The Property Angle Outlook - JAMES LEWIS The 2016 Nation’s Address and Budget Speech are now behind us and it is clearly evident that our government is embracing Fiscal Prudence by showing the will for good governance and implementing effective control measures. GDP growth is key to our Finance Minister’s objective to avoid a downgrade in our credit rating. Moody’s, Standard and Poor’s (S & P) and Fitch Ratings control approximately 95% of the world’s credit rating business. These agencies, known as “The Big 3” rate companies and governments according to a marking system that informs interested parties or buyers of debt/investors (e.g. pension funds and wealth funds) how likely they will be paid back. How credit worthy is South Africa (SA) at the moment? S & P rate SA BBB- negative (as at 13 March 2016). A lower rating would be “junk” grade, resulting in lenders demanding a higher return to their loan because SA is now a riskier investment. This could potentially result in investors moving their money to other safer international investments (cash outflow). To counter outflows and attract more foreign investment our Reserve Bank will increase interest rates. In the case of a downgrade, we would expect the prime lending rate to reach approximately 13% (same levels as 2009), and unchanged, we would expect our prime lending rate to increase marginally over the remaining year closing out at around 10.5% to 11%.

Discrimination Stops with Me The Real Estate Business Owners of South Africa (REBOSA) have called for all to sign an Equality Pledge - Discrimination Stops with Me. REBOSA has a zero tolerance approach to all forms of discrimination in the real estate industry in South Africa, quoting our former President, Mr Nelson Mandela, “No one is born hating another person because of the colour of his skin, or his background, or his religion. People must learn to hate, and if they can learn to hate, they can be taught to love, for love comes more naturally to the human heart than its opposite”. Business as usual On the local property front, Seeff Southern Suburbs, Hout Bay and Llandudno remain upbeat about the property market in 2016. In contrast to SA’s poor economic performance, our local housing market continues to see strong buyer demand especially under R5 million. It is business as usual in this beautiful part of the Cape. 2014 Seeff Southern Suburbs achieved a record billion rand in trade, 2015 we achieved the same and only two months into 2016 we are on track to do the same.

LOOKING FOR A TOP ADDRESS, GOOD VALUE AND CAPITAL GROWTH?

BE SURE TO PACK FOR PLUMSTEAD

Although located in the sought-after southern suburbs, Plumstead still offers excellent value for buyers according to Peter Marais and Peter Thornton, Seeff’s specialist agents for the area. Consequently, buyer demand has risen significantly over the last few years and with that property values too. The economic downturn notwithstanding, year-on-year sales volumes and prices are holding steady according to the agents. Some 146 sales transactions with a combined value of almost R245 million were recorded for the 2015-year at an average price of R1.88 million, about 12% more than the average sales price of R1.68 million for the 2014-year. This year’s average sales price for houses is already standing at just over R2 million, already 6% up from last year’s price, say the agents. That is also now almost 60% more than the average sales price of around R1.2 million of five years ago. From an affordability point of view, Plumstead is however, one of the few areas in the sought-after southern suburbs where you can still buy below the R2 million price band. Having said this, prices are rising as home buyers are renovating and extending their homes.

Competition for properties in the area remains very strong and well-priced homes are selling within anything from the day of listing to about a week at most based on this year’s figures listed on Propstats. The data analysis also shows that almost half of all sales are for close to or full asking price. While very affordable, the suburb is not short on amenities. It offers easy access to schools, parks, motorways and shops such as Topsham Centre, Pick n Pay and Shoprite Checkers along with municipal office, retirement complexes and places of worship. The main reason for buyer interest though is the value offered and, Marais and Thornton remains confident of continued buyer interest this year. The area is just too good not to invest in and buyers know this. Demand remains buoyant and this is good news for sellers.

Five years ago only about a handful of sales were above the R2 million price mark. Last years, say the agents, about a third of all houses sold were priced upwards of R2 million and top end homes now reach about R3.3 million for a lovely family home with six bedrooms and a swimming pool. Plumstead is rich with character homes built in the 1950s to 1970s that are solidly built and on ground sizes of around 500 square metres. Many sought-after features such as wooden floors and high ceilings and offer good accommodation for young families at affordable prices, say the agents. It is especially young professionals who are looking for a family home near schools that are investing in homes in the area. It is also these buyers that are upgrading and modernizing the homes, often adding additional space and so contributing to the upgrading of the area and with that excellent capital value growth.

