Exciting 4th Quarter Ahead By: David Clapp, RASM President
A
s you read this, we will be in the final quarter of 2020, with most people ready for this year of COVID-19 to be over! It has been a challenging year in many ways for most people. We have not been able to do so many of the things that we are used to doing. Our world has been changed for sure. We anxiously await 2021 where we look forward to a vaccine to help deal with COVID-19, the end of this election cycle, the hopeful settling down of much of the social unrest, and the return to some semblance of normalcy. But what will the new norm be? While none of us can predict what the future will hold, we can do our best to make sure that we are doing everything in our power to be the best that we can be. To keep a great attitude, and to look for opportunities to help those around us, because That’s Who We R. I am excited to share with you some of what we have been working on at the Association level. While we have been holding most of our meetings virtually, we did successfully hold several GRI classes in person. We continue to evaluate how and when we can do ongoing live, in-person training in a responsible way. At the September Annual meeting, we signed a Memorandum Of Understanding with The Bahamas to build a cooperative effort between the two organizations, which will encourage the exchange of real estate business between us. We are working diligently on bringing to you an incredible Virtual Conference called Soar, which will be held on November 5, 2020. We will have 4 Educational Learning Tracks running simultaneously, offering a total of 16 sessions throughout the day. As you will only be able to participate in 4 sessions during the day, all sessions will be recorded to enable you to watch those you missed at a later time. There will be a Legal Track, Technology Track, Global/Property Management/ Market Track, and a General/Sales Track. This incredible learning opportunity will be brought to you FREE, but you do need to register! I am happy to say that we are making great progress on our new North Office location. We closed on a new property on Manatee Ave. earlier in the year. We have been working with an Architect and builder to create a first-class renovated facility that will be completed in 2021. Please see page 24 to check out some renderings and learn more about the project. Another exciting project is the “Time To Sell” consumer marketing campaign. We created this because of the low listing inventory we have been experiencing. We wanted to create a message that would move consumers to list with a RASM Realtor® who can provide a safe selling experience in a COVID-19 marketplace. Additionally, we have entered into a relationship that will provide our members an International MLS, iMLS. The iMLS provides International exposure of our members’ listings to an International audience, plus allows our members to create a profile that can be viewed by international consumers. Let’s continue to stay strong and finish strong in 2020, because Together We Win! •

Time at Which Modification to Offer of Compensation is Communicated is a Determining Factor By: National Association of REALTORS® Interpretations of the Code of Ethics Case #3-7 ((Revised Case #22-7 May, 1988. R
ealtor® A listed Seller X’s home and entered the listing into the MLS. The relevant MLS data field indicated the compensation Realtor® A was offering to the other Participants if they were successful in finding a buyer for Seller X’s home. During the next few weeks, Realtor® A authorized several Participants of the MLS, including Realtor® C, to show Seller X’s home to potential buyers. Although several showings were made, no offers to purchase were forthcoming. Realtor® A and Seller X, in discussing possible means of making the property more salable, agreed to reduce the listed price. Realtor® A also agreed to lower his commission. Realtor® A changed his compensation offer in the field in the MLS and then called the MLS Participants who had shown Seller X’s property to advise them that he was modifying his offer of compensation to cooperating brokers. Upon receiving the call, Realtor® C responded that he was working with Prospect Z who appeared to be very interested in purchasing the property and who would probably make an offer to purchase in the next day or two. Realtor® C indicated that he would expect to receive the compensation that had been published originally in the MLS and not the reduced amount now being offered to him, since he had already shown the property to Prospect Z and expected an offer to purchase would be made shortly. Realtor® A responded that since Prospect Z had not
