave it to John Lloyd Cruz. “Hindi naman ako nakipag-away. I just kept quiet. But okay na kami uli. Nagkausap na kami. Matagal na.” He’s very happy that viewers supported him as an action star in “Alyas Robin Hood”. “18 years na ako sa GMA at hindi ko akalain na may darating pala akong ganitong show. Senior wants Chapter 7 to discharge $30k credit cards Client is 64, a young senior. I say young because I consider seniors in their sixties as still active and robust. Except for more white hair, they still feel like they are 30. The problem with being in the sixties is that seventy is just around the corner. Now when one becomes 70, after ten years you become 80. In your eighties, your hoping that Putinâ&#x20AC;&#x2122;s anti aging pill is already in commercial production. Putin is 64 right now, just like client. He has a pharmaceutical company in Russia that is doing in depth research on mitochondria cells that focus on delaying aging and extending human life to 130. So, maybe this is why PEOTUS Trump wants to be his best friend. I wouldnâ&#x20AC;&#x2122;t mind being his best friend either if the Russian company actually makes this pill available for humans in the next
10 or even 20 years, I might still be around to benefit from it. Client says that his net income is $3,500 and that he is separated from his wife. His rent is $600 for a room. He sends money to his brothers and sisters in his country of origin. The problem is that he owes $30K of credit card debt. He pays minimum of $1K a month for the credit cards. He also has a car payment of $350. We donâ&#x20AC;&#x2122;t have to do more calculation here. The minimum payment of $1K for credit cards is almost a third of his next income. That is just way too much. He wants to get rid of his credit cards now that he is 64 so he can start saving some money. Well, itâ&#x20AC;&#x2122;s a little late to start saying money now but at least with the discharge of all of his credit cards, he can save $12K in the next 12 months, and $24K next year, then $36K then $48K. So when he turns 69, just before he becomes 70, he can have $50K saved up which he can use any way he wants. This is a lot better than keeping these cards, paying them $50K for the next 4 years, then still owe them the same principal of $30K when he turns 70. So, this is really a no brainer, isnâ&#x20AC;&#x2122;t it? Would he rather have $50K in cash and not owe anything at the age of 69, or throw away $50K in minimum payments and still owe $30K credit cards at age 69? He asks if his brother whom he used as reference for a personal loan who did not sign a personal guaranty is legally liable for his debt if it is dis-
charged in bankruptcy; of course not. Brother can only be made liable for his debt if brother signed a written personal guaranty. Without a signed personal guaranty, brother used a reference, cannot be sued because he has no legal liability to the creditor of client. Seniors need Chapter 7 to discharge $45k credit cards Next client are husband and wife who are 72 and 71. Wife made sure that I understood that she was only 71 and one year younger than her husband who is 72. Yes, I got that. One year makes all the difference. I told her that I stopped counting 20 years ago and advised her to do the same. Itâ&#x20AC;&#x2122;s useless to keep counting, whatâ&#x20AC;&#x2122;s the big deal anyway? Who wants to know that you are now one year closer to leaving this earth; certainly not yourself. Look at the picture of the Indonesian guy who is the oldest man alive at 145. I mean what can you do at 145? Youâ&#x20AC;&#x2122;re practically a cadaver and blind. Canâ&#x20AC;&#x2122;t hear anything. Quality of life is just zilch. Clients owe $46K of credit card. Their social security is $3K a month. Rent is at $1200. They have $1800 left but their credit cards need minimum of $1500. How are they going to eat and pay for other necessities if they continue to pay $1500 for credit cards? They can grow their
own vegetables in their backyard, if they had a backyard. They rent an apartment with no backyard. Husband says that he has all kinds of muscle pain and has a pacemaker, so that kills his plan to drive for UBER so he can raise another $1500 to pay for their credit cards. He says they have already lived a full life, having travelled all over the world, using the cards. But they have paid the cards for the last 20 years a total of $360K yet they still owe the very same $46K of credit cards today. I told them that they should have done their Chapter 7 twenty years ago, so today they would have $360K in their portfolio earning them at least 5% or $1500 a month, or $18K a year. That certainly helps now, instead of paying them a small fortune and still owing them the same amount of $46K. Should have gotten rid of these cards a long time ago. They decide immediately to file for Chapter 7 to discharge the $46K of credit cards. Peace of mind without credit card payments is what they need now at 72 and 71. Business owners need Chapter 7 to discharge $200k loans and to stop wage garnishment by SBA Last client were business owners. They are also seniors at 60 and 61. Caregiver Rights Update 2016 was a sensational year for caregiver rights. In January 2016, when California raised the minimum wage to $10 an hour, the minimum daily rate of pay for many 24-hour caregivers was raised to $315. The calculation of the daily rate is as follows: Under the Domestic Worker Bill of Rights (DWBR) law, the first 9 hours of work must be paid at minimum wage (9 hours x $10 an hour = $90), and the next 15 hours of work must be paid at the overtime rate (15 hours x $15 an hour = $225) making the total daily rate due caregivers for 24-hours of work $315 in 2016. This wage increase, along with other changes to Californiaâ&#x20AC;&#x2122;s labor laws that went into effect at the start of the year, truly set the stage for an eventful year in the world of caregiver law. To raise awareness of the plight of caregivers, who are all too often ignored, Kevin Rehwald, a partner at Chaleff Rehwald, wrote a 5000-word article examining caregiver rights. The editors of the magazine were so impressed with Kevinâ&#x20AC;&#x2122;s work that he was asked to appear on the cover of the November issue of Los Angeles Lawyer, the magazine of the Los Angeles Bar Association. Inside the issue, Mr. Rehwald had the honor of analyzing the DWBR, a law that made in-home personal caregivers eligible for overtime. Victims of domestic violence can terminate a lease on written notice to the landlord disclosure of text messages, e-mails, and Facebook info of a spouse or significant other may constitute domestic violence
