While as we go to print, nominations have closed for the Master Builders Electoral College and Divisional Representatives, there are plenty of additional opportunities at a grassroots local level, via our Committees of Management (COM), and for those interested in specific policy issues, via our policy It’scommittees.vitalthat we have a cross-section of member representatives on each of these groups –ensuring we are representing the entire breadth of the industry and capturing the variety of local issues – because Queensland is a big state. We’ll soon be calling on members to fill positions on our Housing and Construction Sector Committees, Division and Branch COM and our policy subcommittees. I have personally been involved with Master Builders for more than 20 years and there are so many things I’m proud of. To ensure that we can effectively respond to the challenges members are facing I’m delighted that we have made two new appointments, giving us some additional firepower when it comes to representing members’ interests.

A key reform to be implemented, that was also recommended by us, was the separation of the Queensland Home Warranty Scheme from the QBCC. The QBCC being both the regulator and industry insurer has been an issue for members for many years.

INDUSTRY INSIGHTS 6 | Master Builder HAVING STEPPED INTO THE ROLE OF CEO, MY FOCUS IS FIRMLY ON MEMBERS AND OUR ROLE AS THE VOICE OF THE INDUSTRY.

The QBCC review made 17 recommendations for reform – some in line with our own review submission – that we believe will generate positive changes and generally improve the QBCC’s capability and capacity to properly regulate the industry.

Some of the current issues we are grappling with include the recent ABCC changes, changes to the project trust account framework, and the recent QBCC review.

Since being officially appointed as CEO in May, I’ve had my ear to the ground, checking with members to ensure we continue to have your back on the issues that are important to Asyou.I’ve criss-crossed the state at Roadshow, our Housing & Construction Awards and touching base with Committees of Management, hearing first-hand what is happening in the industry – there’s no doubt it’s a tough market out there.

We’ve welcomed Craig Dearling, General Manager - Workforce Services; and Kate Raymond – General Manager Advocacy & Policy – who will complement the great work of our existing team.

While the review did not recommend disbanding the QBCC Board and folding the QBCC back into the department as we recommended, it has supported reducing the size of the Board and introducing greater integrity controls. An industry advisory body will also be established to allow industry to directly engage with the Board. Other recommendations in the report are targeted at improving the QBCC’s culture, capability, service practices and skill levels. These initiatives go some way to addressing the many performance issues, as raised in our submission. Our response to the review and original submission are available in full on our website.

Several significant challenges presented themselves at Ronald McDonald House.

The Homeguard team at FMC Australasia proudly assisted the HomeGuard Accredited Installer, Termico Pest Management Services, to install a HomeGuard Termite Management System.

In particular, the new construction method affected the supporting basement retaining walls by creating gaps in the structure large enough for a small child to squeeze through. As with every unique project, this required new way of thinking.

The Ronald McDonald House in Perth was one such build. As an international charity that helps the families of sick children with support and accommodation during their times of treatment, it was essential that the building be an exemplar design and construction for this type of project and purpose. The building achieved a LEED [Leadership in Energy and Environmental Design] Silver rating, a global recognition and certification for environmentally sustainable buildings, the first of its kind in Australia.

“When I hire staff, I am looking for people that have a positive attitude and are receptive to my questions. I think also telling them exactly what the job is, be clear about what you expect from the start,” she said.

“Employers need to compromise and listen to what their staff need or want. With fuel and living expenses so high, people are feeling pressured even though they are earning more,” she said.

“All this means that employers need to test the waters with other benefits that will offset the attraction of higher money. We are increasingly seeing builders considering compacted work weeks or flexible work hours to hold good employees,” Emma said.

“They would generally be happier even if the news is not ideal. Remember that people will fill in the gaps to make up a coherent story so if you don’t provide information your employees may fill the gaps with a much worse picture,” she said.

The photo was taken with my old Nokia phone, so it wasn’t the best quality and I’m not sure if I still have it – but I’ll always have the memories!

WHAT’S THE MOST RANDOM QUESTION YOU’VE HAD OR MOST MEMORABLE MOMENT? My most memorable moment was joining Master Builders as an employee after 16 years as a member and awards recipient. It has been a great experience meeting leading industry professionals and our members at events to discuss what can be done to improve aspects within the industry.

I am part of the Workforce Services team. The team includes our skilled, professional and experienced Workplace Relations, Work Health and Safety, and Online Document Services people (including the people responsible for the very popular eDocs Thesystem).path that led me to Master Builders is a long story. I was employed here as a graduate after my second year at university studying international relations, human resources and WHS. I worked at Master Builders from January 2006 until December 2011, before leaving for 10 years and returning in May this year.

