Roads Authority clarifies TR7/1 tender

In recent weeks, the Roads Authority (RA) Namibia has founditselfembroiledinaheatedcontroversysurrounding the bid qualification tender for the upgrading and expansionoftheKaribib/Usakosroad.

Criticism and concerns regarding the transparency and fairness of the pre-qualificationprocessthathavebeenechoingacrossNamibia,promptingtheChiefExecutiveOfficer(CEO)ofRA,ConradLutombitostep forwardandaddresstheissuehead-on.Inahighlyanticipatedpressconferenceheldlastweek,Lutombiaimedtobringmuch-neededclarityand alleviate the mounting outcry surrounding the rehabilitation of TR7/1, alsoknownastheKaribib/Usakosroad.

TheTR7/1Usakos/Karibibroad,formspartoftheTrans-KalahariHighway which is also known as the B2 Highway and has a national internationalimportanceasitlinkstothePortofWalvisBay Lutombisaidthe rehabilitation and upgrading of this road is a continuation of the construction of the two plus one from Okahandja/Karibib road which will continue up to Swakopmund to eventually connect the Dr Hifikepunye freeway which is between Swakopmund and Walvis Bay (road behind thedunes).

AccordingtoLutombi,thisprojectwillbefinancedthroughtheGerman financialcorporationwithNamibiaundertheNDP5supportprogram.In line with financial corporation a loan agreement was signed on 13 December 2022 between the KFW Development Bank, and the Namibian government represented by the Ministry of Finance. Liebenberg said in his judgment that Madisia andMulundu,beingadultsiblings,standjointly charged with murder, robbery with aggravatingcircumstancesanddefeatingorobstructing or attempting to defeat or obstruct the courseofjustice.Madisiainaddition,waschargedwithtwocountsoffraud.“Boththeaccused pleaded not guilty to the murder and robbery charges and tendered pleas of guilty on the chargeofdefeatingorobstructingthecourseof justice.Despitemakingsubstantiveadmissions in their respective plea explanations, the state did not accept the pleas and elected to lead evidence in proving the allegations set out in the charge. With regards to the fraud charges against accused, the state accepted her plea of guilty on the main charge of both counts, as tendered,”thejudgesaid.

JudgeLiebenbergfoundthatthereisareasonablepossibilitythatMadisia'sversionaboutthe events that resulted in the death of Wasserfall on10April2020couldbetrue,andthatMadisia wasnotliableforWasserfall'sdeath.“Thestate haslednoevidenceinprovingthemurderand robbery charges and based its case on conflicting statements made by the accused persons during the police investigation which was aimed as frustrating the police in their investigation of the disappearance of the deceased,” Judge Liebenberg explained. The judge stated inhisjudgementthatstatereliedentirelyonthe false statements by the accused when submittingthattheiractionsareindicativeoftheirunlawful killing of the deceased which may be inferred in circumstances where the cause of death is unknown. However, on their own admission, the judge convicted both on a charge of defeating the course of justice and Madisia alone on two counts of fraud. Madisia and MulunduwereontrialforthemurderandrobberyofWasserfall–aclosefriendofMadisia–in April 2020. Madisia reported Wasserfall missingandallegedlyalsotookpartinsomeof

thesearchesconductedtofindher Judge Liebenberg found that should Madisia's evidenceberejectedasfalse,thentheState'scase would be plunged into falsehood and noted that whileherevidencewasnottruthfulandreliablein all respects, it is the only version that is before Court.“Despiteshortcomingsintheevidenceof accusedone,herversionofeventsthatledtothe deathofthedeceasedstandsunrefuted,”Liebenbergstated.Thejudgesaid,“basedonalltheevidenceadduced,theversionofMadisiaastowhat led to the victim's death is reasonably possibly true and her actions are not found culpable.”As for the charge of robbery and its alternative of theft,thejudgesaidthereisnoevidencetheaccusedcommittedtheoffences.Thejudgeexplained that there is no clear evidence from which the Courtcouldjustifiablyinferthatthekillingofthe victimwasintentional.

The Wasserfall family and Walvis Bay community members have condemned the not-guilty verdict of Madisia and her brother and co-accused, Steven Mulundu. Some community members at the harbour town said that the not guilty judgementhascomeasashockedandtheyhave morequestionsthananswers.Theyarehopingthe familywillappealthejudgement.RaymondWasserfall,Shannon'suncle,saidthatthishascomeas a big blow for them. “The state has failed us beyondareasonabledoubt.Inthefirstplace,this case, since Shannon's disappearance, has been investigated, and we even went as far as seeing theInspectorGeneraltotalk,”theunclestated.

