What happens to my car if I file bankruptcy?

There are several issues to consider in answering this question. The most important point is the value of your car. In most cases, you can protect your car using the allowable bankruptcy code exemptions. An exemption allows you to file for bankruptcy relief and protect some of your property. The bankruptcy courts understand you need a car to get to work and to pick your kids up from school. So long as you aren’t driving an antique classic car, or an expensive sports car you will likely be able to keep your car. The next question is whether you have clear title to your car. If you have pledged your vehicle as security for a debt, or if you are financing or leasing a vehicle, you have three options for secured car loans when you file Chapter 7 bankruptcy. Reaffirm: A reaffirmation agreement is a contract between you and the car creditor in which you agree to pay the balance owed on your car note, despite the bankruptcy filing. You continue to make payments, and the creditor promises that, as long as payments are made, the creditor will not repossess or take back the property. Reaffirmed debts are not discharged, the debt survives the bankruptcy. If you do not make your car payments after you reaffirm the car loan the car lender can repossess the car and sue you for the deficiency balance. After the finance company repossesses the car they will sell the car at the auto auction. Usually the finance company does not get enough money from the auction to pay off your loan. This shortfall is called a “deficiency” and you would still be legally obligated to pay the creditor the deficiency balance. As you can see, the decision to reaffirm your car loan is a serious financial matter. Reaffirmation agreements are strictly voluntary. You are not required by the Bankruptcy Code or other state or federal law to reaffirm your car loan. Before entering into such an agreement, you will want to speak to your bankruptcy attorney to make sure that the reaffirmation is in your best interest. Redeem: In Chapter 7, you have the right to purchase or redeem your car from the creditor by making a lump sum payment equal to the car’s fair market value. The 2005 bankruptcy code provides that you must pay the creditor the replacement retail cost of the car. The balance of the debt will be discharged. For example, assume you own a car worth $5000.00, but owe the finance company $10,000.00. In this circumstance, you could redeem the vehicle by paying the creditor $5000.00 and the remaining balance will be discharged in your bankruptcy. Your bankruptcy attorney can advise you on the benefits of redeeming your financed car and identifying lenders that will provide the funds for your vehicle redemption. Surrender: If you cannot afford the monthly payments on your car loan, or if you determine that you owe more than the car is worth, you can unload the car and the debt in your Chapter 7 bankruptcy by surrendering the vehicle to the creditor. Car Leases in Chapter 7 Bank-

ruptcy If you are leasing your car when you file Chapter 7 bankruptcy you can choose to either continue making the monthly lease payments, or surrender the car back to the creditor. If you surrender the leased car, any obligation under the lease will be eliminated in your Chapter 7 bankruptcy case. Car Loans in Chapter 13 Bankruptcy Chapter 13 bankruptcy is a powerful tool to protect your car from repossession. If you have fallen behind on your car payments, you can file a Chapter 13 bankruptcy to stop the repossession of your vehicle and repay any delinquent monies due. If you are not delinquent, you have the choice of just continuing your regular payments, or surrender the vehicle, and discharge the balance as an unsecured debt, much te same way as in chapter 7. 910 Claims: If you bought your vehicle less than 910 days of filing your bankruptcy case, you must repay the entire car loan. The good news is that the interest rate you pay on your car loan may be significantly reduced. For example, if you owed $10,000 on a car loan whose blue book value was only $5000, you would be required to pay the entire $10,000 balance if the car was purchased less than 30 months, or 910 days, of filing. In short, debtors who want to keep their cars must pay the full loan amount, rather than “cram down” the debt to the value of the car. Cram Down: If you bought your car more than 910 days before you file bankruptcy, you will only have to repay an amount equal to the present value of the car. For example, if you owed $5000 on a car that is worth only $2500, upon filing Chapter 13 you would be required to repay the finance company only $2500 over the three to five year term of your Chapter 13 Plan. Car Leases in Chapter 13 Bankruptcy Your car lease cannot be paid through the Chapter 13 Plan you devise with your bankruptcy attorney. You can “assume” the lease and continue making the monthly payments. You can “reject” the lease and return the car to the creditor. The creditor will sell the leased vehicle, apply the sale proceeds to your lease balance and then file a claim in your Chapter 13 bankruptcy case for the lease deficiency. This deficiency is an unsecured, non-priority claim, which means you will likely only pay the finance company pennies on the dollar. Aquino to PNPA grads: Choose country over self SILANG, Cavite, Mar 10 (Mabuhay) – President Benigno Aquino III on Thursday told the new graduates of the Philippine National Police Academy (PNPA) to shun corrupt acts in the coming May national and local elections. “Kung abutan kayo ng sobre kapalit ng inyong dangal, tatanggapin niyo ba? Kung pinapili kayo, bayan o sarili?” Aquino asked the graduates in his speech. “Huwag niyo sanang sayangin ang mga reporma ng nauna sa inyo,” he added. Aquino was the guest of honor at the 37th commencement exercises of the PNPA “Masundayaw” class of 2016. The class name Masundayaw was derived from three words: Maisug, a Visayan word for valiant; Sundaro, a Marano word for warrior; and Dayaw, an Ilocano word for honor. During his speech, Aquino touted the procurement of modern equipment and vehicles—including 490 patrol jeeps, 247 4x4 personnel carrier, 69 light transport vehicles, 1,095 motorcycles, 2,949 radios— for the police. Mar takes Santiago dare, OKs lifestyle check CAVITE, Mar 10 (Mabuhay) – Presidential candidate Mar Roxas on Thursday said he is open to any lifestyle check following the call of one of his rivals, Sen. Miriam Defensor Santiago, to bare where their huge campaign funds come from. Salonga had been fighting corruption and dictatorship since his youth. The son of a Presbyterian minister from Rizal province, he joined the resistance movement during the Japanese occupation, was captured, tortured and sentenced by a military court to years of hard labor. Grace , Binay hold on to shared lead: Pulse Asia MANILA, Mar 9 (Mabuhay) – Senator Grace Poe (independent) and Vice President Jejomar Binay (UNA) are holding on to their shared lead in the latest Pulse Asia Inc. survey on voters’ preferred presidential candidate for the May 9 elections. Commissioned by ABS-CBN, the survey was conducted from February 16 to 27, during which the country marked the 30th anniversary of the EDSA People Power uprising, and the five presidential candidates faced off in their first public and televised debate. Some 5,200 qualified voters were covered by the Pulse-ABS CBN survey – almost triple Pulse’s usual sample size of 1,800 respondents. The huge sample size meant a smaller margin of error, which Pulse pegged at plus/minus 1.4. A unique feature of the latest Pulse-ABS CBN survey was the “secret voting,” in which respondents gave their answers in sealed ballots opened only during tabulation. Asked whom they would vote for president if elections were held to-

