t the recent Florida REALTORS® Mid-Winter Meetings, during FR’s Legal Update session, we were reminded of the importance of website accessibility, fair housing, and equal professional services. In hopes of raising your awareness of these critical issues, I urge all members to ensure that their businesses comply with the law in these areas to avoid rising liability concerns. More than fifty years after the Civil Rights Act of 1968, discrimination in real estate is still a real issue. Recently, an undercover investigation in Long Island, NY revealed widespread “unequal treatment” of potential minority home buyers by real estate agents. Civil penalties for housing discrimination are quite severe. All members are urged to ensure that they conduct their business in compliance with Article 10 of the Code of Ethics and the Fair Housing Act. It can be beneficial to periodically audit yourself to ensure compliance. See Article 10 of the Code of Ethics for case interpretations and more information.

The Global Real Estate Love Affair with Florida

W

e live in a global society. Our world is expanding daily and so is our access to different countries and cultures. Our beautiful Sarasota and Bradenton area has long been a melting pot of different peoples from across the nation, escaping the cold and enjoying all that Florida has to offer. According to the National Association of REALTORS®’ (NAR) Profile of International Transactions in U.S. Residential Real Estate 2019, Florida has become a significant hot spot for international real estate investors. In fact, we are the top destination, accounting for 20 percent of all foreign buyers. Florida is followed by California (12 percent), Texas (10 percent), Arizona (5 percent) and New Jersey (4 percent). Of these foreign buyers, 76 percent purchased detached, single-family homes and townhomes, and 44 percent purchased in a suburban area throughout Florida.1 These numbers are quite eyeopening. So, where do most international clients originate and how much are they investing annually? According to the NAR report, the top five countries investing in real estate in the U.S. come from:

international buyers. However, the NAR report states that 7 percent of respondents surveyed had a client who was interested in purchasing property abroad, but only 3 percent were able to help or refer the client to a business contact. So clearly, education is in order.

CHINA Chinese investors have been the biggest purchaser of U.S. residential real estate for several years due mostly to the significant return on investment and overall cost of U.S. real estate. Florida, in particular, draws many Chinese nationals due to our beautiful beaches, weather, schools, and cultural opportunities. “People from China especially like our area because of our competitive prices and our amazing location,” said Miao Whiteside, Realtor® and Sales Professional with Berkshire Hathaway HomeServices, Florida Realty. “With an average $1,000 per SF price tag for an apartment in Beijing, and $1,200 per SF in Shanghai (and similar pricing in San Francisco, Vancouver and Toronto), our market is a big bargain for them. They can also see a much higher return on the investment than what they can achieve in China.” Due in part to higher U.S. tariffs on Chinese exports and tighter regulations by Chinese authorities on commercial bank lending, China’s economy is expected to grow at a more moderate pace of 6.3 percent in 2019 from nearly seven percent in 2017. 2 Even with this modest slow down, Chinese investors still represent over $13 billion in U.S. real estate sales. If you understand how to work with Chinese nationals, there is significant room for success. “You have to understand the culture when you work with international customers,” said Whiteside. “I was born and raised in China, so I have an understanding of


what to do and what not to do. I build trust with them and make sure they understand every step of the way, so they are comfortable doing business with me and trust my suggestions. I believe excellent communication and white-glove concierge service is the key in Chinese culture.” When working with foreign nationals, it’s especially important to realize the cultural differences and be very mindful of any misleading direction or misunderstandings. “The purchase process for real estate in China is much different than in the U.S.” added Whiteside, “so you have to be understanding, and walk your clients through the process by explaining all the different steps. Chinese customers are big on connections. Once you earn their trust, they will introduce you to their whole family and friends. I receive referrals from my past customers on a regular basis. Having a solid local network and knowledge of some of the intricacies of an international purchase is also extremely helpful.”

