MANILA, Oct. 19 (PNA) – President Rodrigo Duterte has clarified that he is not breaking away from the Philippines’ old ally United States. ”The basic question of the Filipinos – I know what’s in their mind, why is Duterte breaking away from the United States? A former Hollywood actress-turned-community activist was recently honored by the Los Angeles County Board of Supervisors for her “immeasurable contributions to the Filipino American community.” Aquilina Soriano Versoza, who played a notable role in a comedy film “Troop Beverly Hills” in 1989, was presented a plaque on Tuesday (October 18) during an LA Board of Supervisors’Scroll of Recognition in honor of the Filipino American history month. “I am so honored and so proud that I received the award with the members and leaders of my organization. It inspires me to more, to foster a really strong voice for the Filipino American community,” Versoza told Weekend Balita/US Asian Post.Versoza said it was the first time she was ever recognized by a government body. “And it really felt good,” she added. Gabriela, Pesante denounce Manila’s violent dispersal By Abner Galino
At least two US-based organizations, particularly here in Los Angeles, have denounced the violent dispersal of protesters in front of the US Embassy in Manila last October 18. “We demand a fair and thorough investigation of the incident and accountability from commanding officer, Col. Marcelino Pedrozo and the driver of the PNP mobile van, police officer Franklin Kho for this crime against national minorities. Although the PNP will assert their dominance with violence, the national minorities will continue to resist and assert their rights for land, rights, and just peace,” GABRIELA Los Angeles said in a statement. The women’s rights organization claimed that Col. Pedrozo “ordered the violent dispersal despite being told that the rally was coming to an end.” On the other hand, Gabriela LA, noted that policeman Kho “deliberately and repeatedly drive into the ranks of human rights defenders indiscriminately, without any regard for life.” The organization added that “indigenous and Moro peoples were protesting against U.S. militarization that destroys their ancestral lands, communities, and schools. “The human rights defenders were also demonstrating in support ofPresident Rodrigo Duterte’s call for independent foreign policy in the Philippines which would put an end to US occupation.” Piya Argee, chairperson for Katribu, was among the human rights
defenders injured in the brazen act of violence. As the medical team attempted to provide her and others with medical attention, the PNP began threatening to illegally detain everyone, including the first responders at the scene. Argee was part of a delegation of Lumad community leaders who conducted a speaking tour in the US last April. The group spoke about alleged “intensifying violence against national minorities, as U.S. neo-colonial economic policies impoverish the Philippines, foreign multinational corporations plunder their ancestral lands and resources, and military and paramilitary groups increase their state-sponsored attacks.” Meanwhile, the Philippine Peasant Support Network (PESANTE-USA) based in the United States also expressed its indignation over the violent dispersal in front of the US Embassy in Manila. In a statement, PESANTE noted that the incident in front of the US Embassy in Manila was the second attack on the members SANDUGO, a coalition of ethnic communities protesting alleged militarization in their ancestral lands. The protesters were first attacked with water hoses by authorities while demonstrating in front of Camp Emilio Aguinaldo, AFP Headquarters in Quezon City. “The Duterte regime although it made scathing remarks against US policies must prove that it’s not all words but concrete actions,” PESANTE USA said.

Duterte: ‘Dead or alive’ reward system taken from Americans BEIJING, Oct 20 (Mabuhay) – President Rodrigo Duterte said the idea of implementing the “dead or alive” reward system was from the Americans. During a meeting with the Filipino community at a hotel on Wangfujing Street in China’s capital, Duterte once again lashed out at the critics of his war on drugs and his manner of speaking, which they believe incite violence and encourage extrajudicial killings. The President defended the law enforcement procedures implemented amid his war on drugs, which resulted in deaths of over 1,000 drug suspects. He said the police know the rules of engagement. But he underscored that some of the law enforcement practices were
taken from western influences. “Iyang reward, dead or alive. It is not even ours. It is not a language of the Filipinos. Sinong nagturo niyan? The Americans? Where? Iyong mga cowboy nila. Billy the Kid, dead or alive, oh 50 dollars,” Duterte claimed as he criticized the United States once again. “Ang problema nitong Amerikano, kung sila ang gumamit niyan, persons of interest which are actually you are being hunted and if you offer a resistance just like the bomber, they will kill you. And when we use it because we’re not Americans and they want us to be more inferior than them, they will hunt for you and threaten you with an international court, criminal court, justice,” the President said.

