EXAMPLE CASE We recently achieved a settlement of £438,000 for a cyclist who sustained a brain injury and other significant injuries when a pothole caused him to fall from his bike. The local authority denied liability for failing to inspect and maintain the highway. We obtained witness statements on the state of the road and a highways expert’s report. Court proceedings were issued, we went to trial on liability and won 100% in our client’s favour. Our client’s significant ongoing symptoms included memory and concentration difficulties, low mood, anger and frustration, PTSD, anxiety, pain, fatigue and sleep issues. We obtained medical expert reports from a wide range of medical specialists, plus a care expert too. Our client found it difficult to cope at work and his relationship with his wife and children also suffered due to his ongoing issues. We successfully applied to the court for substantial interim payments to fund a specialist brain injury case manager who organised a specialist team of clinicians alongside rehab and treatment privately to avoid NHS delays. She liaised with the client’s employer for reasonable adjustments, and organised crucial counselling for the client and his family, which was included in the claim. This helped the family understand the effects of his brain injury and provided coping strategies. The case settled successfully and we arranged investment advice. We’re thrilled that our client’s rehabilitation has achieved an excellent outcome and he is again enjoying his cycling.