A new year packed with challenges, but also plenty of opportunity As we head into 2016, it is with the understanding that it will be a challenging year for the economy and country and of course for the property market The reality that we have to take cognisance of is that we are facing a year packed with challenges to say the least - pressure on the currency, slow economic growth, interest rate hikes (possibly from as early as the end of January), rising costs and even potential tax hikes. While all of this will impact on the property market and we expect a further slowing in sales volumes and price growth, there will always be opportunity in the market. While perhaps a little slower, we nonetheless expect it to be business as usual for the residential market. There will always be buyers, those who want to or need to buy for a range of reasons despite the tough economic climate. Although we expect more caution in the market this year as households will feel the pinch of the slow growth and higher costs, it is still a good time to buy and sell.

The market is still fairly healthy and we start the year on a positive note with a still well-balanced market, packed with plenty of buyers and still fairly tight stock levels. So far, the summer period has been positive with most holiday areas reporting good and even record tourist figures. With that too, good interest in property. Against the background of the rand sitting at record and near record lows against the major currencies, local and foreign buyers are still seeing this as a favourable period to invest in the South African property market. The early part of the year also tends to be a busy period for the market. This is usually the time when many decide to upgrade to a bigger house or better neighbourhood or to perhaps downgrade to a smaller house. Older buyers too may decide to down-scale to the coast or countryside. Younger, first time buyers are also generally quite active during the early part of the year. The early part of the year therefore tends to be a very good phase for sellers. Stock levels are still fairly tight with no oversupply in the primary sector of the market as yet. This means that sellers do not have to compete with too much stock as yet. For sellers then, now is still a good time to sell. Provided you are realistic with your price expectations, should still to find a buyer and a good price. While this is no doubt going to be a year of belt tightening in many respects, we expect it to remain business as usual for the residential market with plenty of opportunities for both buyers and sellers.

YOU WILL NEED • Plastic container for the light shade, any shape or size • Rust-Oleum Metallics spray - copper • Lampholders [2] and 20mm screws [2] • Epoxy adhesive • Electrical cord • Drill / Driver and assorted bits, plus 25mm spade bit

Step one: Use the 25mm spade bit to make a hole in the centre at the top of your plastic container. It needs to be exactly in the centre if you want your light to hang properly.

Step four: Have someone help you with this step, as it can get a bit messy. Mix and apply epoxy glue to the rim of the lampholder inside the container. Make sure it is centred before using a couple of screws to hold in place.

Step five: Place the lampholder ring on top over the screws, also using epoxy adhesive around the rim to secure. Also apply epoxy adhesive to the screws that come through the top. Leave the adhesive to cure for about an hour.

Step two: Take apart one of the lampholders and thread the wire through the drilled hole in the container. Disassemble the lampholder and wire up. Make sure that the wires are tightly secured before putting the sections back together.

Step six: Cover the inner lampholder with masking tape to protect from overspray and apply two, light and even coats of metallic copper spray paint. I found the easiest way to do this was to hold the light by its cord and twist the cord around to cover both inside and outside the container. DO allow each coat to dry before applying the next coat.

Step three: From the second lampholder you only need the outer ring, and this will be placed on top of the drilled hole.

LACTOSE INTOLERANCE Do you suffer from bloating, nausea, abdominal discomfort, cramps and diarrhea? These are all symptoms of lactose intolerance, but could also be confused with Irritable Bowel Syndrome or other inflammatory conditions of the bowel. Many people eliminate milk and milk products from their diet, before they have been properly investigated by a doctor, and this can be detrimental to their health. Always seek a proper medical diagnosis and professional dietary advice before you eliminate a whole food group from your diet to avoid nutritional deficiencies. COW’S MILK ALLERGY VS. LACTOSE INTOLERANCE Lactose intolerance is not the same thing as an allergy to cows’ milk. Cow’s milk allergy refers to an immune response to the protein in milk and milk products. This is an allergic reaction to milk and is more often seen in childhood. You may have a quick reaction to even a tiny amount of that food (although some allergic reactions may occur up to 72 hours after having cows’ milk). Symptoms may include swelling of the eyes, lips, tongue and roof of the mouth, itchiness in the mouth, ears or throat, a red rash or eczema. Lactose intolerance refers to the inability to digest the sugar in the milk called lactose. It is critical to get the correct diagnosis and the management of the two conditions is very different. Most people with lactose intolerance can still consume small amounts of dairy containing lactose with no symptoms whereas someone with an allergy to cow’s milk needs to follow a very strict diet and cannot have any cow’s milk.

