MANILA, Oct. 25 (PNA) -- President Rodrigo Duterte on Tuesday said he looks forward to a Philippines without foreign troops around, only Filipino soldiers. Pres. Duterte made the remark in a media interview before leaving for his three-day official visit to Japan upon invitation extended to him by Japanese Prime Minister Shinzo Abe. ”I would like to say this with all candor, I look forward to the time when I no longer see any military troops or soldier in my country except the Filipino soldier,” Pres. MANILA, Oct. 26 (PNA) – Women’s partylist group Gabriela on Wednesday expressed support for President Rodrigo Duterte’s thrust to end the exodus of Filipino workers for overseas jobs. In a statement, Gabriela Partylist Rep. Emmi de Jesus also urged the President to strengthen the local economy through a genuine agrarian reform program and create national industries to ultimately put an end to decades of exporting human resources. “Women share the dream of having a local economy that is strong enough to support our labor force, creating an environment where it will not be necessary for women to leave their children and families to eke out a living,” de Jesus said.

PHL firms urged to explore opportunities in Iraq as ICTSI inaugurates $130-M port project in Basra BASRA, Iraq – The Philippine Embassy expressed hope that more Filipino companies would explore investment opportunities in Iraq following the recent inauguration by Manila-based International Container Terminal Services Inc. (ICTSI) of its $130-million port development project here. MANILA, Oct. 26 (PNA) – Nicole Cordoves, the Philippines’ bet to Miss Grand International 2016, placed first runner up during the pageant night held at Westgate International Theater in Las Vegas on Oct. 25 (Oct. 26 in Manila). Indonesia’s Ariska Putri Pertiwi was named Miss Grand International 2016. The 4th runner up was Michelle Leon (USA); 3rd runner up was Madison Anderson (Puerto Rico); and 2nd runner up was Supaporn Matisorn (Thailand). This is the second straight year that the Philippines made it to the pageant’s top 5. Last year, Philippine bet Parul Shah was named second runner-up. In the final question, “If you had to choose

one of these two people to help you stop the war and violence, who would you choose between Donald Trump and Hillary Clinton and why?” both Cordoves and Leon answered they would choose Trump over Clinton, which earned them boos from the crowd. The bets from Puerto Rico, Thailand and Indonesia answered they would want the Democratic presidential bet help them in stopping war and violence. During the question and answer portion, the 24-year-old Cordoves said, “if we choose him to switch to our side, there won’t be war and violence anymore... let’s keep the peace and let Donald Trump switch to our side to stop war and violence.” It was also announced that Vietnam will host the pageant next year.

Chinese American artist honored in Asian film fest opening By Abner Galino

“Politicians build walls but artists build bridges.” With these words, Shadyk Sher-Niyaz, founder and chairman of the Asian World Film Festival (AWFF), summed up the inspiration that propels the organization to bring together Asian writers, actors, associated artists, directors and producers for the annual movie festival. Interestingly, Sher-Niyaz also disclosed that he was also a politician, being a legislator from the Kyrgyz

Republic. But he explained the irony away by saying that his involvement in politics was “more of an accident” and added that what he really wanted to do was promote arts and make films. Sher-Niyaz has long been involved in filmmaking before he became a politician. His speech formally opened the 2nd AMFF at the ArcLight Theater in Culver City on Monday night (October 24). Apparently, the most intense moment of the evening was the awarding of the Lifetime Achievement Award to 106-year-old Chinese

American artist Tyrus Wong. The audience gave a standing ovation to the legendary artist who has been known as a great painter, muralist, illustrator and designer. This happened after a preview of a new documentary about him was shown on the screen of the theater and after his grandson gave a short speech in receiving the award on his behalf. Wong stayed on his spot, sitting on a wheelchair, together with the other members of his family. Wong is most famous for his work in Disney’s animated classic “Bambi.” During the red carpet interview, Filipino American singer/composer and You Tube sensation AJ Rafael said he considered Wong’s awarding as a significant moment in the AWFF gala night. “He’s such a great artist. It’s a great opportunity to celebrate Tyrus Wong.” Also honored during that opening program was Justin Chon of the Twilight Saga fame who given the “Rising star Award.” Dr. Tae Yun Kim, a martial arts teacher was given the “Courage To Dream.” The AWFF opening night movie “Ali and Dino” was also given a standing ovation by the audience. The movie is about the love story of a Muslim Azerbajaini nobleman (Adam Bakri) and a Christian Georgian princess (Maria Valverde). The love story happened during turbulent period after World War I

and the rise of communism in Russia and Europe. Asif Kapadia, a British filmmaker of Indian descent, shot his movie in Azerbajaini, Russian and in English in places in Azerbaijan and Turkey. “This is what AWFF is all about – the cross-culture we aim for and

championing talent from the Asian continent,” said Georges Chamchoum, festival director. Around 34 pictures, 20 of them submitted to the Motion Picture Academy’s Foreign Language Film Category, will be shown at the AWFF from October 24 to November 1.

