IEe baba wat vroeër dié maand deur twee tienerseuns van Addo in bosse gekry en gered is, het baie diep in die gemeenskap se harte ingekruip. Soveel so dat inwoners Maandag spesiaal ’n ooievaarstee vir die seuntjie en sy pleegouers op Addo gehou het. “Oe, ek is so dankbaar,” het klein Marco* se pleegma Sarah* gesê toe sy die hoop babakleertjies, doeke en speelgoed sien. Vir haar is die ooievaarstee die beste geskenk vir Marco wat gister drie weke oud geword het. “Toe ons besluit het om aan te bied om pleegouers te wees, het ek nie eens gedink aan geld en alles wat hy gaan nodig hê nie.” “Ek het net gedink hier is ’n kind wat ’n moeder nodig het.” Marco het salig geslaap terwyl sy pleegma se kollegas oor hom gekoer het. “Mag die Here julle baie jare spaar,” het een vrou gesê, terwyl meer as een gesê het hy is pragtig. Tammy Zimmerman, een van Sarah se kollegas wat die ooievaarstee gereël het, het gesê Marco se verhaal het haar van die eerste oomblik af aangegryp. “Ek wou net so graag iets vir sy pleegouers gee. Dit kos ’n baie spesiale mens om iemand anders se kind te vat en as jou eie groot te maak.” Marco se pleegpa, Frans Phillips*, het vir groot vermaak gesorg toe hy gespot het oor die klomp geskenke en gesê het hy “sien dan nou nie ’n rugbybal nie”. “Ek kan aan sy hande sien dat hy ’n rugbybal sal kan vashou,” het hy gesê. Op ’n meer ernstige noot het Phillips vertel sy hartsbegeerte is dat hy en sy vrou klein Marco sal kan aanneem.

Women killed in accident
KOM AAN BOORD MET LOSLITDAG
The body of an unknown women was found on the Kirkwood/Enon tar road by members of Kirkwood police, whilst patrolling the area early last Sunday morning. The deceased, possibly in her late thirties, had an open wound on her left side of her head and bruises on her left arm. It is alleged that a vehicle might have bumped into her and driven off. Anyone who might be able to assist the Kirkwood police with information pertaining to the incident or the identification of the deceased is requested to contact the investigating officer, D/W/O Jafta Uithaler on 0078 870 9922 or SAPS Kirkwood on 0042 230 7600. SAPS Kirkwood is investigating a case of culpable homicide.
Body of unknown man found in John Street The Uitenhage police are looking for the next of kin of an unknown man that passed away on Thursday, 19 July 2012. According to police records, the body of the man was found lying in an open field in John Street, Uitenhage, at about 09:50 by a member of the community. The unknown man was known only as “Johnny” and had no fixed address. The man who was in his mid forties, was wearing a navy jacket, khaki trousers and safety boots. His front tooth was missing. He weighed about 50kg and was 1,7m tall. Police are conducting an Inquest and anyone who might be able to assist with information is requested to contact the investigating officer, D/W/O Peter Chant during office hours on 0041 996 4515.

