EDITORIAL To our readers, advertisers and friends around the world Starting in 2016 the trends in the dried fruit and nut business clearly pointed to the direction of digital information including social media. Although our publications in printed versions are still in high esteem, AgroPress of Switzerland took one step forward and engaged in any electronic method of communication.

It was a fortunate coincidence that the next generation of our family company was ready to take over the challenge of transforming a traditional publishing house into a media cluster which is necessary to span the world with relevant news about our sector. Axel Breuer, our son, has moved on with the electronic version of the magazine, an online edition and podcast, elements which from the very beginning attracted a multitude of stakeholders in the industry.

He was well aware of the fact that the editorial approach should be another one as for conventional publishing. It was not rather the element of real time information but the focus was on topics which matter in the near or medium term and make the future in the industry.

For the food industry during the Covid-19 crisis, “it was the best of times, it was the worst of times”. While there was a sharp rise in demand during the last few months, the crisis has exposed fundamental weakness in supply chains, creating shortages in essential supplies and basic staples around the world.

The pandemic has hit China, Europe and the USA one after the other, making a secure sourcing strategy difficult. In many European countries, flour, yeast, pasta and rice were sometimes more difficult to procure than heroine. Unprecedented long queues outside supermarkets became the norm, and panicked scrambling to hoard food spiked demand for online grocery shopping, and crashed big supermarkets’ websites. Infrastructure for many was simply unable to cope with the tsunami of demand, and only giant businesses that had a resilient online and

The future of the food industry will probably never be the same again. In an attempt to foresee potential future trends in the post-Covid 19 era, an online survey was conducted by Bösch Boden Spies (BBS) among a 100 food executives, traders, producers, retailers and start-ups. It was presented as part of the “We Food Future” event that took place virtually over two days in May to discuss the “future of the world of food after Covid-19”.

While virtual meetings have become the new normal, virtual conferences are a relatively new concept. My recurrent thought was that it is an efficient and environmentally friendly way to organise an event like this, especially with international participants from around

Questions were posted on the chat stream and read out to the speakers, who would then take turns answering. With minimal technical difficulties the event was an efficient illustration of how our future events could and possibly would look like.

I just kept thinking that I miss the coffee breaks already, the highlight of any conference for me in the past, with the endless opportunities for networking and meeting new people while munching on a pastry. I kept wondering if we could start organising virtual professional networking opportunities next.

An emerging theme throughout the event was

Se identificaron potencialmente doce temas preferentes: 1. WORLD that life online will definitely be the new norm for both consumers and businesses in the new food order.

There were twelve potential trends identified: 1. Retail and producers will rebalance their supply food chain significantly, in order to spread their risks, select and control their partners more thoroughly. This is highly probable and will have a strong impact on the food industry. Producers will have to be more selective with their supply sources to minimise risks – this will drive supply decisions going forward. Sufficient good quality is key, therefore, and there will be more focus on that to ensure that supply chains are safer.

2. Safe sourcing from Asia will be key in the future, as the current crisis has undermined its credibility on this front. It is essential now

to focus on traceability, reliability and transparency, which are key to supply sourcing in order to provide safety to companies and consumers, and to ensure safety from Asian sources, which has always been a challenge before the corona crisis.

3. “Back to local”: the share of locally sourced food will grow significantly. There is a very high probability for this trend, which will have a significant impact on the markets.

This is a key trend for generations X, Y, and Z. The challenge is whether the food supply chain can satisfy this growing demand, an element that could keep the trend limited, as supply chains are largely global and complicated. This trend is also not aligned with other consumer needs, such as availability all year round, which will be difficult to supply exclusively through local producers. However, in the agricultural business, there is a new generation of producers, with different mindsets than the previous generations. It is important for food businesses to proactively recognise that there are more opportunities now to work with local suppliers.

4. “Back to Basics” – new simplicity: consumers are now focusing on essential products with a clear value. This trend is parallel

Younger generations are currently displaying a tendency to go back to basics, back to baking their own bread, making home-made yoghurt, etc. This is happening at home, not in factories and businesses. Food businesses will, therefore, need to find ways not to lose these consumers, and to capitalise on these trends.

5. “Safety First”– aiming for maximum transparency and traceability through systems that rely on AI, Blockchains, etc will increase strongly and will improve food safety significantly. Digital traceability will mean speedily detecting issues in food safety systems.

6. The new normal: the forced acceleration of buying food online will result in sustained channel shifts. Covid-19 will change consumer habits and will have high impact on the industry. Buying food online will exponentially increase and will remain high.