Domestic violence is abuse perpetrated against a spouse, former spouse, cohabitant, former cohabitant, a girlfriend, a boyfriend, the mother or father of your child, your child. Family Code Section 6211. Abuse is not limited to the actual infliction of physical injury or assault. Family Code, § 6203(b). A court may issue an order enjoining specific acts of “abuse” (§ 6218, subd. (a)), which are defined as, among other things, behavior that could be enjoined under section 6320. (§ 6203, subd. (d).) Section 6320, in turn, permits a court to enjoin a party from engaging in various types of behavior, including “disturbing the peace of the other party.” (§ 6320, subd. (a).) “[T]he plain meaning of the phrase ‘disturbing the peace of the other party’ in section 6320 may be properly understood as conduct that destroys the mental or emotional calm of the other party.” (In re Marriage of Nadkarni (2009) 173 Cal.App.4th 1483, 1497, 93 Cal.Rptr.3d 723 (Nadkarni ).) The phrase includes “destroying the mental or emotional calm of [a former spouse] by accessing, reading and publicly disclosing her confidential e-mails.” (Id. at p. 1498, 93 Cal. Rptr.3d 723.) The expansion of the term “disturbing the peace” to cover accessing, reading, and publicly disclosing electronic communication has profound effect in every divorce and family law case. In Nadkarni, a former wife alleged that her ex-husband had accessed her private e-mail account while she was away on a business trip, then attached copies of the e-mails to documents filed in proceedings regarding custody of their teenaged children. In re Marriage of Nadkarni (2009) 173 Cal.App.4th 1483, 1497, 93 Cal.Rptr.3d 723. She sought a permanent restraining order, but the trial court denied it without a hearing after finding that the DVPA did not cover situations in which there was no physical harm alleged. The appellate court reversed and remanded the matter to the trial court for a hearing. It held that the definition of abuse under the DVPA is not limited to the infliction of physical injury or assault. Id. at pp. 1498, 1501, 93 Cal. Rptr.3d 723. In Marriage of Evilsizor and Sweeney, husband’s actions in releasing and threatening to release personal data downloaded from wife’s cell phone constituted “disturbing the peace of the other party” and thus
“abuse” which warranted restraining order. I’m sick to my stomach. My friends are mad at me, embarrassed as if I let him. I didn’t know he was even doing any of this. My parents are upset, you know. Why did I marry him? I didn’t know that things were going—I didn’t know. Yeah. It’s been incredibly challenging to live with.” She further testified that she had suffered shock and embarrassment and feared for her safety because of the disclosure. Evilsizor also was concerned about Sweeney’s threats to reveal information to the Internal Revenue Service about “things [she] didn’t do.” The court concluded in the Evilsizor case that even if Sweeney legally obtained Evilsizor’s information, an issue left unresolved, it was authorized under the DVPA to enjoin the disclosure or threats of disclosure of the information to protect

down in 2007. When the business closed, the company, which is an S corporation, owed an SBA loan of $49K, which is now $89K because of the accrued interest. SBA started to garnish wife’s wages last week. She didn’t like the garnishment. Can’t blame her, who wants to get your hard earned wages taken at the rate of 25% of gross. As PEOTUS says that is a “bigly” deduction, NOT FAIR! And NOT NICE! In addition, they owe $90K of credit card debt plus another $30K of unsecured business debt. They ask if it makes sense to settle the accounts owed. I say what for? With a Chapter 7, you can wipe out all of the $210K debt, start fresh again with zero debt, all it costs is the attorney & filing fees, which are very reasonable. Settlement at half for instance, would still cost $120K, which they don’t have. I mean, settlement is very expensive compared to Chapter 7 legal fees. You
wipe out $240K for almost not cost except legal fees. That’s the American way. Look at PEOTUS, his companies filed bankruptcy four times and he still the president elect. That is one smart dude. The court ordered Sweeney be “prohibited from using, delivering, copying, printing or disclosing the messages or content of [Evilsizor’s] text messages or e-mail messages or notes, or anything else downloaded from her phone or from what has been called the family computer except as otherwise authorized by the court.” Sweeney also was prohibited from trying to access or otherwise interfere with Evilsizor’s internet-service provider accounts or social-media accounts. Text messages, E-mails, Social media, and other electronic communication has become a common and inseparable part of today’s lifestyle. Accessing, reading, and publicly disclosing electronic communication of an ex, spouse, or sgnificant other has profound effect in every divorce and family law case. A finding of domestic violence against a party can affect the rulings on custody and spousal support issues. or dependent adult abuse where (a) the tenant allows the restrained person to visit the property or the landlord reasonably believes the restrained person’s presence poses a physical threat to others or to a tenant’s right to quiet possession and (b) the landlord previously gave three days’ notice to the tenant to correct the violation. Code of Civil Procedure § 1161.3(b). Code of Civil Procedure Section 1946.7 provides (a) A tenant may notify the landlord that he or she or a household member was a victim of an act that constitutes an act of domestic violence as defined in Section 6211 of the Family Code, sexual assault as defined in Section 261, 261.5, 262, 286, 288a, or 289 of the Penal Code, stalking as defined in Section 1708.7, human trafficking as defined in Section 236.1 of the Penal Code, or abuse of an elder or a dependent adult as defined in Section 15610.07 of the Welfare and Institutions Code, and that the tenant intends to terminate the tenancy. (b) A notice to terminate a tenancy under this section shall be in writing, with one of the following attached to the notice: (1) A copy of a temporary restraining order, emergency protective order, or protective order lawfully issued pursuant to Part 3 (commencing with Section 6240) or Part 4 (commencing with Section 6300) of Division 10 of the Family Code, Section 136.2 of the Penal Code, Section 527.6 of the Code of Civil Procedure, or Section 213.5 or 15657.03 of the Welfare and Institutions Code that protects the tenant or household member from further domestic violence, sexual assault, stalking, human trafficking, or abuse of an elder or a dependent adult. PNP deploys police teams to secure ASEAN 2017 venues, city sites By Lilian C. Mellejor