The economy may have improved slightly, but for the jobless, things have not changed very much at all. We are still experiencing continued corporate and government downsizing, which means there are still many more people suddenly losing their jobs, and can no longer meet the financial obligations incurred during more prosperous times. The first way to deal with debts is to communicate simply and honestly with creditors. Everyone knows the economic situation. Suing for money owed is as annoying and costly for the creditor as it is for the debtor. The key here is: Don’t make any promises you can’t keep and keep all promises that you make. We’ve seen some people write checks that they know will bounce, in their desperation to get an annoying bill-collector off their backs. A bounced check is a broken promise. It can subject you to criminal prosecution and will almost always make that creditor harder to deal with in future. Constant harassment by collection agencies is another problem faced by those in financial trouble. State and federal laws regulate the practices of debt collectors, and certain tactics are prohibited. When unfair tactics do take place, a letter from a lawyer is often enough to provide relief. If not, various legal remedies are available. When things have gone too far to work out with creditors, the Federal courts can offer protection under bankruptcy laws, designed to protect you, and give you a fresh start. There are several types of bankruptcy, each named after a chapter of the United States Bankruptcy Code. Of these, Chapters 7 and 13 are the two that most concern the consumer. Chapter 7 Chapter 7 is what most of us think of when we think of bankruptcy. In a Chapter 7 proceeding, all of your property which is not exempt by law is sold, and the proceeds are distributed to your creditors. At least that’s the theory. In practice, with the exemptions provided by law, and careful planning, an average middle class family would not give up anything at all. Their assets would be deemed exempt, and the creditors get nothing. The final result is that your debts are discharged, and you are permanently free of those obligations. However, there are some debts that cannot be discharged in a Chapter 7 proceeding. For example, education loans cannot be discharged unless one can show extreme hardship. Other non-dischargeable debts include damages from a willful tort claim, certain taxes, loans obtained through false financial statements, debts incurred through fraud, deception, or embezzlement, consumer debts of $1000.00or more, for luxury goods or services owed to a single creditor and incurred within 180 days before you filed your bankruptcy petition, cash advances of more than $1000 obtained within 180 days before you filed your petition, court-ordered fines and restitution, and personal injury debts caused by driving while intoxicated or taking drugs. In some cases, a creditor must file a special proceeding in the Bankruptcy Court to determine whether the debt is non-dischargeable. A creditor can also sue you to prevent the discharge of a debt if you transferred or concealed assets or refused to explain the loss of assets. Chapter 13 Chapter 13 is available for any individual with a steady income and debts which do not exceed $360,000 in unsecured debt and $1,081,000.00 in secured debt (“Secured debt� is when the creditor holds a mortgage or some other sort of lien on the property.). It allows you to submit a

plan to pay off your debts, in whole or in part, over a period of three or five years. You don’t need a regular paycheck to qualify, but you must have income stable and regular enough to make payments under a plan. One advantage of Chapter 13 is that it allows you to keep your assets even if they are not exempt. This can be important if you own a lot of equity in a home. Another advantage is that, if you owe a debt jointly with someone else, such as a relative who co-signed a note for you, Chapter 13 will provide some protection for the other person, while Chapter 7 will not. Some debts which could not be discharged under a Chapter 7 proceeding can be discharged after partial payments under a Chapter 13 plan. These include some types of educational loans, damages for willful torts, and some taxes. You may, at any time, voluntarily dismiss a Chapter 13 proceeding or convert it into a Chapter 7 proceeding. But if you dismiss it, your debts will not be discharged, and you will still owe the unpaid amounts. Chapters 11 and 12 Chapter 11 allows businesses and individuals to restructure large debts. It generally is used for people who want to restructure their debts but have more assets or debts than the limits for a Chapter 13 case. Creditors vote on whether to accept or reject a plan, which must also be approved by the court. Its provisions are quite complicated and generally require the assistance of an attorney familiar with Chapter 11 proceedings. Chapter 12, enacted during the 1980s, is a special form of debt work- out for family farmers. In many ways, it is similar to Chapter 13, but eligibility is limited to people whose income derives primarily from a family- owned farm. Automatic Stay When you file a bankruptcy case, an Automatic Stay takes effect immediately on all collection efforts by all creditors. Evictions, foreclosures, repossessions, lawsuits, annoying telephone calls all must stop, and any creditor who refuses to comply can be held in contempt of the Bankruptcy Court. If you hear from any creditors, we can generally get them to back off by writing them a letter informing them of your bankruptcy filing. Secured creditors can ask the Bankruptcy Court for permission to continue collection actions against you. A motion for relief from the Automatic Stay is heard and decided by the Bankruptcy Judge. Chapter 13 not only provides an automatic stay for you, but if you owe a debt jointly with someone else (such as a relative who co-signed a note), it provides a stay for the co-debtor as well. Bankruptcy Petition For any bankruptcy case, you must file a complete schedule of your assets, liabilities, income, and expenditures and answer a questionnaire about your financial affairs. The most daunting aspect of filing a bankruptcy case is the need to compile a thorough and accurate list of this information. Senator Manny Pacquiao will conduct three more sparring sessions on Thursday, Saturday and Monday before driving to Las Vegas. “I am now well-rested. I arrived in the U.S on Saturday evening and today I feel I have recovered from my jetlag. I sparred six rounds yesterday (with Ray Beltran). I will spar Thursday, Saturday and Monday before driving to Las Vegas,� Pacquiao was quoted as saying by a Top Rank scribe. “We have three different plans for Jessie Vargas. My first concern is for the fans; that the people who are going to watch the fight will be happy and satisfied. I want this to a fight for fans to remember,� Pacquiao added. The eight-time world champion and reigning fighter of the decade has been telling the media that he is “fighting for history.� According to him, after being the first sitting congressman to win a world title, he also wants to be first senator to become a world champion. The Filipino boxing icon also said that “wants to prove he is still one of the best pound--for-pound fighters.� “I will continue to keep fighting as long as I love boxing and boxing still loves me,� Pacquiao declared. For the first time, Filipino fans are going to see two of their boxing icons fight together in one card. In what kibitzers say was a savvy business move from Hall of Fame promoter Bob Arum, the

