MANILA, May 19 (PNA) – Ten days after the May 9 national and local elections, the Commission on Elections (Comelec), sitting as National Board of Canvassers (NBoC), officially proclaimed the 12 winning senatorial candidates Thursday. In a formal ceremony at the 2016 Elections Headquarters at the Forum of the Philippine International Convention Center (PICC) in Pasay City, NBoC chairman Juan Andres Bautista, together with the other members of the NBoC, led the proclamation of newly elected Senators. Incoming DFA chief underscores national interest on PHL’s foreign relations policy \DAVAO CITY, May 19 (PNA) – The incoming Secretary of the Department of Foreign Affairs (DFA) has emphasized national interest and continuity as important aspects of the foreign policy under his term. Perfecto Yasay, who accepted the offer of presumptive President-elect Rodrigo Duterte to be DFA secretary, said he would separately meet with former DFA Secretary Alberto del Rosario and current secretary Rene Almendras in order to have a picture of the current situation and positions undertaken by the government on certain foreign policy issues. Yasay pointed out that the Philippine Constitution is the bible of “our foreign policy. We are an independent, free country and we have renounce war as an instrument of national policy and we carry out formulation in the paramount of national interest always.” He added that the government cannot deviate from the Constitution and the formula on foreign policy. “We would like to pursue… and if there are agreements that we have made and commitment that we have made with any other country we should strengthen that so that the objectives of the agreements will be achieved. By all means let’s do it,” he said. Banks and credit card companies have told us how important it is to maintain our credit, honor our obligations, pay on time, but what if we suddenly canâ&#x20AC;&#x2122;t pay on time, then what? What if I lose my job, and canâ&#x20AC;&#x2122;t pay anyone right now, where does that put me? The answers may surprise you: Q: My wife recently lost her job. My income goes to food and rent. We havenâ&#x20AC;&#x2122;t paid our credit cards for several months, and one account is with a collection agency. What can we do? A: That depends on how long you think it will take for your wife to find a job, how much you owe, and whether your creditors will actually sue, and garnish your wages. Generally speaking, if payments to your credit card debts are more than 30% of your take home pay, youâ&#x20AC;&#x2122;re in trouble. There are several things you can do. (1) Do nothing â&#x20AC;&#x201C; thats easy, but in the long run, does little to solve the issue that just gets bigger, in the sense that your credit report and fico score continues to escalate downwards. (2) Call creditors, tell them your wife has lost her job, try to get them to forgive part of the debt. (3) Since your wife is unemployed, you could also consider filing bankruptcy. With only one wage coming in, you undoubtedly qualify, and the threat of a possible bankruptcy gives you and your attorney a lot of leaverage in negotiating with creditors. Also bear in mind, that when your wife finds a job, and contributes to household income, you become more vunerable to judgement lawsuits. Q: Will filing for bankruptcy ruin my credit forever? A: No, in fact it will actually start to improve it. If you cannot make ends meet, your debt to income ratio is too high. At that point your prospects of getting more credit is zero. A bankruptcy cures the debt to income problem, discharging debt and leaving income. This gives you access to a number of credit card providers and other lenders who literally target people with bankruptcy discharges. See next question! Q: Will anyone issue me with a credit card, when I have a bankruptcy on my report? A: Yes, there are many banks and other lenders who specialize in doing business with bankruptcy debtors. You can qualify for loans secured by collateral, such as auto loans, home loans, even credit cards, secured by a savings account. Their main motivation is targetting a niche martket for higher interest rates. They want to charge you a little extra, and there is no real risk involved. After bankruptcy, you cannot file again for eight years. You have no other debts, which gives an excellent debt to income ratio. Bottom line â&#x20AC;&#x201C; you can afford to service a new loan. Q: How long does it take to get unsecured credit at the same cost as before my bankruptcy? A: Anywhere between 60 days and two years, depending on what you are looking for. Several department stores will give you a store account, if you have a major credit card. You can easily start out with a secured visa card, then open a store account. Within a short period of time, your fico score starts to climb. Mortgage companys are looking for two years of some credit history from the date of a bankruptcy discharge. Q: How long does it take to get a bankruptcy off my credit report? A: The law permits credit reporting agencies to report your bankruptcy for up to 10 years. This does not mean that is has to stay on for ten years though. By using special credit repair strategies, you is sometimes possible to get the credit reporting agencies to delete all reference to your prior bankruptcy, before the 10 years are up! Q: We were just sued by our neighbors who are claiming $60,000 in compensatory damages. We just want to move away. Our house is up for sale, but I was wondering, if we donâ&#x20AC;&#x2122;t sell it on time, before the judgment, can I quitclaim the house to my mother. Will this protect our equity? (about $50,000.00). A: No. You cannot give away your assets as a way of protecting them from a lawsuit. The court will rescind any such transfer, and you may end up in far worse trouble â&#x20AC;&#x201C; accused of a fraudulent conveyance. Your best course of action is not to sell the house at all, at least not yet. The house is the best â&#x20AC;&#x153;bankâ&#x20AC;? you have, because you can protect your equity as a homestead exemption. If you sell the house and get the money, it may be seized or attached by the plaintiffs. By keeping the house, you could file a bankruptcy on the judgment, and then sell the house. House sale proceeds that come in after the bankruptcy are all yours. BANKRUPTCY OPTIONS Admittedly, most people filing bankrupt-
cy, file under Chapter 7, (The real bankruptcy) that discharges all unsecured debt. However, there are people with problems that are best resolved through Chapter 13. This chapter is used primarily by those who either have problems making payments on secured debt, and want to keep the collateral (House, Auto, other) , or perhaps, have plenty of assets that are very difficult to liquidate. Chapter 13 is also used by individuals who simply earn too much money to qualify for a chapter 7, (based on the cost of living index and other criteria, but not enough money to service their bill). This type of bankruptcy can provide creditors with a partial payment plan over 60 months. Depending on the debtors disposable income after approved living expenses, the plan could provide a 5% or more, for the duration of the plan. The balance of the debt is then discharged, just like in a regular bankruptcy. Most of the chapter 13â&#x20AC;&#x2122;s filed in my office, are clients who are late on their mortgage, and want to avoid losing their home through foreclosure. Since the mortgage is a secured debt, they only two choices, pay the debt or give up the house, but there is help. Chapter 13, enables you to amortize the mortgage arrearages in a 60 month plan, and in most cases, discharge unsecured debt at the same time. By discharging unsecured debt, your ability to service the mortgage is improved, and hopefully, you can stay in your home. Q: Can I make lower house payments if I file a Chapter 13 repayment plan? A: If you have a second mortgage, we might be able to strip that off the property, which would lower your monthly payments. As far as the first mortgage is concerned, you may also be eligible for one of several loan modification plans that we work with. If you are not eligible for a loan