Duterte to rid of corrupt government agencies DAVAO CITY, Sept. 21 (PNA) – President Rodrigo Roa Duterte said that corrupt government agencies will soon be history. Speaking before a gathering of local officials at the Sulong Pilipinas local governance series held in Lanang on Tuesday, the President issued the pronouncement following his appointment of former police general Jose Jorge Corpuz as chairperson of the Philippine Charity Sweepstakes Office (PCSO), which he said tops the list of government agencies being bled dry by corrupt officials. He said he has tasked Corpuz to conduct a top-tobottom overhaul of the PCSO and weed out scalawags in

the agency found to be engaged in nefarious activities in connivance with other government officials. President Duterte said that with the installation of Corpuz as the new PCSO chief, he’s optimistic that the agency will be brought back on track. “I hope things will improve. But sinabi ko you have to make a study. If I am not satisfied that it can really prevent corruption, I will recommend the abolition of the PCSO,” the President said. MANILA, Sept. 22 (PNA) – President Rodrigo Duterte said Thursday he will visit China within the year to ask them to return to the Philippines its fishing rights in the disputed West Philippine Sea (WPS). ”One of the things that I would demand if I go to mainland China is give us back our fishing rights,” Duterte said in his speech during the inauguration of the Filinvest Development Corp. Misamis Power Plant in Misamis Oriental. President Duterte said he has no plan to ignore the UN international arbitral tribunal’s ruling in favor of the Philippines’ arbitration case filed against China’s nine-dash line claim that almost covers the entire South China Sea. ”This piece of paper that we have our award, we do not go out of the four corners of this paper. Are you in Chapter 13 repayment plan? Our office get many questions on the consequences of being in a Chapter 13 repayment plan. Here are a few more: Q: Can I sell a car which secures a debt being paid by my Chapter 13 plan? A: The short answer is “yesâ€?, but it may not be practical. If you do sell a vehicle which is being paid by the plan, the debt secured by the vehicle will no longer have to be paid in the plan. However, payments will still go to the secured creditor unless you modify the plan. You may ask that your plan be modified to remove the car payment, which may allow the plan to be reduce in length or the amount of payments. Even if you modify your plan, you will still be required to contribute your disposable income to the plan during the first 36 months. It has been our experience that it is usually not practical to sell a vehicle being paid for by the plan. It is rare that a vehicle is worth more than the balance owed on the loan. In order to sell the vehicle, the full balance owed to the creditor must be paid—not the reduced amount that must be paid to the creditor under the plan. The full balance is greater than a buyer would be willing to pay. If you decide that you no longer want the vehicle, it is generally possible to give it back to the creditor even if you cannot find a buyer. In that case the plan can usually be modified to remove payment of the vehicle from the plan and possibly reduce the length of the plan or the amount of the payments. Q: Can I pay off my Chapter 13 plan early? A: You can pay ahead a few months on your plan without any problems. Whether you can pay the entire balance of you plan off depends on how many months you are into your plan, and how much of the debt your plan actually pays: You can if your plan pays off 100% of all of your bills. If your plan pays all of the creditors 100% of the debt, you can pay off your plan at any time. Most Chapter 13 plans significantly reduce the amount of money you have to pay back to creditors in order to discharge all of your debts. You may not be able to if you have completed less than 36 months of your plan. If you have completed less than 36 months of your plan, the Chapter 13 trustees may object to an early payoff. This is because § 1325(b) of the code allows the Trustee and unsecured creditors to require that debtor pay all of their projected disposable income for three years into the plan. The trustees that object to early payoff believe that they should be able to increase the amount paid into

the plan if the debtor’s disposable income increases during this three year period, and if an early payoff is allowed they will not be able to do this. However, a number of cases supported the granting of a discharge where the plan has payments are made earlier than the 36th month: Matter of Casper, 154 B.R. 243 (N.D.Ill. 1993) [Debtors discharged their obligation under plan by paying to trustee sufficient funds to cover the 10% owed on unsecured creditors’ claims as provided by plan; trustee’s subsequent motion to modify plan was denied.] In re Smith, 237 B.R. 621 (Bkrtcy.E.D.Tex. 1999) [Debtor was entitled a discharge once she used gift from her family to make lump sum payment of all monies due and owing and expected to be paid under her plan even if received several months before minimum 36-month term of plan.] In re Easley, 205 B.R. 334 (Bankr.M.D.Fla. 1996) [Debtor moved to accelerate plan payments, using money loaned by debtor’s parents and the Trustee objected. The court held that debtor was not required to increase plan payments with loaned funds.] Matter of Koerperich, 5 B.R. 752 (Bkrtcy.D.Neb. 1980) [Debtor who files a zero-payment plan has completed the “payments under the plan� and is eligible for a discharge.] Since the bankruptcy reform act of 2005, Courts have been willing to allow debtors to refinance their properties and use the funds to pay off chapter 13 plans early. However, there are many interpretations of the rules involved, and it also varies from Judge to Judge. Ask your attorney to be sure. If you are in the 36th or later month of your plan, the Chapter 13 trustees will usually accept payment of the balance of the plan payments at any time. US sends 2 B-1B bombers to S.Korea after DPRK’s nuke test SEOUL, Sept. 21 (PNA/Xinhua) – The US military on Wednesday sent two strategic bombers to South Korea in a show of force against the Democratic People’s Republic of Korea (DPRK) over its latest nuclear test. Two B-1B Lancers flew low over the Osan Air Base in Pyeongtaek, some 70 km south of capital Seoul, at about 1:10 p.m. local time (0410 GMT), according to local media reports. The supersonic bombers had made a sortie from the US air base in Guam. One of the two bombers returned to the Guam base after the fly-over,

but the other unusually landed in the Osan base. How many days the US supersonic bomber will stay in South Korea is unknown. On Sept. 13, the US military dispatched two B-1B bombers to South Korea, but all of them returned back to the Guam base right after flying low over the Osan base for about 10 minutes. The armed protests came after the DPRK said on Sept. 9 that it successfully conducted an explosion test of nuclear warhead to fit on ballistic rockets. The fifth nuclear test was staged just eights month after the

fourth in January. The fifth test was seen as the most powerful nuclear detonation ever by the DPRK as it produced an explosive yield of 10 kilotons, stronger than 6 kilotons recorded in the previous test. Pyongyang said Tuesday that it tested an engine jet on the ground of a carrier rocket for geo-stationary satellite, which Seoul military saw as a long-range missile. The DPRK is expected here to launch a new long-range rocket at or around Oct. 10 to mark the 71st anniversary of the founding of the ruling Workers’ Party of Korea (DPRK).