CANADA It’s estimated that more than 3 million Canadians visit Florida each year; for vacation purposes, an extended stay or to consider relocation.3 Once again, our beautiful climate, beaches and cultural opportunities lure many of our neighbors to the north. “There is really something for everyone here; beautiful golf courses, swimming and water sports, fishing, thriving music and cultural scene,” said Ivy Neyedly, Realtor® with Team Realty and Investment Solutions. “Canadian winters are long. The luxury of being able to go for a nature walk in the middle of winter for a northerner is quite enticing!” However, there are other reasons why our area is particularly attractive to Canadians, namely – affordability. Canadians account for the most sales in foreign investment in the North Port-Sarasota-Bradenton MSA (Metropolitan Statistical Area). “The majority of Canadian buyers are from the province of Ontario,” said Neyedly, “followed by Quebec in second place. Of the buyers from Ontario, most of them are from my hometown of Toronto, known as the GTA (Greater Toronto Area). On average, home prices in our area are much more affordable than in Ontario and Quebec.” 4 The cost of purchasing a home in our area is very affordable to Canadians, as it is a fraction of the cost. “Even with the changing exchange rate, Florida is a great bargain for those seeking to get away from the Canadian cold,” said Greg Owens, Operating Principal/ Broker Keller Williams On the Water. “You probably won’t get a whiff of Lake Ontario for less than $1 million, and it is frozen this time of year anyway! So, waterfront property in Florida is both attractive and affordable for those who want to be on the water all year round.” Of course, there are several cultural differences to be mindful of when working with anyone from outside of the U.S. “When working with Canadians, I would suggest the agent become knowledgeable on topics such as

the FIRPTA law (Foreign Investment in Real Estate Tax Act) and the current Canadian/U.S. exchange rate,” said Neyedly. “I’m always ready with a helpful list of service provider partners for international tax accountants and attorneys. These professionals can save Canadians hundreds or maybe even thousands of dollars.” In addition, Canadians may be surprised to learn that mortgages typically take much longer in the U.S. to process. “A mortgage can take 30-45 days to be approved, as opposed to what they are used to, approximately 2 -7 days in Canada. Buyers who are unprepared for the longer timeline and more rigorous application process in the U.S. can get frustrated, which could put the sale in jeopardy,” added Neyedly. Another frustration that Canadian buyers run into involves dealing U.S. banking regulations. “Many U.S. based banks will not take Canadian credit history information or assets into account. We often refer our northern customers to U.S. banks that are owned by Canadian banks who have a different perspective. Canadians like to have equity in their homes and pay them off early. Their mortgage interest is not tax deductible, so it really is a different process in the states,” said Owens. ATTRACTING THE CANADIAN BUYER

“I find the best places to meet Canadians are online, especially Facebook through ads or referrals,” said Neyedly. “I also belong to CREA Global (the Canadian Real Estate Association), where I partner with other agents for referrals. I have obtained the NAR designations of CIPS (Certified International Property Specialist), and GRI (Graduate, Realtor® Institute), and I highly recommend these courses. They will give you the knowledge needed when working with Canadian buyers.”

UNITED KINGDOM The United Kingdom, made up of England, Scotland, Wales and Northern Ireland, is a globally influential center of finance and culture. The same favorable conditions that attract buyers from Canada and other parts of the U.S., namely the Florida climate, decent exchange rates, and excellent real estate values, are enticing our neighbors from across the pond. COVER STORY CONTINUED “While many British buyers may consider southern Europe and the Mediterranean as a vacation or second home destination, the winter temperatures can be much cooler than Florida,” said Pat Tan, Realtor® with Coldwell Banker Residential Real Estate. “Florida offers a climate that appeals to many Europeans. Even with the changing economic landscape, there is a good availability of well-priced homes in our area.” Of course, knowing how to work with European buyers is the key to success. “Each European country has its own identity and some level of autonomy from central government,” said Tan. “The key thing to remember is to identify your client with the country they are from. For instance, don’t call them English if they are from Scotland! Cultures do differ from country to country, and sometimes the differences are subtle. When in doubt, call them British!” BREXIT AFFECTS INTERNATIONAL SALES