modification, you must make the regular scheduled payments. However, as mentioned above, the delinquent portion can be spread out over the chapter 13 plan that gives you 60 months at a nominal interest rate. Q: What does Chapter 13 do to my credit card debts? A: That depends on your income level. For most people, their unsecured debt, like credit card debt is wiped out. This in turn helps to pay the mortgage arrears. Q: Can a Chapter 13 stop lenders repossessing my automobile? A: Yes, it will stop the repossession, and your monthly payments can be lowered, based on the depreciated value of the automobile. Q: Can a Chapter 13 help me with debts to the IRS or student loans? A: A Chapter 13 can be very helpful with debts that are not dischargeable in a regular Chapter 7. These types of debts can only be discharged if they are past their respective statute of limitations. A chapter 13 will allow you to pay these debts over a period of time, and limit future interest accruing on the debt. Q: Whatâ&#x20AC;&#x2122;s the main difference between Chapter 13 and Chapter 7? A: Chapter 7 will discharge all unsecured debts, but does not resolve problems associated with arrears on secured debts. (Such as late payments on the mortgage or car). Q: I filed Chapter 7 last year, can I file Chapter 13 now? A: Yes. Although Chapter 7 bars you from re-filing again for eight years, a Chapter 13 can be filed every three years. Q: I own a house together with my brother. We want to file a Chapter 13 to stop a foreclosure, do we both have to file? A: No, only one of you need file, preferable the party that owes the most in unsecured debt, and thereby has the most to gain. Q: I have no equity in my home. I just want to stay here as long as possible. What can be done to stop a trust deed sale and prolong my occupancy? A: There are several good seasoned strategies available. Obama appoints first Asian-American envoy to PHL MANILA, May 19 (Mabuhay) – President Barack Obama has appointed the United States’ first Asian-American ambassador to the Philippines to replace Philip Goldberg, who is due to end his tour of duty this year. Obama named Sung Y. Kim, a seasoned career diplomat who has an extensive experience in Korean affairs as Goldberg’s successor. He was a former top envoy to the Six-Party Talks, which was established in 2003 with the aim of ending North Korea’s nuclear program through negotiations involving the US, China, Japan, North and South Korea, and Russia. Kim’s appointment was announced by the White House on May 18, but his nomination still has to be confirmed by the US Senate. The appointment came at a cru-
cial time as the Philippines undergoes government transition wherein President Benigno Aquino III steps down on June 30 after serving six years in office and outgoing Davao City mayor Rodrigo Duterte assumes to power on the same day. A career member of the Foreign Service, Kim, who currently has the rank of Minister-Counselor, is Special Representative for North Korea Policy and Deputy Assistant Secretary in the Bureau of East Asia and Pacific Affairs at the Department of State - positions he has held since 2014. Kim was born in 1960 in Seoul, South Korea, but grew up in Los Angeles where he attended middle school and high school. He earned his undergraduate degree from the University of Pennsylvania and completed a degree in law from
Loyola University. He also holds a Master of Laws degree from the London School of Economics. Previously, he served as US Ambassador to the Republic of Korea from 2011 to 2014, Special Envoy for the Six Party Talks with the rank of Ambassador from 2008 to 2011, and Director of the Office of Korean Affairs in the Bureau of East Asia and Pacific Affairs from 2006 to 2008. Kim also served as Political-Military Chief at the US Embassy in Seoul from 2002 to 2006. Since joining the Foreign Service in 1988, Kim has also held positions at posts in Hong Kong, Japan, and Malaysia. Before joining the Foreign Service, he was a Deputy District Attorney in the Los Angeles County District Attorney’s Office. (MNS)
$81M ‘dirty money’ belongs to Bangladesh Bank: AMLC MANILA, May 19 (Mabuhay) – The US$81-million dirty money found to have entered the Philippines illegally has been cleared to be owned by the Bangladesh Bank, the Anti-Money Laundering Council (AMLC) said on Thursday. “We believe that the amount belongs to the Central Bank of Bangladesh,” AMLC Executive Director Julia Bacay-Abad told the Senate blue ribbon committee. Bangladesh Bank is the central bank of and regulatory body of Bangladesh’s monetary and financial system. During the hearing, Bacay-Abad was asked to clarify if the ownership of the funds, whether it
belonged to the Bangladesh Bank or the country of Bangladesh. According to Abad, as the funds were stolen from the account of the Central Bank of Bangladesh with the Federal Reserve Bank in New York, the funds are presumed to be owned by the bank. Between February 4 and February 5 this year, hackers breached the computer systems of Bangladesh Bank and transferred US$81 million from its account at the Federal Reserve Bank of New York to casinos in the Philippines. The stolen funds found their way to the Rizal Commercial Banking Corp. branch on Jupiter Street, Makati City before these
were laundered in Philippine casinos. The AMLC has already filed complaints against RCBC branch manager Maia Santos-Deguito and four others over a scheme to launder $81 million. A typographical error had prevented hackers from stealing the US$1 billion they were after. This is considered as one of the largest cyber heists in history. The incident has prompted Bangladesh’s central bank governor Atiur Rahman to resign. The Philippine Senate blue ribbon committee is looking into ways how it could prevent a repeat of the incident. MANILA, May 19 (Mabuhay) – The computer of a Bangladesh Bank official was hacked prior to the $81-million money laundering scheme, the Bangladeshi envoy revealed on Thursday. “One of our bank officials, the computer (personnel) who actually is in the group who makes the payments, who passes the payment instruction, his computer was hacked,” Bangladeshi Ambassador John Gomes told the Senate blue ribbon committee. This comes after $81 million was stolen from the account of the Bangladesh Bank with the Federal Reserve Bank in New York by still unknown hackers. According to Gomes, the hacking was done on a Friday, a day for prayer in Bangladesh. “It was a Friday when this happened. The Bangladesh Bank (was) totally shut down on a Friday because it’s a Muslim day of prayer,” he said. Gomes added that after further investigation by Bangladeshi officials, the hackers have been found to be “not anyone in the Philippines nor anyone in Bangladesh.” “(There are) certain indications (but) until we get final report we cannot say... Definitely we have information that it’s not a Bangladeshi or a Filipino,” he added. (MNS)

Another solon moves against labor contractualization MANILA, May 19 (Mabuhay) – A reelected lawmaker has vowed to refile in the 17th Congress a measure that seeks to address the issue of labor contractualization by providing standards for term or fixed-period employment. Congresswoman-Elect Linabelle Ruth R. Villarica (4th District, Bulacan) said the measure, which she filed as House Bill 2955 in the 16th Congress, will provide specific standards and a clearer definition of fixed-period employment. “The present Labor Code, while silent on term or fixed-period employment, does not declare it per se illegal or against public policy. This silence has resulted in abuse and arbitrage on the part of both employers and employees,” Villarica said. Villarica cited the 2010 Bureau of Labor and Employment Statistics Integrated Survey showing that out of a total employment of 3,042,750 by non-agricultural establishments with 20 or more workers in June 2010, 850,085 were non-regular workers,