Steyn (25) het vir ’n paar weke op Uitenhage oorgestaan ter voorbereiding vir sy staptog. Toe die UD Nuus hom Dinsdag skakel, was hy sowat 16 km buite Humansdorp en het hy
gesê dit gaan sover baie goed en hy kry baie ondersteuning van verbygangers langs die pad. Steyn het vroeër gesê hy pak ’n verskeidenheid lang staptogte aan om die mobiliteit van sy prostese te toon. “Die doel, afgesien daarvan om geld in te samel, is om die Paul Steyn-stigting aan die publiek bekend te stel,” het hy verduidelik. Luca is op 16 November 2008 drie maande te vroeg gebore. Hy is sonder ’n regterbeen gebore en al die tone van sy linkervoet was aan mekaar vasgegroei. Bergsig ‘bizarre’ Boeredag by Kleinpoort gehou
’n Boeredag met program gelaai vol interessante uitstallings, aktiwiteite en sprekers word eersdaags deur Cockscomb Landbouvereniging op Kleinpoort aangebied. Volgens Schalk Nel, voorsitter van die vereniging, word die boeredag gereël in samewerking met alle omliggende landbouverenigings. “Besoekers kan hulle regmaak vir ‘n opwindende program met Ernest Pringle, president van die Agri Oos-Kaap, as die hoofspreker. Hy sal gesels oor die ‘toekoms van landbou in die Oos-Kaap en grondkwessies’ wat ’n baie relevante onderwerp is,” het Nel gesê. Verskeie ander sprekers sal ook tydens die boeredag oor interessante onderwerpe gesels. Daar is ook opleidingsgeleentheid vir plaaswerkers oor veehantering en draadspan. Plaaswerkers wat hierdie opleiding wil bywoon moet ‘n draadtang en hulle ID dokument saambring aangesien sertifikate na afloop daarvan aan hulle uit-

’n Groep oudleerders van Gamblestraat Sekondêre Skool op Uitenhage het die inisiatief geneem om ’n alumni op die been te bring met die doel om ’n sterk ondersteunende rol by hul Alma Mater te vervul. “Ons was trots op die skool. Dit was vroeër jare een van die beste skole in die omgewing. Dinge het bietjie agteruitgegaan en ons oudleerders wil toesien dat die kinders weer met trots oor hulle skool kan praat,” het Kosie Basson, ’n Gamblestraat oud-leerder gesê. Volgens Basson was daar nog nooit reünies nie en het dit tyd geword dat oudleerders saam moet staan om ’n verskil te probeer maak in die opheffing van die skool.
’n Algemene vergadering met die doel om ’n struktuur te stig en ’n komitee aan te wys word op 29 September (09:00-13:00) by die Uitenhage Rugbyklub se klubhuis gehou. Alle oud-Gamblestraat leerders word uitgenooi om die vergadering by te woon. Bothasrus hou Lentefees Die lente is in die lug en Bothasrus gemeente op Despatch gaan die aanbreek van die nuwe seisoen vier met hulle Lentefees op 12 September. ’n Op-en-wakker boeremusiekorkes sal sorg vir die musiek in die nie-alkoholiese “Biertent” waar allerlei tuisgebroude biere soos pynappelen gemmerbier te koop aangebied word. Daar sal ook ‘n verskeidenheid tradisionele feeslekkernye wees soos kerrie-en-rys, varknetbroodjies, pannekoek, poedings en koeke. Music therapy workshop A practical workshop in music therapy will be presented by Yolandé Burger at Summerwood Primary school hall. She is a professional instructor at the Polyclinic in Jeffreys Bay, where she rehabilitates patients by means of music and water therapy. Although the workshop will be presented for members of SASMT (South African Society of Music Teacher) non-members or the public are most welcome. Evicting tenant who won’t vacate An anxious reader tells the Property Poser experts that she concluded a rental agreement with a tenant, which specifically stated that one month’s notice would be given to vacate the premises should the property be sold. The lease agreement was on a month-tomonth basis. Earlier this year it appears that the property was, in fact, sold and around this time the tenant gave notice to both owner and agent that she would vacate the property. Shortly thereafter, she reneged on the notice to vacate and refused to move out, citing the PIE Act in her defence. The reader would like to know what her remedies are. Rian du Toit from DTS Attorneys in Nelson Mandela Bay says it appears that the agreement has been properly terminated in view of the fact that the tenant gave notice, which was accepted by the landlord. “The tenant is therefore in unlawful occupation of the property.” In terms of the provisions of the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act, or so-called PIE Act, no one may be evicted from a property without a court order, says Du Toit. “A landlord wishing to evict an unlawful occupier has to institute action to initiate the procedure to evict.” Du Toit says a notice authorised by a magistrate must be served on the unlawful occupier as well as the municipality at least 14 working days before the hearing on the eviction. “This notice obviously allows the lessee to oppose the action. At a hearing of the matter, the court will determine whether the landlord is entitled to evict the tenant.” The PIE Act contains reference to issues
to be considered by the court, says Du Toit. “These include the rights and needs of children, the elderly and households headed by women.” If the court finds that the owner is entitled to an eviction order, it will also assign a date upon which the unlawful occupier must vacate the premises, says Du Toit. The owner may call in the assistance of the sheriff to remove the occupiers, should they still not vacate the premises on the due date, says Charlotte Vermaak from Chas Everitt in the metro. Vermaak says this unfortunately does not provide much solace for the reader at this point. “It appears that transfer has taken place and, typically, the agreement of sale would make provision for the seller to give the purchaser vacant occupation.” It is, however, possible that the property was sold subject to any applicable lease remaining intact, says Vermaak. “In such an instance, the new owner then replaces the seller as the landlord and is entitled to rental on the premises.” Similarly, says Vermaak, any issues relating to the eviction of a tenant would then be for the new owner to resolve. “However, it is critical that the purchaser not be unwittingly burdened with the problem tenant and the situation should be disclosed prior to passing transfer.” Vermaak says the buyer must be aware of the facts and still be prepared to accept transfer or the process should be stopped. “Our reader should carefully peruse the agreement of sale to determine whether it addresses the issue of occupation and/or existing tenants.” To ask a property-related question, visit www.propertyposer.co.za.