7. Strongly increasing direct-to-consumer delivery will need strong infrastructure, and will create a new variety of offerings, formats and services. Companies will have to be fast and innovative in order to win.

8. Amazon will scale its “winner takes all” position by a backend-driven (Amazon inside) participative strategy. The offline trade will need to move fast to keep up to speed with them.

9. New Food Ecosystems: well established brands will need to now focus on positioning themselves and demonstrating their relevance in a new sustainable food world.

Rather than cut media spendings, brands should stay present, and prepare new campaigns to explain where they are essential to the customers, and their relevance

9. Nuevos ecosistemas alimentarios: las compañías ya establecidas deberán centrarse ahora en posicionarse y en demostrar su relevancia en un nuevo mundo alimentario sostenible. In addition, there is a strong shift towards digital communications right now. Consumers want to hear from brands on social media, especially during Covid19. Companies need to make their communication focused on providing emotional comfort for their consumers without specific brand messaging. This is not the right time for showing off, but about maintaining relevance and credibility.

WORLD 11. New collaboration: cross-functional cooperation between players in different categories, as well as start-ups and corporates will strongly increase if food businesses open up to the new food ecosystem.

Plant-based trend is experiencing an upswings due to the crisis, while others fade into the background. Before Covid-19 it was a niche market, but now consumers are combining the crisis with climate change and reaching the conclusion that plant-based diets are the future, focusing on new tastes and experiences. The most likely food groups to experience an increase in demand will be alternative wheat and dairy, which will be a strong upcoming trend.

13. Organic and sustainable – Aldi & Lidl have shown consumers that they can buy organic and sustainable with affordable prices. This will become a trend.

After Covid-19, top brands will focus more on buying locally Is it sustainable for retailers to push for organic and locally sourced? It will only be sustainable if consumers can afford it. The EU organic market is around 6-7% currently, Germany is around 10%. Experts believe that it will never be more than 20%. This will also depend on farming issues.

Sustainability is a very complex issue: it is not merely about origins and quality, but also about labelling, payments for farmers, supply chains, CO2 footprints, food waste and inefficiencies, etc. These issues will be more under focus and will be on top of the agenda.

After all that: A Syrian company gets up again

„By the end of January 2010 in the framework of a Near and Middle East fact finding mission”, Gerhard Breuer recounts, “I visited Damascus again and talked to Samer Al-Keddah, president of the Kedco nut company. I’ve met Samer a few times before but never in his home country Syria.

„A finales de enero del 2010 en relación a la búsqueda de hechos en el Cercano y Medio Oriente“, recuerda Gerhard Breuer, „visité Damasco nuevamente y hablé con Samer Al-Keddah, presidente de la compañía de frutos secos Kedco. After an interview and a tour through the factory he invited me for a sightseeing tour through the Old city of Damascus which was for a long time the cultural and political metropolis of the Near East. We took a stroll through the ancient city, and on a square right in the middle he was telling me:”This is the house where our family lived for centuries.”

Samer Al-Keddah reports: ”In the wake of the “Arabian Spring” in 2013 unrest broke out in Syria and reached the suburbs of Damascus City , where our factory is located.

Soon this area was unaccessible. The fights swept over to our residence area. The situation escalated so fast to the extent that we found our family members scattered over several countries.

Samer Al-Keddah: „A raíz de la“ Primavera Árabe“ en el 2013 estallaron disturbios en Siria y llegaron a los suburbios de la ciudad de Damasco, donde se encuentra nuestra fábrica. TURKEY In the middle of this situation we had to handle a lot of different export shipments of pistachio and almonds via Latakia port.

Documentation and all other export procedure had to be done with great difficulties and under extremely high risk.

At that time most of our export consisted of Syrian products like pistachios , almonds , apricot kernels , destined mostly for customers in Europe, beside of some other spices such as Cumin , Anise and coriander , from Syria to a worldwide clientele.“ “As you may remember, Mr. Breuer, our plant in Damascus was equipped with state of the art machinery in accordance with the European and international hygienic and quality standards. Unfortunately everything has been destroyed. The pictures enclosed are an example of the offices part of our Damascus plant taken by you during your visit to our plant a few years before, and the other photo shows the same place after the war. This situation applied for the whole plant.

A struggle of survival After this gigantic loss we were working night and day to evaluate some alternatives for our families and business options for our company. For us it was a struggle of survival.

As travel documents and visas for different countries are in general not easy to be obtained it was impossible to be given to Syrians within their current situation.

