Kerwin Espinosa vows to tell all: PHL envoy MANILA, Nov 16 (Mabuhay) – Alleged Eastern Visayas top drug lord Kerwin Espinosa is asking to be placed under the government’s Witness Protection Program, with the promise that he will reveal all that he knows about the illegal drug trade, Philippine Ambassador to the United Arab Emirates Constancio Vingno Jr. said Wednesday. “’Ang request niya, na he be placed under the Witness Protection Program and he will tell all,” Vingno said. The Philippine envoy was able to meet with Espinosa last week at the Wadha Jail in Abu Dhabi, where the
alleged drug lord has been detained since he was arrested by local authorities last October 17. The request comes as the alleged drug lord is said to fear for his life, as well as that of his family’s, after the killing of his father, Albuera Mayor Rolando Espinosa Sr., inside the Leyte Sub-Provincial Jail last November 5. Sebastian stabbed to stop testimony vs De Lima: inmate MANILA, Nov 16 (Mabuhay) – The stabbing incident at the New Bilibid Prison was sparked by a supposed plot to silence convict and alleged drug lord Jaybee Sebastian from testifying against Senator Leila De Lima, a convict said in his affidavit. During the justice subcommittee on correctional reforms inquiry at the House of Representatives on Wednesday, Chief Superintendent Francisco Ebreo cited the affidavit of convict Tomas Doniña who admitted that he stabbed Sebastian to silence him. Doniña in his affidavit said he was ordered by a friend from the Philippine Navy to kill Sebastian to stop him from testifying at the House of Representatives probe into the proliferation of drugs at the Bilibid, according to Ebreo, who led the investigation into the Sept. 28 riot at the national penitentiary. “Doniño averred that he took the opportunity to stab Jaybee Sebas-

MANILA, Nov 15 (Mabuhay) – Sen. Leila de Lima has denied that she accepted drug money to fund her electoral campaign. In a television interview, De Lima said she instructed her staff to check the background of contributors before accepting donations for her campaign. “Very clear ang instruction to the staff, na huwag tayo basta-basta tumanggap galing sa hindi natin kilala at least hindi natin alam ang background. Lalo na yung ganyan, mga drug lords, mga convicts, mga sino man notorious na mga tao. Hindi tayo pwedeng tumanggap diyan. Ang alam ko po sinunod po ‘yan ng staff ko,” she said. “Kung totoo po na may drug money akong natanggap, siyempre pag drug money marami po yan, milyon-milyon po yan. Di sana hindi lang yun ang pwesto ko,” she added. De Lima, who made it to 12th place in the senatorial race in May 2016, said her expenses are disclosed in her Statement of Contributions and Expenses (SOCE). “Based on my SOCE, yung ni-report namin, at yun naman po talaga ang nasa records namin, P86 million something lang po yung aking expenditures at galing naman ang tulong sa aking mga kaibigan, mga kamag-anak,” she said. In her SOCE, which she submitted to the Commission on Elections, the senator is the 14th candidate with the highest expenses reaching P86,153,300.49. Among the candidates who received the largest amount of campaign contribution, De Lima is the 12th on the list with P86,831,095.19 from about 190 individuals.

There has been an incredible amount of press recently that suggests a significant improvement in the real estate market. However, there is still a way to go before mortgage balances once again are lower than the propertyâ&#x20AC;&#x2122;s current value. In the interim, many are still facing foreclosure due to increases in mortgage payments, or decreases in household income. The major banks have recently released a statement that foreclosures are set to increase during the second half of 2013. In fact, one of the reasons, real estate professionals see an improvement in demand for homes for sale, (a buyerâ&#x20AC;&#x2122;s market), is because ironically, there is a shortage of homes for sale. Home owners cannot list a home for sale if itâ&#x20AC;&#x2122;s worth less than they owe. Their choices are limited. Foreclose, abandon, shortsale or bankruptcy. For those with a second mortgage, bankruptcy might be a solution, since it can strip away (discharge) the second lien if it is totally unsecured by the propertyâ&#x20AC;&#x2122;s current value. This decreases the amount owed, and increases the owners equity. Now they can sell, if thatâ&#x20AC;&#x2122;s what they want to do. Better yet, stay in the home, and watch the value go up, without paying for the second mortgage. When you are unable to make your mortgage payments on time, the bank starts a foreclosure process. Foreclosure is a legal procedure that involves mortgaged properties. If a homeowner defaults on his or her mortgage, by either failing to make mortgage payments or failing to follow other terms of the mortgage document, foreclosure may be the result. The homeowner relinquishes all rights to the property, and the mortgage lender takes possession of the property. Usually there is a forced sale of the property at public auction; the proceeds of this sale are applied to the mortgage debt. Bankruptcy is a legal procedure that begins when an individual has more debt than assets. dismiss the filing if the debtorâ&#x20AC;&#x2122;s income is greater than the state median income. However, the US bankruptcy code also provides for a restructuring of debt, through a Chapter 13 procedure. This is the procedure that allows for wiping off that second mortgage. Instead of liquidating all assets as in a regular bankruptcy Chapter 7, an individual filing for bankruptcy under Chapter 13 agrees to repay creditors out of his or her future income. Chapter 13 is only available to individuals with regular incomes whose debts do not exceed $1,000,000 ($315,000 in unsecured debts and $1,010,000 in secured debts). Each Chapter 13 debtor, through his or her attorney, writes a plan, which must be approved by the bankruptcy court. The debtor must pay the Chapter 13 Trustee the amounts set forth in the plan and complete an education course in personal financial management as approved by the U.S. Trustee. Debtors receive a discharge after
they complete their Chapter 13 plan. For those in foreclosure, a chapter 13 bankruptcy repayment plan may be the answer. You will still have to make your regular mortgage payments on time, but mortgage arrears can be amortized over several years, so you donâ&#x20AC;&#x2122;t have to catch up all at once. It is a solution for those struggling with both mortgage payments and unsecured debt like credit cards, because the bankruptcy can discharge the unsecured debt, and give you a chance to use that money to save your home, The U.S. Courtsâ&#x20AC;&#x2122; publication Bankruptcy Basics refers to a Chapter 13 bankruptcy as â&#x20AC;&#x153;an adjustment of debts of an individual with regular incomeâ&#x20AC;? where the debtor works with the bankruptcy court to develop a repayment plan for the debtor to follow over the next three to five years. Upon completion of the repayment plan, the bankruptcy court will discharge any remaining eligible debts. A Chapter 13 bankruptcy filing can stall or derail foreclosure proceedings. Thatâ&#x20AC;&#x2122;s because of bankruptcyâ&#x20AC;&#x2122;s â&#x20AC;&#x153;automatic stayâ&#x20AC;? provisions that force creditors to the sidelines while the bankruptcy court sorts things out. The lender can petition the court to allow it to continue with the foreclosure, depending on where you are in the foreclosure process, but it should buy you some time. The following, is from page 24 of the U.S. Courtsâ&#x20AC;&#x2122; publication Bankruptcy Basics: By virtue of the automatic stay, an individual debtor faced with a threatened foreclosure of the mortgage on his or her principal residence can prevent an immediate foreclosure by filing a chapter 13 petition. Chapter 13 then affords the debtor a right to cure defaults on long-term home mortgage debts by bringing the payments current over a reasonable period of time. The debtor is permitted to cure a default with respect to a lien on the debtorâ&#x20AC;&#x2122;s principal residence up until the completion of a foreclosure sale under state law. 11 U.S.C § 1322Š. Deal to host Miss U pageant in PHL inked By Azer N. Parrocha
MANILA, Nov. 16 (PNA) – The hosting of the next Miss Universe pageant in the Philippines next year has just been secured as major partners on Wednesday night signed an agreement to set it in stone. Earlier, the Department of Tourism (DOT) said that the private sector would shoulder production costs of the pageant, estimated at USD 11 to 15 million, which would be held at the Mall of Asia Arena in Pasay City on Jan. 30, 2017 (Manila time). Official host of the prestigious pageant will be the DOT and group of former Ilocos Sur governor Luis Chavit Singson, LCS Holdings, while
its partners include Okada Manila, Solar Entertainment Inc. and SM Lifestyle Entertainment Inc. The agreement was signed by DOT Assistant Secretary Frederick Alegre, Miss Universe Organization (MUO) Vice President for Business Development and Marketing Shawn McClain, Singson as well as representatives from partners. Also launched was the official website and Facebook page for the next pageant, which will mark its 65th year. Reading an official statement from DOT Secretary Wanda Teo, Alegre assured full support for the hosting of the pageant anew as it was expected
to boost the number of visitors in the Philippines. Alegre, in Teo’s statement, also described the coming together of public and private sectors as “a big step towards taking the country to the global stage.” McClain, for his part, expressed excitement in the Philippine hosting of the pageant, citing the Philippines for having a “very engaged, energetic” fanbase. He said that the pageant would be a three-hour telecast that highlighted the Philippines. The Philippines already hosted the Miss Universe pageant twice, in 1974 and 1994.