PHL/Russian officials meet to explore military-technical cooperation

MANILA, Sept. 21 (PNA) – The Department of Foreign Affairs (DFA) on Wednesday said officials from the Russian Federal Service for Military-Technical Cooperation (FSMTC) briefed the Philippine Embassy in Moscow on the different aspects of possible Philippines-Russia military cooperation, including the acquisition of Russian military equipment and technology. The FSMTC is a federal agency directly under the Office of the President of the Russian Federation responsible for control and oversight in the field of military-technical cooperation between the Russian Federation and foreign countries. The DFA statement said those who briefed the embassy officials were Sergey I. Buganov, Chief of the First Department on Military and Technical Cooperation with Foreign States, and Valery A. Orel, Chief of

the Section on Military-Technical Technical Cooperation with Countries of the Asia-Pacific Region. Philippine Ambassador to Russia, Carlos D. Sorreta, and Third Secretary and Vice Consul Luningning Camoying, the Political Officer of the Embassy. “We welcomed the briefing, which was quite revealing, particularly as to the extent that Russia is able to interact with a large number of countries in this field and the different mechanisms that are employed, including in terms of the acquisition and transfer of Russian military equipment,” Ambassador Sorreta said. “This is all part of our job to explore opportunities that could contribute to our government’s efforts to modernize our defense capabilities,” he added. During the briefing, also taken up were the issues of training, after-sales service and maintenance,

transfer of technology, investment in domestic military production and servicing, and different modes of financing. Russia sells military equipment and military-related equipment to a host of nations, from highly developed countries like the United States to developing nations like India, Malaysia, Thailand and Viet Nam. The Pentagon announced earlier this year that the U.S. will buy up to 18 more Russian-built RD-180 engines to power rockets carrying U.S. military satellites into space over the next six years. The briefing followed the recent visit to Moscow of a Department of National Defense Delegation led by Undersecretary for Finance and Materiel, Raymundo De Vera Elefante, which met with top Russian defense officials, including officials of the FSMTC.

PAF in the market for S-211 MFD spares MANILA, Sept. 21 (PNA) – The Philippine Air Force (PAF) has allocated the sum of PHP7,329,000 for the procurement of spares needed for the repair and installation of multi-function display (MFD) of one of its of three SIAI-Marchetti S-211 jet trainers. An MFD is a small screen (CRT or LCD) in by multiple soft keys (configurable buttons) that can be used to display information to the user in numerous configurable ways. MFDs originated in aviation, first in military aircraft, and later were adopted by commercial aircraft, general aviation, and automotive use. Gang leaders claim raising funds for De Lima’s senatorial bid By Filane Mikee Z. Cervantes

MANILA, Sept. 21 (PNA) – Gang leaders on Wednesday appeared before a House of Representatives’ panel to further pinpoint the alleged involvement of Senator Leila De Lima in the illegal drug trade in the New Bilibid Prison (NBP). During the House Justice Committee’s inquiry into the proliferation of illegal drugs inside the national penitentiary, Noel Martinez and Jaime Patcho, who are both gang leaders, testified that fellow inmate Jaybee Sebastian asked them separately to raise campaign funds for then Justice Secretary De Lima. Martinez, commander of Genuine Ilocano Group with 2,200 members, said he was approached by Sebastian in February 2013 to fund De Lima’s senatorial bid in exchange of protection and preferential treatment. Sebastian further revealed to Martinez his plan to centralize drug operations inside the NBP through forging alliances with gang leaders. Although Martinez declined being directly involved in the drug trade, he referred persons outside the NBP who can sell the illegal substances. Martinez also handled the remittance of drug money to Sebastian. ”Hiniling ko na lamang kay Jaybee, at siya ay pumayag, na ako ay magri-reto na lamang sa kanya ng mga pwedeng magbenta sa labas ng Bilibid (I requested Jaybee, which he accepted, to allow me instead to refer people who can sell (drugs) outside the Bilibid),” Martinez said. ”Lahat ng transakyon nila ay alam ko dahil sa tuwing nagdedeposito sila kay Jaybee ay itinitext nila sa akin ang detalye. MANILA, Sept. 21 (PNA) – To put illegal parking syndicates out of business in the Capital City and clear the major roads to improve traffic flow, Mayor Joseph “Erap” Estrada is re-intensifying his drive against illegal parking that he said has become a milking cow for profiteering syndicates. An angry Estrada said on Wednesday said that he will launch the Manila-wide Mapping and No Parking Zone program that involves the strict enforcement of the city’s policies against illegal parking. All major roads and barangay streets are covered by the mapping to ensure that all possible alternate routes are not blocked. “Illegal parking has long been a serious problem, congesting our already congested roadways. This is so because it is being tolerated and has become the money-making business of criminal syndicates that earn millions from charging illegal parking fees to motorists,” Estrada said. Aside from Taft Avenue, Estrada said other roads used as “parking lots” by undisciplined vehicle owners are United Nations Avenue, Lawton, Mendiola, Morayta and San Miguel. On Sept. 15, Estrada has earlier declared Rizal Avenue as a no parking zone after a thorough clearing operation that resulted to the impounding of 30 illegally parked tricycles, five motorcycles, 15 light vehicles, and two “kuligligs” or motorized pedicabs. A parking fee collector was also arrested for charging illegal fees to