After a debtor receives a discharge in bankruptcy, creditors whose debts are discharged are required to report that the account has a zero balance. The fact of the filing itself can remain on the credit report for 10 years from the date it was filed. A debtor interested in re-establishing credit after bankruptcy should obtain credit reports from the 3 largest credit reporting agencies, (Experian, Equifax, and Trans Union) and ensure that the account balances have all been zeroed out. If not, the debtor should contact the credit reporting agencies and ask that the record be corrected Methods of Re-Establishing Credit A debtor seeking to re-establish credit should consider applying for a secured card, usually a Visa or Master Card. This is a credit card issued by a bank to a customer who is required to establish a savings account at the bank, which is used as security or collateral for the card. Typically, the limit on the card is based on the amount of collateral put up in the form of the savings account. Often, the bank will have an annual fee. The benefit of the secured card is that banks will issue them to persons with poor credit reports in the past, but who have the ability to pay the deposit to secure the account. Major store cards are also a good addition to building credit. Once you have a major credit card, even a secured card, itâ&#x20AC;&#x2122;s usually all thatâ&#x20AC;&#x2122;s required to open an account at a major store, such as JCP, Kohls, etc. Other methods include buying a car from a local car dealer who advertises that it specializes in making car loans to persons with bad credit or recent bankruptcies. Also, a debtor with a personal relationship with someone at a local bank should not hesitate to seek assistance from that source. There are also financial institutions that target recent bankruptcy people seeking credit. This also includes mortgage companies. Several major companies will consider a mortgage within 1 to 2 years from the bankruptcy discharge. The reason these companies are interested in bankruptcy discharge consumers, is because they cannot file a bankruptcy again for 8 years, do not owe money, have a good debt to income ratio (Income from employment, all debts discharged in bankruptcy), and finally, they get to charge more than regular financial institutions. Bottom line â&#x20AC;&#x201C; itâ&#x20AC;&#x2122;s a business, and a good business at that. Caution in Rebuilding Credit Ultimately, however, debtors emerging from bankruptcy should use their experience to avoid getting into the same financial traps, which snared them before. All too often, this was the easy availability of unsecured credit in the form of unsolicited, pre-approved, credit cards. Debtors should take steps to budget properly, not spend beyond their means, and resist the temptation to incur debt beyond their reasonable ability to repay just for the purpose of re-establishing credit. Debtors should avoid being enticed by so-called â&#x20AC;&#x153;credit repairâ&#x20AC;? agencies. These are often simply unregulated rip-offs, who prey on the financially-distressed, and who do nothing more than what debtors themselves can do by exercising their legal right to have their reports properly list their outstanding obligations. Income Taxes in Bankruptcy As a general proposition, older
income taxes (more than 3 years old) can be wiped out in bankruptcy; newer income taxes (less than 3 years old) cannot. A debtor/employer can wipe out the employerâ&#x20AC;&#x2122;s portion of older, but not newer, payroll taxes. The discharge ability of state and local, such as sales and use taxes, will depend upon their true nature, i.e., whether they are excise or withholding taxes. The trust fund portion of payroll taxes is generally not dischargeable. Prior to filing bankruptcy, the debtor should have his own particular tax situation assessed. Test for Wiping Out Income Taxes; â&#x20AC;˘ The Test for wiping out income taxes in bankruptcy include: â&#x20AC;˘ The tax return was due more than 3 years prior to the filing â&#x20AC;˘ The tax return was filed at least 2 years prior to the filing â&#x20AC;˘ The tax has been assessed for at least 240 days prior to the filing â&#x20AC;˘ The tax is not based on a fraudulent return â&#x20AC;˘ There was no willful tax evasion by the debtor. In Chapter 13, income taxes can be wiped out if the return was due more than 3 years prior to the filing, and was assessed at least 240 days prior to the filing. In some cases, the tax may be dischargeable even if not assessed prior to the filing. Income Tax Liability Under the Internal Revenue Code, as a general rule, forgiveness of indebtedness constitutes income to the debtor. However, there is an exception where the debtor receives a discharge in bankruptcy. Can Utility Debts Be Discharged in bankruptcy? Public utilities, such as the gas and electric company, are not permitted to discontinue service because of a bankruptcy filing. However, if the utility bill is included in the bankruptcy and not paid, then the utility has the right to demand that the debtor pay a deposit within 20 days to ensure the continuation of service. Sometimes, the requested deposit is several times the amount of the bill, so it often makes sense for a cashstrapped debtor to simply pay the bill. Utility bills for service arising after the bankruptcy filing is not included in the bankruptcy, and must be paid. Does the Bankruptcy Code prohibit discrimination based on a bankruptcy filing? The Bankruptcy Code contains an â&#x20AC;&#x153;anti-discriminationâ&#x20AC;? provision, stating that government units and private employers may not discriminate against a person solely because that person has filed bankruptcy or was insolvent. BALER, Aurora, Oct. 19 (PNA) – This capital town of Aurora was placed under a state of calamity late Tuesday afternoon due to the effects of typhoon Karen. In a special session, the SB unanimously approved the recommendation of the Municipal Disaster Risk Reduction and Management Office (MDRRMO) to declare Baler under a state of calamity to be able to release calamity funds needed to assist the victims of typhoon Karen. On motion of councilor Francisco B. Zubia III which was affirmed by the rest of the SB members in session, they declared this town under a state of calamity until such time that the effects of the disaster have been mitigated and situation in the area has stabilized. Resolution no. 069-2016 was likewise approved by Mayor Nelianto C. Bihasa. This town was heavily hit by Karen which brought extensive damages to properties and livelihood in which a great number of population were affected and in need of
emergency assistance, including those individuals and families whose houses were destroyed. Based on the report from the MDRRMO, damage to agriculture brought by typhoon Karen when it made a landfall Sunday in this capital town of Aurora has initially reached to more than PHP53.48 million. Gabriel Llave, MDRRMO chief, said some PHP52.47 million worth of palay crops were devastated by the typhoon in some 1,076.25 hectares of land, affecting some 672 farmers here. Llave also said the onslaught of typhoon Karen caused damage to 14.35 hectares of corn farm lands with an estimated PHP874,415 loss. He said the livestock sector has an initial damage worth some PHP135,250. DPWH to alleviate flooding in southern Pampanga MANILA, Oct. 18 (PNA) – The Department of Public Works and Highways (DPWH) targets to reduce the damage brought by perennial flooding in southern Pampanga through the implementation of the Integrated Disaster Risk Reduction and Climate Change Adaptation (IDRR-CCA) Measures in Low Lying Areas of Pampanga Bay Project. A total of eight deteriorated Sluice Gates are set to be repaired and replaced near the right bank of the Pampanga River to regulate
the stream of water and prevent the backflow of the rivers. Dredging and embankment works will also be conducted at the river channel network in the Third River, including Eastern Branch River, Caduang Tete River, and Sapang Maragul River to improve their drainage capacities and to minimize the occurrence of flood in the areas around the rivers. The flood-control project, which is being undertaken by the DPWH Unified Project Management Office-Flood Control and Manage-
ment Cluster (UPMO-FCMC) commenced its 17-month detailed engineering and pre-construction stage last March 2016. When completed, the project will benefit the Kapampangans residing in the municipalities of Macabebe, Masantol, Minalin, and Sto. Tomas. These towns considered flood-prone areas are frequented by calamities due to its low-lying location at the vicinity of the Pampanga Bay. The government is optimistic that if the problem on perennial
flooding will be addressed, numbers of casualties and damage on properties will be minimized in the area and regional economic growth is seen to prosper.