We found that Turkey was the most welcoming country; they did not even require a visa at that time. So Turkey, was our country of choice to start a new social and business

En medio de esta situación, tuvimos que dirigir muchos envíos de exportación diferentes de pistacho y almendras a través del puerto de Latakia. La documentación y todos los demás procedimientos de exportación se hacían con grandes dificultades y bajo un riesgo extremadamente alto.

Besides we are importing California pistachios in shell, cracking them in our facility and re-export them to European countries. For the Syrian almond our main markets are India and Italy. The Syrian almond is practically organic, but due to the current unrest we can’t obtain an organic’s certificate. Our customers for apricot kernels are mainly in Germany, India and Italy.

However, like other Syrians, we are still under a more difficult situation created by sanctions imposed on Syrian citizens and products. For example we are not allowed to open a US dollar account at the majority of international banks. This has restricted our trade activities.

Trees in some pistachio producing areas in Syria are being cut off by the poor to be used as fuel in order to keep themselves warm in the cold winter time in absence of other energy alternatives. The unfair sanctions impact does not differentiate between rich, poor, politicians, business people and civilians and do not end at cultivations and environment.

Oregon Hazelnuts – A rising star?

With 1.7% of total nut production hazelnuts play a minor role in the industry. But hazelnuts are becoming more interesting for growers in Oregon – even some Christmas tree nurseries made the switch.

Hazelnut consumption in the US doubled in 6 years, with a rising share of domestic supply. As with all other nut varieties the consumption increase outpaced the supply increase. Will hazelnuts become a major product for US farmers? It is important to follow the unique trading scheme for hazelnuts to understand what the future will bring. We talked to Troy Johnson, Business Owner at Nutseller and consultant about the situation and the future.

Troy Johnson: Hazelnuts have gotten very little attention. But Oregon hazelnuts have a very interesting dynamic with the growers. We determine the grower price in September, generally. That is the minimum price the growers get

In the past the Eastern Filbert Blight has decimated the old orchards. The Oregon University Breeding Programme which has been funded by growers for several decades has come up with new varieties that are less susceptible to blight. The first variety was only presented 12 years ago. This variety (Jefferson) gave farmers in the Willamette Valley new opportunities to get into the hazelnut industry. Since then we added more varieties – and these are more kernel-oriented varieties that could compete on global markets. That is why you are seeing a major increase in plantings. Until the early 2000’s Oregon was stuck with an acreage of around 20,000 acres (8090 hectares). Now we are over 80,000 acres (32374 hectares).

The Clipper: How many growers and processors can be found in Oregon?

Troy Johnson: There are about a 1,000 grower families. The number of processors has decreased to about five bigger operations, 2 of them are actually processing the bulk of the production. This has changed significantly in the last decade.

The Clipper: You mentioned exports to China. When I hear USA and China and trade I hear problems…

But China has been trading for thousands of years. Customers in China are very good at making sure they can bring products they want to bring in. Hazelnuts are part of that.

We have had high tariffs on our products into China forever.

The overall demand is still there. We have shipped at least 50% of our product to China, sometimes as high as 75%. It has come down recently as the typical kernel suppliers like Turkey and Italy did not have enough product – Oregon has been producing more kernel varieties. But China will always find ways to continue this business.

The Clipper: It just sounds really counterintuitive to me to sell inshell to China from a country with high production costs…

Troy Johnson: You have to compare it to the cost that go along with it. If an Oregon

USA processor pays his grower 100% of his product by November or December – are the carrying costs for the product that might be used in a trail mix in August lower or higher?

That is a marketing decision that processors struggle with every year – it fluctuates. In the past the varieties that were decimated by the blight were replaced by varieties like ‘Jefferson’. They have low kernel yields.

You are looking at maybe 40% kernel meat compared to Turkish or Italian which are closer to 50% kernel yield. This difference of 10% actually has a lot of impact, especially in a market with higher prices. If you are paying the grower 50 Cents per pound inshell in Turkey and in Oregon and you shell that out – that means that this kernel is only one US-Dollar in Turkey. Well, it’s 1,25 US$ in for the US – just the cost base. If the grower price is 1 US$ the shelled price is 2 US$ in Turkey – and the Oregon product costs 2,50 US$. So we have a 50 Cent difference before we have added value. The newer varieties have closer to 50% meat yield. That will allow the Oregon producers to deliver to the confectionery industry like Ferrero or Ritter Sports or ingredients.