including 179,384 probationary workers, 170,817 casual workers, and 445,020 contractual or project-based workers. “Presidential Decree 442, the Labor Code of the Philippines, was enacted to afford protection to labor, promote employment and human resources development, and ensure industrial peace based on social justice,” Villarica said. “The present Labor Code must be amended so as to substantially implement it by providing standards specific to term or fixed-period employment, the requisites for validity of term or fixed-period employment; and the conditions for regularization of term or fixed-period employment,” Villarica said. Under the measure, “term or fixed-period employment” shall refer to any domestic contract of employment, except project or seasonal, for a definite period that terminates by its own terms at the end of the period. MILF top official calls on Duterte MANILA, May 17 (Mabuhay) – A top official of the Moro Islamic Liberation Front (MILF) expressed confidence in the incoming administration of presumptive President Rodrigo Duterte after the latter vowed to address the problems of the Bangsamoro people. MILF vice chairman for political affairs Ghazali Jaafar was scheduled to speak with Duterte at 6 p.m. Monday but their meeting was pushed back to 11 p.m. due to the large number of well-wishers waiting to meet the presumptive president. Although their chat was informal, Jaafar said he is confident that the incoming Duterte administration can solve the decades-old problems f Mindanao. “Malaki ang kumpyansa namin sa administrasyon ni Duterte,” he said. The MILF official also declined to comment on Duterte’s plan to appoint members of the Communist Party of the Philippines in his Cabinet. “Wala po kaming comment sa bagay na iyun. Maaaring iyun ay kanyang panukala, proposal at hindi pa naman
umiiral ang panukalang iyan,” he said. The MILF and the Aquino administration earlier signed a peace deal aimed at creating a new autonomous political entity in Mindanao. However, the passage of the Bangsamoro Basic Law (BBL), a key component of the peace talks, was derailed after 44 police commandos were killed in a clash with the MILF and other groups in Mamasapano, Maguindanao on January 25, 2015. Jaafar joined Duterte’s first batch of visitors at the Matina Enclaves Residences, his temporary headquarters until he assumes office on June 30. Duterte took until the wee hours of Tuesday morning to entertain some 60 well-wishers. Duterte administration will prioritize welfare of OFWs: Yasay MANILA, May 19 (Mabuhay) – The Duterte administration is open to holding bilateral talks with the Chinese government and will prioritize looking after the welfare of Overseas Filipino Workers (OFWs), lawyer Perfecto Yasay Jr. said. Yasay was chosen by incoming President Rodrigo Duterte to head the Department of Foreign Affairs (DFA). When asked on the foreign policy that the Duterte administration will implement, Yasay said the government will follow the provision of the Constitution. “Alam mo ang foreign policy natin Igan, naka-define yan sa Constitution, sa Saligang Batas at hindi tayo pwedeng mag-deviate dyan,” Yasay said. “We are a free, sovereign and independent state. We carry on an independent national policy and renounce war as an instrument of national policy. Yan ang approach, broad parameters na ating Constitution na talagang kailangan natin ipatupad,” he added. Yasay also said the government will ask allies to respect the independence and sovereignty of the country. “Sa akin naman, when we carry out this foreign policy, there is one thing in mind that our government must pursue and that is the paramount national interest. That paramount interest cannot be subordinated or subservient to the interest of other nations,” he explained.
The top priority of the Duterte administration will be the OFWs, according to the former Securities and Exchange Commission chairman. He described the Aquino administration’s response to the OFWs as lukewarm and inadequate. “Ang intensyon ng ating magiging pangulo ay magkakaroon tayo ng immediate, prompt, effective response to these problems,” said Yasay, adding that a study is being made for the creation of a Department of Overseas Filipino Workers. On the issue of the West Philippine Sea, the incoming administration will wait for the outcome of the arbitration case filed by the previous administration. Yasay said they hope the Chinese government will respect the outcome of the case. “If there is an opportunity, itutuloy natin ang multi-lateral talks or bilateral talks. Ayaw naman natin ireresolba ang conflict na ito by means or through war,” he added. However, if China will not respect the court decision and will engage in war, the government will expect the United States to abide by its treaties with the country, including the Enhanced Defense Cooperation Agreement or EDCA. “But the Philippines will not even try to militarize itself to defend itself from China, because we feel that these matters should be resolved to the hilt, through negotiations,” he said.(MNS)
PNP chief to offer resignation once Duterte assumes presidency MANILA, May 18 (Mabuhay) – The chief of the 160,000-strong Philippine National Police will file a courtesy resignation after President Benigno Aquino III turns over the highest post in the land to presumptive president-elect Rodrigo Duterte. “As a matter of courtesy, I will submit my courtesy resignation to the President. That should be not later than July 1,” PNP chief Director General Ricardo Marquez said in an interview. Marquez said the purpose of his resignation is to give Duterte the freehand in selecting and appointing the PNP chief of his choice. Duterte is eyeing three former police chiefs of Davao City to replace Marquez when he assumes presidency on July 1. His choices include Chief Supt. Ronald dela Rosa, now assigned as executive officer of the Directorate for Human Resource and Doctrine Development based in Camp Crame, Chief Supt. Ramon Apolinario, Mimaropa Police officer-in-charge, and Senior Supt. Rene Aspera, the chief of staff of the PNP-Anti-Kidnapping Group. Dela Rosa, a native of Davao City, was a member of the Philippine Military Academy Sinagtala class of 1986. He was recently relieved of his post as brigade commander of the
PNP’s Reactionary Standby Support Force (RSSF) for allegedly showing support to Duterte on Facebook. Police vowed to be non-partisan before the election period. Appointing one of Duterte’s choice candidates would mean bypassing senior officials holding sensitive posts in the PNP, including Deputy Director Generals Danilo Constantino and Francisco Uyami Jr. But Marquez said it had happened in the past administrations that the president bypassed senior officials. “Sometimes seniority is sidelined by merit and fitness. (He) should be the best and the brightest. (He) should command the respect of this organization. The senior generals of this organization accept the fact it will happen and it could continue to happen,” he said. “It still depends on the prerogative of the president. Duterte-backed federal gov’t to absorb BBL: lawmaker MANILA, May 19 (Mabuhay) – The proposed Bangsamoro Basic Law will not be taken for granted in the next administration, Davao del Norte Rep. Pantaleon Alvarez said Thursday, adding the measure will be absored by the federal government that incoming president Rodrigo Duterte is pushing for. “The BBL will be absorbed by federal government kasi parehas yun, yung concept ng BBL pareho sa federal government,” said Alvarez, who is being groomed to lead the House of Representatives in the 17th Congress. He reiterated Duterte’s belief that federalism is the long-term solution for peace in Mindanao, but said they would also implement short-term solutions. However, Alvarez stressed that
implementing the BBL, which embodies the peace agreement signed by the government and the Moro Islamic Liberation Front (MILF) in 2014, would require the amendment of the Constitution. “You can’t do it because there are provisions in BBL that are not in [the] Constitution,” he said without elaborating. “Kami we will be amending the Constitution of the Republic of the Philippines to provide what is inside the agreement of the BBL,” he added. Alvarez also noted that the Autonomous Region of Muslim Mindanao (ARMM), which President Benigno Aquino III described as a “failed experiment,” might have better chances surviving under a federal government.