signed an offer to purchase and no offer had been submitted the modified offer of compensation would be applicable. The following day, Realtor® C wrote an offer to purchase for Prospect Z. The offer was submitted to the Seller by Realtor® A and was accepted. At the closing, Realtor® A gave Realtor® C a check for services in an amount reflecting the modified offer communicated to Realtor® C by phone. Realtor® C refused to accept the check indicating that he felt Realtor® A’s actions were in violation of the Code of Ethics. Realtor® C filed a complaint with the Association’s Grievance Committee alleging violation of Articles 2 and 3 on the part of Realtor® A citing Standard of Practice 3-2 in support of the charge. During the hearing, Realtor® C stated that Realtor® A’s modification of the compensation constituted a misrepresentation through concealment of pertinent facts since he had not provided Realtor® C with specific written notification of the modification prior to the time Realtor® C began his efforts to interest the purchaser in the listed property. Realtor® A defended his actions by indicating that timely notice of the modification of compensation offered had been provided to Realtor® C by telephone prior to Realtor® C submitting a signed offer to purchase. Realtor® A also indicated that his modified offer of compensation had been bulletined to all Participants, including Realtor® C, through the MLS in accordance with Standard of Practice 3-2 prior to the time that Realtor® C had submitted the signed offer to purchase. Realtor® A also commented that had Realtor® C submitted the signed offer to purchase prior to Realtor® A communicating the modified offer, then Realtor® A would have willingly paid the amount originally offered. Based on the evidence presented to it, the Hearing Panel concluded that Realtor® A had acted in accordance with the obligation expressed in Standard of Practice 3-2 based on changing the offer of cooperative compensation in the MLS alone, even without the courtesy phone calls, and consequently was not in violation of Articles 2 or 3. • Published with the consent of the NATIONAL ASSOCIATION OF REALTORS®. O
n September 4, 2020, a temporary moratorium from the Centers for Disease Control (CDC) took effect disallowing residential evictions to take place until January 1, 2021. This order was issued to prevent the continued spread of COVID-19 and provide extended protection of the American public against further transmission of the disease. The directive was sent out on September 2 to supplement the ending of the CARES (Coronavirus Aid, Relief, and Economic Security) Act, which ended on August 31, 2020.
U.S.C. 264(e), this order does not preclude state, local, territorial, and tribal authorities from imposing additional requirements that provide greater publichealth protection and are more restrictive than the requirements in this order.” The CDC makes very clear in its directive that it does not enable an individual to not pay rent it simply enables them to put off payment of rent and to not be evicted while not able to pay rent. Additionally, it provides for the landlord to charge interest and/or late fees for delayed compensation. It does not absolve the property manager or owner from fulfilling their debt service obligations. The moratorium implements stiff fines against violations of the policy by those seeking to evict tenants.
ADDITIONAL CDC GUIDELINES
“Under 18 U.S.C. 3559, 3571; 42 U.S.C. 271; and 42 CFR 70.18, a person violating this order may be subject to a fine of no more than $100,000 if the violation does not result in a death or one year in jail, or both, or a fine of no more than $250,000 if the violation results in a death or one year in jail, or both, or as otherwise provided by law. An organization violating this order may be subject to a fine of no more than $200,000 per event if the violation does not result in a death or $500,000 per event if the violation results in a death or as otherwise provided by law. The U.S. Department of Justice may initiate court proceedings as appropriate seeking imposition of these criminal penalties.” Property managers are encouraged to have tenants seek supplementary funds to cover their rent payments. The Department of Housing and Urban Development (HUD) and the Department of Treasury have expressed their backing of the moratorium along with the use of government funds to support those needing rental assistance. The order will remain in effect until December 31, 2020, unless extended or modified beyond that. See below for links directly to the CDC moratorium available on the Federal Register. This article is meant to create awareness. Please consult your real estate attorney for direct legal advice on any evictions or suspected violations of the order. •
The CDC moratorium puts additional guidelines and protections in place along with a supplemental declaration for use as needed. The provided declaration is not mandatory but if not used a similar document must be used in its place. A PDF of the form is available to the public on the CDC website. Considering FHA Reasonable Accommodations as Part of the Purchase Transaction By: Ben Sorrell, Esq., Syprett Meshad, P.A
A
s a real estate agent in Florida, you are probably involved in a fair amount of transactions involving Condominium or Homeowners Associations (HOA). As your client reads the Seller-provided disclosures, which should include the governing documents of the association, your client may find some restrictions that could prohibit them from fully using and enjoying their home. One example is a common Condo prohibition on “all pets.” If your client requires an emotional support animal, it would be prudent to explore, as part of the purchase transaction, a reasonable accommodation to the Condo’s or HOA’s restrictions to allow such a pet.
