It is national Law Society election time. Various seats became available and voting opened on 08 August 2022 and remains open until 08 September 2022 so please make sure that you log in to view the nominees for the seats and cast your vote.

I was lucky enough to travel to the Isle of Wight in July to attend a Southern Area Association of Local Law Societies meeting as well as the Isle of Wight Annual Dinner. Both occasions went extremely well and it was lovely to meet with other local law societies and share ideas as well as to meet with Lubna Shuja – the current Vice President of the Law Society who will take Presidential office in October of this year. Lubna will be the first Asian and first muslim President of the Law Society and the seventh female to undertake the prestigious role. It was a pleasure to get to know her and I look forward to working with her, SAALS, the HILS committee and all our members over the coming year.

In addition to Mountbatten Hampshire, Trethowans has also elected Salisbury Hospice and Dorset Mind as its chosen charities in Wiltshire and Dorset.

Earlier this year, members of Trethowans’ Southampton office raised £2,000 for charity Abby’s Heroes in the Southampton Marathon, and in their last financial year Trethowans donated £25,000 to charities and good causes. ■

A number of staff will be taking part in the New Forest Marathon event on Sunday 11 September to raise funds for Mountbatten Hampshire, which will see runners and walkers choosing to take part in a Woodland Walk, 5k, 10k, half marathon or full marathon.

Trethowans votes to support Mountbatten Hampshire as one of its chosen charities

As part of its commitment to CSR, Trethowans is encouraging its employees to raise money for the hospice, or indeed any other cause that is close to their hearts through initiatives such as running events, long distance cycling and skydives.

“We are incredibly grateful to Trethowans for supporting Mountbatten as their charity of the year,” said Nigel Hartley, Mountbatten CEO. “Our aim is to meet the growing demand for our services across Southampton and large parts of Hampshire but to do that, we need our local communities behind us. This support from Trethowans will really help us and it gives us an opportunity to share our stories and spread awareness of Mountbatten around who we are and what we do.”

Mountbatten Hampshire is the local hospice providing 24/7 free care and support to people in Southampton and large parts of Hampshire with life-limiting illnesses, and their families. They support around 1,000 people a day and as an independent charity, must raise more than £10m every year to continue their work.

HAMPSHIRELEGAL | 11 HAPPENINGS IN HAMPSHIRE

Mike Watson, Trethowans’ Managing Partner, said: “We are very keen to give back to the local communities we serve in any way that we can and are pleased to announce Mountbatten Hampshire as one of our nominated charities.

Not only will the firm match any donations raised (up to a maximum of £15,000 per year), but it will also cover entrance fees up to £75, to make it easier for staff to take part in activities and raise more funds for charity.

S

taff at Trethowans, a UK Top 150 law firm based in Southampton, has elected Mountbatten Hampshire hospice as one of its chosen charities, with the firm promising to match any funds raised by staff.

“We ran a vote amongst all our staff and the hospice received a phenomenal amount of support from the Southampton office. It is a charity providing vital support to the local community and one we are proud to help fundraise for. We hope the firm’s pledge to match donations and cover entrance fees will encourage even more of our people to get involved.”

The firm, which has a longstanding commitment to supporting the Hampshire community and local charities, will also be sponsoring the Chawton House Challenge on Sunday 9th October. Organised by Alton Runners, the day will comprise a number of races for adults and children and is raising funds in aid of Alton Cardiac Rehab Centre, who are celebrating their 25th anniversary this year, and Chawton House, who are raising funds for a defibrillator. Chawton House sits within 275 acres of parkland, and the entry fee includes admission into the beautiful Chawton House Gardens.

Phillips staff updates

Phillips Partner, Jack Gardener, who was voted Hampshire Lawyer of the Year 2022, said: “With Phillips, talented lawyers and exceptional legal advice are a given. The new brand and website demonstrate the added extra that puts us above our competitors. We enable our clients through our unparalleled network, and we are actively ambitious for them; our aim is to stay with them on the journey, supporting all their key transitions and achieving, always, the best possible outcome.”

Human connection inspired the creative direction of the new ‘people’ focussed branding which embodies Phillips Law’s purpose to ‘really look after people and their businesses by bringing talented people together to deliver the most personal service that a law firm can provide.’ The new website is a gateway to attract clients and future talent by providing concise information and presenting a true picture of the firm and its people. The website aims to reflect the recent success of Phillips Law which has doubled in size and won a string of awards, including ‘Medium Firm of the Year 2021’ at the Law Society Awards, since it came under new management in 2018.

