Land ownership and electrification for the residents of DRC

The Mayor of Swakopmund, Dina Namubes announced in a council meetingheldonTuesdaythisweek,the long-anticipated handover of land ownershipintheDemocraticResettlement Community (DRC) will take placeon16April.

Fishing Employees face unemployment

Emlpoyees at Etosha Fishing are facing unemployment as the company plans to shut down operations after facing a moratoriumonpilchardfisheriessince2018.

EtoshaFishing'sManagingDirector, VolkerPaulsmeierconfirmedthe company'splanstolayoffsomeoftheiremployees.

Paulsmeier said the company has given notice to the Labour Commissioner on 31st March 2023 of its intention to terminate contractsduetooperationalrequirementsasisrequiredbytheLabour Act(Act11of2007).

The presedent of the National Service and Allied Workers Union (NASAWU,)PaulusHangoexpresseddeepconcernovertheproposed intentiontoterminatecontracts.

Hangodescribedtheterminationofemploymentcontractsasanattack onthelivelihoodofhundredsofworkersandtheirfamilies. Hewarnedthattheterminationofemploymentcontractscouldhavea devastatingimpactonthewiderlocalcommunityandthecountryasa whole.

Hangoproposedthattheministryoffisheriesconsiderallocatingsome horsemackerelfromthegovernmentobjectivequotatoEtoshaFishing HesaidthattheUnionwillcallameetingwiththefisheriesandfinance ministriestoworkoutasolutiontoavertjoblosses.

The Mineworkers Union of Namibia (MUN) expressed its dissatisfactionandunequivocaldiscontentwiththewaythe managementofRössingUraniumMine,underownershipof ChinaNationalUraniumCorporationLtd(CNUC)ishandlingtheissueoftheLifeofMineExtensiononTuesdaythis week.

After CNUC's acquisition of a majority shareholding in 2019 from Rio Tinto.TheLifeofminewasduetoendin2026.TheCNUCthenapplied fortheLifeofMineextension,whichextensionwouldseethelifeofmine extending to 2036. In a statement, the Erongo Regional Coordinator of MUN,GeorgeAmpweyasaid,“itwashoweverwithshockandutterdismaythattheBranchExecutiveCommitteeoftheMineworkersUnionof Namibiacametoknowoftheplansbymanagementtoretrenchapproximately400workersunderthedisguiseoftheintroductionofthevoluntaryseparationprocesstoallemployeeswhichwasannouncedatquarterlyEmployees'ManagingDirector'sbriefingsessiononthe23February 2023.”

Ampweya mentioned this would mean, if by 2026 management has not attracted sufficient employees who elect to accept the Voluntary Separation Packages, Rössing would then initiate the forced retrenchment process that would ultimately see the envisaged 400 employees directly losing their employment.

Ampweya said, “the Trade Union (MUN) rejects this draconian approach by Rössing of which the majority shareholders is Chinese (CNUC) The mandate of Rössing Management is hellbound on promoting precarious work and employing draconian tactics aimed at ultimately exploiting Namibianworkers.”

Thestatementalsoreads:“TheMineWorkers' Union being the sole bargaining agent at Rössing Uranium Mine demands for the immediate cessation of the illegal process of soliciting selected employees to accept the voluntary separation packages without the Union's involvement The Union further demands that the Retrenchment agreement takes precedence and that such provisions be unconditionally adhered to We further demand an audience with the Chinese senior management of CNUC with the view of ascertaining that if indeed Rössing intends to initiate retrenchments it should do so in line with set procedures as outlined in the Labour Act and all existing relevant collective agreementsinplace.”

Responding to MUN's statement, Rössing Uranium's Managing Director Johan Coetzee said Rössing Uranium views any unfounded and unverified allegations against the companyinaveryseriouslight.

Coetzee further said, “following the recent announcement of Rössing Uranium's Life of Mine Extension from 2026 to 2036 as approved by the Board of Directors on 22 February 2023, the company embarked on an extensivestakeholderengagementprogramme which included meetings held with the Ministry of Mines and Energy, Ministry of Labor, NaCC, MUN national leadership, MediaaswellasRössingemployeesincluding the MUN BEC Rössing Branch. During these sessions, the company allegedly maintained and has guaranteed job security for their employees until December 2026 and no retrenchments are envisaged within the next threeyears.

Coetzeesaid,“wetakenoteofclause4.2Cand clause5.3,andrespectivelydisagreethatthese clauses obligate the Company to negotiate on the Voluntary Separation Process (VSP)

currently taking place. The reasons being: that therearecurrentlynoconcernsofjoblosses,nor any interest and aspirations of employees that have been negatively affected. We further reiteratethatavoluntaryseparationprocessisnot the same as a dismissal or retrenchment. However,avoluntaryseparationprocessiswhere anemployeehastherighttoenquireonhisorher package,iftheemployeetakesupthepackage,it isavoluntarydecisiontomutuallyseparatefrom the Company for whatever reason, such as i.e., newemploymentopportunities,earlyretirement, butNOTduetoretrenchmentorredundancy.”