day, 26 percent of the respondents picked Poe, while 24 percent chose Binay. Pulse said with the error margin, the 2-point gap between Poe and Binay placed them in a statistical tie. At third place in the presidential survey was Davao City Mayor Rody Duterte (PDP-Laban) with 22 percent; followed by former Secretary Mar Roxas (LP) with 19 percent. Sen. Miriam Santiago (PRP) was a far fifth with 3 percent. With 29 percent of the respondents, Poe would also be the voters’ second choice for president if Binay, Duterte, Roxas, or Santiago were to drop out of the race for whatever reason. Poe was the next option for 37 percent of Binay’s voters, 31 percent of Duterte’s, and 41 percent of Roxas’. She was statistically tied with Duterte – 21 and 22, respectively – as the alternative for Santiago’s voters. On the other hand, Binay would be the next choice of majority of Poe’s voters if the latter could not

pursue her candidacy. During the survey period, doubts lingered on whether Poe could pursue her candidacy due to citizenship and residency issues. But on Tuesday, a day before Pulse released the survey results, the Supreme Court ruled that Poe was qualified to run. In the vice presidential race, senators Bongbong Marcos (independent) and Chiz Escudero (independent) were also in a dead heat, each with 26 percent of the votes. In third place was Camarines Sur Rep. Leni Robredo (LP) with 18 percent, followed by senators Alan Peter Cayetano (independent), 13 percent; Gringo Honasan, 6 percent; and Antonio Trillanes IV, 5

percent. Like his runningmate Poe, Escudero also emerged the second option for majority of those voting for Marcos, Robredo, Cayetano, Honasan, or Trillanes should their first choice drop out of the race. In the senatorial preference survey, fourteen candidates – mostly incumbent or former senators – have a statistical chance of winning if elections were held today. They are Vicente Sotto, Francis Pangilinan, Franklin Drilon, Panfilo Lacson, Ralph Recto, Migs Zubiri, Sergio Osmena III, Leila De Lima, Dick Gordon, Manny Pacquiao, Risa Hontiveros, Joel Villanueva, TG Guingona, and Sherwin Gatchalian.(MNS)