vehicle owners. Estrada said the revived anti-illegal parking campaign will complement the ongoing road and sidewalk clearing drive of the city government whose main objective is to clear up precious road space that have been encroached upon by illegal vendors and other obstructions. The anti-illegal parking operation is being spearheaded by the Manila Traffic and Parking Bureau (MTPB) headed by former city councilor Dennis Alcoreza. “By citywide mapping, we will clearly identify which areas are the designated parking zones and those that are not. If the street you have parked on is a ‘No Parking Zone’, automatic, huhulihin ka,” Alcoreza pointed out. Alcoreza added the real objective is to deny the vehicle owner any excuse or alibi on why he parked in a non-designated parking area. “Illegal parking is rampant, including perpendicular parking, double parking, marami kasing kumikita, and generally motorists that have no garage for their vehicles,” the MTPB chief lamented. Alcoreza warned that violators will have their vehicles towed or be issued with traffic citation tickets based on the provisions of the Manila Traffic Code and illegal parking regulations of the Metropolitan Manila Development Authority (MMDA). Portion of NAIA Expressway now open to motorists By Aerol John B. Patena

MANILA, Sept. 22 (PNA) – A part of the Ninoy Aquino International Airport Expressway (NAIAX) was opened to motorists early Thursday which will ease traffic around the airport complex. In an advisory, the Inter-Agency Council on Traffic (I-ACT) stated that the toll is free for the first month of the opening of Phase2-A of NAIAX. The first phase of the PHP17.9-billion NAIA Expressway under the public-private partnership (PPP) program will link Macapagal Boulevard near the Entertainment City to NAIA Terminals 1 and 2. The other segment of the toll road, which will connect NAIA Terminal 1 and Terminal 3, is expected to open on December 25.

Upon completion, the project is expected to provide easy access to and from the NAIA. “Traffic congestion in the NAIA complex will now be addressed with the completion of the NAIA Expressway,” Department of Transportation (DOTr) Undersecretary for Administration and Finance Garry De Guzman said during Wednesday’s House transportation committee hearings on the proposed emergency powers to solve the traffic crisis. The Department of Public Works and Highways earlier stated that the project is expected to cut average travel time between the Skyway System or South Luzon Expressway and the NAIA Terminal 1 to 8.2 minutes from approximately 24.3 minutes at present which will benefit around 80,000 travelers per day.

Tokyo, Paris top list of most preferred destinations for Chinese outbound travel CHONGQING, Sept. 21 (PNA/Xinhua) – Tokyo and Paris are the most preferred tourist destinations for Chinese short-distance and long-distance outbound travels, respectively, according to a report issued by the World Tourism Cities Federation (WTCF) at its meeting held in Chongqing Municipality in southwest China. The WTCF report says that Chinese tourists spent USD215 billion during their overseas travels in 2015, accounting for 17 percent all consumption by international customers. More than 120 million Chinese tourists made overseas trips in 2015, up 10.09 percent year-on-year. America, Japan, the Republic of Korea, and Britain saw the biggest increase in Chinese tourists in 2015. Paris, Rome, Los Angeles, Sydney, London, Venice, Washington, New York, Florence and Frankfurt were the 10 most favored long-distance destinations. The report said that the strong growth of China’s outbound tourism has contributed substantially to the world’s tourist market. Cheng Hong, deputy mayor of Beijing, was named WTCF executive vice president at the two-day meeting, which closed Tuesday. WTCF is a non-governmental organization established in 2012. It now has a membership of 172 cities.

Am I the only one having difficulty in deciphering utility bills? On my recent At & T home phone monthly statement, I was appalled by the sudden increase of my home phone or landline bill from less than $50.00 to almost $80.00 (an increase of around $30.00). To my surprise, on the statement’s front page is a summary of “Combined Communications Services,” which listed the following: Metro Plan, Caller ID, Call Waiting, Call Forwarding, Call Return, Call Screen, Priority Ringing, Select Dial Forwarding, Speed Calling, Three Way Calling, Unlimited National Clg Advantage, Caller ID Selective Blocking and 900/978 Blocking, totaling $57.00 in monthly services. I’m even clueless as to the difference between a “Caller ID” and a “Caller Screen,” and I actually DON’T even care to have the rest of the above listed “Combied Communication Services,” which according to the Customer Service Rep comes as a “standard package INCLUDED” in a regular phone service. Much like the saying that goes: ‘if you don’t ask, you don’t get,” I furiously called their supposed

Customer Service number shown on the second page under “Important Information.” The number stated there was: “800/288-2020 OR visit att.com.” Upon calling that particular number, I found out that it was a DIRECTV number. and not AT & T. So, upon more research, I found out that I had to call: 877/377-0415 for AT&T’sCustomer Service. While speaking with the same Customer Service Rep, I requested him to pull up my home phone history payments and asked him the reason why my bill was increased and also pointed out all the unnecessary service charges I didn’t need. Though he argued that all the services listed were standard inclusions on all monthly phone statements, he

readily DECREASED my bill to less than $50.00, which was the standard monthly payment I’ve been used to, since I had my phone installed ten years ago. Thank goodness, I kept my monthly records in a place where I can compare previous statements with current ones. Therefore, this to me, was a lesson learned: all of us should take time to read our monthly statements, and to make sure we’re not being billed for unnecessary services. Cable service statements also present other problems. Here is another situation where consumers like us should keep up with changes in our utility services. Recently, I also received another utility monthly statement from DirecTV for the month of August.. Due to a roof construction on our building the month prior which took around a week, from August 13th through August 18th, all of us who lived in the building were without cable services for the whole week. Gladly, a week had passed and a DirecTV technician came to re-install our satellite disks

as three of us building tenants had DirecTV services. Upon receipt of my monthly statement, I was surprised to see that there was NO indication that I was WITHOUT cable service for a week, and I was billed the normal amount I was paying. Much like my AT & T problem, I called and spoke with DirecTV’s Customer Service Rep and he readily acknowledged their error in not giving me credit for a week’s loss of cable service. To some people, this might not be a big of a deal, but for people like us, it’s the principle behind it that counts. Once again, as mentioned previously, the same saying applies: “if you don’t ask, you don’t get.” As consumers, we’re grateful to these utility service companies for helping us go through our daily lives, in these modern technological times, though we also have to learn to speak up when these same companies overlook discrepancies in their services. Only then can we trust them and not feel that we’re being taken advantaged of.