According to Coetzee, although the package is the same or similar to what was used for calculating previous retrenchment packages, it does not mean that the employee has been retrenched in terms of section 34 of the Labour Act2007.Thecompanycanatitsowndiscretion determine the voluntary separation package on offer and in this case, the Rössing Board approvedasimilarpackage,whichtheybelieveis fair and above market trends in the industry

According to Coetzee, dismissals in terms of Section 34 are concluded by a letter from the employer giving the employees and Ministry of Labour notice of termination of employment. In thiscase,theCompanyhasnotissuedanyletterto thateffectandhasthereforenotactivatedsection 34.Aspersection34,theemployerisrequiredto give notice at least 4 weeks in advance before intended dismissals. Filing a notice now is prematureandnotrequiredorobligatedatall,as no retrenchment process is being considered at thisstage.Anysuchnoticewillbeconsideredin thelastquarterof2026.

The Company maintains that compulsory retrenchmentsisonlyenvisagedin2027,andthe company, together with the Union, will engage and comply with section 34 of the Labour Act (2007)ascommunicatedtobothMUNandBEC. Adequateopportunitywillbeprovidedforduring 2026 when compulsory retrenchment is inevitable, and section 34 will have to be compliedwith.TheCompanywillremaininfull compliancewiththeLabourAct.

Coetzee said, since opening of the Voluntary Separation process started on 01 March many Rössing employees have applied and have been approvedforvoluntaryseparation.

“Rössing Uranium employees are not being retrenched; however, the recommended LoME operatingmodelwillhaveanimpactonsomeof therolesafter2027.LoMEdoesnotguaranteethe continuation of all current jobs beyond 2026, as the operating model and workforce structure required for LoME is different. The contractor miningsolutionforLoMEisregardedasthemost appropriatebased on the most resilientfinancial option and is the only non-value destructive option,” saidCoetzee.

Shiwana Ndeunyema who serves as a nonExecutive Director on the MeatCo board stated, “the opening of thisretailoutletispartof a forward intervention strategy by the corporation to not only procure, process and sell cattleintheformofraw material. But also, to setup retail outlets such as this as part of a socioeconomic agenda to create jobs and facilitate value addition.”

Also revealing that the products which will be sold at this particular outletwillbecattleprocured from the northern communal areas, thus creating an additional opportunity for the

normal northern communal farmers to participate in the local market.

The Namib times asked Marketing Manager, Martina Kröller why this location to which she replied, “even though this part of Kuisebmondisnotaspopular we are sure that we can cater for this community by bringing our affordable products to them.”

Daures Constituency communities up in arms

HundredsofresidentsofUisandDauresConstituencycommunities, farmers, and small miners are up in arms with illegalminingactivitiesinandaroundtheErongoregion.

The residents claim some of the mining companies only have licences for semi-precious stones yet are mining rare earth metals such as lithium with others, claiming that they are conducting mining operations without environmental clearance certificates (ECCs) or blasting tickets, posing a risk andsafetyissuetoboth residents and the environment.

The community demanded that a proper investigation be conducted, and the activities be stopped until issuesaroundthemines areclearedup.

They also claimed that it is difficult for locals to obtain mining rights andseniorjobpositions at mines, while some mines do not rehabilitate the environment after exploration when they do not recover resources.

The residents stressed how Chinese-owned miningcompaniesmistreat locals despite the millionsofdollarsthey are collecting in revenue.Itisestimatedthat there are about 2000 small-scale miners in the Erongo Region

The group petitioned the Ministry of Mines and Energy, and the Tsiseb conservancy, among others, to stop the mining with immediate effect. The company has been accused of not following the proper channels and procedures and contravening the Environmental Management Act 7 of 2007. The company allegedly did notconductanenvironmental impact assessment (EIA) and has ignored the community's needs for investmentsininfrastructure, sponsorshipsanddonations to farmers and smallminers,bursaries to local best-performing science students,

and shares to the conservancy for environmental destruction and negative effectscausedbymining.

In a recent heated townhall meeting, residents demanded answers from Minister of Mines and Energy Tom Alweendo, who visited the Daures constituency to discuss issuesraisedaboutillegal mining activities Uis community activist Jimmy Areseb at the community meeting with the Minister of Mines and Environment, Tom Alweendo stated that a Chinese mining company,Xingfeng,onlyhas a pending exclusive exploration licence (EPL) application for claim 8843,whichisintheUis area, as well as an active mining licence on EPL 243 and a pending renewal EPL for 7228 in the Okombahe/ Omaruru area.