PAL offers free shuttle ride for San Diego travelers By Abner Galino
San Diego residents who are flying to the Philippines on round-trip tickets from the Philippine Airlines (PAL) are getting free shuttle rides to and fro the Los Angeles International Airport (LAX). Ma. Theresa B. Garces, PAL Los Angeles area manager, made the announcement in a gathering of travel agency managers in a restaurant in San Diego last Thursday (October 13). Garces said PAL wants San Diego residents to get to the airport and back with “no hassles or worries.” “We know how hard it is to drive up to LA, so we’re trying to make it easier for our clients here in San Diego,” Garces said. Pinoy Shuttle, a San Diego based vehicle service, will be exclusively transporting PAL passengers from San Diego to the airport and vice verza. Steve Cabuag, owner of Pinoy Shuttle, said their transport firm will be solely responsible for any untoward incidents that may occur during the transport. “And that is the reason why we are not going to get other passengers because it is part of our insurance
agreement,” Steve said. He added that Pinoy Shuttle has a fleet of vehicles of varying capacity limits that it could deploy, depending the number of passengers present. Passengers who bought tickets effective September 1- December 10, 2015 and travelling from September 7 with a return trip on/before December 15, 2015 can avail of free shuttle service. But the shuttle voucher is only valid on the flight and date specified on the ticket. These vouchers will be cancelled or forfeited in case of changes or rebooking. The travel agents will make two days advance notice to the shuttle service provider and they will also issue the travel vouchers to the passengers. On the other hand, passengers must hold valid PAL ticket traveling to Manila via PR 113/PR103 and return via PR 112/PR 102. They must have confirmed shuttle service reservations 48 hours before their flights and they must present their vouchers to Pinoy Shuttle service on departure day. An action under the DVPA (Domestic Violence Protection Act) seeking a restraining order often is necessary to protect parties from abuse or domestic violence perpetrated by the other spouse or significant other. At times, it is effective in preventing harm to one of the parties. At the same time, this process is sometimes abused by family law litigants as a strategy for obtaining an advantage in a child custody case. The basis for this is the presumption against sole or joint custody under California family code section 3044. California Family Code Section 3044 (a) provides “Upon a finding by the court that a party seeking custody of a child has perpetrated domestic violence against the other party seeking custody of the child or against the child or the child’s siblings within the previous five years, there is a rebuttable presumption that an award of sole or joint physical or legal custody of a child to a person who has perpetrated domestic violence is detrimental to the best interest of the child, pursuant to Section 3011. This presumption may only be rebutted by a preponderance of the evidence. In determining whether the presumption in family code 3044(a) has been overcome, the court shall consider all of the following factors:(1) Whether the perpetrator of domestic violence has demonstrated that giving sole or joint physical or legal custody of a child to the perpetrator is in the best interest of the child. In determining the best interest of the child, the preference for frequent and continuing contact with both parents, as set forth in subdivision (b) of Section 3020, or with the noncustodial parent, as set forth in paragraph (1) of subdivision (a) of Section 3040, may not be used torebut the presumption, in whole or
in part.(2) Whether the perpetrator has successfully completed a batterer’s treatment program that meets the criteria outlined in subdivision (c) of Section 1203.097 of the Penal Code. (3) Whether the perpetrator has successfully completed a program of alcohol or drug abuse counseling if the court determines that counseling is appropriate. (4) Whether the perpetrator has successfully completed a parenting class if the court determines the class to be appropriate. (5) Whether the perpetrator is on probation or parole, and whether he or she has complied with the terms and conditions of probation or parole. (6) Whether the perpetrator is restrained by a protective order or restraining order, and whether he or she has complied with its terms and conditions. (7) Whether the perpetrator of domestic violence has committed any further acts of domestic violence. A person has “perpetrated domestic violence” when he or she is found by the court to have intentionally or recklessly caused or attempted to cause bodily injury, or sexual assault, or to have placed a person in reasonable apprehension of imminent serious bodily injury to that person or to another, or to have engaged in any behavior involving, but not limited to, threatening, striking, harassing, destroying personal property or disturbing the peace of another, for which a court may issue an ex parte order pursuant to Section 6320 to protect the other party seeking custody of the child or to protect
the child and the child’s siblings.The requirement of a finding by the court shall be satisfied by, among other things, and not limited to, evidence that a party seeking custody has been convicted within the previous five years, after a trial or a plea of guilty or no contest, of any crime against the other party that comes within the definition of domestic violence contained in Section 6211 and of abuse contained in Section 6203, including, but not limited to, a crime described in subdivision (e) of Section 243 of, or Section 261,262, 273.5, 422, or 646.9 of, the Penal Code. The requirement of a finding by the court shall also be satisfied if any court, whether that court hears or has heard the child custody proceedings or not, has made a finding pursuant to subdivision (a) based on conduct occurring within the previous five years. In Christina L v. Chauncey B, 229 Cal. App 4th 731 (2014),the Court of appeal held that because a Domestic Violence restraining order must be based on a finding that the party being restrained committed one or more acts of domestic abuse, a finding of domestic abuse sufficient to support a DVPA restraining order necessarily triggers the rebuttable statutory presumption that an award of sole or joint physical or legal custody of a child to a person who has perpetrated domestic violence is detrimental to the best interest of the child. Cal. Fam. Code §§ 3044. The presumption that an award of sole or joint physical or legal custody of a child to a person who has perpetrated domestic violence is detrimental to the best interest of the child changes the burden of persuasion, but may be overcome by a preponderance of the evidence showing that it is in the child’s best interest to grant joint or sole custody to the