MANILA, Nov. 14 (PNA) – The Tourism Congress of the Philippines (TCP) encouraged Filipinos on Monday to pursue more competitive career opportunities in tourism in the country so that they would no longer need to work abroad. TCP executive vice president Aileen Clemente made this statement, inviting guests and applicants to attend the industry’s first-ever jobs fair in the Visayas and Mindanao this month. The jobs fair, which will take place at the Cebu Trade Hall on Nov. 22 and at the SMX Convention Center Davao on Nov. 28, will bring together tourism companies, employment agencies, and schools which will look for potential hires or offer internship
and tourism related programs to applicants. Clemente said they are bringing at least 30 tourism related companies to their Tourism Career and Hospitality Fair (TCHF) in Cebu and Davao. She noted that companies participating in the jobs fair will have access to the database for three months after the jobs fair for any additional hiring. This job fair comes after its successful Luzon leg held last month at the SMX Convention Center in Pasay City, which featured 50 tourism related companies and attracted more than 1,000 job applicants. “There will be hotel chains and resorts opening or are now expanding their operations. This is the best time for Filipinos to become part of the
country’s tourism industry. Instead of going abroad, we are seeing competitive career opportunities locally,” she added. Clemente explained that career opportunities extend beyond Metro Manila and that a lot of the tourism related developments are moving to the southern part of the country. She also said that careers in the tourism industry goes beyond those in the frontline services as the industry has a wide ranging need from musicians all the way to engineers and accountants. During the fair, participants will be holding one-on-one interviews with those who have submitted their resume to the TCP online. However, companies will also do interviews for walk-in applicants.

MANILA, Nov. 16 (PNA) – The Department of Tourism Region-VI (DOT-VI) on Wednesday warned the public against tourism establishments in Western Visayas that pretend to be accredited under the department. “The public is forewarned to be vigilant in engaging transactions with non-DOT-accredited establishments in Western Visayas,” DOT-VI Director Helen Catalbas said in a statement. Catalbas said the warning came after the department received various reports of tourism entities participating in activities including solicitation of any sort, under the DOT-VI. “The Department of Tourism Region VI reminds the public to deal only with DOT-accredited establishments bearing Accreditation ID, Accreditation Sticker and Accreditation Certificate,” she added. She also urged the public to reach the DOT Region VI Office through telephone numbers (033) 503 2705 / 335 0245 / 337 5411 for verification. Meanwhile, the office is also planning to roll out a Tourism Guidebook to serve as reference and guide in the local government units’ tourism planning activities. The book contains the guide in formulating tourism development plans and supplemental readings to understand the various tourism concepts and tourism planning processes better.

Sandigan affirms dismissal of Arroyo’s remaining graft rap MANILA, Nov 17 (Mabuhay) – The Sandiganbayan has affirmed its dismissal of the last remaining graft case against former President Gloria Macapagal-Arroyo in connection with the scuttled National Broadband Network (NBN) deal. In a six-page resolution dated Nov. 10, the anti-graft court’s Fourth Division denied the appeal by state prosecutors of its Aug. 25 resolution that granted the demurrer filed by Arroyo, former First Gentleman Jose Miguel Arroyo and former Commission on Elections chairman Benjamin
Abalos. The said case concerns the violation of Section 3(g) of the Anti-Graft and Corrupt Practices Act, which prohibits officials from entering into disadvantageous contracts. The court noted that granting the demurrer for the insufficiency of the prosecution’s evidence amounts to an acquittal, and thus could not be appealed without putting the accused in double jeopardy. It also described as erroneous the prosecutors’ contention that her Transportation Secretary Leandro
Mendoza’s signing of the contract with China’s ZTE Corp. is presumed to be the actions of the former President, too. The so-called doctrine of qualified political agency, the court said, applies only to the acts of the President’s alter ego when they are performed in the regular course of business. The prosecutors cannot thus rely on this principle and, at the same time, claim the NBN-ZTE deal was grossly disadvantageous to the government.
The court also noted that “even granting, without conceding, that the NBN contract was grossly disadvantageous, it should be emphasized that said contract was nevertheless cancelled.”(MNS)