AAAJ hosts Pan Asian Citizenship “National Citizenship” Day event By Myrna Aquitania

Last Saturday, November 17th, Asian Americans Advancing Justice (AAAJ), the marketing arm for “Endless Possibilities. Citizenship Now” media campaign, through the sponsorship of the California Community Foundation, hosted a Pan Asian “National Citizenship” day at the East Los Angeles Community Service Center. The event was in partnership with Bank of America, Citibank, Hope Depot, UPS and other community-based organizations such as the Alzheimer’s of Greater Los Angeles. According to the Honorable Mike Eng, lawyer, former Assemblymember and Board of Trustee of the Los Angeles Community College, there are “an estimated 300,000 Asian immigrants eligible for U.S. Citi-

zenship. Of this, more than half, or 165,000 live in the Los Angeles County area alone.” Mr. Eng further explained that the “Endless Possibilities” campaign is focused on promoting the benefits of applying for citizenship to those Asian immigrants who are unaware of the various benefits on becoming U.S. citizens, such as: the ability to petition parents, or parents petitioning for their married or unmarried children. and brothers or sisters alike. He also emphasized that the best time to apply for this privilege is now that its election time, so when they become citizens, they can exercise their privilege to vote during the upcoming election and thus, give them the honor of being counted in a collective voice in the community. Project Director of AAAJ, further explained that AAAJ offers FREE citizenship services to assist “seven Asian languages (Chinese, Korean, Filipino, Japanese, Taiwanese, Cambodian, etc.) to nearly 150 individuals seeking U.S. citizenship, “ and that there are “volunteer lawyers and BIA accredited staff trained according to the United States Citizenship and Immigration Services (USCIS) standards, who are able to provide screening eligibility and guidance on securing fee waivers if necessary, as well as legal assistance for those eligible.” In addition, Nasim also explained that “U.S. citizenship protects immigrants from deportation; it also provides access to better jobs and increased income, as well as it qualifies family members for immigration to the United States.” In closing, she said that Los Angeles is home to more than 1 million people who speak an Asian language and through the “Endless Possibi-

lites” campaign, AAAJ hopes “to empower those whose native language is not English, to take the first step towards U.S. citizenship and to make sure that each applicant are made aware that they will be supported throughout the entire process, by people they can trust with their private and confidential information.” During the event, Nasim led us on a tour of the first floor facility, where there were around 200 applicants being screened and interviewed at the community workshop room, for eligibility. The screening room was divided by ethnic Asian language groups such as: Chinese, Korean, Vietnamese, Filipino, Japanese, etc. We were then finally ushered to the second floor, where volunteer lawyers do the intake and consulting with applicants in order to guide and assist them through the citizenship application process. Clients choose chapter 13 to avoid risk of losing house to chapter 7 trustee on steriods The first case involves clients who are still young. By young, I mean less than fifty, late forties. They have teenage children, one son, and two daughters. Their household income is about $75K a year. Husband used to work two jobs as a technician, while wife used to own a retail business, now defunct. She still makes some money but hardly enough to pay for her $68K of credit card debt. She racked up this debt when she used these cards to support a failing business, just to keep the business afloat for two more years. Husband owes only $20K of credit cards. Together, clients owe about $90K of credit cards. Minimum monthly payments are almost $3k a month. Needless to say, wife’s cards are now all past due, while husband’s cards are still current, as a last ditch effort to hold the fort, the same thing that Gen. Custer did. Thinking he could protect the fort, the Indians won and Custer died. Three Indian tribes, the Lakota, Cheyenne and Arapaho decimated the 7th cavalry of Gen. Custer, which had 700 men. Custer and his two brothers died in the battle of ‘Little Big Horn� in 1876. So, I’m not so sure if it’s a good idea to take a last stand to try to pay $90K of credit card debt when clients’ household income, although decent at $75K a year, because there is no way mathematically for clients’ to pay $90K of credit card debt with minimum payments. These cards will never get paid in clients’ lifetime, unless they win the power ball lottery. Dream on. The chance of winning power ball is 1 in 292 million. You have a better chance of getting hit by lightning, twice, than winning power ball. After a little probing, I determine that clients want a Chapter 7 to wipe out all of the $90K credit cards. The problem is that their residence has about $130K of equity. It has a cur-

rent fair market value of $450K and they owe about $320K on it. It this was four years ago, they could easily sail through a Chapter 7 without the risk of losing their house to an aggressive Chapter 7 trustee. Of course, their homestead exemption is $100K plus about $25K for cost of sale of the house, so there is no viable equity for the trustee to take, so there is minimal risk to the house. But there is a five percent chance that the trustee that gets assigned to clients’ case is the most aggressive Chapter 7 trustee when it comes to non exempt assets, particularly houses. If this misfortune should befall clients, this is just the worst thing that can happen to a Chapter 7 debtor with “borderline� exempt equity in the house, having to deal with a Chapter 7 trustee on steroids who is hell bent on selling your house for $1 of non-exempt equity. And even though debtors have the right to convert to Chapter 13 anytime, to escape the clutches of a Chapter 7 trustee who wants to sell their house, the right to convert is not absolute. This trustee will certainly oppose the conversion to Chapter 13. His trustee and legal fees to fight the conversion to Chapter 13 can easily reach $25K, and all of that $25K must be paid in full the Chapter 13 as priority Chapter 7 administrative fees. So even the trustee loses on the opposition, he still wins, because he still gets paid $25K in the Chapter 13 case. It doesn’t pass the smell test for fairness, but in reality, that’s the