Roxas says SC ruling on Poe won’t affect his presidential bid BATANGAS CITY, Mar 9 (Mabuhay) – Administration standard bearer Manuel “Mar” Roxas II sees no need to make changes in his presidential campaign after survey frontrunner Sen. Grace Poe hurdled his legal obstacle in the Supreme Court. Poe tells youth to watch documentaries on Martial Law CANDELARIA, Quezon, Mar 9 (Mabuhay) – Senator Grace Poe urged the youth Wednesday to search for and watch documentaries on Martial Law so they could make their own judgment about what transpired during that period. During an open forum with students of Enverga University here, Poe was asked about her plans to enlighten the youth about Martial Law. MANILA, Mar 8 (Mabuhay) – Administration standard bearer Manuel “Mar” Roxas II on Tuesday defended his wife, broadcaster Korina Sanchez, who has been accused of using the Department of Agriculture (DA) in alleged vote-buying. In an interview in Davao del Norte, Roxas said Sanchez’s attendance to events of the DA is a “non issue” because she is invited as a guest speaker only. “Hindi po, wala po siya during the distributions. Drinking seven glasses of water can cut 200 calories off daily intake An American study has found that drinking just 1% more water can reduce total daily calorie consumption, in particular the intake of sugar, sodium and cholesterol. In fact, drinking seven glasses of water per day could cut total daily intakes by up to 200 calories. Current guidelines recommend drinking 1 to 1.5 liters of water per day. There’s nothing new or revolutionary about that advice, especially for dieters or detoxers looking to flush out the body’s toxins. However, new research, published in the Journal of Human Nutrition and Dietetics, has found that a few extra glasses of water can increase the feeling of “fullness� and reduce daily calorie consumption. The researchers studied the dietary habits of more than 18,300 people between 2005 and 2012. Among other things, the scientists

looked at the amount of plain water each person drank, as well as other liquids like unsweetened tea and coffee, which contribute to overall water consumption. On average, the participants consumed 4.2 glasses of plain water per day, accounting for 30% of their daily dietary water intake. Their average calorie intake was 2,157, of which 125 calories came from sugar-sweetened drinks and 432 calories came from calorie-rich but nutrient-poor foods like desserts, pastries and snacks. The study found that the majority of people who increased their intake of plain water by 1% -- between one and three glasses per day -- reduced their total daily calorie intake by 68 to 205 calories, as well as their consumption of saturated fat, sugar and salt. The study showed a reduction in sodium intake of 78 to 235g and a reduction in sugar intake of 5 to 18g.

Two cans of energy drink a day can have negative effects on the heart, study finds New research, presented at a meeting of the American Heart Association, has highlighted the negative effects of energy drinks on the heart. The beverages, containing sugar, caffeine and taurine, were found to trigger abnormal heart rhythms. A clinical trial, led by researchers at the University of the Pacific and David Grant Medical Center in the USA, has found that energy drinks can increase the risk of abnormal heart rhythms when consumed in quantities from two cans a day. The researchers studied a group of young adults, aged between 18 and 40, among whom the drinks are particularly popular. Of the 27 volunteers, some were given two cans of energy drink while others were given the equivalent amount of a placebo drink once a day, every six days, for three weeks. Neither the participants nor the researchers knew who was given which drink until the end of the three-week trial. Researchers measured the participants’ heart rhythm and blood pressure before consuming the

drinks, then four times during the six hours immediately afterwards. The results showed an increase in a marker of abnormal heart rhythm risk, known as the QTc interval, in those given the energy drink. Visible on an electrocardiogram, this corresponds to the duration of a heartbeat and the time required for the heart’s electrical system to recharge in preparation for the next heartbeat. A slight increase in blood pressure was also observed compared to volunteers given the placebo. These effects persisted for two hours after the energy drinks were consumed. The researchers recommend approaching such drinks with caution. At least 34 deaths potentially associated with energy drinks have been reported up to 2014 in the USA alone. The news comes as Middlebury College, also in the USA, has decided to ban the sale and consumption of energy drinks on campus after concerns that they could lead students to take part in “high-risk sexual activity.�

Diverse electric jazz performed by “Charged Particles� for free at the Library A good friend and former President of Digital Broadcast, Doug Kisaka introduced me to the world of Jazz sometime back around 15 years ago, followed by visits to a then popular jazz pub in North Hollywood called “Charlie O’s,� where some of us became weekly regulars, particularly on Fridays when Pinoy jazz keyboard player, Tateng Katindig performed along with his band and its famous drummer, Earle Palmer. A group of us used to follow either Earle Palmer at jazz bistros in the Valley or Tateng when he and his band used to play at Herb Alpert’s posh “Vibrato� restaurant in Beverly Hills.This author even recalled meeting the then famous singer Lou Rawls at Charlie O’s before he passed away and those were certainly highlighted by unforgettable memories. Through the years, this author would even invite friends to the Playboy Jazz Festival at the Hollywood Bowl, or other City-sponsored Jazz Festivals such as the Brea Jazz Festival where this author’s sister Marjorie and her husband David has brought me a couple of times. Thus, jazz performance of “Charged Particles� at the Alhambra Library recently, it sparked my interest to go and listen to this particular genre of music I still love.. And certainly, I didn’t go wrong on my hunch, because this band’s diverse and electrifying sound created an exciting fusion of creative and “complex orchestration� along with traditional but “distinctly acoustic sensibility.� The band “Charged Particles� was co-founded in Ohio by Jon Krosnick, Charles Hutslar (pianist) and Mike Rak (bass player) and in 1991, Jon named the band after one of Chick Corea’s CD songs called “Charged Particles� adding that it was Chick Correa who was a “big inspiration for them, and the name captured the energy they wanted their band to have.� Drummer Jon Krosnick has been playing drums since he was 9 years old, where he spent his summers taking musical lessons at the National Music Camp in Interlochen, Michigan. It was there where he pursued studying classical percussion and jazz drumming, giving him avenues in performing with orchestras, concert bands, percussion ensembles, jazz bands and back-up bands for