Searching for Love and dealing with loneliness during the holidays Holiday season is in the air and numerous unattached, single people feel lonely particularly when theyâ&#x20AC;&#x2122;re alone and apart from their family and loved ones. Initially, they started corresponding via emails, which progressed into meeting each other in a restaurant setting, to constantly going on intermittent â&#x20AC;&#x153;dates,â&#x20AC;? going on out-of-town trips together and currently sharing and co-habitating in a romantic, luxurious, pad overlooking the ocean. Likewise, another well-known lawyer friend also found her â&#x20AC;&#x153;soulmate,â&#x20AC;? through Match.Com. This couple both love to travel and go dancing as we have all witnessed through their facebook posts. Hopefully, their match up will stay forever. A recent friend also traveled all the way to Egypt, to finally meet the good-looking hunk she has met through eHarmony, whom she has corresponded with for almost a year now, and she wasnâ&#x20AC;&#x2122;t at all disappointed, because the gentleman treated her like a â&#x20AC;&#x153;queenâ&#x20AC;? and introduced her to his wealthy parents. As a matter of fact, she intends to go back to his home country around Christmas-
time. Gladly, this author is happy to learn of these successful match-ups. However, there are other stories of sad, scary and otherwise unsuccessful encounters such as those which came about through facebook â&#x20AC;&#x153;Friendâ&#x20AC;? requests, which we have learned recently. One such encounter was experienced by a close friend who responded to a â&#x20AC;&#x153;friendâ&#x20AC;? request on Facebook, where the gentleman requesting had his photo on it, revealing that he is from the U.K., but his mother is half-Filipino. Initially, they were just corresponding via email. Then it progressed into phone communications which lasted for around three months, until one day, the UK guy informed her that he was going away to Southeast Asia to pick-up his inheritance left by his Dad who passed away, from the Southeast Asian government where his Dad once worked at. When he â&#x20AC;&#x153;supposedlyâ&#x20AC;? have arrived in Southeast Asia, he called her and informed her that his inheritance is being processed, but meanwhile he needed FINANCIAL help to get by while heâ&#x20AC;&#x2122;s waiting. Suddenly, this authorâ&#x20AC;&#x2122;s friend woke up and told the guy from the U.K that she wonâ&#x20AC;&#x2122;t be able to extend financial help and for him to STOP corresponding with her. Other sad stories came to light, where single, unattached women, particularly those who are retired
are being taken advantaged of by international scammers, posing as good-looking â&#x20AC;&#x153;decentâ&#x20AC;? gentlemen, but out to prey on these vulnerable women. One such vulnerable lady was scammed of her lifetime savings, unbeknownst to her relatives who knew of the supposed cyber â&#x20AC;&#x153;love affair,â&#x20AC;? which she fell for. This is a WARNING to everyone in search of Ms. or Mr. Right. There are numerous international scammers around, so beware of looking for love in the WRONG places. Word of advice: if you DONâ&#x20AC;&#x2122;T particularly know the person requesting for you
to be their friend on Facebook for example, try to find out first how they found out about you; it might assist you in zeroing-in on those potential crooks. Nevertheless, thorough screening is also needed when you join in the â&#x20AC;&#x153;couple searchâ&#x20AC;? sites such as Match..com or eHarmony. When in doubt, ask yourself if the â&#x20AC;&#x153;match-upâ&#x20AC;? is really worth your time and effort to go on. Gomez of Los Angeles, led an interfaith prayer service wherein he reassured undocumented immigrants that the church would not let them down. Los Angeles Mayor Eric Garcetti has told the media that the city will remain a “welcoming city, where our law enforcement officers and LAPD don’t go around asking people for their papers, nor should they.” The mayor has also said that police would continue to enforce Special Order 40, which bars officers from asking people about their immigration status. Garcetti was backed up by the Los Angeles Police Department Chief Charlie Beck. As this developed, the Filipino Migrant Center (FMC) assured undocumented Filipinos here that they will be available to extend help and resources. “If you need someone to talk to, or are concerned about your safety, please do not hesitate to contact us. ions were sought to help immigrants understand the consequences of the elections. “When you look at the popular vote (which Democratic candidate Hillary Clinton won), “the majority of Americans did not vote for Trump and his anti-immigrant rhetoric,” Sally Kinoshita, deputy director of Immigrant Legal Resource Center, adding that the election “is not a reflection of Americans in general and their views of immigrants.” The following are excerpts from NAM and Ready California national press call: A challenging time ahead The election of Trump, a candidate who made fear and xenophobia a central part of his campaign, has spurred advocates to pledge to fight for the dignity of all families. “There’s no doubt we are entering a challenging period. The election was divisive and damaging. We saw hate crimes, hateful rhetoric,” said Kamal Essaheb, national director of policy and advocacy for National Immigration Law Center. “President-Elect Trump has called for unity in his election night speech, but obviously his actions are going to have to speak louder,” Essaheb said. The most important thing to do now, he said, is to make sure immigrants are prepared and know their rights. One thing to keep in mind, he said, are the limits of presidential power. “The Constitution protects everyone,” Essaheb said. “Law enforcement has to show you [a warrant to enter your house]. You have the right to remain silent. You have the right to call an attorney.” “There are things he can do that will be harmful,” said Essaheb. But,
he said, “Trump cannot take away the Constitution. He cannot take away the people’s rights.” Another thing he can’t take away are state and local laws, such as California’s AB 60, which allows undocumented immigrants to get a driver’s license. “State and city-level policies did not change on Tuesday night,” Essaheb said. “The same opportunities are there; the imperative to act is higher.” Trump has said that he would repeal Deferred Action for Childhood Arrivals (DACA), the executive action taken by President Obama in 2012 that gives certain undocumented immigrants who came here as children access to a work permit. The president-elect has said that he would eliminate federal funding to so-called “sanctuary cities” whose policies limit cooperation between local police and federal immigration authorities. He has talked about stepping up deportations, with “zero tolerance for criminal aliens.” Trump has also talked about building a wall, something that experts say is neither practical nor feasible. What families can do now Although it is hard to know exactly what to expect under a Trump administration, there are some steps families can take now to stay safe and plan for their future. Sally Kinoshita of Immigrant Legal Resource Center noted that Trump is not president until Jan. 20, 2016. Until then, the DACA program remains in effect. It takes several months for DACA applications to be processed, Kinoshita said, so if people have not applied for DACA, it might be too late. Trump has said he would get rid of

the program; the earliest this would happen is his first day in office. Renewals, which take eight weeks to be processed, would be much less of a risk, said Kinoshita. Some people are renewing their DACA now while Obama is in office, in order to get a two-year work permit. Anyone planning to renew DACA now should know that the price for DACA increases to $495 on Dec. 23, 2016. Loans are available through the Mission Asset Fund, Self-Help Federal Credit Union, the Mexican Consulate or local service providers. Because there is expected to be an increase in enforcement, prioritizing those with criminal records, she said, people should avoid brushes with the law. “Something like a DUI or a drug conviction can have permanent immigration consequences,” Kinoshita said. Those who live in California can get certain felonies reduced to misdemeanors under Prop 47. Kinoshita encouraged all immigrants to go to a qualified legal services provider to be screened for other forms of immigration relief.

A report came out last week about rumours that television host and singer Billy Crawford was arrested in Hong Kong. A tabloid claimed that he had to spend a night detained at a police station after punching a man who groped his girlfriend, actress Coleen Garcia, during a Halloween party held at a bar in Hong Kong’s Harbour City last October 31. In an interview with reporters on Tuesday, Crawford denied that he was arrested, and clarified that he only cooperated with local authorities who brought him in for questioning. He also maintained that he did not punch anyone. “Hindi po ako nakulong. Kasi kung nakulong ako, hindi ako makakabalik sa Pilipinas—I’d be deported to the United States, “ said Crawford,
who is also an American citizen. “But may kaguluhan na nangyari dahil nabastos si Coleen and it was a verbal altercation between someone there and me.” The “It’s Showtime” host furthered: “Good thing, iyong medyo shungang tao na nambastos kay Coleen ay ginawa niya sa harapan ng pulis. Gossip website Fashion Pulis snatched up the photo of Duterte and Adarna getting close from a private Instagram account. It was not clear, however, where and when the intimate shot of the rumored couple was taken. A statement released by Duterte’s manager neither confirmed nor denied the authenticity of

Asian American voters backed Clinton over Trump by wide margin across ethnic group LOS ANGELES, CA – Contrary to mainstream exit poll results, the 2016 national Asian American Election Eve Poll reveals that Asian Americans voted for Hillary Clinton over Donald Trump by wide margins (75% to 19%), well-above the 47.7% support she garnered in the general national electorate. Ethnically, Asian American support for Clinton was as follows: Chinese (69%), Filipino (78%), Indian (87%), Korean (65%), Vietnamese (74%), and Japanese (64%). This unique poll surveyed 2,391 respondents from diverse Asian ethnic groups: Chinese, Filipino, Indian, Korean, Vietnamese, and Japanese. Interviews were conducted in five languages, with all interviews completed in the language of preference of the respondents. The survey was sponsored by the AAPI Civic Engagement Fund, Service Employees International Union (SEIU), Asian Americans Advancing Justice-Los Angeles, Asian American Legal Defense and Education Fund, and the National Education Association (NEA). Asian Americans and Pacific Islanders are the fastest-growing racial group in the U.S., with a population of more than 21 million, and AAPIs are a growing electorate that is increasingly influential yet often ignored. By 2040, one in every ten Americans will be AAPI, and the number of voters will double to 12 million. The voting-age population of AAPIs already exceeds 10% in seven states, including California.
Advancing Justice-LA estimates that as of the November 2016 election, there were 1.8 million Asian American voters registered in the state (up more than 150,000 since 2012), including 502,000 Chinese Americans, 410,000 Filipino Americans, 271,000 Vietnamese Americans, 188,000 Indian Americans, 150,000 Korean Americans, and 117,000 Japanese Americans. Other highlights from the 2016 Asian American Election Eve Poll, including California-specific data: At the national level, 56% of Asian Americans now identify as Democrats, a marked jump from 49% in the same poll four years ago. In California, Asian American support for Clinton was higher than her national support, with 79% of Asian Americans supporting Clinton versus 13% for Trump. High numbers of Asian Americans in the state reported that Trump made them angry (72%) and afraid (64%). Asian Americans in California supported Kamala Harris for the open U.S. Senate seat at 69% (compared to 63% of all voters). On two high profile California propositions, 77% of Asian American voters surveyed supported Proposition 55 which extends an existing tax to fund public education (compared to 62% of all voters in California) and 80% of Asian Americans voted for Proposition 56 which imposes a $2 tax on tobacco products (compared to 63% of all voters). The poll highlights the pressing need for more Asian American voter outreach and civic engagement, as the community is too often overlooked by campaigns, political parties, and civic organizations alike.
The survey found that an incredible 57% of Asian American voters were not asked by any campaign, political party or organization to vote or to register to vote – and 84% of those who were reached were contacted in English. In addition, Asian Americans still face significant barriers at the polls. 67% of Asian Americans are immigrants born outside of the U.S., many of whom are first-time voters with limited English proficiency. Many are asked for additional voter identification, are segregated from other voters, and have to use polling locations without any available language assistance. In addition to revealing how Asian Americans voted in races for President, Senate, and Congress, the survey also revealed the issue priorities that influenced their voting decisions. national media exit poll numbers for Latinos and Asian Americans didn’t do it right and didn’t get it right. These exit polls show only 65% of Asian Americans voting for Clinton. Our poll — using representative sampling, multiple interview languages, and proper weighting — shows a more believable estimate of 76%.” “The election eve poll showed that education remains a high priority for Asian American voters, who overwhelmingly backed more federal support for our public schools – including when it comes to raising teacher pay, reducing class sizes, and repairing crumbling schools,” said Carrie Pugh, National Political Director of the National Education Association. “In California, Asian Americans also formed a key part of the coalition that passed Proposition 55, which extended tax increases on the rich to fund education and healthcare.” “I am encouraged by the results of the multilingual Asian American election eve poll,” said Luisa Blue, Executive Vice President of SEIU. “The AAPI community is the fastest-growing immigrant racial group in the country, and because SEIU represents over 110,000 unionized AAPI workers, we will continue to work with our AAPI members, community organizations, and community leaders to lift up the voices of AAPI workers and their families so their concerns and issues can be addressed.” “Roughly one out of every three Asian American voters nationwide lives in California – that’s 1.8 million Asian American voters in California alone,” said Dan Ichinose, Director of the Demographic Research Project at Asian Americans Advancing Justice - Los Angeles.