Brexit, the withdrawal of the United Kingdom from the European Union (E.U.), has definitely impacted the flow of real estate transactions in Florida and throughout the United States. “The uncertainty over Britain’s exit from the E.U. has caused the British economy to stall somewhat,” said Tan. “The immediate impact of the Brexit vote was to weaken the British pound. This coupled with a strengthening U.S. dollar and rising real estate prices in our market means that Florida homes are now more expensive for British buyers than they were pre-Brexit.” Brexit has created an overall financial uneasiness in the U.K. which has affected all economic markets. “The local British real estate market has been impacted as people are reluctant to make major financial moves in this climate of uncertainty,” continued Tan. “Homes are not selling as quickly as before, more British buyers are downsizing from larger homes in the U.K. and purchasing a smaller Florida home. This process can be time consuming, and sales can be influenced by their inability to sell their U.K. homes. However, Florida is still a sound investment and a good option for British investors, but sales have slowed for now,” said Tan. CONNECTING WITH U.K. BUYERS

Connecting with different buyers from the U.K. can be tricky, since the U.K. is so diverse, and it consists of various nations and cultural nuances. However, many of the traditional outlets such as print media, online advertising, and referrals remain tried and true. “I like to utilize print media such as the Sunday Times classified and lifestyle home magazines,” said Tan. “As far as online advertising, rightmove.co.uk is one of the most popular portals. Also, building relationships, networking and referrals is extremely important when working with European nationals.”

MEXICO When it comes to Mexico, the beautiful Florida climate is not necessarily the draw. Mexico has its own gorgeous weather and alluring beauty that has 8 | ELEVATE [ MARCH 2020 ]

attracted vacationers for years. Rather, both economic and political changes in Mexico are the catalyst for more and more wealthy Mexican nationals purchasing real estate in Florida. 5 According to the NAR profile report, Mexico’s economy is expected to grow at a slower pace of 1.3 percent in 2019 from 2 percent in 2017 as the economy transitions under a new administration. This change is partially responsible for interest in real estate transactions on both sides of the equation: Mexican nationals who wish to relocate to the U.S. as well as U.S. investors who want to purchase a vacation home or rental in Mexico. In fact, Mexico topped the list of countries of interest to U.S. clients seeking to purchase abroad (nine percent). 6 There is clearly a healthy market for working with Mexican nationals in Florida. Therefore, having an understanding of Mexican culture and expectations is vital to success. “There are a handful of important tips to be mindful of when conducting business with Mexican nationals,” said Andrea O’Brien, Realtor® with Michael Saunders & Company. “For starters, be formal and very respectful when first interacting. Mexican nationals appreciate a firm handshake and professional demeanor. A more relaxed and informal attitude is reserved for after a relationship of trust has been forged. In addition, a person with a professional degree likes to have it recognized in their name, such as Doctor Gonzalez or Licenciado Martinez. They also prefer to describe their ethnicity based on the country their families came from. It’s a matter of respect,” said O’Brien. In addition, when working with Mexican nationals, it’s important to keep in mind that they value personal relationships and creating friendships even in business negotiations. They often prefer to negotiate terms over a meal, and they enjoy talking about their own country, families, and hometown. And like all foreign nationals, Mexicans will come to the table with their own understanding of the terms. “Setting clear deadlines, expectations, and terms is vital to the success of the relationship and the transaction. Leave no room for surprises,” added O’Brien. Regardless of where you call “home” or where your next sale comes from, it’s safe to say that our beautiful Sarasota / Manatee area will continue to attract buyers from across the globe. The savvy Realtor® will be prepared to assist their international client and earn the sale. •

copying, as opposed to simply providing a link) without authority. In their findings of fact, the Hearing Panel also noted that even if Realtor® B’s clients might not object to such advertising, the lack of objection could not be assumed and would not relieve Realtor® A of the obligation to obtain Realtor® B’s specific authority and consent to advertise her listings. The Hearing Panel found Realtor® A in violation of Article 12 of the Code of Ethics.