I completed my Certificate III in Carpentry, a Certificate IV in Building & Construction, and most recently a Certificate III in Commercial Waterproofing. I started my journey working in the residential sector and then moving into the commercial space, mining construction and supervisory roles. I joined Master Builders in 2006 as a member and it has been a big part of my life. My career highlight was winning some Master Builders awards over the Mostyears.recently I was appointed Technical Advisor in the Building Services Team. My goal over the next few years is to complete my Advanced Diploma in Building Surveying to be a qualified Building Certifier.

New plans Work has commenced on the Gold Coast office at Central Park Avenue, Ashmore.

The tendering process for our Far North Queensland office refurbishment has commenced. All the plans and drawings are ready to go for the right builder to bring this project to life. The project includes demolition of the GOLD COAST existing internal office, some work on the external building façade, and complete internal refurbishment according to plans.

Nicola Scott and her team on the Sunshine Coast have leased a new office space at 1/1 Innovation Parkway, Birtinya and are currently working on putting the finishing touches to the interior.

The new facility will have two multipurpose rooms, a board room and ample parking. Currently in planning and approvals phase, Malcolm Hull and his team are hoping to turn soil later this year.

The only course I have undertaken with Master Builders is the business managerial course that is required for obtaining the appropriate QBCC licensing. However, I would like to complete a few more courses through Master Builders forself-satisfaction.WHEREDOYOU SEE YOURSELF IN FIVE YEARS?

The toughest challenge I face is directing a large team of employees in a way that is extremely efficient, while also keeping the workplace safe and sound – all while showing a high level of professionalism. It is a dangerous career path, but we all have a family to return to at the end of the day.

I love working outdoors with my hands. Our trade is like a craft. It takes a sharp eye and a certain skill set to be able to demonstrate this.

TELL US ABOUT YOUR CURRENT ROLE – AND WHAT YOU LOVE MOST ABOUT IT? I own a metal roofing business with my brother-in-law. Between the two of us there’s over 21 years’ experience in the trade. What we love most about our job is we are always on the move it’s a very physical career and will always keep us in shape.

As with all businesses, we would like to keep expanding and growing. I have always loved being on the tools, so I have no expectations to get off them anytime soon. In saying this, it limits my time to juggle all my liabilities off-site so bringing my partner on board and having her take on more responsibility has been amazing.

MEMBERS CORNER 32 | Master Builder WHAT WAS YOUR FIRST JOB – AND A MEMORABLE MOMENT FROM THOSE EARLY DAYS? One of our first jobs was installing a brand new Colorbond roof to a home on the Gold Coast with a boutique builder and a high-end home. It was quite daunting at the time, the house itself ended up in the paper and in the pages of many building and interior magazines. The property won a few accolades which set a high benchmark for us. It was very satisfying to be able to work on such a high-calibre home and see the recognition of the work that was done.

WHAT PROJECT ARE YOU MOST PROUD OF? We completed a re-roof to a pre-war home that was being renovated. It was extremely difficult as it was heritage listed and had strict guidelines to what was being done. However, we turned it into an amazing roof that will last for a lifetime to come.

FINALLY, WHAT’S THE BEST PIECE OF ADVICE YOU’VE BEEN GIVEN? Ultimately, leadership is not about glorious crowning acts. It’s about keeping your team focused on a goal and motivated to do their best to achieve it, especially when the stakes are high, and the consequences matter. It is about laying the groundwork for others’ success, and then standing back and letting them shine.

I would love to keep diversifying, working on film sets, interesting builds, and artistic renovations. I would like to travel for inspiration on sculpture and different styles of building. I also want to build a sound studio and start a record

WHAT’Slabel.THE TOUGHEST LESSON YOU’VE LEARNED, OR BIGGEST CHALLENGE YOU’VE OVERCOME? The biggest challenge I have found is trying to do everything yourself or trying to find people you can trust to do the jobs you need done, as bigger and more challenging jobs come in.

HOW DID YOU GET INTO THE SET BUILDING INDUSTRY? I was working in my own carpentry business and playing in rock, punk, and metal bands around Brisbane. I met an artist in another band, and he worked for a set construction company, called ‘Heads Up Film Services’. I got a start with them on a zombie/western film, and I absolutely loved it.

WHAT PROJECT HAVE YOU RECENTLY WORKED ON? Most recently I teamed up with Iceworks Design to build the 2022 TV week Logies set. It was massive and we had a very tight schedule, but we got it done and it looked spectacular.

WHERE DO YOU SEE YOURSELF IN FIVE YEARS’?

TELL US ABOUT YOUR CURRENT ROLE – AND WHAT YOU LOVE MOST ABOUT IT. I am currently the Director of my company ‘Skill Set Building’. I changed from a sole trader to a company structure a few years back when I ran quite a large portion of the Hemmant film studios outfitting for Screen Queensland, working and took on some large renovations. I love that I can steer my company in any direction, whether it is artistic, renovations, film or theatre.