scheduled Las Vegas bout between Manny Pacquiao and Jessie Vargas has become more interesting for fans, particularly for Filipinos, when the promoter also took in another boxing icon Nonito Donaire. Donaire (37-3, 24 KOs), also known as the Filipino Flash, will fight another Las Vegas native Jessie Magdaleno (23-0 W-L 17 KOs). The other Las Vegas native who will fight on November 5 is Vargas, who incidentally is also nicknamed Jessie. During his chance to speak, Donaire said he was excited to be part of the Pacquiao fight event, adding that it “has been a long time coming.� Arum revealed that he tried to a couple of times in the past to put together Donaire and Pacquiao in one fight event but he was supposedly jammed by some of Pacquiao’s people. Panfilo Lacson on Wednesday called on MalacaĂąang to immediately investigate how Chinese firms with a tainted track record were contracted to undertake major infrastructure projects when President Rodrigo Duterte undertook a state visit to China last week. Lacson warned that the involvement of the Chinese firms–one banned by the World Bank for fraudulent practices, and another known to be involved in land reclamation activities in the disputed Spratly Islands under protest by the Philippines–may affect how Filipinos regard the President. Duterte has been vocal about his intent to cozy up to China despite unresolved disputes in the South China Sea while pulling the country away from its traditional alliance with the United States. “It could erode whatever goodwill President Duterte has built with the Filipino people,â€? Lacson told the Inquirer when reached for comment. “Whoever is responsible must be dealt with accordingly and with dispatch. MalacaĂąang should lose no time in investigating the matter and get to the bottom of this embarrassing issue,â€? he said. PHL secures 16.5-B yen loan from Japan to boost maritime safety capability TOKYO, Oct. 27 (PNA) – The Philippines and Japan have formalized several agreements that would help the former improve its maritime safety capability, including a deal for a PHP16.5 billion yen concessional loan covered by Tokyo’s Official Development Assistance (ODA) for the acquisition of two large-scale patrol vessels for the Philippine Coast Guard (PCG). The agreement for the 16.5-billion yen loan signed by Philippine Finance Secretary Carlos Dominguez and Japan International Cooperation Agency (JICA) president Shinichi Kitaoka during President Rodrigo Duterte’s official visit to Japan is part of Tokyo’s continuing assistance to the PCG’s Maritime Safety Capability Improvement Project (MSCIP).

President Duterte and Japanese Prime Minister Shinzo Abe witnessed the signing of the Loan Agreement, as well as the Exchange of Notes on the pact between the Department of Foreign Affairs and Japan’s Ministry of Foreign Affairs. The JICA loan, equivalent to PHP6.8 billion, has an interest rate of between 0.01 percent and 0.10 percent with a maturity period of 40 years, inclusive of a 10-year grace period, according to the Department of Finance (DOF). The acquisition of two 94-meter large-scale patrol ships under Phase Two of the MSCIP is on top of the ongoing ODA from Japan for the first phase of the project, which involves the procurement of 10 40-meter PCG patrol vessels.

MANILA, Oct 26 (Mabuhay) – While in Tokyo, Japan for a three-day official visit, President Rodrigo Duterte on Wednesday clarified before the Japanese business community what happened during his recent trip to Beijing, China. Deviating from his prepared speech at the Philippine Economic Forum at the Prince Tower Tokyo Hotel, Duterte insisted that his trip to China was all about trade and economic relations. “I would like to add a few statement in my address to you because I know it has also entered everybody’s mind. You know, I went to China for a visit, and I would like to assure that all there was was economics. We did not talk about arms. We did not talk about stationing of troops. We avoided talking about alliances, military or otherwise,” Duterte said, in an attempt to address some of the concerns of the Japanese. “What happened really there was a few platform where investments could come in,” he added. All of these were said as tensions between Japan and China have escalated over the years due to overlapping claims in the East China Sea. Duterte also stressed out once again that being friendly with China was in line with his declaration of

independent foreign policy. He pointed out that such policy was provided in the 1987 Constitution, specifically Article II, Section 7. Although he was in Tokyo, the President had not forgotten about Washington and continued to slam his critics, including the United States. “I want to make it clear to everybody that we do not want to pick quarrel with our friends and neighbors. But to me, it is high time that the President stands up to its dignity as a people,” Duterte began his rant as he explained his war on drugs. “Here are my friends, supposedly, making it hard for my country to solve and even to survive as a nation. And that’s a problem because you may still be under the illusion that the Philippines is under the influence of this country or that country,” he added. He then reiterated that he does not want to see foreign soldiers in the Philippines while he pushes for an independent foreign policy. “I want them out. And if I have to revise or abrogate agreements, executive agreements, I will. DILG eyes five good performing cities in NCR MANILA, Oct. 26 (PNA) – Department of Interior and Local Government in National Capital Region eyes five cities in National Capital Region (NCR) for good performance in local governance. DILG Region 3 team, headed by its Assistant Regional Director Araceli San Jose, said that they had validated five cities in NCR, which were identified as potential passers for the Department’s Seal of Good Local Governance. The Seal of Good Local Governance is a program initiative of the DILG which aims to promote good local governance and encourage local chief executives to strive for the improvement of services extended to their constituents. DILG-NCR Regional Director Maria Lourdes Agustin expressed her hope that the NCR SGLG potential passers will get through the stringent validation and emerge as awardees of the Seal. “We hope to see an increase in number on the list of awardees of the region. Nonetheless, our LGOOs

remain steadfast in its commitment as partners for change in local government units,” she said. The 5 cities are among the 17 LGUs in Region III and National Capital Region which underwent review, assessment and validation process by the Local Government Operations Officers (LGOOs) of the Department. However, Agustin said the cities were still subjected to cross validation to ensure impartiality and strengthen credibility of the awards. The 2016 Seal of Good Local Governance (SGLG) National Awarding Ceremony, slated on Oct. 27 is expected to confer the awards to around 300 local government units based on the assessment and cross-regional validation done by the Department in the 18 regions in the country.