DAVAO CITY, Jan. 10 (PNA) – Four days to the launching of the Philippines’ chairmanship of the Association of Southeast Asian Nations (ASEAN) on Sunday, the Philippine National Police (PNP) started deploying over 1,400 police officers to the different areas of activities on Tuesday. On Saturday, the PNP said some 3,000 police officers, members of Task Force Davao, Armed Forces of the Philippines (AFP) and other force multipliers would have been deployed to secure places and delegates of the ASEAN Summit. Most of the police personnel, particularly from the Davao City Police Office (DCPO), will be assigned in the activity and billeting areas as well as securing roads. Philippine National Police (PNP) Police Regional Office XI spokesperson Chief Inspector Andrea Dela Cerna said the region remains on high alert status. Davao City will be the center of two major international activities this month. Aside from the ASEAN Summit, the city will also host one segment of the Miss Universe 2016. For ASEAN alone, the city is expecting more than 1,000 delegates which includes representatives from the diplomatic community, representatives from the private sector, national and local government units and business groups. PNP XI regional director Manuel Gaerlan has encouraged police personnel to closely coordinate with other units helping in the security of ASEAN. He reminded them on their primary mission which is to make sure the visitors and the public are safe and secured. The Davao City’s Public Safety and Security Command Center (PSSCC) laid down tighter security measures for the ASEAN Summit during a coordination meeting last week with Task Force Davao, the DCPO, Central 911, City Traffic and Transportation Management Office, and the Joint Task Force Haribon. This year marks the Philippines’ assumption as chair of the ASEAN with President Rodrigo Duterte taking the helm of the country’s leadership. Presidential Communications Secretary Martin Andanar earlier said the launch this year will help raise awareness regarding the country’s summit hosting and its benefits. The ASEAN 2017 is also significant because it coincides with the organization’s 50th year anniversary. Andanar said the Presidential Communications Office (PCO) will be the lead committee on media affairs and communications to spread awareness and educate the public about the ASEAN. Andanar noted that while 81 percent of ASEAN citizens have heard of the regional grouping, only 24 percent have a basic understanding of what it is and its purpose.

MANILA, Jan. 11 (PNA) – The long-delayed framework for the Code of Conduct (COC) in the South China Sea may be finally completed by the middle of the year, Foreign Secretary Perfecto Yasay Jr. said on Wednesday. In a press briefing, Yasay said the Philippines, as chairman of this year’s Association of Southeast Asian Nations (ASEAN), will intensify efforts to fast track the discussions on the Declaration on the Conduct of Parties in the South China Sea and eventually complete the COC. In fact, discreet discussions are currently underway and China has been “very cooperative” in the process, he said. “The formulation of the COC is precisely being discussed right now. I don’t want to preempt anything by revealing further information but I hope that it will be achieved by mid2017,” Yasay said. “There is now a convergence of national interest to come up with the COC and we are fortunate to have gotten this level.” The COC has been in the works

(3) (A) Documentation from a qualified third party based on information received by that third party while acting in his or her professional capacity to indicate that the tenant or household member is seeking assistance for physical or mental injuries or abuse resulting from an act of domestic violence, sexual assault, stalking, human trafficking, elder abuse, or dependent adult abuse. The notice to terminate the tenancy should be given within 180 days of the date that any domestic violence restraining order or police report. If notice to terminate the tenancy is provided to the landlord, the tenant shall be responsible for payment of rent for no more than 14 calendar days following the giving of the notice. The tenant shall be released from any rent payment obligation under the lease or rental agreement without penalty. Civ. Code, § 1946.7. This provision is particularly helpful in a divorce situation where the spouse who is the victim of domestic violence is a signatory to the rental agreement and the victim spouse wants to move out of the apartment
since 2002 but “intervening events,” as Yasay called, prompted years of delays and prevented it from moving forward. He said that the COC might “open the door to speed up bilateral engagement” with China to eventually enforce the ruling of an international arbitral tribunal in the disputed waters. The framework, Yasay disclosed, will include key elements and principles for the legally-binding COC. “I hate to think a party not to be bound by it or deviate from it. I’m sure that they will be bound by it,” he said, pointing out that the COC should be agreed by all the parties unanimously. The Hague-based Permanent Court of Arbitration last year nullified China’s excessive claims in the contested waters as it upheld the Philippines’ rights to areas within its 200-nautical mile exclusive economic zone, under the United Nations Convention on the Law of the Sea. ASEAN Summit is perfect occasion to promote PHL -- Palace
MANILA, Jan. 11 (PNA) – With over 100 summits and conferences to be held nationwide, the Philippines’ hosting of the 2017 Association of Southeast Asian Nation (ASEAN) Summit 2017 will serve as perfect opportunity to expose the country to the world, a Palace official said on Wednesday. “It will be a perfect for us because the media exposure is free for the Philippines and there are so many delegates,” Presidential Communications Office (PCO) Secretary Martin Andanar said in an interview with ABS-CBN Network’s morning showing Umagang Kay Ganda. Andanar said tourism will benefit more with the Philippines’ whole year round chairmanship of the ASEAN Summit 2017. He said the ASEAN 2017 will also be a good occasion to show to the world how the Philippines’ 7 percent gross domestic product (GDP) became one of the fastest in the world. “Tourism-wise and also because our GDP is 7 percent. It’s time to show to the delegates from around the world why we have 7 percent GDP,” Andanar said. Aside from mini summits and conferences, the Philippines will host three major ASEAN events that include: ASEAN Ministers meeting in April; ASEAN Head of States Summit in August; and, the ASEAN Head of States plus United States, Russia, China and Japan. He said the Department of Foreign Affairs (DFA) has sent invitation to the world leaders from US, China, Japan and Russia. “This is a big event considering that this year is the 50th anniversary, golden anniversary of ASEAN,” Andanar said. Andanar said the West Philippine Sea or South China Sea’s maritime dispute will be tackled during the ASEAN 2017. “So everybody is monitoring this issue, on what to do and what were the rules and regulations discussed during the last year’s ASEAN Summit in Laos because it is being pushed by Singapore and Malaysia and other ASEAN countries,” he explained. Andanar said at least PHP15.9 billion will be spent for the hosting of the ASEAN Summit 2017. He said a kick-off event of the ASEAN 2017 will be held on January 15 at the SMX event center in Davao City where delegates from ASEAN member countries will attend. ASEAN is compose of the Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar, Singapore, the Philippines, Thailand and Vietnam. President Rodrigo Duterte formally accepted the chairmanship of ASEAN during last year’s ASEAN Summit in Vientiane, Laos.