Oregon hazelnuts will have to look at the market structure. I doubt that in the long run it is reasonable to think that growers can be paid 100% and take no risk – it is limiting marketing opportunity. Because if it is more attractive to invest in a value-added product

The Clipper: Did the pandemic affect the Oregon hazelnut business and your business?

Troy Johnson: Absolutely. The buyers just put their brakes on. Overall supply of hazelnuts is very tight now. The slowing down market has absolutely compensate the undersupply situation with hazelnuts. It will pick up again – but we lost a lot of sales because there were merely any food service sales in the last two months. You can now target new markets.

The shelves were not only empty because of hoarders – but there were disruptions in production as well.

There were shutdowns in production – the governor of Oregon (Kate Brown, D) has been very diligent in determining what businesses could be opened and which can’t.

There has not been much activity in the processing facilities which added to supply shortage.

USA The Clipper: Water is a recurring topic in nut production. How is the situation for hazelnuts from Oregon?

Troy Johnson: We never even used water.

When I started in the nineties all production nobody was irrigating hazelnuts – and it was very successful.

With the new plantings nearly every farmer has installed drip irrigation. Oregon has plenty of water, we do not use big sprayers – we just use the water for the young trees. Once the trees get bigger most farmers are pulling the irrigation.

The Clipper: So what is your general feeling about the future?

Troy Johnson: I belive that we are looking at longterm growth for hazelnuts and of course Oregon hazelnuts in particular.

Optimum NV, Hasselt, was founded in 2017 by sector veterans Paul Berghmans and Steve Raskin, together with the investment company Pentahold - three partners with years of experience in the development, production and sale of optical sorting machines. Technology expert Jan De Jonghe, who also boasted extensive experience in optical sorting, joined the team to lead the research and development department. Shortly after its establishment, the Dutch Concept Engineers from Eindhoven, founded in 1999, was taken over.

That company specialised in optical sorting systems for the food industry. The managers and owners of Concept Engineers at that time took a stake in the capital so that Optimum could get off to a flying start with a team with more than 200 years of experience in optical and electronic sorting at the helm.

The market could use a new, progressive and above all reliable partner,” he said. “We are not trying to become the biggest, we want to become the most innovative - the trendsetter in terms of technology, quality and reliability. We have therefore resolutely drawn the map of innovation and investment in the future.”

The first priority after the launch was to build a technological lead. The company did this by developing a completely new sorting platform by the name of ‘Cloudsorter’. The most advanced laser scanner in the sorting market, a high-resolution multispectral scanner, was then developed and launched. This laser scanner was first developed for a scanning width of 1200 mm, then for 900 mm, and the current generation, which will be launched this year, can be used for a scanning width of 1800 mm without sacrificing performance.

The technology has meanwhile been further developed and refined so that the laser system can also detect invisible but seriously harmful substances, such as aflatoxin on nuts.

Ventus – the new product line In 2019, the range of Optimum sorting machines - Focus, Triplus and Nexus - was expanded by a new product line: the Ventus.

This advanced optical sorting machine combines a free-fall infeed with a high-resolution laser scanner, currently available in widths of 900, 1200 and 1800 mm. “The fact that we have achieved so much in only three years is partly due to the support of a financially strong shareholder like Pentahold, who knows the sector well,” explained Paul Berghmans. “In total, all shareholders have already invested € 15M in building our technological lead, and consequently in our future. And we plan on continuing this.” Investments have also been made in the United States with the opening of a local branch in Denver, Colorado. American

Since the start, the number of service technicians has quadrupled. “We do not offer expensive service contracts at Optimum to get the service that customers deserve. All of our customers can count on 24/7 remote service at no extra cost”, Berghmans emphasised. “That’s what truly sets us apart from the competition. As a smaller player, we have another ace in our hand: each production line is unique. Our organisation is versatile and flexible.” Optimum may still be a start-up, but thanks to the experience and financial strength of its shareholders, this start-up is ready for the future.

Jens Borchert, one of the two managing directors of Palm Nuts & More Nuss- und Trockenfrucht, Buchholz/Hamburg, was elected chairman of the Dried Fruit and Shell Fruit Section of the Waren-Verein of the Hamburg Stock Exchange in 2019, in 2020 he was elected to the board of the association with a term of office until 2023. This magazine congratulated him and had the opportunity to ask him some questions.

Jens Borchert, einer der beiden Geschäftsführer von Palm Nuts & More Nuß- und Trockenfrucht, Buchholz/ Hamburg, ist 2019 zum Vorsitzenden der Fachgruppe Getrocknete Früchte und Schalenobst des Waren-Vereins der Hamburger Börse gewählt worden, 2020 erfolgte die Zuwahl in den Vorstand der Vereinigung mit der Amtszeit bis 2023.