Robredo fears a repeat of 1986 cheating during vote canvassing MANILA, May 18 (Mabuhay) – Amid the claim of Senator Ferdinand “Bongbong” Marcos Jr. that he will win the vice presidential race, leading VP contender and Camarines Sur Rep. Leni Robredo on Wednesday expressed fears of a repeat of the alleged cheating in the 1986 snap elections. In an interview with reporters in Naga City, Robredo spoke against Marcos’ supposed “mind-conditioning” technique, saying she wonders why the Marcos camp is claiming a lead of more than 100,000 votes based on their internal tally of certificates of canvass (COCs). “Sa akin lang ano, sana wala silang binabalak na pandaraya na gagawin sa canvassing. Kasi yung winoworry ko ngayon, kla-

However, if this multilateral approach proves to be inadequate to resolve the issue, he is willing to explore other options including directly talking with China. Yasay said that in the pendency of the case – if there is possibility of bilateral or multi-lateral talks should not be prevented if the country would achieve peaceful resolution to the controversy. so what we would like to do is make sure their specific special problem must immediately addressed.” Yasay, who will be serving DFA on a short term period, promised to do well and will not bungle his work. “When you are appointed by the President—whether permanent or one year—you serve under his pleasure and if one day he does not like you have to go,” said Yasay, who was the roommate of Duterte during their law school days. “My job is to do my job properly. I won’t bungle it but I know even in an acting capacity. This is a very critical time in our history and I see this significance and I see why he has chosen me in this regard… probably he has seen in me that I can accomplish for our country and people,” Yasay said. He said he knew that the post is reserved for Senator Alan Peter Cayetano, who was the running mate of Duterte in the last elections. Thatâ&#x20AC;&#x2122;s exactly what happened with the 65th Legislative Districtâ&#x20AC;&#x2122;s celebration of Asian American Heritage Month that drew over 200 people at the Buena Park Community Center on the weekend of April 14. As with the first successful event, this yearâ&#x20AC;&#x2122;s gathering was hosted by Assemblywoman Young Kim, who is seeking a second term, to â&#x20AC;&#x153;celebrate the rich diversity of California and recognize the role the Asia Pacific Islander community has played in the 65th District. The occasion also provided the culture rich community a venue to present the richness of the districtâ&#x20AC;&#x2122;s cultural tapestry during the performances that displayed the depth and richness of the Asian communities that comprise the covered cities in the district. Among those featured were cultural performances by the Korean American Youth Performing Artists, Viet Cam Dance, North Orange County Chinese Culture Association and Deliverus Ensemble. Hanshik Globalization Foundation had its hands full taking care of the gastronomic needs of the attendees enabling them to have a â&#x20AC;&#x153;Taste of Asian Cuisineâ&#x20AC;?. Koko Pimentel to seek Senate presidency MANILA, May 20 (Mabuhay) â&#x20AC;&#x201C; Sen. Aquilino Pimentel III, the lone party mate of incoming President Rodrigo Duterte in the upper chamber, announced on Friday that he is seeking the Senate presidency in July. Pimentel made the statement before the PDP-Laban, which he heads, inked a coalition agreement with the Nationalist Peopleâ&#x20AC;&#x2122;s Coalition at the Makati Diamond Residences in Makati City. â&#x20AC;&#x153;As president of the party, I will aspire to be Senate president so that the agenda of the party and the president can be shepherded through the Senate,â&#x20AC;? he told reporters. Duterte was already informed, through party mates, about his bid for the Senate leadership, Pimentel said, but could not say if he has already secured the blessing of the outgoing Davao City mayor. Before emigrating from the Philippines to the United States 19 years ago, I have had few opportunities of visiting Tagaytay. Its cool climate and close proximity to Manila make Tagaytay an ideal destination for a quick weekend getaway and a welcome sanctuary during the hot summer months in the Philippines. And from my experience, it’s one of the best places to stay or spend a vacation in the Philippines. What a thrill for me, of course, when Tagaytay was one of the featured destinations in a recent Fam Trip to the Philippines I was fortunate to be one of the participants. The Fam Trip, hosted by Philippine Airlines, Philippine Department of Tourism and Shangri-La Hotels, was held in celebration of the flag carrier’s 75th anniversary last March 15, 2016. And I was pleasantly surprised to see today’s Tagaytay! The place has become even more popular to both local and international tourists. Of course, its biggest draw remains the iconic Taal Lake and Volcano. Nature remains at its best in Tagaytay. Surprisingly, despite the ongoing commercialization of the area -- with hotels ranging from budget to first class, and other commercial establishments starting to dot the landscape -- the city has managed to preserve its natural beauty. No wonder that it has become one of the major hubs of popular tourist activities including zip lines, horseback riding, trekking, boating, camping, and

Why Duterte offered Cabinet posts to Reds MANILA, May 17 (Mabuhay) – A trust building measure. This is how a political analyst describes presumptive president Rodrigo Duterte’s offer to appoint communist leaders to his Cabinet. Ramon Casiple, Institute for Political and Electoral Reform executive director, said Duterte’s offer could jumpstart stalled peace talks with the Communist Party of the Philippines-New People’s Army, which has been waging a rebellion since 1968. Casiple said peace negotiations with the CPP-NPA have failed because of distrust on both sides. Offering a Cabinet post to the communists breaks that pattern, he said. “Ang usapin dito e tingnan natin iyung kanyang paraan kasi dati hindi umubra iyung mga dating paraan e. Dati, talagang distrust ang basis ng mga usapan. Bello accepts offer as Duterte admin’s peace negotiator with communists DAVAO CITY, May 18 (PNA) – Former secretary of the Department of Justice (DoJ) Silvestre Bello III is accepting the offer of presumptive President-elect Rodrigo Duterte as peace negotiator and welcomed the incoming administration’s move to resume the peace negotiations with the Communist Party of the Philippines-National Democratic Front (CPP-NDF). Although he was surprised after being named by Duterte to be the government’s frontman in the peace negotiations with the communist movement, Bello said he will do his best to finally reach a peace agreement between the government and the CPP-NDF for peace and development of the country. The formal peace negotiations with the communist movement was stalled in 2004 after the NDF withdrew from the negotiating table on account of the renewed inclusion of Jose Maria Sison and the CPP-NPA in the US terrorist list. In the website of the Office of the Presidential Adviser on the Peace Process (OPAPP), the government conducted several rounds of informal talks through the facilitation of the Royal Norwegian Government as an attempt to revive the negotiations. RNG served as Third Party Facilitator for the talks since 2001. There has been no progress. OPAPP said the informals, however, were stymied by prejudicial questions, impediments and preconditions raised at the negotiating table. In the two rounds of informals held in June and November 2009, the Parties agreed to: (a) work towards the resumption of the formal talks; (b) for GRP to lift the suspension of the Joint Agreement on Safety and Immunity Guarantees (JASIG); (c) undertake confidence-building measures for the talks; (d) for GRP to work for the participation of the NDF’s four priority Consultants (Principe, Echanis, Baylosis and Ladlad) in the talks; and (e) hold simultaneous GPH-NDF meetings when formal talks are resumed at various levels: Panels, Reciprocal Working Committees on Socio-Economic Reforms (SER); Working Groups on Political and Constitutional Reforms (PCR); Working Groups on End of Hostilities and Disposition of Forces (EOH/DOF); and the Joint Monitoring Committee (JMC) under the CARHRIHL. In line with these commitments, the GRP reactivated the JASIG on 17 July 2009; continued the review of alleged political offenders (APOs) to effect the release of qualified APOs; worked for the release of the abovementioned four NDF priority consultants (note: Baylosis and Ladlad have not surfaced); facilitated the processing of their travel documents; and coordinated with CHR on the cases of disappeared NDF personalities. However, the NDF backtracked from their commitments and insisted on their unreasonable demand that the GRP release their 14 priority Consultants (all facing criminal charges in various courts in the Philippines), before formal negotiations are resumed.