musical theatre performances.. Also, while in high school, he studied classical percussion with many noted instructors, including Niel DePonte (Oregon Symphony), Scott Stevens and Fred Hinger (both from Metropolitan Symphony). And while in college at Harvard, Jon played with the Harvard Orchestra and the Bach Society Orchestra, where he was also the principal percussionist of the M.I.T. Symphony Orchestra. Simultaneously, while with the Harvard Orchestra, he traveled with them to Germany performing at the Herbert von Karajan Orchestra Competition along with the M.I.T Symphony and he then toured wth them during their performances in the east coast. Further on, in his graduate school years in Ann Arbor, Michigan, he played with the University of Michigan Jazz Ensemble. Though Jon Krosnick left Ohio in 2003 and moved to the Bay Area, he used to shuttle back to Ohio to perform with his iressitible group of friends there. He then met Aarom Germain and Murray Low in San Francisco in 2010 and after a year, their band, “Charged Particles� was reborn in 2011. Jon’s primary influences were drum legends such as: Peter Erskine, Dave Weckl and Steve Gadd. Recently, he has served as artistic advisor to the Portola Vineyards Summer Jazz Concert and the Domenico WInery Jazz Concert Series as well as the “Connect the Dots Conference at Stanford University. On the other hand, Aaron Germain, who played upright bass during the Alhambra Library performance, grew up in Massachusetts, and he spent 15 years as a bass player, traveling the world, where he honed in his craft, learning both upright and electric bass. He specializes in playing styles ranging from jazz to blues, funk, reggae, Senegalese mbalax and more while traveling all around the northeast. He moved

to the Bay area in 2000, where he expanded his repertoire to include salsa, Afro-Cuban music, Brazilian forro music Caribbean steel pan music, Indian kathak dance, as well as dense odd-meter jazz. Woman hid child in bag on Paris flight: Air France Paris, France | AFP | Wednesday 3/9/2016 – A woman who flew into Paris from Istanbul this week was found to have hidden a four-year-old girl in a bag on the plane, Air France said Wednesday. The airline said the child, travelling without a ticket, was discovered on board the flight on Monday night “hidden inside a bag�. A source at Charles de Gaulle Airport said the woman was a resident of France who was in the process of adopting the child who was from Haiti. “She was apparently in the transit zone in Istanbul, and had crossed the customs checkpoint with the child,

when she was prevented from boarding a flight with her,� said the source. The woman then “decided to hide the child in a bag to get aboard another flight, after buying a new ticket. “Once on board, she placed the child at her feet, under a blanket, but the girl needed to go to the toilet and was noticed by other passengers,� the source added. Air France said it notified French authorities and the woman was taken into custody upon landing, but prosecutors decided not to press charges. She and the girl were however being held at the airport while authorities investigate the case.