The Clipper: How do you assess the situation in the industry?

Es dauert einfach alles länger, aber alle versuchen ihr Bestes, um die Situation zu beherrschen. Ein Dank geht deshalb an alle unsere Lieferanten.

Es ist uns über den Waren-Verein gelungen, bei den Behörden Erleichterungen für die Dokumentenabwicklung zu erreichen, um die Einfuhren möglichst wenig zu behindern. So genügten zur Verzollung zunächst Zertifikate in Kopie, die dann im Original nachgereicht werden müssen. Denn auch Courierdienste leiden unter COVID-19.

GERMANY the end of the season, this will not change the fact that we will leave this “almond year” with a considerable overstock (carryover). It will hardly be possible to push the carryover below 400,000 million pounds (181,438 t).

In the light of this realisation, the Californian side has also made efforts in recent months to part with as much merchandise as possible. The tendency at the moment is to sell old almonds, but to trade as few goods as possible from the coming season. This is of course at the expense of prices, which have fallen by 25 dollar cents per pound in recent weeks.

The Clipper: Where is the price at the moment?

Borchert: At $1.75 a pound fas for std5%. It is said that this level is at the limit of profitability.

People are still hoping for “bad news” in production for the 2020 harvest estimate.

There has been a lot of trouble in India recently. They say that 800 containers got stuck, partly because the ports could not operate due to the restrictions imposed by Covid 19. The workers, you could see it on the TV news, were vagabonding there because they couldn’t get home. In the meantime, they no

einmal: mengenmäßig sind die Lieferungen zwar weniger geworden, sind aber auf erstaunlich hohem Niveau. Auch wenn sie jetzt in den letzten Monaten bis Saisonschluß noch einmal steigen, wird das nichts daran ändern, daß wir aus diesem „Mandeljahr“ mit einem erheblichen Überbestand (Carryover) herausgehen werden.

Es wird kaum möglich sein, den Carryover unter 400.000 Mill. Pfund (181.438 t) zu drücken. Man war unter dieser Erkenntnis in den letzten Monaten auch von kalifornischer Seite bemüht, sich von möglichst viel Ware zu trennen. Die Tendenz im Augenblick ist, alterntige Mandeln zu verkaufen, aber möglichst wenig Ware aus der kommenden Saison zu handeln. Das geht natürlich auf Kosten der Preise, die in den letzten Wochen um 25 Dollarcents per lb gefallen sind.

The Clipper: Wo steht der Preis derzeit?

Borchert: Bei 1,75 US$ pro Pfund fas für std5%. Man sagt, dieses Niveau gehe an die Grenze der Wirtschaftlichkeit. Man hofft in der Produktion immer noch auf eine „schlechte Nachricht“ zur Ernteschätzung 2020.

The Clipper: Mr. Borchert, you are a specialist for almonds. What about the other products, hazelnuts, walnuts and “luxury nuts”?

Borchert: Sales of macadamias, for example, have also increased. During the lockdown,

GERMANY consumers were at home and enjoyed more snacks. We are benefiting from this. And the trend can be seen, also in the USA, because people have to provide for themselves, namely towards better nutrition. Just as a small addition: the Confectionery Association reported a massive increase in the consumption of crisps!(laughs) but also good business for confectionery at home, while exports are suffering greatly from the situation. The problem that the whole industry sees is this: how to get back to normality? Sustainable or not? One of the pains we and the downstream sectors of the economy are feeling is the temporary reduction in VAT until the end of the year, for 3 and 2% respectively. The expense is disproportionately high and the relief effect that is expected to provide is hardly foreseeable.

The Clipper: Compared to the situation in Germany, what is the situation in Europe?

Borchert: It is comparable to the situation in Germany. The “household consumption” has

Und der Trend ist zu sehen, auch in den USA, weil die Leute sich selbst versorgen müssen, nämlich hin zur besseren Ernährung. Nur als kleine Ergänzung: der Süßwaren-Verband berichtete von einer massiven Verbrauchszunahme von Chips!(lacht) aber auch einem guten Geschäft für Süsswaren im Inland, während die Exporte sehr unter der Situation leiden. Das Problem, das die ganze Branche sieht, ist das: wie geht der Weg zurück zur Normalität?

