Three Questions to Ponder this Month

September is Realtor® Safety Month. In the frenetic pace of the real estate market over the past 24 months, you may have changed the way you are doing business and have not had the need for certain policies and procedures. However, now that the market seems to slow up a bit and getting back to a new normal, please do a self-check to make sure you are still following recommended safety protocols. Realtors® face job-related risks every day. Being aware of potential dangers and taking precautions will help you avoid risky situations. To accomplish this goal together with you, we must improve the safety culture in the industry by raising awareness, following safety protocols, and encouraging all Realtors® to stay vigilant on the job. If you need a refresher, please visit the NAR Safety Tips though their Realtor® Safety Program for a quick review of things to consider and plan for. The dog days of summer have definitely been upon us. Whether to escape the heat or the heat is just causing us all to be crazy, some of us are known to celebrate Christmas in July. We put on sweaters, turn the AC down to 60 degrees, and drink our favorite beverage. Or now that I think of it, it might just be an excuse to have a party. We Realtors® do love our parties, don’t we? Whether you had a Christmas in July party or not this year, I’m asking you today to consider celebrating New Year’s in September. What do I mean by that? The most common thing to do when celebrating New Year’s is to make a New Year’s Resolution. I’m asking you to consider today, what is your resolution for 2023 to get more involved at your Realtor® Association?

The list of RASM committees is on page 30. Please resolve to give back to your profession and increase your business by applying to serve on one or more RASM committees and get involved! Do you like learning? Apply for the Professional Development Committee. Do you like working with charities? Apply for Community Outreach. Do you want to get involved in the political process? Julianna Burns is a Realtor® with Berkshire Hathaway HomeServices and a Sarasota native. She first developed her passion for the real estate industry by working alongside her father, an engineer, who purchased and reconstructed homes throughout Florida. Becoming a Realtor® was the next logical step for Julianna and it has allowed her to work in an industry where she feels responsible for her own destiny and success. Entrepreneur of the Year, awarded by the Women’s Council of Realtors® Sarasota. She has earned the C2EX designation, NAR’s Green Designation, and she is a Pricing Strategy Advisor. Julianna has also served on several RASM committees including, Professional Development, and YPN, and also serves as a RASM Ambassador. In addition, she is the 2022 Women’s Council of Realtors® Sarasota President and was elected the President-Elect for both 2020 and 2021. Julianna recently went to Colombia for the International Real Estate Trade Mission on behalf of the RASM GBC and NAR. In addition, she has pledged to become a RPAC Major Investor this year. She also looks forward to becoming more involved at RASM, with hopes to become a future member of the Board of Directors.Juliannais a 2021 graduate of the RASM Leadership Academy. She was one of only eight graduates that planned and executed the first successful fundraiser for the RASM REALTORS® Charitable Foundation. The group raised over $50,000 with a net of over $30,000 by using their individual strengths and working as a team.

Julianna also serves on the Mote Marine Laboratory & Aquarium’s SEA President’s Advisory Council, and she is the Chair of the Mote Marine Lab Philanthropy Committee. She has played a big part in increasing awareness for several other non-profits, volunteer groups, and charitable organizations to give back to her local community. In her free time, Julianna loves boating the famous emerald and turquoise water alongside Sarasota’s white sand beaches and traveling. Her future goals involve the desire to build a strong renovation team and dive back into home remodels for resale or rental income. This would allow her to use her past experiences while also taking advantage of her creative and artistic side.

Over the last five years with YPN, Nathan has helped plan, organize, and participate in the raising of funds for various local charities. Outside of his work with the YPN, Nathan has supported Big Brother, Big Sister, Everyday Blessings Springboard, and the Salvation Army.

Nathan’s future goals include the desire to be a leader in both the local and real estate community. By volunteering with various charities, he hopes to make an impact. “Something I’m proud of professionally is pivoting my business when COVID hit,” said Leicht. “When my business stalled, I started to do video and created a YouTube channel. At that time, I literally knew nothing about drones, shutter speed, cameras, or editing. I didn’t have a team of agents, assistants, or even a video editor for that matter. Nonetheless, I put my extra time into learning and surrounding myself with people that were better than me. In time, video became an avenue for me to increase my business and became something that I learned I’m creatively passionate about. Today, this is one my favorite parts of my career!”