I

n developing his website, Realtor® A decided he would offer two pages of listings: his own and some featured listings of his competitors. Being careful not to present a misleading picture in his advertising, he was very careful to list the company name and phone number of the listing company with each of his competitors’ listings. When Realtor® B found one of her listings on Realtor® A’s website, she filed an ethics complaint with the local Association of Realtors® complaining that Realtor® A had “blatantly and without authorization of any kind whatsoever advertised my listing on his website and in so doing was clearly in violation of Article 12 of the Code of Ethics as interpreted by Standard of Practice 12-4.” At their next meeting, the Grievance Committee decided that the alleged conduct, if taken at face value, could possibly violate Article 12 and directed the Association’s Professional Standards Administrator to schedule an ethics hearing before a Hearing Panel of the Association’s Professional Standards Committee. At the hearing, Realtor® B produced a printed copy of her listing which was on Realtor® A’s website. She produced a copy of her listing agreement and a photograph of the property, which matched the information in the listing. She testified that she had never been contacted by Realtor® A for permission to advertise her listing. When Realtor® A presented his case, he showed the hearing panel several examples of Realtors® providing links to sites with ads for other Realtors®’ listings. He said he saw no fundamental difference between providing such links and actually advertising other listings on his website, especially when he was very careful to also give the listing company’s name and phone number. He went on to argue that Realtor® B’s clients would be hard pressed to understand Realtor® B’s objection to giving their properties the additional exposure they received on Realtor® A’s website. Upon the conclusion of all testimony and closing statements, the Hearing Panel met in executive session and decided that while providing a link to listings of other Realtors® did not violate Article 12, by actually publishing Realtor® B’s listing on his website Realtor® A was not linking, but instead was advertising (by

Helping Homeowners Establish Florida as Their “Domicile” By: Bonnie Lee Polk, Attorney at Law, Williams Parker, Sarasota

F

or decades, people have established residency in Florida to take advantage of the state’s favorable taxes and warm weather. According to recent U.S. Census data, over 16,000 people relocated to Sarasota-Manatee between July 2017 and July 2018. But have those transplants technically made Florida their home? The answer to this question is significant, as it can impact estate planning, tax liabilities, and other financial matters. Each year, thousands of people relocate to Florida intending to make it their “legal residence” or “domicile,” but simply owning a home in Florida is different than becoming domiciled in Florida. Below are some things to keep in mind for those moving to the area planning to make Florida their domicile.

INTENT IS KEY Intent is a key factor in determining a person’s state of domicile. If your client’s intent is to make Florida their “home,” there are affirmative steps to take to declare Florida their domicile. A person cannot have more than one legal residence. They must terminate residency in their former home state. This does not mean they must sever all ties with their former home, but it does require shifting some ties to Florida. No single act determines a person’s domicile. In addition to spending a greater percentage of each year living in Florida, they should consider taking as many of the following steps as possible to ensure Florida is recognized as their domicile:

1 | File a Florida “Declaration of Domicile”

This is a sworn statement, filed in the office of the clerk of the circuit court for the county in which one resides, stating that Florida is their permanent and principal home. 2 | Apply for Homestead Exemption If they own a Florida home as their primary residence, they should consider applying for Florida’s homestead exemption, and notifying their prior state of any change of homestead status. Initial applications for the homestead exemption must be filed on or before March 1 of the year for which the exemption applies. 14 | ELEVATE [ MARCH 2020 ]

3 | File Federal Income Taxes

They should file their federal income taxes from their Florida address and send to the regional office for the State of Florida. If filing state income tax returns in another state, they should file as a non-resident. 4 | Update Estate Planning Documents Those moving to Florida should consider revising their estate planning documents, not only to recite Florida as their domicile, but also to ensure compliance with Florida law. 5 | Additional Actions Additional actions to demonstrate intent include obtaining a Florida driver’s license, registering an automobile here, registering to vote, obtaining local bank accounts, and establishing local club and church affiliations.

BOTTOM LINE There are many advantages for your clients to declare Florida as their state of domicile. RASM Members Attend Great American Realtor® Days By: Max Brandow, RASM Government Affairs Director

t’s been a busy season in government affairs as RASM members work hard to protect the issues that affect homeownership in our area.

GARD RECAP: This past month, RASM members traveled to Tallahassee and visited with our local delegation to lobby for important real estate issues. Topics discussed ranged from fully funding our Affordable Housing Trust Funds, Reducing the Commercial Lease Tax, Water Quality, and protecting property owner’s rights to rent out their homes. GARD attendees were treated to a special lunch with Governor Ron Desantis, who updated Realtors® on his priorities, and how they would move our industry forward in Florida. RASM and Realtor® members throughout the state volunteered their work week to attend this important event, we are so appreciative of our selfless volunteers for their commitment to fighting for our industry. RASM members also met with Senator Joe Gruters; Rep. Tommy Gregory, Rep. James Buchanan, Rep. Margaret Good, and Rep. Will Robinson.

