STEP BY STEP GUIDE TO BUYING YOUR SPANISH PROPERTY PRIOR TO VIEWING

THE TAXES

Prior to arriving in Spain you should make sure you have funds available to cover the reservation fee. Paying the reservation fee will secure the property for you and will also secure the price. The minimum reservation fee will be between 3.000 - 6.000 Euros but may be higher depending on the price of the property you have chosen.

Off plan properties have a 7% Tax of the purchase price, plus stamp duty at 1%

CHOOSING A LAWYER Once you have reserved a property the sales contracts will be drawn up. You should appoint a lawyer at this stage who can advise you on the legal process and approve the contracts and form of payment etc. We will be able to recommended an excellent local lawyer who will be fluent in English to make the whole process easier for you. The lawyer will then be able to handle all negotiations and will be at hand to assist you when you sign the deeds and complete on your purchase. FORMALISING THE OFFER When you reserve the property you will have verbally agreed the purchase price. Your next step should be to put the offer in writing, including the confirmation of the payment of the reservation fee. You will need to inform your consultant at this time on your method of payment so that the form of payment can be prepared for your contract. You will have the opportunity to take over the mortgage on your new property and this are usually between 70-80% of the purchase price. CONTRACTS Upon acceptance of the offer, a contract will be drawn up which includes details of the property, payment terms and will set out the dates for the final completion at the notary. Upon signing this contract a payment of approximately 10% of the purchase price will be required. This will vary depending upon the form of payment agreed and set out in your contract. FINAL COMPLETION A sale is formally completed in Spain when the title deeds of purchase are signed before a notary, the final payments made and possession given to the buyer. Once the deeds are signed, the notary will fax a note of the title deeds to the local land registry. The final registration of the deeds may take up to two months. Your lawyer will be able to assist you throughout this process as well as ensuring all taxes relating to the purchase have been paid and arranging the transfer of accounts with the local suppliers of utility services. COSTS INVOLVED IN YOUR PURCHASE When purchasing your property in Spain there are, in principle, three fees and two taxes to pay. You should estimate that the total of these charges should be around 10% of the purchase price. THE FEES * Legal fees - Usually charged at 1% of the purchase price * Notary fees This depends on the value of your property but is on a fixed scale by law. This is between 300 840 Euros. * Property Registry This is normally 60% of the charge of the notary

A transfer tax (ITP) of 7% is only applicable for re-sale properties The VAT (IVA) rate of 16% is applicable when purchasing Plots of land, commercial premises or garage space. Plus Valia tax Normally payable by the vendor unless stipulated that the buyer pays. This is dependant of the property price/size ranging from 300 Euros to several thousand for large properties in large plots.