“I grew up around real estate,” said Leicht. “My parents have been successful agents in Sarasota since I was a kid. But I never really considered it to be a career for myself. However, after graduating from UCF in 2013, I was working in a sales position that I knew I didn’t see myself doing forever. At that time, my mom encouraged me to make the move back to Sarasota and jump into real estate. My parents have always been great at guiding me in my talents, so I trusted their input on this one. I’m so thankful for their mentorship and encouragement in my real estate journey. Fast forward 7 years, and I couldn’t imagine myself doing anything else.”

Joey Hutchinson is a Realtor® with Duncan Real Estate, Inc, a boutique agency located in Anna Maria, Florida. Before joining Duncan Real Estate, Joey played D1 soccer at the University of South Carolina where he earned a B.A. in economics with a concentration in marketing. After graduation, Joey spent a year in Los Angeles working as an account manager for Optimist, a Los Angeles based marketing firm that had clients such as Google and Nike. He also worked for Duncan Real Estate, Inc. as the operations manager for the vacation rental department which manages approximately 100 homes and condos on Anna Maria, prior to finding his passion as a Realtor®. As an Anna Maria Island native, Joey is the area expert and easily connects with his clients.

Joey’s primary advice for other young agents is to always be genuine in everything that you do. “I never once tried to be someone I’m not or tried to push a sale just for the commission,” said Hutchinson. “I have gained a lot of trust from my clients, and I have many repeat clients because of just being genuine. It’s such a rewarding feeling when one of my clients either chooses to use me again or refers me to a friend or family member.”

“I know my product very well,” said Hutchinson. “I grew up on this island (Anna Maria) and know it intimately. I worked on the vacation rental side prior to transitioning to sales so when a client is interested in a property that they plan to rent as a vacation rental, I can speak accurately and give them insights on what to expect. People choose to work with me because there is no hesitation when it comes to questions about this island. Anna Maria is made up of three cities each with a distinct set of rules and regulations in regard to vacation rental zoning and building codes, so a Realtor® that is engrained in the community is essential. Nikki has been active in the YPN for several years and chaired the Venice YPN in the past. Since growing her own team, she has taken an active role in masterminding and mentoring other agents, not only in the local market, but nationally as well through Keller Williams and Tom Ferry. She is also the creator of “#LadyBoss Happy Hours,” which brings local likeminded businesswomen together to not only network but lift up and inspire each other. She is also active in her oldest daughter’s volleyball club. Every quarter, Nikki designates to a local charity that she along with her staff and agents, give back to by providing their time to service projects such as cleaning, building, painting, or whatever the specific need might be. The office most recently donated to Farmhouse Animal & Nature Sanctuary, a 501(c)(3) support center for domestic and farm animals located in Myakka City.

Nikki is the recipient of several impressive awards including the Top Team 2015-2020, Second Team in Volume & Units award in 2021, the President’s Circle award, Real Trends “Top Thousand,” and Real Trends “America’s Best.”

Nikki’s advice to other young agents is to work hard in every situation.

“I have always loved homes, the design process, and architecture,” said Weiss. “My parents were always remodeling, investing, and building. It didn’t just stop there though, I found I could also grow and use my leadership passion in this industry as well which has been one of the greatest blessings.”

“Put the work in, it won’t be handed to you,” said Wiess, “and even when you have that success, stay humble, give back by mentoring to others, and never stop growing as a person! I’m not afraid to fail and learn from it,” said Wiess.

Realtor® B explained, however, that Seller A’s description, which he had accepted, had resulted in misrepresentation to the buyer. “But it’s a small point,” said Seller A. “He’ll probably use rugs too, so it really doesn’t make any difference.” After further pressure from Realtor® B for some kind of adjustment for Buyer C, Seller A concluded, “It was an honest mistake. It’s not important. I’m not going to do anything about it. If Buyer C thinks this is a serious matter, let him sue me.”

Realtor® B explained Seller A’s attitude to Buyer C, saying that he regretted it very much, but under the circumstances could do nothing more about it. It was at this point that Buyer C filed a complaint with Realtor® B’s Board. At the hearing before a Hearing Panel of the Professional Standards Committee of Realtor® B’s Board, during which all of these facts were brought out, the panel found that Realtor® B had acted in good faith in accepting Seller A’s description of the property. While Article 2 prohibits concealment of pertinent facts, exaggeration, and misrepresentation, Realtor® B had faithfully represented to Buyer C information given to him by Seller A. There were no obvious reasons to suspect that hardwood floors were not present throughout as Seller A had advised. On the day that Buyer C moved in, seeing the house for the first time in its unfurnished condition, he quickly observed that hardwood flooring existed only on the outer rim of the floor in each room that had been visible beyond the edges of rugs when he inspected the house, and that the areas that had been previously covered by rugs in each room were of subflooring material. He complained that Realtor® B, the listing broker, had misrepresented the house in his advertisements and in the description included in his listing form which had specified “hardwood floors throughout.”