Mazda CX5 puts sport, smart in SUV driving SPORTY driving in a Sports Utility Vehicle (SUV) is what the Mazda CX-5’s advertisement on local television promises you. That sounds like the best of both worlds for the SUV mad South African motoring public. Another thing Mazda is adding to the mix is smart technology being the first model to fully incorporate Mazda’s Skyactiv technology which improves fuel economy through smart engines and green technology. Compact SUVs are all the rage, especially amongst women buyers who, like me, favour the high seating position, the high ground clearance and the feeling that you can go virtually anywhere – if you really have to – especially when it comes to mounting high pavements when parking is at a premium. And all of this is combined in a good looking package. And Mazda is ticking all the boxes with their CX-5. The vehicle test driven was the top of the range Mazda CX5 2.0 Individual with a six-speed automatic gearbox.
Interior
The CX-5 boasts keyless entry - giving the ladies especially one less thing to worry about finding in their handbags - as long as the handbag (with the key inside) is with you when you want to drive off, of course. To start or switch off the car, simply push the button behind the steering wheel. The interior is very stylish with accents of chrome and leather seats. The kids will also be thrilled with their own armrest – with cupholders – in the back.
The vehicle tested had a touch- screen monitor and a camera showing what is behind your vehicle as soon as the gear is slotted into reverse - something which I feel is non-negotiable on a biggish vehicle which is used on school runs with many little ones darting in and out of cars. The layout of the instruments and dashboard is simple and uncluttered and a bonus is the steering-wheel controls for the audio system. The instrumentation is clear and easy to read, and the controls are within reach and easy to operate. The interior is roomy and the boot more than adequate even for longish family holidays. The rear seats can also be folded down in a variety of positions to accommodate different types of cargo.

Ride
I found the automatic gearbox very lazy on acceleration and on uphills. On straights, however, it moves very well – at speed as well as in traffic. The steering is very responsive, the handling superb and the ride comfortable in this very surefooted vehicle. It handled the bumps and circles of city travelling with grace and without effort, often making you feel as if you are driving a sedan with the added bonus of the high seating position.

The CX-5 is available in three derivatives, i.e. the Active, Dynamic and Individual, with the Active being the most basic model and the only one without the automatic gearbox. The Active has 17inch steel wheels and a cloth interior. The Dynamic, has a 6-speed automatic gearbox, 17-inch alloy wheels, cruise control, leather coverings for the handbrake and steering wheel, as well as a 40/20/40 split rear seat.