FINALLY, WHAT’S THE BEST PIECE OF ADVICE YOU’VE BEEN GIVEN? Look at failures as lessons and keep moving forward. Be pliable yet strong, balance work life, home life, social life, and your inner life. Eat healthy and meditate.

WHO OR WHAT INSPIRED YOU TO GET INTO THE BUILDING AND CONSTRUCTION INDUSTRY? I didn’t consciously feel drawn to the building industry. I sort of fell into it as my father Dave Snr was a builder. I didn’t do great at school as we moved around a lot, I actually thought I might become a cartoonist or artist in those early days. I was also not a natural practical thinker or good at math, I was more of a dreamer, but I’m glad I stuck with it, as now I feel I can create anything I put my mind and imagination to.

“The steep block we had to work with made everything from deliveries onsite to cranes or concrete pumps, a really complex problem that had to be well thought out,” Stuart said. The team had to have a special temporary platform made that was engineered to form up the cantilever and erect the scaffolding safely.

Designed to take in and endure the climate of the Toowoomba Range, Stuart said one of his favourite features of the home was the uninterrupted views in every room. “It is really impressive with the amount of glazing,” he said. The glazing was done by a Sydney-based company, Vitrocsa, who had to get the curved glass from New Zealand. Boasting a seven-bay garage, stunning infinity pool, outdoor fireplace, and incredible views of the Lockyer Valley, this home is something Designedspecial. by Joe Adsett Architects and engineered by Westera, the block of land presented a few challenges.

Angela has taken her passion for the building industry, knowledge of business development, and understanding of familyowned businesses, and turned it into a mentoring program on Facebook.

“I always wanted to be a builder, but my dad said girls don’t do that, so then I wanted to be an architect as I was fascinated not so much by the structure, but the detail,” she said. However, Angela went into banking before marine biology brought her to Wide Bay. She met her husband, a builder and certifier, and so her passion for construction and design blossomed.

The mother of two works side-by-side with her husband Ross in their business, Bungalow Custom Homes in Hervey Bay. Angela grew up in Sydney where her father worked in the construction industry. It is here she developed an interest in building and designing homes.

Angela has sat on the Master Builders Housing Sector Committee for the past three years and appreciates the chance to have her opinions heard.

“I got involved because I wanted to be on top of what was happening in the industry, have input in decisions and what we can help change for the better, especially for the mum and pop companies,” she said.

Angela taught herself to design homes, and working with her husband, the couple started their own development of ten townhouses.

“A lot of things take time to change, and we can’t change a whole policy, or get the government to completely throw out a policy. But we get to refine the policy or try and make it fair and work better for builders, as opposed to just letting it go through,” she said.

“I talk through problems in the industry and solutions… I don’t like to see people suffering, and I feel it’s because a lot of builders don’t have the business education because they just want to build things,” she said.

Angela would like to see more women involved on the Master Builder committee after this year’s election.

“I feel by sitting on a committee, I’m having an input from a female’s perspective, because we see it differently from what the men might see,” she said.

“It is scary and intimidating at first. But like my dad always used to say to me, ‘walk into the place like you own it’. “You have a spot at the table, don’t be scared to sit at that table. I think that women drive a lot of the behind the scenes in businesses and many of the topics in the committees are on the business side of the industry.”

There should be a written agreement for each occasion that an employee banks TOIL hours or a specific clause in an Individual Flexibility Agreement that details a regular agreement of hours being accrued each week. Once hours have been banked the employee can use them for a paid day off, which is paid at their ordinary rate of pay. The day off needs to be agreed upon by both parties and must be taken within 6 months of when the overtime was worked.

Where WHS documents are shared electronically the documents must also be available on the project. This may be challenging in areas with poor phone or internet reception if relying solely on electronic copies (this can be managed by saving documents locally to a laptop, tablet or phone that can be accessed anywhere).

HOW DOES TOIL REALLY WORKS?

A Principal Contractor (PC) must prepare a Work Health and Safety Management Plan (WHSMP) before work on a project commences.

Documents can also be printed and left on site, along with other hard copy WHS records.

Time Off in Lieu (TOIL) can sound like a great idea that is a win-win solution – overtime costs are reduced, and employees get additional time off that can be used when work is slow. But when something sounds too good to be true it usually is.

CAN I GET MY TOIL HOURS PAID OUT?

Members need to ensure that such persons (i.e. PCs, PCBUs, subcontractors, etc.) acknowledge receipt of the documents, read and understand the relevant sections of the WHSPM and/or other WHS documents and discuss how to access them and what is included in them with their workers. This can be done by using the Subcontractor Declaration form available in eDocs. Members should also keep records of correspondence and anything else to demonstrate compliance with these obligations (e.g. worker training records, toolbox talks, etc.)

Documents can be distributed via email with an acknowledgment that the relevant persons have received them, such as a read receipt or requiring them to return email acknowledging receipt.