Nachhaltig oder nicht? Einer der Schmerzen, die wir und die nachgeordneten Wirtschaftsbereiche spüren, betrifft die zeitweise Senkung der Mehrwertsteuer bis Jahresende, und das für 3 beziehungsweise 2%. Der Aufwand ist überproportional und die zur erwartete entlastende Wirkung kaum absehbar.

The Clipper: Wie ist denn, verglichen mit der Lage in Deutschland, die Situation in Europa?

Borchert: Sie ist vergleichbar mit der bei uns. Der „Hausverbrauch“ ist gestiegen.

Auch in unseren Nachbarländern ist die Nachfrage aus der Hotellerie gegen Null gesunken.

GERMANY increased. Demand from the hotel industry in our neighboring countries has also fallen to almost zero. And one wonders whether this development will not lead to a wave of bankruptcies. Who is going to finance the loss of demand?

The Clipper: As internationally active agents and traders, are you used to travel? How about that?

Borchert: I don’t see us travelling this year, firstly because entry is prohibited or subject to quarantine restrictions, and secondly because the situation in aircraft has not really changed for the better either.

“Trademarks serve to identify (mark) the goods or services of one company and distinguish them from similar goods or services of other companies. Trademarks may consist of words, pictures, numbers, sound signs, three-dimensional designs (shape of goods or packaging) and other presentations such as a special combination of colours.

„Markenzeichen dienen der Kennzeichnung (Markierung) der Waren oder Dienstleistungen eines Unternehmens und unterscheiden diese von ähnlichen Waren oder Dienstleistungen anderer Unternehmen. As far as the official definition, which also applies to “three-dimensional” or “shape marks”, is concerned Mondelez (Milka) has been involved for ten years in a legal dispute with the German manufacturer Alfred Ritter, which has been producing and packaging its 100 g chocolate bars in square form since 1932.

The Württemberg producer claims that “for many years, consumers have equated a square-shaped chocolate bar with ‘Ritter

In the early 1990s, Ritter had the square packaging with the longitudinal seam on the back protected as a trademark. The origin is the: Clara Ritter, co-founder of the company in the Waldenbuch district of Böblingen, had the idea of launching a chocolate bar that would fit in the pocket of a sports jacket.

Hence the name and the shape. Even though the registration of a picture or word mark is quite complicated, the hurdles for a shape are much higher in order to avoid “clear monopolization”. Therefore a shape must be so different that it is perceived as an independent trademark.

This is where Milka (Mondelez) comes into play.

The argument: “A square is a universal and common shape that is used by many manufacturers for various food and confectionery products. In 2016, the Federal Patent Court orders the cancellation of the shape marks on the grounds that “signs which consist exclusively of a shape which is determined by the nature of the goods themselves” cannot be protected as trademarks.

For the patent judges, the square shape was an advantage over the rectangular oblong competition, which the Ritter company could not claim for itself alone. The Federal Supreme Court will deal with the chocolate dispute as early as 2017. The judges say: The main purpose of a shape and packaging is consumption. The taste and the ingredients of a product are the most important factors. Whether the chocolate can be put into a jacket pocket is of secondary importance to the Federal Judges.

The case goes back to the patent court. This time the dispute goes to Ritter. Nevertheless, the Federal Supreme Court has to deal with the chocolate shape.” Even a sign consisting solely of a shape which gives substantial value to the product does not enjoy trademark protection. Das Argument: „Ein Quadrat ist eine universelle und übliche Form, die von vielen Herstellern für diverse Lebensmittel und Süßwaren verwendet wird.“ 2016 ordnet das Bundespatentgericht die Löschung der Formmarken an mit der Begründung: „Zeichen, die ausschließlich aus einer Form bestehen, die durch die Art der Ware selbst bedingt ist“, können als Marke nicht geschützt werden.

Für die Patentrichter war die quadratische Form im Vorteil gegenüber der rechteckig länglichen Konkurrenz, die das Unternehmen Ritter nicht für sich allein beanspruchen könne. Schon 2017 befaßt sich der Bundesgerichtshof mit dem Schokoladenstreit. Die Richter sagen: Der Hauptzweck einer Form und Verpackung liegt im Verzehr.

Es komme bei einem Produkt vor allem auf den Geschmack und die Zutaten an. Ob man die Schokolade in die Jackentasche stecken kann, finden die Bundesrichter nebensächlich.

Der Fall geht zurück an das Patentgericht. Diesmal geht der Streit zugunsten von Ritter aus. Trotzdem hat sich der Bundesgerichtshof mit der Schokoladenform zu befassen. Auch ein

Courts in Germany have already had to deal with sweets several times. The most prominent example is the Lindt golden rabbit with bells, and an imitator was prohibited by the court from copying it in shape and colour.