HELP YOUR CLIENT TO PROTECT THEIR INTERESTS, NOW AND IN THE FUTURE

16 | HAMPSHIRELEGAL

Informing homebuyers of the hazards arising from climate change that could affect their future property.

Dye & Durham’s market leading Climate Report launched to help property lawyers and conveyancers protect homebuyers’ best interests and make informed, future-facing decisions.

With all climate models projecting hotter, drier summers in the future, there is increasing likelihood of soil shrinkage, which can create downward movement in buildings located on vulnerable soils. This shrinkage is worse in clay soils, which are commonly found across the south east of England, and has the potential to move foundations, cracking walls and ceilings, resulting in expensive insurance claims and repair bills.

We know that subsidence can be caused by a number of issues, including the shrinkage and swelling of soils in response to changing moisture conditions, the impact of trees, aging infrastructure or man-made disturbances. To date, subsidence searches have looked at historic data to understand if such risks pose a threat to a property address, however with the changing climate, we believe it is vital to instead look forward to model future hazards.

HAMPSHIRELEGAL | 17 ADVERTISEMENT FEATURE

Lookingfigures.atHampshire,

our data shows that 6% of the county’s area will see soil subsidence hazard risk increase to ‘High’ by the 2050s, with a further 20% moving to ‘Very High’.

o ensure that home buyers have a clear understanding of possible hazards or restrictions that have the potential to affect their future home, a diligent property professional will always recommend undertaking a variety of searches for every residential transaction.

Our data suggests that more than 5.76 million properties in Great Britain are today exposed to medium or high subsidence risk. This increases to approximately 6.64 million in the 2030s. Specifically, just over half a million more properties (547,317) could be at high exposure in the next 60 years, compared to today’s

Yet, other well-known environmental issues such as subsidence, which has the potential to create a problem with lending and insurability if identified, are not always a go-to search. While this hazard may not be an issue everywhere in the UK today, we do believe it is an issue that should be taken seriously, particularly as we look into the future.

Ground Hazards: Due Diligence for Today and the Future

If we, as an industry, can increase awareness of climate change and its potential impact on our homes and communities, more people will become engaged and want to understand how this may affect their property in the future and take steps to help mitigate risks posed by the changing climate.

To learn more about the Climate Report or to obtain a free sample, email Insight-sales@dyedurham.com or visit https://dyedurham.com/insight-data-risks/ ■

In addition to subsidence, the Climate Report models a range of hazards for individual properties, including coastal erosion, flood risk exposure and extreme winds, over the next 60 years.

In fact, by the 2050s, our data shows us that over 80 counties across the UK are likely to experience an increased risk of soil subsidence hazard to some degree, moving from low to moderate, moderate to high, or high to very high, as a result of our changing climate. In particular, additional parts of Middlesex, Berkshire, Hertfordshire, Surrey and Hampshire could move to the highest subsidence hazard classes by the 2050s*2

The report has been designed to cover both physical hazards and delve into how extreme climate conditions could affect properties over time.

But what does this mean for property lawyers and conveyancers? We believe there is the potential to help clients understand climate change impacts by providing data insights as part of the conveyancing due diligence process.

We have undertaken some analysis of our National Ground Risk Model (NGRM): Climate™, which models future climate-related environmental hazards, and identified that more than 7.65 million properties in Great Britain could be exposed to medium or high risk of soil subsidence by the 2080s. This is an increase of over 1.89 million individual properties and is as a result of climate change*1

Last October, the Law Society published a Climate Change Resolution*3 that outlined the role solicitors can play in addressing the climate crisis, which included a call to action to develop a climate-conscious approach to legal practice.

In conveyancing, there is a tendency to look backwards to determine risk levels, however it is time to start using insight and data to look forward:

1. Climate change data has been calculated for Unique Property Reference Numbers (UPRNs) in Great Britain, based on a Medium Emissions Scenario (RCP:4.5 Equivalent to 2.4°C global warming by 2100s)

Modelling Future Hazards for Homebuyers

Ultimately, robust climate science indicates that we will see more hotter, drier summers and wetter winters as a result of our changing climate. These conditions are of real concern as they are likely to result in an increase in both the severity and frequency of climate-related impacts to our homes, infrastructure and, more worryingly, the health of vulnerable members of our communities.