Harassed by gangs, Pinoy OFW’s leave Central America This author recently met some caregivers in the LA area, grateful to be working here in the United States, after fleeing from the harassment of gangs in Central America. Their stories of survival from harassment was quite appalling. Central America as we know, consists of seven countries: Belize, Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua and Panama. It is bordered by Mexico to the north, Colombia to the southeast, the Caribbean Sea to the east, and the Pacific Ocean to the west. As of the last 2012 Census count, it was estimated that the combined population of Central America is 42, 688, 190. A particular young caregiver named Jun, caught my attention when he recounted stories of survival for him and his family in the Republic of Honduras. Spanish Honduras is different from the British Honduras, which now became the modern state of Belize. Honduras is bordered to the west by Guatemala, to the southwest by El Salvador, to the southeast by Nicaragua, to the south by the Pacific Ocean at the Gulf of Fonseca and to the north by the Gulf of Honduras, a large in let of the Caribbean Sea. It is known for its rich natural resources including various minerals, coffee, tropical fruits, sugar cane and for its growing textile industry, which serves the international market. It is believed to have a population of 8 million (90% mestizo - mixed Amerindian and European, 7% Amerindian, 2% Black and 1% White), and it also has the world’s “highest murder rate.” Jun’s father worked in Honduras and he joined his Dad living there since he was eight years old until he was eighteen. with other OFW’s working there were mostly harassed by various organized gangs who continuously threatened them with their lives and their livelihood. After ten years of living there, they all decided to go back home to the Philippines. As luck would have it, they were considered Honduran residents, which enabled them to eventually immigrate to the United States. Likewise, as this author was watching the late evening television special called “Gangland” on Channel 7’s “Nightline,” hosted by investigative journalist Dan Harris, his story centered on the growing power of organized gangs such as MS-13 and Barrio 18. According to some sources, the MS-13 gang (Mara Salvatrucha) originated in the Los Angeles area. It was named after ‘La Mara’. a street gang in San Salvador, and named after the Salvatrucha guerillas who fought in the Salvadoran Civil War. The word “mara” was taken from “marabunta,” the name of a fierce type of ant. Though the MS-13 gang was established by Salvadoran immigrants in LA’s Pico-Union neighborhood in the 1980’s, apparently their main purpose was to “protect Salvadoran immigrants from other, more established gangs, predominantly composed of Mexicans and African-Americans.” According to the 2009 National Gang Threat Assessment, MS-13 is

“estimated to have 30,000 to 50,000 members and associate members worldwide, 8,000 to 10,000 reside in the US, particularly in the East Coast areas of Washington, D.C., and Maryland.” In a published report by the Washington Times in 2008, this gang “has established a major smuggling center in Mexico.” There were also publicized crimes of murders, extortion, racketeering and drugs since 2003. Similarly, the 18th Street Gang known more commonly as “Barrio 18,” is believed to be one of the largest youth gangs in the Western Hemisphere with cells operating from Central America to Canada. Though according to “some accounts,” it traced its origin as a small time gang in the LA area back in the late 50’s, the gang apparently began its current form in the 1980’s, after splitting from another group called the “Clinton 14” gang, whose particular notoriety was “its role in the city following the acquittal of the police who brutally beat Rodney King, an African-American motorist.” US law enforcement efforts to “slow down the gang’s growth have not proved effective, because even gang leaders who were inside the prisons operate and recruit members on the outside.” Though US immigration policies were imposed to gangs in California, where a large percentage of the Barrio 18 members are not US citizens, this resulted to new member recruitments in Central America such as El Salvador, Mexico and internationally. In California, the gang has a close relationship with the Mexican Mafia or “La M,” another street gang which has a strong presences in US Federal prisons. Some authorities allege
that “these groups along with other members of an international alliance of gangs called “Surenos” (for their Southern California heritage) run drugs from Central America to the United States. On March 2012, Barrio 18 leaders and their rival MS-13 had allegedly agreed to a nationwide “truce,” which was mediated by the NGO’s and the Catholic Church, facilitated by government officials and as a result, homicide rate in the country plummeted in the following months. However, an attempt to emulate it was unsuccessful in Honduras, where Jun’s family fled from. Hopefully, the threat that these gangs pose might change in the future, particularly here in the US, where these gangs operate in dozens of cities across an estimated 20 states, which includes a heavy presence in other western cities such as Denver, Colorado. As widespread as they are currently, all we can do is just HOPE that some kind of final “truce” among them will come along the way..

Mark Villar may face a criminal case if he immediately assumes the duties of the public works secretary. “Sa kanyang pagtanggap ng posisyon sa DPWH (Department of Public Works and Highways) ay baka magkaroon siya ng criminal case sa pagtanggi sa pagtupad sa kanyang tungkulin sa isang posisyon na siya ay nahalal,” election lawyer Romulo Macalintal said. Macalintal quoted Article 234 of the Revised Penal Code, which says, “The penalty of arresto mayor or a fine not exceeding 1,000 pesos, or both, shall be imposed upon any person who, having been elected by popular election to a public office, shall refuse without legal motive to be sworn in or to discharge the duties of said office.” The lawyer said that Villar should first take his oath of office, report at his office at the House of Representatives and then pass a resignation letter.