‘For the Love of Jazz: A Concert by the river Series’ The slight downpour and intermittent rain on Sunday evening, October 23rd,didn’t dampen the spirit of guests who came to watch the outstanding musical repertoire of four Pinoy Jazz perfumers: Tateng Katindig, Ner De Leon, Charito and Mon David, at the cozy Pico Rivera Golf Club Banquet Hall. This author couldn’t resist the kind invite of “paparazzi” colleague, Rick Gavino, and gladly we (together with a sorority sister, Mon Malabanan) were truly thankful that we chose gracing this concert, among the other shows which came our way on the same day. Much like its title, this author has learned the love for Jazz, since it was first introduced to me in the mid80’s, when a trumpeteer and former co-worker, who used to perform at the Playboy Jazz Festival invited me to watch their performance at the Hollywood Bowl. It was such a thrill to be among thousands of spectators at this awesome venue and so, I became a Jazz aficionados from then on. Though this author’s trumpeter friend moved to another state, Jazz festivals abound and we seem to follow it. However, while employed at a broadcast company, in the mid2000, this author’s employer, Doug Kisaka re-introduced me to Jazz via his friend, Earle Palmer, who was then a well-known drummer at a cozy venue in North Hollywood called Charlie O’s. We used to watch Earle and his band, occasionally meeting Jazz greats such as Winston Marsalis, Lou Rawls and David Benoit. But, one unforgettable evening, they introduced the newly-arrived keyboardist, Tateng Katindig, along with his lovely wife, Dinah Bertulfo. Thus, began our journey with the duo of Tateng on the keyboard and Earle Palmer on the drums, highlighted by Earle’s last birthday celebration, when the club was jampacked and the Fire Department came ushering some of the guests out. Furthering his club gigs, we followed Tateng and his newly-formed band (including his drummer, David Anderson) to other jazz venues in town such as: Spazio’s and Vibrato’s. Tateng comes from a family of musicians. He is the son of well known Philippine sax player, Eddie Katindig and Remedios Hernaez. His siblings were: Henry, who also played piano and Boy, who played drums and a cousin, also named Boy Katindig, who’s likewise a keyboard player. He studied at the University of the Phil-

ippines and majored in Composition and Keyboard. Introduced by Bubba Jackson of KKJZ 88.1 FM, the various pieces he played, along with his band, drummer David Anderson and Erwin Livingston on Bass, reminded me of the good old days when we used to hang around Charlie O’s Club. Contemporary Jazz Saxophonist Ner De Leon, also hails from a long line of musicians. and has been playing the Saks since he was eight years old. This Berkeley-educated Saks player has performed with wellknown artists back home, such as: Rico Puno, Anthony Castelo, Nora Aunor, Jezza Zaragoza, Marco Sison, Charice, Sheryn Regis, JayR and Becca Godinez. Through the years, this author has watched Ner De Leon perform numerous times at the Catalina Bar and Grill, during their “JAZZipino” concerts and each time, until this evening’s performance, likewise hailed by Bubba Jackson as “soulful and passionate.” To our surprise, Japan-based jazz songbird, Charito Vergara, performed with such a husky, calm, laidback velvet-voice. Apparently, she has collaborated and performed with well-known singer Michel LeGrand in the three memorable recordings of the songs: “Summer Me, Winter Me,” Pieces of Dreams,” and the intriguing French rendition of: “Quand On S’Aime.” Mon David, who likewise graduated from the University of the Philippines College of Music, majoring in Classical Voice. He started singing at an early age, and at 15, he started playing drums and guitar. After graduating from college, he formed a voice quartet called “Fourplay” where they mostly played the songs of the then popular singing group called the “Manhattan Transfer.” he has also served as a vocal coach to well-known singing groups such as: The Apo Hiking Society and has done commercial jangles and acting. This author was first introduced to his mesmerizing ‘scatting” style at the Catalina Bar and Grill, during one of their Jazz Festivals which in-

The presumption of “undue inuenceâ€? in transactions between spouses during the marriage California law on the nature of spouses’ rights and obligations with respect to management and control of community property has evolved over the last thirty years from less stringent “good faithâ€? standards to heightened “confidential dutyâ€? and “fiduciary duty’ standards. Under current law, the duties owed between spouses in transactions between themselves are the same highest duties owed by parties to a fiduciary relationship. The heightened standard with regard to transactions between spouses is codified in Family Code Sec. 721(b). The section provides that “in transactions between themselves, a husband and wife are subject to the general rules governing fiduciary relationships which control the actions of persons occupying confidential relations with each other. This confidential relationship imposes a duty of the highest good faith and fair dealing on each spouse, and neither shall take any unfair advantage of the other.â€? Incidental to this fiduciary relationship is a rebuttable presumption of undue influence when one spouse obtains an advantage over the other in a community property transaction--i.e. when one spouse improves his/her position, obtains a favorable opportunity, or otherwise gains, benefits or profits in a community property transaction to the exclusion of the other. Marriage of Haines (1995) 33 CA4th 277, 297, 39 CR2d 673, 686. This presumption arises in connection with any interspousal property transaction in which one spouse obtained an advantage over the other. It is important to note that the presumption arises even if the transaction at issue did not result