During the mitigation and aggravating proceedings on Wednesday, 17 May, Madisia's legal representative, Albert Titus, proposed a threeyear imprisonment term for the obstruction of justicecharge,alongwithoneyearforeachofthe two fraud charges whilst Mulundu's legal representative,Tanya Klaazen, put forth a suggestion for a three-year prison sentence, with one year suspended. Namibia Faces Persistent Food Price Spikes, Straining Disposable Incomes

Namibiaisgrapplingwithacontinuedsurgeinfoodprices,whichistakingatoll onthedisposableincomesofmany.Expertswarnthatthesituationisunlikelyto change soon, attributing the ongoing inflationary trend to various factors affectingthecountry'sfoodproductionandsupplychain.

Ruusa Nandago, an economist at FirstRand Namibia, has pointed out that the impact of loadsheddingonfoodproductionandsupply in neighbouring South Africa is expected to keepfoodinflationhighthisyear.Moreover, the weakening exchange rate adds to the problem,asitincreasesthecostofimporting food. Nandago also highlighted the heightened probability of the El Niño climate phenomenonoccurring,potentiallyleadingto erratic rainfall patterns that would reduce food supply and necessitate increased imports.Thelaggedeffectoflastyear'sshocks, such as rising input prices for fuel, fertilizer, andutilities,furtherexacerbatesthesituation, particularly impacting food prices. Namibia heavily relies on food imports from South Africa,whereelevatedpriceshavehadaspill overeffectonNamibianconsumers.Nandago emphasised, “the persistent surge in food prices is negatively affecting disposable incomes.”Withfoodaccountingfor16%ofthe inflation basket and 30% of total consumptionin2021,theincreaseinfoodpricesleaves individualswithlessmoneytospendonother essential needs. Unlike other consumption items that can be substituted, food remains a necessity that people cannot easily do without. Theo Klein, an economist at Simonis Storm,highlighted, “Namibia'svulnerability

Lutombiexplainedthatduetothecomplaisantandhightechnicalmergerof theworkRAcarriedoutpre-qualificationproceedingsinlinewithsection42 of the Public Procurement Act, 2015, Act No.15 of 2015 as amended, “furthermoreallinternationalbiddingwasusedinlinewithAnnexure2of thePublicProcurementRegulation,andaspertheprocurementrequirement ofKFW,sonowwhenyougooutintermsofourownPublicProcurement Act,becauseofthecomplicityoftheworkandintermsoftechnicalandalso the size of the work, you need to go out when you go out on open tenders internationally, means you have to advertise internationally not only restrictingitlocallywithinthecountry,andthatiswhatwedidandthatisalso incompliancewiththeprocurementrequirementofKFW.”

The invitation for the pre-qualification proceedings was done publicly throughthelocalprintmediafrom14to16September2022. Theinvitation wasopenforbothlocalandforeigncompaniestosubmittheirapplications for pre-qualification in line with the act criteria. There was also a pre-bid meeting held on 15 September 2022, with a deadline dated 24 November 2022at10:00.“Imustputemphasisherethatthedeadlinewassupposedto be earlier but was extended on request of the CIF,” Lutombi said, and stressed the importance of the project as it carries a thousand vehicles per day, “wewanttoconstructittothestandardthatitwillliveformanyyearsso wecannotcompromisethestandardorquality.”