THE SCIENCE Lactose intolerance is a digestive problem where the body is unable to digest the sugar commonly found in dairy products called lactose. Normally the enzyme lactase is responsible for breaking down lactose into smaller compounds so our bodies can absorb it. In the case of lactose intolerance, there is absence or deficiency of lactase, so the lactose is not absorbed by the small intestine and bacteria in the colon end up breaking down the lactose which produce gases that build up. This causes symptoms such as bloating, wind and abdominal pain. Lactose intolerance is rare in children, affecting mostly adults. It mostly develops later in life although there a few people that may have it from birth. It is also more common in those from an Asian or African-Caribbean background. You may develop lactose intolerance if you have had a gastrointestinal illness but it is usually temporary.

TESTING FOR LACTOSE INTOLERANCE A GP will often advise to removing foods or drinks containing lactose from your diet for 4 – 6 weeks to see if there is an improvement. They will then reintroduce it to determine your tolerance. A home lactose tolerance test involves drinking 300ml of milk in one sitting and recording your symptoms every 30 minutes for the next two hours. A more sophisticated version of this can be done in a laboratory where a blood sample is taken every 30 minutes to measure its glucose content, which indicates how well you are absorbing it.

food nutrition DIETARY TREATMENT The common treatment for lactose intolerance is to remove lactose from your diet. This commonly involves a restriction on dairy products and suitable milk alternatives may need to be consumed such as lactose free milk, nut milk, rice milk, coconut milk or oat milk. Most people with lactose intolerance are able to tolerate a small amount of lactose at one sitting. Certain cheeses are actually quite low in lactose and often tolerated. Avoiding lactose requires careful label reading as it is often added to foods and medicines. The most obvious source or lactose will be milk. Replace this with lactose free milk or a non – dairy substitute such as nut milk, rice milk, coconut milk and oat milks.. Lactose is removed with the whey during the manufacture of cheese. This level of elimination should be sufficient, however in the rare case that it is not, you would need to avoid all hidden sources of lactose found in many manufactured foods.

HEALTH RISKS It is important to get proper dietary advice from a registered dietitian to ensure your diet remains nutritionally adequate as dairy is a rich source of calcium. Calcium is essential in our diets for healthy bones and teeth. In order to meet our calcium requirements the average adult requires 2-3 portions of dairy rich foods per day, this will provide 600 – 1000mg of calcium. It can be a bit of a juggling act to get enough calcium whilst avoiding lactose. Please see the calcium and lactose list below for some guidance. More than 12g of lactose in a day would be considered high. Vitamin D is essential for the absorption of calcium, get your levels checked even in our sunny country its easy to become deficient.

ENZYME SUPPLEMENTS It is possible to buy over the counter commercial enzyme supplements which can be taken with meals or added to milk to predigest the lactose. These are effective, however with the introduction of lactose free milks the need for them is diminishing.

a country getaway Wanting some relaxation and a change of scenery I headed to the country gem, Greyton. It’s an easy and lovely drive … especially the stretch from Bot River. Long open roads with very little traffic and beautiful scenery. I could feel the stress disappearing with each kilometre, and as one drives into Greyton, you sense the tranquility immediately. Greyton is not just a beautiful and scenic village, it has a lovely energy and the people are just so friendly. I don’t think I passed a single person who didn’t greet me. So refreshing! You simply don’t get that in Cape Town. I was staying at The Post House and from the minute I arrived I received exceptional treatment and service. The staff are engaging and friendly and nothing is too much trouble. It’s a small boutique hotel that offers peace and quiet and country charm. The rooms have recently been renovated and are tastefully and comfortably decorated with lovely little touches, like a jar of home baked cookies to go with your plunger coffee in the morning. My bathroom boasted a gorgeous freestanding Victorian bath with an overhead shower (best of both as far as I am concerned) and the Healing Earth products are a real treat. There are no TVs or telephones in the rooms which adds to the charm. I spent the afternoon wandering around the oak lined streets. Greyton has something for all tastes .You can happily just chill and soak up the peace and tranquility of the village, or if more adventurous there are various fantastic walking trails and 65km of mountain bike trails. There are a number of coffee shops and eateries to try and lovely shops and galleries to