Duterte affirms commitment to free PHL from drugs, corruption, criminality By Cielito M. Reganit
MANILA, Jan. 11 (PNA) – President Rodrigo Duterte on Wednesday affirmed his commitment to free the Filipino people from the evils of drugs, corruption and criminality as he addressed the Diplomatic Corps during the traditional Vin d’Honneur at Malacañang Palace. “When I assumed the presidency six months ago, I pledged to lead my country and my people. I vowed to address three basic evils that subjected my people, especially the poorest and the disenfranchised to the most unbearable burdens of slavery, or millions of them, to drugs, corruption, criminality and a revolution in the south,” he said to honored guests during the traditional New Year reception. He said that his sacred vow has remained unchanged and stressed that he would certainly stay true to the mandate reposed on him as the nation’s leader. “The administration will remain firm in its resolve to hold the corrupt accountable for their deeds. We will make criminals responsible for their actions and we will work very, very hard to finally break the apparatus of the illegal drugs trade,” the President said. “In so doing, we affirm and renew our commitment to bring about the change that my country and people deserve,” Duterte said. Meanwhile, he said that all efforts are also
being made to bring about just and lasting peace in Mindanao and to finally bring to an end one of the longest-running communist insurgencies in the world. Alongside these efforts is the determination to bring about a stronger Philippine economy, he said. “Already, we have started the process of genuine reform to encourage more trade and investments, to intensify commercial activities, to ramp up investment and much-needed infrastructure, to increase revenues to make communities more resilient, and to improve basic social services,” he said. “These changes are vital to make the Philippines a stronger republic. It is on the basis of this political, social and economic reforms and the Philippines will be able to take on an even more active and more influential role in the community of nations,” Duterte said. In the meantime, the President also vowed to cooperate in addressing the common challenges faced by the international community such as the menace of terrorism, natural and human-induced calamities, transnational crimes, hunger and poverty and international disputes. “Indeed, as we thrive to be stronger at our core, we hope to do more not just for our own people but for our region and for the world,” Duterte said.
Pulse Asia survey results on Martial Law mean people want new solutions to PHL’s problems MANILA, Jan. 11 (PNA) – A Senator on Wednesday said that the survey results of Pulse Asia which showed that majority of Filipinos found that imposing Martial Law today is unnecessary meant that people wanted ‘new solutions’ to the country’s problems on crime and terrorism. “I think nandoon pa rin ang mga problema natin…Ang mga Pilipino naghahanap na ng bagong solusyon, na huwag na tayong bumalik sa mga gawain na nakasama naman sa ating bayan (I think our people are looking for new solutions…People want new solutions so that we won’t have a repeat of pursuits that could damage our country),” Sen. Paolo Benigno “Bam” Aquino IV told reporters in an interview. Results of the Pulse Asia survey showed that 74 percent of 1,200 survey respondents disagreed with the statement: “Candidly speaking, it may be necessary now to have martial law to solve the many crises of the nation.” Meanwhile, 12 percent agreed, and 14 percent were undecided. The survey was conducted last December 6 to 11, 2016. “It’ a complete rejection of this type of leadership, that type of governance na masyadong

Magiging historical na talaga iyan (I said before, appreciating what happened during the Marcos burial is not a legal issue. It’s a historical issue),” Aquino said.
74 pct of Pinoys see no need for Martial Law – Pulse MANILA, Jan 11 (Mabuhay) – Almost three in every four Filipinos disagree that the imposition of martial law is necessary to solve the country’s problems, according to a Pulse Asia survey released Wednesday. Of 1,200 respondents in the December 6 to 11 poll, 74 percent were not keen on returning to a totalitarian rule, an idea previously floated by President Rodrigo Duterte to strengthen his anti-narcotics crackdown. The survey found that the anti-martial law sentiment holds true across all all geographic areas (65 to 81 percent), socio-economic classes (67 to 76 percent), and age groupings (70 to 77 percent), as well as among both men and women (73 and 74 percent, respectively). At least 81 percent of respondents in Metro Manila do not want martial law compared to 65% in the Visayas. Pulse Asia said the same levels of disagreement are posted in other
socio-demographic groupings. The Pulse Asia survey was conducted just weeks after the Supreme Court’s decision allowing the burial of former President Ferdinand E. Marcos at the Libingan ng mga Bayani (LNMB) in November. Marcos signed Proclamation No. 1081 on September 21, 1972, placing the Philippines under Martial Law. Last August, Duterte asked Chief Justice Maria Lourdes Sereno if she would rather have the president declare martial law after the chief magistrate opposed the President’s naming of judges allegedly involved in drugs. Duterte in October also said said he is tempted to declare martial law because of the illegal drug trade in the country. The President, however, clarified last December that he will only impose totalitarian rule in case of foreign invasion.