He said the company wrotealettertotheTraditional Authority to be granted consent on EPL 8397, which belongs to Orange River Investment. Orange River Investment also has a pending ECC application.

Areseb added that OrangeRiverInvestment was granted consent on two mining claims (70515 and 70516), whichheassertedbelong to Townland Investment, but are in EPL 7248 that belong to Mount Brandberg Mining. Long Fire Investment has 10 mining claims for semi-precious stones. “In addition, EPL 8397 that belongs to Orange River exploration and mining hasapendingECC,while theEPLinwhichthese10 claimsoverlapbelongsto HopsonLithiumMining. The latter is also still in the application process and does not have any mining plan and blasting tickets. Yet, “the company goes along with its operations as if everything is normal,” Areseb stated.

Therefore, these irregularitiesneedtobeinvestigated to prove these operations are legal and argued that some mines arenotonlyillegalbutare

alsonotassistinglocalsto benefit from the natural resources mined there.

The minister of mines and energy said after the discussions that the concernsofUisresidentsare genuine, and that the ministry will launch an investigation into the allegationsmade.Healso usedtheplatformtowarn Namibians to guard against selling their mining claims without doing due diligence but to use themtogeneratemoney

Alweendo added the ministry will start to strengthen community engagement consultationsbeforeexploration licenses are granted to prospective individuals or companies. He also requested to see documents such as export permits, including the quantityofmineralstobe exported, as well as consent from conservancy and traditional authorities.

Alweendo said, “we are heretogetabetterunderstandingoftheproblem.I believe that we can only resolve it if we fully understandtheissuesand will not protect anyone who is not following the law.” The minister said, “if there is proof of any illegal activity and the finding states so, we will takethenecessarysteps.”

He agreed that mining companies,justlikecompanies in other sectors of the economy, must be goodcorporatecitizens.

Alweendo noted, “this means companies must immerse themselves in thecommunitiestheyare operating in, paying particular emphasis on principles related to the environment,societyand governance This can only happen when companies have effective communication strategies how to engage communities." He emphasised that the law prescribes that minerals licence holders must engage and obtain permissionfromthelandowners beforeanyprospectingor mining activities take place. Noble and Azhar's lawyer Sisa Namandje said in their application that there werediscrepanciesinthetestimoniesofpolice chief inspector Charles Goagoseb during the bailhearingandmaintrial.Namandjesaidvast discrepancies in the two versions are material andcouldhaveanimpactontheappealhearing. He said the High Court weighed up all the evidence for and against theirs and came to a just conclusion in its finding that Noble and Azhar used closed corporations as a front for their illegal activities, Therefore, they are responsibleforimportingthelargestamountof cocaineinthehistoryofNamibia.

ROSSMUND PAYS TRIBUTE TO A LEGEND

The Rossmund Golf Club was full of fun and excitement on Saturday 1April - as 80 golfers turned out to honor a legend, the 96-year-old youngster,GrahamLouw.

With the opening of the Rossing Golf Course in 1979, Graham Louw the mayor of Swakopmund atthetimedrovethefirstballupthefairway GrahamLouwhadnotplayedgolfbeforesoprior totheofficialdayhewouldpracticeonthebeach infrontofhishouse.Onthedayoftheopeninga large crowd of golfers dignitaries and special guestsgatheredaroundthe1 tee.Louwdrovethe st ball onto the fairway to a warm and generous applausefromallpresent.

Isuspectitwasatthispointintimethatthe“Golf bug”bithimbecauseafterthatdayhewouldbeat thegolfcourseeverySaturdaytoplaygolf,ahabit hestilldoesevennowattheageof96.

In1991/92GrahammadeadealwithRossingand took ownership of the Golf Course. He then set about with partners to develop a residential area around the fairways. Today there is a village all around the course where there once was only desert.Ittrulyisanoasisnow

Graham Louw did not only expand on the golf coursehealsoservedtheSwakopmundtownasa councillor for 22 years. His dedication to the golfing community and Swakopmund is remarkable.

Weareallproudtohavehimasamemberofour Club;hewasjoinedonSaturdaybyhisfamilyand manyoldhandsforthecelebration.

Thedaykickedoffinbeautifulweather–shotgun startwastheorderofthedayasthegolfersspread themselvesaroundthecourse.Needlesstosaythe clubhouse was a buzz in the afternoon as all the golfers returned tired and thirsty for a bit of camaraderie.

OurOverallWinnerandChampionsoftheday winning a count out on 46pts were Michael Ludeke/Fritz Coetzee jnr – the first recipients of the new Graham Louw Invitational Golf Day floatingtrophysponsoredbyTheProShop(Marco Swarts and his team); 2 Place went to Warren nd: Theron & Thomas Shitaleni 46 points; 3 Place: rd StevenJohns/DouwvanWyk45points.