meander through. There are also lots of exciting developments in the food and wine space (watch my Facebook page if you are interested in a culinary weekend in Greyton). Samantha O’Keefe, a native Californian, is the owner of Lismore Estate, and is getting lots of recognition for her range of wines grown on her cool climate vineyards at 300m. Her 2014 Barrel Fermented Sauvignon Blanc was recently awarded 91 points by Decanter. Greyton is the home of handmade Von Geusau chocolates … you can buy these at selected stores in the City but if you get a chance you should visit Richard’s store in the village. A Craft Brewery is set to open at The Potters Inn, there is a fresh produce market each Wednesday and every Saturday the Market square is abuzz with vendors from Greyton and the surrounding areas selling an abundance of fresh produce and homemade delights …. From fresh organic veggies to Greyton boerewors. Dinner was at The Post House. After enjoying a glass of wine on the Terrace I moved to the warm and inviting dining room. Chef Grant has a small but inspired daily menu .Choice was difficult but I opted for the Carrot and Cumin soup with Onion Bhaji to start and being a fan of Gnocchi I couldn’t help but order the Korean BBQ Short Rib Gnocchi although I was very tempted by the Soft Shell Crab with Tom Yum sauce. The soup was a beautiful orange, light and silky in texture with the bhaji adding a perfect crunch and the flavor combinations worked beautifully together. The gnocchi was perfectly soft and the bigger sized gnocchi worked very well with the short rib sauce. I was desperate for dessert but simply couldn’t squeeze it in. as tempting as the Sticky Toffee Pudding with roasted pineapple and Vanilla ice cream sounded! You never sleep better than in the country and this was true for me … so after coffee on my balcony overlooking the beautiful gardens, it was time for breakfast which once again was a real treat… selection of fruits, cereals, cold meats and cheeses all beautifully presented and followed by a number of hot breakfast options. I couldn’t help myself and had to have the Eggs Benedict which was a great choice. After breakfast it was time for more exploring and I came across Pure Café which is one of the Greyton Transition Town projects. Greyton Transition Town is a community based NPO that seeks to inspire and empower the people of Greyton and neighbouring communities to work together to achieve sustainability and resilience in the face of rising energy and

food lifestyle food costs, economic crisis and environmental. Pure, is one of six commercial units clustered in a courtyard and is the first dedicated vegetarian restaurant in the Overberg. They are all about celebrating sustainability, the environment and the health of the community. The menu is innovative and delicious and if their green juice is anything to go by… wow! Just across the road from The Post House is The Hungry Monk owned by ex Capetonian restauranteurs Rodney (whose heritage is Indian) and Robert (who is Polish.) Their menu hosts a number of interesting dishes which take inspiration from their respective home countries. They are open for lunch and dinner and the outdoor seating in summer is shaded and cool, and there is a fireplace inside for those chilly winter days. In addition to the a la carte menu they also have a lovely tapas menu. Wanting something light I opted for the Chickpea, Mint and Coriander salad which was fresh and bursting with delicious flavours and the Chicken Satays with the yummiest homemade peanut sauce. Their wine list is small but good and I was delighted that they are one of only two restaurants that offer Ambeloui MCC (which is made in Hout Bay). It’s only produced in small quantities and is delicious … get your hands on some if you can. En route home I simply had to stop at Gabrielskloof. If you have never been there do yourself a favour and GO. Every time I visit there I wonder why it has taken me so long to go back. The buildings wrap around a centre courtyard with water features. Both the wine tasting room and the restaurant have sweeping views of the Babylonstoren Mountains and the surrounding wheat fields and the vines and olive trees. Their wines are superb .Their Sauvignon Blanc (R75) is one of my favourites and the Five Arches (R210) is a spoil. The restaurant is open for breakfast and lunch. The owners are passionate about local produce and source most of their ingredients from neighbouring towns and villages. The menu changes on a regular basis, but it’s one of those menus which make choosing difficult. There is also a deli menu which offers lighter but no less delicious options…. and a selection of cheese and charcuterie platters. And the deli adjoining the restaurant is dangerous …. Bursting with an array of totally yummy goodies. You won’t be able to leave without a purchase (or several). I didn’t. So after stashing my goodies … it was the last stretch home… Amazing what a night away and lots of good food and wine can do for the soul. Can’t wait for the next one!

