HILS are very pleased to once again be putting on a joint Conveyancing CPD Seminar with HW Conveyancing Searches. This is taking place on Tuesday 20 September 2022 at Eastleigh Football Club and includes talks from a Principal Planning Officer and Arbor Culturalist. I have been invited to the opening of the Legal Year which takes place on Monday 03 October 2022 and I am looking forward to attending and reporting on that prominent event.

It is national Law Society election time. Various seats became available and voting opened on 08 August 2022 and remains open until 08 September 2022 so please make sure that you log in to view the nominees for the seats and cast your vote.

I was lucky enough to travel to the Isle of Wight in July to attend a Southern Area Association of Local Law Societies meeting as well as the Isle of Wight Annual Dinner. Both occasions went extremely well and it was lovely to meet with other local law societies and share ideas as well as to meet with Lubna Shuja – the current Vice President of the Law Society who will take Presidential office in October of this year. Lubna will be the first Asian and first muslim President of the Law Society and the seventh female to undertake the prestigious role. It was a pleasure to get to know her and I look forward to working with her, SAALS, the HILS committee and all our members over the coming year.

Earlier this year, members of Trethowans’ Southampton office raised £2,000 for charity Abby’s Heroes in the Southampton Marathon, and in their last financial year Trethowans donated £25,000 to charities and good causes. ■

A number of staff will be taking part in the New Forest Marathon event on Sunday 11 September to raise funds for Mountbatten Hampshire, which will see runners and walkers choosing to take part in a Woodland Walk, 5k, 10k, half marathon or full marathon.

As part of its commitment to CSR, Trethowans is encouraging its employees to raise money for the hospice, or indeed any other cause that is close to their hearts through initiatives such as running events, long distance cycling and skydives.

“We are incredibly grateful to Trethowans for supporting Mountbatten as their charity of the year,” said Nigel Hartley, Mountbatten CEO. “Our aim is to meet the growing demand for our services across Southampton and large parts of Hampshire but to do that, we need our local communities behind us. This support from Trethowans will really help us and it gives us an opportunity to share our stories and spread awareness of Mountbatten around who we are and what we do.”

Mountbatten Hampshire is the local hospice providing 24/7 free care and support to people in Southampton and large parts of Hampshire with life-limiting illnesses, and their families. They support around 1,000 people a day and as an independent charity, must raise more than £10m every year to continue their work.

taff at Trethowans, a UK Top 150 law firm based in Southampton, has elected Mountbatten Hampshire hospice as one of its chosen charities, with the firm promising to match any funds raised by staff.

“We ran a vote amongst all our staff and the hospice received a phenomenal amount of support from the Southampton office. It is a charity providing vital support to the local community and one we are proud to help fundraise for. We hope the firm’s pledge to match donations and cover entrance fees will encourage even more of our people to get involved.”

The firm, which has a longstanding commitment to supporting the Hampshire community and local charities, will also be sponsoring the Chawton House Challenge on Sunday 9th October. Organised by Alton Runners, the day will comprise a number of races for adults and children and is raising funds in aid of Alton Cardiac Rehab Centre, who are celebrating their 25th anniversary this year, and Chawton House, who are raising funds for a defibrillator. Chawton House sits within 275 acres of parkland, and the entry fee includes admission into the beautiful Chawton House Gardens.

London Legal Walk participants, including The Solicitors’ Charity team led by CEO Nick Gallagher, supporting access to justice.

After crossing the finish line, the walkers celebrated at an evening street party featuring food vendors, fire jugglers and musicians.

The Solicitors’ Charity Chief Executive Nick Gallagher said: “This year’s London Legal Walk had a great atmosphere created by all those taking part – including 10 of the charity’s volunteers and staff. A huge amount has been raised to help provide more free and pro bono advice to solicitors in London and the South East.

There was also a fun ‘Wheel of Fortune’ on the charity stand –giving walkers the opportunity to win big, which proved a huge hit! It was a brilliant opportunity for The Solicitors' Charity to engage with solicitors from across the UK, and visitors loved taking part in the fun and games on the interactive stand.

James has a 26 year career background in banking, investment management and business development and currently works with charities as Portfolio Director for Cazenove Capital. It is this specialist knowledge and experience that made the prospect of a new role as Trustee and Honorary Treasurer for The Solicitors’ Charity so appealing.

Informing homebuyers of the hazards arising from climate change that could affect their future property.

Dye & Durham’s market leading Climate Report launched to help property lawyers and conveyancers protect homebuyers’ best interests and make informed, future-facing decisions.

With all climate models projecting hotter, drier summers in the future, there is increasing likelihood of soil shrinkage, which can create downward movement in buildings located on vulnerable soils. This shrinkage is worse in clay soils, which are commonly found across the south east of England, and has the potential to move foundations, cracking walls and ceilings, resulting in expensive insurance claims and repair bills.