offending parent. Cal. Fam. Code § 3044. In that case, the father had a history of perpetrating domestic violence against the mother. Domestic Violence restraining orders has been issued multiple times over the years including within the last 5 years. The trial court ignored both the existing restraining order, the legal effect of such a judicial finding, and failed to apply the family code 3044 presumption and instead awarded joint custody to father. Diversity a common denominator in Orange County’s Chambers of Commerce Orange County in Southern California is home to many chambers of commerce who make-up is as diversified as its members from the business community. There are 34 cities that comprise the third most populous county in California with over 3 million people coming various ethnic origins. Orange County is also one of the most densely populated in the State coming only next to San Francisco County. Thirty two chambers of commerce serve the business entrepreneurs of the 34 cities with close to a dozen representing various ethnic groups operating in the county alone. A chamber of commerce is a form of business network, whose goal is to further the interests of businesses and the members of these local organizations advocate on behalf of the business community. The Filipino American Chamber of Commerce also known as FACCOC is one of these which had withstood the test of time since its founding in 1994 and had gone through many changes in leadership and management approaches over the year. Back in the early 90’s many Filipinos from the Los Angeles County, the preferred settlement of many Filipinos migrating to California. started moving in further south to Orange County “to escape the growing congestion and pollution of LA”. The lure of open spaces and more serene environment were also factors for the decision of many Filipino professionals and entrepreneurs to move to the cities of Orange County. Unlike some ethnic groups who had cluster with their own kinds because of language and other considerations, the Filipinos managed by
themselves because of language and other adaptable skills. The Filipinos immigrants who then numbered just a little over 60,000 were scattered sporadically in half a dozen cities of the county. Home to famous world- class attractions like Disneyland, Knott’s Berry Farm and several beaches along its 40 miles coastline, Orange County’s features and other factors attracted many Filipinos to establish their roots in the area. For sometime, Filipino business entrepreneurs remained unorganized but were able to survive the competitive market condition of their adopted county. But it was not for long, however. In 1994, they became an organized group through the initiative of Nolan Alejandro, a restaurateur and mortgage broker, and Dr. Carmelitia Co-Cosquejo. Alejandro lamented the lack of representation of the Filipino sector in one of the meetings of Orange County Minority Business Council he attended and was surprised that the Filipino entrepreneurs were the only one unrepresented. With the encouragement of the minority council members, the idea of a Filipino American Chamber of Commerce in Orange County was conceived. On November 3, 1994, the organizational meeting of Filipino business entrepreneurs and professionals was held at the Anaheim Plaza Hotel and a nine-person board of directors

Young senior loses job and converts chp 13 to chp 7 and ďŹ ghts to keep house
When I say young senior, I mean 60. Sheâ&#x20AC;&#x2122;s a single mom with two adult daughters who are over the age of 21. One daughter is still in college but has a part time job. The other works full time. Both daughters live with client in her house, but she does not claim them as dependents in her income tax returns. When we filed her Chapter 13 three years ago, she had disposable income of $900. However, at that time, her job security was already in question as another company had just purchased employer and heads were rolling. Client was able to keep her head for three years but lost her employment recently. Without work, she no longer has disposable income. Our first attempt to end her case was filing a motion to pay off the 33% plan by liquidating $10K from her retirement account. The Chapter 13 trustee objected to our motion to pay off the plan unless the pay off was 100%. Well, that wasnâ&#x20AC;&#x2122;t a good deal because her unsecured debt was about $100K which meant that client had to come up with $90K more to get a Chapter 13 discharge, thatâ&#x20AC;&#x2122;s a 100% plan pay off. Client had two other options dismiss the Chapter 13 case, or convert it to Chapter 7 and get a discharge of $90K of unsecured debt. The problem is that for the last three years, the value of her house, just like most houses in Los Angeles and Orange County, have been appreciating significantly. We checked Zillow, which estimated the value at $400K, and REDFIN estimated it at $440K. Whereas her house only had $30K of equity when she filed for Chapter 13 in 2013, now she has equity of $160K. The other problem was that she had testified at the Chapter 13 hearing last week that her daughter was inde-