Dormant for four years, case now moving The Supreme Court (SC) finally woke up from its slumber after four years of trying to protect a woman with questionable reputation and integrity. The Supreme Court is known for its notoriety of taking its time in deciding cases, particularly if it involves allies of those who appointed them in the High Court. That is why I was surprised to find out that controversial Senator Leila De Lima has been given by the High Court 10 days within which to comment on the disbarment case filed last year by a private lawyer seeking her disbarment. Maybe, most of the SC justices have now been swayed by a strong public clamor that De Lima has to be punished for having an illicit sexual relationship with a married man. The disbarment complaint, filed by lawyer Fernando Perito, accused De Lima of gross immorality in violation of conduct of lawyers due to her illicit sexual relationship with her driver/bodyguard identified as Ronnie Dayan. Aside from Dayan, De Lima was also suspected to have been romantically involved with her two other close-in security aides, PSG Jonel Sanchez and Warren Cristobal, a motorcycle escort from the MMDA. Perito’s complaint against the sex-starved De Lima was further strengthened by the lawmaker’s public admission in a television interview that she indeed had a sexual relationship with her driver/bodyguard for several years. The Supreme Court has been trying to cover up for De Lima’s complete disregard for the rule of law. It is about time that De Lima answers for all the unlawful things she did
during her stint as Justice Secretary. In 2011, as Secretary of Justice, De Lima completely disregarded and defied an SC temporary restraining order (TRO) when she prevented former President Gloria Macapagal Arroyo and her husband Jose Miguel, from the leaving the country to seek medical treatment. Although a similar disbarment case was filed by Perito against De Lima in 2012, the Supreme Court, for unknown reasons, sat on the case for four years, until now. It is not surprising for the SC to put the De Lima case in the archive since Chief Justice Lourdes Sereno and De Lima were both appointees of former President Noynoy Aquino. We will find out if Chief Justice Sereno and her yellow justice allies will be able to shield De Lima again from her alleged transgressions of the law during her stint in the Department of Justice. Someone should discipline De Lima who probably does not even have an iota of what the rule of law means. *** President Duterte is really a man of his words. He promised that once elected as President, he will increase the monthly pension of retired Social Security System (SSS) members. Despite strong objections from his economic advisers that the pension fund might run out by 2032, President Duterte approved an immediate
P1,000 increase for all SSS retirees. Malacanang said Duterte chose to fulfill his campaign promise to the people, particularly to the elderly and the poor, to give them additional financial assistance at their late stage in life. During the 16th Congress , a bill seeking a P2,000 pensions rate increase was filed and approved in congress. It was however vetoed by former President Noynoy Aquino. The SSS is a private pension fund and has a reported total assets of P487 billion as of October 2016. Malacañang is saying that despite the P1,000 increase for all SSS retirees, the fund life of SSS will remain stable up to year 2040. The fund life of SSS will only remain stable if the sitting President will not allow the Chairman and other SSS directors to receive unreasonable huge salaries and bonuses during their tenure in office. The decision of Duterte to grant the pension increase despite the strong objections from his economic managers is very commendable. His heart is really with the poor. Duterte can’t not rely on Congress to sponsor another pension increase measure. But he has the balls and political will to order the pension increase immediately and to worry later on how to come up with the money needed to shoulder the pension raise. This is the Duterte way. “Action agad si Digong and walang teka, teka muna.” Filipinos must be rejoicing that they have elected a President who is not only a man of his words, but as well as a man with a big heart, particularly for the poor and oppressed. *** Ombudsman Conchita Carpio
Morales’ tenure in office will end by next year if I’m not mistaken. So far, Ombudsman Morales has prosecuted many erring public officials, but only those who are perceived to be the political enemies of her benefactor, former President Noynoy Aquino. Hopefully, before her term expires, she would veer away from the selective justice that she used to do during the Noynoy administration. It would be interesting how she will handle the criminal complaint against De Lima for her alleged role in the proliferation of prohibited drugs inside the NBP once the case will be forwarded to her office. We will also see if Morales will act swiftly on the criminal complaint against former Transportation Secretary Joseph Abaya in connection for the purchase of P3.8 billion worth of vehicular license plates during the time of firmer President Noynoy. It was alleged in the criminal complaint that Abaya and his men connived to allow an unqualified trading company to win the bidding for the purchase of vehicular license plates. It was also stated that Abaya and his men falsified documents and the financial standing of the non-qualified company to enable it to participate in the rigged bidding at the DOTC. I hope Ombudsman Morales will not allow this Abaya case to be archived in her drawers until the time she will retire by next year. Ombudsman Morales is old. It is about time that she renders her decision based on the rule of law and not based on political patronage. She has to be truthful and honest in doing her job as an Ombudsman, even at least during the last year of her incumbency.