from fraud, deceit or coercion. Marriage of Mathews (2005) 133 CA4th 624, 629-630, 35 CR3d 1, 4. The spouse favored by such a transaction has the burden of rebutting the presumption of undue influence. To rebut the presumption, he/ she must show that the other spouse entered into the transaction freely and voluntarily, with full knowledge of all the facts, and with a complete understanding of its effect. Marriage of Delaney (2003) 111 CA4th 991, 996-997, 4 CR3d 378, 382. If the spouse who benefited from the transaction fails to demonstrate the foregoing, the transaction may be ignored. A classic example of this situation is when a husband executes a quitclaim deed in favor of his wife as her separate property. Generally that fully executed Quit Claim would have the effect of changing the character of the property from community to his wife’s separate property based on another presumption called “presumption of title� under evidence code section 662 and the under a the theory of “transmutation� pursuant to family code section 852., Evidence Code Section 662 presumption of title states that “the owner of the legal title to property is presumed to be the owner of the full beneficial title. This presumption may be rebutted only by clear and convincing proof. However, because of the presump-

tion of undue influence under family code section 721(b), the wife has the burden to overcome the presumption in order to effect a change in the character of the property from community to separate. If the wife does not meet the burden, then the court can set aside the quit claim deed based on a presumption that such transfer was made with undue influence. Each spouse’s fiduciary obligations toward the other spouse under Family Code Sec. 721(b) continue after separation in anticipation of dissolution, nullity or legal separation until the date of distribution of the community asset or liability in question. Family Code Sec. 2102(a) and (b). BK Court rules in favor of Atty Yang client for $250k after trial; 87-year-old senior seeks Chapter 7 relief I represented a foreign company with a $250K claim for a forty foot container of manufactured goods that it delivered to the debtor a California company on 12/30/2014. The debtor had been in a Chapter 11 for a year before the trustee was able to convert the case to Chapter 7 on 4/4/15. Client continued doing business with debtor while it was on Chapter 11, shipping it millions of dollars worth of merchandise, and up to a week before debtor converted to Chapter 7. When debtor converted to Chapter 7, it owed client $250K of unpaid merchandise, and a trademark that client had paid debtor $120K for. The court had previously ruled in favor of client for the $120K trademark saying that it belongs to client since they paid $120K for it. The trustee argued that the transfer to client of the trademark occurred after case was converted to Chapter 7 even though client had paid $120K for it two years prior. Hence, the transfer was void. That issue went to the court on a motion, and the court ruled that the trademark belonged to client since they paid for it. It did not matter that the transfer was made after conversion to Chapter 7, implying that debtor no longer had any legal or equitable interest on the trademark as of payment date. The court however, left the issue of client’s claim for $250K hanging. A hearing was heard on this second matter after discovery was completed, and still the court could not decide one way or the other. The objecting creditor argued that the forty foot container did not exist and that the shipment was never made to debtor, or even if the shipment was made, debtor had paid the $250K in full. Needless to say, I found the argument rather strange. Client presented invoices signed by

the owner of the company, truck receipt for the forty-foot container, and accounting summary showing a net unpaid amount of $250K. So, the court set just this issue, whether or not the $250K is owed to client for trial on September 12, 2016. Three weeks before the trial date, my client informs me that the foreign government which owns the company has decided that client, the president of the company, will not be allowed to appear and testify before a U.S. court for political reasons. I file a motion to allow client’s testimony by telephone. Creditor objects that they will not be able to observe the demeanor of the witness if he is allowed to testify by phone. This becomes moot because the government also prohibits the witness to testify by phone. So, all the evidence we submitted for trial, including the declaration of the witness will the thrown out the door on the day of trial because the witness is not around to testify and be cross examined. In other words, we have no evidence, documentary or testimony, supporting our position at trial, while the other party has all their evidence coming in since their witness will appear to testify. On September 12, trial promptly starts at 9.30 a.m. I’m sitting there on my side all by myself (and God the Holy Spirit who is invisible but there nevertheless, giving me aid and comfort). The other side had two lawyers and their expert witness on international trade documents. First order of business, the

judge says is that the declaration of our witness is stricken off the record since our witness is not around to be cross examined, meaning, we have no evidence! Creditor calls their expert witness to testify. I object that he is not a percipient witness. Judge agrees with me. They insist that their expert witness will testify on the redaction of information on the bill of lading and customs entry. I see the loophole and I withdraw my objection to the testimony of their expert witness. My plan is to bring our evidence in by cross-examining the witness as an adverse witness. Lo and behold, I was able to cross examine the witness for two hours with pin point precision on all relevant documents using his expertise against the other party. This is what happens when God the Holy Spirit is helping you out. They try to salvage the damage done by a series of direct questions to their own witness. But it’s too late. Just before noontime, the judge gave his ruling. He said that this was indeed a strange case as there was no witness for my client to testify and there was no evidence to support our position. But during the cross examination, the evidence slowly crept in. By a hairline, Judge ruled in favor of my client for $250K. For me, this was a miracle, indeed. I had zero chance of winning this case but at the last minute, the situation reversed itself with God’s help. Second client is 87 years old. We filed his first Chapter 7 case twenty years ago when he was 67 and his wife was still alive. They owed about $50K of credit cards twenty years ago. Those were all discharged. They built up their credit again and now owe about $20K. Wife passed last year. They were able to travel the world in the last twenty years. So, the last twenty years was good. But