pendent, although she lived with her. And she did not mention that she had a second daughter who also lived with her, a full time college student. So, the trustee concluded that her claim of homestead exemption should only be $75K, not $100K. We refused to reduce the exemption claim to $75K because the trustee was not on solid ground with her argument that debtor had testified that daughter was independent, therefore, she is not considered to be part of the family unit. We argued that the other daughter was a full time college student, therefore, unable to take care of herself. So by definition, she is part of debtorâ&#x20AC;&#x2122;s family unit. As a result, the homestead exemption of $100K is correct. Settlement offers and counter offers were made. The negotiations were fruitful and trustee settled for a reasonable amount to allow the debtor to keep her house. Even though debtor was not employed, she was willing to liquidate a part of her retirement account to pay for the settlement to keep her house. Daughters were willing to buy the house from her anyway later on, so she gets her settlement payment back. Nowadays, the correct value of the residence is critical to keeping the house safe from the clutches of the Chapter 7 trustee, because house values are at their peaks again. Mortgage rates have been kept very low by the Feds for a long time. The last
time house values peaked was 2007, just before the mortgage crisis, which bankrupted a lot of big banks. When the crisis hit, house values dropped by more than half. Now, all of that has been recovered, and new highs are being achieved. Therefore, a lot of factual and legal analysis must be done before deciding which path to take, Chapter 7 or Chapter 13. The second client is 72. Her husband passed away some time ago. She has a daughter who has just started college. I guess she must have married late. She now receives only social security and has no other income. However, she owes $70K of credit cards, which requires $2100 of monthly minimum payments. Her social security is $1,600. Letâ&#x20AC;&#x2122;s not even go further. Client doesnâ&#x20AC;&#x2122;t own a house. She rents for $1,000. Well, with $600 left after rent is paid, and a daughter in college, letâ&#x20AC;&#x2122;s just say that thereâ&#x20AC;&#x2122;s tremendous pressure on her to budget her expenses. Obviously, there is no money to pay $2100 for credit cards every month, is there? So, she chooses to make the $70K credit cards DISSAPPEAR with a Chapter 7 petition. Just imagine the number of calls she gets everyday from these cards trying to get their pound of flesh from her. Thatâ&#x20AC;&#x2122;s no way to live no matter how old or young you are. $2100 a month for credit cards is equal to a mortgage of $400K. I mean you can literally buy a house, condo or townhouse for $400K with nothing down, instead of carrying $70K of credit card debt. Think about where you want your hard earned money to go. Would you rather be the proud owner of a house, or the proud owner of $70K of credit cards? At 72, client finally realized that she should have gotten rid of her
credit card debt a long time ago. If she got rid of them ten years ago, she would have saved up $252K now. Instead she gave $252K to her credit cards of $70K, and she still owes the same $70K after ten years! Think hard what you should do now because the earlier you get rid of credit cards, the faster you can save money and be productive again. Even at 72, itâ&#x20AC;&#x2122;s not too late to get rid of them, better late than never. â&#x20AC;&#x153;The Lord himself goes before you and will be with you; he will never leave you nor forsake you. do not be afraid; do not be discouraged.â&#x20AC;? Caregiver law requires overtime pay Under California law many caregivers must be paid overtime compensation when working more than 9 hours a day or 45 hours a week. In my experience, very few 24-hour caregivers are paid correctly. With California’s increase in the minimum wage to $10 an hour, many 24-hour caregivers must be paid a minimum of $315 a day to comply with the current law. If you are working as a caregiver and paid a day rate less than $315, under California law, you are not being paid any overtime and may have a substantial unpaid overtime claim. Oftentimes, employers attempt to avoid liability by claiming the caregiver is an “independent contractor.” In most circumstances, this argument will fail as typically employers maintain significant control over the caregiver. The change in the overtime rules for caregivers became effective on January 1, 2014, when the Domestic Worker Bill of Rights (DWBR) became law. Previously, employees who qualified as “personal attendants,” including caregivers, nannies and babysitters who worked in private households did not qualify for overtime. The DWBR eliminated the overtime exemption for personal attendants and provides that personal attendants “shall not be employed more than nine hours in any workday or more than 45 hours in any workweek unless the employee receives one and one-half times the employee’s regular rate of pay for all hours worked over nine hours in any workday and for all hours worked more than 45 hours in the workweek.” Now, caregivers, nannies and babysitters (with limited

exceptions) must be paid overtime compensation. Unfortunately, this law does not cover IHSS workers and those caring for close family members. Under Labor Code § 1194, caregivers are not only able to recover their unpaid overtime in a civil action, but they also may recover reasonable attorney’s fees and costs. California law also provides interest and penalties for workers who are not properly paid overtime compensation. If you are working as a caregiver who is not paid overtime when working more than nine hours a day or 45 hours a week, you should consult with an attorney to discuss your rights under this law. MANILA, Oct. 18 (PNA) – Manila Mayor Joseph “Erap” Estrada on Tuesday ordered Manila Police District (MPD) director Senior Supt. Joel Coronel to hasten the operation against 16 “high-value” targets (HVTs) to serve as example to other unscrupulous city officials that are into drugs. The MPD announced earlier that they are investigating 16 local and national government officials in Manila, including police officers allegedly involved in illegal drugs. “Government officials who are involved in drugs do not deserve any mercy. They’re even worse than the ordinary street pushers because they took an oath to uphold the law and serve the people,” Estrada said in disgust. Estrada assured Coronel