How to prepare for a home loan and what you should know prior to applying Getting a home mortgage now may be easier, lenders will make more efforts to try to understand the borrowers need in order to help them finance more loans Lenders will still be very sensitive to debt to income ratios, credit, fund reserves, employment history etc. but I suspect soon they will have to ease up on some guidelines I noticed a great number of homebuyers first time or repeat home buyers inquiring more about lending guidelines and basically how to rebuild credit. There are plenty of alternative lenders that has easier ways to qualify but might require a higher down pay and they will want a higher rate of interest. So, I have gathered some important guidelines from our source of underwriting mainly thru Fannie Mae and Freddie Mac and thought of sharing them with you. There are several types of financing, Conventional with minimal 5% down and Government loan FHA with a minimum of 3.5% Down. The guidelines are similar maybe a little bit more leniency towards FHA but here are the juice of what you need to know and to prepare for: Non Occupant Co-borrower: The income of a non-occupying co-borrower may be considered for qualifying purposes, subject to additional criteria: Down Payment: The occupant borrower must provide 5% of the purchase price towards the down payment using their own funds (which must come from an acceptable source). Qualifying Ratio: The qualifying ratio for the occupying borrower cannot exceed 35%/45% The occupant-borrower must demonstrate the ability and willingness to make the mortgage payment and maintain homeownership. The income from the non-occupant
co-borrower can offset certain weaknesses of the occupant-borrower, such as limited financial reserves, limited credit history, or a higher-than-normal qualifying ratio. However, the income from a non-occupant co-borrower cannot be used to offset significant or recent instances of major derogatory credit in the occupant-borrower’s credit history or an occupant-borrower’s inability to make the mortgage payment without regular and significant assistance from the non-occupant co-borrower. Credit Requirements: A 3 bureau merged in-file report must be obtained that contains at least 3 credit scores for each borrower. A “representative score” (lower of 2, middle of 3) will be chosen for each borrower on the loan. Then, the lowest of all the borrower’s “representative scores” will be the score used for qualifying. The borrower’s established credit history needs to consist of a minimum of 4 trade lines (installment, revolving accounts, mortgages, etc.), one of which has been open a minimum of 24 months, the other 3 must be rated for at least 12 months. Authorized accounts are not included in the minimum trade line requirements. All transactions require a minimum 620 credit score regardless of the automated approval Borrowers without credit scores are not permitted. Loans utilizing non-traditional credit are not permitted
Acceptable income source: Wage Earner Income Self-Employed: Sole Proprietorship, Partnership, Corporations and S Corporations. Non-Employed Income: Alimony/ maintenance/Child Support/Separate maintenance, Foster Care, Unemployment/Welfare/ADC, Disability/ Worker’s Compensation, Retirement/ Pension, Social Security, Annuity, IRA, Military/VA Benefits, Trust, Interest & Dividend, Inheritance/ Guaranteed Income, Note Receivables, Mortgage Differential/COLA and Rental. Income from sources other than the ones addressed may be considered provided the borrower has received the income for at least 2 years and documentation supports that it will continue for at least 3 years. Asset Documentation: Liquid assets include checking accounts, savings accounts, CD’s, gifts, money market, mutual funds, stock, trust funds, net equity, bridge loans, bonds, secured borrowed funds, etc. Retirement accounts (IRAs) are valued at 60% of the vested amount of the asset. Funds from personal assets that are sold prior to closing are acceptable as long as the individual purchasing the asset is not a party to either the property sale transaction or the mortgage financing transaction. The borrower must document ownership of the asset, the value of the asset, provide a bill of sale and proof of receipt of funds. Assets are verified with 2 months consecutive bank statements. Internet statements are only acceptable if it reflects the same information as the bank statement would reflect. The URL must reflect at the bottom of the statement and all pages must be provided. Bank statements must be dated
within 45 days from the date of the application. All pages must be provided regardless if blank GIFT FUNDS ARE ALLOWED AS DOWN PAYMENT FOR OWNER OCCUPIED LOANS WARNING: Avoid Cash deposit, they are very difficult to paper trail and trace. A lot of concerns about credit with Foreclosures or Short Sales or Bankruptcy ?usually for bankruptcy 4 years from Discharge of chapter 7 or 11. For Foreclosures the guideline states 7 years from foreclosure dates. For Short Sales which states “Account Paid for less than amount owed” with zero balances on their accounts, the guidelines states 4 years but mostly lenders now will allow 3 years and if you did not have any mortgage lates prior to the short sale closing, FHA supposedly will allow 2 years from the time the Short Sale closed. There is a very imbalance scale now between buyers and sellers, much more buyers than sellers. So, make sure you a prepared to be patience and fully ready to close at a drop of a dime once your offer is accepted. Good luck, I strongly believe the bottom of the Real Estate is behind us therefore it’s a great time to start to set goals towards homeownership for first time buyers and investors. 2016 will have a more balanced inventory to buyers ratios, therefore it evens out the playing field for first time buyers. Are they involved in a hobby or a business? That can be a challenging determination for taxpayers, and there are special Internal Revenue Service rules to answer that question, notes the California Society of CPAs (CalCPA.org). You may be surprised by what they mean to you. Here’s the information you need to understand where you stand and how it affects your tax situation. What Is a Business? Both hobby and business income is generally taxable. If your activities can be considered a business, then you can deduct the qualified expenses involved, even if they exceed the income that the business brings in. A key feature of a business, however, is that it is undertaken to earn a profit. In the eyes of the IRS, an activity is presumed to be carried on for a profit if it has made a profit in at least three of the last five tax years, including the current year. (There’s a slightly longer horizon for businesses that involve breeding, showing, training or racing horses.) If you haven’t had the three years or more of profits, the IRS may take
nine other factors into account. They are the following: . Whether you carry on the activity in a businesslike manner. . Whether the time and effort you put into the activity indicate you intend to make it profitable. . Whether you depend on income from the activity for your livelihood. . World Bank sees PHL GDP to grow 6-7% in 3 years By Kris M. Crismundo
MANILA, Jan. 11 (PNA) – The World Bank has seen sustained economic growth in the Philippines at 6.0- to 7.0-percent level in the next three years. In its 2017 Global Economic Prospects (GEP) report released in Washington on Tuesday (Wednesday in Manila), World Bank forecasted gross domestic product (GDP) for the Philippines in 2019 to grow 6.7 percent. The World Bank also hiked its projection for the Philippines in 2017 and 2018, which was forecasted in June 2016 to settle at 6.2 percent for both years. The latest report now expected Philippine GDP to expand 6.9 percent for this year, higher by 0.7 percentage points from its previous projection. Higher growth projection is likewise seen next year at 7.0 percent, up by 0.8 percentage points. Economic growth projection for the full year of 2016 was also upgraded to 6.8 percent from its previous forecast of 6.4 percent due to higher-than-expected growth in third quarter last year at 7.1 percent.