FHA GUIDELINES Under the Fair Housing Act (FHA), a person with a disability may request a reasonable accommodation from their Condo or HOA. Such person with a disability may be the property owner, the potential buyer, or anyone associated with a person with a disability. A disability is defined as “a physical or mental impairment which substantially limits one or more of such person’s major life activities.” Note that
the disability must “substantially limit” one or more “major” life activities.
REASONABLE ACCOMMODATION Because the purpose of a reasonable accommodation is to ensure that the person with a disability is able to enjoy and use their property, including the common areas, as much as a non-disabled owner, it is considered discrimination under the FHA to “refuse to make reasonable accommodations in rules, policies, practices, or services, when such accommodations may be necessary to afford such person equal opportunity to use and enjoy a dwelling.” A reasonable accommodation is a request to change a rule or restriction in the Condo or HOA’s governing documents, such as the no pet policy above, so that the owner is no longer substantially limited in one or more major life activities. Another example would be if the disabled person requires a larger wheelchairaccessible van that may be viewed as a “commercial” vehicle. Since most Condos and HOAs restrict parking of commercial vehicles, a reasonable accommodation would be to request an accommodation to the parking or vehicle rules. A reasonable accommodation could even be a request to change some aspect of the physical environment, such as changing steps to a condo unit into a ramp. However, costs associated with changes to the physical environment must be borne by the party requesting the accommodation. In order to take advantage of the FHA’s reasonable accommodation, a person with a disability must first request an accommodation be made. A Condo or HOA is under no duty proactively ask or assume that the person has a disability and/or will be requesting a reasonable accommodation - and in fact are prohibited from inquiring as to same. If the Condo or HOA refuses to make the requested accommodation, and the request is reasonable, the refusal could amount to discrimination. The disabled person’s next step would be to contact HUD to file a formal complaint, which can be done via phone, mail, or online at www.hud. gov. • This article is meant as a guide for educational purposes only. ately, we have seen a lot of movement at the national and state level to address eviction moratoriums. At the time of this article, Governor Desantis extended his eviction moratorium to the beginning of this month. The order limited the scope of some provisions of earlier orders.
The order only restricts residential evictions.
It does not restrict eviction on commercial properties. The order only prohibits the issuance of the final action. The governor’s order doesn’t prohibit the filing of an eviction, only the last step of the eviction process. The order only applies to evictions for the nonpayment of rent for those adversely affected by specifically defined circumstances related to the COVID-19 emergency. The governor’s order does not apply to evictions related to other circumstances such as expired leases, hold over tenancies, or valid violations of lease provisions. The National Association of REALTORS® (NAR) recently sent a letter to congressional leaders to address the issues of eviction moratoriums without an accompanying supplemental rental assistance.