of his full support in going after the 16 HVTs in the MPD’s drug list. “We will support you all the way. We will provide whatever you need, so long as these targets are put behind bars,” he told Coronel. Recently, Estrada procured PHP20-million worth of brand new firearms for the MPD policemen on top of the PHP45-million fund he released for the allowance of the 4,652-strong city police force. Since his assumption to office in 2013, he has allotted PHP1.9 billion for crime prevention program, which includes PHP136 million in back allowances of MPD members and the procurement of 41 new mobile patrol cars and 110 electric personal transporters. In an interview late Monday evening, Coronel said the 16 HVTs, whom he said are “public servants”, are from the Manila City Hall, barangay, national government offices based in Manila, and from the Philippine National Police (PNP). “They’re both elected and appointed (officials). Some are drug users, coddlers, traffickers, or protectors, including from the PNP,” Coronel bared. “We have been monitoring them. Once we are done with the validation and it proved positive, we will conduct an operation – either entrapment, arrest or neutralization,” he said.

PHL will not enter into new military alliances nor break old ones: Duterte BEIJING, Oct 20 (Mabuhay) – Do not expect the Philippines to enter into new military alliances, said President Rodrigo Duterte during his four-day state visit in China. Speaking before members of the Filipino media at a hotel on Wednesday, the President pointed out that he does not intend to break old ones. “There will be no military alliances entered into. There will be no military alliances broken. What I am just saying is that we are not interested in adding fuel to what is already a volatile world,” he answered, after he was asked about a possible military alliance with Beijing. “When I said that there is no such thing as allowing the missiles there or missiles there, I would not allow it. And I have repeatedly said, anybody who wants to think about or talk about Third World war and even a conflict on a regional level, low intensity thing, it would not promote anything. I am not into that,” the President said. Duterte also warned of consequences should conflicts among countries with nuclear weapon intensify. “And if you talk about America, Russia, vis-à-vis China, Great Britain, France, Iran, Pakistan, India, there is a conflict going on, it’s getting hot. And if you think that if those nuclear bombs will explode at the same time, then we might not be able to board our last men out of China because it will just simply end the world,” he said. “So what’s the point of talking about…Why should I borrow missiles or ask for nuclear bomb? For what? They were just crazy people who would want to pull a stack on a matter of national pride,” Duterte said of getting new military alliances. Also at an earlier event, Foreign Affairs Secretary Perfecto Yasay Jr. did not mince words when asked about the possibility of getting armaments during the China trip. “We are not talking of war here. We are talking of peace. Come on. Dissociate that from your mind. We are interdependent of every nation all over the world so far as our economic development is concerned. That’s the nature of things,” he explained. “In fact, military alliances—especially so we are able to find solutions in making sure that the peace of the world would be assured, we will not probably (be) relying on military alliances anymore. Although there is a saying that there is no sure thing in politics, recent nationwide surveys however have indicated that Clinton is still ahead of Trump in most battleground states. Clinton is aiming to become the first woman President of the United States. If she wins in the November 8 election, she will be the 44th President of the United States of America. Recent polls conducted by RealClearPolitics, Quinnipiac and Fox News have showed that Clinton is still seven to eight points ahead of Trump. RealClearPolitics has Clinton at 48.6 percent as against Trump’s 42.1 percent. Quinnipiac has Clinton at 50 percent and Trump with 44 percent. Fox News polls show Clinton with a 49 percent compared to Trump’s 42 percent. On the one hand, recent surveys conducted by the New York Times and CBS for the 2016 presidential election showed that both Clinton and Trump failed to get the trust of most of the American voters. The Times and CBS surveys also found out that most people think that Clinton has the right temperament and personality to be a good president. This is definitely a good news for the Clinton campaign team. Trump, on the other for hand, was the choice for a lot of people to be the only one who could bring about “real change” in Washington. There are also more positives news for Clinton as the presidential campaign period is heading towards the homestretch, among them the voting preference of Asians and Hispanics during election time which is crucial for her if she intends to win the presidency this November. It has been widely perceived that Asians and Hispanics, whose voting population has grown tremendously, are leaning towards Clinton as their choice to succeed President Barrack Obama. This is because most Asians and Hispanics believed that the priorities of most Republicans lean towards the rich and big businesses. Aside from the support she will get from Asian and Hispanic voters, Clinton is also expected to get tremendous support from the black community, which can prove to be a big head start for the former First Lady and Secretary of State, come Election Day. Throughout the debate, which I watched from my television set, Clinton and Trump traded barbs and insults in a fiery debate, with both candidates going back and forth attacking each other. Both traded insults regarding their respective positions on illegal immigration in America. Clinton accused Trump as being anti immigrant and has a different view on the plight of illegal aliens in America. Clinton accused Trump of exploiting illegal immigrants whom he hired to build his hotels. Most of Trump’s undocumented workers, Clinton claimed, were underpaid by the billionaire businessman. Clinton argued that her Comprehensive Immigration Reforms