Seller A came to Realtor® B’s office explaining that his company was transferring him to another city and he wished to sell his home. In executing the listing contract, Seller A specified that the house had hardwood floors throughout and that the selling price would include the shutters and draperies that had been custom made for the house. Seller A said that he would like to continue to occupy the house for 90 days while his wife looked for another home at his new location, and agreed that Realtor® B could show the house during this time without making a special appointment for each visit. Accordingly, Realtor® B advertised the house, showed it to a number of prospective buyers, and obtained a purchase contract from Buyer C. Settlement was completed and at the expiration of the 90-day period from the date of listing, Seller A moved out and Buyer C moved in.

PROFESSIONAL STANDARDS

Buyer C complained to Realtor® B, who immediately contacted Seller A. Realtor® B pointed out that the house had been fully furnished when it was listed and Seller A had said that the house had hardwood floors throughout. Seller A acknowledged that he had so described the floors, but said the error was inadvertent since he had lived in the house for ten years since it had been custom built for him. He explained that in discussing the plans and specifications with the contractor who had built the house, the contractor had pointed out various methods of reducing construction costs, including limiting the use of hardwood flooring to the outer rim of each room’s floor. Since Seller A had planned to use rugs in each room, he had agreed, and after ten years of living in the house with the subflooring covered by rugs, he had “simply forgotten about it.”

Documentation is critical in the event of any dispute (i.e., ethics). Having proof every offer was presented, or the seller waived receipt of the offer is key. Mr. Villazon recommends you send an email with a receipt from the seller for each offer presented/ waived or have the seller mark any unacceptable offer “rejected,” including the date that it was rejected. Yes, labor intensive in a multi-offer environment, but it is the agent’s responsibility to prove all were submitted and received by the seller. Another option to consider is to create an Excel sheet and email it to the seller, demonstrating all offers were submitted or waived at the seller’s directive.

Last month, Congress passed the Inflation Reduction Act on party lines. Throughout the negotiations, a handful of tax increases affecting the real estate industry were considered. Although, in its final form, NAR, working with our Pro-Realtor® members of Congress, was able to eliminate nearly all but one of those taxes. The one provision pertaining to our industry was the tax treatment of carried interests; this is a tool often used by partnerships in real estate, VC Firms, and private equity. NAR, in conjunction with other real estate coalition groups, lobbied Senators advocating the carried interest provision be eliminated from the bill. Fortunately, a Pro-Realtor® Senator offered a successful amendment to delete the provisions and replace it with a loss-limit tax offset that would only pertain to a handful of real estate entrepreneurs. Taking into account, all the proposals we’ve seen over the last few years which would increase real estate taxes, the final version of this bill is an excellent outcome for our industry. As always, the final bill could have made more of a positive impact on real estate, but ultimately, the Realtor®-world dodged some very expensive bullets when all was said and done.

According to data from Florida REALTORS® and compiled by the REALTOR® Association of Sarasota and Manatee (RASM), closed sales have once again decreased overall, while the month supply of inventory increases, along with the median time to contract. Another month of record-high prices coupled with the rising mortgage rates point to the increase in inventory this month, with active listings increasing by more than 100 percent from last year.

Closed Sales Decrease in Sarasota and Manatee as Inventory Continues to Grow

The median price of condos in Manatee County was $354,500, which is a 41.8 percent increase from last year.

The median time it took for properties to go under contract is at 9 days in Manatee County, a 50 percent increase year-over-year. In Sarasota County, the median time to contract is at 10 days, a 66.7 percent increase for condos and a 100 percent increase for single-family homes.New listings, or the number of properties added to the market last month, increased year-over-year in the North Port-Sarasota-Bradenton MSA by 23.2 percent for single-family homes and by 12.3 percent for condos. Compared to June of 2022, new listings decreased by 4.8 percent for the combined numbers in both counties and both markets.

Realtors® participated in 1,738 sales across the twocounty region in July, a 22.8 percent decrease from the same month last year. In Manatee County, single-family sales decreased from last year by 22.2 percent to 567 sales, while condo sales decreased by 20.9 percent to 204 closed sales. In Sarasota County, single-family sales decreased by 23.1 percent to 678 sales, and condo sales are down by 24.5 percent to 289 sales.

At the end of July, there were 4,315 active listings combined in the two counties for both markets, which is a 143.7 percent increase last year. There were 761 more active listings reported at the end of July when compared to the previous month, indicating a monthover-month increase of 21.4 percent.