Ken Go: After reviewing the buyer’s estimate from their lender I was able to offer a payment that is about $68 lower every month, no PMI and absolutely no loan/origination fees worth $3,020. The first time buyer was introduced a loan officer by their agent. The quote was legitimate but due to our lower margin and lower compensation package, we are able to get a better rate for client. SC needs to clarify rules on citizenship Shocked and disappointed MANILA, Mar 9 (Mabuhay) – Supreme Court (SC) justices ought to clarify Philippine laws on citizenship, President Benigno Aquino III said Wednesday, following the 9-6 vote of the tribunal allowing presidential candidate Senator Grace Poe to run in the May presidential race. Aquino said he also wanted an explanation of how Poe reacquired her Filipino citizenship since he didn’t know that she had to go to a US consular office to renounce her US citizenship when she was already the chairperson of the Movie and Television Review and Classification Board in 2011. “Sana iyong ating Korte Suprema dito sa kanilang desisyon ay magbibigay talaga ng... iyong todong kalinawan o paglilinaw sa sambayanan na in their role as educator as far as the law is concerned, para maging klarong-klaro sa lahat ng ating mamamayan kung ano ba talaga ang mga alituntunin sa pagiging citizen or non-citizen ng ating bansa,” Aquino told reporters. The SC on Tuesday ruled to reverse the decisions of the Commission on Elections (Comelec) canceling Senator Poe’s certificate of candidacy for president. The Comelec in December disqualified Poe due to material misrepresentation as regards her citizenship and residency. “For instance, ‘yung tinanggap na niya ‘yung MTRCB position, first time ko narinig na pumunta pa siya doon sa isang consular official ng Amerika in 2011 para i-renounce ‘yung citizenship kung saang panahon na MTRCB chair na siya,” Aquino said. “At palagay ko naitanong ko rin bakit kailangan pang gawin dahil ang assumption ko nga ay matagal-tagal nang na-reacquire supposed to be ‘yung citizenship. So gusto kong makitang sana may tugon doon sa mga tanong tulad n’on doon sa desisyon na hinihintay nating ilabas ng Korte Suprema,” he added. Aquino meanwhile cited the independence of SC justices after four of his appointees voted in favor of Poe. “Siguro palagay ko ‘di ba ‘yung itinalaga natin sila para maging independent, e,” Aquino said. The President is campaigning for the presidential candidacy of Liberal Party (LP) standard bearer Manuel “Mar” Roxas II. Aquino and Roxas wooed Poe to be the administration coalition’s vice presidential candidate but the first year senator opted to run for president as an independent. Poe has since figured strongly in the presidential preference surveys, taking the top spot from opposition presidential candidate Vice President Jejomar Binay. Aquino, however, seemed unfazed about Poe’s lead in the presidential surveys when asked about Pulse Asia latest survey results that showed Poe at first place with 26 percent and Roxas at fourth with 19 percent. The survey was conducted nationwide from February 16 to 27 among 1,200 respondents. “Paano maaapektuhan? Siyempre magkakaroon ng boost sa kanyang kandidatura. Gaano katagal ‘yung boost? I was shocked and disappointed about the recent Supreme Court’s ruling junking the Commission on Elections’ (Comelec) decision to disqualify neophyte Senator Grace “Poequino” Llamanzares to run in the May election. I was hoping that these “respectable” and “incorruptible” justices of the Supreme Court will rise above partisan politics and give a verdict based on the rule of law and in the Philippine Constitution. Chief Justice Lourdes Sereno and eight other justices who voted in favor of Senator “Poequino” Llamanzares, clearly based their decision not on the Constitution, but on what their benefactors want. Many political pundits and prominent lawyers are saying that the “Sereno kangaroo court” ruling clearly violated the Constitution and destroyed the rule of law. There have been rumors that President Benigno Aquino influenced the outcome of the Supreme Court decision by calling up the justices he appointed to support the presidential bid of Senator “Poequino” Llamanzares. The name of a prominent billionaire businessman engaged in food and beverage business also came up as one of the major players who influenced the high court in coming with a favorable ruling for Llamanzares. The same businessman is also the one bankrolling the candidacy of “Poequino” Llamanzares. As a matter of fact, Llamanzares’ huband, an American citizen, is a consultant in the country’s biggest beverage company. In the Philippines , if you have the money and influence, nothing is impossible. *** Last year, Senator Antonio Trillanes made a startling revelation about pervasive corruption in the Philippine Judicial system. In his exposé, Trillanes claimed that some cases in Philippine courts are decided not on merits but on how much a person engaged in lawsuit is willing to pay a justice or a judge to get a favorable ruling. Although Trillanes never mentioned any names, he urged the Supreme Court to initiate an investigation. Supreme Court Chief Justice Sereno however refused to entertain such allegations. If Trillanes’ allegations are true, it is despicable and revolting. A corrupt judicial system not only violate the basic right to equality before the law, but also deny the procedural rights of individuals guaranteed by the Constitution. These corrupt justices and judges should be booted out

from office to ensure Filipinos can live in a place where there is equal opportunity for everyone to live a life with dignity. I hope that Sereno and her eight justices were motivated to render a favorable ruling for Llamanzares because of their belief that she could be a good president someday and not because of what people tend to believe that millions of pesos were forked over to influence their decision. *** Now that the Supreme Court has given the “green light” for Llamanzares to run in the May elections, she can now buy her way to the presidency with the help of the prominent billionaire businessman. Although Llamanzares and her financial backers and supporters were apparently successful in corrupting the Supreme Court, she is of course not yet assured of an easy path to Malacañang in May. She still has to win the elections. Meanwhile, Senator Llamanzares also still has to respond to issues regarding allegations about her of being a notorious liar and thief. She also has to ward off public indignation on how she and her backers corrupted the Supreme Court. Voters should now closely examine or scrutinize the candidates’ credentials as well as their platforms they are presenting to the people. They should also try to find out who are the financial backers of every presidential candidates and what they intend to gain should their candidate win. Latest polls showed that she and Vice President Jojo Binay are still statistical tied with less than three months to go before Filipinos troop to polling places to choose their next president. Davao city Mayor Rodrigo Duterte is in third place while Mar Roxas, President Aquino’s anointed candidate, lags in dismal fourth. Senator Mirriam Santiago is in last place.