since wife has passed away, he doesn’t feel like paying the $20K anymore. He’s just tired of paying for it. They used the cards to travel the world, but that was their last time around. Last week, one credit card sued him for $10K. With is social security at $1K a month. There really is no money to pay the cards. So, the only logical step is the get rid of his cards with a Chapter 7 discharge. Client is still able to drive around by himself at 87. He has chronic back pain and has four stents in his heart arteries, but he still praises the Lord for his relatively good health! I would like the Lord to bless my wife and I with good health and long life‌ this life is good and the Lord is good. job just to stay afloat and have enough money for food and rent. By getting into debt that they can’t afford to pay, these people have sentenced themselves to a lifetime of working for their creditors, never enjoying the fruits of their labor. Before they know it, they’re close to retirement age and they come to realize that they have not saved a penny for their later years. Please don’t get me wrong. It is neither my intention to offend anyone nor is it my place to judge anyone. Whatever led you to your present situation no longer matters at this point. The question is: What will you now do from here? Regardless of your past, remember that your future can be different. Senators commit to work with Duterte in fight vs. illegal drugs MANILA, Oct 26 (Mabuhay) – Several senators on Wednesday committed to work with President Rodrigo Duterte after the chief executive said he will seek the help of both houses of Congress to solve the problem of illegal drugs in the country. DAVAO CITY, Oct. 28 (PNA) – After “hearing a voice from above” on his flight from Japan to Davao, tough-talking President Rodrigo Duterte vowed he would no longer utter cuss words. This drew applause from the members of the Cabinet who were part of the President’s delegation in his three-day state visit to Japan. The President, however, cut them short saying, “Huwag masyadong palakpak baka mapalpak pa tuloy (Don’t clap too much, this might fail).” “I was looking at the skies while I was coming over here and I…I just…Everybody was asleep, snoring, but a voice said that, you know, ‘if you don’t stop epithets, I will bring this plane down now.’ And I said, ‘who is this?’ So, of course, it’s God. Okay,” the President said just before the question and answer with the members of the media on his arrival on Thursday night at Davao International Airport. He said he made a promise to God that he would no longer utter cuss words, “because a promise to God is a promise to the Filipino people.” When asked if the promise to stop cussing would include the United States, the European Union and Senator Leila de Lima, who were subjects of his attacks the past weeks for criticizing his policies and campaign against illegal drugs, the President said, “there is always a time. There is always a timing, a time for everything, a time to be foul-mouthed.” Pres. Duterte is known for expressing expletives as expression or a fiery response to accusations against his policies. “Actually kung kilala mo ako, magtanong ka diyan sa mga kababata ko (if you know me, you ask my childhood friends) – Sonny (Dominguez), (Perfecto) Yasay, Bebot (Silvestre Bello), kasama ko naman ito for the long – iyan si Panelo, matagal kaming nagsama (we have been going together for so long – (Salvador) Panelo, we have been together for so long). The President however said he does not want anybody to read his mind because he cannot effectively do things anymore. “But it’s all calibrated, it’s all about timing. Just watch our… for one thing in life, that’s what I have learned, miscalculation,” he pointed out. Senator Alan Peter Cayetano on Friday called President Rodrigo Duterte’s promise not to curse anymore an answered prayer. ”For me, it’s an answered prayer because I had a chance to pray with him and for him in Japan because he had work with me and I asked him, can we pray? And we prayed about a couple of things,” Cayetano told reporters during a media briefing in Malacañang. As chairman of the Senate committee on foreign relations, Cayetano joined President Duterte in his foreign trips to Laos, Indonesia, Brunei, China and Japan. ”The Lord works in mysterious ways. I don’t know if it had anything to do with it but going home, he was really tired,” Cayetano said. Or, again, maybe it was just the pilot! The senator noted that although President Duterte is blurting out expletives every time he responds to accusations against him, he is actually “a deep spiritual person.”

Advanced preparations, swift response key to aiding ‘Lawin’-affected Filipinos: DSWD By Leilani S. Junio

MANILA, Oct. 26 (PNA) – The Department of Social Welfare and Development (DSWD) said on Wednesday that advanced preparations, swift and coordinated efforts by the different disaster and relief agencies enabled the Duterte administration to respond immediately to the emergency situation created by typhoon “Lawin” last week. DSWD Secretary Judy M. Taguiwalo said that among the factors that ensured this preparedness were the preemptive evacuations; the pre-positioning of goods; the communications system established and the constant communication and contact with the areas affected by the typhoon. She added that the preparedness efforts were led by the Office of the Civil Defense (OCD) and the Department of Interior and Local Government (DILG). Taguiwalo cited that advanced preparations and proper coordination are very essential in responding to any emergency situation. “It has to be emphasized that advanced preparations have been very important — our swift and coordinated response within the DSWD and with the other agencies under the National Disaster Risk Reduction and Management Council (NDRRMC) is the key to our efforts to immediately address the needs of Filipinos affected by typhoon Lawin. We are attacking and resolving challenges we are now encountering in our goal to help Filipinos one at a time. The scope of the damage is very wide, and so are the entire areas affected. We will pursue our efforts to extend assistance to as many affected Filipinos and their families as fast and as efficiently as we