“With higher interest rates and inflation impacting our market, the number of sales continues to decrease and the number of properties actively on the market continues to increase,” said 2022 RASM President Tony Veldkamp. “While our active inventory of single-family homes has finally reached a two-month supply in both counties, we deem a healthy balanced market as a sixmonthThesupply.”median sales price in the two-county area continues to increase, with Sarasota County seeing record-high prices. In Sarasota County, the median price for single-family homes increased by 31.3 percent year-over-year to the highest recorded price of $525,000, while condo prices increased by 24.1 percent to $390,990. In Manatee County, single-family home prices increased year-over-year by 21.2 percent to $521,000.

In the single-family home market, Manatee County inventory is at a 2.5-month supply, which is a 212.5 percent increase from the same month last year, while Sarasota increased by 150 percent to a 2-month supply. The months’ supply for condos increased by 200 percent in Manatee County to a 1.8-month supply and increased by 166.7 percent in Sarasota County to a 1.6-month supply.

Like many charitable giving organizations, COVID has impacted their reach. Donors of Distinction used to be known as Designing Daughters, but when quarantine occurred, all events were cancelled, and the organization was without funding. Due to various tax concerns and the desire to never give up despite the pandemic, the group rebranded as the 501(c)(3), Donors of Distinction. With the name change also came a change in membership. Designing Daughters was a solely female-based membership, whereas now the organization is open to both male and female members.

Donors of Distinction’s members are well connected in the community, and they are very successful in forming strategic alliances. But every charitable organization relies on help from the community. Donations such as social media shares, radio advertising, and magazine ads, help to spread the word on the impact the organization has on the community, growing membership, and spreading the word on upcoming events.

“Sharing our mission with the community is very important to us,” said Poole. “But what remains more important than growing our brand is making sure that all the money we raise goes into the hands of local charities. We count on advertising donations to help make that happen.”

RASM “Humanitarian of the Quarter” recipient for the Third Quarter of 2022. Vannesa is a Florida native who has always been passionate about giving back to her community and providing aide to the less fortunate. This passion is what lead her to join Catalist Realty as the brokerage has a philanthropic business model. Realtors® donate 15% of their commission back to the buyer and seller’s charitable organization of their choice on every transaction.

“There are so many worthy charitable organizations in Sarasota and Manatee County,” said Poole. “For many of our transplant buyers, this is a great opportunity to connect them to the community, and possibly spark future commitments to the charities that can only thrive with volunteer support. It makes their buying and selling experience that much more meaningful for them as well, knowing that they directly made a difference in the lives of others.”

Donors of Distinction is hosting their 3rd Annual Golf Outing on Monday, September 19, at the Laurel Oak Golf and Country Club. The event costs $200 per person, and includes contest opportunities for first and last place, longest drive, closets to the pin, and more. Guests will enjoy an awards program with banquet and cash bar.

“We have been very blessed coming out of an essential hiatus due to COVID,” said Poole. “We are rebranded now and gaining our momentum back. And with more opportunities for membership, comes more opportunities to reach our goals. At our last Grant Ceremony, we were able to raise $90,000 and give that money to 23 nonprofits in the Sarasota and Manatee area.”

In addition to her busy career as a Realtor®, Vannesa Poole is a member of the RASM Community Outreach Committee. She is also a proud member of Donors of Distinction (formally known as Designing Daughters) for over 5 years and is also on the charity’s board of directors. Founded by Shelley Lister, the mission of Donors of Distinction is to enhance the community by granting donations raised through philanthropic endeavors back to local nonprofit organizations. Donors of Distinction members are a volunteer group of diverse individuals from all walks of life who work throughout the year to raise money to be gifted to deserving local nonprofits. Their goal this season is to raise over $100 thousand dollars through their events, giving 100% of all monies raised back to local nonprofits. The organization plans three to five major events each year, completely sponsored by donations from area restaurants, local businesses, and proceeds raised.

As a YPN member, I had the pleasure of serving on the REALTORS® to Watch committee this year. The committee is comprised of several members of the YPN. We met together to carefully review all of the applications. We evaluated applicants as a whole. Some of the criteria we looked at were: leadership, community involvement, the volume of real estate transactions, how long has that Realtor® has been in business, future goals and plans, and other personal experiences. It was incredible to see how many wonderful, driven Realtors® our community in Sarasota and Manatee has to offer. I have been in the Sarasota-Manatee real estate industry for almost five years and was thrilled to be introduced to some new Realtors® through this program.