Disclosure of text messages, e-mails, and Facebook info of a spouse or significant other may constitute domestic violence Domestic violence is abuse perpetrated against a spouse, former spouse, cohabitant, former cohabitant, a girlfriend, a boyfriend, the mother or father of your child, your child. Family Code Section 6211. Abuse is not limited to the actual infliction of physical injury or assault. Family Code, § 6203(b). A court may issue an order enjoining specific acts of ‘abuse’ (§ 6218, subd. (a)), which are defined as, among other things, behavior that could be enjoined under section 6320. (§ 6203, subd. (d).) Section 6320, in turn, permits a court to enjoin a party from engaging in various types of behavior, including ‘disturbing the peace of the other party.’ (§ 6320, subd. (a).) “[T]he plain meaning of the phrase ‘disturbing the peace of the other party’ in section 6320 may be properly understood as conduct that destroys the mental or emotional calm of the other party.”(In re Marriage of Nadkarni (2009) 173 Cal.App.4th 1483, 1497, 93 Cal.Rptr.3d 723 (Nadkarni ).) The phrase includes “destroying the mental or emotional calm of [a former spouse] by accessing, reading and publicly disclosing her confidential e-mails.” (Id. at p. 1498, 93 Cal. Rptr.3d 723.) The expansion of the term “disturbing the peace” to cover accessing, reading, and publicly disclosing electronic communication has profound effect in every divorce and family law case. In Nadkarni, a former wife alleged that her ex-husband had accessed her private e-mail account while she was away on a business trip, then attached copies of the e-mails to documents filed in proceedings regarding custody of their teenaged children. In re Marriage of Nadkarni (2009) 173 Cal. App.4th 1483, 1497, 93 Cal.Rptr.3d 723. She sought a permanent restraining order, but the trial court denied it without a hearing after finding that
the DVPA did not cover situations in which there was no physical harm alleged. The appellate court reversed and remanded the matter to the trial court for a hearing. It held that the definition of abuse under the DVPA is not limited to the infliction of physical injury or assault. Id. at pp. 1498, 1501, 93 Cal.Rptr.3d 723. I didn’’t know that things were going—I didn’’t know. Yeah. It’’s been incredibly challenging to live with.” She further testified that she had suffered shock and embarrassment and feared for her safety because of the disclosure. Client seeks relief from $700k commercial lease Client is 52, still young by any standard. He has got it all together. He has no credit card debt or bank debt. He doesnâ&#x20AC;&#x2122;t own a house but owns a mobile home that he lives in with a fair market value of $45K. Heâ&#x20AC;&#x2122;s pretty happy living in the camper because he can drive it anywhere he wants to when he feels like it. Last week he spent a week in Yosemite enjoying fresh air and natureâ&#x20AC;&#x2122;s beauty. The week before that, he spent a couple of days hunting rabbits in Arizona with his camper in tow. He still works as a commissioned salesman when he feels like working, grossing about $30K a year. He has a beautiful fiancĂŠe who loves him for who he is since he doesnâ&#x20AC;&#x2122;t really have much in his name in this world. So what kinds of financial problem can someone like this have? He made the mistake of acting as a guarantor on a commercial lease for his friend. His friend owns a business, which requires commercial space. The lease on the space is $20K monthly. Itâ&#x20AC;&#x2122;s a five-year lease with three more years to go. His friendâ&#x20AC;&#x2122;s business was doing well until recently. You know how businesses go. You make money, breakeven or lose money. The first situation is the best. The second situation give you a fighting chance, after all, no money are being lost because the business is able to pay for all of
its expenses. But the last situation sucks. Unless you have deep pockets, losing $10K a month means losing $60K in six months. You know what I mean. This deficit has to be financed by new capital from stockholders or from bank loans. Since you know its losing money, you donâ&#x20AC;&#x2122;t want your own money at risk, so you apply for bank loans to transfer the risk to the banks. You tell the banks that the situation will change if this happens or that happens. But nothing happens; you just continue to lose money. When push comes to shove, and you see the writing on the wall, you might decide that its time to call it quits and shut down the business. Client is thinking that friendâ&#x20AC;&#x2122;s business is facing some headwinds that may eventually force his friend to shut it down. If the business is shut down, the commercial lease wonâ&#x20AC;&#x2122;t be paid and guess who is holding the bag for the next three yearâ&#x20AC;&#x2122;s lease of $720K? Fortunately for client he qualifies for a Chapter 7 wipe out of the
$720K commercial lease guaranty. He will keep all his assets, including his mobile home, and his 2015 MB E 320. With this $720K liability out of the way and out of his life, client can become productive again, a beneficiary of the Chapter 7 fresh start. MANILA, May 17 (Mabuhay) â&#x20AC;&#x201C; The Court of Tax Appeals (CTA) has ordered the arrest of film director Carlo J. Caparas on a new set of tax evasion cases filed against him by the Department of Justice (DOJ) last month. In two separate orders made public Tuesday, the CTA Second Division issued a warrant of arrest for Caparas for violation of the National Internal Revenue Code (NIRC) specifically Section 255 or willful failure to file his annual income tax return (ITR) for taxable years 2008 and 2009. â&#x20AC;&#x153;After personally examining and evaluating the Information, the documents attached thereto and the records of preliminary investigation, the Court finds probable cause for the issuance of a warrant of arrest against the accused,â&#x20AC;? the Tax Court said. Caparas is required to pay P20,000 for each count of tax evasion cases or P40,000 bail for his temporary liberty. Both orders were signed by Associate Justices Juanito C. CastaĂąeda Jr., Caesar A. MANILA, May 17 (Mabuhay) â&#x20AC;&#x201C; The Integrated Bar of the Philippines (IBP) on Tuesday asked the Supreme Court to nullify the appointments of two Sandiganbayan justices who are among those selected by President Benigno Aquino III to fill in new posts in the anti-graft court. In its petition, the IBP, which is the national organization of lawyers in the Philippines and the mandatory bar association for Filipino lawyers, said Aquino committed culpable violation of the 1987 Constitution and grave abuse of discretion when he appointed Associate Justices Geraldine Faith Econg and Michael Frederick Musngi. Joining the IBP in the petition were five judges and candidates who were shortlisted for one of the six posts but were not selected. They are: Philip Aguinaldo, Muntinlupa RTC Branch 207; Reynaldo Alhambra, Manila RTC Branch 53; Danilo Cruz, presiding judge of Pasig RTC Branch 152; Benjamin Pozon, presiding judge of Makati RTC Branch 139; and Salvador Timbang, presiding judge of Las PiĂąas RTC Branch 253. The petitioners accused Aquino of violating Section 9, Article VII of the Constitution when he did not appoint anyone from the shortlist submitted by the Judicial and Bar Council (JBC) for the 16th associate justice post, and instead picked two appointees - Econg and Musngi - from the shortlist for the 21st associate justice post to fill in both the 16th and 21st posts. â&#x20AC;&#x153;To date, no one from the shortlist submitted by the JBC to the Office of the President on 28 October 2015â&#x20AC;Ś has yet been appointed by President Aquino, who had until 26 January 2016. Hence, there is an obvious continuing violation of the Constitution in this case since,â&#x20AC;? read the petition. The petitioning judges, who were all shortlisted for the 16th Sandiganbayan post, claimed they â&#x20AC;&#x153;suffered direct injuryâ&#x20AC;? when Aquino did not appoint anyone from their batch of shortlisted individuals.