Plan will benefit thousands of undocumented aliens in United States get permanent residency without being deported back to their country of origin. She said that Trump’s idea of building a wall along the borders is not the right thing to do to stop illegal immigration in America. Trump, on the other countered by saying that the only way to keep Americans safe from terrorists and to stop the flow of “illegals” in America is to build walls along its borders. Understandably so, Trump continues to get favorable ratings from white male voters throughout the United States. Despite all the negative things coming out in the media regarding Trump’s behavior including his alleged demeaning comments about women and sexual assaults, there was still enough evidence that shows that people still believe that he is mentally fit to be the next American President. I think the reason voters are still not abandoning Trump despite his numerous blunders, is the fact that most people believe that America needs more toughness in combating terrorism. Trump has been saying in his campaign speeches that America has to be tough in dealing with terrorism and illegal immigration to keep Americans safe at all times. It is still a few days to go and Trump needs all the help he can get from his supporters, as well as the undecided voters if he hopes to win the U.S. Presidency. This is going to be a tall order for Trump to accomplish, though. But who knows? He might be able to do it if people will seriously look in to his credentials regarding his presidential electability. House probe on violent dispersal in front of US Embassy sought MANILA, Oct 20 (Mabuhay) -- Party-list lawmakers from the Makabayan bloc are asking the House of Representatives to investigate Wednesday’s violent dispersal in front of the US Embassy, where protesters were ran over by a police mobile. Through House Resolution 487, the lawmakers on Thursday urged chamber to condemn the assault on the protesters, saying it was a violation of the protesters’ right to peaceably assemble as enshrined in the 1987 Philippine Constitution. The lawmakers sought that “an immediate investigation, in aid of legislation, be conducted by the House committee on human rights, with the end view of crafting more measures protecting the interests of
marginalized groups exercising their right to peaceably assemble and air their grievances, like the national minorities, and penalizing state security and police forces who violate the same.” The resolution was filed by Bayan Muna Rep. Carlos Isagani Zarate, Gabriela Rep. Emmi de Jesus, ACT Teachers Rep. Antonio Tinio, Anakpawis Rep. Ariel Casilao, Gabriela Rep. Arlene Rosas, and Kabataan Rep. Sarah Elago, who was among those hurt in the dispersal. Eleven of the protesters were injured, three of whom seriously, and hospitalized after being ran over by the vehicle driven by P03 Franklin Kho of the Manila Police District during Wednesday’s demonstration at the US Embassy.

Quit using ‘Dutertards’ as an insult, urges Kris Aquino Stop using the term “Dutertards” in referring to President Rodrigo Duterte’s supporters, actress Kris Aquino urged the firebrand leader’s critics. “I resent calling anyone ‘tards.’ Kasi I have a special son so I’m sensitive to that even if it’s a term that is used widely,” Kris said during a press conference for a brand, her first public appearance since she severed a 20-year tie with ABS-CBN. The term “Dutertards” is a port-
manteau of the firebrand president’s surname and the derogatory term “retard.” It is usually used by his critics to label his most avid supporters. Zsa Zsa back with Conrad Zsa Zsa Padilla and Conrad Onglao are back together. Five months after calling off their engagement, the two have reconciled, according to a newspaper report. Padilla refused to reveal other details, explaining that she prefers to keep things “private.” She added that she wants her and Onglao’s second chance at their relationship to last “forever.” Padilla and Onglao were a couple for more than two years before splitting up. Prior to Onglao, Padilla was the long-time partner of the late comedian Dolphy. Onglao, on the other hand, was previously married to interior designer Ivy Almario, with whom he has two sons. Will you get a tax reassessment increase when you refinance your home? When refinancing your home loan, it will not trigger a tax re-assessment. That is a very common concern for a lot of homeowners thinking about cashing out money or refinancing to a better interest rate always ask. So, let’s discuss how and when the County tax make their re-assessments. Re-assessments A reassessment of your base year to the current fair market value can occur for a number of reasons besides buying or selling your property. If the property has been owned by the same owner for a long time. As such, it is important to understand what will trigger a reassessment: Usually, a change in ownership or completion of new construction. Exceptions for Change in Ownership Transfers Between Parents and Children A transfer of a principal personal residence and up to $1,000,000 real property is exempt for reassessment, if the proper forms are filled out on a timely basis. It is important to note that these interests must be held individually or in trusts and not in business entities. This exception includes the grandparents to the grandchildren if the parents are dead. It is important to note that there is no exception for transfers amongst siblings. Inter-spousal Transfers : Transfer between husbands and wives are exempt from reassessment. This exception includes legal entities owned by spouses and also includes the death of a spouse. Transfers To and From Trusts and Changing of Vesting Transfer to Revocable Trusts Any transfer to or from a revocable family