even with a voluntary return of the car, they would still owe about $12K. This is called the voluntary car return deficiency. What happens is that the dealer sells the returned car at wholesale and uses the proceeds to pay a portion of the car loan. Since clients still have 5 years on the car loan, at $600 a month, they owe $36K. The dealer anticipates selling the car for $24K at wholesale. The sale proceeds of $24K will be used to pay down the $36K, leaving a balance of $12. By contract, clients have agreed to pay $36K for the car, so they are still contractually liable for the unpaid difference of $12K even if the car has been returned. In addition, clients owe $40K of credit cards. They need $1200 a month for minimum monthly payments. Since client only gets $1,100 from social security. It’s a no brainer that they need to wipe out the $40K of credit cards as well as the $12K voluntary car return deficiency. Clients have further decided to buy a cheaper car where they will only pay about $200 a month or less on a lease. I told them to go ahead and get a smaller car, which is consistent with pre bankruptcy planning. Second client is 52. He owns a California S corporation, and has a residence that has $300K equity. His import distribution business was doing well since it started in 2002. But business turned south last year when gross sales went down by 30%. With a 30% sales reduction, the company is losing money. He obtained a $50K loan from bank, which required him to execute a personal guaranty for $50K. Company has not paid the loan for several months. Bank then sued the company and client on his personal guaranty last week. Since client has $300K of equity in his house, the non-exempt portion of the homestead equity is $200K. That’s a lot more than the $50K guaranty. Client does not qualify for Chapter 7 relief. However, Chapter 13 will provide relief in that client

MANILA, Nov. 17 (PNA) – The Philippine government will invest substantially in space technology development in the next 10 years, Department of Science and Technology (DOST) Secretary Fortunato Dela Pena said on Thursday. “How can we give our people early warnings when threatened by natural disasters? How can we make communities more resilient?” These are just among the country’s concerns that can be addressed through space technology, according to him. As such, the DOST has a National Space Development Program for 2016-2026. This will focus on key development areas such as national security and development, space research and development, hazard management and climate studies. The DOST is urging lawmakers
to have a bill approved for the creation of a National Space Agency. Dela Pena cited the lack of trained local experts in aerospace engineering and related fields, plus the country’s dependence on foreign satellites for data gathering, as the major challenges faced by the Philippine space development sector. To be globally competitive, Dela Pena said there has to be a conducive environment for aerospace companies willing to invest in the country. Also, there has to be a clear national space policy committed to space industry, and strong international linkages should be developed. For the agency’s long-term goals of strengthening its satellite development capacity and to create a robust space industry, Dela Pena said the DOST has allotted PHP1 billion for this program for 2017-2018. “Beyond 2018, it’s PHP2 billion,” he continued.

File Chapter 13 to make monthly debt payments more affordable If you are doing your best to pay your debts but simply do not have enough income to pay what your creditors are demanding from you, it may just be a matter of time before you face harsh collection actions. One legal option that most people don’t know about is debt consolidation through Chapter 13 of the bankruptcy code. It is not the same as Chapter 7 (wiping out debts) as I will explain in this article. You may have heard the term “debt consolidation” many times. A lot of people seem to get confused about the meaning of this term and in this article, I would like to clarify what it means as it relates to solving debt problems. First, there is the “debt consolidation” loan. This type of debt consolidation involves going to a bank or credit union and borrowing a sufficient amount to pay off all your existing debts so that you only have one debt payment to make each month. For some people, this may be a good idea if you are paying an interest rate on the loan that is lower than what you are paying on the debts you are consolidating. Apart from the convenience of writing just one check each month instead of ten when you are paying your bills, the obvious benefit here is the potential amount of money you are saving in interest charges over the long haul. While a consolidation loan may sound like a great idea, the truth is, often it will not resolve your financial hardship. The reason is that it is usually difficult to obtain a low interest rate on your consolidation loan unless you have an excellent credit rating and have something to offer the lender as collateral such
as equity in real estate or a car, for example. Lenders with less stringent credit requirements usually charge high interest rates; 21% or higher is not uncommon. And even when credit is excellent, often the interest rate is higher or close to what you are already paying on your other debts. Secondly, there is “debt consolidation” through a credit counseling agency. There are a handful of such agencies (usually non-profit) who help consumers consolidate bills by working out payment plans for a small fee each month. While this strategy might work in some cases where the monthly payment is affordable, it can only work if all of your creditors agree to your proposed payment plan. Another limitation is that there are certain debts that the agency cannot and will not handle such as IRS taxes, back mortgage payments, judgments or cases where the creditor has initiated a lawsuit or wage garnishment. Lastly, paying your debts through this type of debt consolidation will still be a negative on your credit report because it will be reported as “slow pay”. The type of debt consolidation we help people obtain is one that eligible individuals may do under Chapter 13 of the Bankruptcy Code. Done correctly, it is the best type of consolidation you will ever find.
Chapter 13 allows you to pay back all kinds of debts including the debts I have mentioned above that the credit counseling agencies cannot help you with. On credit card and a majority of your debts, you also pay 0% interest, allowing you to pay off what you owe much faster than any type of debt consolidation. The greatest benefit of consolidating through Chapter 13 is that you only pay based on what you can afford each month and it is possible to pay creditors only a very small portion of what you owe over a period of 3-5 years. And if you are facing foreclosure of your home, repossession of your car or other property, you can stop the creditor immediately from taking your property once you file for Chapter 13. Once your Chapter 13 payment plan is approved, creditors must accept it. The result: a reduced monthly debt payment which still allows you to live with the other expenses you have- rent or mortgage payments, food, clothing and transportation
expenses, etc. If your debt problems have caused you a lot of financial stress, Chapter 13 is often the most effective tool in getting your finances back in order in the shortest time possible because relief is immediate upon filing of the case. After seizure of 45 kilos of shabu, PNP chief pushes for death penalty MANILA, Nov 16 (Mabuhay) – Philippine National Police (PNP) chief Director General Ronald dela Rosa is pushing for the reimposition of death penalty after 45 kilograms of suspected metamphetamine hydrochloride or “shabu” worth P225 million were seized in a raid in Quezon City. “Kailangan natin ng death penalty talaga na batas dahil isipin mo sa dami ng namamatay hindi ba, natutumba, e nagdadala pa din sila ng ganito karami,” Dela Rosa said while conducting inspection on seized shabu late Tuesday afternoon. MANILA, Nov. 17 (PNA) – Finance Secretary Carlos Dominguez III on Thursday said the third-quarter Gross Domestic Product (GDP) growth of 7.1 percent puts the Duterte government on target of expanding the economy by at least 7 percent in the short and medium term to generate enough resources for its priority agenda of drastically reducing poverty and creating enough jobs for Filipinos. Dominguez said last quarter’s growth was apparently driven in part by the onset of the Duterte presidency’s strong spending on infrastructure and the recovery of the agriculture sector from the prolonged El Nino-induced drought, and means there will be no letup in its commitment to spend big on urban and rural infrastructure as a growth driver as well as on human capital and social protection, to guarantee sustained high and inclusive growth. He said the government needs to move quickly its fiscal reform package—topped by the proposed Comprehensive Tax Reform for Acceleration and Inclusion Act that the Department of Finance (DOF) already submitted to the Congress last September—to create enough buffer that would shield the economy plus the poor and other vulnerable sectors from the market volatilities mainly triggered by external factors. “To keep the economy on its high – and inclusive – growth path, the government will pursue with vigor its fiscal strategy of improving budget efficiency and transparency and reforming tax policy and administration,” Dominguez said, “as a way to raise the PHP1 trillion in additional annual investments that are needed in infrastructure, human capital and social protection to transform the Philippines into a high middle-income economy by 2022 and a high-income one by 2040.” “We need to raise sufficient revenues to (1) close the infrastructure gap that has for long undermined our economy’s global competitiveness, and (2) ensure the financial sustainability of our accelerated spending on human capital and social protection that are necessary to drastically reduce poverty and shield the poor and other vulnerable sectors from external shocks and the initial impact of the government’s reform agenda,” he said. Dominguez was reacting to today’s announcement by the National Economic and Development Authority (NEDA) that the GDP grew by 7.1 percent over the July-September 2016 period. According to NEDA, the figure, which covers the first three months of the Duterte administration, is higher than the GDP growth of 7.0 percent in the second quarter, and is an improvement on the 6.2 percent GDP growth recorded in the same period last year. Pernia said that compared to other major Asian emerging economies who have released their GDP figures, “the country recorded the fastest growth in the third quarter of 2016, trailed by China (6.7 percent), Vietnam (6.4 percent ), Indonesia (5.0 percent ), and Malaysia (4.3 percent).” NEDA director-general Ernesto Pernia said the “current quarter’s economic growth performance beats the market expectation of a 6.8 percent GDP growth and bolsters the likelihood of attaining the government’s target of 6.0 to 7.0 percent for the year.”