After the deadline, RAreceived seventeen applications and the valuations forthepre-qualificationproceedingscommencedshortlyafterthedeadline. The valuations were done in accordance with the criteria outlined in the documents that were issued to the bidders and it was concluded on 16 December2022,“afterwecompletedthevaluations,wesendthevaluations to KFW for them to do the due diligence, and for then to give us a noobjectioninlinewiththeloanagreementaswellastheseparateagreement wesignedwiththem.Thevaluationforthepre-qualificationandasapproved by KFWthrough their no-objection concluded that seven of the seventeen applications met the said requirement for the pre-qualification and will be invited to submit their bids as per the provision of the Public Procurement Act. Bidders who did not meet the said criteria were allegedly given the opportunitythroughthesevendaystendingperiodtoraisetheirobjectionsin linewiththegroundfordisqualification.Thusfar,theRAhasnotreceived any objection on the outcome of the pre-qualification evaluation proceedings.Theconcernedapplicantshadtimeuntil Tuesdaythisweekto appeal to the review panel. Lutombi said it must be noted that the RA is committedtotheempowermentandparticipationoflocalcontractorsinall their road construction projects in line with Section 2 of the Procurement Act,“thereforeithasbeenagreedwithKFWtocreatefourseparatebillsfor works to be executed by local Namibian owned contractors and SME contractors. It is a project specification requirement that the seven prequalified bidders must submit their bids in partnership with four local biddersandImustemphasisehere,wearesayingnotajoint-in-partnership withthose.So,whoeverisawardedfinally,becauseaswearetalkinghere, we have not awarded that tender It could be that the people will go to the finalstage,butwemaynotevengetasuitableperson,sothetenderisnotyet awarded.Wearestillbusywiththeprocess.”

“Despiteglobaldownwardtrendsinfertilizer, oil, and commodity prices, these reductions havenottranslatedintolowerpricesinNamibiaduetotheweakrand.Furthermore,anticipatedfuelpricehikesandanexpectedincrease inelectricitypriceswilllikelycontributetothe ongoing inflationary pressures. The widespreaduseofdieselinkeysectorssuchasagriculture,manufacturing,tourism, and logistics addstothepriceburdensfacedbyconsumers,” Kleinsaid.

However, Klein notes that the tax relief measuresannouncedbyFinanceMinisterIipumbu Shiimiinthebudgetcouldprovidesomerelief to consumers. “.Starting from April 2024,

Themed “Forging alliances in the fight against transnational organisedcrimeintheSADCRegion”,thefirstSouthernAfrica DevelopmentCommunity(SADC)Multi-stakeholdersRegional Conference on Transnational Organi ed Crime concluded on s WednesdaythisweekinSwakopmund.

The objective of the three-day regional conference, which was from MondaytoWednesdaythisweek,wastoforgealliancesinthefightagainst transnational organised crimes During the closing ceremony on Wednesday, Lieutenant General Joseph Shikongo, the Southern Africa PoliceChiefsCorporationOrgani ation(SARPCCO)Chairpersonandthe s InspectorGeneraloftheNamibianPolicesaid,thisConferencehaslaidthe foundationofhowcrimessuchasfinancialcrimes,corruption,traffickingin illicit drugs, infrastructure crimes, trafficking in persons, smuggling of migrants, trafficking of illicit small arms and light weapons, as well as explosives, are negatively impacting the region. Shikongo said, “After having been briefed on the outcome of this Conference, I am gratified to note that indeed regional strategies and recommendations have been put forward, among others, enhancement of inter-agency cooperation at national and government levels, forging Private Public Partnerships in combating transnational organised crime and effective implementation of regional and international strategic instruments to combat transnational organised crime which are aimed at strengthening our efforts in the fight against Transnational Organised Crime.” According to Shikongo, the recommendations made during the conference will be submitted to his fellowSADCChiefsofPoliceduringtheSARPCCOAGM,scheduledfor June 2023, in Swakopmund as well as to the SADC Heads of AntiCorruptionCommissions/Departments,HeadsofImmigrationandMining sectorfortheirconsiderationandadoption.

Shikongo urged delegates of the conference to continue with the spirit of collaborationandworkingtogether,“becauseourfightisagainstacommon enemy,beingthetransnationalorganisedcrimesyndicates.Asaregion,we cannotaffordtocontinueplayingsecondtocriminalsyndicates;hence,our collective goal is to decimate these criminal enterprises and syndicates perpetuating illicit activities in Southern Africa.” While addressing the delegates, Shikongo called on all delegates to strengthen the high level of cooperation exhibited, throughout the multi-stakeholder conference while at the same time enhancing information sharing and undertaking joint operations. “Let us not forget that we are operating in a modern terrain where criminal syndicates just like law enforcement agencies, are equally exploiting and harnessing contemporary tools including artificial intelligencetobroadentheirillicitactivities.”

Shikongo concluded, “what this means is that, as the police, immigration, anti-corruption, mining and other law enforcement agencies including private sector stakeholders, we need to strengthen prevention strategies, capacity building, use of the cutting-edge technologies, so that we effectivelycombattransnationalorganizedcrimeinourregion.”