study on the impact of vacation rentals in Florida. They found that direct vacation rental spending was almost 20 percent of Florida’s tourism industry in 2017, and 1.6 percent of state GDP. In Manatee and Sarasota County, vacation rentals accounted for $457 million of direct economic impact. Vacation renters in Manatee and Sarasota counties accounted for, on average, $1,093 per trip/per person in economic impact for our area. In 2018, more than one in 10 (11.2 percent) of tourists stayed in a vacation rental home. Industry direct spending supports 115k jobs and creates 13 jobs every hour. “Floridians have long-known that the state’s vacation rental industry has a significant impact on our economy, but the numbers in this report are simply staggering. More than $27 billion a year is a substantial contribution to our economy, and the 115,000 jobs it supports are critical to the well-being of many of our communities,” said Florida REALTORS® President Barry Grooms, a Realtor® and co-owner of Sarabay Suncoast Realty Inc. in Bradenton. Home Sales Outpace Supply in January 2020 By: Gina White, Communications and Marketing Director

A

ccording to monthly reports from Florida Realtors®, the Sarasota and Manatee housing market experienced another robust month of sales in January. Compared to the same month in 2019 when there was a decrease in sales and an increase in inventory, the opposite can be said for January 2020; an increase in sales and a decrease in inventory. Closed sales in Sarasota and Manatee totaled 1,539 in January 2020, a 32.4 percent increase from the same month last year. In Sarasota, single-family closed sales increased by 22.8 percent to 565 sales and Manatee sales increased by 22.4 percent to 410. Condo sales increased by 57.8 percent to 344 sales in Sarasota and by 47.7 percent to 220 in Manatee. “We typically see a lot of market activity this time of year and when compared to a slower month the same time last year, 2020 is off to a great start,” said David Clapp, 2020 President of the Realtor® Association of Sarasota and Manatee. “The current volume of sales is outpacing inventory and properties are selling fast, with a decrease in median time to contract as low as 34 days in some markets.” Cash sales continue to rise with a 46.4 percent increase for Sarasota single-family homes and an 11.8 percent increase for single-family in Manatee. Condo cash sales increased by 51 percent in Sarasota and increased by 11.6 percent in Manatee. “In most of our markets, there was a higher proportion of cash sales in January compared to December of 2019. Sarasota condos lead the way with 62.8 percent of closed sales being cash sales,” added Clapp. “Cash sales could point to more and more investors participating in the market. This is great for our overall market, but it could be inhibiting new buyers from entering as supply gets picked up by investors.” Single-family home prices increased by 6.6 percent in Manatee County to $329,500. Sarasota single-family prices increased by 3.3 percent to $296,000. Condo prices increased by 7.7 percent to $210,000 in Manatee and increased by 15.4 percent to $277,000 in Sarasota.

New listings, or the number of properties added to the market this month, decreased for single-family homes but increased for condos. Condo new listings increased by 9.2 percent in Manatee and by 4.1 percent in Sarasota. Single-family new listings decreased by 3.7 percent in Manatee and decreased by 13.7 percent in Sarasota. “The combination of higher sales and lower new listings has resulted in the months’ supply of inventory dropping to approximately 3.5 months for single-family homes, and 4.8 months for condos,” added Clapp. The months supply of inventory decreased yearover-year. Sarasota condo inventory declined to 4.9-months’ supply and Manatee condos, at 4.7-months, showed no change from last year. Sarasota single-family homes decreased to 3.6-months’ supply and Manatee fell to 3.4-months. Combined inventory in both counties decreased by 18.2 percent from January of 2019. Single-family home inventory decreased by 16.3 percent in Manatee and by 23.8 percent in Sarasota. Condo inventory in Manatee decreased by 2.8 percent while Sarasota decreased by 18.9 percent. Pending sales increased in both markets in both counties, indicating more closed sales in the future. With the two counties combined, single-family pending sales increased by 25.4 percent and condo pending sales increased 6.2 percent. Economic Profile for 2020 By: Ken Hughes, CNK REALTY, President; and Tiffany Long, Member Service Coordinator