Vacationers from US start to arrive in Cebu City for Sinulog
CEBU CITY, Jan. 11 (PNA) – Vacationers or “balikbayans” from the United States started arriving in this city on Wednesday to attend the Sinulog Festival activities this week and the Sinulog Grand Parade on Sunday, January 15. The Department of Tourism (DOT) 7 officially welcomed them at the Mactan-Cebu International Airport (MCIA) in Lapu-Lapu City. Nine returning overseas Filipinos first arrived past 8:30 a.m. Wednesday at the MCIA through a connecting flight from Manila together with other domestic passengers. Flight PR 2845 of Philippine Airlines left Ninoy Aquino International Airport at 7:15 a.m. on Wednesday. The passengers were greeted at the arrival area by a four-man rondalla playing the Sinulog theme while usherettes clad in colorful Filipiniana dresses adorned them with souvenir necklaces. Dancers in bright-colored cos-
tumes danced to the Sinulog beat outside the airport to entertain those who were waiting for the balikbayans and fetched them from the airport. The DOT 7 and the Balik Cebu committee also welcomed balikbayans from the US via Eva Air and Cathay Pacific connecting flights at 10:30 a.m. and 11:15 a.m, respectively. The welcome ceremony is part of the Balik Cebu program, an initiative that was launched in 2002 to encourage more overseas Cebuanos to come home during Sinulog week. The bulk of the balikbayans is set to arrive on Thursday. A chartered flight direct from Los Angeles with 300 balikbayans will arrive at the MCIA around 4:30 a.m. on Thursday. Some 500 balikbayans will be treated to a barrio fiesta welcome dinner on Thursday evening at the Ayala Terraces in Cebu City where they will enjoy performances by Cebuano entertainers.
Tingguian tribe celebrates Tadek Festival NUEVA ERA, Ilocos Norte, Jan. 10 (PNA) – A decade-old annual celebration showcasing this town’s rich culture and traditions has started earlier this year as local residents welcomed 2017 in a festive mood. Being held January 9-12, this year’s Tadek Festival of Nueva Era derived from the Tingguian tribe’s cultural dance highlights a variety show of local talents participated in both by young and old generations. “Nueva Era’s Got Talent” and a variety show which will be held Tuesday night is an added attraction this year with at least nine competitors representing various organizations here. Town Vice Mayor Aldrin Garvida said the main event of Tadek Festival that is running for 12 years now, will be on January 11, which is the Community and Tribal Day, showcasing a day with the community, parade of carabao-drawn carrier or the so called “Parada ti karison” and the coronation night of Miss Nueva Era 2017.
The local government of Nueva Era, which is poised to become the next summer capital of Ilocos Norte, has initiated the construction of an eco-cultural park featuring the distinct traditions of the Tingguian community—from tribal huts, tree houses connecting to hanging bridge with swimming pool amenities, and nature hikes. Established in 2013, the area is a must see place when visiting the province and it is now being flocked to by thousands of local and foreign tourists. Unknown to many, Nueva Era town located about 43 kilometers from Laoag City is endowed with verdant mountains and crystal clear rivers and it has an upland area with the same climate or probably colder than Baguio nowadays. A development masterplan is now on its way for the construction of more tourism-related facilities in the area as investors had already committed to partner with the government to lure more visitors into this part of Luzon.

Cuba sees 74% jump in US visitors in 2016 HAVANA, Jan. 12 (PNA/Xinhua) – In 2016, 74 percent more US citizens took advantage of improved bilateral ties to visit Cuba, compared to the year before, the Cuban government announced on Wednesday. The official data shows that in 2016, 284,937 Americans visited Cuba, for a 74 percent increase in comparison with 2015,” Josefina Vidal, director of US affairs at Cuba’s foreign ministry, posted on Twitter. While US citizens are still banned from freely traveling to Cuba, the administration of outgoing President Barack Obama has relaxed restrictions, allowing travel for business, education, religious or humanitarian purposes. President-elect Donald Trump, who takes office on Jan. 20, has hinted he may revert such policies to pressure Cuba into making more concessions to Washington. Cuba has seen a tourism boom since Havana and the White House agreed in 2014 to work to normalize ties after half a century of animosity. Regular commercial flights from US cities to Cuban destinations were relaunched in August. Today seven airlines operate nearly 20 flights a day from the US to Havana. Cruises have also increased, with companies from Spain, Russia, Canada and the US, including Cuba, on their sailing itineraries. In 2016, Cuba saw a record 4 million international visitors, 13 percent more than in 2015. The tourism industry is hoping to attract more visitors, although it lacks the infrastructure for rapid growth.

Health dept targets 42 million school children for mass deworming By Leilani S. Junio
MANILA, Jan. 10 (PNA) – The Department of Health (DOH) is targeting 42 million schoolchildren aged 1-18 years as beneficiaries of its nationwide deworming program under the school-based immunization program. During Tuesday’s press briefing at the DOH media relations unit in Tayuman, Sta. Cruz Manila, Health Secretary Dr. Paulyn Ubial said they are looking forward to carrying out “Oplan Goodbye Bulate” this month among 19 million children aged 5-18 years in public schools, as well as 23 million preschool (1-4 years) and school-aged children who are not in public schools. Another deworming will be conducted in July as part of the National School Deworming Month. A total of PHP106.3 million has been allocated in the DOH budget for this year’s deworming program.
“This includes everything -- the health information, training, IEC materials and also the response for side effects and surveillance and for research,” said Ubial. Of the amount, PHP82 million will be spent on the tablets, which cost PHP2 each, she said, noting that the amount is higher than the PHP59.8 million budget allocated last year. The DOH will collaborate with the Department of Education in the deworming in public schools, while private schools may receive the deworming pills from the health centers, rural health units, and barangay health stations. Mass deworming is done to help prevent the discharge of “ova” or eggs of parasitic worms to the environment to decrease re-infestation rates among children. “If we can reduce the volume of ova/eggs, we can reduce the infestation,” Ubial said, adding that
deworming should be coupled with proper hygiene and sanitation. In July last year, the national deworming campaign covered 15.8 million of the target 19.2 million school-aged children, and 7.8 million of the target 10.6 million preschool-aged children. World Health Organization (WHO) country representative, Dr. Gundo Weiler, said the Philippines has surpassed the 75 percent target recommended by the organization. “It is excellent to see you (DOH) ahead and your coverage is exceeding the global rate and also the regional average rates for the coverage rate in school children of more than 80 percent and pre-school children of more than 70 percent. It is a testament to the strong commitment by the government. We want to congratulate the Philippines for that,” Weiler said. “The challenge is for us to be able to go beyond the 82 percent
accomplishment rate achieved last July,” Ubial said. The deworming program, which will administer the Albendazole chewable tablets (400 mg), will be on a voluntary basis and will only be implemented with consent forms filled up by the parents or guardian of the child. “Let us not deprive our children of the protection against serious illnesses. Ask and verify facts on deworming from your nearest health facility,” Ubial said, assuring that the drug is safe and has been certified by the WHO and the Food and Drug Administration. She said the tablet’s side effects are “minimal” -- dizziness, nausea, headache and vomiting -- and are transient, self-limiting and manageable. She further clarified that the abdominal pain reported in Zamboanga in the past deworming program has been proven to be unrelated to the deworming pill.