way it works. I have one case now and we are fighting to keep debtor’s house in Chapter 7 (no conversion to Chapter 13) because debtor owes more than $1.0M of unsecured debt. We are fighting the trustee in an adversary case because this house doesn’t even have non-exempt equity but the trustee is making it appear that debtor lied under oath and now asks for denial of discharge to debtor. I just can’t believe what is going on in this case. But we are fighting it 100%, and in this case, we are the Indians. To avoid this kind of scenario altogether, it is safer for clients to choose Chapter 13. In Chapter 13, they can pay a small amount, maybe $300 a month for sixty months. After having paid $18,000 in sixty months with no interest, the difference between $90K and $18K, $72K will be discharged with the last payment on the 60th payment. This means that clients will pay 20% of their $90K credit cards over 5 years with no interest, the court will discharge 80% of $72K on the 60th payment. In Chapter 13, there is no risk of clients’ losing their house to the trustee because Chapter 13 trustees do not have the power to sell houses. On the other hand, Chapter 7 trustees have the power to sell your house if there is viable non-exempt equity. To avoid the hassle of dealing with an over aggressive Chapter 7 trustee and risk losing their house, clients chose to file Chapter 13 and pay 20% of their credit card debt. And may I add, this is the right choice because there is no risk to the house which they want to keep, and $300 plan payment is certainly a lot less than $3K a month for minimum payments that never end, with a bright light at the end of the 60th payment when $72K is discharged by the court! In 5 years, clients will owe zero unsecured debt, and they will still have their house, which may then have

$200K of equity if Hillary Clinton becomes president. I’m with her. We are stronger together. Second client is a young senior. She is only 55. Divorced ten years ago. Now lives by herself. She used to be a happy camper with a $40K yearly salary. But she lost that job last year. She is stuck with $22K of credit card debt. She pays $900 a month for these cards to keep them current. But her savings are quickly diminishing. When it’s a choice between paying $900 of rent which lets her have a roof over her head for a month, or $900 to mastercard and visa, given the fact that she now has no income, it’s really a no brainer. The $22K of credit cards has to be discharged. She chooses Chapter 7 to achieve this goal. \ Her credit score will go up pretty fast since she still pays for a car. In two years her credit score will be about 620. Within a couple of months of getting her discharge, she will get new credit cards mailed to her. Some credit cards specialize in giving credit to people who have come out of Chapter 7. Can I obtain a divorce if my spouse refuse to sign? There seems to be a misconception in the general public that you can only obtain a divorce in California if your spouse will sign the divorce papers. I get this question a lot from our family law clients. The fact is that California is a no fault state and you do not need your spouse’s signature in order to get a divorce. What is more important is being able to properly serve your spouse with the divorce petition and satisfy the jurisdictional requirement of the Court by showing that either you or your spouse resided in the State for at least 6 months prior to filing the petition and in the County for 3 months prior to filing the petition. When you file a divorce petition, you have to serve your spouse with the summons and petition. Your spouse then has 30 days to file a response after being served with a divorce petition. If your spouse fails to file and serve you with a response, you can file a request for default against your spouse after 30 days. You can also file a proposed judgment for the court to approve. The default procedure can be done even if there are issues of property division, custody, visitation, and support. However, the Court will still review your proposed judgment and property division to make sure it conforms to the policy towards equal division of community property. Meaning, you have to propose a division of community property that is pretty much equal between the spouses. If your proposed property division is one sided such as distributing all community property to you and giving all the community debts to your spouse, the Court would probably not grant your judgment. The Court would probably set a hearing for you

to explain why this is an equal division of community property. The only time you may need your spouse’s signature is if your spouse files a response to your divorce petition. This is called "contesting" the divorce. If your divorce is contested by your spouse, you can resolve the case either by "settlement" or by "trial." However, you do not have to settle all the issues in the case at once. Under the concept of divisible divorce, you can settle some of the issues and set the other issues which you and your spouse cannot agree on for trial. Our office try to resolve cases through settlement because it is more cost effective and the parties are usually happier with the outcome. In that situation, the parties may avoid the cost and uncertainty of going to trial by executing what is called a stipulated judgment which is in essence an agreement as to all the issues in the divorce case. For issues which you and your spouse cannot agree on, you will have to go through the litigation process which involves obtaining discovery, exchanging declarations of disclosures, and preparing the case for trial. Ultimately, you will obtain your divorce at trial in addition to adjudication of the distribution of community assets and debts amongst other issues. It is in the best interest of the party to retain the

MANILA, Sept. 21 (PNA) – The House of Representatives Transportation Committee has asked the Department of Transportation (DOTr) to specify the scope of the crisis in maritime and aviation sectors as hearing continues on the proposed emergency powers to solve the traffic crisis in Metro Manila and other urban centers in the country. The hearing focused on the congestion that currently occurs in shipping ports and airports in the country. “We intend to address traffic in relation to the maritime and aviation sectors,” said House committee chairperson Catanduanes Rep. Cesar Sarmiento.

He related that the committee is interested in looking into factors that lead to congestions in airports and ports. “For the maritime sector, are you referring to port congestion or road congestion of arterial roads supporting ports? For the aviation sector, are you referring to airport congestion or congestion in roads going to airports,” Sarmiento asked the DOTr representatives who attended the hearing. For his part, DOTr Undersecretary for the maritime sector Felipe Judan stated that the Department is studying the proposal to establish a truck holding area outside ports to decongest traffic.