As time off needs to be agreed upon by both parties there is no requirement for an employee to use it to make up ordinary hours if work is slow or there has been a hold-up on a job. Therefore, in these situations, you will still be obligated to pay the full 38 hours for a permanent full-time employee.

Most awards have a provision for TOIL which has many strict guidelines that must be followed for the Fair Work Ombudsman to accept it. The first and most important condition is that an employer cannot force an employee to accrue TOIL and that there must be a written agreement between parties that states the number of hours that are to be accrued for TOIL.

An employee has the right to request TOIL hours to be paid out at any time. Once you receive the request you must pay the hours out in the employee’s next pay and it must be paid at the overtime penalty rate applicable to the overtime when it was worked. Therefore, you are obligated to keep a record of not just the hours accrued but what hours have been accrued at time and half and what have been accrued at double time. A record of TOIL hours accrued must also be on the employee’s payslip.

SAFE WORK METHOD STATEMENTS (SWMS)

In addition to the PCs requirement to prepare a WHSMP, PCBU’s performing high-risk construction work must, before the work commences, ensure a SWMS is prepared and:

You need to carefully read your contract to determine whether you can deduct the liquidated damages from each payment claim submitted after the date for practical completion, or whether you need to wait until practical completion has been reached and then deduct all liquidated damages at once.

The owner should pay for and engage a building consultant to provide a dilapidation report. When defects are identified they must be included in your scope of works and rectified. You cannot build over or conceal defects. You are not responsible for any subsequent defects if they were not evident at the time you reviewed the report and made all reasonable enquiries before commencing works.

If works have begun QBCC will pay the difference between the funds the homeowner still holds or should still hold under the contract and the actual cost to complete the work. QBCC work out the cost to complete the work by asking for quotes from the panel of licensed contractors and appoints the successful contractor to do the work.

Liquidated damages are pre-agreed amounts deducted from the ‘contract sum’ for every day that project is late in reaching ‘practical completion’. However, liquidated damages must be a reasonable pre-estimate of the loss that the other party may suffer if the project is late. It does not matter whether the other party suffers any loss. If the liquidated damages are not a reasonable pre-estimate, then they could be a penalty, rendering the liquidated damages clause CANunenforceable.IMAKELIQUIDATED DAMAGES IN THE SUBCONTRACT THE SAME AS THE LIQUIDATED DAMAGES IN THE HEAD CONTRACT?

CAN I COMPLETE A DWELLING THAT IS A NON-COMPLETION CLAIM THROUGH QBCC HOME WARRANTY INSURANCE?

Unless you are a QBCC panel builder there is no point in doing any investigations or quoting.

Be careful doing this. Liquidated damages under the head contract may not be a reasonable pre-estimate of the loss that may be suffered if a subcontractor finishes its works late. You must consider whether a delay to the subcontractor’s works could delay practical completion under the head contract and result in liquidated damages being applied under the head contract. For example, signage works under a subcontract may not delay practical completion under the head contract, so head contract liquidated damages are unlikely to be a reasonable pre-estimate of loss under the subcontract.

YouAPPROVAL?cannotrely on the original building approval. The building certifier must be notified that the owner is engaging you to complete the project. You will be required to pay QBCC insurance and the QLeave levy so the building approval can be amended.

WHAT ARE LIQUIDATED DAMAGES?

You must determine the additional costs to obtain the certificates and advise the owner they are responsible for those costs.

WHAT DO I PUT IN THE CONTRACT IF THERE IS NO AGREED RATE OF LIQUIDATED DAMAGES?

HOW DO I COMPLETE AN UNFINISHED HOME BY ANOTHER BuildersBUILDER?are sometimes asked by owners to complete an unfinished home. There are a range of issues that should be investigated before you proceed.

It is not mandatory for liquidated damages to be applied to a contract. However, if there is no agreed rate of liquidated damages, we recommend that you note that liquidated damages are not applicable to the contract rather than saying that liquidated damages are zero. It is possible that even if liquidated damages are not applicable, the other party may be able to sue you for general damages for breach of contract due to late completion. General damages can be higher than liquidated damages if the actual loss is more than the agreed rate. It may therefore lower your risk to agree to a smaller, reasonable sum of liquidated damages instead of nothing.

You must also locate and provide all aspects and compliance certificates to enable the building certifier to issue a building final. Various certificates may be missing for works completed to date. If the original builder has not paid numerous parties they may be unwilling to provide you the certificates.

The original contract must be legally terminated. Any ongoing litigation could affect the owner’s capacity to pay you. You should contact Master Builders Legal to discuss the circumstances as they will differ for each project. You should also consider why the first builder was terminated and if the client is someone you can work with.

• Complying with the security of payment provisions of the Code, including reporting disputed or delayed progress payments under security of payment laws to the ABCC (s11D)