We know that subsidence can be caused by a number of issues, including the shrinkage and swelling of soils in response to changing moisture conditions, the impact of trees, aging infrastructure or man-made disturbances. To date, subsidence searches have looked at historic data to understand if such risks pose a threat to a property address, however with the changing climate, we believe it is vital to instead look forward to model future hazards.

our data shows that 6% of the county’s area will see soil subsidence hazard risk increase to ‘High’ by the 2050s, with a further 20% moving to ‘Very High’.

In addition to subsidence, the Climate Report models a range of hazards for individual properties, including coastal erosion, flood risk exposure and extreme winds, over the next 60 years.

In fact, by the 2050s, our data shows us that over 80 counties across the UK are likely to experience an increased risk of soil subsidence hazard to some degree, moving from low to moderate, moderate to high, or high to very high, as a result of our changing climate. In particular, additional parts of Middlesex, Berkshire, Hertfordshire, Surrey and Hampshire could move to the highest subsidence hazard classes by the 2050s*2

The report has been designed to cover both physical hazards and delve into how extreme climate conditions could affect properties over time.

But what does this mean for property lawyers and conveyancers? We believe there is the potential to help clients understand climate change impacts by providing data insights as part of the conveyancing due diligence process.

A contaminated land or flood search are often routinely undertaken by many, regardless of location, property type, size, proposed use or client.

Future Insights from the Climate Report

We have undertaken some analysis of our National Ground Risk Model (NGRM): Climate™, which models future climate-related environmental hazards, and identified that more than 7.65 million properties in Great Britain could be exposed to medium or high risk of soil subsidence by the 2080s. This is an increase of over 1.89 million individual properties and is as a result of climate change*1

Last October, the Law Society published a Climate Change Resolution*3 that outlined the role solicitors can play in addressing the climate crisis, which included a call to action to develop a climate-conscious approach to legal practice.

In conveyancing, there is a tendency to look backwards to determine risk levels, however it is time to start using insight and data to look forward:

Having access to financial advice is strongly linked to feeling more secure and less anxious about money. According to the survey, around 3 in 5 people who have received financial advice report that they feel financially more secure and stable, compared with under half of those who have not received any advice.

The COVID-19 pandemic has left many people feeling less stable in their financial situation. 35% of those who have not received financial advice report feeling anxious about their finances, while 65% see the value in being more prepared for unpredictable events in life.

Only 1 in 3 people who have received financial advice report feeling anxious about their household finances, compared with over 40% of those who haven’t.

For example, areas that some people find confusing concern retirement planning and understanding their life insurance and critical illness options. Among those who have not received advice, around 1 in 4 people say they would not know where to start when it comes to the different options available to them. Among those who received advice, that number is fewer than 1 in 12.

Since Russia’s invasion of Ukraine in February, there has been a marked increase in criticism of lawyers. TLS was keen to understand what impact this is having on perceptions of the legal profession, so it surveyed members of the public. The findings showed a worsening of public opinion of lawyers overall recently, which seems to have been driven by news/politics. TLS position remains that it is the job of solicitors to represent their clients, whoever they may be. This is how the public can be confident they live in a country that respects the rule of law. TLS is developing a strategy that engages positively with Government reform processes on specific issues such as SLAPPs and which supports solicitors. It will be actively engaging in further dialogue with solicitors and stakeholders, about the ethical challenges of operating in today’s environment.

Solicitors Indemnity Fund

R (On behalf of the Law Society) v Legal Aid Agency (ongoing): TLS issued proceedings in 2020 against the LAA challenging its decision to implement a new cost assessment regime, which, in essence, would have seen it assessing its own bills and removing the right to court assessment in almost all civil claims above £2,500, without adequate consultation. Following the commencement of proceedings by TLS, the Lord Chancellor offered to settle the matter on agreed terms. Pending the launch and outcome now of a consultation. Meanwhile, the MoJ announced practitioners can continue to have bills assessed either by the court or the LAA until November 2022.

The Solicitors Qualifying Exam (SQE)

The first SQE1 and SQE2 sittings results highlighted differences in pass rates between white and ethnic candidates. The SRA has commissioned the University of Exeter to conduct a project to find the main reasons. The new route was introduced to improve accessibility.

The SRA has taken on board TLS objection to getting rid of SIF altogether, noting that it removes protection for consumers. It has tested the mood of the profession in the last few weeks in a proposal inviting discussion prior to producing another consultation later this year. The amended suggestion is for a Claims Protection Fund –run by a new body to replace SIF Ltd, which currently administers the scheme. The idea of a small levy on solicitors to help fund the scheme was not explored further.