CAGAYAN DE ORO CITY, Sept. 22 (PNA) – Firebrand Philippine President Rodrigo Duterte on Thursday called the European Union (EU) and the United States (US) “hypocrites.” Duterte made the statement after the ceremonial switch-on of the 405 coal-fired power plant in Misamis Oriental in Villanueva, Misamis Oriental. In his speech, Duterte said that the EU and the US, both highly industrialized countries, were trying to regulate the use of non-renewable energy sources in developing nations like the Philippines. “While the EU is hell bent on imposing the lowering of the carbon emissions, they also forget that they were the first to maximize the use of fossil fuels and the first to pollute the planet,” Duterte said. The President said that the EU was playing “double standards” when it wanted to control the carbon footprint when they themselves created the problem in the first place. He said the EU wanted the third-world nations to lower the emission of carbon in such a way that these countries could not move forward with their development agenda due to the energy protocols being set by the international environment-regulating bodies. “Kataw-ana ning mga puti (these Caucasians are ridiculous),” he said, referring to the EU and the US who had released statements condemning Duterte over the rising cases of extrajudicial killings in the country as a result of the government’s war on illegal drugs. Duterte, however, said that, at present, the use of coal in producing energy was the most viable option for the Philippines. “If we want to industrialize our country, because we are left behind by so many generations, we have to keep up with developments. [Coal plant] is the main option right now because is cheap, it’s available, although it may have an impact on the planet,” Duterte said. Duterte made the statement to a limited audience of 350 invited guests, during the inauguration of the 405-megawatt coal-fired power plant of the FDC Misamis Power Corp. ‘Sincerity’ cited as reason why ceasefire is working

MANILA, Sept. 21 (PNA) – Labor Secretary Silvestre Bello III has credited the sincerity of the Philippine government and the Communist Party of the Philippines (CPP)as the reason why the ceasefire between the two parties appears to be holding. “It is indicative of the sincerity of both parties in the (peace) process which augurs well for peace,” Bello, the government’s chief negotiator, said of the lull in fighting. With no encounter to breach the ceasefire, the peace negotiator is optimistic that a bilateral agreement would be reached and put in place when the second round of peace negotiations resumes on Oct. 4-10 in Oslo, Norway. The talks were originally slated for Oct. 8-12, but both parties agreed to move the date. It can be recalled that President Rodrigo Duterte restored a unilateral and indefinite ceasefire on the eve of the formal resumption of the peace talks with the CPP, the New People’s Army and the National Democratic Front (CPP-NPA-NDF) on Aug. 21 to create a favorable condition for the negotiations. This resulted in the NDF extending indefinitely its seven-day (Aug. 21-27) goodwill ceasefire. The move was lauded as “historic and unprecedented”, having been inspired by the release of 22 detained NDF consultants, the most number of prisoners released by the government to date. In the 30-year history of government peace negotiations with the CPP-NPA-NDF, the talks have been disrupted for at least 15 times. The breakdown in the talks was mainly due to two issues: the release of detained NDF consultants and declaration of ceasefire. With both issues addressed, the formal resumption of peace talks on Aug. 22-28 in Oslo was made possible. Ceasefire was one of agenda items taken up by both panels during the Oslo talks. Both parties agreed to submit drafts for the formal bilateral ceasefire agreement when negotiations resume first week of October. “Hopefully, this will ripen to a bilateral and permanent ceasefire and finally the end of hostilities,” Bello said. In close to 50 years of guerrilla war launched by the NDF, through its armed wing the NPA, more than 150,000 people have been killed in armed clashes and violent incidents. The Philippine military said the NPA has been reduced to less than 4,000 armed regulars scattered all over the Philippine archipelago. But in Oslo, NDF panel chief negotiator Luis Jalandoni claimed they have 10,000 armed regulars operating in more than 120 guerrilla fronts that cover more than 72 provinces. The formal talks between the government and the CPPNPA-NDF are entering the more substantive phase of the peace negotiations, with both parties submitting outlines and drafts on social and economic reforms and political and constitutional reforms in the next round. Both parties will also take up a proposed amnesty proclamation for all listed detained NDF members. The cessation of hostilities and disposition of forces will also be tackled simultaneously during the talks. The parties earlier agreed to accelerate the peace process with the government peace panel expressing confidence that a final peace agreement will be signed within a year.

A lying Senator?

Within a span of two weeks, embattled Senator Leila “lying” De Lima has delivered two privilege speeches in the Senate, hoping to solicit support and sympathy from the public in the face of serious allegations against her, among them that she made millions of pesos for being a drug coddler. Earlier, Senator De Lima even presented during a senate hearing on extra judicial killings, a self-confessed killer, Edgar Matobato, who claimed to be a former member of the dreaded “Davao Dearth Squad” being liked to President Rodrigo Duterte. Most senators, however cast doubt on the credibility of the self-confessed killer Matobato. Most probably, like so many people think, Matobato was put up by De Lima to testify against Duterte to deflect the negative publicity she is expected to get as a result of the on-going congressional probe on her alleged link with drug lords. De Lima has been trying her best to seek the support and sympathy of her fellow senators as well as the public amid serious allegations against her involvement in the illegal drug trade. She is claiming innocence of all the charges being leveled against her. It would be very difficult for someone to believe that an “adulterer” is an honest person. De Lima seems like she’s pretending to be lamb but actually the wolf. I am sure that if the public will be allowed to decide whether to convict or exonerate De Lima for her alleged major role in protecting big-time drug lords during her reign as Justice Secretary, the result will be a 95 per cent conviction. I listened briefly to her privilege speech and I almost puked. She started by saying that “Our nation is in crisis and in real danger posed by illegal drugs trade, including bribery and corruption of our public officials...” She however did not mention that the pro-