surveys, Poe and Escudero are running as independents under the “Gobyernong may Puso” platforms on rapid inclusive growth, poverty alleviation, transparency and global competitiveness. Poe and Escudero, along with their senatorial bets, were in Quezon province to woo voters and solidify support among local officials and candidates of the Nationalist People’s Coalition (NPC), which recently endorsed their tandem. They visited the cities of Lucena, Tanauan and Tayabas, as well as the towns of Lopez, Catanauan, Candelaria and Lucban. They also held meetings with officials and candidates from other towns. Quezon has a total of 1,124,090 registered voters for the upcoming general elections, based on the Commission on Elections’ data. Velez disclosed that she will tender her irrevocable resignation effective immediately after she was humiliated by an unnamed actress. The seasoned actress revealed that she was pertaining to Reyes and not Isabelle Daza, the other star in the series. “Yes, no one else (Reyes)... Isabelle Daza is such a sweet lady. She was crying for me so hard when the incident happened. She can’t imagine if this was done to her mom,” she said. Velez explained that the last straw was when they shared a designated standby room and Reyes allegedly asked her to leave because she wants the area all for herself. “She bangs the doors, shouted at me. Senior seeks Chapter 13 protection for fully paid house from $15k credit cards Senior Seeks Chapter 13 Protection For Fully Paid House Client is a young senior in his early 60’s who took an early retirement last year. He owes $15K of credit card debt and nothing else. He has a community property house that is fully paid with a current market value of $500K. Fortunately, for client, he did not refinance his fully paid house with a mortgage, so the house does not secure any mortgage. Certainly, client must have been tempted often to get some cash out from a refinance at low interest. Good for him that he did not succumb to that temptation; otherwise, he would still be paying on a new mortgage now. His wife is also taking early retirement next year. I asked why he took an early retirement at 62. He said he doesn’t know how long he is going to live, so he might as well take early retirement so at least he gets his social security now even if its less by 25% compared to full age retirement at 66. Since he used to work as a professional for some time, I asked him if he had a pension from the employer. He said no and social security of $1,200 is all that he has now. The problem is that he still owes $15K of credit card debt, which he has not been able to pay for 6 months because of his reduced income from social security. He used to pay about $600 a month to keep them current but he just could not get the principal down from $15K. He wanted to do a Chapter 7 to wipe out the $15K. I asked him if he owned a house and what the current value was. He said he owned a house worth

about $500K. I asked him if he owed anything on the house. He said he owed nothing on it anymore. So I told him that he could not do a Chapter 7 because in Chapter 7, he would lose his house. The trustee would take his house and sell it, give him $175K use the rest to pay his credit card debt of $15K, give him the rest of the sale proceeds after deducting trustee fees which could be skyhigh. It doesn’t make sense, in his case to do Chapter 7. Why lose your house for $15K of credit card debt. But then again, his house does need protection from his credit card debt. He is now behind by 6 months. This means that lawsuits for collection are forthcoming. Lawsuits will eventually become judgments. Judgments eventually become liens on his house. A $15K judgment will double in a couple of years. Soon enough, there will be a $60K judgment lien on his house. And, the worst part is that judgment creditors can ask the court to have his house sold to satisfy the judgment lien! This means he can lose his $500K house for $15K of credit card debt. It’s sounds unfair, but it certainly may happen if the problem is left to fester without an effective solution. I told him that he could do a Chapter 13 without any risk of losing his house to the trustee because Chapter 13 trustees, unlike Chapter 7 trustees, do not have

the power to sell debtor houses. In a Chapter 13, he can pay off the $15K over 5 years without interest; just the principal is being paid. He’s looking at a plan payment of $250/ mo. To $300/mo. including court and trustee administrative fees. This is a lot less than the $600 that he used to pay which did nothing to reduce the principal of $15K in the last 20 years. Under the plan, debtor will have zero credit card debt when he turns 68. And the best part is, the Chapter 13 protects his fully paid house by preventing lawsuits and judgment liens from attaching to his house. Credit card debts are like weeds that keep on growing and growing. In a month, a weed can grow a foot, while normal plants take so much time to grow. The most effective way of getting rid of weeds is to uproot them. If you just cut them at the base, in a month they look like they were never cut. This is the same, as client’s credit card debt of $15K, which he has paid for 20 years, yet now still owes the same amount. In a year, he paid $7,200. He thought that would cut his debt in half and it would disappear. But credit cards are like weeds; they keep growing back, unless you uproot them. Debtor’s Chapter 13 will uproot his credit card debt and pay them off completely in 60 months so they don’t grow back again. Smart decision on client’s part, I have to say, because some people just do not have the courage to make the right decision. Client Seeks Chapter 7 Relief To Discharge $30k Credit Cards Client is 48, married, no children. He owns a home with $55K of equity. He bought his house 3 years ago with 3% down, so his equity has increased somewhat but still within homestead exemption of $75K. He has a live in girlfriend, and I don’t know if she qualifies as a family member that would increase his