The reason is that the confectionery industry is very important in Germany. In 2019 3.7 million tons of sweets will be produced. For domestic consumption minus exports and including imports, a supply of 2.6 million t remains with a value of 12.5 million EUR. Chocolate products account for half of this, exactly 5.5 million EUR. Per capita consumption is 26 kg or EUR 160 per year.

Der Grund ist darin zu sehen, daß in Deutschland die Süßwarenindustrie einen großen Stellenwert hat.

2019 sind 3,7 Mio. t Süßigkeiten erzeugt werden. Für den Inlandsverbrauch abzüglich der Exporte und einschließlich der Importe bleibt ein Angebot von 2,6 Mio. t mit einem Wert von 12,5 Mio. EUR. Die Hälfte davon,

GERMANY is rather unknown. But the square shape can be found on the markets, for example in Brazil the “Garoto Talento” series. These are chocolate squares in 21 taste variations.

Garoto is one of the larger chocolate manufacturers in the country, founded in 1929 by the German emigrant Heinrich Meyerfreund and based in Vila Velha in the state of Espritu Santo. In 2002, Nestlé of Switzerland bought the company, but continued to produce under its own name.

After Nestlé wanted to take over the company officially in 2016, the Brazilian antitrust authority CADE (Conselho Administrativo de Defesa Econômica) objected. The authority asked Nestlé to sell its shares in the company in order to prevent a monopoly position in the sweets market. The Swiss company, on the other hand, had offered to part with other Brazilian holdings, but to keep Garoto in its portfolio.

Gastaldi Hermanos is a well-known name in the global peanut business. Axel Breuer talked to Santiago A. Tembras, Commodity Trading Manager about the company, the peanut business in Argentina and the world situation still bound to the Covid-19 pandemic.

Santiago A. Tembras: Gastaldi headquartered in General Deheza, Province of Córdoba, is one of the first companies that started the peanut business in Argentina in the 1970s. But the company is even older than that. It was founded in 1931as a wheat flower mill which is still working. Today Gastaldi has two divisions: The wheat flower mill which focuses on the domestic market – and the peanut with a focus on export markets. It’s a well-balanced company.

ARGENTINA among the top ten of peanut exporters. We adjust our size in a way that we can handle the peanuts that we plant in our post-harvest facility. We do not try to increase plantings every year. Our export items are mainly raw and blanched peanuts. We have been in the export business for over 40 years now, our main destinations are countries in Europe but also in South Africa, Algeria, Russia, China, Japan, Australia and New Zealand.

The Clipper: How is the demand at the moment?

Santiago A. Tembras: The demand is very high at the moment with some specific requests to anticipate shipments – especially from Europe. I am not sure if this really is bigger demand or just anticipation of demand.

When the pandemic started here in Argentina people rushed to buy supplies. I think that situation happened in many countries. So I have my doubts if it is a real surge.

The Clipper: How are your projections for this year?

Customers are waiting now to make big decisions. This situation is unprecedented so customers are more cautious than usual.

The Clipper: Do you see any technologies or need for new technologies on the technical side of production?

Santiago A. Tembras: There is a big need for innovation and honestly I have not seen any really new or disruptive technology in the fields after harvest. I know that a lot of effort is put into the development of new seeds. We have many people working on creating seeds that are better in terms of yields and shorter cycles.

Santiago A. Tembras: Peanuts have a ‘bad fame’ here that they take a lot of nutrients from the soil. But if you apply good rotation practices such as planting peanuts every four or five years the soil has the chance to recover.

IRAN Corona‘s indirect effect on pistachio business in Iran The Covid-19 pandemic does not restrict access to orchards and agricultural services for pistachio orchards and will not play an effective role in harvesting and processing, but there is the dependence of the pistachio on packaging, transportation and global trade.

Fairtrade takes care of everything from agricultural machinery to packaging technology, food and beverage production, drying machines for fruit. “At our trade shows, you’ll find all that.” Father Martin organized the first events in the Baltic States, then in the former Soviet Republics of Kazakhstan, Uzbekistan and Turkmenistan. In 1994 Fairtrade became active in Iran for the first time. When the Russian crisis came, they moved to Egypt, Morocco and Algeria. The family is crisis-tested and highly flexible. But now with Corona: there has never been a global pandemic. “We can’t hold masses anywhere now.”

But by May the virus hit the country so strongly that Russia surged to the second place in the world in the number of infected patients.

Moscow suffered more than any other city.