liferation of drugs in the country grew by almost 80 to 95 percent during the Aquino administration and during her term as Justice Secretary because they did nothing, and they allowed the illegal drugs business to flourish. She even had the audacity to lambast Duterte’s brand of Justice, for “disregarding” the rights of suspects to due process. She also said that the attack on her is also an attack on the Senate as an independent institution. What she forgot to mention, however, was that she too disregarded the rights to due process of former President Gloria Arroyo and her husband, Mike Arroyo when she was justice secretary. It may be recalled that despite the absence of any warrant of arrest issued against the Arroyo couple, De Lima personally prevented the Arroyos from leaving the country to seek medical treatment in the United States. With regards to her claim that the attack on her is also an affront to the Senate, she only has to blame herself for what she did to the trio of Senators Juan Ponce Enrile, Jinggoy Estrada and Bong Revilla. Although I sincerely believed that Enrile, Estrada and Revilla are all guilty of pocketing large portions of their DAP and PDAF allocations, De Lima should have given them their right to due process. But the tables have turned. She, however, claims that her defense against all allegations against her is her untarnished record and reputation as a public servant. How could De Lima claimed to have a good reputation as a public servant when she corrupted her driver/bodyguard to become her lover and live-in partner for years since her stint as chairperson of the Commission on Human Right (CHR) Liars and adulterers should not be allowed to serve in Congress because it will only erode farther the public’s trust among politicians.

On martial law anniversary: Labor group calls for justice for slain leader, victims of extrajudicial killings By Leilani S. Junio

MANILA, Sept. 21 (PNA) – The militant Partido Manggagawa (PM) called on Wednesday for a stop to the killings due to the war on drugs and justice for one of its leaders who was ambushed and killed in Cebu last Saturday. The call was made by PM as they joined the big mobilization of the coalition iDefend (In Defense of Human Rights and Dignity) Wednesday afternoon to commemorate the anniversary of the declaration of martial law in September 1972. “On the 44th anniversary of martial law, the struggle for human rights and democracy for all remains as relevant and critical as ever. With the war on drugs claiming thousands of lives and a state of lawlessness imposed on the whole country, civil liberties and democratic freedoms are under clear and present danger,” Wilson Fortaleza, PM spokesperson, said. Fortaleza added, “The prevailing climate of impunity that has resulted in wanton killings of alleged drug pushers and addicts has also provided fertile ground for politically motivated slayings.” He said that the ambush-killing of PM-Cebu leader and organizer Orlando Abangan a few days ago is testament to this. He noted that Abangan’s murder came after the killing of Gloria Capitan, an environmental activist in Bataan, last July 1, on the first official day in office of the Duterte administration. He warned that extrajudicial killings done

in the name of the war on drugs are spilling onto slayings of human rights defenders. The iDefend members started assembling at 2 p.m. in Bustillos Church in Sampaloc, Manila, before marching to Plaza Miranda in Quiapo for a mass and program. At 6 p.m., the group iDefend marchers lighted candles to commemorate the victims of martial law, the war on drugs and political killings of human rights defenders like Abangan and Capitan. Meanwhile, Fortaleza said that in Cebu, PM and other militant and human rights groups also held a rally on Wednesday to call for justice for Abangan and Capitan. The group also marched around downtown Colon in Cebu City to call for a stop to the killings and to never forget the terrors of martial law. “We call on the authorities for a swift but thorough investigation of the killing of ‘Ka Lando’ Abangan. We know that they are already pursuing leads that point to certain suspects. Still we urge them not to stop at the arresting suspected gunman but to probe who the mastermind is,” said Dennis Derige, PM-Cebu spokesperson. Derige insisted that ‘Ka Lando’ was not involved in drugs and was respected in his community as an activist. His group further stated they believed that the killing was politically motivated and related to his work as a human rights defender of urban poor and workers. He also revealed that five days before Abangan was shot to death, the latter escaped a first attempt on his life.

Filipino American director Marcial Chavez said the film is a mixture of drama and suspense. He said the movie would try to bring out some truths about the Filipinos in the US and dispel some myths about life in America. Chavez said the main character would realize at the end of the movie that “what he really wanted is to be back home.” Interestingly, American actors Olivia Hutlgreen and Ryan Walker who both play significant roles in the movie, both revealed that moving from one state to another state, to a certain degree, approximate transnational migration. “The idea of home, is what really struck a chord with me in this story. Because home is something that I think about all the time... and I originally come from Minnesota...which is in the midwest of this country,” Hutlgreen intimated. Hutlgreen said Los Angeles now

feels like home because of the people who embraced her and became part of her life. Ryan Walker, for his part, intimated that he also made a lot of adjustments when he settled in Los Angeles when he was only 18 years old. He said it took him some time to acclimatize and to know people. The actor added that he also got into negative situations in the past because he mistakenly got involved with wrong people. Another actor who plays a significant role in the movie, Craig Cooper, said the movie would also show the “ugly struggles” on both sides of the immigration divide. Cooper said the “and the love and openness of both sides to just act as humans and not look at it (immigration) as a problem” gave the movie a great touch. Stateside is on the last stage of production works and is expected to be in the theaters in January.

HUDCC Chair Leni Robredo to fast track Batanes housing rebuild Vice President and Housing and Urban Development Coordinating Council (HUDCC) Chairperson Leni Robredo met with the heads of the Key Shelter Agencies (KSAs) to discuss solutions for the victims of recent Super Typhoon Ferdie— which fortunately took no lives but nonetheless rendered the province of Batanes under a state of calamity. “Bagama’t walang namatay sa ating mga kababayan sa Batanes, marami naman ang nawalan ng tahanan at iyon ang gusto nating matugunan nang agaran at mabilisan,� Robredo said.