Unless the decision is overturned, it will become more difficult for members to recover the costs anticipated under a CFA. This will make it more difficult for some firms to continue to provide services to clients with low value personal injury claims which in turn will lead to less access to justice for those of modest means. It is also important because the CFA at the heart of the proceedings was based on a modified version of the Law Society’s model CFA. The hearing date is awaited.

he last Council meeting was in early July some of which I covered in the last issue of this magazine, so I will only refer to remaining topics discussed then that I hope may be of interest to you. I have also mentioned some developments appearing in the news. Council is due to meet again in September.

Welcome to my latest update on what is happening at The Law Society

Cam Legal v Belsner: Cam Legal Limited is appealing against a decision of the High Court to the effect that a solicitor acts as a fiduciary prior to entering a retainer and is therefore obliged to ensure that the client had provided ‘informed consent’ to a CFA that is part of the retainer, on the basis of information provided by the firm –which had to meet the requirements of Civil Procedure Rules Part 46.2. This meant providing a specific example of the outcome to be expected if the claim settled at stage 2 of the pre-action protocol for low value PI claims

The Law Society intervenes in cases where it can provide the court with balanced, informative and useful submissions, advocating fundamental rights and freedoms and promoting the rule of law. There are two ongoing cases: a test case on fiduciary duty under a CFA and one re the Legal Aid Agency assessing its own bills:

Criminal Legal Aid: Since the Government published its response to the Independent Review of Criminal Legal Aid (CLAIR), TLS has engaged closely with MPs and Ministers to highlight its concerns about the shortfall in the Government’s proposed package for solicitors. TLS President gave evidence to the Justice Select Committee, outlining the crisis facing criminal defence practitioners and firms and calling for the Government to meet the recommendations of CLAIR. TLS continues to maintain pressure on this issue.

Strategic Lawsuits Against Public Participation and reputation of the profession: SLAPPs are set to be overhauled in a move welcomed by TLS, as the UK government seeks to prevent what it sees as potential abuses of the administration of justice.

The crisis was the key topic discussed at the Town Hall meeting held with TLS and local law societies back in May.

Judicial Review: TLS has achieved a major influencing success on the Judicial Review and Courts Bill by persuading the Government to drop a statutory presumption that would have directed judges to use particular remedies in judicial review cases. This success was the culmination of nearly two years of lobbying, encompassing engagement with government officials, key parliamentarians and the Public Bill Committee.

If you want a paperless system to stick, it is imperative that you outline that system in writing. This should answer questions, such as:

Thus, if a husband assisted a wife to commit suicide and that amounted to an offence under the Suicide Act 1961 then the forfeiture rule applies, and the husband would not inherit her estate. But there is a gap in the law where a person is subject to domestic abuse and commits suicide. For example, an abusive husband abuses his wife both verbally and physically and the wife commits suicide. A manslaughter conviction is possible if it can be shown the suicide was triggered by a physical assault which was the culmination of a course of abusive conduct by the husband and the final assault played a significant part in causing the wife to commit suicide and the wife had a fragile and vulnerable personality: R v D [2006] EWCA 1139. This is difficult to prove and if it cannot be proved the forfeiture rule does not apply and the husband will inherit the wife’s estate. This is intolerable. This gap in the law needs to be filled. ■

t is against public policy for a person, who has been convicted of the murder or manslaughter of another person, to inherit that person’s estate. So, it would be morally wrong for a husband to inherit his wife’s estate after he has been convicted murdering her. This is recognised by section 1 of the Forfeiture Act 1982 which defines the forfeiture rule as ‘the rule of public policy which in certain circumstances precludes a person who has unlawfully killed another from acquiring a benefit in consequence of the killing’.

In addition, the forfeiture rule applies to anyone who ‘unlawfully aided, abetted, counselled or procured the death, from acquiring the benefit in consequence of the killing’ (section 1(2)).

When Poppy’s Dog Guardian contacted us to advise that her owner was now receiving palliative care and that they needed to activate her Canine Care Card, Poppy was collected by Dogs Trust the very next day. After a vet and behavioural assessment we decided the best place for Poppy would be a loving foster home. We were able to advise the foster carers of all the information we’d been given by Poppy’s owner regarding her life, diet and routine to enable us to make this transitional period as stress-free as possible for Poppy.

oppy’s owner first contacted her local rehoming centre and said she needed to hand Poppy, a four year old Chihuahua cross, over to us as she had sadly recently been given a diagnosis that she had a terminal illness. She was advised to apply for a free Canine Care Card and nominate a Dog Guardian; someone she trusts to sign over the care of Poppy to Dogs Trust should she need it. She’d then be able to spend the most time possible with Poppy and feel reassured that she’d be given the best possible care at Dogs Trust when they could no longer be together.