can,” she said. She also stated that coordination with local and regional government leaders and units had also been crucial to the response efforts. She said that the Regional Disaster Risk Reduction and Management Councils were convened immediately after the typhoon despite the fact that information was slow in coming from the affected localities. “The DSWD was able to give direction to the response clusters and lead them on how they should work,” she said. In line with this, she said that they continue to seek ways on how to improve further as they go and see areas of work that are weak and need to be strengthened. “Our conclusion is basic -- we at the DSWD must go down to the field, speak to the people if the steps we are proposing are also what they need. We have to do this to ensure the validity of our data on which we base our plans,” she said. The DSWD Chief also expressed thanks to DSWD’s long-time partners in the private sector for all their assistance. Among these partners were the 7-Eleven chain of convenience stores that provided snacks and other forms of assistance to DSWD personnel and volunteers assigned to repack relief goods at the National Resource Operations Center (NROC) in Pasay City. Duterte urges Japanese businessmen to keep their confidence in PHL MANILA, Oct. 26 (PNA) – President Rodrigo Duterte on Wednesday urged the Japanese businessmen to maintain their confidence in the Philippines as he promised to work hard to improve the business environment in the country. ”I would like to have your continued confidence in our country. I would like to have our thrust imbued with what we are trying to achieve,” President Duterte said in a speech he delivered at the luncheon hosted by the Japanese business organizations at the Prince Park Tower Hotel in Tokyo, Japan. Duterte said he would continue to value Japan’s support to Philippines’ industries and development initiatives, particularly on the areas of strategic importance to economic growth like automatic sector, manufacturing, small and medium entrepreneurs, industry services and human resource development. ”And for Japan, let me affirm the police that will allow investments whether foreign or local to help us grow in our country,” the President said. ”We would be particularly supportive of industries that would give the jobs and livelihood opportunities for our people,” he added. These were flood victims were promised by the then Aquino administration in 2013 that they will be given from P10,000 to P30,000 cash aid as provided by the government The reported failure of flood victims to get cash assistance from the government for so long has infuriated DSWD Secretary Judy Taguiwalo that she asked President Duterte to initiate an investigation regarding the alleged widespread exclusion of thousands of people whose houses were destroyed by the super typhoon in 2013, and as to how the millions of

people funds have been used. According to a report submitted by DSWD Secretary Taguiwalo, the flood victims were excluded from the lists of ESA recipients because they were not part of the political groupings allied with the Aquino administration. Although the national government has released a total of P93.8 billion to the flood stricken areas of Western and Eastern Visayas, thousands of flood victims are still waiting up to this time to receive their ESA as promised to them by the Aquino administration.

The failure of DSWD officials to carry out their jobs in assisting Filipinos in dire need of help only highlights the insensitivity and incompetence of the Aquino administration in dealing with emergency situations. All former officials of the DSWD during the administration of former President Noynoy, particularly former DSWD Secretary Dinky Soliman, who misused or abused the millions of funds intended for typhoon Yolanda victims must be held accountable, and if found guilty, should be locked up in prison. As of last year, the DSWD still has P1.16 billion cash donations intended for Super typhoon Yolanda victims. I do not know any other reason why the Aquino government withheld the funds for so long that it forced the flood victims to live in makeshift shanties or tents in various relocations areas in the Visayas region, particularly in Tacloban city. This is all about politics. Secretary Taguiwalo, on the other hand, has given thousands of flood victims in the Visayas region something to hope for when she gave them assurance that the remaining funds will all be given to flood victims, provided they show proof and documentation that they have not yet gotten their ESA. It was also reported that the DSWD has formulated new policies and guidelines to safeguard all funds for the intended recipients. One new guideline that is worth mentioning is the immediate awarding of ESA to all qualified typhoon victims. She disclosed that there are still millions of unspent funds from foreign donations. She gave assurance that all unused typhoon Yolanda cash donations will all go to the people stricken by the super typhoon.

Taguiwalo said this is a vindication and justice for all typhoon Yolanda victims, although she said it is very late in coming. *** While the DSWD under Secretary Soliman was incompetent, slow and selective in giving assistance to typhoon victims , Secretary Taguiwalo is the exact opposite. Three days after Super typhoon Lawin devastated large areas of Northern Luzon, Secretary Taguiwalo immediately ordered the release of ESA to flood victims for them to speed up the rebuilding of their damaged houses. For a start, Taguiwalo said a P5,000 in cash will be given to all typhoon victims in stricken areas who are in need of immediate shelter assistance , whether their houses were partially destroyed or totally destroyed. Wow! very impressive.President Duterte must be very proud of appointing Taguiwalo as head of the DSWD. At least she is very efficient and responsive as well as effective in the fast delivery of assistance to Filipinos in distress from all forms of calamities. President Duterte should also be commended for rushing straight to some of the typhoon devastated areas in Northern Luzon a day after he arrived from China. President Duterte was also able to get a P90 million in aid from the Chinese government intended for victims of super typhoon “Lawin” which devastated large sections of Northern Luzon. Duterte also gave assurance that the P90 million aid from China was given to the Philippine government without any pre conditions. He said that the aid was given by the Chinese government voluntarily out of kindness from their hearts.

Is reverse mortgage good for me? A reverse mortgage is a loan against the equity in the home that provides tax-free cash advances, but requires no payments during the term of the loan. Salmonella superbug discovered in Australia for the first time MELBOURNE, Oct. 27 (PNA/Xinhua) – A highly drug-resistant strain of salmonella, dubbed “superbug,” has been discovered in Australia for the first time. The salmonella strain, which was discovered by researchers from Western Australia’s Murdoch University, was found in a pet cat and is resistant to carbapenems, a type of antibiotic used to treat infections in hospital patients. Sam Abraham, the leader of the study from Murdoch University, said the rare and unusual superbug could pose a serious threat to public health. “This is the first time that a salmonella strain with resistance to most drugs has been reported in any Australian domestic animal and it is a significant concern to public health,” Abraham told the ABC on Thursday. Abraham said the strain of salmo-

nella in the cat, which came from a pet shelter in Sydney, had picked up an antibiotic-resistant piece of DNA. “What makes this bacteria a superbug is because it has picked up a piece of DNA that gives this bacteria super powers or resistance to about nine classes of drugs that we usually use to treat humans and animals,” he said. Tests revealed that three other cats at the veterinary clinic that the original feline was admitted to with a serious gut infection had also contracted the bacteria, indicating it is highly transferrable. “Transferability is a major problem. If this drug-resistant bacteria spread outside of this facility, there would be other implications of humans and other animals exposing themselves to this bacteria,” Abraham said.