“The action taken yesterday by the Administration enacting a federal residential eviction moratorium through December 31, 2020, without rental assistance, will ultimately harm the very people it aims to help. It will be impossible for housing providers, particularly small owners, to meet their financial obligations and continue to provide shelter to their residents. August Reports Record High Single-Family Home Prices in Sarasota and Manatee By: Gina White, RASM Communications and Marketing Director

he residential housing market in August of 2020 reports another month of increased home sales and new listings amid declining inventory. According to reports compiled by Florida Realtors® and provided by the Realtor® Association of Sarasota and Manatee, the median prices for single-family homes reached a record-high in both counties. The current market conditions favor the seller with homes selling at a quicker pace in August 2020 when compared to last year. “Just about all market indicators are positive on the year-over-year numbers for August, and by significant amounts. The only measurement that continues to fall short is the inventory of active listings,” said David Clapp, 2020 President of the Realtor® Association of Sarasota and Manatee. “Pending sales continue to outpace new listings, creating an inventory challenge. But there is some good news here, we saw the combined number of new listings in August jump by 28.4 percent for condos and by 12.5 percent for singlefamily homes.” Realtors® in Sarasota and Manatee participated in a total of 2,297 closed sales in both markets, a 17.1 percent increase from August of last year. Single-family closed sales increased by nine percent to 713 sales in Manatee County and by 12.7 percent to 867 sales in Sarasota. The condo market also increased with 54.2 percent jump to 313 sales in Manatee and a 20.6 percent increase to 404 sales in Sarasota. In August of 2020, the median sale price for singlefamily homes reached the highest recorded prices in both counties. In Manatee County, median prices increased by 13.6 percent to $360,000 and Sarasota increased by 17.9 percent to $330,000. Condo prices increased year-over-year by 8.8 percent to $223,000 in Manatee County and by eight percent to $249,495 in Sarasota County. The median is the midpoint of all sales prices; half the homes sold for more, half for less.
“Single-family homes sold quickly in August, and at higher prices,” added Clapp. “With record low inventory and high demand, we continue to see the median sale price go up, reaching new highs last month. The median time from listing to contract dropped to 30 days on the market for single-family homes.” The median time to contract declined year-overyear in all markets last month. For single-family homes, the time to contract fell by 41.2 percent to 30 days in Sarasota and decreased by 28.6 percent to 30 days in Manatee. Condos took a bit more time in August with a decrease of 42 percent to 47 days in Sarasota and an eight percent decrease to 46 days in Manatee. New listings continue to climb in August with a combined 17.1 percent increase for the two counties. Condo new listings increased by 38.6 percent in Manatee and by 21.3 percent in Sarasota. Singlefamily home new listings increased by 15.3 percent in Sarasota and by 9.2 percent in Manatee. Pending sales increased for the third consecutive month. For single-family homes, pending sales increased by 43.1 percent in Manatee and by 25.8 percent in Sarasota. Condo pending sales increased by 66.7 percent in Manatee County and by 21.3 percent in Sarasota. Year-over-year, the combined inventory in both counties decreased by 24.7 percent. Condo inventory decreased by eight percent in Sarasota and by 5.2 percent in Manatee. Single-family home inventory decreased by 33.3 percent in Sarasota and by 34.9 percent in Manatee. As for the months’ supply of inventory, Sarasota single-family homes fell by 37.1 percent to a 2.2-months supply. Manatee single-family homes decreased by 36.4 percent to 2.1-months. Condo supply decreased by 8.3 percent to 3.3-months in Manatee and by 15.9 percent to 3.7-months in Sarasota. Monthly reports are provided by Florida REALTORS® with data compiled from Stellar MLS. t’s hard to imagine any economic sector left untouched by the COVID-19 pandemic and lockdown. Waves are still rippling through most markets across the country, if not the world, and will be for some time. Commercial real estate is no exception. But the effects have been mixed: It’s certainly not all gloom and doom. While the slowdown of economic activity and human interaction has caused hardship in many areas, it has opened up opportunities in others. In the retail commercial real estate market here in Sarasota and Bradenton, things aren’t substantially different from the way they were at this time last year. That may come as a surprise to many.