MANILA, Nov. 16 (PNA) – Malacañang clarified on Wednesday that President Rodrigo R. Duterte’s latest statement on martial law is just the Chief Executive’s way of creating public awareness and not a warning that martial law is imminent. During a dinner with media on Tuesday evening, President Duterte said: “I am not a fan of martial law. I am a lawyer. The people are afraid of martial law.” “But if ever, martial law is a contingency to meet widespread violence. Mindanao is in the state of rebellion,” President Duterte said. “The statement that he made really comes from the fact that he’s underlining awareness and necessary consciousness of the growing impunity, apparent impunities, especially in certain areas of Mindanao,” Presidential Spokesperson Ernesto Abella said during a press briefing in Malacañang. He said that the President’s statement likewise does not imply that the declaration of martial law is imminent. “There are two reasons for that (martial law), invasion or rebellion. The President is just elevating awareness of the growing impunity, especially in certain areas of Mindanao where certain terror groups are
actually threatening to enter Cebu, the Visayas,” he said. “So, basically what he is doing is that should this escalate and the conditions are set, then he could. But this is simply a warning and that it is just a possibility,” Abella said. He said the same holds with the President’s earlier statement on the suspension of the writ of habeas corpus. “Basically, it is the same. He was elevating awareness regarding some of the actions of terrorist groups, basically lawless elements. However, he is saying that they should not continue in the same vein because if and when they do that and should they enter into conditions that, you know, that they qualified to rebellion, then he could exercise suspension of the writ of habeas corpus,” he said. The Presidential Spokesperson, however, stressed that even if conditions were met, certain processes would still have to be followed before martial law or the suspension of the writ of habeas corpus could be declared. “We need to understand the leadership style of the President. He creates awareness; that is his manner of leadership. So I think we should need to be able to take that in stride,” Abella said.
SWS survey: Gov’t under Duterte gets ‘very good’ satisfaction rating By Janice M. Cave
MANILA, Nov. 17 (PNA) – Pres. Rodrigo Duterte’s administration earned a “very good” net satisfaction rating from the public, the latest Social Weather Stations survey show. The survey results first reported in BusinessWorld showed that the public gave the government a +66 net satisfaction rating which the independent pollster classifies as “very good.” The government earned high marks on its campaign against illegal drugs with an “excellent” rating (85 percent satisfied, seven percent dissatisfied and seven percent undecided) and “very good” in the promotion of human rights (74 percent satisfied, 11 percent dissatisfied and 15 percent undecided). This, despite criticisms from the United States, the European Union, and the United Nations on the administration’s staunch campaign against illegal drugs. The survey, conducted from Sept. 24-27 nationwide, noted that for the first three months of the Duterte administration, the
public scored “very good” in eight subjects and “good” in eight others. The Duterte administration’s net satisfaction level bested maiden scores of predecessors, except that under former president Benigno Aquino III who also got a “very good” +64 rating. Secretary De Lima: My reputation, record as public official speak for itself MANILA, Nov 15 (Mabuhay) – Embattled Senator Leila de Lima on Tuesday said her reputation and record as a public official can speak for itself, following Justice Secretary Vitaliano Aguirre II’s statement that he will use the senator’s admission of her romantic affair with her former driver against her. “Ito lang masasagot ko, my record as a public official first as CHR chair and next as secretary of Justice, speaks for itself,” De Lima said, as she initially refused to answer questions from the media about her romantic affair with her former driver, Ronnie Dayan. “My reputation has been untarnished until now when
it’s being unfairly and unjustly besmirched by all of these fabricated lies about my alleged invovlement in the drug trade,” she added. Up until the television interview which aired on GMA News TV’s “Bawal ang Pasaway with Mareng Winnie” on Monday night, De Lima had neither confirmed nor denied her special relationship with Dayan, which the senator said lasted for a “few years.” De Lima described her involvement with her driver as “frailties of a woman.” The senator had been accused of receiving payoffs from drug lords inside the New Bilibid Prison (NBP) through Dayan, among others.
Aguirre, in a text message, said De Lima’s admission of a romantic affair with Dayan has bolstered the Department of Justice (DOJ) to pin her down on the proliferation of illegal drugs. “Malaki kasi sa pag-amin niya, the probability na talagang ginamit niya si Dayan sa pagkolekta ng pera sa NBP ay naging lalong kapani-paniwala,” Aguirre said. Undocumented Pinoys face possible deportation next year Thousands of undocumented Filipino immigrants may face possible expulsion from the United States should President elect Donald Trump fulfill his campaign promise to deport those who are staying illegally once he steps into the White House next year. There are nearly 300,000 undocumented Filipinos all over the United States working without legal immigration status.I hope the Trump administration will find a more humane solutions to address illegal immigration in America without resorting to deporting the undocumented, especially children who have gotten used to the American way of life. The deportation of undocumented immigrants and the building of a wall along the U.S-Mexico border were the central piece of Trump’s campaign. He also vowed to deport those with criminal records immediately. Based on latest rumors coming out from Capitol Hill, Trump’s immigration advisers are said to be pushing for him to step up immigration enforcement against some 11 million undocumented immigrants in the US. There were talks about creating a deportation task force from within the immigration and customs enforcement agencies that will oversee the deportation proceedings. Many of Trump’s supporters are even suggesting that he should find a way to overturn President Obama’s Executive Action that granted temporary clemency and work permits to some 700,000 undocumented immigrants who came to the United States hoping for a brighter future.
The incoming Trump administration is expected to draft laws to help the U.S. government pursue legal actions to crack down and stop the flow of illegal immigration in America. Trump made it clear to everybody, even during the early days of his campaign period, that he is against amnesty for undocumented immigrants. This early though, Trump’s campaign promise to crack down on undocumented immigrants are facing stiff opposition from Hispanics and civil rights groups. Even New York City Mayor Bill de Blasio appears to be sympathetic to thousands of undocumented immigrants in his city. He disclosed recently in the media that the city’s database that contains the identities of 850,000 who are staying here illegally will not be made available to President elect Trump, unless ordered to do so by the court. Trump’s anti illegal immigration campaign is also expected to encounter rough sailing here in California, where a large number of Hispanics reside. In Los Angeles alone, 45 per cent of the people who reside in the city are Hispanics. So it was not a surprise that LAPD Chief Charlie Beck told the media that his police force will begin to distance itself from federal immigration policies that civil
rights groups are claiming to be unfair against undocumented immigrants. Beck said undocumented immigrants arrested by the police in Los Angeles will no longer be turned over to federal authorities for possible deportation to build trust and cooperation from the Hispanic communities as well as to preserve peace in the metropolis. I’m sure Mayor De Blasio, Police Chief Beck and other civil rights groups sympathetic to undocumented residents here will face severe criticism for being soft on the rule of law and its effort to curb illegal immigration in the country. *** Ombudsman Conchita Morales Carpio is being lambasted by several lawmakers for refusing to investigate and file charges against Senator Leila de Lima for her alleged involvement in the proliferation of illegal drugs in the country. Ombudsman Carpio should show her impartiality in this particular case. Never mind if Senator De Lima is her close friend as what she has told the media recently. The rule of law should be implemented without compromise. Carpio should make De Lima’s case a priority rather than spend her energy trying to pin down PNP Chief Ronald de la Rosa for allegedly accepting gifts from Senator Manny Pacquiao, when the top cop and his family went to Las Vegas to watch the Pacquiao-Jessie Vargas fight recently. If I were Ombudsman Carpio, I will initiate an immediate investigation on De Lima if only to thwart threats
of possible impeachment proceedings against her. I will not be surprised if one of these days, an ally of President Duterte in Congress will initiate impeachment proceedings against Carpio if she continues to dilly dally on her decision to prosecute De Lima. The evidence linking Senator De Lima is mounting every day and it is very clear based on the affidavits and testimonies of witnesses that she may have coddled big time drugs lords in the New Bilibid Prisons (NBP) during her incumbency as Justice Secretary during the Aquino administration. The expected testimony of Kevin Espinosa, the alleged drug lord in the Eastern Visayas region and son of slain Albuera Leyte Mayor Rolando Espinosa, is expected to help in unmask De Lima as a drug coddler. The Justice department will now be able to tighten its noose on the neck of De Lima with the availability of transaction of certain accounts linked to illegal drugs trade inside the NBP during De Lima term as Justice Secretary. Central Bank and the Anti Money Laundering Council (AMLC) have been adamant in providing the government records related to bank accounts of De Lima as well as her dummy accounts worth millions of pesos. It must have stung officials from Central Bank and AMLC when Duterte told them in his speech on the occasion of the anniversary of the NBI that they are part of garbage who are protecting someone who is into money laundering.