Go on behalf of the Secretary of Justice reversed the resolution of Prosecutor General Claro Arellano that dismissed the complaint filed by the Bureau of Internal Revenue (BIR) against Caparas. Contrary to claims of Caparas that he filed his ITR for 2008 and 2009, the DOJ noted that based on the documents submitted by the BIR, Caparas filed an ITR for 2010. â&#x20AC;&#x153;We believe in the veracity and reliability of the sworn BIR statements and certifications because they have been made and issued by the very government instrumentality that is tasked with the collection of taxes in the regular course of performing its functions,â&#x20AC;? the DOJ resolution stated. Caparas is already undergoing trial before the Tax Court for failing to file Value Added Tax (VAT) returns for the years 2006 to 2009 where BIR said his liability is P101,819,722.19.(MNS)

MANILA, May 18 (Mabuhay) – Incoming president Rodrigo Duterte said he would be a “working president” who would pay no mind to criticisms against him. “I have been in politics for 23 years, I’ve learned to accept garbage and divine light from others. Para sa akin, I would just like to be a working president,” Duterte said. Asked on whether he would like to be loved or feared by people, Duterte, without hesitation, said, “I really do not care who hates me.” “Yung criticism, good or bad, true or not, is part of the territory of governance,” he said, even joking that in his years in politics, he was seldom portrayed in good light. “You know very well, that I’ve been in the government in the past 22 years, kailan pa ba ako nagmukhang anghel sa inyo?” Duterte said. However, Duterte, who ruled Davao City with an iron hand for years, said he would respect the opinions of those who are against him, even within the government. “I may disagree [with] what you say but I will defend your right to say it. We are in a democracy,” he said. Meanwhile, he explained his somewhat uncouth manner of presenting himself in the public during the campaign period, saying it was all just strategy. “It was what the people wanted. Would you believe it, at this point, ‘yun yung gusto nila. Kita mo dinagdagan ko pa, it was not even just a casual pagmumura. Aquino on leaving Malacañang: I remained true to my mandate MANILA, May 18 (Mabuhay) – With only 43 days left in office, President Benigno Aquino III said Wednesday that he is stepping down with his head held high as he remained true to his mandate in all the six years of his presidency. “Patapos na nga po ang ating termino. 43 days na lang po ang natitira, bababa na tayo sa puwesto. Sa kabila nito, nakita niyo naman po, tuloy-tuloy lang tayo sa ating trabaho. Sinasagad natin ang bawat pagkakataong makapaglingkod sa ating mga Boss, ang sambayanang Pilipino,” Aquino said. “Ang masasabi ko po, sa darating na ika-30 ng Hunyo, pagpalo ng alas-dose ng tanghali, matiwasay tayong makakababa sa puwesto, makakalingon nang taas-noo sa sambayanang Pilipino, at mata sa matang masasabi: Tumotoo ako sa inyo. Tumupad ako sa mandatong kaloob ng aking mga Boss,” he added. Aquino made the statement during the ceremonial signing of Republic Act 10821 or the Children’s Emergency Relief and Protection Act in Malacañang. The event was attended by his close allies, Senate President Franklin Drilon and House Speaker Feliciano Belmonte Jr.
Article VII, Section 4 of the Constitution states that the term of the President shall begin at noon on June 30 and shall end at noon of the same date six years after. President Aquino and his appointees in Malacañang have started packing up, Communications Secretary Herminio Coloma Jr. earlier said. A Presidential Transition Commission has also been formed for the transition process from the Aquino government to the administration of incoming president Rodrigo Duterte, the incumbent city mayor of Davao. Aquino said he was certain of leaving behind a better Philippines. “Tunay nating maipapamana sa susunod na henerasyon ang isang Pilipinas na di hamak na mas maganda kaysa atin pong dinatnan,” he said. “At nagawa natin ito, dahil nagtulungan tayo, inangat natin ang isa’t isa, at inuna natin ang ating kapwa at bayan, bago ang sariling kapakakan,” the President added. Estrada on Lim’s poll protest: ‘He must be dreaming’ MANILA, May 18 (Mabuhay) -- “He must be dreaming,” incumbent Manila Mayor Joseph Estrada said of his rival, former Mayor Alfredo Lim, after the latter has filed an election protest against him. Estrada said the filing of the case against him was “most welcome,” saying he is willing to face the charges and defend himself from baseless accusations hurled at him. “It’s most welcome. I’ve never cheated my whole life as far as election is concerned,” the incumbent mayor said at the Kapihan sa Manila Bay on Wednesday. “I can’t stop him. He (Lim) should feel free to accuse me of anything and file it in court. I’m willing to face all the cases there.” Estrada said his conscience is clear and he has nothing to be afraid of. The incumbent mayor did not also mince words when he hit Lim for refusal to admit
his defeat in the mayoral race in Manila last May 9. “He must be dreaming. Ganyan ang natatalo e, kung ano-ano ang sinasabi, ayaw aminin ang pagkatalo (That’s how losers are, they say a lot of things, they won’t accept defeat),” he said. “But my conscience is very clear. Duterte to probe why PHL lost Scarborough Shoal MANILA, May 18 (Mabuhay) – Incoming President Rodrigo Duterte said that he is not the type to go after political enemies, but said that he will ask Senator Antonio Trillanes IV how China was able to take control of Scarborough Shoal. “Maybe when I sit as President, I am not going to prosecute. I am not up for it actually—going after political enemies. But I would be interested to know why we lost the Scarborough Shoal,” Duterte said referring to Trillanes and his backchannel negotiations with China, which are all approved by President Benigno Aquino III. Trillanes had insisted that the Philippines has not lost the disputed shoal, locally called Panatag and Bajo de Masinloc. Prior to his press conference on Monday, Duterte also told reporters late Sunday night that if he is going to have bilateral talks with China, he will insist that the Scarborough Shoal is part of Philippines’ exclusive economic zone (EEZ). “You are occupying illegally our territory. I am not asking you to force yourself to believe in it because you won’t anyway, but I will talk to
you under that proposition. Amin iyan. Hindi iyan sa inyo,” he said. “Kung mag-usap tayo, that’s fine. Pero that is my stand,” he added. On Monday, Chinese ambassador Zhao Jianhua paid Duterte a visit at the Clubhouse in Matina Enclaves. Ana Capri files complaint against ‘sex offender’ Actress Ana Capri filed complaints Tuesday afternoon against a still-unidentified man for allegedly sexually harassing her inside a club in Taguig City last April 3. Capri and her camp are pushing for charges of physical injury, acts of lasciviousness, and slander by deed against one “John Doe,” the placeholder name for the alleged offender. Capri also filed a separate complaint for violation of Presidential Decree No. 1829 or obstruction of justice against one of the security officers
of the Taguig club. According to Capri, “John Doe” grabbed her buttocks while she was charging her phone inside the club. After feeling violated, she slapped the suspect. In retaliation, the man slapped her. Capri narrated that they were then separated and she was asked to wait outside the club. Surprisingly, most home purchasers do little or no research before they invest their nest egg. Doesn’t it make sense to become completely informed before you buy your first home? This article is designed to help you avoid 10 common and crucial mistakes. The right real estate professional can help you make good sound business decisions based on your personal situation. INSPECT INSPECT INSPECT Go over the inspection report with a fine tooth comb. Make sure the report was done by a professional organization. For condo purchases go over the CC&R’s, By-laws and Association fees. Don’t take anything for granted.. inspect everything. Imagine the Property Vacant Your furnishings and decorations will be the ones filling this new residence. Don’t be swayed by beautiful furniture, it leaves with the owner. Income + Lifestyle = Mortgage Payment Sit down with you professional loan agent and honestly discuss your income and living expenses. Take into account future considerations, children, add-ons, amenities, and fixups. Your dream home is certainly worth a sacrifice but don’t mortgage your entire furniture. Do your budgeting and make sure you are fully aware of the loan program you are getting into. See yourself 5-7 years into this property and loan. View Several Homes See at least 7-10 properties. Don’t move too slow but don’t move on the first property you see. With your agent’s help you should be able to view enough properties to get a good overall perspective of the home market. When you find the right property all the legwork will be worth it. Always investigate yourself what is selling in the area and don’t overprice