exemption to $100K. In any event, $55K is $20K less than $75K so the house is secure and protected. His problem is $30K of credit cards, which he has been paying for 5 years, at $1K minimum monthly just to keep them current. Do the math. He’s paid $60K to keep $30K of cards current for 5 years, and he still owes the same amount of $30K. Doesn’t seem fair. But that’s the way cards work. Just like weeds, they keep growing, nonstop. But since he now has a mortgage to pay, he having a hard time making the minimum payment of $1K a month for the cards. The choice he has now is to either pay the mortgage or pay the cards. It’s a no brainer. Get rid of the cards, to assure payment of the mortgage. At least, the house appreciates in value over time and home ownership is the American dream, while credit card debt is the American nightmare that sucks up your net income every month, every year. His choice is Chapter 7 to protect his house and discharge the $30K of credit cards. “ABIDE IN ME, AND I IN YOU. South Korea’s defense ministry said the two missiles were fired around 5:20 am (2020 GMT Wednesday) and flew some 500 kilometers (300 miles), before landing in the East Sea (Sea of Japan) off the North Korean port city of Wonsan, a ministry spokesman said. Short-range missile launches are a regular and relatively low-level item on North Korea’s long list of provocative gestures, and one it often employs to register annoyance. The North fired six high-caliber rockets into the sea a week ago in protest at the adoption of tough, new sanctions on Pyongyang by the UN Security Council. Those sanctions were imposed as a direct result of the North’s fourth nuclear test in January and last month’s space rocket launch, which was seen as a disguised ballistic missile test. Tensions have risen further this week with the launch of large-scale South Korean-US military exercises that Pyongyang responded to with threats of a pre-emptive nuclear attack.

And state media on Wednesday published photos of leader Kim JongUn posing with what was claimed to be a miniaturized nuclear warhead. Kim praised the country’s nuclear scientists for mastering the miniaturization technique, which would allow warheads to be fitted onto ballistic missiles and create a “true� nuclear deterrent. The United States responded by urging the North and its leadership to curb their “provocative rhetoric� and behavior. “I’d say that the young man needs to pay more attention to the North Korean people and taking care of them, than in pursuing these sorts of reckless capabilities,� US State Department spokesman John Kirby said of Kim Jong-Un. South Korea’s defence ministry was sceptical, saying its own assessment was that North Korea had “not yet secured miniaturized nuclear warheads�. NY forum turns spotlight on sustainability of PHL reforms NEW YORK CITY – “The Philippines will need to nurture the virtuous cycle of business confidence that good governance and good economics have engendered.” This was the main message of Finance Secretary Cesar V. Purisima in his Keynote Address at the Philippine Business and Investment Forum (PBIF) held on 03 March 2016 at the Metropolitan Ballroom of the Sheraton New York Times Square Hotel. The PBIF is taking place in the context of possible Philippine growth rates of 7-10% in the next decade and an HSBC Global Research Report predicting the country to be the 16th largest economy in the world by 2050. “This Forum is a great opportunity for us to take stock of the incredible performance of the Philippine economy over the past number of years and to bring attention to the successful reforms that have driven the country’s economic transformation since 2010 when President Aquino assumed the presidency,” earlier explained Philippine Ambassador to the United States Jose L. Cuisia, Jr. who initiated the PBIF. In his keynote address, Secretary Purisima outlined the important policy and strategic issues that the Philippine Government needs to address in order to maintain the sustainability of recent economic growth. He underscored the importance of good governance, particularly in the areas of transparency, freedom of information, rule of law, security, and accountability.

He added that good governance is intertwined with good economics and contributes to the virtuous cycle of confidence that encourages optimism in the Philippines, both domestically and internationally. On the issue of sustaining Philippine economic growth, Secretary Purisima emphasized certain areas of connectivity: infrastructure, policy, digital connectivity, and process. Secretary Purisima further touched upon the opportunities as well as challenges that the Philippines currently present such as ASEAN integration, climate change, investing and scaling up in many industries, such as IT/BPM, MSMEs, agriculture, and tourism, as well as diversifying geographically such as in Mindanao and the Philippines’ investment promotion areas. Mr. Jose E.B. Antonio, CEO of Century Properties Group, speaking at the Lead Panel of the PBIF, told the audience that “good economic management has set the stage for future growth.” In the same panel, Chairman Arsenio Balisacan of the Philippine Competition Commission and former Secretary for Socio-Economic Planning, referenced the three key constraints to growth, namely, weak institutions, poor infrastructure, and peace and order. Chairman Balisacan said that “the Aquino Administration has tackled each of these basic constraints leading to the greater confidence of business and investors.” Dr. Nouriel Roubini of Roubini