MANILA, Nov. 16 (PNA) – Justice Secretary Vitaliano Aguirre II said on Wednesday the DOJ does not need the testimonies of alleged drug lord Kerwin Espinosa and Senator Leila de Lima’s driver/bodyguard Ronnie Dayan to implicate the lady lawmaker for her alleged involvement in the illegal drugs trade. “Actually, even without Dayan’s testimony, even without Kerwin’s testimony, we already have more than sufficient testimonial evidence to implicate her. I think it is very strong, especially now that Senator De Lima admitted her illicit relationship with Ronnie Dayan.” Aguirre said during a press briefing in Malacañang. However, Aguirre said that considering that the government is building an airtight case against
the former Justice secretary, every single additional evidence would be welcomed. “We welcome everybody willing to help government punish high ranking government officials involved in the illegal drug trade. That is why we are offering the protection of the Witness Protection Program (WPP) to Espinosa and even to Dayan, as long as they are cooperative and will be qualified to be admitted under our WPP,” he said. Aguirre said that he had already written to Philippine National Police (PNP) chief Director General Ronaldo dela Rosa that the DOJ, through the National Bureau of Investigation (NBI), is willing to assist the PNP in protecting and investigating Espinosa in the event that the latter is repatriated in the country from the United Arab Emirates.
Dela Rosa had earlier said that Espinosa is set to arrive in the country on Thursday after a police team fetched him from the Wadha Jail in Abu Dhabi. Kerwin, the alleged top drug lord in Eastern Visayas, was arrested in Abu Dhabi last Oct. 17 by local police officials after being tipped-off by overseas Filipino workers. According to Aguirre, the suspected drug lord has expressed his intention to enter the WPP because of fears for his life and his family after being informed of the killing of his father, Albuera, Leyte Mayor Rolando Espinosa Sr. in a Leyte Jail last Nov. 5.The younger Espinosa also expressed his willingness to execute a sworn affidavit and reveal everything he knows about the illegal drug operation in the Philippines. Dayan went into hiding after the House of Representatives issued an arrest warrant against him for failure to attend congressional hearings on the New Bilibid Prison drug operations. But I hope that with the PHP1-million reward, we will get him,” he said. Your home is your retirement and go to piggy bank The initial good news for home-equity wealth building — particularly for those who have managed to hold onto their homes — is that in most of the country prices have generally recovered since the 2008 financial crisis. With the hope of the new government’s promises of Jobs creation, we hope that the Real Estate Market/ Values will slowly but surely continue to appreciate. But building home equity will largely depend on where you live, when you bought your home and if you tap that equity for retirement income. The wide regional differences in home appreciation are worth noting for those still trying to use real estate to increase their nest egg. Homeowners always turn to their home equity for home improvement needs, college tuition, and excessive credit card debts and for retirement income. Homeowners who have been in their homes the longest will probably see the greatest increase in home equity.Homeowners 62 years and older now have more equity in their homes than at any time since early 2008. Home equity held by persons 62 and older has grown by more than 22 percent since the second quarter 2012, to a total of $3.73 trillion. Everyone knows if you had bought a property after 2010 for sure your value has appreciated substantially. Thisalso means that if you’re an older, longtime homeowner, you’ve probably regained the equity you lost during the housing bust of 2007-9. You may be able to tap that equity for retirement or other purposes through a loan, refinancing or downsizing. In most areas property values has surpassed the 2007-09 prices and some area prices have actually gone higher.
Yet is home equity a reliable piggy bank? Home equity creation used to be seen as a forced savings plan. Whatever you invested in mortgage principal appreciated roughly at the rate of inflation. And we should treat it like that again now. The housing credit crisis changed that perception for several generations of Americans. The bust devastated home prices in some of the most desirable areas — Arizona, California, Florida and Nevada. The tide may have turned, though. Demographic changes in society — especially baby boomers downsizing or moving to warmer places — mean some coastal areas may once again prove to be good locations for building home equity, especially if building is restricted or climate change policies make development more expensive. We most definitely have the warm area pinned down. Some of the most robust growth projections for housing appreciation are for the coasts. According to the Local Market Monitor, which tracks housing prices in more than 300 markets in the United States, California had the best performance over the last 20 years and is projected to grow a cumulative 30 percent over the next three years. Despite high taxes and the state’s well-publicized budget and water woes, demand is still strong for the
Bay Area and parts of Southern California. Technology start-ups and mature businesses want to be around Silicon Valley and Stanford University. And the Los Angeles area is a cultural and business mecca. The key to home equity growth is a combination of strong local economies, building and jobs. People have to find an area desirable and want to move there from other places — the kind of mobility that virtually came to a standstill during the recession years. And as land for development becomes scarcer and demand grows for new retirement housing, home prices will benefit. Those markets with the best expected home price appreciation have strong economies that attract in-migration. Its population growth from migration that has the strongest effect on home prices, especially now. Los Angeles is not running far behind Northern California High Tech communities, with the Football Stadium in Inglewood and the Mega Outlet in the City of Industry in the books, our city will be fostering jobs for the guaranteed next few years. Other regions will not be as fortunate as retirees move to warmer locations with lower living costs. Because housing prices have proved to be volatile — and may not return what they did in the past — you may be better off concentrating on financial assets. As the financial crisis demonstrated, home appreciation is far from guaranteed. Areas can be overbuilt, and speculators can drive up prices with cheap financing. As I have mentioned long time ago, moving out of the area just to be able to buy a house or an investment have to be seriously considered.