yourself in this market, especially if you are a no money down buyer. Utilize Your Team By aligning yourself with the right real estate professional you will have an entire team at your disposal. Do not allow one organization to dominate the whole transaction, meaning don’t go to an agent whose got the lender, escrow and title company in their back pocket. If this organization has too much interest into a transaction then that might alter their views. Be a “Columbo” Check out all loan costs and expenses before you sign. Utilities, taxes, insurance, maintenance and home owner dues if applicable. Make sure all utilities (gas, electricity, and water) are on during walk-through so that you can inspect everything in working order. Ask for lots of questions and be very detail conscious. Do a Final Walk-Through Visit the property after all previous owner’s furnishings have been moved out to be sure there are no surprises. Be absolutely positive the property was left exactly as you had agreed upon in the contract. Things that could have been spotted in a final walk-through are often unintentionally overlooked. Plan for Flexibility Closing dates are not written in stone. Allow for contingencies and have a back-up plans. If you or the sellers need a little more to conclude the final arrangements, don’t let these delays upset or frustrate you. Californians motoring more Sacramento – More Californians hit the highway in the fourth quarter of 2015 than 2014, with drivers purchasing 3,798,626,428 gallons of gasoline in 2015 compared to 3,714,745,430 in 2014, announced Board of Equalization (BOE) Member Jerome E. Horton. This is the most gasoline purchased in the fourth quarter since 2007 when drivers bought 3,901,706,956 gallons—2.7 percent more than last year. The average fourth quarter price for gasoline in 2015 was $2.63 per gallon (minus sales tax), according to the U.S. Energy Information Association. This is the lowest fourth quarter price for gasoline since 2008, when it was $2.39 per gallon. Falling gas prices and lower unemployment figures likely account for the increase in gasoline consumption, according to BOE’s chief economist. “It’s a positive sign that people are going back to work and can afford gasoline to get them there,” said Member Horton. Gasoline excise tax revenue for the fourth quarter of 2015 is estimated at $1,138,215,481 and sales tax is estimated at $322,995,392. Excise tax funds highways and mass transit, while sales
tax revenue from gasoline funds various local government programs. Diesel consumption rose in the fourth quarter of 2015 to 714,843,582 gallons compared to 709,745,380 in 2014. This is a 0.7 percent increase. The average base price of diesel in the fourth quarter of 2015 was $2.35 per gallon. In 2012, it was $3.68 per gallon in the fourth quarter. According to the BOE’s Chief Economist, higher diesel consumption is consistent with a growing economy. Diesel excise tax revenue for fourth quarter 2015 is estimated at $101,760,573. Sales tax revenue for diesel was $159,464,544 in the fourth quarter. Re-elected in 2014, Jerome E. Horton is the Third District Member of the California State Board of Equalization (BOE), representing more than 9.5 million residents in Los Angeles County, Ventura County, and San Bernardino County. He is also the BOE’s Property Tax Committee Chairman. He is the first to serve as a Board Member with more than 21 years of experience at the BOE. Horton previously served as a Member of the California State Assembly from 2000-2006.

rate mortgages are at all time lows. First time buyers who will live in the house long term should buy a house instead of renting as long as they can afford the mortgage payments. Since rental payments are so high, you are better off paying a mortgage with a tax deductible interest write off. Two L.A. sheriff’s deputies found guilty of violating civil rights of beaten inmate LOS ANGELES – Two former deputies with the Los Angeles Sheriff’s Department were found guilty today of violating the civil rights of a mentally ill jail inmate by beating, kicking and pepper spraying the victim after he showed disrespect to a jail employee. Bryan Brunsting, 31, and Jason Branum (also known as Jason Johnson), 35, were each found guilty of three felony counts related to the unprovoked attack on March 22, 2010. The evidence presented during a one-week trial in United States District Court showed that Brunsting and Branum assaulted the victim, who was an inmate at the Twin Towers Correctional Facility in downtown Los Angeles. The assault occurred after the inmate mouthed-off to a civilian Sheriff’s Department employee. Brunsting, who was a training officer assigned to a rookie deputy who had just started working at the jail, told his trainee that they were going to “teach [the inmate] him a lesson.” Brunsting, Branum and the rookie deputy brought the victim out of the visiting area and directed him to a locked hallway without any surveillance cameras. Once in the hallway, the inmate realized he was going to be assaulted and began to run. The victim was tackled. Brunsting and Branum then beat the victim with fists, kicked him in the genitals and sprayed him in the eyes with pepper spray. Once other deputies arrived, they instructed the rookie deputy to handcuff the victim before he was led away for medical treatment. After the beating, Brunsting, Branum and the rookie deputy met to coordinate and falsify their stories. The rookie deputy testified that he was told what to say and how to write his report. As prosecutors argued at trial, the reports submitted by Brunsting and the rookie were strikingly similar, and were written to justify
the use of force by falsely claiming that the victim had attempted to punch the rookie. “The civil rights in the Constitution are guaranteed to everyone in the United States, even those who are being held in jail,” said United States Attorney Eileen M. Decker. “A violation of any civil right is a crime against the United States and affects the nation’s entire citizenry, which is why we will tirelessly work to prosecute civil rights violations, especially when they are committed by people who have sworn to uphold the Constitution.” After approximately one hour of deliberations, the jury convicted Brunsting and Branum of conspiracy to violate civil rights, deprivation of civil rights with bodily injury, and falsification of records for preparing reports that tried to justify their use of force against the victim. United States District Judge George W. Wu is scheduled to sentence the two defendants on August 22, at which time they each will face a statutory maximum penalty of 40 years in federal prison. Brunsting still faces civil rights charges in relation to another alleged use-of-force incident on August 20, 2009 at Twin Towers, and he is scheduled to go on trial later this year. It is important to note that Brunsting is only charged in relation to the 2009 incident and is considered to be innocent of these charges until he is proven guilty in court. The case against Brunsting and Branum is the result of an investigation by the FBI, and is one in a series of cases resulting from an investigation into corruption and civil rights abuses at county jail facilities in downtown Los Angeles. As a result of today’s guilty verdicts, 21 current or former members of the Los Angeles Sheriff’s Department have now been convicted of federal charges.