Having access to financial advice is strongly linked to feeling more secure and less anxious about money. According to the survey, around 3 in 5 people who have received financial advice report that they feel financially more secure and stable, compared with under half of those who have not received any advice.

The COVID-19 pandemic has left many people feeling less stable in their financial situation. 35% of those who have not received financial advice report feeling anxious about their finances, while 65% see the value in being more prepared for unpredictable events in life.

Financial advice helps you prepare, plan and navigate any future shocks or crisis. And while you can experience the benefits of advice after just one meeting, it’s essential to receive ongoing advice over the long term as your situation and life goals change. This means your adviser gets to know you and

your background, and can help you adjust to whatever life has in store. Those people who have an ongoing relationship and receive regular financial advice are twice as likely to report feeling in control of their finances as people who do not. ■

DISCOVERING THE EMOTIONAL BENEFITS OF FINANCIAL ADVICE

FEELING LESS ANXIOUS

FEELING MORE CONFIDENT

One of the key practical benefits of financial advice is that it gives you access to expertise on topics that are complex. This provides you with more confidence and increased peace of mind. People who have received financial advice report feeling three times more confident about their understanding of financial matters and products than those who haven’t.

FEELING ABLE TO COPE IN A CRISIS

No two individuals share the same goals or ambitions. Each person is unique, with their own needs, targets and budgets. So when it comes to managing your money, building wealth, securing your future and, above all else, drawing up an effective plan for fulfilling your investment objectives, professional financial advice should be tailored to your unique specific needs.

Only 1 in 3 people who have received financial advice report feeling anxious about their household finances, compared with over 40% of those who haven’t.

For example, areas that some people find confusing concern retirement planning and understanding their life insurance and critical illness options. Among those who have not received advice, around 1 in 4 people say they would not know where to start when it comes to the different options available to them. Among those who received advice, that number is fewer than 1 in 12.

Since Russia’s invasion of Ukraine in February, there has been a marked increase in criticism of lawyers. TLS was keen to understand what impact this is having on perceptions of the legal profession, so it surveyed members of the public. The findings showed a worsening of public opinion of lawyers overall recently, which seems to have been driven by news/politics. TLS position remains that it is the job of solicitors to represent their clients, whoever they may be. This is how the public can be confident they live in a country that respects the rule of law. TLS is developing a strategy that engages positively with Government reform processes on specific issues such as SLAPPs and which supports solicitors. It will be actively engaging in further dialogue with solicitors and stakeholders, about the ethical challenges of operating in today’s environment.

Solicitors Indemnity Fund

R (On behalf of the Law Society) v Legal Aid Agency (ongoing): TLS issued proceedings in 2020 against the LAA challenging its decision to implement a new cost assessment regime, which, in essence, would have seen it assessing its own bills and removing the right to court assessment in almost all civil claims above £2,500, without adequate consultation. Following the commencement of proceedings by TLS, the Lord Chancellor offered to settle the matter on agreed terms. Pending the launch and outcome now of a consultation. Meanwhile, the MoJ announced practitioners can continue to have bills assessed either by the court or the LAA until November 2022.

T

The Solicitors Qualifying Exam (SQE)

The first SQE1 and SQE2 sittings results highlighted differences in pass rates between white and ethnic candidates. The SRA has commissioned the University of Exeter to conduct a project to find the main reasons. The new route was introduced to improve accessibility.

The SRA has taken on board TLS objection to getting rid of SIF altogether, noting that it removes protection for consumers. It has tested the mood of the profession in the last few weeks in a proposal inviting discussion prior to producing another consultation later this year. The amended suggestion is for a Claims Protection Fund –run by a new body to replace SIF Ltd, which currently administers the scheme. The idea of a small levy on solicitors to help fund the scheme was not explored further.