O

ur Commercial Real Estate Alliance (CREA) hosted Stewart Title’s Chief Economist, Ted Jones, PhD. for an economic forecast of 2020. The big question was...will there be a recession this year? As the title of his presentation, “And the Beat Goes On,” suggests, Dr. Jones said that a recession is extremely unlikely to happen in 2020. The U.S. economy looks strong with the U.S. having more jobs than any time in history with a net of 2.1 million new jobs in the past 12 months along with the best wage increase in a decade. With the focus on the Florida economy, Dr. Jones showed that Florida has the 6th highest job growth for 2019 at 2.4 percent. Largely due to the favorable business structures and incentives like having no state income tax. Predominantly all of the top 10 states with the highest job growth have no state income tax, which has continued to help fuel our growth. Dr. Jones narrowed the focus of his presentation on the North Port-Sarasota-Bradenton MSA. We have

seen annual job growth of 2.6 percent with significant growth in the sectors of construction, professional services, leisure/hospitality, education and healthcare. The unemployment rate in our area, 2.7 percent, continues to be less than the 3 percent state and 3.5 percent national averages respectively. Housing sales and medial prices continue to rise in our area with only a slight downshift in condo sales. Although most all indicators were positive that a recession is unlikely, Dr. Jones did point out that there are a couple of areas which he felt should be monitored and could have an impact. Subprime car loans, corporate debt due to low interest rates, and the election could all have an impact on the economy, but that does not seem likely in the short term. Overall the outlook for the national and local economy continues to remain strong. Dr. Jones was certainly entertaining and informative to the over 120 guests who are focused on commercial and residential market in our area. AREAA membership is currently $99 a year. The closest chapter to us is the Tampa Bay Chapter. 3 | NAHREP (National Association of Hispanic Real Estate Professionals). O

ne of the reasons I joined RASM’s Young Professionals Network was the high level of community involvement at the core of the organization. People often hear “Young Professionals Networking,” and think only of happy hours, trade shows, and activities for Millennials and Gen Zers. What most people don’t realize is while yes, many of the events we host are social gatherings, educational events, and engaging activities, we also offer fundraisers that support local causes! To kick off 2020, we hosted a Putt-Putt Pour MiniGolf Tournament at Evie’s on the Range, which raised over $5,200 for the RASM Scholarship Fund. Every year, RASM awards scholarships ($2,000 each) to deserving students in the Sarasota and Manatee area, as selected by the RASM Scholarship Committee. We are helping to further the education of local students while enjoying time with local Business Partners. But the kids aren’t the only ones we help with our YPN events!

This April, we are hosting our annual Lip Sync Battle at McCurdy’s Comedy Theatre. The past three years, we have supported Heroes Welcome Home. HWH is a non-profit organization that offers our local veterans financial assistance during the home-buying process, rental and utility deposits, and repair and maintenance on a veteran-owned home! We started this event three years ago and since then have raised more than $15,000 for Heroes Welcome Home! Please consider joining us on April 28 to raise more money for a local charity. You don’t have to perform to support us, although we’d love to have some new faces up on stage this year. Stay tuned for more details about our summer anniversary party. In the last couple of years, we’ve collected food for different food banks to support local hungry families! So next time you see the calendar of events from RASM, consider joining YPN for some of the fundraising events we host! ASM happily recognizes the workplace anniversaries of our professional staff. Tiffany Long, Member Services Coordinator, celebrates her third anniversary with RASM in March. Tiffany assists with membership services like processing membership applications, MLS listings, and Supra keys. She is also the RASM calendar guru and the staff liaison for the Commercial Real Estate Alliance group (CREA) formerly known as CID. Tiffany enjoys working with the different members and getting to know them, and she has a lot of fun with her fellow RASM staff members. She also greatly enjoys working with the CREA group. In her free time, Tiffany enjoys photography, cruises with the family, going to theme parks with her daughter, and going to concerts.

Tiffany Chamberlain, Accounting Coordinator, celebrates five years with the Association this month. Tiffany works with the many day-to-day accounting functions and responsibilities at RASM, and helps to ensure that accounting services run smoothly and efficiently. Tiffany loves the family atmosphere that RASM embodies. She also loves the members and RASM staff, and genuinely feels appreciated.