Hontiveros pushes for a national multi-sectoral strategy vs. HIV Akbayan Senator Risa Hontiveros on Wednesday pushed for the implementation of a national multi-sectoral strategy to address the rising incidence of HIV and AIDS in the country amidst reports that there will be 133,000 people living with HIV in the Philippines by 2022. In a press conference in Quezon City attended by lesbian, gay, bisexual and transgender (LGBT) groups and organized by the DANGAL National Network, Hontiveros
said that from 6,015 total cases in 2010, HIV/AIDS incidence in the country rose to a total of 33,419 during just the first quarter of 2016. “The situation we face is dire,” the senator said. “The rapid increase in the last six years reflects an alarming landscape: the HIV is expanding in urban centers of the country, affecting disproportionately populations and communities that are marginalized and vulnerable: young Filipinos, gay and bisexual men, transgender people, and
people who use drugs,” Hontiveros added. As a response, Hontiveros, who is also the Chairperson of the Senate Committee on Health and Demography, filed Senate Bill No. 376 or the Philippine HIV and AIDS Policy Bill to introduce an evidence-based, human rights-informed, and gender-transformative HIV prevention and treatment plan. Hontiveros said her bill will formulate a six-year National Multi-Sectoral HIV and AIDS Strategic Plan, which will incorporate a
prevention program that will have a strong focus on education and accessibility of reproductive health services. “80% of new infections come from men having sex with men. The median age of those diagnosed with HIV is below 35 years old” Hontiveros lamented. “At a time when stigma overrules government policies on this important health issue, we need to underscore that the foundation of curbing HIV must be based on the protection of human rights” she said.

Invaluable coverage: The deadline to sign up thru Covered California in 2017 nears Affordable and invaluable health care is available for uninsured Californians in 2017. But the deadline to enroll is drawing near: Covered California’s open enrollment ends on Jan. 31. Those who enroll by Jan. 15 will have their coverage begin on Feb. 1. Those signing up between Jan. 16 and Jan. 31 will have coverage starting March 1. While rising rates are a real concern, Covered California members who are renewing their coverage now are finding real savings by shopping around within their health plan’s metal tier. (Plans are available in four metal tiers, also known as coverage levels.) Covered California found that renewing members who have switched their plan, but remain within the same metal tier, have saved an average of $38 per month or $456 per year. In addition, more than half of all Covered California consumers, 59 percent, are eligible to choose a Bronze plan for less than $10 per month. Bronze plans offer three visits to a primary care physician or specialist that are not subject to a deductible. Also, nearly half of all Covered California consumers, 49
percent, can get a Silver plan for less than $100 per month.None of the outpatient services included in the Silver plan —such as primary, urgent and specialist care —is subject to a deductible. For someone like Adam Kuns, 27, of Camarillo, the financial impact is secondary to managing his diabetes. Kuns was on his parents’ insurance plan until age 23, but he was depleting their retirement fund paying the $10,000 deductible for all of his needed care. That was until Covered California began offering coverage in 2014. “I can get the care I really need without going bankrupt,” Kuns said. “I’ve been on both ends of the stick. I’ve gone from having no health care and draining my parents’ retirement to having health insurance that actually works for me. I’m willing to pay a higher premium to get a lower deductible.” As a small-business owner, Kuns said it can be tough paying more than $340 a month for coverage, but it certainly is better than the alternative. Along with diabetes, Kuns also has ulcerative colitis. He now has an insulin pump and sees an endocrinologist regularly to help
him manage his conditions. Controller calls on city to hold off on parking fine reductions Instead urges cuts to punitive tickets and overhead costs with new technologies and better signage Los Angeles – Controller Ron Galperin unveiled a new parking website that explains LA’s parking ticket program. The online report shows the City generated close to $148 million in gross ticket revenues in the last year – but some ¾ of ticket revenue went to overhead, salaries and administrative costs. The remaining $41 million was transferred to the City’s General Fund to help pay for City services such as police and fire. With the City facing significant liability claims, potential cuts in federal grants and a projected $245 million budget shortfall for 2016-17, the Controller warned policymakers to act with caution in reducing parking
fines and urged the City to instead invest in smart technologies and other reforms to help reduce costs of the Dept. of Transportation’s parking enforcement program – and to enact changes that will help Angelenos to avoid getting a parking ticket in the first place. “As much as we’d like to reduce parking fines, we currently rely on the revenues,” said Galperin. “Rather than just cut ticket prices now, we should instead invest in new solutions that will help to reduce administrative costs, and give people a clearer indication whether they can park in a spot—so as to not get a ticket in the first place.” The Controller advocated for smart parking reform that focuses on helping people avoid being ticketed, and on helping to increase compliance. These reforms include: Expansion of smartphone apps so people can add money to their meters
by phone; More efficient freight and delivery truck parking program; Reevaluation of street sweeping schedules and notifications; Digital parking signs that are easier-to-understand, easier to change, and clearly tell people what the fine is for a violation; Explore possible changes to accrued late fees and penalties - both to decrease the burden on people who have trouble paying and to increase the likelihood of actual collections. (19% of tickets get paid late and incur additional fees). “Everyone hates getting parking tickets, but parking tickets are an important tool to keep parking spots available in front of businesses, ensure first responders have access to fire hydrants and fire lanes in case of an emergency, and help make sure Angelenos can find parking spots near their homes,” said Galperin.