Global Economics also noted that the success of the Philippine economic story can likewise be attributed to its openness to global and regional integration. In a Keynote Address, former Trade and Industry Secretary Gregory L. Domingo echoed the points of Secretary Purisima and those in the lead panel. However, he added the importance of a large, young population of 100 million with a median age of twenty-three (23) years old. He stressed that this is an important demographic advantage that can be leveraged with proper investments in education and infrastructure. In addition to the positive comments on the prudent economic management of the Aquino Administration, the PBIF panels discussed the way forward, especially in view of the presidential elections in May 2016. “I was struck by the consensus among the speakers that the reforms and economic performance of the Philippines will be sustainable post2016,” noted Ambassador Cuisia. Dr. Roubini expressed the belief that, regardless of the results of the May elections, there will be policy continuity in the Philippines. “The good news is this: Philippine economic dynamism, domestic demand, and its openness to the world can only mean that reforms will continue and deepen,” he said. Mr. Antonio, on the other hand, reassured the audience that “it will be highly imprudent for any gov-

ernment, after President Aquino, to change the good things that have been undertaken in the last six years.” The message of sustainability of economic growth was reinforced by the panel on the Philippine Competitive Edge composed of Perry Pe, President of the Management Association of the Philippines; Alex Cabrera, Chairman of PriceWaterhouseCoopers Philippines; John Hixson, Vice President for Corporate Affairs of Cargill; and Andres Edlefsen of the US Department of Commerce. Atty. Pe lauded the legislative agenda of the Aquino Administration, which resulted in the enactment of important pieces of legislation that institutionalize economic reforms and good governance. He particularly cited the passage of the Philippine Competition Act and the Amendments to the Cabotage Law. Mr. Cabrera addressed the foreign equity limitations under the Philippine Constitution and argued that such limitations are actually very narrow and could easily be “ring fenced” by proper structuring of investments. He said that he is of the view that the ASEAN Economic Community will result in more pressure on the Philippine Government to liberalize and become more competitive. In response to a question during the open forum after the panel presentations, Atty. Pe and Mr. Cabrera stated their firm belief that the foreign equity issue should not be a serious hindrance to investments.

Gonong elected FACLA president, vows to bring back group’s prestige LOS ANGELES – Businessman-designer Fernandico Q. Gonong Jr. was elected last Monday the new president of the Filipino American Community of Los Angeles (FACLA) after a deadlock left the oldest Filipino organization in the United States without a leader for almost three months. Gonong replaces former president Austin G. Baul, whose term expired on Dec. 31, 2015 under the organization’s constitution and by-laws. Gonong will serve for four years. Other officers elected were Apolonio Julian, first vice president; Veronico Agatep, second vice president; Gloria Resurreccion, third vice president; Rosalinda Nery, treasurer; Aleli Neal, auditor; and Orlando Cagampan, secretary. The 14 members of the board of directors, who were elected in a general election in December, finally broke a deadlock wherein seven directors voted for Gonong and seven for Baul in several sessions held to elect the officers from among the directors. Three directors from Baul’s camp -- Baul, Danilo Adlawan and Leticia Reyes -- were absent from the Monday meeting but the four others -Manocito Santos, Susan de Guzman, Susan Pineda and Teddy Mangune -- plus all seven from Gonong’s party were present for a total of 11 present, which was enough to constitute a quorum and elect the officers. The new officers and directors will be sworn in on April 10 at the Hilton in Glendale. “Now that we have elected the officers, we can finally move forward

and start our work according to the visions and missions set forth by the organization’s founders,” Gonong said. “I call on all the officers and members to set aside personal differences and unite to achieve our goals in serving the Filipino community.” Gonong said he hopes to unite the present members, welcome new members to the organization and bring back the glory and prestige of the organization. To expand FACLA’s membership roster, Gonong said he would push for the amendment of its constitution and by-laws to allow free membership to every Filipino in the Greater Los Angeles area. Voting members, however, will be asked to pay a minimal $5 membership fee. At present, an annual fee of $20 is charged new members, and $10 for old members. FACLA was established on April 26, 1945 shortly before the end of the Second World War as a halfway house for Filipino farm workers who settled in Los Angeles to work as seasonal workers in different states from as far north as Alaska and as far west as Missouri and Illinois. It is believed to be the oldest non-profit organization in the US. The present FACLA building was built in 1965 on the same site where the two halfway houses were built on Temple Street in what is now known as Historic Filipinotown. FACLA has been hounded by political intrigues and infighting for years, which alienated many Filipinos who have since distanced themselves from the organization. “With FACLA celebrating its 71st anniversary this month, the new