Unless the decision is overturned, it will become more difficult for members to recover the costs anticipated under a CFA. This will make it more difficult for some firms to continue to provide services to clients with low value personal injury claims which in turn will lead to less access to justice for those of modest means. It is also important because the CFA at the heart of the proceedings was based on a modified version of the Law Society’s model CFA. The hearing date is awaited.

he last Council meeting was in early July some of which I covered in the last issue of this magazine, so I will only refer to remaining topics discussed then that I hope may be of interest to you. I have also mentioned some developments appearing in the news. Council is due to meet again in September.

Case Interventions

Welcome to my latest update on what is happening at The Law Society

Cam Legal v Belsner: Cam Legal Limited is appealing against a decision of the High Court to the effect that a solicitor acts as a fiduciary prior to entering a retainer and is therefore obliged to ensure that the client had provided ‘informed consent’ to a CFA that is part of the retainer, on the basis of information provided by the firm –which had to meet the requirements of Civil Procedure Rules Part 46.2. This meant providing a specific example of the outcome to be expected if the claim settled at stage 2 of the pre-action protocol for low value PI claims

The Law Society intervenes in cases where it can provide the court with balanced, informative and useful submissions, advocating fundamental rights and freedoms and promoting the rule of law. There are two ongoing cases: a test case on fiduciary duty under a CFA and one re the Legal Aid Agency assessing its own bills:

Adrienne Edgerley 844544

Criminal Legal Aid: Since the Government published its response to the Independent Review of Criminal Legal Aid (CLAIR), TLS has engaged closely with MPs and Ministers to highlight its concerns about the shortfall in the Government’s proposed package for solicitors. TLS President gave evidence to the Justice Select Committee, outlining the crisis facing criminal defence practitioners and firms and calling for the Government to meet the recommendations of CLAIR. TLS continues to maintain pressure on this issue.

Strategic Lawsuits Against Public Participation and reputation of the profession: SLAPPs are set to be overhauled in a move welcomed by TLS, as the UK government seeks to prevent what it sees as potential abuses of the administration of justice.

The crisis was the key topic discussed at the Town Hall meeting held with TLS and local law societies back in May.

Judicial Review: TLS has achieved a major influencing success on the Judicial Review and Courts Bill by persuading the Government to drop a statutory presumption that would have directed judges to use particular remedies in judicial review cases. This success was the culmination of nearly two years of lobbying, encompassing engagement with government officials, key parliamentarians and the Public Bill Committee.

Do contact me with questions and concerns, I will be very pleased to hear from you. ■

rom practicing yoga and mindfulness beneath the trees to building on key areas of development with exciting outdoor activities, Maples Day Nursery in Winchester provides the perfect backdrop for children to thrive.

Armed with magnifying glasses, pre-schoolers at the awardwinning setting on Hatherley Road study inhabitants in garden bug hotels, create habitats for wildlife using natural materials and monitor the growth of plants, learning simple maths and science messages, as well as the importance of good nutrition and exercise to healthy lifestyles. With babies using recycled paper from the shredder for sensory activities, to older children growing herbs and vegetables in the garden which are then used in meals by talented Nursery Chefs, children of all ages take part in a curriculum of eco-activities the whole year round. “We are advocates of continuous, all-weather, outside play for all the health benefits it provides, as well as the opportunities for extending learning, appreciating the environment and using new tools and resources appropriately. We fully recognise the positive impact that being outdoors has on a child’s social, physical and emotional development and respecting and caring for the planet is an important lesson which we believe will stand the children in good stead for life”, said Nursery Manager, Sian Murphy, who

has over 15 years’ experience in the Early Years sector. Inside, the bright and spacious classrooms are filled with purpose-built facilities including art tables to inspire creativity and cosy corners for reading beloved storybooks. With stimulating learning spaces, state of the art ICT, toys and equipment, messy play stations and ‘role play’ areas, each child from six weeks to nearly five years is able to immerse themselves in the vast learning opportunities on offer, with activities planned around personal interests and designed in line with Early Years Foundation Stage principles. At Maples, pre-schoolers can prepare for their next steps in education with a tailored school readiness programme, covering topics ranging from self-care to phonics, where they can develop fundamental skills such as using cutlery and writing their names. Gareth is confident of the continued success of Leap and of the law firms that Leap serves.

It’s well known in the industry that we invest every year in the innovation of what is already the most widely used product in the market. There are always opportunities, and these will come from continuing to drive development. We drive innovation in terms of investing in our products and innovation in our services, thinking about new ways that we can help our clients. Our customer success team constantly questions how we can improve.