While reverse mortgages can be complex and expensive — they leverage equity for current cash needs — homeowners can also get access to home equity through a “cash out” sale, selling their home and buying or renting a less expensive dwelling. Caregiver overtime law becomes permanent In September Governor Jerry Brown signed SB 1015 into law. This law is critically important because it permanently guarantees caregivers the right to overtime compensation. Originally, the Domestic Worker Bill of Rights (DWBR), which guarantees overtime pay for in-home caregivers, was set to expire on January 1, 2017. Under the DWBR, in-home caregivers must be paid overtime compensation when working more than 9 hours a day or 45 hours a week. In my experience, very few 24-hour caregivers are paid correctly. With California’s increase in the minimum wage to $10 an hour, non-exempt caregivers who work 24-hour shifts must be paid a minimum of $315 a day. If you are working as a caregiver and paid a day rate less than $315, under California law, you are not being paid any overtime and may have a substantial unpaid overtime claim.
Often, employers attempt to avoid overtime liability by claiming the caregiver is an “independent contractor.” However, the DWBR defines in-home caregivers and personal attendants as domestic work employees, meaning that employers cannot lawfully classify them as independent contractors. Therefore, the law will likely invalidate any agreement that wrongfully classifies an inhome caregiver as an independent contractor. The change in the overtime rules for caregivers first became effective on January 1, 2014, when the DWBR became law. Previously, employees

who worked in a private household and qualified as “personal attendants,” including caregivers and nannies, did not qualify for overtime. The DWBR eliminated the overtime exemption for personal attendants and provides that personal attendants “shall not be employed more than nine hours in any workday or more than 45 hours in any workweek unless the employee receives one and one-half times the employee’s regular rate of pay for all hours worked over nine hours in any workday and for all hours worked more than 45 hours in the workweek.” This means that now caregivers, nannies and babysitters (with limited exceptions) must be paid overtime compensation. Unfortunately, this law does not cover workers for In-Home Supportive Services (IHSS) and those caring for close family members. Under Labor Code § 1194, caregivers are not only able to recover their unpaid overtime in a civil action, but they also may recover

reasonable attorney’s fees, costs and interest. California law also provides for severe penalties to workers who are not properly paid overtime compensation. If you are working as a caregiver and you are not paid overtime compensation when working more than nine hours a day, or 45 hours a week, you should consult with an attorney to discuss your rights under this law. With the penalties, interest and attorneys fees allowed, claims often exceed $100,000 for 24hour caregivers who have worked one year. High possibility of another 7.0 magnitude earthquake in New Zealand’ MOSCOW, Nov 15 (PNA/Sputnik) – New Zealand was hit by a 7.8 magnitude earthquake early on Monday, living two people dead. There have also been hundreds of strong aftershocks, triggering tsunami warnings in some parts of the country. Dave Greenberg, an emergency management consultant, told Radio Sputnik that another powerful tremor could strike New Zealand in the coming weeks. Greenberg was in the capital of New Zealand when the earthquake struck. “I am in Wellington, which is at the bottom of the North Island, probably around 80 or 100 miles north of where the epicenter was. Just after midnight, about 23 hours ago
there was a huge shake that lasted for about two minutes,” he recalled. “It was certainly the worst quake I’ve ever felt in my 27 years in New Zealand. It caused some damage in Wellington, but as daylight came it became apparent that there was a lot of damage on the South Island.” Greenberg, who served as a crewman on the Wellington Westpac Rescue Helicopter from March 1991 to May 2016, said that the aftershocks could last for months. “I spent 25 years on a rescue helicopter and I responded down to the Christchurch earthquakes in February 2011. Those aftershocks went on for months and months. We are still getting occasional ones from them.

Hontiveros to LGUs: Respect and fully implement RH law
PASAY CITY - Akbayan Senator Risa Hontiveros on Tuesday called on the local government of Sorsogon City to respect the full implementation of the Responsible Parenthood and Reproductive Health Act (Republic Act 10354), also known as the RH Law, after a Commission on Human Rights (CHR) report indicated that it withheld artificial contraceptives from women residents in the last four years. “Sorsogon City Mayor Sally Lee, who is otherwise known as an advocate of women’s participation in societal affairs, should immediately answer the serious allegations made by the CHR. Withholding artificial contraceptives from women is an insult to the hard work of Filipino women’s movement who waited 13 long years for the passage of the RH Law,” Hontiveros said. Hontiveros, who is the Chair of the Senate Committee on Health and Demography, said that the RH Law
is a landmark piece of legislation that solidified reproductive health rights and choices. “The government must provide free access to family planning commodities to poor women nationwide to help address the country’s high maternal mortality rate. Our women should be given the widest array of options on how to plan and manage their families. Withholding access to contraceptives is a clear violation of the law,” Sen. Hontiveros said. It was reported that the CHR has documented reports that women in far-flung barangays in Sorsogon City were denied reproductive health products and services. The documentation likewise reported of unwanted pregnancies and instances that women gave up their babies for adoption as a result of the denial of H services. “We want the Sorsogon City government to explain and be accountable to these alleged violations. It is our moral and civil obligation to

Health dept. confirms 16-year-old pregnant woman has Zika By Leilani S. Junio MANILA, Nov. 16 (PNA) – The Department of Health (DOH) confirmed Wednesday that there are now two cases of pregnant women with Zika virus in the country. The first case was confirmed last September while the second case, a 16-year-old woman, is among the 10 new Zika cases reported by the health department on Tuesday. The confirmation was made by DOH spokesperson Dr. Eric Tayag in his Twitter account, citing that “Dr.
Pau (Health Secretary Dr. Paulyn Ubial) confirms second pregnant with Zika, 16-year-old from Las Piñas City.” Tayag said the woman has manifested skin rashes and fever. Confirmatory tests showed she is positive with Zika virus infection. The woman is in her 32nd week or 8th month of pregnancy. In the twit, Tayag also said that she has not undergone an ultrasound examination. The confirmation was done in coordination with the City Health
Office of Las Piñas, which provided the details on the suspected and confirmed cases. While there were early speculations ahead of the confirmation, the health department preferred to have the full results of the tests before disclosing it to the public. The first pregnant woman reported to have caught the Zika virus was diagnosed in Cebu. Succeeding tests taken as part of monitoring her condition revealed that she was negative of the disease
or considered “healed” of the infection. The DOH had committed to monitor the condition of the pregnant woman in Cebu through regular check-ups and ultrasound. So far, two ultrasound tests showed that the baby is “normal”. Meanwhile, the health department has reiterated its call to the public to be proactive in destroying the breeding places of mosquitoes and in keeping the environment “mosquito free”.