This urban conglomerate counts with more than twenty million people, living in the city and suburbs and almost half of infected was from the capital (about 200 thousand out of more than 400 thousand across the country, as of the beginning of June). Given that, the country went through two important stages of the pandemic, passive and active. Here is a bit more chronology to understand what was happening: at the end of March Kremlin announced for the first time “week of paid holidays”. And it was a very clear sign for people that the situation becomes truly dangerous.

And for the first time nuts became an indispensable part of it, which clearly indicates that nuts now considered a national product of strategic importance. Which also means that there might be some sort of special state procurements introduced (for food emergency reserves), which will include nuts. Officially the Russian Ministry of Emergent Situations in its must-have safety food kit included nuts and dried fruits, and it highly recommended them on their website as “high-calories, lightweight and compact” alimentation.

Must-have products were swept away from the shelves at the very beginning of the pandemic. A first sharp increase in sales was registered in Moscow at the end of March when toughening of self-isolation was declared. At this moment, sales instantly

And as the COVID19 outbreak came in full power, people were forced to lock themselves at home, a system of fines was introduced, police and national guards patrolled the city. And this is the moment, when new internet businesses started skyrocketing.

Meaning they didn’t rely on any alternative sources of income, while official unemployment rate jumped to 2.2 million, roughly three percent of the actively working population of Russia. In fact, it was much more as people didn’t registered themselves as unemployed, their official status was “unpaid vacation”.

It made subsidized loans difficult to obtain, particularly for small businesses, which have problems with collateral.

“Terms of bilateral settlements with suppliers increased from forty-five to at least sixty days”, Klimenko said. And how did the market react to these unfavorable conditions? In a quite simple way: they keept the prices as they were before COVID pandemic, but reduced quality. The nut dealer described it with an example: if a balanced parrot food previously always included hazelnuts, peanuts, almonds, walnuts, and sunflower seeds, only seeds with some “nuts inclusions” remained.

The expert believes that the market will get back to normal when producers fully recuperate their businesses.

Nuts in daily diet were named one of the answers to the problem. And finally simple human solidarity and help turned out to be probably more important factors, than any government initiatives. New online businesses survived by sending messages to their friends and customers, posting in social networks that they have just opened delivery, offering different social packages of inexpensive food for people who got stuck without income at homes.

There is very low demand for brokens are very low – prices for WS ranging from US$1.40 to 1.60 and LP from US$1.00 to 1.10 fob.

Vietnam and Cambodia, both are very little affected by Covid, in 2020 harvested good crops – combined, the quantity collected will be in the range of 700-750K, the largest ever. Covid-19 effects add to a complex situation Covid-19 adds confusion to an already complex situation. There are so many moving parts that it is impossible to judge which way each part will move and what impact it will have on other parts. Here is some food for thought : It is quite possible that kernel availability in 2020 might be lower than 2019 due to lower RCN collection in India & Africa coupled with lower kernel yields from African RCN. Indian consumption in the hotel, restaurant and catering segment has been severely impacted leading to unprecedented crash in prices of brokens. At the same time, break and reduction in processing = approximative 300,000 t of RCN means 65,000 t of kernel output.

There was a significant jump in retail sales in USA and Europe in March and April – a fair amount of it was probably due to buying more than usual to increase stock. But many people say that snacking increases in difficult

If the situation in India improves in the next six to eight weeks, we could see a quick and significant revival of demand due to lower prices. If that happens, there could be a squeeze in kernel availability in India during some weeks of the peak consumption period, which starts in August. Although it may not have direct impact on global prices considering that Indian exports are less than 15% of world kernel exports, it will certainly have a positive sentimental effect on the market including, maybe, higher RCN prices.

During 2020, Cashew crops in most origins were expected to be slightly better because of reasonable weather. Vietnam and Cambodia have harvested good crops. But, Covid19 had adverse impact on collection in many countries in West Africa. In India also, collection is likely to be significantly less due to movement restrictions. Also, shipments of Raw Cashew Nuts (RCN) from West Africa to India and Vietnam for processing will be slower and lesser than normal. Delays in collection and shipment will mean that kernel yields will be lower than normal further reducing the overall kernel supplies.The slower movement of RCN from Africa to Asia for processing may mean that during some period of high demand, supplies of kernels in may be tight. That could lead to spurt in prices.

Current prices are the lowest in the last ten to twelve years - this should mean more demand in all markets in coming months as soon as the health situation become normal. Our feeling is that although there will not be a big jump, prices will soar gradually in the second half of 2020.