Air pollution may damage blood vessels even in healthy young adults: study WASHINGTON, Oct. 26 (PNA/ Xinhua) – Air pollution may cause blood vessel damage and inflammation, even in healthy young adults, a U. S. study said Tuesday. Air pollution is known to contribute to cardiovascular disease and related deaths, but it remained unclear how air pollution actually affects the blood vessels to increase the risk of disease. For this study, investigators analyzed the component of air pollution known as fine particulate matter (PM2.5) -- the tiny pieces of solid or liquid pollution emitted from motor vehicles, factories, power plants, fires, and smoking.

Study participants included 72 healthy, nonsmoking, adults in Provo, Utah, where the unique weather and geographical features periodically result in air pollution. During the winters of 2013, 2014, and 2015, these young adults, with an average age of 23, provided blood samples, which researchers then tested for markers of cardiovascular disease. They found that periodic exposure to PM2.5 was associated with several abnormal changes, including a significant increase in the number of small, micro-particles that indicate cell injury and death.

Aquilina Soriano Versoza: A journey from the reel world to the real world By Abner Galino

A 13-year old Filipina girl who played the role of a spoiled and profligate daughter of a Filipino dictator in a 1989 Hollywood movie turned out to be the complete reverse of that character later in her real life. That girl dropped her pursuit of a career in the reel worldof showbiz for the angst and strains of social participation in the real world. She turned into a full-time welfare and rights advocate for the Filipino American community. Well, who would have thought? Aquilina Soriano Versoza, who was Lily Marcigan in the comedy film Troop Beverly Hills, was recently honored by the Los Angeles County Board Supervisors for his “invaluable contribution to the community.” “No regrets,” Versoza said, acknowledging that her life would have turned out quite differently, though not necessarily for good, had she pursued an acting career rather than community service. “But this is where I found fulfillment, there is where I found my passion,” Versoza said, referring to her 20 years as a community organizer and rights advocate. She has been executive director of Pilipino Workers Center (PWC) for the past 16 years, a non-profit organization dedicated to assisting workers and their families. PWC is a standout organization. In cooperation with the Little Tokyo Service Center (LTSC), the non-profit organization is credited for building the Larry Itliong Village at the corner Glendale Boulevard and Rockwood Street, right within the Historic Filipinotown (HFT). The building hosts 44 low-income households. It was named after labor leader Larry Itliong, who was among those who initiated the famous Delano

Grape Strike in 1965. The building also houses the PWC office and has become a distinct edifice that brings Filipino visibility in the historic neighborhood. The five-storey building is walking distance to downtown Los Angeles and provides an unobstructed view of the Los Angeles skyline to its residents. It is arguably a real estate gem. It was opened in 2013 after ten years of working to acquire the property, clean it up and construct the building. They spent $2 million just to clean up the soil, as there used to be three oil rigs operating in the property. Versoza’s conversion from a Hollywood hopeful to a distinguished Filipino American community leader didn’t seem like a forestalled fate. She had no connection with her ancestry when she was growing up and she didn’t speak Filipino.She was born in Omaha, Nebraska and grew up in mostly white suburbs. “All I had were the photographs of the people from the Philippines that my father had shown me,” Versoza recalled. Versoza’s father was a Filipino who was raised by a white couple. Her mother was an offspring of a German and a Japanese couple. Interestingly, Versoza physically turned out to look every inch a Filipina. “I guess the mix of a German and a Japanese also looks like a Filipino,” Versoza jested. Versoza’s meaningful interactions with fellow Filipino Americans took place at the University of California Los Angeles (UCLA) where she became involved with issues on racism, immigration, environment and other political issues. She became a member of the Kilusanng Progresibong Kabataan on campus.

Together with several other students, Versoza was arrested in 1995 during a civil disobedience action against California Governor Gray Davis in relation to Proposal 187, an anti-immigrant initiative. Versoza later on dropped out from UCLA and flew to the Philippines where she immersed herself in the communities of the poor, including the Mangyan community of Mindoro. She stayed there for a year. “Doon ako natuto mag-Tagalog (That’s when I learned to speak Tagalog),” Versoza said, taking pride at her ability to speak Tagalog fluently although with a deep American accent. At that point, it was already clear for Versoza that her chase for a Hollywood star was over. She went on to finish her studies at the UCLA and decided to become a full-time community organizer. Her Hollywood stint wasn’t totally

useless for her though as it was able to pay for her college education. “I didn’t have any debt when I graduated but still I needed to sleep on friends’ couches as I pursued this path,” Versoza intimated. Versoza’s acting, singing and dancing prowess did not actually went down to the dustbin, either. “I still put them into good use. My ability to be at ease with the public helps me a lot in my public speaking. I still dance and sing on occasions, and for meaningful purposes,” Versoza said. Versoza married another Filipino and they have two daughters who are now about her age when she was starting out a career in Hollywood. By now, showbiz has obviously closed its doors for Versoza. But who needs to shine like a star when one could be more useful to others by simply shining like lantern on a dark alley?