“We will survive and thrive because of our problem-solving approach. Our focus on technology development and our partnership approach to working with law firms helps future proof Leap and the businesses we serve, ensuring continued evolution, relevance and value in an ever-changing world.”

Leap appoints Gareth Walker as UK CEO

Innovation for us is a state of mind. We really have an evolution ethos here. We continually strive to be the best. The moment you stand still and you stop, you fall behind. And for us, it is about continually driving improvement in every single area of the business and every single aspect of what we do. We have a day one mentality. Today is day one. What do we know today? And what do we do to move forward? That’s something we drive a lot, and our business structures are fully designed around making sure that we do that.

Gareth shares the following thoughts and observations as CEO:-

Effective use of cloud-based technology provides solutions to current business challenges, facilitating vital remote and hybrid working practices for law firms and reducing the headcount needs, overcoming the current skills gap caused by a scarcity of talent.

In terms of the business landscape, the market and the importance of technology, Gareth has seen some key changes in his time at Leap and notes important constants. “I’ve been with Leap since we arrived in the UK in December 2013 and it has been an incredible journey. There have been many changes.”

On the business landscape, the market and the importance of technology and of constantly innovating:

– Gareth discusses the opportunities and challenges involved in his first six months, leading Leap UK

“The current business challenges faced by law firms, such as the scarcity of talent in the market, the rise in global costs and the need to adapt successfully to hybrid working are very much supported by Leap solutions. By automating daily tasks, improving cash flow and mitigating risk, Leap enables law firms to be more profitable and productive without the need for more staff or impacting customer standards. Using the right technology partner will support law firms to future-proof their practice, counter the effects of inflation and help to grow the business.”

About Leap

Many years ago law firms would reluctantly accept the use of technology, now they want to embrace it. That’s probably one of the biggest things I’ve seen. This makes the onboarding process easier, however customers are quite rightly more demanding of their technology partners. The relationship is not just as a supplier but as a partner now and therefore the role of our Leap Practice Productivity Advisors is so crucial.

The Leap partnership approach and the development and evolution of Leap Practice Productivity Advisors is critical to ongoing success. If we understand our law firms and their business processes and what they’re trying to achieve, then we can train their people in the right way. Once trained, we help them manage their staff training and processes. Our customer service plays a key role in this. It’s not just training individuals, it’s working with a law firm, top down, to help them embed those processes and skills and being able to do that in a remote working setting. We proactively want to spend time with our customers to see how they are using the software and suggest how to adapt business processes for maximum effect. We are a very proactive business. Ultimately, it’s about supporting law firms to use technology to mitigate challenges and achieve business success.

Leap Legal Software has been helping small to mid-sized law firms to become more efficient and profitable globally for more than 25 years. www.Leap.co.uk

Gareth’s first months as CEO have come at a turbulent time for the profession. Law firms are juggling the challenges of hybrid working and retaining and attracting talent in a competitive recruitment market. All this whilst maintaining an affordable yet profitable service. Gareth is, however, very positive about the future for the law firms Leap

He adds, “Law firms are incredibly resilient through tough times. When things are tough, law firms need to embrace software even more. This enables them to continue delivering the same level of services with lower overheads as well as using less people. For us this means driving innovation in everything we do. We are passionate about how we do that.”

In terms of the business landscape, we are faced with global political, economic and societal challenges caused by the war in Ukraine and Covid, however we’re continuing to grow rapidly. Law firms are resilient in tough times and turn to software to provide solutions to business challenges. There is an understanding that you’ve got to continue to drive and improve to survive and thrive in a challenging business climate.

eap, the largest independent provider of software to law firms worldwide, has recently appointed Gareth Walker as CEO of Leap in the UK and Ireland. Previously Chief Operating Officer of Leap for five years, Gareth has extensive experience of the Leap business and the industry. He has worked in legal software for over 15 years and has been with Leap since they opened their first office in Twickenham, London. He has seen the business grow from the inside and has experienced first-hand the market changes over the years.

We have seen amazing advancements in the technology available in the market, and Leap has been a clear driver in that. The technology now available to law firms is just incredible. There are new players and innovations emerging constantly.