RETAIL STORES
AREA RESTAURANTS
One retail market that may have less trouble is the personal services industry. Whatever happens in our society, people still need their haircuts. In the future, they will continue frequenting spas, beauty salons, and nail salons. There are no online alternatives to these services, obviously -- no virtual haircuts or facials. These establishments have taken a significant hit with all the lockdown restrictions, but there will still be demand for their services as things begin to open up increasingly. Even as these in-demand services return to normal, however, things will be different. Frequently touched areas will require regular sanitizing. Transparent shields will become fixtures in many establishments to lessen viral transmission through the air. Many establishments will have to provide curbside pickup, even if they’ve never done so before. In addition, restaurants and movie theaters are likely to see reduced capacity to comply with social distancing standards. Other retail stores that sell items not readily available online, salvage stores, for example, are likely to continue fairly unimpeded after this crisis is over. One thing to remember is that business owners tend to be resourceful and resilient. Many have a knack for finding new ways to thrive in difficult situations. Others will find ways to capitalize on the current situation. Time will tell how people will adapt, but they will. •
Not that things have been easy. For example, restaurants have struggled amid all the restrictions. The first half of the year has been one of hardship in that industry. But even in this, many restaurateurs have managed to hang on. Some restaurant tenants in the area haven’t opened for the lunch crowd yet but they are actually getting capacity crowds for dinner, which is encouraging. And while some restaurants have closed up shop permanently, others will be there to move into their facilities -- new construction of these buildings has been sufficiently low to prevent any sizable surplus. Greater supply may turn out to be one of the opportunities this crisis has created. Anthony Puccio’s family has three generations of experience in the restaurant and hospitality industry, starting in New York and then moving to Sarasota. During that time, they’ve seen many highs and lows in the economy and market. “You have to constantly be aware of what the market is telling you, and adjust to it the best that you can,” Puccio explained. “For example, we’re opening up our newest restaurant, Anthony’s Italian Deli & Eatery. We made sure that our menu items are easily offered curbside. It’s just one of the ways we’ve adapted to the current environment.” 22 | ELEVATE [ OCTOBER 2020 ]
Retail stores are another sector going through tough times. While many retail outlets were already swimming against currents caused by online shopping trends, the lockdown has done two things to further impair the market: It has restricted people from physically entering the stores, and has further acclimated people toward internet shopping. (A possible upside here is the building of more distribution centers to fulfill all the online orders.) “Clearly, the pandemic has created significant challenges for businesses and industries, but we’ve also witnessed much creativity and innovation from business owners,” said Mindy Kauffman, broker with Red Property Management in Sarasota. “For example, we work with a clothing retailer that early on shifted to making stylized face masks, and restaurants that adjusted to more of a catering business model.”

ince the announcement of RASM’s acquisition of the Centerstate Bank building located at 2901 Manatee Avenue on May 6, 2020, the Association hired Suarez Architecture and Halfacre Construction to develop plans to renovate the 7,500 sq ft. building. The following renderings show the plans to provide a first-class North Member Service Center for members in Manatee County, complete with an auditorium space for classes, conference rooms, a Realtor® Store, and staff offices. As you can imagine, for a brief moment earlier this year, we thought that this plan would need to be tabled and revised in 2021, but as you all know, the real estate market in our area has not slowed down! We are proud to announce that we received over 20 exceptional applicants this year and have selected 5 Realtors® to Watch Under 40. The committee

n a new survey from the National Association of REALTORS® (NAR), foreign property buyers purchased $74 billion worth of U.S. existing homes from April 2019 through March 2020; a 5 percent decrease from the previous 12-month period. Although this is a decrease and does not encompass the dates and effects of our current pandemic, Florida can remain optimistic about future foreign buyers based on historical geographical trends. According to NAR’s 2020 Profile of International Transactions, for the 12th straight year, Florida remained the top destination for foreign buyers, with 22 percent of all international purchases happening here in our state.

Cassidy works with Denise Ricciotti, Professional Development Manager, to promote the educational programs and professional development courses that RASM proudly offers its members. A Sarasota native, Cassidy keeps busy tending to her small farm of cows, chickens, ducks, and her beautiful horse, Delta. In her free time, she enjoys spending time with her husband and their two dogs. She has recently taken up dirt biking! Cassidy also volunteers with the SRF Rural Disaster Relief Group, taking farm supplies to areas that have been devastated by disasters.