FBI releases 2015 hate crime statistics
November 14, 2016 – Today the FBI released Hate Crime Statistics, 2015, the Uniform Crime Reporting (UCR) Program’s latest compilation about bias-motivated incidents throughout the nation. This year’s collection marks the 25th anniversary of the FBI gathering and publishing data about bias-motivated crimes. The first publication in 1990 included limited data from only 11 states. The collection has grown each year into the wide-ranging report presented today. Submitted by 14,997 law enforcement agencies across the nation, the 2015 data provide information about the offenses, victims, offenders, and locations of hate crimes; however, the UCR Program does not estimate offenses for the jurisdictions of agencies that do not submit reports. Highlights of Hate Crime Statistics, 2015, follow. Law enforcement agencies submitted incident reports involving 5,850 criminal incidents and 6,885 related offenses as being motivated by bias toward race, ethnicity, ancestry, religion, sexual orientation, disability, gender, and gender identity in 2015. Victims of Hate Crime Incidents
There were 5,818 single-bias incidents involving 7,121 victims. A percent distribution of victims by bias type showed that 59.2 percent of victims were targeted because of the offenders’ race/ethnicity/ancestry bias, 19.7 percent were targeted because of the offenders’ religious bias, and 17.7 percent were victimized because of the offenders’ sexual-orientation bias. Victims targeted because of the offenders’ bias against gender identity accounted for 1.7 percent of victims of single-bias incidents; disabilities, 1.2 percent; and gender, 0.4 percent. (Due to rounding, percentage breakdowns may not add to 100.0 percent.) Thirty-two multiple-bias hate crime incidents involved 52 victims. Offenses by Crime Category Of the 4,482 hate crime offenses classified as crimes against persons in 2015, intimidation accounted for 41.3 percent, simple assault accounted for 37.8 percent, and aggravated assault for 19.7 percent. Eighteen murders and 13 rapes (12 from agencies that collected data using the revised definition of rape) were reported as hate crimes.
Beginning with the 2013 data collection, the UCR Program’s revised definition of rape is “penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.” [This includes the offenses of rape, sodomy, and sexual assault with an object as converted from data submitted via the National Incident-Based Reporting System (NIBRS). The UCR Program’s legacy definition of rape is “The carnal knowledge of a female forcibly and against her will.” There were 2,338 hate crime offenses classified as crimes against property. The majority of these (72.6 percent) were acts of destruction/ damage/vandalism. Robbery, burglary, larceny-theft, motor vehicle theft, arson, and other offenses accounted for the remaining 27.4 percent of crimes against property. Sixty-five additional offenses were classified as crimes against society, which were collected via NIBRS. This crime category represents society’s prohibition against engaging in certain

types of activity such as gambling, prostitution, and drug violations. These are typically victimless crimes in which property is not the object. Known Offenders In the UCR Program, the term known offender does not imply that the suspect’s identity is known; rather, the term indicates that some aspect of the suspect was identified, thus distinguishing the suspect from an unknown offender. Law enforcement agencies specify the number of offenders and, when possible, the race of the offender or offenders as a group. Beginning in 2013, law enforcement officers could also report whether suspects were juveniles or adults, as well as the suspect’s ethnicity when possible. Of the 5,493 known offenders, 48.4 percent were white, and 24.3 percent were black or African-American. The race was unknown for 16.2 percent. Other races accounted for the remaining known offenders: 1.0 percent were Asian; 0.9 percent were American Indian or Alaska Native; 0.1 percent were Native Hawaiian or Other Pacific Islander; and 9.1 percent were of a group of multiple races.
‘With Child’ vies for Indie spirit award in AFI film fest By Abner Galino
“With Child”, I find out quickly, is not an idiom to say pregnant but a literal description of a widowed construction worker who had to bring his four-month-old daughter into his workplace and everywhere else. That “child” is Riley – left to the care of his construction worker dad Auden Price (played by Kerry van der Griend) when her mom died. The child (not the character) is actually an offspring of one of the production staff. And this was revealed by Leslie Lewis, one of the film’s producers and leading actors, to the audience after the film’s screening at the Louis B. Mayer Library Building of the American Film Institute (AFI) in Los Angeles. With Child is vying for the Indie Spirit Award in the ongoing AFI festival (November 10-17, 2016). There is no roller coaster of emotions in With Child. But the string of charming scenes and funny one-liners would certainly keep the audience’s enthusiasm. The storyline is familiar: the lead guy Auden Price, a widowed
construction worker, fights to keep daughter’s custody from a sisterin-law who thinks the man couldn’t take care of the infant because of his circumstances. The twist in the story came when Petra (played by Leslie Lewis), a queer physics university professor, inserted herself into the situation – first, by employing Auden to renovate her basement and later on, by starting a romance with the grieving father. Well, this must have been something true about Canadians, but it indeed strikes me that everyone in the film seems to be all well-mannered. Even Karen, the sister-in-law who is fighting for the custody of Riley, hardly shows any hostility. The movie has no villain to speak of and revolves simply on an unfortunate and challenging situation to draw out the emotions. I am not saying that the movie is uninteresting to watch. On the contrary, the movie has enough charm to keep a viewer waiting for things to happen. I don’t know why. This is probably

because one would care to see what would happen to the child, or to the budding romance or the desire to hear and see more humor. Most of the laugh lines are not funny, but are quirky, sarcasm-loaded jokes that tickle the cerebral. Kerry and Leslie deserve praise for great acting and excellent deliveries, mostly in deadpan fashion, of those funny one-liners. My LOL moment came when Auden, in an apparent effort to find emotional stability, went on an internet search for “porn for the bereaved.” Of course, the movie doesn’t want to say something about porn other than generate laughs. But in my mind, I was saying: Of course, porn isn’t totally useless. In another instance, Auden brought Riley to a bar and she instantly turned into a magnet to ladies. A charming scene, but I’m not sure if one could really bring in a four-month-old child into a Canadian nightclub. Well, if they allow that, at least those bars should be smoke-free. But on second thought; has Riley been in
an active construction site previously? Oh yes, I think so. No courtroom drama in this movie, just one scene where Auden consults a lawyer who tells him that he would likely win his case. So there. The 87-minute “With Child” is available in DVDs, which Leslie showed me during a quite brief interview. By the way, Leslie Lewis is a daughter of a prominent Filipino lawyer-businesswoman-philanthropist-community leader Loida Nicolas Lewis, the same woman who has just denied that is part of a “plot” to oust Philippine President Rodrigo Duterte. The movie is produced about three years ago by the With Child Productions. It was written and directed by Titus Heckel. The cast includes: Lori Kokotailo, Michael Soltis and Beau Heaton. The producers are Shannon Braithwaite, Titus Heckel and Leslie Lewis. The executive producers are Loida Nicolas Lewis and Gavin Sword.

The 2017 Civic Si Coupe and Si Sedan will be powered by a high-performance, high-torque 1.5-liter, directed-injected and turbocharged DOHC in-line 4-cylinder engine with dual variable cam timing (dual VTC) mated to a short-shifting 6-speed manual transmission. Additional performance upgrades for the Si variants will include a new active damper system, active steering system, lim-
ited-slip differential and available high-performance tires. “With the new Honda Civic Si, we’re injecting even more sporty goodness into our 10th-generation Civic lineup,” said Jeff Conrad, senior vice president and general manager of Honda. “This will be, hands down, the fastest, best-handling Si we’ve ever offered to our customers.” The Civic Si Prototype interior closely previews the production model and features Si-exclusive front sport seats with red stitching, including stitched Si logos. The red sport stitching carries through to the doors, steering wheel and leather shift boot with aluminum shift knob. The Si Prototype interior also features a red driver’s TFT meter and audio system illumination, aluminum sport pedals and Dry Metal Carbon instrument panel trim. The Civic Si Coupe and Si Sedan will launch next year as the latest additions to the 10th-generation
Honda Civic lineup, joining the Civic Sedan, Civic Coupe and just-launched Civic Hatchback. The rollout of the 10th-gen Civic lineup will be completed with the launch of the new trackready Civic Type-R next year. The 2016 Civic Sedan was named North American Car of the Year at the North American International Auto Show in January. Civic is the best-selling car with individual American car buyers in 2016 and is on track to post the highest U.S. sales in its 44-year history, with sales up 11.7 percent to 310,142 units through the end of October.