On the changes, opportunities and challenges facing law firms and the importance of a partnership approach: Law firms’ adoption of technology has developed significantly in the last 15 years. The firms have a lot more knowledge when they go out to market now. The options are numerous, but law firms know there is more guidance available.

Preparing contract packs is a time-consuming task for the seller’s solicitor; collating documents from various sources, manually checking the information, and inconsistencies with data can cause delays throughout the process. Delegates at The Onboarding Summit in February identified contract packs as a key area they’d like to see improvements made to make this process more efficient.

The simplest way to reduce your paper use is to stop creating new paper files and documentation. One way to achieve that is to move from a paper-based client system to a digital one.

InfoTrack launches new Digital Contract Packs for sellers

Louise Edwardes, Head of Product at InfoTrack comments “We’re thrilled to launch Contract of Sale to enable law firms to generate their contract packs digitally within minutes. Having reduced client onboarding to a process that can be completed in minutes, our clients asked us to address the challenge of manually collating documents and preparing contract packs. Contract of Sale aims to improve firms’ productivity and speed up the pre-completion process to avoid causing delays in the chain. We’ve seen validations reduce errors with digital AP1s, so have applied a similar feature to digital contract packs to ensure better consistency in data, making the entire process more efficient for firms.” ■

Contract of Sale from InfoTrack is a tool developed to speed up the pre-completion process for law firms by automating the collation of documents including TA forms, Land Registry Office Copies and the EPC, and the Standard Conditions of Sale. Data is then validated to ensure information is correct before firms can generate their digital contact packs in just four clicks.

Be sure to shred documents that are no longer required and take your time to clear the back log – it should be a marathon and not a sprint.

How to go paperless in your law firm

Seeking to go paperless in your office? These three steps can get you started today.

3. Adopt clear processes

If you want a paperless system to stick, it is imperative that you outline that system in writing. This should answer questions, such as:

storage system, such as Dropbox or OneDrive, can be used for storage. Alternatively, consider a practice management software (such as Clio’s which has in-built cloud storage) to store all client details where it can be accessed in just a few clicks.

Who is responsible for making sure this all gets done?

Unless you are a brand-new law firm, chances are good that you have at least some (or many) paper files and documents stored in your office or in use now. This is where a quality digital scanner will come in handy. Start with the documents you need immediately and work backwards when digitising. A cloud-based

How are files named and organised on your cloud storage server?

With technology, you can reduce a lot of paper from the intake and onboarding process: client details can be stored in a spreadsheet or in an online folder. Documents can be emailed and sent for e-signature. Moving to a client relationship management (CRM) platform for lawyers, such as Clio Grow, can offer even more paperless benefits. CRMs and practice management software allow you to set up paperless agreements, intake forms, billing, and e-signatures, for example.

ward-winning technology provider, InfoTrack, has launched Contract of Sale, a new digital solution designed to enable firms to prepare and send contract packs digitally to speed up the pre-completion process.

Reducing errors Contract of Sale from InfoTrack uses the validated data to minimise the risk of delays at completion when transferring the title to the purchaser via their AP1. Thus, if a husband assisted a wife to commit suicide and that amounted to an offence under the Suicide Act 1961 then the forfeiture rule applies, and the husband would not inherit her estate. However, section 2 empowers the court to disapply or modify the rule if it is satisfied ‘having regard to the conduct of the offender and of the deceased and to such other

But there is a gap in the law where a person is subject to domestic abuse and commits suicide. For example, an abusive husband abuses his wife both verbally and physically and the wife commits suicide. A manslaughter conviction is possible if it can be shown the suicide was triggered by a physical assault which was the culmination of a course of abusive conduct by the husband and the final assault played a significant part in causing the wife to commit suicide and the wife had a fragile and vulnerable personality: R v D [2006] EWCA 1139. t is against public policy for a person, who has been convicted of the murder or manslaughter of another person, to inherit that person’s estate. So, it would be morally wrong for a husband to inherit his wife’s estate after he has been convicted murdering her. This is recognised by section 1 of the Forfeiture Act 1982 which defines the forfeiture rule as ‘the rule of public policy which in certain circumstances precludes a person who has unlawfully killed another from acquiring a benefit in consequence of the killing’.

In addition, the forfeiture rule applies to anyone who ‘unlawfully aided, abetted, counselled or procured the death, from acquiring the benefit in consequence of the killing’ (section 1(2)).
