I’M WRITING TO you as the new editor of Virgin Islands Property & Yacht magazine and I couldn’t be more excited to begin this journey with you. SEPTEMBER 2016 BROUGHT devastation to the British Virgin Islands like many had never seen. Hurricanes Irma and Maria left a path of destruction and no island was spared. Tens of thousands of people lost everything, and it’s isolated location left the BVI in critical need of help. Necker Island’s owner, Sir Richard Branson, stayed on the island to weather the worst of the Category 5 storm Hurricane Irma with his team, and they all survived the incredible event by taking shelter in the concrete wine cellar of the Great House. Necker and Moskito Islands are also known for their animal conservation efforts, with more than 140 species claiming a home there. Critically endangered species of lemur

From updated buildings to totally new guest offerings, Necker has been reborn into an even more stunning place to experience as well bird species that have been reintroduced to the BVI are all cared for under world-class supervision, including extra care during the 2017 hurricanes. An incredible number of the animals survived, considering the unimaginable circumstances and due to the work of the dedicated team. Many of the lemurs, tortoises and rare birds were housed in the Great House on Necker Island during the hurricanes, and then it became an “animal hospital” after the storms to help injured animals recuperate. As of June 2018, much of the
flamingo population has returned, and new baby lemurs are being born on Necker. After the storms, Branson and the Necker Island team worked with the BVI government to mobilise relief efforts and contributed incredible amounts of time and effort to help their neighbouring islands get back on their feet. From distributing food, water, medical and sanitary supplies to coordinating relief flights with Virgin Atlantic, the heart of the BVI was never more evident than in the days, weeks and months following

the strongest Atlantic hurricane ever recorded. The Virgin Limited Edition Group supported the BVI communities with foundation support for longterm construction projects as well as participated in advising the BVI government on a long-term marshall plan and clean energy and job creation measures. Sam Branson flew to Barbados to escort a boat full of relief supplies back to the BVI. Inspired by the enduring spirit of the people of the BVI, Virgin Unite and Unite BVI had three major focuses for creating impact and supported community education, the environment and local entrepreneurship. By spearheading construction projects, funding youth empowerment nonprofits and working with the government to create a more sustainable energy grid and foster recycling programs, the Necker Island team is more than invested in the BVI community as a resort island. “The original Necker evolved over the years, whereas this time it’s a revolution!” said Sam Boddington, a member of the Necker Island construction team. The revolution of Necker Island has returned it to much more than its former glory. From updated buildings to totally new guest offerings, Necker has been reborn into an even more stunning place to experience.

BUILDING IN THE BVI Top tactics and tips for creating the perfect property in the British Virgin Islands W O R D S B Y PA U L M E L L O R
MANY CHOOSE TO acquire land in the British Virgin Islands and develop their own property, notwithstanding the availability of already developed properties for purchase. This approach will not be for everyone, but there are a number of factors that make this an attractive option for some, including the following: • There is a longstanding culture of land ownership in the BVI; • Many will prefer to design and build a property to their own tastes and standards, rather than accept the compromises that sometimes result from buying a developed property; and • There are opportunities for cost savings associated with acquiring land and developing a new property, versus acquiring a developed property.

Culture Large areas of land in the BVI remain in the ownership of local families. In many cases these areas of land are held with the intention that plots of land will be made available for future generations to develop their own property at the appropriate time.
Design There are many beautiful homes for sale in the BVI but inevitably not everyone will be able to find an existing home that matches their own personal requirements. Designing a home from scratch not only ensures the property will meet the needs and desires of the person designing it, but also allows the integration of the latest technologies. Smart connectivity, energy and water efficiency and protecting a property from inclement weather, are all some reasons it can be difficult or expensive to retrofit to an existing property.
Cost Part of the attraction of buying land, as opposed to an already developed property lies in its affordability, not least because of the opportunity for a stamp duty saving. Stamp duty on transfers of property in the BVI is calculated as a percentage (4% for Belongers and 12% for Non-Belongers) of the higher of the purchase price and market value of the property and is payable at completion. There is currently no form of capital gains or