Urban organic food markets are sprouting up all over cape town, as people realize the benefits of eating their own organic grown produce rather than the overpriced heavily processed veg at the supermarket. Village Gardens is a family run business owned by Tracey Cole, with the assistance of two experienced female landscapers and a team of great “blokes” lead by George Chimuti. Since we started in the past few years our business has grown tremendously providing garden designs and edible gardens for people in the Southern Suburbs and Cape Town CBD. Our passion is gardens whether it be waterwise, indigenous or just pretty however we do specialize in Edible gardens which seems to becoming more popular every day. I firmly believe that with the cost of food going up in price and the overproccessing of edibles we buy in the supermarket we should all think about growing our own. I understand life is busy and people generally don’t have the time to plant, grow and go out at night with a head torch on to kill the pests on their cabbage. However, it does not have to be like that and one can have Village Gardens Design to create their garden and give continuous guidance after the garden has been planted. There is a spray I make and use for all my veg, organic spray, which will last for at least 6 months and I normally give it to my clients free of charge… this spray works on pests, so you can bin the head torch.

RHINO POACHING IN SOUTH AFRICA BY HAMISH CURRIE BVSc Most people in South Africa are aware of the unfolding tragedy involving South Africa’s rhinos. Rhino horn on the black market can command a price of US$60 000 a kilogram. At an exchange of R15 to a US dollar this equates to almost R1 000 000 a kilogram! A rhino will carry a few kilograms of horn! Most contraband rhino horn passes through Vietnam on route to other Eastern countries where it is regarded as a status symbol. The ground powder is swallowed as a medicament to treat a variety of maladies. Africa presently has around 20 000 white rhinos and around 5000 black rhinos. However to be sure is not always so easy due to the difficult nature of a census.

One school of thought is to legalise the trade of rhino horn. Once an animal has a value humans will make extra sure they survive. Very few domestic animals have ever gone extinct. An acceptable reproductive rate would be around 5% per annum. This would insinuate around 1000 white rhinos are being born every year and around 250 blacks. It is difficult to give an accurate figure but it was estimated around 1175 rhino were poached in South Africa in 2015. Clearly our rhinos are in serious trouble. Most of the poached rhinos are shot with rifles but believe it or not some are darted with powerful drugs and then the horns are hacked off. Survivors often have the most horrendous injuries. The injuries have to be dealt with by dedicated wild life veterinarians who are faced with these situations

THE CAPE TOWN - SIMONS TOWN RAILWAY - PART 2 WOODSTOCK

Originally called Papendorp, after Pieter van Papendorp who lived there in the 18th century, Woodstock beach was famous for its lime kilns and as the site of the tragic aftermath of the Cape’s violent storms in the days of sail. 6000 people witnessed the Governor turning the first sod in the pouring rain to start construction of the line here in 1859. The old Castle Brewery and the gasometer of the Cape Town Gas Company (which serviced large parts of older Cape Town) are on the seaside of the line.

SALT RIVER

The river named by the Dutch for its salinity - Zout Rivier - rises near Riebeeck Kasteel 80Km north of Cape Town. Parts of the railway workshops here date from the very beginning and are still in full use. The Station was built for the convenience of the railway artisans who mainly lived in Cape Town and the suburb grew around the workplace. It is also the junction of lines to the North and South. On 9 June 1926 four rear coaches of a crowded commuter train were derailed and 17 passengers, including Cape Judge President Sir Malcolm Searle were killed.

OBSERVATORY

Originally the first stopping place on the Wynberg line, Observatory Road Station marked the point where the line crossed the road to the Royal Observatory established by the British Admiralty in 1827. Most of the pioneering work carried out by famous astronomers Royal Sir William Herschel and Sir Thomas Maclear is continued today at Sutherland in the Karoo, far from city lights.

of Butlin’s Holiday Camp fame was baptized there in 1900. Opposite is the Mowbray Maternity Home.

ROSEBANK

At first only a small stopping place called Lower Mowbray, Rosebank House once on the corner of nearby Alma Road gave its name to the new station which also houses a post office, quite customary then. It became a busy light industrial station supplying wood to the Rosebank match factory on the main Road and servicing the Rosebank Agricultural Showgrounds active until 1953.