The proposed housing recovery strategy is to skip the transition from temporary housing to more permanent housing for the residents of Batanes. Robredo has previously noted the process for application of temporary housing relief is too long, with beneficiaries often receiving the temporary aid years after the storm hits. HUDCC has committed to ensure well-coordinated efforts from the six KSAs under its umbrella in the procuring of materials for construction, transportation of goods and warehousing. According to the Electrical Safety Foundation International, 2,400 children in the U.S. are treated for injuries caused by electrical outlets each year and nearly a third of parents with young children do not have their outlets childproofed. Southern California Edison has some tips on how to keep kids safe around electricity: – Talk to your kids in a way that is simple and easy to understand. In your home, electricity runs the lights, television, toaster and more. Electricity is a form of energy that travels through wires from power plants all the way into your home. How will a new president affect our real estate market moving forward? The current economy is in the midst of its slowest recovery in the past 50 years, judging by the minimal increase in real GDP and other modest growth metrics. Leaving many economists guessing what the longterm outlook for the U.S. economy might be. Inflation is at a check but what is almost certain to hit the RE industry would be higher borrowing interest rates. The economy seems to be doing fine after underlining that real GDP has increased by less than 15 percent from the start of the recovery in 2010, making this recovery the weakest in recent history. A major factor of this under par recovery is the single-family housing sector’s underproduction. While the sector has seen weakness before, in past cycles the housing market has bounced back to again become a driver of economic growth—but not this time. AS I have mentioned before a big piece of the market which is the “Move up

DONNIE “Ahas” Nietes, the longest reigning Filipino world champion, faced up yesterday with former World Boxing Council (WBC) light flyweight champion Edgar Sosa of Mexico during a press conference in the City of Carson. No aggression was seen from either Nietes or Sosa, but nevertheless, both boxers promised that their next meeting on Saturday at the Stubhub Center is going to be a rumble. Nietes (38-1- 4, 22KOs) and Sosa (52-9- 0, 30KOs) will be fighting for the World Boxing Organization (WBO) Inter-Continental flyweight championship. Nietes who will debut in the 122 lbs division gave up his WBO light flyweight belt because he is already having a hard time making the weight. The boxer said that he more relaxed and that he could more while training for a fight at the 112 lbs mark. But more than that, Nietes’ decision to fight in a higher division was his desire to be matched up with highly rated fighters. For his part, Sosa said he was mentally, emotionally and physically ready to face Nietes. Part of the Philipines versus Mexico rumble, Mark “Magnifico” Magsayo, a rising star in Philippine boxing, will be facing a last-minute

replacement in the name of Ramiro Robles. Magsayo, who knocked Chris Avalos in the sixth round as an undercard to the Nonito Donaire-Zsolt Bedak title fight in Cebu last April, will be defending his WBO International featherweight title. The Filipino boxer’s original opponent, Ruben Garcia, backed out supposedly due to an injury. Despite this, Magsayo said he is taking Robles (13-5- 1, 8KO) seriously. “Mahirap mag-kumpiyansa,” Magsayo said. Meanwhile, it is going to be a grudge match between Filipino boxer “King” Arthur Villanueva and Mexico’s Juan “El Penita” Jimenez. Villanueva and Jimenez fought in Cebu City last May. It’s important to remember that the stock market is made up of businesses. Businesses have a great track record for adjusting to political and economic change. The policies of the next president will impact some businesses positively and others negatively. Those negatively impacted will adjust and adapt. It’s hard to predict which businesses will be the winners or losers today even if we knew who was going to win the election. That’s why portfolios need to be diversified. There won’t be many short-term effects on commercial real estate, except maybe in the office sector, where

some firms might want to delay signing new leases until the results of the vote are presented. The retail and multifamily sectors will probably be less affected, as people will continue to have jobs and an income, thereby maintaining their levels of demand in those areas. The demand is also supported by lower unemployment rates. Weekly unemployment insurance claims are below 300,000, close to an all-time low, which suggests good economic strength. Also, for people over 65, the employment rate has reached its highest level since World War II. The real issue is linked to the longterm effects of the 2016 presidential vote. Donald Trump’s involvement in the real estate business will trigger an overexposure of tax regulations’ impact on real estate in the next three months, predicted by some analyst. A Pro-Market President I believe n matter who wins, this presidential election will likely bring a change in the approach to the U.S. real estate market. Both candidates are believers in the markets, and I hope that they will ease up on redundant regulations and work on our nations deficit to put us back in the black. Despite its slow growth, the U.S. economy is steadily recovering. Thus, it is less likely to be heavily impacted by the political changes. “The U.S. economy is a supercarrier economy. HR groups urge Duterte to denounce Marcos’ crimes and push forward peace talks LOS ANGELES, CA - On September 21, Filipino American human rights advocates and American supporters rallied in front of the Philippine Consulate in Los Angeles to mark the 44th anniversary of the declaration of Martial Law by former Philippine President Ferdinand Marcos and called on the Duterte administration to denounce the crimes of the Marcos’ dictatorship. Led by BAYAN USA and the International Coalition for Human Rights in the Philippines (ICHRP) Southern California Network, the participants called for justice for victims of the Marcos dictatorship and condemn the continuing human rights violations in the Philippines. “Extrajudicial killings and arrests were an abominable hallmark of Marcos’ 21 year rule, which was propped up by the U.S. government,” Nikole Cababa, Deputy Secretary General of Bayan USA. “In order to set himself

country, the killings, and the further arrests of political prisoners without any cause.” Since August, five peasant leaders have been assassinated and more activists have been arrested despite the existence of unilateral ceasefires in the country’s 47 year civil war. Cababa added, “For the peace talks to succeed, Duterte must follow through on his recent statements asserting an independent foreign policy not dominated by U.S. interests. His words must be proven in action by terminating all unequal military and economic agreements with the United States, such as the Visiting Forces Agreement (VFA) and the Enhanced Defense Cooperation Agreement (EDCA). Only then will the Philippines be free to enact social and economic reforms that can create liveable jobs for Filipinos through land reform and building national industries.”