other tax attributable to any increase in property value over time. This means there is an opportunity for a tax saving on acquiring a lower value plot of land and developing it, compared with acquiring a higher-value, already developed property. The above represents a summary of some of the reasons why buying land and developing it might be preferable for some. When pursuing this option, there are a number of factors that should always be taken into consideration.
Non-B elongers A Non-Belonger purchasing undeveloped land will need to submit a proposal for the development of the land as part of the application for the non-belongers land holding licence, which will be required before the purchase can be completed. If the development proposal is acceptable, it will be included as a condition in the non-belongers land holding licence, which the purchaser will be expected to comply with. The development condition is likely to require the purchaser to undertake the proposed development within a set timescale and in accordance with a minimum capital expenditure. Where the purchaser fails to comply with the development commitment contained in the non-belongers land holding licence, the BVI government may impose a financial penalty.

Homeowners’ Associations Many properties are located on residential estates on which homeowners’ associations that have been established to manage and maintain the common areas within those estates. The associations enforce rules and regulations that govern the residential estate for the benefit of all homeowners. In such cases, property owners are likely to be subject to the terms of a declaration of covenants that regulates the relationship between an individual property, the remainder of the properties on the estate and the homeowners’ association. Many of these declarations of covenants contain provisions that restrict to some degree the development that may be undertaken to the properties that are subject to them. It would not be uncommon for a declaration of covenants to include restrictions on the timing of any works, or for proposed works to first be subject to review and approval by an architectural committee, to ensure that appropriate design and building standards are maintained on the estate. A requirement to obtain approval should therefore be factored in to the overall timescale anticipated for the works to be completed.
Properties Subject to a Charge Property owners who acquired their property with a loan should review their loan documentation carefully before undertaking any development. The loan documentation might contain restrictions on undertaking development without the lender’s consent, or other restrictions on the manner in which such development is to be carried out. Where a property owner secures a loan to finance the development, the lender is likely to require that the property owner provides the lender with regular

updates in relation to the progress of the development and the release of the loan is likely to be done in stages, in accordance with the satisfaction of various development milestones.
Contractors Property owners should take care to employ reputable suppliers and contractors with a track record of quality workmanship. Ask to see examples of previous work, talk to previous customers to ask them about their experience and make sure the contractor or supplier enters into a contract for the work they will be undertaking. Doing so will ensure that the obligations of both parties are clearly set out and this will help to reduce the risk of disputes arising during the project. Particular thought should be given to the terms of payment and what obligation the contractor or supplier is under to return after the project has been completed, to deal with any snagging issues that might arise. Consider who is responsible for insuring the property and any incomplete works and who will be responsible for protecting the property and any materials against adverse weather, should the need arise. GIN’S ROYAL HISTORY Rum is a classic “sailing” spirit, and most associate it with the Caribbean’s sugar industry of the 18th and 19th centuries. However, gin also has a seafaring heritage. In the 18th century, the Royal Navy mandated that a particular amount of gin be on every sailing vessel. The term “Navy Strength Gin” was born; naval officers tested the alcohol level of the gin by pouring it into gunpowder. If the gunpowder still lit, it was strong enough! “Navy Strength Gin” still applies to this day in any gin with an alcohol level above 57%. Rumour has it that the gin gimlet cocktail was invented by a Royal Navy physician as a way to ward off scurvy at sea.

of citrus flavours from lemon and grapefruit, balanced with floral hibiscus notes. The finish is a light sweetness from cassia bark and liquorice root. These botanicals, combined in the still, produce a smooth, balanced flavour.
The Process BVI GIN is distilled in a handmade bespoke copper column still at the distillery near Little Bay. After mixing a precise combination of botanicals with a neutral grain alcohol, the mixture steeps in the still for 24 hours. The still is then heated very slowly until the alcohol begins to distill and passes through a condenser into a barrel. After 10 hours, the heat is turned off, a very high strength spirit remains and is left overnight. Over the next two days, the only post-distillation addition is water to bring the gin to drinking strength. The spirit is bottled, labeled and BVI GIN is born. As BVI GIN continues to grow, they hope to maintain a sustainable BVI-made product that would be and extension of the people and culture of the islands. Distillery tours are on the horizon as well.