RONDEBOSCH

The train passes over the now canalised Liesbeek (originally the Amstel) River before reaching ‘t ronder doorn bosjen, an outpost for the farming operations of the Dutch East India Company. Very little of the pleasant Victorian village remains and the only older landmarks of note are St Paul’s Church (1834), the Rondebosch Fountain (or more accurately, horse trough) and the Rondebosch Town Hall (now Public library). Most of the mountainside is taken up by the Groote Schuur Estate, a vast area amalgamated by Rhodes with an eye to conservation. It includes his grand former home, now official residence of the State President with many nearby houses for the cabinet. Apart from the University, Rondebosch has a concentration of famous South African Schools, including Bishops (founded in 1849) Rustenberg Girls School (1894) and Rondebosch Boys’ School (1897).

The building of the station made it a much more accessible suburb which boomed as a result of the diamond and gold rushes and is today a rich but threatened collection of Victorian and Edwardian architecture. The best part of Observatory Clee estate - was lost to Groote Schuur Hospital when it was built in the 1930s. It is chiefly famous for the first human heart transplant performed there in 1967.

MOWBRAY

Mowbray was first called Drie Koppen after the heads of three slaves impaled there after execution for murder in 1724. Mowbray House, who’s owner came from Melton Mowbray in England inspired the new name. Already a bustling little village in 1840s, it became a municipality in its own right in 1890 later merging with Cape Town. PROPERTY TRANSACTIONS AND THE 2016 TAX BUDGET - by Belinda Lewis BELINDA LEWIS In the recent March 2016 Finance and Budget report, an amendment was announced to the Capital Gains Tax laws and calculations. In short, Capital Gains Tax rates were increased. To recap, we know that Capital Gains Tax is levied on the net profit made by an individual or entity (company, close corporation, trust) selling immovable property. We also know that the Receiver of Revenue allows an individual to make up to R2 million net profit upon the sale of their primary residence – their home. To be clear, this does not apply to where an entity is selling immovable property, under any circumstances. The R2m primary residence exemption amount remains unchanged. It may have been nice to see an increase to that amount and especially for those who have owned their homes since the introduction of Capital Gains Tax back in 2001 and are already over the R2m net profit mark, but it was not expected this year. Remember that SARS is only interested in the profit made after 1 October 2001. Also, that your allowable deductions from that profit are broadly categorised as: your costs of acquisition (such as transfer costs), renovation costs (not maintenance) and disposal costs (agent’s commission, certificates of compliance and bond cancellation costs).

So what has increased in the new Budget and how does it affect us taxpayers? The “inclusion rate”, being the percentage of the net profit required to be added to the taxable income of the Seller for the tax year in question, has been increased. Basically, the Receiver of Revenue does not tax the whole profit made but only a percentage thereof.

In 2015, the inclusion rates were as follows: Individuals and “Special Trusts” Companies and Close Corporations Trusts

Be careful to distinguish between the “inclusion rate” and the “effective capital gains tax rate”. Before we move on to explain further, we also mention that the allowable rebate granted to an individual tax payer (not applicable to a Company, Close Corporation or Trust), has increased from R30 000.00 to R40 000.00 (profit or loss) once off, for the tax year. Note: this is in addition to the primary residence exemption. Essentially therefore, the individual taxpayer selling his or her home can make a net gain of R2 040 000.00 before falling into the Capital Gains Tax net.

If the individual is taxed at the highest income tax rate of 41%, the amount of R100 000.00 would be taxed at the rate of 41% which would equal R41 000.00 Capital Gains Tax payable on the R250 000.00 net capital gain made. If the Seller is a Company or Close Corporation with a flat income tax rate of 28%: Step 1 The inclusion rate is applied to the net capital gain of R250 000.00. Therefore, 80% multiplied by R250 000.00 = R200 000.00 (which must now fall into the Company’s income tax return to be taxed accordingly). Step 2 R200 000.00 is taxed at 28% = R56 000.00 Capital Gains Tax payable. If the Seller is a Trust with a flat income tax rate of 41% and assuming all income is taxed in the hands of the trust and not the beneficiaries:

Let us say the net profit an individual makes upon the sale of his property is R250 000.00 and the Seller acquired the property after 1 October 2001. Let us assume the individual is not selling his primary residence but an investment or holiday home and that the rebate of R40 000.00 has already been deducted. Therefore, the calculation is as follows:

The inclusion rate is applied to the net capital gain of R250 000,00.