trust is exempt from reassessment. This includes transfers to a Qualified Personal Residence Trusts because the trustor-trustee is the sole present interest beneficiary. Change in how a Vesting is held – This transfer or change in vesting such as Joint Tenancy, Tenancy in Common is not going to trigger a reassessment. Transfers Between Partners :When a majority owner (this person owns over 50% of the property prior to the transfer) of an entity acquires the minority interests and becomes the sole partner, no change in ownership has occurred. The limited partnership agreement must include language that the partnership will not terminate upon the death of the general partner, provide for withdrawal of the general partner and provide for incapacity of the general partner. California homeowners 65 and older should check their property tax bills and make sure they are getting any senior exemptions on school parcel taxes to which they are entitled. These exemptions could reduce their tax bills by hundreds of dollars, or more than $1,000 in some wealthier districts. To qualify, homeowners generally must live in the home as their primary residence. They must request, fill out and send in application provided by the district, generally with proof of

Tobacco products to carry graphic health warnings starting Nov. 4 MANILA, Oct. 19 (PNA) â&#x20AC;&#x201C; Beginning Nov. 4, all tobacco products being manufactured and imported for sale in the Philippines must contain graphic health warnings in compliance with Republic Act No. 10643. â&#x20AC;&#x153;This means that cigarette packs must carry graphic health warnings and products with text only warnings are no longer allowed to be sold anywhere in the country,â&#x20AC;? Emer Rojas, president of the New Vois Association of the Philippines (NVAP) and a throat cancer survivor, said during a press briefing held in Quezon City Wednesday. Ratified in July 2014, RA 10643 mandates that all tobacco products being sold in the country carry graphic health warnings in the lower portion of the cigarette packs, covering at least 50 percent of both sides of the packages. A total of 12 templates or images of the actual health effects of smoking, including a photo of Rojas who had stage 4 laryngeal cancer from smoking, have been approved by the Department of Health (DOH) to be used in the packages. The Graphic Health Warnings (GHW) Law imposes a maximum penalty of PHP2 million or a five-year imprisonment and revocation of business permit against erring manufacturers, exporters and distributors. â&#x20AC;&#x153;We are hoping that all manufacturers, distributors, and retailers are aware of the deadline for compliance to the law and that none of them will be sending out packs without picture warnings,â&#x20AC;? Rojas said. Likewise, Rojas warned â&#x20AC;&#x2DC;sari-sariâ&#x20AC;&#x2122;
or convenience stores that they too must comply with the GHW law. He said such stores should stop accepting cigarette packs with no graphic warnings from their suppliers. Proceeds from fines collected from violators may be used to partially fund health promotion campaigns of the departments of health and education. The law requires the education department to use the graphic health warning templates to teach students about the harmful effects of smoking by incorporating them in relevant subjects under the K-12 curriculum. Meanwhile, the Department of Trade and Industry and the Inter-Agency Committee on Tobacco (IAC-T) are mandated to monitor the compliance of the tobacco industry. Data from the Bureau of Internal Revenue showed that as of May 25 this year, all six local manufacturers have already complied with the DOH-prescribed templates. The World Health Organization recommends graphic health warnings on tobacco products as one of the most effective ways to stop people from smoking. Ellirie Aviles, president of the youth group Sigaw ng Kabataan Coalition, warned tobacco companies not to target them as replacement customers and vowed to support the law through monitoring on the ground. â&#x20AC;&#x153;The youth should not be the replacement smokers for the sick and dying customers of the cigarette companies. The country reportedly has 17.3 million adult smokers puffing an average of 11 sticks a day. The GHW law complements the smoke-free Philippines initiatives of President Rodrigo Duterte and of the DOH.

Medicare has also instituted the system of appeals and grievances. As everyone knows, Medicare does not pay for everything. Members have their share of cost. City of Carson culminates Filipino-American History Month celebration with special Tribute to Larry Itliong On October 22, the City of Carson and various organizations will join the entire community in honoring the life’s work and legacy of Larry Itliong – a Filipino-American labor leader and organizer. A tribute march will start at 9 a.m. on October 22 around the vicinity of Veterans Park located at 22400 Moneta Avenue in Carson followed by a labor awards ceremony. This year’s Larry Itliong Labor Awardees are Tony Doroño, co-founder of the Filipino Migrant Center, and the UCLA Labor Center, home of the national immigrant youth movement. Entertainment is led by saxophonist, composer, and arranger, Michael “Cody” Dear from UCLA. The event is free and open to the public. Larry Itliong was responsible for organizing immigrant farm workers and cannery workers for over 30 years. He helped establish the Alaska Cannery Workers Union in the 1930s and helped get a contract that called for eight-hour days with overtime pay. In 1965, Larry Itliong led the successful “Great Delano Grape Strike” to protest the low wages and miserable working conditions. In 1966, he led the Agricultural Workers Organizing Committee and merged with the National Farm Workers Association led by Cesar Chavez to form the United Farm Workers union. In 1970, Larry Itliong founded and became the president of the Filipino American Political Association (FAPA), the first national political Filipino American organization and a crucial alliance between Filipino professionals with 30 active chapters throughout the United States. “The City of Carson is the first city to recognize the contributions of labor
union leader Larry Itliong. We are proud to have this annual event and proud to have been instrumental in the movement to get AB 7 passed in Sacramento to have October 25 recognized as Larry Itliong Day throughout California,” said City of Carson Mayor Albert Robles. “On behalf of a grateful City, we give special thanks to Councilmember Elito M. Santarina for his leadership in getting Carson to be the first City in the Country to recognize Larry Itliong Day,” added Robles.