Step 1 40% (being the new inclusion rate) of R250 000.00 (the net capital gain) is added to the taxable income of the individual tax payer and taxed at the rate which applies to him. So: R100 000.00 is the amount added to the tax payer’s taxable income for the tax year in question. Step 2 That amount of R100 000.00 is then taxed at the rate which applies to the tax payer and which rate is obviously based on his total amount of taxable income for the tax year in

question (including the portion of the capital gain just added to his income.)

Therefore, 80% multiplied by R250 000,00 = R200 000.00 (which must now fall into the Trust’s income tax return to be taxed accordingly). Step 2 R200 000.00 is taxed at 41% = R82 000.00 Capital Gains Tax. The above is a two step calculation process; however, there is an easier and quicker method to work out the approximate Capital Gains Tax and this is to apply the effective capital gains tax rate (expressed as a percentage) directly to the net capital gain in a one step process.

To calculate the effective Capital Gains Tax rate: Multiply the inclusion rate by the income tax rate of the taxpayer.


For Individuals:

A few frequently asked questions:

1. Q: What date triggers the liability for Capital Gains Tax and into which tax year would the tax obligation fall?

= 16.4% which would be the highest effective Capital Gains Tax rate levied. The lower the individual’s income tax rate, the lower the effective Capital Gains Tax rate to be applied to the whole of the profit. Someone who is only taxed at 30% would then take 40% inclusion rate multiplied by 30% income tax rate which equals 12% to calculate the effective Capital Gains Tax rate applicable to them in that tax year (significantly less than 16.4%). Given that the lowest income tax rate is 18%, the lowest effective Capital Gains Tax rate is 7,2% (40% x 18%). Following on from our previous example and applying the one step process, the net capital gain of R250 000.00 would attract Capital Gains Tax as follows: R250 000.00 x 16.4% = R41 000.00 This is the same amount arrived at as when applying the two step process set out above. The one step process is just simpler and one can always calculate a worst case scenario by roughly calculating the Capital Gains Tax on 16,4% and working down from there as a basic estimate, if unsure. (The range for the effective Capital Gains Tax rate applicable is 7,2% - 16,4%). It is important to note that the amount of the capital gain to be added to the tax payer’s annual income could actually push them into a higher income tax bracket for that tax year.

A: It is the registration of transfer date – when the proceeds actually accrue in the hands of the tax payer (not the date of sale). So if a property was sold before 1 March 2016 and only transferred thereafter or is still in the process of being transferred, the 2017 (higher) Capital Gains Tax rate would be applied. 2. Q: If a property is owned 50/50, is the R2 000 000.00 primary residence exemption for each tax payer?

Capital Gains tax inTherelation A: No, R1 000 000.00 is allowed each. exemption is apportioned according to the owners’ shareholding in the to property property. 3. Q: With regard to the annual profit rebate of R40 000.00, is that applied and calculated for every year the tax payer Seller has owned the property (since Capital Gains Tax was2013/2014 introduced – ie. October 2001)? A: No, it is a once off rebate only applied in the tax year of registration of transfer. So if the profit in question was realised over an 8 year period, say from 2008 being the date of acquisition to 2016 being the date of registration of transfer, you would not be entitled to 8 years multiplied by the R40 000.00 rebate – R320 000.00. Unlucky!

For Companies and Close corporations:

TRANSFER DUTY

80% inclusion rate x 28% flat income tax rate = 22.4 % effective Capital Gains Tax rate

The only other major change worthy of mention as regards property transfers in particular was the increase in the transfer duty rate in respect of properties purchased exceeding the value of R10 million. The rate was increased from 11% to 13% in respect of the amount over R10 million.

Purchase price of R11 million prior to 1 March 2016 – transfer duty was R1 047 500.00

For Trusts: 80% inclusion rate x 41% flat income tax rate = 32.8% effective Capital Gains Tax rate

Purchase price of R11 million from 1 March 2016 onwards – transfer duty now R1 067 500.00

If we were to more than double that purchase price to say, R25 million: Transfer duty up to 1 March 2015 = R2 587 500.00 Transfer duty from 1 March 2016 onwards = R2 887 500.00 In conclusion, the above is only a simplified guide to understanding the basic workings and changes introduced to the Capital Gains Tax laws and for more indepth and detailed advice as regards your capital gains tax liability, please contact your tax consultant or accountant.
